The process is slight- ly more nuanced in Jammu and Kashmir, where not the President's, but Governor's rule is imposed. Under the provision of Section 92 of the Jammu and Kashmir Constitution, Governor's rule is imposed for six months, but only after the consent of the President of India. The Constitution of India grants special status to Jammu and Kashmir among Indian states, and it is the only state to have a separate Constitution and regulations specific to it. The President's rule in other states of India is imposed under Article 356 of the Indian Constitution. Under the Governor's rule, the State Assembly is either kept in suspended animation or dissolved. If it is not possible to restore state machinery before the expiry of the six-month duration, the provision of Article 356 of the Constitution is extended and the President's rule is imposed . The Governor's rule was imposed on the state for the first time in March 1977, when the Congress withdrew support to National Conference (NC) government led by the late Sheikh Abdullah. Senior advocate and ami- cus curiae Vijay Hansaria told the top court that high courts in Bihar and Kerala have issued direc- tions for setting up special designated courts in each of their districts as direct- ed by it on December 4. He said special courts, which were directed to be established by the Patna high court and Kerala high court, may be direct- ed to exclusively deal with cases of lawmakers assigned to them on prior- ity basis. Hansaria, in his third status report filed on Thursday, said 18 states which do not have any special designated courts for trial of cases against lawmakers should be directed to set up in each districts. "That in States, namely, Arunachal Pradesh, Assam, Chhattisgarh, Goa, Gujarat, Haryana, Himachal Pradesh, Jammu and Kashmir, Jharkhand, Manipur, Meghalaya, Mizoram, Nagaland, Odisha, Punjab, Rajasthan, Tripura and Uttarakhand no special courts have been constituted and cases are pending in respective jurisdictional court. It is submitted that appropriate directions for expeditious disposal of cases in the said states may be passed...", the report said. The apex court is seized of a PIL filed by lawyer and BJP leader Ashwini Upadhyay seeking a life time ban on politicians convicted in criminal cases besides the setting up of special courts to expeditiously try such cases. Hansaria was appointed by the apex court as amicus curiae in the matter. He sought directions for respective high courts of these 18 states to allocate the crim- inal cases involving sit- ting and former legisla- tors to as many Sessions courts and Magisterial courts as each high court may consider proper, fit and expedient. "Such courts will exclusively deal with cases thus assigned and no other cases till all such cases are decided. The courts will fix a calendar for each case and will try the cases on day to day basis with- out grant of adjournment except in rare and excep- tional circumstances and for reasons to be record- ed," the report said. Hansaria added that directions should be passed that the special courts will give priority to the trial of cases against MPs and MLAs without distinction between for- mer and sitting legisla- tors. District Election Officer (DEO) Srinagar, Dr SyedAbid Rasheed Shah, Thursday called on all stakehold-ers to cooperate in enrolment of eligible voters of thedistrict during the Special Summary Revision ofElectoral Rolls (SSRER).

The DEO was speaking at a meeting with the repre-sentatives of political parties asking them to appointtheir Booth Level Agents (BLAs) as soon as possible toensure accurate and error-free preparation of electoralrolls.

The meeting was informed that a special camp willbe held at all 857 polling stations of the district onDecember 16. Concerned BLOs will read out the elec-toral roll and BLAs can raise objections during thecamp. He impressed upon the representatives of politi-cal parties to ensure their BLAs coordinate with the con-cerned BLOs in order to ensure timely updation andcompletion of the summary revision of electoral rolls.

Pertinently, the last date for receiving claims andobjections in connection with the Special SummaryRevision of Electoral Rolls (SSRERs) is December 23.The approved dates for disposal of claims and objec-tions and the final publication of the electoral roll areJanuary 12 and January 22 respectively.

District DevelopmentC o m m i s s i o n e r ,Mohammad Aijaz Asad,today reviewed the physi-cal and financial achieve-ments of RDD, PWDHealth and Education sec-tor for the financial year2018-19, here at a meeting.

The DDC took sectorwise review of theprogress on projectsundertaken by differentdepartments in the districtduring the period.

It was informed in themeeting that under ele-mentary education, out ofan availability of Rs 117.96lakh, 61.46 % expenditurehas been achieved while90.60% expenditure hasbeen incurred in the sec-ondary education till theend of November 2018.

