It has also told the people that the Government cannot ask a court to expedite proceedings of any particular case. No administrative action can be taken on a grievance for which the court has already been approached, the department of justice in the law ministry has said. "…No action can be taken by the Government where the petitioner is aggrieved of the fact that there has been inordinate delay in disposal of the case," according to the 'general guidance' issued by the department of justice for 'aggrieved grievance holders'. The document states that a grievance regarding a complaint against a judge can be taken up for inquiry by the concerned high court or the Supreme Court as per the in-house procedure adopted by them. "There is no role of government in disposal of such grievances," the guideline states. A Met department spokesperson said on Tuesday that a fresh WD, which originated in the Arabian Sea, had entered the region. But, he said, it didn't exactly hit the state, adding it however, resulted in cloudy skies. "Light rain or snow could occur at isolated places in the Valley in the evening on Tuesday," he said. However, he said from Wednesday onwards the sky will be clear, which could result in further dip in the night temperature. Leh and border town of Kargil were the only two places in the region which witnessed improvement in the night temperature due to cloudy skies though they were still below freezing point. Even though there was an improvement of about a degree in the night temperature from yesterday at Leh in Ladakh region, it was still the coldest place in the region at minus 7.3 degree. The mercury at the border town of Kargil witnessed an improvement of 4 degree from yesterday and settled at minus 6.4 degree Celsius, still the second coldest place in the region. They also said that the revenue position after the introduction of GST was comfortable. The government is also working on making the new tax system more user-friendly and has lined up several steps to hand-hold taxpayers. Under the GST system, returns filed under forms such as GSTR-1 and 2 have to be matched with the GSTR-3 to ensure that the claims made by taxpayers are correct. The government has extended the deadline for filing returns several times as taxpayers have complained about the technical glitches that had affected the IT backbone - the Goods & Services Tax Network (GSTN). Since then, the GST Council has undertaken several measures to ensure stability of the system and has asked Infosys, the technology provider, to fix the glitches. The numbers of returns have also steadily increased and the government's promise of hand-holding taxpayers is also expected to bolster confidence among traders and the business community. Earlier this month, the GST Council unveiled a series of steps to help calm jittery businesses and undertook sharp cuts in rates of nearly 200 items to help consumers. The worries over revenues have also receded with receipts under GST registering steady gains. In October, GST receipts, including cess, totalled Rs 95,131 crore. The glitches in the IT system and uncertainty linked to the tax reform measure had triggered concerns over revenues. The government has maintained that it will take a few months for the system to stabilise. According to a source, the Ministry has started working on the proposal after the success of the pilot project of ITBP where for the first time women soldiers, known as "Heem Veearngana" have been deputed to guard the Indo-China border. Close to 800 women constables have been deployed at the height of 8,000 feet to 15,000 feet manning Border out Posts (BoP) in Ladakh frontier of Jammu and Kashmir. A few have been posted at other locations in Himachal Pradesh, Sikkim and Arunachal Pradesh including the 'Mana pass' border post, (the last village on the Indian side in Uttarakhand) along with the treacherous Sion-India border. These BoP are being guarded by women only. Talking to newsmen here, ISRO Chairman A S Kiran Kumar said that the launch, carrying 30 satellites, including the lead spacecraft, Cartosat will take place either during the last week of December or early January. ISRO suffered a setback in its workhorse launcher PSLV when the previous launch PSLV C39 mission was unsuccessful on August 31 due to failure of the opening up of the heat shield. The launcher was carrying IRNSS 1H payload that had been built in collaboration with private sector. Dr Kiran Kumar indicated that ISRO would push far atleast one launch a month during 2018. Referring to Chandrayan-2 Mission, he said that the work on realising the satellite was in full swing. The launch is likely to take place by the middle of next year. The practice of setting up of winter secretariat started in 1990's at the civil secretariat Srinagar where the ministers would remain available for the redress of public grievances on rotation basis. However, for the third consecutive year, the PDP- BJP government did not