One dead, three injured in Doda road accident DODA: A person died and three others recieved serious injuries when a vehicle they were travelling in skidded off the road and fell into a deep gorge near Dudwar Morh area of Gandoh in Doda district of Jammu and Kashmir on Monday. Reports said a load carrier (bearing registration number HP38A -8893) skidded off the road and fell into a 250- feet deep gorge at Dudwar Morh on Gowari-Neli Road in Gandoh sub-division when it was on its way to Neeli from Changa Gowari. SDPO Gandoh, Nawaz Mohd Khanday said that four persons associated with a telecom company were on their way to a tower site when the mishap took place. "After getting information, I along with a police team immediately rushed to the spot and along with locals shifted all the injured persons to PHC Changa, where doc- tors declared one of them as brought dead," said Khanday, adding that other seriously injured were shifted to GMC Doda for further treatment after first aid. He said the driver's negligence might have caused the mishap. The deceased has been identified as Kareem Baksh (50), son of Mai, a resident of Tipri, Patshala- Bonjwah area of Kishtwar. The injured have been identified as driver Mohd Mussa S/o Mohd Hussain R/o Tipri Patshala, Bonjwah, Bashir Ahmed S/o Abdul Gani R/o Loran Mandi Poonch and Mohd Ashraf S/o Kareem Baksh R/o Tipri Patshala Tehsil Banjwah. An official said that a Srinagar-bound pick- up truck (bearing registration number JK14D 3673) carry- ing bovines went out of the driver’s control and plunged into a deep gorge near army camp Digdool, resulting in death of one person and injuries to another. After receiving information about the accident, the rescue teams compris- ing police, SDRF, local volunteers and a road opening party of the Army stationed near the accident spot launched a res- cue operation, he said. After hectic efforts, the injured person was rescued from the gorge and shifted to the district hospi- tal Ramban for treatment. The deceased was identified as Munir Ahmed and the injured as Keshu, both residents of Udhampur. Six absconders held in Poonch JAMMU: Police have arrested six absconders, including a woman, who were wanted in separate cases in Jammu and Kashmir's Poonch district, officials said on Monday. The six had been evading arrest for 6-13 years, they said. Several police teams conducted raids at different localities in Poonch district and arrested the absconders who were identified as Mohd Sahakeel, Mohmmad Aftar, Mohmmad Riyaz, Khaliq, Shakeela Bi and Mohmmad Zabeer, the offi- cials said. Khaliq had been on the run since 2007 in a crim- inal case, they said. The six accused were nabbed by a team of Mendher police station on Monday and they were pro- duced before a court after legal formalities, according to the officials. They further high- lighted that the valorous and peace-loving people of Jammu, who are patriotic to the core and have given exemplary sacrifices for the country and nation, including maximum number of supreme sacrifices, have been treated shabbily and unjustly both by the erstwhile J&K State Governments and the Kashmir-centric Governments at the cen- tre relegating them to the status of 2nd class citizens in their own country. “However with the change of the State of J&K to Union Territory, the people of Jammu, who had welcomed this change, were expecting that now at last Jammu will get justice & dignity long denied to it,” said Professor Lalit Mangotra and Zorawar Singh Jamwal, further lament- ing, “But, the said orders of Prasar Bhaarti, have sadly belied the hopes and expectations of Dogras, and on the con- trary are aimed at belit- tling their language & culture. That is why J&K is the only state having two capitals Jammu & Srinagar. Shutting down of the local Dogri programmes from Jammu & impos- ing Kashmir channel, which has negligible content pertaining to Jammu region, is not only gross injustice to Jammu but also a step fraught with very dan- gerous consequences,” warned Professor Lalit Mangotra and Zorawar Singh Jamwal. Dogri Sanstha, Team Jammu lambast Prasar Bhaarti for undermining Dogra identity NEW DELHI, JULY 28 The Rajasthan government on Tuesday (July 28) forwarded a revised proposal to Governor Kalraj Mishra seeking to convene assembly session from 31st July. The fresh pro- posal includes the government's reply to the three condi- tions that the Governor had earli- er raised in case the session is convened, according to sources. Chief Minister Ashok Gehlot today chaired the Cabinet meeting to dis- cuss the points raised by the Governor. The revised note has been forwarded to the Raj Bhawan today after approval from the Cabinet, a PTI report said citing official sources. The government note is learned to have not mentioned if it wants to seek a vote of confidence in the assembly session. On the issue of 21- day notice required for calling the session, Rajasthan Transport Minister Pratap Singh said that 10 days have already passed and asked why did the gover- nor not give a date if he is talking the notice. Speaking to reporters in Jaipur, the minister said that it is for the Business Advisory Committee of the assem- bly to decide when asked about the agenda of the session. Regarding seating arrangement as per social distancing norms in the assembly, he said that it was for the Speaker to look after. Criticising the BJP, the minister said that the party has made it a pres- tige issue, adding that the BJP stands exposed. In a related develop- ment, BJP leader Madan Dilawar today filed another petition before the Rajasthan High Court against the merger of six Bahujan Samaj Party (BSP) MLAs in the state with Congress party. This is the third petition against the merger. Earlier in the day, Dilawar had filed a second petition in the Rajasthan High Court challenging the merger of MLAs. Dilawar told ANI that the petition seeks can- cellation of the member- ship of the six BSP MLAs from the state legislative Assembly, adding "Rajasthan High Court had dismissed my peti- tion observing that it did not include a copy of the Legislative Assembly Speaker`s order for the merger of the BSP MLAs. He (Speaker) deliberately did not give me a copy of the order." Notably, Dilawar had also sat on a protest in the office of the Vidhan Sabha Secretary yester- day demanding a copy of the order given by Rajasthan Speaker on the merger. In a relief for Chief Minister Ashok Gehlot- led government, the High Court on Monday dismissed Dilawar`s plea against the merger. Dilawar told ANI thatthe petition seeks can-cellation of the member-ship of the six BSP MLAsfrom the state legislativeAssembly, adding"Rajasthan High Courthad dismissed my peti-tion observing that it didnot include a copy of theLegislative AssemblySpeaker`s order for themerger of the BSPMLAs. He (Speaker)deliberately did not give

