Traffic on the Jammu- Srinagar national highway was also restored on Monday a day after it was closed due to landslides at different places, they said. "A total of 29 people, including six women and 10 children, were rescued from various flood-hit areas of Kathua district during overnight operations," a police officer said. They were rescued from the Nagri, Chabbe Chak and Jakhole and Billawar areas of the district by police and state disaster response force personnel. Bovines are also being moved to safety, the officials said. Rescue and police teams had been deployed at various areas following the flash floods triggered by incessant rain in different rivers of Kathua district, they said. Mir was kidnapped by militants after they barged into his house in Sopore's Harwan area in the north Kashmir district on Saturday night, he said. The body had been sent for post-mortem, the official said. "The Commission directs… To place all those so-called 'classified papers' before the prime minister and the home minister, who are recommended to consider the fundamental right to know and demand of the people… To declassify (the records) either through an expert committee or by any other process to get the mystery probed and resolved," Information Commissioner Sridhar Acharyulu said. He also expressed surprise that there are no records with the Rajya Sabha pertaining to the Raj Narain Committee to look into Shastri's death initiated during the Janata Party government in late seventies. "Parliament is known for meticulous maintenance of documents. Every word uttered in Parliament is recorded and kept in public domain, a humongous task the office is perfectly performing. Then how such a significant record disappeared," he said. Acharyulu recommended that the "constitutional authorities" in Parliament to probe or make efforts to secure the committee records. Samoon said J&K BovineBreeding (Regulation ofProduction & Sale ofBovine Semen, ArtificialInsemination Servicesand Other BovineUpgradation Services) Act2018 aims to increase theannual milk production inJammu and Kashmir from2756 thousand metrictonnes to 4076 thousandmetric tonnes. The Principal Secretarystressed the officers ofthe department includingSKAUST to takecorrective measures for

the preservation ofCrossbred varieties ofbovines including cowsand buffaloes as suchanimals give a high yieldof milk. Samoon saidsuch steps will also openup new avenues ofemployment for youth ofJammu and Kashmir.The meeting was

informed that the state ofJammu and Kashmir hasa bovine population of1800000 which includes864000 Crossbred and936000 nondescriptvarieties with averagelactation yield of fivelitres per day. While theaverage yield ofnondescript bovine is twolitres per day, the figurestands at 8.25 litres perday for Crossbredvarieties. Officials said the policyaims at increasing milkyield of nondescriptvarieties from two to fivelitres by 2023 and ofCrossbred/Exotic from8.25 to 10 litres. With thisintervention, annual milk

yield by nondescriptcattle will go up to 1432thousand metric tonnesby 2023 and byExotic/Crossbredvarieties to 2644thousand metric tonnesSamoon directed theconcerned to finalise thepolicy at the earliest byincorporating rules andregulations for Fish withlatest data on livestockstatistics and health ofthe overall livestocksector in Jammu andKashmir. Commissions ofinquiry arepotentially powerful

instruments to fixresponsibility on publicfunctionaries, buteverything possible hasbeen done to blunt thisinstrument, says DrMadhav Godbole, retiredUnion home secretary.Democracy and vibrantpublic life need thesupport of a number ofinstitutions such asParliament, the media,the judiciary and otherspecially authorisedConstitutional andstatutory bodies.One of them is themechanism of thecommission of inquiryappointed to look intodefinite matters of publicimportance. But itbecomes frustrating ifthese institutions startfunctioning at cross-purposes, as has oftenbeen the case with thecommissions of inquiryand the judiciary.The latest example of thisis of the judicialcommission of inquiryinto the land deals ofRobert Vadra, Congressleader Sonia Gandhi'sson-in-law.The report submitted byJustice S N Dhingra tothe Haryana governmentin August 2016 has beenlanguishing since then asthe state government hadgiven an undertaking inthe high court that thereport of the commissionwould not be publishedtill the petitionchallenging the

