The fresh plea has been filed by Jamiat Ulama-I-Hind, a Muslim body, which sought to declare The Muslim Women (Protection of Rights on Marriage) Act, 2019 as "unconstitutional" on the ground that it allegedly violates the provisions of the Constitu- tion. President Ram Nath Kovind has given assent to the Act which makes 'talaq-e-biddat' or any other similar form of talaq having the effect of instantaneous and irrevocable divorce pronounced by a Muslim husband void and il- legal. AGENCY NEW DELHI, AUG 22 Continuing the record-setting trend, gold price on Thursday hit a new high of Rs 38,970 per 10 gram by gaining Rs 150 in the national capi- tal, according to the All India Sarafa Association, mainly on account of a weaker rupee and safe-haven buying from investors due to weak equity market. Gold prices have been hitting a fresh high everyday since Tuesday. Silver advanced by Rs 60 to Rs 45,100 per kg on increased offtake by industrial units and coin makers. Despite sluggish overseas trend, gold prices rose on account of sus- tained buying from local jewellers, traders said. Besides, weakness in rupee and equity market also aided the rally in the yellow metal, they added. In New York, spot gold was trad- ing lower at USD 1,498.80 an ounce, while silver was down at USD 17.09 an ounce. "Gold prices in the international market are hovering near the psycho- logical level of USD 1,500 an ounce as traders stayed away from taking fresh position amid the key econom- ic events scheduled this week," Ha- reesh V, Head Commodity Research, Geojit Financial Services said. "Expectations are high that the US Federal Reserve chair's speech at Jackson Hole meeting on Friday would provide cues on future US in- terest rate cuts that may influence gold prices. Also, traders are keenly awaiting the result of G7 summit for hints of any additional steps by poli- cy makers to push global economic growth," he said. GST fraud of Rs 60 crore detected, trader held PATIALA: The Punjab Excise and Taxation department on Thursday claimed to have de- tected a GST fraud of Rs 60 crore. A local iron and scrap trader, Subhash Chander, was arrested in connection with the fraud, an official of the department said here. Chander used to procure fake GST invoices of iron and scrap from Delhi without the de- livery of goods, the official further said. Vehicles shown in the bills for the transportation of the ma- terial turned out to be two-wheel- ers as per the investigation con- ducted by the department. He was accused of creating bo- gus input tax credit running into crores of rupee and further pass- ing on to various dealers of Pun- jab, said Navdeep Kaur Bhinder, Additional Commissioner-cum- Director Investigation, Punjab. AGENCY NEW DELHI, AUGUST 22 A Delhi court on Thursday sent Congress leader P Chi- dambaram to CBI custody till August 26 the INX Media case. Earlier today, the CBI produced Chidambaram before the court and sought his five-day custodi- al interrogation saying there is a need to unearth a larger con- spiracy. He was produced before Special Judge Ajay Kumar Kuhar where Chidambaram's advocates opposed the CBI plea on the ground that all the other accused, including his son Kar- ti, have already been granted bail in the case. Pronouncing the order, the court said medical test of Chi- dambaram has to be conducted in accordance with law. He will be in CBI custody for four days, it added. “Considering all facts and circumstances, I am of view that police custody of Chi- dambaram is justified,” the judge said. Lawyers and family of Chidambaram will be al- lowed to meet him for half-an- hour every day, the court added. Senior advocate Kapil Sibal, appearing for Chidambaram, argued that the first arrest in the case was of Bhaskar Raman, chartered accountant of Karti, who is presently out on bail. Besides, Peter and Indrani Mukherjea, also accused in the case, are out on default bail as they are in jail in connection with another matter, Sibal said. He contended that grant of bail was a rule and the issue before the court was of personal liber- ty. Sibal was countering the 5- day custodial interrogation of Chidambaram sought by CBI which said it needs to unearth the larger conspiracy. Solicitor General (SG) Tushar Mehta, ap- pearing for CBI, told the court that the agency was not extort- ing confession but it has the right to reach the root of the case. Besides Sibal, senior ad- vocate Abhishek M Singhvi also appeared for Chidambaram and opposed CBI's plea by say- ing that the former Union Min- ister was not a flight risk. Singhvi said the entire CBI case was based on the statement of Indrani Mukherjea, who has turned approver in the case. He said Chidambaram cannot an- swer