me a copy of the order."Notably, Dilawar had

also sat on a protest inthe office of the VidhanSabha Secretary yester-day demanding a copy ofthe order given byRajasthan Speaker onthe merger.

THE COVID-19 pandemichas sidelined the issue of cli-mate change. This can have

very serious consequences giventhat the matter had been receivingfar from adequate attention evenbefore the virus began its globalsurge. Two things have been imped-ing progress. First, leaders like USPresident Donald Trump andPresident Jair Bolsonaro of Brazilare known to be dismissive of theenvironmental threat. The second isa lack of will on the part of govern-ments and people to take effectivepreventive action.

A recent report in The New YorkTimes, (last updated on July 15) byNadja Popovich, Livia Albeck-Ripka and Kendra Pierre-Louis,cites a New York Times analysis,based on research by Harvard andColumbia law schools and othersources, saying that the Trumpadministration has officiallyreversed, revoked or otherwiserolled back nearly 70 environmen-tal rules and regulations. More than30 other rollbacks are works inprogress.

A report by Sarah Gibbens in theNational Geographic, published onFebruary 1, 2019, mentions 15important decisions by the Trumpadministration that would adverselyimpact the environment. The list,which starts with the US withdraw-al from the Paris ClimateAgreement, includes decisions thatwould undo measures to ensureclean power and fuel, prevent airpollution and protect wildlife.Besides, the Trump administrationhas opened up public land to busi-ness and dropped climate changefrom the list of national securitythreats. Bolsonaro’s policiesregarding de-regulation of econom-

ic activity and tax cuts to encourageFDI are liable to severely damagethe environment and devastate thelives of Brazil’s indigenous com-munities.

As to the lack of will to take pre-ventive action against climatechange, one must begin by recog-nising that the task here is vast anddaunting, requiring basic and trans-formational changes in the patternof development followed by mostcountries since the industrial revo-lution in the second half of the 18thcentury. Whether in the form ofsteam produced by burning coal orelectricity generated by coal-basedthermal power plants, diesel orpetrol combustion, it has been driv-en by fossil-based fuel, the burningof which has been a potent cause ofair pollution. The institutionalstructures, management and/oradministrative procedures, commu-nication systems and, in morerecent times, information transferand processing, have all been basedon this form of energy utilisation.

Clearly, the pattern of fuel use hasto change. Of course, the use of fos-sil-based fuel cannot be given upimmediately. It has to be graduallyreduced and alternative forms ofenergy have to be harnessed. Hydroelectricity is a safe bet but its gener-ation is limited by the availabilityof dam sites and water. The worldhas taken baby steps towards theutilisation of solar and wind(through windmills) power. Eventhough the potential of both are yetto be fully grasped, it is doubtfulwhether they can by themselvesmeet the steady, gargantuanincrease in global energy demandsthat will continue.

This leaves one with nuclear ener-gy. It produces zero-carbon emis-sion as it is generated throughnuclear fission and requires less

land to produce more electricitythan any other clean air source. Thesecond is important at a time whenfinding land for establishing powerplants often prompts mass protestsagainst land acquisition, particular-ly in India. Against this, there is stilla problem of waste disposal, thoughtechnology is taking care of itthrough its re-processing and re-cycling to generate nuclear power.

The major fear, of course, is of thespread of radiation through acci-dents like the ones that occurred at

the Three-Mile Island in the US in1979, Chernobyl in Ukraine in1986 and Fukushima Daiichi inJapan in 2011. Clearly, one has toproceed very carefully and slowlyin generating and harnessingnuclear power. Indeed, what oneneeds is a mix in generation pat-terns to cater to diverse consump-tion demands with local variations.Solar panels, for example, havealready begun providing householdpower.

The mix will have to be differentfor different countries and evenregions, depending on the nature ofpower demand. This will requireplanning at the international,national and regional levels andalso huge amounts of investmentfor which the developing countrieswould require assistance. TheWorld Bank has increased climate-related spending and the UnitedNations Environment Programme(UNEP) has set climate change as a

priority in its capacity-buildingefforts. These efforts are con-strained, however, by funding, thatis not commensurate with the scaleof the challenge as well as by deep-er challenges in the developmentaid model. Under former PresidentBarrack Obama, the US hadpledged three billion dollars to theGreen Climate Fund a globalreserve fund created to, amongother things, help developing coun-tries invest in renewable and low-emission technologies. A sum of

one billion dollars had already beengiven during his tenure in office.Trump has pledged no money to thefund.