appointment of thecommission filed byformer state chiefminister BhupendraSingh Hooda is decidedby the court.Reportedly, there havebeen 26 hearings in thehigh court so far. InMarch 2018, the SupremeCourt had urged the highcourt to decide thematter within twomonths. We are now inSeptember 2018 and thecase is still pending. (TheIndian Express,September 5, 2018)Several questions arisefrom the plain reading ofthe news report. Knowinghow matters can bedragged in the courts,should the stategovernment have givenan undertaking that thereport of the commissionwill not be released tillthe matter is decided bythe court?Why did the stategovernment not requestthe court to permit it torelease the reportpending the court'sdecision in the matter?Why could the high courtitself not have taken upsuo motu the question ofreleasing the report,pending the decision inthe case, since theCommission of InquiryAct itself lays down thatthe report of thecommission is to bemade public within sixmonths of its submission.This is not the first timethat judicial proceedingshave led to frustratingthe very purpose ofsetting up of acommission of inquiry. I

had dealt with theseissues at length in mybook, The Judiciary andGovernance in India(2008).At the outset, thedistinctive features of aninquiry by a commissionmust be noted. In such aninquiry, there is noplaintiff or prosecutorand there is no defendantor accused.The commission is notexpected to act as ajudge, but has to makeevery effort to arrive atthe truth. Strict rules ofevidence do not applyand the commission doesnot pass any order whichis binding on thegovernment.It merely makesrecommendations basedon its findings. It is left tothe government to decidewhether to accept therecommendations or tooverlook them altogether.The main idea is to bringall facts to the notice ofthe people at large inopen hearings, unless thematter pertains to Statesecrets or are such thatthe commission feels thatthey may not be madepublic till they are fullyinquired into, as was thecase in the inquiryregarding theassassination of IndiraGandhi.Looking at the above, it isdifficult to understandwhy anyone should objectto an inquiry by acommission. And even ifsuch an objection israised, the courts mustlay down the strictestpossible requirementsbefore entertaining such

pleas.The most scandalouscase of challenge to theappointment of acommission of inquirywas by Indira Gandhi tothe appointment of theJustice J C ShahCommission to look intothe excesses committedduring theEmergency,/strong>.She not only refused totake an oath and deposebefore the commission,but went to the extent ofcasting aspersions onJustice Shah, a formerChief Justice of India.When she was proceededagainst in a criminalprosecution, as ArunShourie had written inhis book, Institutions inthe Janata Phase (1980),the Delhi high court,going out of its way,knocked the bottom outof the Commissions ofInquiry Act andeffectively provided ablanket cover formalfeasance and abuse of

power.In another casepertaining to thecommission of inquiryappointed by governmentof Maharashtra, on theEnron power project,under the chairmanshipof a retired judge of theSupreme Court, theobjection to the settingup of the commissionwas raised by the centralgovernment and SharadPawar, former chiefminister of Maharashtra,who had approved theproject.In this case, the SupremeCourt gave ex parte stay,without giving a hearingto the state government.The stay continued forsuch a long time that thestate government, whichhad reluctantly appointedthe commission underintense public pressureconveniently decided towind up the commission!The issues, which wereconsidered to be of publicimportance according to

the state government'sown notification, ceasedto be so due to theinjudicious interventionof the apex court.Another striking case isthat of the LiberhanCommission of inquiry inrespect of the BabriMasjid demolition. TheGovernment of Indiaappointed thecommission within twoweeks of the demolitionof the masjid inDecember 1992.It took 17 years for thecommission to submit itsreport. This was thelongest time ever takenby a commission ofinquiry so far. But, asubstantial part of thedelays was accounted forby the stays granted bythe Allahabad and Delhihigh courts from time totime, when approachedby concerned parties.I have been advocatingover the years that theSupreme Court must laydown a guideline that any

stay granted to theproceedings of acommission of inquiryshould not be operativefor more than threemonths and shouldautomatically lapse at theend of such a period.Unfortunately, the apexcourt has not takencognisance of this majorhurdle in the working ofthe commissions ofinquiry.Successive commissionsof inquiry havehighlighted yet anotherhandicap which they hadencountered and this wasof the lack of contempt ofcourt powers.As a result, thecommissions had becomeweak and ineffective.Almost all suchcommissions are judicialcommissions appointedunder retired high courtand Supreme Courtjudges.It was thereforedisappointing to see thatthe national commissionto review the working ofthe Constitution took avery restrictive view andrecommended that noother court, tribunal orauthority should have, orbe conferred with, thepower to punish forcontempt of itself.I am of the view that itwill be in the largerpublic interest if powersunder the contempt ofcourts act are given tothe commissions of