establish winter secretariat in Kashmir. As the ministers would not be available at the civil secretariat Srinagar for redress of public issues, the government has directed officers not to leave the station "without prior" permission from the divisional commissioner, Kashmir. The district development commissioners and heads of departments have been directed to seek proper permission before proceeding to Jammu to attend any function or meeting. These officers have been told to attend meetings being held in Jammu through video conferencing instead going to winter capital. "These officials have been directed don't come unnecessarily to Jammu instead attend the meetings through video conference," an official posted at the Divisional Commissioner, Kashmir officer, said. Observing that the time has come for the nation to be apprised of facts in this regard, he said one should ask at whose behest the loans, which have turned NPAs were disbursed between 2008 and 2014 by public sector banks. "The public needs to ask the rumour mongers at whose behest or under whose pressure were such loans disbursed. They should also be asked that when these debtors delayed in repayment of their loans and interest thereon to Public Sector Banks, what decision was taken by the then Government," the finance minister said. No loan waiver for capitalists: FMnorms to keep defaulters as non-NPA account holders.The asset quality review (AQR) carried out for clean and fullyprovisioned balance-sheets in 2015 revealed high NPA, thefinance minister said.As a result, he said, loans of about Rs 4,54,466 crore, whichwere actually fit to be NPA and were under the carpet, wererecognised after intensive scrutiny under AQR."Government has not waived any loans of big NPA defaulters…," he said, adding under the new Insolvency andBankruptcy Codet, cases have been instituted in the NationalCompany Law Tribunal (NCLT) for timebound recovery from12 largest defaulters.These 12 defaulters account for non-performing assetstotalling Rs 1.75 lakh crore.Cases for the recovery of NPA dues from the assets of thesebig defaulters are under way at various stages.Jaitley further said with the object of increase credit off-takeand creation of jobs, government has taken "the big decision"of capitalising state-owned banks.Under this, with maximum allotment in the current year,capital increase of Rs 2.11 lakh crore would be effected withintwo financial years."Through capital infusion, banks weakened by NPAs would

become strong and become capable of raising adequate capitalfrom the market," Jaitley said.For receiving the capital, banks will have to carry out severalreforms so that such situations do not recur, he added.Jaitley further said through strong steps taken over the lastthree years, "not only have the problems received as legacy"been addressed but reforms for rebuilding the strength ofpublic sector banks have been boosted.The minister said that the process of creation of strong andlarge banks began with the integration of State Bank of India,and the recapitalisation announced will bolster this process."While honest businesspersons will be able to access loansfrom strong and reformed banks, strict and clear law and theall-round clean-up initiated by the Government would resultin a clean system in the country," Jaitley added. Directions were issued to all the concernedOfficers to ensure deployment of additional sanitation stafffor improving the sanitation of different areas especially inthe areas around the mosques and on the roads leading tothem. The Executive Engineer (Electrical) of JMC was alsodirected to ensure that all the Street lights are madefunctional and also undertake repair of defective lights wellbefore Eid-i-Milad-ul-Nabi and special attention be given tothe lights installed on the roads leading to the mosques.Besides above, the AEE (Transport) was also directed toensure proper lifting of garbage and also to avoidaccumulation of garbage. Post the terrorist attack in Zakhura area of Srinagaron November 17, the Islamic State, through itsnew platform 'Amaq', has claimed its first kill in

J&K. The ISI supported Tehreek-ul-Mujahideen(affiliated to the Salafi Ahle-Hadith) simultaneouslymade a counter-claim. Government says it has takennote of the Islamic State claim and appropriate courseof action would be adopted after examination.In the incident on November 17, three terrorists in a caropened fire on a police team at Zakura crossing on theSrinagar-Ganderbal road, killing Sub-Inspector ImranTak and injuring another special police officer (SPO).The retaliatory action left a most wanted local terroristdead, whose body was wrapped in ISIS flag duringfuneral procession. The Srinagar-based Army CorpsCommander and DGP J&K addressed a joint pressconference (first ever - to convey political message?)stating there is no evidence of presence of ISIS in J&K.The perception is that the security forces having killed190 terrorist this year (including 110 foreign