The question of funds is particu-larly important in respect of theintroduction of technologies toreduce emissions. An example isthe Carbon Capture and Storagetechnology, which focusses onsecuring and storing carbon dioxideemissions before they are releasedinto the atmosphere. Although it isstill in its early stages, successfulpilot projects offer hope of develop-ing and implementing it on a largescale.

Some countries are committed toimplementing variations of it andboth bilateral and multilateral coop-eration is under way. One, however,has still to wait and watch as imple-menting it on a large scale can beexpensive beside offering few obvi-ous economic benefits.

Meeting the costs of implement-

ing such technologies, indeed of allmeasures against climate change,will require political will. Thistakes us back to the second factoridentified at the beginning of thispiece as impeding the fight againstclimate change the lack of will onthe part of governments and peopleto take effective preventive action.Governments are constrained bygroups whose incomes and profitsare going to be reduced by theimplementation of climate changemeasures as well as the compulsionof having to decide among diversedemands on their resources. Peopleare generally hostage to their exist-ing ways of life. This applies espe-cially to the elite, who decide onpolicies and measures in every soci-ety and who enjoy all the comfortslike air conditioning, which is high-ly polluting, and conveniences thatpresent technology-powered civili-sation has brought them.

The answer lies in developing andintroducing non-polluting technolo-gies relating to heating/cooling,transportation, cultivation, con-struction and all other human activ-ities. The money and effort neededhave to be forthcoming, theCOVID-19 pandemic and the dis-ruption caused by it notwithstand-ing. It is important to recall herethat the ParisAgreement onclimate change,signed onDecember 12,2015, calls forholding theincrease in glob-al average tem-perature to wellbelow twodegree Celsiusabove the pre-industrial-revo-lution level and

to try to limit the temperatureincrease to 1.5 degree Celsiusabove it, stating that this would sig-nificantly reduce the risks andimpact of climate change. TheSpecial Report on Global Warmingof 1.5°C, released by theIntergovernmental Panel onClimate Change (IPCC) at Incheon,South Korea, on October 7, 2018,makes the chilling statement that atthe current rate, the global meantemperature is likely to rise to the1.5-degree mark sometime between2030 and 2052.

The world has already warmedone degree Celsius since the indus-trial revolution. Hence, it is really aquestion of another half degree.Further, the report clearly indicatesthat warming, even if limited to 1.5degrees Celsius, would not reducethe risks and impact of climatechange. Sea levels will continue torise beyond 2100, threateningcoastal ecosystems and infrastruc-ture. Flooding, drought and extremeweather events will wreak havoc oncommunities around the globe.Many species will continue to bedriven toward extinction andmarine ecosystems could face “irre-versible loss.” The is long and writ-ten on the wall. Humankind willignore it at its own peril.

HC breather to PilotAFTER the Supreme Court’s observation that no party could suppress the

“voice of dissent” in a democracy by disqualifying members holding adifferent viewpoint under the anti-defection law, thereby holding on to