Likewise, 93% expen-diture has been registeredunder mid-day mealscheme while 100 percentexpenditure has beenrecorded under RMSA tillNovember 2018.

Under MGNREGA,against an availability ofRs 6649.25 lakh, an expen-diture of Rs 5033.58 lakhhas been registered.

A threadbare discus-sion on various issues likedisposal of pending liabil-ity and generation ofFTOs and related matterswas held.

While taking stock ofPMAY, DDC expresseddismay over slow pace ofprogress and asked BlockDevelopment Officers togear up their efforts andachieve the target withinthe stipulated time. Hedirected him to get anydevelopment work inau-gurated by local girls to

boost their morale.While taking stock of

PWD, it was informedthat under languishingprojects 16 bridges and 61roads have beenapproved at an estimatedcost of 12566.34 lakh.Besides, work on most ofthe projects is in progresswhile in remaining thetenders have been floated.It was also informed thatthe out of 16 bridgesunder the languishingprojects, 10 will be com-pleted by March 2019. Itwas also informed that allthe projects underNABARD are in progress.

To execute work for Branch cutting and tightening ofjumpers, the shutdown of 11KV feeder TRN-3 ema-nating from 2 x10 MVA 33/11 kV R/Stn TrikutaNagar is being observed.

During the shutdown, the power supply to Sector-2 & 2-Extn in Trikuta Nagar and its adjoining areaswill remain affected on December 14 from 10 am to 12noon.

Meanwhile, for replacement of 33 KV isolator and33 KV LA set by M/s IRCON International Ltd, theshutdown of 33 KV Janipur-Sheetli Line is beingobserved.

During the shutdown, the power supply to Sheetli,Sidhra, Bamyal, MES Sheetli, PHE Sheetli and adjoin-ing areas will remain affected on December 14 from12 noon to 3 pm. However, to carry out work forbranch cutting of 33 KV line from Salehat to Sai, theshutdown of 33 KV Salehar-Sai Tap in emanatingfrom Salehar is being observed. During the shut-down, the power supply to Sai, Bilaspur and itsadjoining areas will remain affected on December 15from 10 am to 3 pm. However, for replacement ofCT/PT unit of M/s Kashmir Ispat, SIDCO Complex,Bari Brahmana, the shutdown of 33/11 KV feeder isbeing observed. During the shutdown, the powersupply to Industrial Complex Bari Brahmana willremain affected on December 14 from 1.30 pm to 2 pmand 5.30 pm to 6 pm.

The DC directed theofficers concerned toimmediately release the

pending payments ofrent. He also directedconcerned Collector totake up work of landacquisition cases on pri-ority basis so that people

would not suffer on thisaccount. He exhortedupon the officers andfield functionaries ofRevenue department tospeed up the process ofland acquisition.

In this regard, forsome cases, the commis-sioner constituted a teamfor demarcation of landin active possession of thearmy, so that the rentheld up is released infavour of the land own-ers.

JAMMU, DEC. 13Days after his expul-

sion from the BJP's Jammuand Kashmir unit, GaganBhagat has accused thestate party leadership ofbeing "anti-Dalit" andalleged he was victimisedfor being one.

He claimed that theparty's debacle in therecently concludedassembly elections in fivestates was a result of its"anti-Dalit" ideology.

Going against the partyline, Bhagat had onDecember 3 moved theSupreme Court challeng-ing the dissolution of stateassembly. The apex court,however, dismissed hispetition on Monday, say-ing there was no merit inthe pleas filed by the for-mer legislator.

He was expelled by theBJP on the same day withimmediate effect for his"continued indiscipline,anti-party and anti-Jammu activities."

"I am a Dalit and facedvictimisation from theparty which is 100 percent anti-Dalit...I wasalways given the positionwhere my caste fits,"Bhagat told reportershere. "I have always faceddiscrimination because ofthe anti-Dalit attitude ofthe party leadership.

Scheduled Castes gaveseven reserved seats to theparty in the state but itgave no representation tothe community in the pre-vious government. Noministerial berth wasgiven (to communitymembers) nor any higherposition in the party," healleged.

He added that whenev-er someone highlights thetruth, he is dubbed anti-party.

Earlier in July, Bhagatwas suspended by the dis-ciplinary committee of theparty over his alleged rolein the abduction of an ex-serviceman's daughter, acharge he and the womanrejected.