what CBI wants to hear and added that the agency can- not seek remand on the ground of evasive replies. Haryana honours 25 Urdu Litterateurs with cash awards AGENCY PANAJI, AUG 22 Union Home Minister Amit Shah on Thursday said the Centre will send its own teams to the flood -affected areas without waiting for re- ports from respective states to assess the damage caused by the natural calamity. Shah expressed concern for the flood victims in the states of Gujarat, Maharash- tra and Goa He requested the states to quickly assess the dam- age caused by the recent floods and send their re- quirement to the Centre. Shah was speaking at the 24th meeting of the Western Zonal Council, a forum for the Centre and states to exchange ideas on issues like health, security and social welfare, here. The meeting was attend- ed by chief ministers of Gu- jarat (Vijay Rupani), Maha- rashtra (Devendra Fad- navis), Goa (Pramod Sawant) and representatives of Union Territories of Daman & Diu and Dadra & Nagar Haveli. He said the Centre has taken an initiative to assess the flood damage on its own. "As part of the initiative, central teams have been constituted to visit the flood-affected areas without waiting for reports from the respective states," Shah said. He said the Western Zone has been instrumental in giving an impetus to the Indian economy. States and Union Territories falling un- der this zone contribute around 24 per cent to the na- tional GDP and 45 per cent to the total exports of the country. The Western Zonal Council, one of the five such bodies, comprises the states of Goa, Gujarat, Maharash- tra and Union Territories of Daman & Diu and Dadra & Nagar Haveli. He said all pending issues between the states and the Centre need to be resolved on a priority ba- sis through the forum of the Western Zonal Council. "After due delibera- tions, unequivocal decisions taken by consensus should be implemented to further strengthen the federal struc- ture of the country," he said. Lauding the states in the Zone, Shah said they have done excellent work in the cooperative sector. AGENCY HYDERABAD, AUG 22 The Centre has no immediate plans to withdraw security forces from Jammu and Kashmir, where Article 370 has been revoked, in view of the continued tension in the region, Minister of State for Home G Kishan has said. "Why will we withdraw troops im- mediately from there when Pakistan is trying to provoke? Pakistan is trying to provoke Kash- mirs and disturb the peace so that it can go to international community (to com- plain). The decision on whether to with- draw or not will be taken by the local ad- ministration," Reddy told a news agency when asked whether the centre had any plans to with additional forces. He said the situation in J&K was peaceful now and Home Minister Amit Shah was regularly monitoring the situa- tion. Reddy pointed out that schools had opened, Section 144 had been withe- drawn, government offices had started working and some of the controls im- posed had been relaxed. Internet and telephone services had also been re- stored, barring in a few districts (four or five), he said. Asked why opposition leaders were not being allowed to hold meetings in the state, he said government has taken precautions in view of Pak- istan's intentions and the opposition lead- ers should have patience. AGENCY CHANDIGARH, AUG 22 As many as 17 villages of Punjab's bor- der district Ferozepur were flooded after Pakistan opened headworks gates in its area on the Sutlej river, an official said on Thursday. Several villages of Ferozepur are al- ready inundated because of the recent rains and breaches in embankments of the Sutlej river. "With the opening of gates of head- works (used for regulating water flow) in Kasur area by Pakistan, 17 villages in our side (located near Indo-Pak border) have been affected," deputy commis- sioner, Ferozepur, Chander Gaind said. He said the water released by leather tanneries in Pakistan's Kasur district into the river contained pollutants. "Polluted water of tanneries of Pak- istan was also added into the river water, which is the main cause of cancer," he said. Kasur district, which is part of Pak- istan's Punjab province, is known for leather tanneries. A few days back, Pakistan had ac- cused India of releasing about 2,00,000 cusecs of water into the Sutlej river with- out any intimation, causing flood-like situation in various areas in the country. Gaind said the teams of the Army and the NDRF are carrying out rescue and rehabilitation works in the af- fected areas. As many as 17 villages of Punjab's bor-der district Ferozepur were flooded afterPakistan opened headworks gates in itsarea on the Sutlej river, an official saidon Thursday.

