Re: Proposed Rezoning Application Fairfax County Tax Map Reference: 33-2 ((2)) 10B (the "Subject Property") Applicant: Matan Glorus Road, LLC

Dear Ms. Strunk:

Please accept the following as a statement of justification in conjunction with a rezoning application on property located at 3720 Glorus Road and identified among the Fairfax County tax map records as 33-2 ((2)) 10B (the "Subject Property"). The Applicant proposes to rezone the Subject Property from the 1-3, WS and AN Districts to the 1-4, WS and AN Districts to permit the construction of a 78,976 square foot industrial building on the Subject Property.

The Subject Property is located in the northwest quadrant of the intersection of Glorus Road and Thompson Road in Chantilly. The Subject Property consists of approximately 5.18 acres (approximately 225,650 square feet) of vacant undeveloped land. The Subject Property is currently zoned to the 1-3 District, and is also located in the Water Supply Protection (WS) Overlay District (WS) and the Airport Noise Impact (AN) Overlay District. The Subject Property is bordered to the north and west by vacant undeveloped land, and to the east and south by industrial uses. The surrounding area is industrially zoned, and inclUdes properties zoned to the 1-3 and 1-5 Districts. Based on a review of available zoning records, the Subject Property is not subject to any prior land use approvals.

The Subject Property is located in the northern portion of Land Unit F-1 of the Dulles Suburban Center in Area III of the Fairfax County Comprehensive Plan (the "Plan"). While there are no site-specific recommendations for the Subject Property, the northern portion of Land Unit F-1 is planned for industrial uses at an intensity up to 0.35 FAR.

The Applicant's proposed development of a 78,976 square foot industrial building on the Subject Property is consistent with the recommendations of the Plan. The size of the proposed building will result in a 0.35 FAR that is consistent with the intensity recommendations of the Plan. The proposed 1-4 Zoning District is compatible with the zoning of the surrounding area which, as discussed above and as indicated on Sheet C-02 of the submitted Generalized

Development Plan, includes a number of properties zoned to higher intensity zoning districts including the 1-5 District. While the Applicant has not yet identified a tenant(s) for the proposed building, the Applicant is requesting flexibility to allow the permitted uses in the 1-4 District set forth in Section 5-402 of the Zoning Ordinance. These uses are consistent with the industrial use recommendations set forth in the Plan. Given the Subject Property's location in an area that is currently industrially zoned and predominantly developed with existing industrial uses, the proposed development is highly compatible with the surrounding area. The Applicant's proposal will advance County objectives by contributing to the County's supply of industrial space and meeting an increasing market demand for industrial users.

Access to the Subject Property will be provided via two curb cuts on Thompson Road, an unimproved gravel road that runs along the southern border of the Subject Property. As part of the proposed development, the Applicant will improve the section of Thompson Road along the frontage of the Subject Property by constructing a full street section including two travel lanes, curb and gutter on the north and south sides of the road, and a sidewalk and landscape buffer along the Subject Property's frontage. This new road will be a significant improvement over the existing conditions on Thompson Road.

In addition to compliance with the recommendations of the Plan discussed above, the Applicant's proposed rezoning of the Subject Property and construction of a 78,976 square foot industrial building is consistent with the development criteria listed in Appendix 9 of the Policy Plan as follows:

Site Design

The proposed development is characterized by high quality site design that is appropriate and well-suited for the proposed industrial use. The building will be oriented toward Thompson Road and located near the center of the Subject Property. The building will be surrounded by a drive aisle to provide adequate circulation for the large trucks that are anticipated to serve the industrial user(s). A truck loading area is provided at the rear of the building, shielded from view along Thompson Road, where loading and delivery activities will occur. Ample surface parking is provided for employees and customers, with landscaping along Thompson Road and the eastern and western property lines. The proposed building will include a high quality design, which will be generally compatible with the illustrative images included on the GDP.