He said he is notagainst the BJP's nationalleadership.

Bhagat claimed that the

party's state leadershipwas dictatorial and itwould face a drubbing inthe next assembly electionas the people had seen itsreal face.

He alleged that the BJPhad done nothing for theJammu region despitebeing in power in the stateand at the Centre.

"I know everythingabout the party and itsfunctioning. I know howministers were chosenwhen money changedhands. They have filledtheir coffers and havedone nothing for the peo-ple, including those livingalong the InternationalBorder, who are direct tar-gets of Pakistan'sshelling," the doctor-turned-politician said.

Bhagat dared the BJP toannounce its chief minis-terial candidate ahead ofthe Assembly electionsand said "the party wouldnot do so because itknows its position".

"It might push fordelaying the polls giventhe mood of the people,"he said.

The Jammu andKashmir legislativeassembly was dissolvedby Governor Satya PalMalik on November 21.The Election Commissionhas to hold fresh assemblypolls in the state withinsix months, by May 21.

On Article 35A, whichguarantees special rightsand privileges to perma-nent residents of the state,Bhagat said the party istoeing the line of nationalleadership and ignoringpotential threat its revoca-tion poses.

He alleged that thewithdrawal of his securitycover was one of the"pressure tactics" of theBJP to silence him.

On his future plans,Bhagat said he was intouch with all other politi-cal parties.

"I am in touch with allthe parties...barring theBJP, every other party isfor the unity of Jammuand Kashmir. Even thePDP has done more forJammu than the BJP," hesaid.

from Dera Baba NanakNEW DELHI, DEC 13: India will develop 4 km stretch ofKartarpur Sahib Corridor from Dera Baba Nanak inGurdaspur district of Punjab to International Border withPakistan, Parliament was informed Thursday.

The much-awaited corridor will connect Darbar Sahib inPakistan’s Kartarpur – the final resting place of first Sikh guruGuru Nanak Dev – with Dera Baba Nanak shrine in India.

“The government of India has decided to develop the cor-ridor from Dera Baba Nanak in Gurdaspur district up to theInternational Border (with Pakistan),” Minister of State forHighways Mansukh L Mandaviya said in a written reply toLok Sabha. He was replying to a question whether theNational Highways Authority of India has developed or plansto develop any project on the corridor. “Approximate lengthof the road project is about 4 km,” he said. Work on determi-nation of the alignment of road has been initiated, he added.On November 26, Vice President M Venkaiah Naidu andPunjab Chief Minister Captain Amarinder Singh laid thefoundation stone for the corridor. The decision to build thepassage was taken by the Union Cabinet on November 22.Guru Nanak Dev, the founder of Sikhism, had spent morethan 18 years of his life in Kartarpur. Pakistan Prime MinisterImran Khan laid the foundation stone for the corridor inPakistan on November 28. The corridor will facilitate visa-free movement of Indian Sikh pilgrims.

In Indian politics, themoment a political partyloses one election, peoplestart writing it off.Similarly, one victory,and it is as though theparty will win all elec-tions in the future. To besure, every election haslessons and messages.But no one contest canpredict the course offuture elections.

The results of therecent Assembly polls infive states are being readas the ‘arrival’ of RahulGandhi, and as the send-off of the Modi govern-ment in 2019.But mytakeaways, based purelyon the results, reiteratewhat has been provedmany times in the past —each election is different,and needs to be treateddifferently.

Revival of Congress?The Assembly polls

verdict is definitely a bigboost for the Congress,as finally, after four longyears, it has managed totaste victory in importantstates — especially inthose being ruled by theBJP.

In the run-up to thepolls, the Congress hadbeen claiming that ruralIndia was in distressunder the Modi regime,and voters would teachthe BJP ‘a lesson’.

What the Congressfails to talk about, how-ever, is that it took theparty 15 long years torebuild itself in MadhyaPradesh andChhattisgarh — despiteclaims by its leaders thatit was the UPA govern-ment that worked for therural India for 10 years.

In fact, despite farmer

suicides, the Mandsaurfiring incident anddemonetisation, the BJPput up a good fight,especially in MadhyaPradesh, where two stal-warts, Kamlanath andJyotiraditya Scindia,were taking on ShivrajSingh Chouhan.