inquiry.It is unfortunate thatmost of the institutions ofoversight of India's robustdemocracy have fallen indisuse. The mostprominent among theseare Parliament and statelegislatures. A number ofstatutory bodies such asLokayuktas have becomepaper tigers.Commissions of inquiryare potentially powerfulinstruments to fixresponsibility on publicfunctionaries buteverything possible hasbeen done to blunt thisinstrument as well.Successive governmentsat the Centre have failedto take any remedialaction. Though over fouryears have elapsed sinceassuming power, theModi government's sloganof 'less government andmore governance' hasremained on paper as theCommission of InquiryAct has not beenamended in the light ofexperience so far.Unlike in most otherdemocracies, thejudiciary in India holdsthe reins of governancein the country. internal election means thathe can expect to head thegovernment till the next election isdue in late 2021, when he wouldhave been the country's longestserving prime minister.In achieving his victory, Abe hasovercome powerful headwinds,which include domestic politicalscandals, a persistently sluggisheconomy and an unpredictableTrump in the White House.Japan is an important economic andpolitical partner of India. Its low-interest loans are invaluable forIndia's infrastructure. They arehelping connectivity projects acrossthe country and their assistance inurban development schemes istransforming the landscape in Delhi,Mumbai and Chennai. New Delhiand Tokyo have a robustrelationship across the Indo-Pacificand are collaborating on the Asia-Africa Growth Corridor to provide ahigh-quality alternative to the Beltand Road Initiative in the IndianOcean Region. Abe's strategiesWhen Abe took office for the secondtime in 2012, the stagnant economywas Japan's only major problem. Hehad declared that he had threearrows in his arsenal to fix it -monetary easing, fiscal stimulusand structural reforms.Since then, in the face of risingproblems with the US and China,Abe has achieved a great deal, buthe needs to do much, much more toensure that Japan can meet theeconomic and political challenges itconfronts.His expansionary economic strategyhas brought back a measure ofgrowth in the otherwise stagnantJapanese economy.It may not be much by globalstandards, but it is the strongestsince the 1990s.He has used his office to pushJapan's security perimeter beyondthe bounds to which it is confined bythe constitution and he has initiatedstructural reforms aimed at raising

the retirement age, scrapping taxrules that encourage women to keepaway from the workforce and makethe wealthy pay for their own healthcare.The arrival of Donald Trump in theWhite House added a headache thatneed not have been there. Abe hasgone out of his way to work withTrump, but the latter has not quitereciprocated.In his dealings with North Korea,Trump has often ignored Japaneseinterests.The US is extremely important toJapan as a trade partner andsecurity provider. But the US haschallenged Japan in both theseareas.Trump famously walked away fromthe patiently negotiated Trans-Pacific Partnership (TPP), whichwould have been greatly beneficialto Japan. Now, one of the short-termrisks to the Japanese economy is thetariffs Trump has threatened to puton imported cars and car parts.Japan may have to makeconcessions to the US on this scoreand we may see some action whenTrump meets Abe at the sidelines ofthe UNGA in New York this week.Looking for solutionsAbe needs some skillful footwork indealing with his problems. On trade,he has joined 11 nations of thePacific littoral to give life to analternative to the TPP and, at thesame time, has reached out to theEU to create one of the world'slargest liberalised trade zones. TheTrump factor has encouraged Abe to

reach out to both China and Russia.His October visit to China isexpected to normalise ties betweenthe two East Asian neighbours aftera decade of tension.Trump may have dampened theJapan-China tensions, but they arenot going to go away so easily. But ifAbe is able to successfully fire histhird arrow to restructure theJapanese economy, it can have atransformative impact not only inJapan, but the rest of Asia as well.Among his most difficult problemshe still confronts are to find ways ofdealing with Japan's shrinkingworkforce. The Japanese arenotoriously allergic to immigrantsand at the same time, they arereluctant to allow women into theirworkforce. Yet, with its shrinkingpopulation, Japan desperately needsadditional hands to power itseconomy.A pledge to the Army Another significant domestic issueis his pledge to revise the Japaneseconstitution to make it clear thatJapan's military is legal. Currently,Article 9 of the Constitution barsJapan from maintaining "land, seaand air forces, as well as other warpotential", though the countrymaintains de facto 'Self DefenceForces'.Neither of these two problems willbe easy to resolve since thereremains significant politicalresistance to change, especially thatin relation to the pacifistConstitution.