power, it was clear the way things would go in Rajasthan. So it came as no sur-prise that the Rajasthan High Court stopped the Speaker from taking actionagainst now-sacked deputy Chief Minister Sachin Pilot and other rebel Congressleaders. The breather holds till Monday when the Supreme Court is to take up theHigh Court judgment as desired by the Rajasthan Speaker. And since the topcourt will need some time to deliberate and define the larger constitutional ques-tion of the Speaker’s powers and whether his moves were neutral or biased, therecould be some more delay for the stalemate to be resolved. In fact, the HighCourt reprieve gave further credence to Pilot’s contention that he was not againstthe party but the Chief Minister, making it look like an egoistic contest of theliked and the unliked. The Ashok Gehlot Government, which is in an ugly battleto see Pilot and his group turfed out, had hoped that it could use the anti-defec-tion law to disarm the rebels, arguing that their skipping the legislature partymeeting amounted to defiance and that the Speaker could take action even if theHouse was not in session. Pilot claimed that considering that he and his party hadnot initiated any move to self-destruct or leave the party on their own exceptexpress a divergence of opinion with the Chief Minister concerned, this infringedupon the right to “freedom of speech.” In fact, Gehlot’s provocative legal actionhas misfired and Pilot’s reactive strategy has worked for the time being. Vilelyderided and almost forced to break away, it is now easier for Pilot to take the helpof the BJP, which has been courting him for quite some time. Not only forreclaiming Rajasthan but to deal a body blow to the Congress as Pilot, likeJyotiraditya Scindia, has been close to its undeclared leader Rahul Gandhi. Aninkling of this came when Pilot, who had challenged the disqualification noticesin the High Court, added the Centre as a party to the case so that it can weigh inon whether the anti-defection law applies to his group or not. According to ear-lier Supreme Court judgments on clause 2(1)(a) of the 10th Schedule of theConstitution, any anti-party activity could be interpreted as voluntarily giving upmembership. Gehlot has, therefore, been building damning evidence of Pilot’sbreakaway moves, like parading MLAs claiming bribery offers and publicisingalleged tapes of senior BJP leaders coaxing rebels at Pilot’s behest. But Pilotsought to blunt that edge, threatening a legal suit and demanding authenticity ofsuch claims. The clouding up of legalese has meant that both Gehlot and Pilotwill have a tough time holding on to their men. Gehlot needs to prove that he hasmore than 101 MLAs in his support in the 200-member Assembly. If Pilot andhis group are disqualified after the top court considers the merits of his plea, thehalfway mark would come down and Gehlot could sail through. But with thePilot group voting against his Government, he would have it tough. Pilot couldactually get some advantage now as Gehlot has been dangling the Damocles’sword of disqualification over his rival’s loyalists, saying they would lose bycrossing over and gain privileges by staying with him. The breather means thatsome floaters could pitch in with Pilot. As of now, the Pilot camp has 19 MLAsand the BJP 72. Including smaller parties and Independent members, theOpposition has 97 at the moment. This is one of the reasons why Gehlot soughtan appointment with Governor Kalraj Mishra for a floor test as his supportersmarched to the Raj Bhavan soon after the “status quo” ruling. Although he hasherded his MLAs at Fairmont hotel, more delays will make that job difficult. Ifa floor test is held now and he wins, there cannot be fresh elections for the nextsix months. Meanwhile, the BJP will try to exasperate Gehlot as much as possi-ble, considering he had named Union Minister Gajendra Singh Shekhawat as thearchitect of toppling games and even written to Prime Minister Narendra Modiabout it. The Governor, while maintaining that he wasn’t against a floor test, saidhe needed some time to go over the rule book. The Supreme Court, too, has saidthe issues raised in the Speaker’s petition on the right to issue disqualificationnotices required “prolonged hearing” as it involved a “larger question” related tothe democracy. So clearly, the imbroglio cannot be resolved as fast as Gehlotwould have liked. Meanwhile, Bahujan Samaj Party (BSP) supremo Mayawati,who has accused Gehlot of poaching six of her MLAs, could be another hurdle.If she somehow manages to woo them back and decides to take the help of theBJP in doing so, Gehlot could have trouble. As for Pilot, he may not have theChief Minister’s chair still but given his solid Gujjar votebase, he could bargainhard for a leadership role. Jyotiraditya Scindia delivered 22 MLAs to the BJP inMadhya Pradesh and now, having got some positions for them in theGovernment, is attracting more MLAs to cross over. The BJP will spare no effortto bleed out the Congress.

FORMER Rajasthan DeputyChief Minister Sachin Pilot’srebellion against Rajasthan

Chief Minister Ashok Gehlot, hascrashlanded in the Rajasthan HighCourt and the Supreme Court ofIndia. Upon Mr. Pilot’s invitation inRajasthan and Rajasthan AssemblySpeaker C.P. Joshi’s appeal to theSupreme Court, today’s judges seemto have rushed in, where their prede-cessors have feared to tread. There isConstitutional history behind judi-cial reticence, which is normallyexpected, in matters involving theworking of Parliament and legisla-tures. This history bears someretelling.

A retelling of the pastCharles Bradlaugh was elected to

England’s Parliament in 1880. Hewas an atheist and refused to takeoath as a Member of Parliament inthe name of god. The format of theparliamentary oath, only providedfor swearing in in god’s name. TheSerjeant of Parliament, one Mr.Gossett, refused to seat Bradlaugh inParliament without the oath in thatform. Bradlaugh appealed to thecourts. The courts said they could donothing. In Bradlaugh vs Gossett(1884), a court held the ‘decision ofthe House of Commons in resolvingnot to allow an elected Member,Bradlaugh, to take the oath, and theactions of the Serjeant at Arms inpreventing Bradlaugh from enteringthe House, were subject to the solejurisdiction of the House’.

In India, one Keshav Singh wassentenced to a week’s imprisonmentin 1964 for breach of privilege of theUttar Pradesh Legislative Assembly.Subsequently, a petition filed by himwas listed before the LucknowBench of the Allahabad High Court.When the case was called out, thegovernment advocate was not pres-ent. The petition was admitted, andas the sentence was only one week,Singh was directed to be released onbail during the pendency of the case.The Assembly took umbrage to this.The order of stay passed by theBench of two judges was regardedas a breach of their privilege. Soonthereafter, the assembly made anorder directing the Marshal of theAssembly to arrest the two judgesand produce them before the Bar ofthe House. These judges approachedthe full Bench of the Allahabad HighCourt, which protected them from

arrest. According to ShantiBhushan’s recollections, JusticeNasirullah Beg, who had beenordered to be arrested and confinedby the marshals of the U.P.Legislative Assembly, was waitingwith a loaded gun, ready to shootdown the marshals and protect thehonour of the Allahabad High Court.

Hands-off approachAt this stage, the President of India

made a presidential reference to theSupreme Court on the relative pow-ers of legislative assemblies andconstitutional courts. The SupremeCourt, answering the reference, heldthat there is a broad separation ofessential powers of each organ of theState. However, the Court went on to

hold that a judge who entertains apetition challenging any order of thelegislature imposing any penalty onthe petitioner for its contempt“…does not commit contempt of thesaid legislature and the legislature isnot competent to initiate proceed-ings against that judge”.