This shows that BJP isbetter in using anti-incumbency — when BJP

wins a state afterCongress rule, its usuallya landslide victory.

On the other hand, itis still not in theCongress’ DNA to workas a formidableOpposition when out ofpower, which can ensureconvincing victorieswhen elections come.

Congress has manybastions to breach

The crushing defeat ofthe Congress inTelangana clearly showsthat it is still not anoption for voters in

many parts of India,especially wherever athird alternative is avail-able.The BJP, on theother hand, is makingrapid inroads in stateswhere it traditionallyhasn’t had much of apresence. In states likeOdisha, for example, theBJP has already taken therole of the mainOpposition, and the

Congress has done littleto revive it itself.

Fortunately for theCongress, Rajasthan,Madhya Pradesh andChhattisgarh had adirect fight between itand the BJP. InTelangana, it was unableto take on a regionalparty, which, to anextent, the BJP manageswell. In Maharashtra, ithas managed to surpassthe Shiv Sena in popular-ity, in Bihar, it is relevant,and in Uttar Pradesh, itactually won power,

despite the strong pres-ence of BSP and SP. InBengal, it is on the path ofgrowth. The Congress,meanwhile, has barelymanaged a presence instates where it was onceformidable. This is hard-ly an encouraging signfor 2019.

Nehru-Patel a thing ofthe past?

According to the

results, the BJP has got adrubbing in rural areas— one of the reasons forits poor show inChhattisgarh.This clearlyshows that it doesn’tmatter to rural voterswhether Pandit Nehruwore a rose in his‘achkan’ or not, whetherhe mistreated SardarPatel or not. What mat-ters to the rural youth iswhether the governmentwill listen to their needs,whether it will be able toimprove their income,and whether they will get

a good price for theirfarm produce.

It may be a matter ofpride for the educatedurban working class thatPM Modi got a standingovation in the USCongress, or that he wasgreeted by gushing NRIcrowds on his visitsabroad. For rural India,jan dhan accounts andtoilets are clearly notenough.Soft Hindutva isit the way forward forCongress?

Rahul Gandhi’s tem-ple run started fromGujarat, but then it con-tinued religiously, espe-cially in MadhyaPradesh, which in 1990sused to be called a‘Hindutva lab’ andwhere the BJP has beenstrong since the time ofthe Jana Sangh.

Many say the templerun started to change thepeople’s perception ofCongress as a ‘party ofMuslims’— somethingAK Antony in his reporthad pointed out as one ofthe reasons for the 2014Lok Sabha rout.

The truth is that theCongress is to be blamedfor not promoting secularMuslim leaders in theparty. Also, playing withsoft Hindutva may costthe party badly —historyis proof. Nehru hadfought the likes ofPurushottam DasTandon within theCongress to stronglysupport its secular ethos,at the risk of becomingunpopular with the partyleadership. But whenRajiv Gandhi decided to

allow ‘shilanyas’ atAyodhya, the Congresspaid heavily for it.TheBJP has no qualm abutopenly playing religiouspolitics, as that is themain identity of theparty. But that is not thecore of the Congress, anddeviating from it willharm the party.

Where are BJP’s‘panna pramukhs’?

A lot was spokenabout ‘panna pramukhs’(party workers to takecharge of each page ofthe voters lists) duringthe Gujarat elections,when the BJP was sayingit would win at least 150seats. But in the threerecent elections, thepanna pramukhs seemedto be missing.

Last year, when AmitShah had addressed BJPworkers in Mumbai, hehad insisted on theimportance of the ‘man-jha’ (string) in kite flying.He had said the party’skite would soar high onlyif the ‘manjha’ (partyworkers) was strong. Onpaper, the party organi-sation looked verystrong, with the appoint-ments of panna pra-mukhs and booth pra-mukhs. But on theground, BJP workerswere seemingly not keenon campaigning for theparty, because of the verylittle say they have indecision-making later.

Learn from historyIn the end, there is a

lesson to be taken fromhistory— something theBJP is quite fond of dip-ping into.

Secretary SocialWelfare, Dr FarooqAhmad Lone todayreviewed implementa-tion of Pradhan MantriMatru Vandana Yojana(PMMVY) in the state.

Mission DirectorICDS, Vir ji Hanglooinformed the SecretarySocial Welfare that 60598beneficiaries are regis-tered under the schemein J&K.