Neighborhood Context

As discussed above, the proposed building and industrial use(s) therein are compatible with the industrial character and pattern of development in the surrounding area.

Environment

As indicated on the GDP, a small portion of the northwest corner of the Subject Property is located within a Resource Protection Area (RPA). The proposed development does not encroach into this RPA. Stormwater management and BMP facilities will be provided in

accordance with applicable requirements as detailed on the GDP. Site lighting will comply with Zoning Ordinance requirements.

Tree Preservation and Tree Coverage Requirements

In order to accommodate the proposed development and provide adequate circulation for trucks that will serve the anticipated industrial uses in the building, the Applicant is requesting a deviation from the tree preservation target set forth in the Fairfax County Public Facilities Manual (PFM). No disturbance is proposed in the RPA located on the northwest corner of the Subject Property. Additional plantings will be provided along the new street frontage and along the perimeter of the Subject Property.

Transportation

The proposed development will provide safe and adequate access to the existing road network. As discussed above, access to the building will be provided through two curb cuts on Thompson Road. Adequate circulation for trucks and other vehicles is provided on-site. The Applicant will construct significant road improvements to Thompson Road along the Subject Property's frontage, resulting in a benefit to the existing road network.

Public Facilities

The Subject Property has adequate access to public water and sewer. The proposed industrial development will not have an adverse impact on public facility systems such as schools, parks, libraries, police, fire and rescue, stormwater management or publicly owned community facilities. As detailed on the GDP, stormwater management and BMP facilities will be provided on-site.

Affordable Housing

As an industrial development, the affordable housing criteria listed in Appendix 9 is not applicable.

Heritage Resources

The Applicant is unaware of any heritage resources located on the Subject Property that are worthy of preservation.

Waivers and Modifications

To the best of the Applicant's knowledge, the proposed development conforms with all applicable ordinances, regulations and adopted standards, except for the following requested waivers and modifications:

• A waiver of the requirement to construct a vehicular travel lane, service drive or other access connection to and from adjacent properties as set forth Section 17-201(3) of the Zoning Ordinance. The Subject Property is surrounded by public right of way on the eastern, southern and western boundaries of the Subject Property. While the Subject Property abuts the adjacent parcel to the north, there is no existing or proposed vehicular travel lane abutting either side of the Subject Property. In addition, the adjacent property to the north is also vacant undeveloped land, a majority of which is located in an RPA. As such, there is a limited desire for travel between the proposed development on the Subject Property and the vacant adjacent parcel. A waiver of the requirement for an inter-parcel connection is therefore appropriate.

• A modification of the requirement to install signs prohibiting parking a minimum of fifty feet (50') apart along travel lanes. The Applicant will provide 'No Parking' signs a maximum of one hundred feet (100') apart, which will satisfy the intent of this requirement.

• A modification of Section 12-0508.3 of the Public Facilities Manual to allow a deviation from the tree preservation target. A modification is necessary in order to provide adequate drive aisles and loading areas for the trucks that are anticipated to serve the future industrial uses in the proposed building. The Applicant is maintaining all of the existing trees in the northwest corner of the Subject Property that are located in an RPA.

Lastly, to the best of the Applicant's knowledge, there are no known hazardous or toxic substances currently located on the Subject Property. To the extent any hazardous or toxic substances will be generated or stored in conjunction with future uses on the Subject Property, which have not yet been identified, said substances will be generated, utilized, stored and/or disposed of in accordance with all applicable regulations.

The Applicant's proposed rezoning of the Subject Property to allow the development of a new industrial building is consistent with the recommendations of the Plan, compatible with the surrounding area, and will help meet a growing demand for industrial space in Fairfax County. Given its location and the existing industrial character of the surrounding area, the future industrial uses on the property will have no adverse impacts on nearby properties. The proposal will provide a significant benefit in the form of road improvements to Thompson Road along the Subject Property's frontage.