Ever since, it has generally been a“hands-off” position as far as thecourts interfering in the workings oflegislative assemblies or Parliamentis concerned. The sole exception isunder the anti-defection law — aftera final order of disqualification hasbeen passed.

This is because, a Constitutionbench of the Supreme Court inKihoto Hollohan’s case in 1992 heldthat the Speaker acting in a disquali-fication matter acts as a tribunal andis subject to judicial review.However, the same judgment makesit clear that the Court will not inter-vene at an interim stage.

The majority very clearly held:“Having regard to the constitutionalscheme in the Tenth Schedule, judi-cial review should not cover anystage prior to the making of a deci-sion by the Speakers/Chairmen; andno quia timet actions are permissi-ble.” The same judgment furtherholds: “The Speakers/Chairmenhold a pivotal position in the schemeof Parliamentary democracy and areguardians of the rights and privi-leges of the House. They are expect-ed to and do take far reaching deci-sions in a Parliamentary democra-cy.”

When the Sachin Pilot episode isconsidered against this constitution-

al backdrop, it is clear that a mereissuance of a possible disqualifica-tion notice by the Speaker, has beencontested in constitutional courts,which have not rejected the chal-lenge at the threshold. Even in rou-tine petitions against notices of pro-posed administrative actions, courtsare reluctant to review at an interimstage. Almost invariably, the peti-tioner is told to answer the showcause notice and to challenge thefinal action only.

The Rajasthan High Court howev-er entertained a petition on behalf of19 MLAs who having ensconcedthemselves in a resort in a neigh-bouring State, proceeded to chal-lenge the Speaker’s authority to

decide, if they had committed an actof defection. Arguments at lengthwere addressed, almost as thoughthe limitations of the ConstitutionBench judgment in KihotoHollohan, had ceased to apply to thiscase. The Speaker chose to appearbefore the High Court and arguedthe merits of the matter, though hecould have at a preliminary stage,challenged the court’s jurisdiction tointervene at an interim stage. TheRajasthan High Court reserved itsjudgment, requested the Speaker todefer further proceedings and pro-ceeded to direct him to await judg-ment.

A co-equalThe High Court’s direction to the

Speaker, led to him moving theSupreme Court, questioning thecourt’s power to direct aConstitutional authority. The princi-ple of law being urged is thatConstitutional authorities cannotissue directions to each other. Theycan, at best, make a polite request.

In 1982, a Bench of the SupremeCourt, directed a single judge of theCalcutta High Court to urgently heara matter and proceed to judgment(A.K.M. Hassamanuzaman & Ors.v. Union Of India & Ors). The singlejudge in Calcutta, JusticeSabyasachi Mukherjee (later, ChiefJustice of India) proceeded to hearand decide the matter. He howeverrecorded in his judgment that theSupreme Court was only co-equalwith the High Court, as aConstitutional Court. Appellatepowers of the Supreme Court did notmake it a superior authority to which

the High Court was subordinate.Ever since, the Supreme Court hasbeen careful to couch its orders asrequests to any High Court, orConstitutional authority.

Constitutional courts have fol-lowed the same principle, inaddressing other Constitutionalauthorities. The Speaker of a Houseof legislature or Parliament, repre-sents that august body and is theguardian of its privileges. The Housecannot be ordered around in its inter-nal working, by any court, no matterhow high or supremely infallible itperceives itself to be. Unnecessaryconflict between organs of state maywell invite some Speaker, backed bya solid majority at State and Centre,to defy the courts, when it comes tothe internal working of the House ofParliament or legislature.

The last wordCourts are apolitical but keep get-

ting pulled into political thickets,especially in matters of mass defec-tions resulting in regime change.They must therefore be very charyof being turned into a third house ofParliament or legislature. The wallsof separation between constitutionalorgans, once breached, cannot bethen repaired against future intru-sions. Even under a sovereignConstitution, parliamentary and leg-islative supremacy in their spheresof functioning should be respected.The Supreme Court permitted theRajasthan High Court to proceed tojudgment on July 24, but directedthat its orders would not be imple-mented, as the Supreme Court itselfproposed to rule on the larger ques-tion of the jurisdiction of courts toentertain such pleas. The RajasthanHigh Court has thereafter decided toawait the Supreme Court judgmentand in the meanwhile injuncted theSpeaker from proceeding further.

JAMMU: Hailing the Lt. Governorfor his statement that J&K adminis-tration has no objection to therestoration of 4G connectivity inthe erstwhile State, Mr. Harsh DevSingh, Chairman-JKNPP & formerM inister today called upon theUnion Government to ensure highspeed mobile internet services inthe J&K UT at the earliest.

He said that Central governmenthad earlier taken the stand that theJ&K administration would take thecall over the issue. And after cate-goric unambiguous statement bythe Lt. Governor ruling out anyopposition to restoration of 4Gservices, the said facility needed tobe restored immediately. He wasaddressing a press conference inJammu today.

Speaking to media persons, Mr.Harsh Dev said that providing 2Gservices in J&K despite chargingfor 4G connectivity was an organ-ized loot which could not have beenpossible without the involvement ofbigwigs holding top positions in thegovernment. “The Lt. Governor has

A three-memberNCLAT bench dismissedthe plea filed by promoterVishal Vijay Kalantrichallenging the orderpassed by the Mumbaibench of NationalCompany Law Tribunal(NCLT), which hadapproved the Rs 650-croreresolution plan by AdaniPorts & Special EconomicZone (APSEZ) on March5.