Thefreedom to profess, propagate andpractice the religion of one's choice ismainly enjoyed by men with womenhaving to meekly follow religiousdoctrines formulated and practiced bymen, forcing gender iniquity onwomen and feeding an industry builton credulity.And so we have:o Bishop Franco Mullakal's resignationas the Bishop of Jalandhar has beenaccepted by the Pope in Rome. He isthe first Indian bishop to face thisignominy in the history of the Catholicchurch. He is facing the charge ofraping a nun 13 times between 2014and 2016. The victim turned oppressorbecause this nun's congregationcirculated her photograph alleging shewas seen at public functions in thecompany of the allegedly sex-taintedbishop. It took five of this nun'sconfreres to stage a silentdemonstration in her support beforethe Kerala high court to build publicsupport for the beleaguered nun.o Asaram Bapu, whose real name mayhave been Asumal SirumalaniHarpalani, a bogus Godman who setup 400 ashrams since the 1970s bothwithin India and abroad was popularamong politicians and common peoplefor his religious discourses. In 2018,Asaram was sentenced to jail for lifefor raping a minor girl in Jodhpur.o Gurmeet Ram Rahim Singh Insan,born 20 years after Asaram Bapu'sbirth, was the head of the social groupDera Sacha Sauda (DSS) since 1990.He was listed as being among the 100most powerful Indians of 2015 by theIndian Express. Like Asaram Bapu, hetoo was convicted of rape by a special

CBI court on August 25, 2017 which ledto 38 of his disciples dying whileunleashing mayhem and 300 othersinjured. On 28 August 2017, RamRahim was sentenced to 20 years injail for rape. He has been charged withmurder and forced castrations.o Dhananjay Bhave, the priest fromthe Mangueshi temple at Ponda in Goawhose anticipatory bail plea wasrejected when he went underground toescape arrest after he allegedlymolested two young girls who hadcome to seek the blessings of the deity.The trial has yet to commence afterframing of charges. The GoudSaraswati Brahmins who performedpujas at the Mangueshi temple in1543, on behalf of their family deity,Lord Manguesh, an incarnation ofLord Shiva, would have beenthunderstruck at the antics of Bhavewho has allegedly defiled the templeand its deity.The list is endless which leaves us toinfer that Indians seek spirituality inGod's representatives, not realisingthat nirvana can be achieved throughone's own efforts and not through theabominable wisdom of a few priestswho act as self-proclaimedspokesmen for God. As a result, Indiaemerges as the fourth most intolerantnation in the world, according toresearch done by the Pew ResearchCentre, a non-partisan organisationwhich listed India after Syria, Nigeriaand Iraq among 198 intolerant nationsthey have studied in 2015. TheThomson-Reuters Foundation rankedIndia in 2018 as being the mostdangerous nation for women.So, Articles 25 to 28 which have beeninterpreted as ensuring religiousfreedom within India fuels an industrywith the likes of Bishop FrancoMullakal, Asaram Bapu, Guru Ram-Rahim and Dhananjay Bhave. It istheir variants who lead the countryinto riots such as the 1984 anti-Sikhriots in Delhi, the 1990 anti-Hinduriots in Kashmir, the 2002 Gujaratriots and the 2008 anti-Christian riotswhich destroyed an entire community.Today, these leaders decide nationalpolicies and incite riots throughgodmen while professing the doctrineof sarva dharma sambhava or theIndian variant of secularism whichstill discriminates against women.

It is true that canon law hasnot envisaged the extraordinarypredicament of a nun accusing abishop of raping her. That is thedomain of the Indian Penal Code whichwas enacted in 1860.What this ravaged nun has notrealised is that man created God in hisown image to formulate religiousdoctrines with man as the centre ofthe universe created by a male-God tosubjugate and dominate women for alleternity. recruitment,” the CriminalInvestigation Department(CID) officer said.The devices were hidden inthe “sole of shoes andslippers” of candidates, hesaid.“We have also seized microearpieces from manycandidates. These devices, ifconnected to a mobile phone,could be operated byaccomplices outside thepremises.”There could be a racketbehind the illegal practice,the senior officer said.“A racket could be runningthe operation from outside.The CID is making efforts toarrest all those involved inthe racket,” he added.

television, radio and electronicand print media against moblynching and cow vigilantism.The Centre had earlierinformed the bench that inpursuance of the apex courtverdict, an empowered Groupof Ministers has been set up to