He said out of thetotal number of regis-tered beneficiaries 49493have received one instal-ment, 35597 two instal-

ments and 17023 threeinstalments till date.

The registered benefi-ciaries include 4666scheduled castes 5229scheduled tribe and50403 general categorybeneficiaries.

The meeting wasinformed that theMinistry of Women andChild Development,Government of India hasreleased Rs 29 croretoJ&K for the implementa-tion of the scheme out ofwhich Rs 15.47crorehave been released to thebeneficiaries throughDBT.

It was informed that

all the beneficiariesunder the scheme areAadhar seeded.

Speaking at the meet-ing, Dr Lone asked forexpediting the imple-mentation of the schemeand to ensure that no eli-gible beneficiary is leftout.He directed forcapacity building offrontline workers partic-ularly Anganwadi work-ers for effective imple-mentation of thescheme.It was decidedthat best performingworkers and officers willbe given performance-based incentives out offlexi funds available

under the scheme.Pertinently, under

PMMVY a cash assis-tance of Rs 5000 is pro-vided to the women inthree instalments for thefirst child at differentstages of pregnancy andpost-child birth.

While addressing theconvention, MohamadYousuf Tarigamiexpressed serious concernover the plight of theworking class which isadversely hit by the neo-liberal economic policiespursued by the BJPGovernment. He calledfor united struggle tofight the onslaught of theanti-labour policies of thecentral government, dueto which every section ofthe society has been bear-ing the brunt. The claimsof economic growth donot carry any weightwhen the statistics revealthat 73 per cent of the

additional wealth createdduring 2017-18 has beenearned by one per cent ofthe population.

These policies are dras-tically affecting the work-force especially workingin the unorganized sectoracross the country includ-ing Jammu and Kashmirvirtually reducing themto the status of bondedlabour. The continuationof neo-liberal economicpolicies of the Modi gov-ernment coupled withdemonetization andimplementation of GSThave serious ramifica-tions on the lives andlivelihood of the working-class people.

Labour laws in thestate were not in tunewith the interests ofworkers in organized andunorganized sector andthere was imminent needto amend and updatethese. High levels ofunemployment being acause of serious concernhave not been addressedseriously by the succes-sive governments therebyputting our youth in a

state of despair and wor-risome. Widespreadunder-employment isalso gaining momentumas highly qualified andskilful youth are doinglow end and unskilledjobs. The governmentseems to be in no mood totake measures to maxi-mize employment oppor-tunities. Scores of studentsfrom KashmirUniversity's law depart-ment on Thursday stageda protest to press fordeferment of their 6thsemester (final) exams toMarch.

Dozens of studentsassembled at the campusand staged protestsagainst the varsity's lawdepartment authoritiesfor their decision to holdexams in December. Thestudents demanded that

the department shouldissue a notification toannounce deferment ofexams to the month ofMarch.

"The authorities seemto be in a hurry to hold ourexams. The departmentshould follow a propercalendar for holdingexams so that students canget ample time for prepa-rations," said a studentwho were part of theprotest. In wake of theprotests, some teachingfaculty members tried topacify the students to call

off their protests. Whencontacted, Head of thedepartment, law, ProfHussain said that theexam was scheduled inDecember on the demandof students who want toappear in the exams forthe post of Munsif judge."The law department hasadvertised 24 posts ofMunsif judge and our out-going (LLB 6th semester)students want to appear inthat exam," he said. Prof.Hussain said some stu-dents want the depart-ment to hold exams in

March which has put theauthorities in a catch-22situation. Education Officer (CEO)concerned to the DirectorOffice after having clearedall deficiencies in themonth of April this year.He regretted that despiteclearing all deficienciesno action has been takenso far to regularize thedeserving ReT teachers.He sought intervention ofthe Director to get thisissue resolved.

To ameliorate the veterinary problems of thelocal populace the Indian Army organized a 'MobileVeterinary Camp ‘on 13 Dec 18 at Village Songri,Rajouri District.A team of Veterinary Doctors andVeterinary Assistants from the Army and Dr. MohdShabir and Dr. Maqsood Hussain from Civil attendedto the animals arriving in the camp. A total of 169 ani-mals to include sheeps, goats, cows, buffaloes, mules,dogs and horses were treated during the veterinarycamp. Addressing Youth National Conference meet at

Srinagar Khalid Rathore said, "The governance

deficit, deteriorating development scenario and dis-

enchantment has dejected the youth, the need of the

hour is to engage youth and help them realize their

dreams," he said.