The appellate tribunalrejected Kalantri's sub-missions contending thatNCLT has failed to con-sider objections raised byit over the resolution plansubmitted by APSEZ andrejected the settlementproposal submitted by his

company Balaji InfraProjects Ltd (BIPL).

"All objections raisedqua the action of the'Resolution Professional'during CorporateInsolvency ResolutionProcess (CIRP), approvalof 'Resolution Plan' of'APSEZ' by theCommittee of Creditorsand its subsequentapproval by theAdjudicating Authoritybeing unfounded are here-by repelled. "There is nomerit in this appeal andthe same is dismissed,"said the NCLAT benchheaded by ActingChairperson Justice B LBhat. The appellate tribu-nal also observed that all"possible endeavours aremade by the promoters tofrustrate the CIRP andthwart all attempts atresolution" of the corpo-rate insolvency andrevival of Dighi Port,thereby jeopardising thelegitimate interests of all

stakeholders and defeat-ing the object of the legis-lation. "At the very out-set, we may observe thatthe instant case is yetanother instance of thepromoters not letting thegoose escape from theirdragnet, though it nomore lays golden eggs,"said NCLAT. It furthersaid: "We say so as in theinstant case this is thethird attempt to stall theprocess, the earlier twoefforts on the part of pro-moters having fizzled out.The NCLAT also observedthat due procedures werefollowed while approvingAPSEZ's resolution plan.

"It is not disputed thatthe fair value and liquida-tion value was deter-mined by the dulyappointed registered val-uers and the approvedresolution plan was con-sidered with regard to itsviability and feasibility interms of the provisions ofthe I&B Code' and CIRP

Regulations."Nothing has been

brought to our notice todemonstrate that theapproved resolution planof APSEZ' contravenesany provisions of law, itsaid in its order passed onJuly 24.

The only issue raisedis that the settlementoffer emanating from thepromoter is better, asregards maximisation ofthe value of the assets ofthe company and sub-serves the interest of allstakeholders.

"This argument, in thenature of such settlementoffer being superior to theapproved Resolution Planof 'APSEZ' in the contextof a financial matrix, via-bility and feasibility, can-not be accepted for thesimple reason that thedecision regarding feasi-bility and viability of aResolution Plan qua theintended objective of I&BCode' is essentially a busi-

ness decision resting uponcommercial wisdom of theCoC and is not amenableto judicial review, NCLATsaid.

Dighi Port, which isbeing developed by BIPL,promoted by industrialistKalantri, in the Raigaddistrict of Maharashtra,owes over Rs 3,000 croreto the lenders and is goingthrough the corporateinsolvency resolutionprocess.

The promoter, throughthe holding companyBIPL, had offered Rs 680crore to the financial cred-itors besides Rs 50 croretowards the CIRP costsand payment to opera-tional creditors, whichwas rejected inSeptember 2019. The res-olution plan submitted by'APSEZ' was approved bythe 'Committee ofCreditors' with an over-whelming majority ofabove 99.68 per cent voteson September 19, 2019.

NEW DELHI: Officers atGAIL Ltd the state-ownedgas marketing and trans-mission company continueto oppose the government’splans to unbundle its gastransmission business andgas marketing businesses,and claim that the Centrehas not replied to orapproached the GAILOfficers Association (GOA)on their concerns regardingthe proposed unbundling.

GOA had, in 2018, writ-ten to the Prime Ministerand the PetroleumMinistry to express itsopposition to the move, cit-ing concerns about the via-bility of the two businessesas separate entities and theimpact of the move on thecompany’s plans to expandits pipeline network.Recently, PetroleumMinister DharmendraPradhan had reaffirmedthe Centre’s plans tounbundle GAIL’s gas mar-keting and transmission

businesses to make it morecompetitive and “increasecredibility.” One of themajor concerns which thegovernment hopes toaddress with the proposalis to assure natural gasconsumers of equal accessto GAIL’s 12,200-km gaspipeline network whichaccounts for around 70 percent of the gas pipeline net-work in India.

Representatives ofGOA said that there wasunderutilisation of GAIL’spipeline network and thatthey had received informa-tion, based on an RTI plea,from the Petroleum andNatural Gas RegulatoryBoard (PNGRB) that therehad been no complaintsalleging misuse of marketpower by GAIL made to theregulator. Capacity utilisa-tion for GAIL’s transmis-sion business stood ataround 52 per cent inFY19.

“Such a move may be

suitable when Indiabecomes a more mature gasmarket,” said a representa-tive of GOA, noting thatthe gas marketing andtransmission businesseswere able to add stability toGAIL’s overall financialhealth in scenarios wherethe profitability of the gasmarketing business may behit by fluctuations in inter-national natural gas prices.Another GAIL officer notedthat profits from the gasmarketing business hadhelped the company investin further building gasinfrastructure, and thatthere was concern aboutviability of these business-es as separate entities.“The businesses supple-ment and complementeach.