terrorists)may have led to the googly of the ISIS claim. At thesame time, there are rumours of a pan-Islamist grouphaving entered the Valley from the general area ofGulmarg few days back, reportedly admittedunofficially by an intelligence official.It may be recalled that on May 12, a video by ZakirMusa Bhat went viral rejecting all kinds of nationalismand condemning politicians of all hues includingHurriyat; calling for an Islamic Caliphate - beingcovertly propagated in few radicalized districts of theValley past six months but not talked about in hushedtones. ISIS flags have been periodically unfurled in theValley past year and half plus especially atop mosquesin Srinagar after Friday prayers.In the beginning these were perhaps bravado ofradicalized youth influenced by propaganda photos ofarmed youth in military-like fatigue bearing ISIS flags,not different from a radical mullah distributing ISIS T-shirts in south India some months back. But then theburgeoning population of the youth in the Valley,unemployment, and the reward of joining the terroristorganizations are cumulatively attracting more youthinto militancy - something that the Army too is worriedabout. So, has the Islamic State entered the Valley? Theanswer may be 'yes' and 'no'.Who is the Islamic State? Called Al Qaeda in Iraq(AQI) till early 2014, onslaught of the Islamic State (IS)brigades into Iraq starting in June 2014 was part of acarefully planned military-intelligence operationsupported covertly by the US-NATO. The US has beenpast master in irregular warfare.Way back, Ronald Reagan was entertaining theIslamists in White House to fight the Soviets. PaulJoseph Watson, wrote in December 2011 that just as Al-Qaeda terrorists were used to oust Gaddafi, hundreds ofLibyan rebels with Al Qaeda willing members werebeing airlifted into Syria to aid opposition in carryingout attacks against government forces. There was talkof US, Jordan and Turkish Special Forces operatinginside Syria. In October 2012, Mitt Romney, USPresidential candidate vowed to arm Al Qaeda in Syria.While Obama contemplated bombing Syria, USbloggers accused US would be providing air support toAl Qaeda. Later, in her book 'Hard Choices', HillaryClinton wrote she would have armed "moderate"Syrian rebels much earlier.In March 2014, Iraqi scholars spoke of CIA pumpingin money for terrorism in Iraq. US Senators like JohnMcCain were openly hobnobbing with Al-Qaeda andISIS leaders in the making months before the ISIS wasunleashed on Iraq. There are enough indications theWest was supplying the ISIS arms and ammunitionand providing air support, while bombing the

moderate factions and the Syrian forces. In August2013, UK's Telegraph News Service reported SaudiArabia had secretly offered Russia a sweeping deal tocontrol the global oil market and safeguard Russia'sgas contracts, if Kremlin backs away from the Assadregime in Syria, an offer Putin turned down. Up tonow the belief was that the US, UK, NATO withbacking of Saudi Arabia were instrumental in trainingthe ISIS, but now evidence has emerged that Pakistantoo had a hand in this; according to a Russian middle-east expert says that ISIS cadres were also trained bythe ISI in Pakistan.Canadian scholar Michel Chossudovsky is moreexplicit about Pakistani involvement in writing that therise of the Islamic State was with active support ofBritain's MI6, Israel's Mossad, Pakistan's Inter-Services Intelligence (ISI) and Saudi Arabia's GeneralIntelligence Presidency (GIP), Ri'?sat Al-Istikhb?r?tAl-'?mah It is also known that the Tehrik-e-TalibanPakistan (TTP) had established presence in Iraq-Syriato fight along the ISIS and Al Qaeda and the latter twoalso had collaborated to some extent.Significantly, Muhammad Amir Rana wrote in theDawn on July 03, 2014, "ISIS could play a verydangerous, inspirational role in Pakistan, where morethan 200 religious organizations are operating on thenational and regional level. These organizationspursue multiple agendas such as transformation ofsociety according to their ideologies, the enforcementof Shariah law, establishment of Khilafah (caliphate)system, fulfillment of their sectarian objectives andachievement of Pakistan's strategic and ideologicalobjectives through militancy". However, Rana wasperhaps only referring to the ISIS operating in Syria-Iraq.It took time for the US intelligence to finally revealthat the Khorasan branch of ISIS (called ISK) is"amalgamation of primarily disaffected and rebrandedformer Afghan Taliban and Tehrik-e-Taliban Pakistan(TTP) members". It was left unsaid that they werecobbled together in Peshawar region under tutelage ofPakistan's ISI and pushed west into Nangarharprovince of Afghanistan. That they foundsympathizers in Afghanistan and expanded is alsoestablished. The ISK was different from the ISIS inSyria-Iraq; Afghans were actually referring to ISK as"ISI".In 2016, Voice of America had reported Afghanistanofficially telling Pakistan that Hafiz Saeed, formerLeT chief was directing