Militant killings trigger clashesin Sopore in north Kashmir

SOPORE, DEC 13: Militant killings on Thursdaytriggered violent protests in Sopore area of northKashmir's Baramulla district. An eye witness said thatthe youth hurled stones on the forces withdrawingfrom the Brath Gund area soon after the gunfightended. The forces, he said, fired tear gas shells to chaseaway the protesters. Two militants - Owais Bhat andTahir Ahmad Dar- were killed in an overnight gun-fight in Brath Gund area of Sopore. Meanwhile, a com-plete shutdown is being observed in Sopore to mournthe militant killings.

Witnesses said all shops and other commercialestablishments are shut while public transport hasgone off the roads.

Malik drove to SMHS hospitaltoday afternoon soon after he visited Mugjund wherethree militants were killed in a gunfight on Sundaymorning, said a JKLF spokesman. Malik inquiredabout the well-being of Hiba from her parents.

Hiba is the youngest pellet victim in the currentphase of violence in Kashmir, joining approximately1,200 others hit in the eyes in the state since 2016.

Hiba was injured on November 25, after protestsbroke out at her village in Kapran, Shopian, followingan encounter during which six militants were killedby government forces.

"Each court will sent a month-ly status report to the high court and the high court onexamination of the same will issue necessary adminis-trative directions as and when required," he said addingthat directions should also be passed to the forensic lab-oratories to give priority in furnishing the pendingreport in cases tried by the special courts. He said thatdirections should also be given to the state governmentand Union Territory administration to designate at leasttwo special public prosecutors for prosecuting casesbeing tried in special courts and request to the highcourts to decide the cases where stays were being grant-ed. "That there are about 250 cases pending in differenthigh courts in which further proceedings in criminalcases against MPs/MLAs have been stayed. Highcourts may be requested to decide all such cases prefer-ably within three months from date of order of thecourt," the report said. Giving the details of number ofpending cases against the lawmakers, Hansaria saidthat there are 430 cases which involve offences entailinglife sentence and out of those charges have not been yetframed in 288 cases. The apex court was informed thatthere were total of 4,122 criminal cases pending, somefor over three decades, against present and formermembers of Parliament and legislative assemblies. Thetop court had fixed the sequence for cases to be tried inthese designated courts and said that cases against sit-ting or former Member of Parliament (MP) or Memberof Legislative Assembly (MLA) involving offences pun-ishable with life imprisonment or death sentence, shallbe taken as a first priority. The court had said that cre-ating designated courts in each districts will be a moreeffective step instead of concentrating all the casesinvolving former and sitting legislators in one specialdesignated court. Earlier, Hansaria in his second statusreport had said that out of 4,122 cases, 2,324 are againstsitting lawmakers both MPs/MLAs and 1,675 casesagainst former legislators (both MPs/MLAs). The courthad however, made it clear that the rest of the specialcourts already set up by the earlier direction of apexcourt shall continue to work and try cases assigned tothem until further orders.

Governor's Rule...government's jurisdiction extends over limited mat-

ters with respect to Jammu and Kashmir. In all othermatters, not specifically vested in federal governments,actions have to be supported by the state legislature.

Among notable differences with other states till 1965,the head of state in Jammu and Kashmir was calledSadr-e-Riyasat, whereas in other states the title wasGovernor. The head of government was also calledPrime Minister in place of Chief Minister in other states.

The Government of India can declare emergency inJammu and Kashmir and impose Governor's rule in cer-tain conditions. Matters related to defence, foreign rela-tions, communication and finance of Jammu andKashmir are under the jurisdiction of the IndianConstitution.

All Parties SikhCoordination Committee(APSCC) today said thatthe internal bickeringand disintegration ofPeoples DemocraticParty (PDP) has takenplace due to the wrongpolices of present partyPresident and formerchief minister, MehboobaMufti.

In a statement issuedto ,, APSCC ChairmanJagmohan Singh Rainasaid that MehboobaMufti failed not only aschief minister of Jammu& Kashmir, but also asPresident of PDP.