Embattled liquor baronVijay Mallya told a specialcourt in Mumbai Mondaythat the EnforcementDirectorate (ED) “resisted”his efforts to settle hisloans with public sectorbanks.Mallya, who is currently inthe United Kingdom, hasbeen charged by the ED ofdefaulting on bank loans tothe tune of Rs 9,000 crore.Mallya, through hiscounsel, was replying inthe PMLA court of Judge MS Azmi to an EDapplication seeking that hebe declared a fugitiveunder the FugitiveEconomic Offenders Act.In his reply, Mallya statedthat “despite continuingefforts over the last two tothree years, when effortshave been made to repaythe public sector banks,instead of taking steps tofacilitate the process ofrepayment to banks, theED has, at every step,resisted this effort”.Mallya’s reply also statedthat the ED’s application,in its endeavour toconfiscate assets, is onewhich is contrary to publicand national interest.

Objecting to the ED plea todeclare him a fugitive,Mallya mentioned that hehas been cooperating withthe authorities in the UK inextradition proceedingsand has submitted himselfto the jurisdiction andprocess of the UK courts- aprocess invoked at thebehest of the government ofIndia.Mallya’s reply contendedthat, in thesecircumstances, it was falseto contend that he “refusesto return to India”, addingthat “adherence to the lawof the land cannot anddoesn’t render one asfugitive economicoffender”.The arguments in theextradition proceedings inUK have concluded and thematters are to be listed onDecember 10 forjudgement, the reply read.Mallya’s reply sought thatpresent proceedings oughtto be stayed or adjournedsine die till the judgementis delivered in theextradition proceedings (inthe UK).Meanwhile, the ED Mondayfiled its say in theintervention applicationmoved by some partiesseeking to impleadthemselves in the matter.The PMLA court on Mondayset September 28 as thenext date for hearing on theintervention application.The main application (todeclare Mallya fugitive) will

be heard after its order onthe intervention plea, thejudge said.The court had earlierissued non-bailablewarrants against thebusinessman in two casesfiled by the ED.Mallya, his nowdefunctventure Kingfisher AirlinesLimited and others availedloans from various banksand the outstandingamount, including interest,now stands at Rs 9,990.07crore.Both the ED and theCentral Bureau ofInvestigation (CBI) havefiled cases for alleged loandefault against him.The Fugitive EconomicOffenders Act hasprovisions for specialcourts under thePrevention of MoneyLaundering Act, 2002(PMLA) to declare a personas a fugitive economicoffender and orderimmediate confiscation ofassets.The law lays down that afugitive economic offenderis a person against whoman arrest warrant has beenissued in respect of ascheduled offence and whohas left India so as to avoidcriminal prosecution, orbeing abroad, refuses toreturn to India to facecriminal prosecution.Cases of fraud, chequedishonour or loan default ofover Rs 100 crore comeunder the ambit of this law.

It had reservedthe verdict on the issue onAugust 28.Ruling out any judiciallegislation to checkcriminals enteringParliament and statelegislatures, the Benchhad last month wonderedif it can ask the Election

Commission not to allotsymbols to recognisedpolitical parties’candidates facing seriouscriminal charges, even asthe NDA governmentvehemently opposed it.The Bench had said itwould consider directingthe Election Commissionto ask political parties toget their membersdisclose criminal casesagainst them to enablevoters to know about“alleged crooks”attempting to enter thelegislature.Attorney General KKVenugopal had told theBench that Article 102provided for Parliament tomake law on the issue andhence the top courtshould leave it to thewisdom of theparliamentarians. He hadreminded the Bench of theconcept of separation ofpowers. ”Everybodyunderstands that. Wecannot direct Parliamentto make a law. Thequestion is what we cando to stem the rot,” theBench had commented.But Venugopal had said

district Monday.A group of believers alsoprotested in front of theparish hall, demandingwithdrawal of actionagainst the nun.Speaking to reporters,Sister Lucy Kalapura saidthat she was happy thatthe church lifted the banon her. “It is a victory ofjustice”, she added.The nuns had protestedfor 13 days, demanding thearrest of the bishop whowas accused of repeatedlyraping a nun.Mulakkal, who wassubsequently arrested onSaturday after three daysof intense grilling byKerala Police, is now in 12day judicial custody.