Several villages of Ferozepur are al-ready inundated because of the recentrains and breaches in embankments ofthe Sutlej river.

"With the opening of gates of head-works (used for regulating water flow) inKasur area by Pakistan, 17 villages inour side (located near Indo-Pak border)

have been affected," deputy commis-sioner, Ferozepur, Chander Gaind said.

He said the water released by leathertanneries in Pakistan's Kasur district into

the river contained pollutants."Polluted water of tanneries of Pak-

istan was also added into the river water,which is the main cause of cancer," hesaid. Kasur district, which is part of Pak-istan's Punjab province, is known forleather tanneries.

A few days back, Pakistan had ac-cused India of releasing about 2,00,000cusecs of water into the Sutlej river with-out any intimation, causing flood-likesituation in various areas in the country. Gaind said the teams ofthe Army and the NDRF are carrying outrescue and rehabilitation works in the af-fected areas.

Police gears up forassembly polls, setto launch crackdownon criminalsCHANDIGARH: With a view to ensuresmooth conduct of forthcoming VidhanSabha elections, Haryana Police is allset to launch a crackdown on wantedcriminals and notorious elements in thestate. Police will launch a one-and-halfmonth long special drive beginning fromAugust 26 to arrest criminals and to un-earth illicit arms/liquor/narcotic sub-stances throughout the State.While disclosing this here today, Addi-tional Director General of Police (Lawand Order) Mr Navdeep Singh Virk saidthat absconding criminals could be oneof the biggest challenges for the Police inconducting free and fair elections. Thespecial drive which commence on Au-gust 26 would continue upto October 10,2019.He said that Police is going to launch thedrive on the direction of the State PoliceChief, Mr Manoj Yadava in view of theVidhan Sabha elections. The DGP haddirected all the Commissioners of Policeand district Superintendents of Police tonail down the warrantees, other criminalsand notorious elements in their respec-tive areas. This would help in keepingthe crime under check and put the crimi-nals behind bars. Hooda appearsbefore CBI in landallotment casesPANCHKULA: Former Haryana ChiefMinister Bhupinder Singh Hooda onThursday appeared before a Central Bu-reau of Investigation (CBI) special courtin Haryana's Panchkula in connectionwith the National Herald publisher Asso-ciated Journals Limited (AJL) land allot-ment case and Manesar land scamcase. The CBI will file its reply at aPanchkula court on September 18.According to the Enforcement Directorate(ED), Mr Hooda allegedly misused his offi-cial position and allotted a plot in the guiseof re-allotment at an under-valued price tothe Associated Journals Limited (AJL), agroup that runs the National Herald news-paper. The agency claimed that the valueof the plot was Rs. 64.93 crore but MrHooda gave it away for Rs. 59 lakh. InMay this year, the Enforcement Direc-torate had attached the plot under thePrevention of Money Laundering Act(PMLA). In December 2018, the agencyhad filed a chargesheet against Mr Hoodaand Congress leader Motilal Vora for al-leged fraudulent allotment of the land toAssociated Journals Limited in Panchkulain 2005. The probe agency had on July26, this year questioned Mr Hooda forover four hours in Delhi in connection withthe Associated Journals Limited land allot-ment case. In the Manesar land scamcase, the Enforcement Directorate had at-tached 18.5 acres of land in Gurugramand Rs. 66.57 crore lying in bank ac-counts of a private company and someothers under the Prevention of MoneyLaundering Act, 2002 (PMLA).

We have completelyelimi-nated this practice and now peoplecould get the benefit of various serv-ices online on this basis of their eligi-bility. He said that yesterday only,

about 57,000 BPL cards have beendistributed to the beneficiaries in all90 assembly constituencies in theState. These beneficiaries have beenadded to the BPL list after a long spanof 11 years, he added. He said thatduring the previous government, BPLcards of well-off families having allfacilities were prepared but we havenow started the process under whichBPL cards of only eligible beneficiar-ies would be prepared.

Maintaining a direct dialoguewith the people, he said that treadingthe path of Sabka Sath Sabka Vikasand Haryana Ek Haryanvi Ek, the

present State Government has under-taken uniform development in all 90assembly constituencies without anydiscrimination. The Chief Ministerappealed to the people that the waymore than one crore people of thecountry gave up their subsidy on LPGgas cylinders, on the appeal of thePrime Minister, Mr Narendra Modiand provided relief to lakhs of womenunder the Ujjawala scheme, in thesame way, if any BPL family be-comes financially sound, then itshould also withdraw taking benefitunder the scheme and remove itsname from the BPL list.

Theissue occupied the centre-stage during a meeting theTechnical Education and In-dustrial Training MinisterCharanjit Singh Channi ac-companied by the Industriesand Commerce MinisterSunder Sham Arora heldwith the higher officials ofboth the departments. Duringthe course of the meeting,

Channi said that 3-6 monthstraining is necessary for thestudents of the technical ed-ucation institutes to be pre-pared for the jobs in keepingwith the demands of theemerging trends in the indus-trial sector.

The issue of students be-ing imparted with just 1months’ practical trainingwas also discussed in a veryminute manner. It was alsoagreed that the period of onemonth is just not enough forthe students to be able tograsp the technical skills forqualifying for jobs in the in-dustrial sector. This protest was organised under the bannerof Joint Action Committee of Retired Em-ployees of Board and Corporations of Punjabaffiliated with Mahasangh. They raised slo-gans against Assistant PF Commissioner andPF Commissioner for its autocratic decisionwithout any written order and stay granted bythe Supreme Court of India.

They threated of gherao residences of twoofficials in case pension is not released imme-diately as per direction of the Supreme Court.JAC President Kashmir Singh said that PF of-ficers were responsible if anything misshapentook place to the pensioners waiting revisedpension. He said that Chandigarh PF office hasstopped even to release revised pension ofthose who had deposited Rs 5 to 7 lakh by tak-ing loan from private firm with higher rate ofinterest for the last five months.