Raina said thatMehbooba could notpursue the agenda as setout by her father LateMufti MohammadSayeed and it is due toreason that PDP has dis-integrated like a pack ofnine pins.

The APSCC Chairman

said that Mehboobaplayed truant with theSikh community of thestate by denying themrights that were due tothem under the NationalMinorities Act.

He said the PDPPresident in fact sabo-taged the extension ofminority status to Sikhsof the state by filing acounter affidavit in thecourt of law and that tooat the highest level.

"Before 2014 assemblyelections Late MuftiSayeed promised beforea huge gathering of Sikhsthat he would giveminority status to Sikhsof Jammu & Kashmir andthe same formed a part ofthe party manifesto forthose elections.

However, for threeand half years the power-ful Kashmiri Panditlobby ensured that Muftidoes not fulfill the prom-ises made to the Sikhcommunity," said Raina.

The APSCC Chairmansaid that after beingelected as CM of state in2016, Mehbooba waskeen to implement thecentral policies in state.

He said her advisorProf. Amitabh Mattoomanipulated certainorders and rephrased thesame so that theKashmiri Pandits getbenefitted out of therevised orders.

"It is a pity that all thelegislators knew aboutthis, but none amongthem raised a fingeragainst the same.

Mehbooba led stategovernment filed an affi-davit in Supreme Courtand opposed the exten-sion of National MinorityAct to Jammu &Kashmir. She also issuedSRO 425 by virtue ofwhich employment bene-fits due to Sikhs weregiven to the KashmiriPandit youth," saidRaina.

The APSCC Chairmansaid that despite meetingMehbooba many timesno headway whatsoeverwas made with regardsto demands of Sikhs liv-ing in Jammu & Kashmir.demanded that ElectionCommission of Indiashould ban PDP since theparty went against itsown election manifestoby opposing minoritystatus to Sikhs and thattoo in the apex court ofcountry.

Raina said thatKashmiri Pandits cannever be given minoritystatus since Hindus arein majority and not inminority in India.

He said that commu-nities like Muslims,Sikhs, Christians,Buddhists and Jains havebeen classified as minori-ties in India by NationalCommission forMinorities.

NEW DELHI, dec 13: TheSupreme Court, which is hearing aplea challenging the validity of thesensitive Jammu and KashmirResettlement Act of 1982, sought toknow Thursday as to how manypeople who migrated from the statehave applied for returning fromPakistan.

A bench headed by ChiefJustice Ranjan Gogoi asked thestate government’s counsel to takeinstruction on the issue and postedthe matter for further hearing onJanuary 22.

Senior advocate RakeshDwivedi, appearing for the state,told the bench, also comprisingJustices S K Kaul and K M Joseph,that he will seek instruction from thecompetent authority and give thedetails about the migrants and their

descendants who may haveapplied for returning under the law.

The apex court wanted to knowhow many migrants and theirdescendants have applied andwhether applications for return havebeen made by permanent residents— persons who are being givenspecial rights and privileges underthe Jammu and KashmirConstitution.

The top court was apprised thatthe Act was meant for those peoplewho have migrated to Pakistan in1947 and were willing to return.

During the brief hearing, thebench showered several questionsfor the lawyers appearing in thematter, to the extent of the meaningof the term descendant under thelaw.

Dwivedi along with Jammu and

Kashmir’s standing counsel ShoebAlam said a letter has been circulat-ed seeking adjournment of the mat-ter saying that it should be heardafter other contentious issue per-taining to Article 35-A and Article370.

The apex court is seized of thepetitions on both the issue. Article35-A empowers the state assemblyto define “permanent residents” forbestowing special rights and privi-leges to them.

Article 370 grants special statusto Jammu and Kashmir and limitsParliament’s power to make lawsconcerning the state.

The Jammu and KashmirResettlement Act of 1982, whichwas stayed by the apex court in2001, envisages grant of permit forresettlement of Pakistani nationals

who had migrated to Pakistan fromJammu and Kashmir between 1947and 1954 after India’s partition.

The petitioner, Jammu andKashmir National Panther Party(JKNPP) is arguing the matterthrough its Chief and senior advo-cate Bhim Singh.

Singh has contended that thematter has been pending for longand needs to be decided.

The top court had on August 16,2016 indicated that it may refer thematter to a constitution bench if itfinds that some issues neededinterpretation of the Constitution.