Thus far in the calendar year2020 (CY20), RIL’s market-caphas surged 49.8 per cent, or Rs4.77 trillion, from Rs 9.59 trillionon December 31, 2019. In compar-ison, the S&P BSE Sensex haslost 7.7 per cent so far in CY20with the combined market-cap oflisted companies slipping 5.3 percent during this period.

On December 31, 2014, RILaccounted for 2.9 per cent of thetotal BSE listed companies mar-ket-cap of Rs 98.36 trillion. Sincethen, the company’s market-capjumped nearly five-fold from Rs2.88 trillion.

Driven by continuedstrong performance, since end-2014, RIL is up 4.1 times versusthe Nifty’s modest rise of 30 percent, suggests a Nomura's July 16report. While the run has beenvery strong, and valuations aregetting rich, Nomura stillbelieves the outperformance maysustain. “The outlook for Jio hasimproved significantly with alarge stake sale and strategic tie-ups with Facebook and Google;accordingly, we raise ourEV/EBITDA multiple for Jio to11x (9x earlier).

I have to admit that I was notfollowing Sushant and his career.I don't follow anybody. But myfirst reaction was shock, sheerdisbelief. To me, he was (at thatpoint) just another star, verypromising and very talented. Iwould admit that at first, itlooked like an impulsive thingthat he might have done. Ithought maybe because everyoneis locked down, and this is a veryunusual situation, so maybe thatgot to him? I was not thinkingabout all the layers.

Sushant and I, we never real-ly crossed paths. But we werealways really close, you know.For example, when he was new,we had a common friend calledSandip Ssingh. He even came toone of my birthdays I think, my25th birthday, with Ankita. Iremember speaking to Ankitathat night and not him. Later, Iknew that he was doing 'Ram-Leela', and then he did not do it.I used to get all the updates.Kamal Jain, who was the produc-

er of 'Manikarnika', worked withSushant in the Dhoni film also.Every now and then, he used totalk about Sushant. When I waslearning horse riding, he used tosay that he organised the train-ing for Sushant also. He used towake up at 4am and finish thetraining at 6am. There are a lot ofthings involved with arelease of a film. On OTTplatforms and even onsatellite releases, there’sa transparency of money.In theatres, we don’tknow. You’re never sure,”he says.

Elaborating on hisviews, Basu adds thateveryone wants to releasetheir films “safely” butthat safe word “doesn’tcome” with theatres.

“When the theatreowners say that picture neitna business kiya hai, wehave to take their wordfor it,” he points.

However, the directornotes that there are bothadvantages and disadvan-tages in releasing a filmmeant for theatres on anOTT platform.

“When you make afilm for the theatre, thelanguage of cinema is dif-ferent.

The way you’re shoot-ing and telling the story,that changes. When youwrite for theatres, youwrite with an interval inmind.

So there’s a beginning,middle and end in thefirst part, and sameprocess is there for thesecond half.

If a filmmaker knowsbeforehand that his filmswill release on the web, hecan do a better job aboutit,” he explains, whileadding that the pros of adigital release include awider reach.

“All that an entertain-er in performing arts

wants is that their workreaches maximum people.That is only possibletoday with OTTs,” heshares.

Currently busy withthe post production ofLudo, which was slated torelease in April, the film-maker says he’s steppingout, but with caution.“We’ve to go out, we can’thelp it.

The work cannot bedone from home, we’ve togo to the studios. Butthankfully, most of thework was done because itwas supposed to come outearlier. I’m excited andlooking forward,” he ends.

Insuch a situation, thoughactor Harsh VarrdhanKapoor feels the “financialpinch” that cinemas mustbe facing, he insists that“slow and steady” is theway forward for any activ-ity involving a huge gath-ering. “It’s not cheap torun cinemas, so they’ve toopen up at some point withsafety measures in placeand with implementationof social distancing andregular sanitisation of thepremises. But I hope theyknow what they’re doingand that it’s well thoughtout. I hope that they’re notdesperate to start withouthaving mapped out a prop-er health protocol, whichthey should be capable ofexecuting,” the 29-year-oldsays. Kapoor also foreseessome major overhauls in

the coming year about thedealing between theatresand producers.

“This is a good opportu-nity in my opinion for pro-ducers to renegotiate profitsharing deals they havewith cinemas. For a verylong time, those ratioshave been unfair.

Another issue whichneeds to be addressed iswhen a film comes out andif it doesn’t do well in thefirst couple of shows, theexhibitors remove the filmto make way for a morepopular film. That's not theway to do it,” says theactor, who doesn’t hesitatein questioning the integrityof cinema chains.

The Mirzya (2016)actor asserts that it’s high

time that cinemas, espe-cially given the currentscenario, adopt a more flex-ible approach when itcomes to releasing differ-ent kinds of films. Citingthe example of his 2018film, Bhavesh JoshiSuperhero, which didn’tget enough screen and timeto play at theatres, Kapoorsays, “You cannot releaseevery film in the same way.A big film, for exampleSooryavanshi, will have tohave a different releasestrategy than a BhaveshJoshi. In the West, theyfirst release films in fivescreens and then after theresponse, they go wider.The whole way theexhibitors handle releaseswill have to be revisited.”