They did not bother to given valid groundand release of stoppage of process of releasingrevised pension. A memorandum was also

submitted to the PF Commissioner. Mean-while, PF Commissioner Pramod Singh as-sured of sympathetic consideration of demandand said that monthly meeting will be heldwith members of JAC to resolve matter relat-ing to revised pension.

HP one among few states to givesalary, allowances on time: CM

Despite the bleeding state economyand scarce economic resources,this hill state figures among the fewin the country, known for in-timepayment of salary and otherallowances to its employees, ChiefMinister Jai Ram Thakur told theState Assembly on Thursday.

Replying to a query during theQuestion Hour, raised by Congressmember Mukesh Agnihotri andCPI (M) member Rakesh Singha,Mr Thakur said the state economycould not permit to continue theprovisions of Old PensionSchemes.

Barring West Bengal, all thestates have adopted the NewPensions Scheme in the country,Mr Thakur pointed out, adding thatthe Kerala government alsorecently decided to adopt the NPSfor it's employees.

He said the state governmentincreasing liabilities on thepayment of salary, pensions andallowances, did not permit to paythe gratuity and pension on the oldpattern. The government waspaying Rs 6600 crore per annum topay the pensions. The state havecollections from various taxes andlevies to tune of Rs 10,000 crore,however, the total annual liabilitieson the salary and pensions is Rs19000 crore.

2018 saw dip in touristsvisiting HP: Thakur

SHIMLA: The number of foreignand domestic tourists visitingHimachal Pradesh declined by 10per cent in the April-June 2018tourist season as compared to thecorresponding period in 2016 and2017, Chief Minister Jai RamThakur has said. As per the dataprovided by Thakur in the stateAssembly on Wednesday, 1.25lakh foreign tourists visited thestate in the tourist season fromApril to June last year. Thenumber was over ten per cent lessas compared to foreigners visitingHimachal Pradesh in the threemonths in 2016 and 2017. In replyto a question by Congress MLASunder Singh Thakur, the chiefminister said 1.42 lakh and 1.36lakh foreign tourists had visitedthe state from April to June in2017 and 2016 respectively.Similarly, the number of domestictourists also saw a dip.

Dueto these cancellations, lakhs ofpeople have lost their source ofincome while others, who haveprocured items required for thesefunctions, are facing acute financialcrunch as it is highly unlikely thatthey will be able to sell theirproducts,' Shabir Ahmad, owner of acatering company, told UNI.

According to officials,there was no report of anymajor untoward incidentduring the night in thevalley, where restrictionswere eased in majorityareas, including in summercapital, Srinagar.

Restrictions wereeased in some more areasin the downtown andShehar-e-Khas (SeK)though business and other

activities remainedcrippled. All gates ofhistoric Jamia masjid,stronghold of moderateHurriyat Conference (HC)chairman Mirwaiz MoulviOmar Farooq, remainedclosed and large number ofsecurity forces and statepolice personnel remaineddeployed to prevent anyassembly. Business andother activities remainedcrippled in the downtownand SeK and outskirts. Alarge number of CentralParamilitary Forces(CPMF) and state policepersonnel remaineddeployed to thwart anydemonstration. Residentsalleged that they are facingacute shortage of

essentials, particularlymilk, baby food,vegetables and medicine.Milkmen and vegetablesellers from outskirts arenot able to come fromoutskirts due to restrictionsand strike. The local breadmakers on main roads alsoremained closed.

All educationalinstitutions, includinguniversities, engineering andother professional collegeswere closed from August 5,when Article 370 and 35 Awere scrapped and Jammuand Kashmir was dividedinto two union territories--Jammu and Kashmir andLadakh, evoking sharp andspontaneous reaction.

However, the

government orderedreopening of primary schoolsfrom August 19 and Middleschools from Wednesday.However, majority schools inSrinagar wore a desertedlook though 60 to 70 per centteachers and other staffattended their respectiveinstitutions. Private schoolsalso remained closed.

According to Director,Education Kashmir,Mohammad Yaseen Maliksaid 774 middle schools werereopened yesterday afterreopening of primary schoolson Monday. There was anetwork of 6,000 schools inthe Kashmir valley.However, he said, theattendance of students wasthin. Malik said attendance of

students has now startedpicking up.

Good number of studentsattended schools in Kupwara,Bandipora and centralKashmir district ofGanderbal, he said.

The Kashmir University(KU), Islamic University ofScience and Technology(IUST), Central UniversityKashmir (CUK) and ClusterUniversity also remainedclosed. Students of theseuniversities who werestaying in hotels have alreadyleft for their home. The IUSThae also postponed allsemester examinations.

First organ transplantation unitsuccessfully commissioned at IGMCDINESH AGARWALSHIMLA, AUG 22

The Himachal Pradeshgovernment on Thursdayinformed the state Assemblythat the first OrganTransplantation Unit wassuccessfully commissionedat the Indra Gandhi MedicalCollege, with transplantationof two Kidneys in theHospital, here recently.