The court had said that it willhear the matter and if during thecourse of proceedings it is foundthat no constitutional issue is

involved, then it will pass an order.JKNPP had earlier told the court

that a division bench in 2008 hadissued direction to list the casebefore a constitution bench but theChief Justice in the same year hadover-ruled the decision and orderedthe matter to be listed before athree judge bench. It had said thatpeople of Jammu and Kashmir whomigrated to Pakistan from 1947could be considered for their returnbut their descendants could not be.

The party had said that the lawpassed by the Assembly was dra-conian, unconstitutional andimproper which threatened thesecurity of the state.

JKNPP through Harsh DevSingh, a then MLA, had challengedthe Act passed by the J&KAssembly in 1982.

Chief of Army StaffGeneral Bipin RawatThursday warned thatofficers and jawans of theArmed forces “who can-not withstand stress” and“feign disability citinghigh blood pressure, dia-betes and hypertension toavoid operational dutiesand earn extra money”will soon face action fromthe Army headquarters.

He made the statementin Pune while addressing

a gathering of soldiersand officers who havebeen disabled in the lineof duty.

He said, ”The Armywill continue to provideall possible assistance,even of financial nature,to the truly disabled sol-diers. But I am warningthose who feign disabilityto earn extra money, willsoon face action from theArmy headquarters thatthey will not like. (Thistype of) disability cannotbecome a reason to avoid

operational duty at thecost of lives of officerswho continue to performthe duty till the lastbreath.”

The function alsoincluded a dance andsong performance by dis-abled soldiers.“Some offi-cers and jawans who can-not withstand stress andsay they are disabled onaccount of high bloodpressure, diabetes andhypertension should beashamed of themselveslooking at the inspiringperformances of the dif-ferently abled persons onthe stage today,” he fur-ther added.

During the event,General Rawat alsoannounced that as a partof the initiative, an exer-cise to collect data of alldisabled soldiers in thecountry has been under-taken under the banner of“Year of Disabled Soldierin the Line of Duty” and isnearing completion.

In a Public Interest Litigationfiled in alleged RajouriDevelopment Authority, Scam, ADivision Bench of State High CourtComprising Chief Justice GitaMittal and Justice Sanjay KumarGupta closed the PIL.

When the PIL came-up forhearing, Division Bench observedthat status report dated 11December, 2018 has been filed byMrs. Seema Shekhar, Sr. AAG,whereby we are informed that theEnquiry Officer under cover of hisletter dated 25th October, 2018 hassubmitted the enquiry report to theGeneral AdministrationDepartment. It is further stated inthe status report that the reportstands examined at various levels

in the Government Departmentand the same has been accepted bythe State Government.

Sr. AAG Seema Shekharhas also brought a copy of thereport dated 25th October, 2018,wherein after enquiring into theallegations against MohammadJaved Khan, IAS (respondent No. 7before us), the Enquiry Officer afterdetailed consideration has conclud-ed thus:- "Therefore, in the light ofabove details, Shri MohammadJavid Khan, IAS, the then ChiefExecutive Officer, Rajouri Dev.Authority is not found involved inany criminal negligence and, there-fore, charges against him needs tobe dropped. However, competentauthority may like to order RegularDepartment Action against othertwo officials as the undersigned

was assigned to conduct enquiryagainst Shri Mohammad JavidKhan, IAS."

During the course of hear-ing Sr. Adv Sunil Sethi submittedthat that on account of false allega-tions made against Javed Khan IASand has having been subjected torepeated enquiries at the instanceof the petitioner, the respondentNo. 7 has suffered gross prejudiceand damage including loss of hisreputation.

Senior Counsel seeks liberty toinvoke such legal remedies for thedamage suffered by him. DivisionBench observed that nNo liberty isnecessary for this purpose. It isalways open to respondent No. 7 toavail such remedies for appropriaterelief as he may deem fit and prop-er in the matter.

Myworkers are not satisfied with the treatment I was givenby the party and when my workers are not satisfied,what can I do without them. I had no option but to quit.I will decide future course in consultation with myworkers."

Saying that the party empowered 5000 votes ofKhanyar in Srinagar, Raja Aijaz said, "When five thou-sand votes could be empowered there was no scope forthe party leadership to dis-empower 19000 votes."