NEW DELHI: The gov-ernment on Monday toldthe Supreme Court thatKashmir Bar Associationpresident Mian AbdulQayoom's detention wouldnot be extended beyondAugust 6 even as hislawyers demanded hisimmediate release.

Solicitor General TusharMehta informed a Benchheaded by Justice SanjayKishan Kaul that Qayoom'scurrent detention under theJammu and Kashmir PublicSafety Act (PSA) was dueto expire on August 6 andthe government would notextend it.

Terming his detention asillegal, senior advocateDushyant Dave and advo-cate Vrinda Grover, repre-senting Qayoom, demandedhis immediate release, con-tending his fundamentalrights were being violated.

The top court askedMehta to seek instructionsas to if Qayoom could bereleased on bail before theexpiry of his detention peri-od on August 6 and postedit for further hearing on July29.

The Supreme Court had

on July 23 deferred thehearing on Qayoom's peti-tion against his detentionafter Mehta said the issuewas under consideration ofthe authorities concerned.

"Soon we will have areply from the concernedauthority," Mehta had toldthe Bench.

"If required the learnedSolicitor General cansecure instructions within24 hours and the matter belisted tomorrow. I am will-ing to argue on merits,"Dave had said, adding,"Habeas Corpus petitionscannot be delayed anddragged in this manner."

Qayoom, who suffersfrom many ailments, hasbeen under detention sinceAugust 5, 2019, following

nullification of Article 370of the Constitution.

On May 28, a divisionBench of the J&K HighCourt had dismissed hispetition against his deten-tion under the Public SafetyAct.

While upholding his pro-longed detention, the HighCourt had suggested that heshould submit a representa-tion declaring that he had"shunned" his ideology.Then the governmentauthorities would exercisetheir discretion "to take adecision" on any such rep-resentation, it had said.

On July 15, the SupremeCourt had sought to knowthe basis of Qayoom's con-tinued detention under theJ&K Public Safety Act.

"These are COVID19times...He is 73 years old.We want to know on whatbasis you would like todetain him in Delhi's Tihar(Jail)? Moreover, his deten-tion period per order isabout to expire," the Benchhad told Mehta.

As the Solicitor Generalsaid Qayoom's ideologywent against national inter-est, the Bench had said,"His ideology remains thesame.”

“All the earlier FIRsagainst Qayoom date as farback as 2010. In the currentscenario would you stilllike to keep this pending?"it had asked.

On June 26, the top courthad issued notice to theJ&K Administration onQayoom's petition chal-lenging the May 28 order ofthe J&K High Courtupholding his detentionunder the Public Safety Act,1978.

It had also directed theauthorities to provide himsummer clothing and dailyessentials in Tihar Jailwhere he is currentlylodged.

NEW DELHI: Fivesites across the countryare ready for the thirdand final phase ofhuman trials of theOxf or d-A str aZenecaCOVID-19 vaccine,Secretary ofDepartment ofBiotechnology (DBT)Renu Swarup said onMonday.

This is an essentialstep because it is neces-sary to have data withinthe country before thevaccine is administeredto Indians, Ms Swaruptold.

The Serum Instituteof India, the largest vac-cine maker in theworld, has been chosenby Oxford and its part-ner AstraZeneca tomanufacture the vac-cine once it is ready.Trials results for thefirst two phases werepublished earlier thismonth.

According to MsSwaroop, the DBT ispart of any COVID-19vaccine effort in India"... whether it is fund-ing, whether it is facili-tating the regulatoryclearances or whether itis giving them access todifferent networkswhich exist within thecountry".

"The DBT is now set-ting up Phase 3 clinicalsites. We have alreadystarted working onthem and five sites are

now ready to be avail-able for Phase 3 trials,"Ms Swarup told in atelephonic interview.

The Pune-based SIIhas also sought permis-sion from the DrugsController General ofIndia (DCGI) for con-ducting Phase 2 and 3of human clinical trialsof the potential vaccine.

It had said earlier itwill start manufactur-ing the vaccine evenbefore the final nod soit is ready with sizablevolumes once the vac-cine gets all permis-sions.

"DBT is closely work-ing with every manu-facturer and Phase 3trial of Serum (insti-tute) is importantbecause if the vaccine

JAMMU: In a significant decision withregard to management of COVID-19 patientsand in line with the earlier decision of reserv-ing four tertiary hospitals in Srinagar as refer-ral centres, the three tertiary hospitals inJammu city shall now also be only referralhospitals for COVID-19 admissions.

This was decided in a meeting chaired bythe Chief Secretary, B. V. R.Subrahmanyam, to review COVID-19 mit-igation measures in Jammu and Kashmir,here today.

With an aim to maintain availability ofbeds in tertiary hospitals across Jammu andKashmir for acute COVID-19 cases whorequire specialized treatment or intensivecare, it was decided in the meeting, on thelines of the decision declaring SKIMS,Srinagar, SKIMS, Medical College,Bemina, Chest Diseases Hospital andSMHS Hospital as referral only hospitalsfor COVID-19 patients, to institute a simi-lar mechanism in Jammu city and declareGMC, Jammu, CD Hospital and ASCOMS,Sidhra as referral only hospitals forCOVID-19 patients. These hospitals shallnow admit only such COVID-19 patientswho have been referred to by other hospi-tals of Jammu Division.