Giving a suo-motustatement on the issue here,Health Minister Vipin SinghParmar said the advancesurgery was conducted by aseven-member expert teamfrom the All India Institute ofMedical Sciences.

He informed that IGMCHospital successfullyoperated two patients forKidney transplantation on

August 12, scripting history of

launching this advancehealth facility, first time inthe state.

The Minister said aftercommissioning this organtransplantation centre atIGMC, the government hasfulfilled one of the promisesmade by Chief Minister JaiRam Thakur, in the 2018-19state budget.

The Minister informedthe House that currently,1200 kidney patients wereregistered in the state, out ofwho, 500 requiredtransplantation. He said thisfacility would benefit anumber of patients, whohave been deprived so farfrom this, due to either non-availability of the service inthe state, or due to economic

reasons. Kidney-relatedailments were increasing inthe state due to high bloodpressure and hyperglycemia.Patients have to go fortransplantation at last, whenthe ailment reaches analarming stage, the Ministerinformed the House.

The government alsotrained IGMC staff anddoctors in AIIMS andPGIMR Chandigarh beforecommissioning this facilityand one Intensive Care unitfor the transplantation ofKidney having three bedDialysis Unit was also set upin the IGMC for thispurpose, he said.

As many as 17 Doctorsand other staff were trainedin AIIMS and PGI, beforesetting up this unit, MrParmar added.

Talking to media afteran aerial survey to assess thedamage caused by floodingin Sultanpur Lodhi (Ka-purthala) and Jalandhar ar-eas, the Chief Minister an-nounced a project to projectto realign river streams andcourses, besides strengthen-ing and widening of the riv-er embankments for a per-

manent solution to the prob-lem of floods. CaptainAmarinder also announceddedicated village-reliefteams in the affected areas.Each team would compriseofficers of Health, CivilSupply and Animal Hus-bandry departments, andwould ensure regular andtimely supply of food, med-icines and fodder for all af-fected families. Passing orders on a plea by her, seeking one monthextension of her parole to complete arrangements for her daughter's marriage, a DivisionBench comprising Justice M M Sundresh and Justice M Nirmal Kumar extended herparole by three weeks. Nalini moved the court after the Vellore prison authorities refusedher request for extension of parole by a month. In her plea, she said despite her bestefforts all arrangements for her daughter's marriage could not be completed. She said sheneeded one more month to complete the wedding arrangements. Stating that herdaughter was residing in London with her husband Murugan alias Sriharan's brother,Nalini said they were likely to visit India in the first week of next month.

Maha: One held forcheating people bycloning ATM cardsTHANE: A 30-year-old man has beenarrested in Maharashtra's Thane districtfor allegedly cheating people by cloningtheir debit and credit cards andwithdrawing several lakhs from ATMs,police said on Thursday. Acting on a tip-off, Thane police's central crime unitlaid a trap and nabbed ShabazMohammad Arif Khatri alias Rehan AliKhan near Thane railwaystation onTuesday. A number of cloneddebit/credit cards, fake Aadhaar andPAN cards, having different names butsame photograph on all, a high-endmobile phone and a fake driving licencewere seized from his possession, apolice spokesperson said. The officialsaid during interrogation, Khanrevealed that some of his accomplices,who worked at a hotel in Mumbratownship, provided him informationabout the credit and debit cards usedby customers there to make payments."These persons would steal the carddetails of customers and sell theinformation to Khan, who when thenuse it to make cloned cards," he said.Khan withdrew several lakhs of rupeesfrom ATMs in Thane, Kalyan, Dombivili(both towns in Thane district), Pune,some other districts of Maharashtra aswell as other states since 2017 byusing the cloned cards, he said. Boosting the firepower of India'sdefence forces, Defence MinisterRajnath Singh will officially inductthe first batch of Apache attackhelicopters into the Indian Air Forceon September 3 in Pathankot.

"The Defence Minister isscheduled to induct the Apacheattack choppers into the Air Forceofficially in Pathankot onSeptember 3. The first batch ofchoppers had arrived at the Hindanair base about three weeks ago atthe Hindan airbase in an Antonovcargo plane," defence officials toldANI here. The AH-64E helicopters,the latest variants of the Apache,were delivered from the US.

After the first four choppers,another batch had come to the airbase and the eight Apaches arelikely to be inducted in the first go.

The Defence Ministry hadfinalised the order for production,training and support of 22 AH-64Apache attack helicopters in 2015.Two years later, the Centralgovernment cleared the acquisitionof an additional six Apaches for theIndian Army. By 2020, Boeingwould hand over the entire fleet of22 Apaches to the Indian Air Force

for operations.India had signed a deal worth

USD 3 billion in 2018 for thesupply of 15 Chinook heavy-liftchoppers and 22 attack helicoptersfrom American firms.

