ANOTHER BARRIER GONE.

All Native, and their European friends will have noticed how ,tesdily the artificial barriers set up to bar the Natives' progre, s are being wept away. Tbe hope­ful ,ign about this is that the barriers are going bec.use the con,cience of the people realizes that they are wrong and not becau.e of any forceful or drastic opposition of the sufferers them­selve.. If the conscience of tbe people who rule this land is right th~ Natives need not have any fear but that the justice of their cause will prevail.

The lates t barrier to go is the colour bar. The Supreme Court bas declared that regulation 179 of Act No. 12 of 1911 is ultra vires. The regulation says that "tbe operation of, or attendance on machinery shall be in cbarge or • competent shiftsman, and in the TranSVAal and O.F.S. provinces, such shift 8m an shall be a white man". The theoretical argument in favour of the regulation is that Natives are not sufficiently re­spon,ible persons to be entrusted with work which endangers the safety of others. The absurdity of this argument is shown by the fact that in the Cape and Natal the regulation bas never been in force and the theory bas never even been advanced. The real reason for the colour bar clause bas been, of course, the fear of tbe wbite miners and labour unions tbat the Native may become as competent as themselves. It is only very slowly that the white people can rid themselves of the fallacy based on a bad tradition that the Natives are and always will be inferior in ability to the whites. We have even heard a well-known scientific medical man declare that the N ati ve will never attain a mental age of more than twelve! .

The most satisfactory feature about the judgment is the dignified way in which tbe Court has reproved the Government for attempting togovern by regulation, has vindicated the right of the Courts to interfere where an inju.tioe has been done, and bo. .tated tbe policy of tbe country with regard to tbe g radual emancipation of tbe Natives from restricti ve legislation as soon as they have sbown tbemselves capable and worthy of being freed. AltbDugb Law 4 of 1885 recognIsed the fact tbat for varioDs reasons the Native population was un6t for tbe doties and responsibilities of civilised life. the law giver tbere expressed the desire tbat tbe differentiation should only cootinue to exist unul tbey should be able properly to understand and appreciate such duties and responsibilities as they may reasonably be deemed capable of performing in obedience to tbe general law. The policy of the statute seemed to contemplate bls gradual emancipation. Tbe policy of the regulation on tbe contrary deprived tbe Native from enjoying the very fruits of bis advancement by prohibiting bim from performing snch work as in this case it was proved tbat he was capable of dOing· Greater repugnancy could hardly be imagined.

We rejoice in the bigb sense of justice, and tbe great wisdom and dignity of our South African judiciary. We doubt if any country isso well off as we are in tbe feeling lVe have that ju.tice will be dOne though the beavens sbould fall. No people has a greater innate feeliug for ju.tice tban tbe Natives and it must be a great consolatiod to them to realige tbat in . pite of notable exceptions the court. are just and tbe beart of tbe legi, rature is sound.

Tbe fifth Cricket matcb in tbe GlIlie Cup CompetitioD took place on the 10th November 1923 in briJliantweMber 00 the Fort Hare RecreatioD Ground.

The Fort Hare C. C. sent in their flr~t men to bat at 9.45 a m. a t wbich time the match commeoced \Yiih lll~ first delivery, PCd.!:>~ bowhog from the western end, clean bowled Makunga, amidst loud applause. Dietrich next weut in, aod kept up bis partnership with Goetbam till the score was 24, when be was caught aod bowled by Pease. Goetharn was playiog very steadily, aDd the bowliog Gnd fieldlog were of a very blgh standard. Mabo· nga, wbo was the next man bad stayed for hardly a miDote when Pease clean bowled him with a fine oft break, the score remaining at 24 (3 wickets down). There was loud applause when Ferreira, tbe Fort Hare Captain, went In· He managed to briDg tbe score up to 45. Tbe top' scorer. Goetbam, was neatly caulfbt at slips by Maho off Maliodl's bowliog having scored 26. Tbe sixth wicket fell when 64 had heen made to which the remaining four batsmen added nothing