Both the deals were initiatedduring the UPA era around 2008-09but could not be signed due toprocedural and other issues in thecontract.

On March 25, IAF Chief AirChief Marshal BS Dhanoa hadpresided over a ceremony inChandigarh for the officialinduction of the Chinook heavy-liftchoppers.

The choppers will be used forferrying heavy loads in themountainous region of Ladakh andother areas for the Army and AirForce requirements.

Yamuna below danger markas water level recedes

The couple had marriedat a registrar's office inEttumanoor against thewishes of her family.

During the trial whichbegan three months ago,Kevin's family and witnesseshad alleged that it was a caseof honour killing.

The government had recently formed thefirst women battalion with over 550 membersas part of efforts to enhance representation ofwomen in the police force.

Tamil Nadu: Four gangstersarrested for killing rival

Police on Thursday arrested four persons of a ganginvolved in killing a rival gang's member in K.Pudur area. The murder weapon has also beenrecovered by the police. According to the police, the victim,identified as Raja, was driving a two-wheeler whenhe was ambushed by a gang of eight persons whoattacked him using stones and knives. Aftersustaining injuries, the victim tried to escape butfell down after running for a short distance on theroad, the police said. The police conducted itsinitial investigation by examining the CCTVfootage at the scene of the crime and are currentlylocating the whereabouts of four remainingmembers of the gang who attacked Raja. The chief justice of India and his Supreme Court may notview the matter of hearing former finance and home min-ister P. Chidambaram’s plea for protection from arrest as

sitting on the horns of a moral dilemma. The case would ideal-ly be viewed strictly in legal terms, and regardless of how it hasbeen blown up in the political firmament. Already, the highestjudiciary has deviated from what has come to be viewed as nor-mal in India of the high and mighty being heard instantly andrelief being given to them at once as a matter of right. In fol-lowing the rulebook, the court may have asserted its autonomyin the face of the influence of powerful politicians, but there isa long way to go before we will hear how this sensationalisedcase of Mr Chidambaram (and his son) in the INX Media caseand other cases is finally ruled upon.

In the forefront of this complex issue is the matter of inter-im protection from arrest of one of those said to be an accused.In Indian jurisprudence, even an accused has to be viewed asinnocent until proven guilty. Various arms of the executive aretasked with proving guilt; although under the strictest provi-sions of the new Prevention of Corruption Act it is the accusedwho has to prove his innocence. Bail is a civil right of even themost hardened criminal and may be granted in the normalcourse save in exceptional circumstances where the accusedmay be seen as capable of “fleeing from justice”. Even the re-ported silence of the accused in the face of interrogation isguaranteed as a fundamental right of an individual. However,there are inferences to be drawn from silence or the in-tractability of the mighty who may consider the law to be abovethem.

Why the cases against the former finance minister, accusedof financial crimes on a quid pro quo basis — some of whichinvolve his son who is also a sitting Member of Parliament —are getting even more complex is because of the inherent de-lays in the justice delivery system. The accused cannot be heldresponsible for this. Mr Chidambaram who was incommunica-do for a while, leading even to lookout notices against him, sur-faced briefly to lay down a challenge regarding the INX Mediacase and left. Considering the circumstances of the cases, itwould be ideal if the top court were to rule that they be fast-tracked so that verdicts are delivered in a reasonable time frameand not after a couple of decades as in the corruption cases in-volving J. Jayalalithaa.

The only way justice can be rendered in cases of financialskulduggery behind corruption in high places is if they are pre-sented properly in court based on hard evidence and verdictsdelivered despite the seeming complexity. The courts wouldalso have to ensure that the application of the law is the samefor all and not subject to any sense of entitlement among thepowerful, irrespective of whether they are in the ruling party orthe Opposition.

After CDS, several key military reforms neededThe Modi government deserves kudos for taking some historic decisions

Prime Minister NarendraModi’s announcementon the appointment of a

Chief of Defence Staff (CDS)was a much-awaited endorse-ment of the recommendationmade by the Group of Minis-ters (GoM) in February 2001,in the aftermath of the Kargilconflict. The decision on thisvital issue had remained onthe backburner for over 18years owing to some concernsof the bureaucracy, incon-gruity in the views of thethree services and the status-quoist stance of decision-makers. It required a stronggovernment with a decisiveleadership to finally take acall that will pave the way forfar-reaching military reforms.The Modi government de-serves kudos for taking somehistoric decisions and proac-tively pursuing national secu-rity interests in a focusedmanner. To ensure time-bound implementation, thegovernment has formed acommittee, which will recom-mend within three months therole and charter of the CDSand suggest the modalities forimplementation.

As per the timeline givento the implementation com-mittee, the government, afterdue deliberation, will be in aposition to confer the rank onthe selected Chief by Decem-ber 2019. By then, the presentAir Chief will have retired.The Army Chief, who tookoffice in December 2016, hasmore experience of the strate-

gic politico-military arena un-der his belt vis-a-vis the othertwo chiefs, who took chargeof their organisations thisyear. He is also better placedin terms of the understandingof the regional instabilitiesthat threaten our national in-terests, internal security chal-lenges and various prongs ofnational strategy beingevolved under this govern-ment. Logically, he emergesas the frontrunner. However,given the strong credentials ofthe government, it couldspring a surprise based on itsinternal evaluation of not justthe three chiefs but also thecommanders-in-chief of thethree services. It could evenextend the tenure of the AirChief should he be the pre-ferred choice.

The implementation com-mittee, while suggestingmodalities for launching thefirst CDS, should dispassion-

ately study the concerns of allstakeholders and not getbogged down by their biasesand past assertions. The joint-ness models of friendly for-eign countries along withtheir best practices should beexamined, albeit with an eyeon our unique security chal-lenges.

It is important to ensurethat the CDS is suitably em-powered not just in terms ofhis role and mandate but alsoin terms of his authority topush through various trans-formational initiatives. Itneeds to be understood thatthe basis of all command andcontrol in the military is theauthority vested in a com-mander over his or her subor-dinates. In this, rank plays amajor role. A four-star CDS,as being suggested by somesections of the strategic com-munity, would fail to elicit thedesired levels of accountabil-

ity from the three services inimplementing major reforms.With the three chiefs donningthe same rank, a four-starCDS would be tantamount toa mere nomenclatural changeto the current Chairman of theChiefs of Staff Committee.

A five-star CDS will cer-tainly have the authority overthe three chiefs to leveragethe optimal potential of theirorganisations in creating“ready and relevant” multi-domain joint capabilities. world require prior permis-sion? An ongoing controversyswirling around a recent edito-rial (“Fear and uncertaintyaround Kashmir’s future”) inthe Lancet, among the oldestand most prestigious medicaljournals in the world, on thehealth situation in Jammu andKashmir compels one to posethe question.

The issues at stake go be-yond one editorial, one journal,one state or even one country. Itthrows up a basic question:Who can speak, about what,and where?

The Indian Medical Asso-ciation (IMA), the country’slargest body of doctors, in anofficial letter to Dr RichardHorton, the journal’s editor, haslashed out at the Lancet for itsrecent opinion piece on Jammuand Kashmir, arguing that thejournal has no “locus standi onthe issue of Kashmir” and thatits editorial amounts to “inter-ference into an internal matterof the Union of India”, and thatthe journal has reacted to an"internal administrative deci-sion of the Government of In-dia under the garb of concernfor the health of Kashmiris”.

As someone who has beenwriting for decades on health inIndia and in other developingcountries, and who is an occa-sional contributor to theLancet, the controversy tookme by surprise. This is not thefirst time that the Lancet has

looked at geopolitical conflictsthrough the health lens.

In the past, it has focusedon the crisis in Gaza, Iraq, Syr-ia, Afghanistan, the Europeanmigrant crisis, gun violence inthe United States and manyother such topics.

The Lancet has taken astand on crises around theworld, when health has been atrisk. It has also been very openabout why it believes in takingthe positions it does. In its 2014commentary piece “Gaza: Anurgent call to protect civilianlife and health”, the Lancet stat-ed: “The role of the doctor is toprotect, serve, and speak up forlife. That, too, is the role of amedical journal.”

The Lancet is also not theonly publication which has

flagged such concerns. TheBMJ (British Medical Journal),for example, also carried a re-port this month titled “Kashmircommunications blackout isputting patients at risk, doctorswarn”.

The IMA’s vitriolic reac-tion to the Lancet editorial res-onates with many doctors in In-dia. They have been vocal inthe social media. However, notall doctors agree. Sanjay Na-gral, an Indian medical doctor,tweeted: “Many doctors areoutraged by this edit fromLancet, one of the world’s re-spected medical journals. Reg-ular readers know that it has along tradition of commentingon major global political devel-opments. You could differ withthe view but to question its

mandate reveals ignorance.”I was travelling in areas

with poor connectivity this pastweek when I chanced upon theverbal slugfest between doctorsand health advocates in Indiaon the Lancet editorial. TheLancet opinion piece calls therevocation of Article 370 a“controversial move” that al-lows the federal government inIndia “greater authority overthe state’s affairs”.

It flags the findings of tworeports — one by the UN highcommissioner for human rightson human rights violations inJ&K, and also another reportby Medecins Sans Frontieres(Doctors without Borders), theNobel Prize-winning interna-tional humanitarian medicalNGO, on the state of mental

health in J&K.The editorial goes on to

state that “despite decades ofinstability, developmental indi-cators suggest that Kashmir isdoing well compared with therest of India”.

It notes that “in the capitalcity Srinagar, a lockdown hasbeen implemented that sus-pended communications andInternet links, and a strict cur-few has been imposed. Themilitant presence raises seriousconcerns for the health, safety,and freedoms of the Kashmiripeople”, and goes on to raise“serious concerns for thehealth, safety, and freedoms ofthe Kashmiri people”. Thisbrouhaha over an editorial in amedical journal may or maynot blow over soon. But it iscritical to understand the con-text in which the heated debateis taking place.

The issue of the “locusstandi” that various doctors’bodies, including the IMA, talkabout throw up questions thatgo far beyond the Lancet or itsrecent editorial.

It is also not just about thehealth situation in Jammu andKashmir. Non-interference orthe non-intervention rule is aprinciple of international law.The understanding of whatconstitutes “intervention” hasmany grey areas, as expertshave pointed out. But in itsessence, it is about the right ofterritorial sovereignty pos-sessed by each nation that re-stricts the ability of nations tointerfere in the affairs of other

nations.Words like “interference”

are typically part of the vocab-ulary of governments. A gov-ernment’s remit is a function ofnational boundaries. It reactswhen it feels its sovereignty ischallenged. But the languageand idiom of governments isnot the same as that of ordinarypeople.

If one believes in democra-cy, one has to concede that or-dinary citizens, anywhere in theworld, have a right to expresstheir views on any issue. Peo-ple in other countries or regionsmay agree, disagree or not payattention, but one’s right to ex-press oneself on a topic is notsubject to territorial bound-aries.

Those of us who are notpart of the government or thestate apparatus are not circum-scribed by geography. Nothingstops anyone in India from ex-pressing concern about adultsor children in any part of thiscountry as well as those in Pak-istan, Yemen, Syria, China, theSolomon Islands, or any richworld country Equally, nothingstops people in other regionsfrom commenting on India.The other critical question ishow one views health of a peo-ple which is a critical compo-nent of human development.Can health be really delinkedfrom its social determinants?The World Health Organisationdescribes the social determi-nants of health as “the condi-tions in which people are born,grow, live, work and age”.

Nepal will make the Everestregion a plastic-free zone by2020 by banning single-useplastics, a move that willcurb excessive pollution onthe highest point of theEarth’s surface. Theexecutive council ofKhumbu Pasang LhamuRural Municipality inSolukhumbu districtreached this decision onWednesday, the Efe newsreported. The new rule willcome into effect fromJanuary 1, 2020. Nepal isalso marking the “VisitNepal” campaign next yearwhich aims to draw 2million foreign visitors.I n t e r n a t i o n a lenvironmentalists haveexpressed their concern thatNepal has not done enoughto protect the fragileenvironment of the world’shighest peak.

plastic items fewer than 30microns thickness had beenbanned. These items includeplastic bags, straws, sodaand water bottles and mostfood packaging.

The federal budget deficit is expectedto balloon to more than USD 1 trillionin the next fiscal year under the firstprojections taking into account the bigbudget deal that President DonaldTrump and Congress reached thissummer, the Congressional BudgetOffice reported Wednesday.

The return of USD 1 trillion annualdeficits comes despite Trump's vowwhen running for office that he wouldnot just balance the budget but paydown the entire national debt.

"The nation's fiscal outlook ischallenging," said Phillip Swagel,

director of the nonpartisan CBO."Federal debt, which is already high byhistorical standards, is on anunsustainable course."

The office upped this year's deficitprojection by USD 63 billion and thecumulative deficit projection for thenext decade by USD 809 billion. Thehigher deficit projections come even asthe CBO reduced its estimate forinterest rates, which lowers borrowingcosts, and as it raised projections foreconomic growth in the near term.

The number crunchers at CBOprojected that the deficit for the currentfiscal year will come to USD 960billion. In the next fiscal year, whichbegins Oct. 1, it will exceed USD 1

trillion. The CBO said the budget dealsigned into law earlier this month,which took away the prospect of agovernment shutdown in October andthe threat of deep automatic spendingcuts, would boost deficits by USD 1.7trillion over the coming decade.

relief and border security would addUSD 255 billion. Downward revisionsto the forecast for interest rates willhelp the picture, trimming USD 1.4trillion. It also projects the unemploymentrate will remain close to its currentlevel of 3.7 per cent through the end of2020 and then rises to 4.6 per cent bythe end of 2023.

The CBO's estimate is the first toreflect the hard-won budget and debtdeal signed into law earlier this month.

"The recent budget deal was abudget buster, and now we have furtherproof. Both parties took an alreadyunsustainable situation and made itmuch worse," said Maya MacGuineas,president of the private Committee fora Responsible Federal Budget.