ISIS operations inAfghanistan. So the so called ISIS in Afghanistan isobviously mixed with LeT and other Pakistani proxieslike JeM etc, along with ISI cadres and personnel fromPakistan's Mujahid Battalions disguised as civilians.Pakistan claims to be fighting the Haqqani Networkand the TTP but both Taliban have coalesced withefforts of the ISI-supported Haqqani network. TheTaliban leader killed by the SAS in 2008 in Helmandregion of Afghanistan in 2007 was a Pakistani armyofficer. The ISK to start with was different from theISIS, but were establishing links with the latter.In July 2016, James B Comey, then Director US FBIhad said, "Eventual victory against the Islamic Statecould well lead to an uptick of terrorist attacks in theWest, not a reduction in them ….. hundreds of reallydangerous people, and they are going to flow primarilyto Western Europe, but some could well end up in theUnited States". So it was expected that they would bediverted elsewhere. Now reports have emerged thathundreds of ISIS terrorists were smuggled out ofRaqqa during October 2017, as part of aUS-UK deal and freed to spread out far andwide across Syria and beyond according toBBC documentary 'Raqqa's Dirty Secret'.This included large number of foreigners

from Pakistan, China, France, Turkey, Azerbaijan,Yemen, Saudi, China, Tunisia, Egypt; the escapeconvoy comprising some 50 trucks, 13 buses and over100 ISIS owned vehicles carrying hundreds of ISISfighters, family members and loads of arms on October12.The footage showed lorries towing trailers crammedwith armed men despite an agreement to take onlypersonal weapons; 10 trucks were loaded withweapons and ammunition. With the purge in Iraq-Syria, ISIS cadres have begun arriving in Af-Pak. TheISIS in Afghanistan has recently released photographsof new Islamic State fighters who have just completedtheir training in Kunar region of Afghanistan.It has often been portrayed that Pakistan is threatenedby Pan-Islamism. Nothing can be farther from the truth;where Pakistan army's bible is the 'Quranic Concept ofWar' (authored by Brigadier SK Malik in 1979) thatjustifies killing all non-Muslims and calls for everyPakistani citizen to rise in 'jihad'. So, ISIS cadresreturning from Iraq-Syria will be welcomed byPakistan army with open arms and used for cross-border attacks, even as they fight the moderate cadres -same as the ISI has done in the case of Al Qaeda andTTP.Pakistan is using JeM to attack both India andAfghanistan but China still continues to put its so-called 'technical hold' at the UN to stop Azhar Masoodbeing branded terrorist; 'technical hold" being aneuphuism for abetting Pakistani terrorism. This, despiteChina being only country that is drilling oilcommercially in Afghanistan since 2012, and makinghuge profits in copper mines extraction. WhilePakistan is using the LeT, JeM and HM to terrorizeIndia, the deadliest remains LeT with some 60 militantsin J&K, 70% of whom are foreigners.Our security forces recently gunned down six terroristsincluding Zakiur Rehman Lakhvi's nephew Owaid, forwhich the LeT is expected to react strongly - recentthreat to Hindon airbase being one example. It may berecalled that LeT which was established primarily totarget India, grew into an international terroristorganization filling up vacuums in Al Qaeda and laterjoining in the proxy war in Afghanistan. Ironically, theUS Department of Defence (DoD) has prevailed uponthe key Congressional committees to drop a provisionlinking financial aid to Pakistan with Islamabad takingdemonstrable action against LeT, despite the provisionbeing part of the bill meant to finance the US armedforces for 2018 known as the National DefenceAuthorisation Act (NDAA).When Qamar Javed Bajwa, Pakistani army chiefsucceeded Raheel Sharif in November 2016, Pakistanischolar Ayesha Siddiqa wrote about the latter, "GeneralSharif will be remembered for positing the military asa state within a state more than many of the guys beforehim. The manner in which he pushed the envelope wasunbelievable." Bajwa has continued to play the radicalconstituency, masterminding the proxy war on Indiaand Afghanistan. He is buoyed not only with China'ssupport but Raheel Sharif heading the Saudi coalitionaimed at Iran (Iranian terrorism?), coupled with theUS-Iran estrangement, gives him extra buoyancy.Where and how he plans to employ the Pakistan andChina origin ISIS cadres returning from Syria-Iraqneeds to be taken into consideration. And that is not all;add to this Pakistani support to the Arakan RohingyaSalvation Army (ARSA) in Myanmar and the West-China oil-game underway in Myanmar's Rakhineprovince.

Amajor goal of ourforeign policy is tosafeguard our security.

We are not members of any military alliance,which means that we have to essentially relyon ourselves to deal with day-to-day threatsto our security. This requires us to be as self-reliant as possible for our defence needs. Solong as we are dependent on foreign defencesuppliers we cannot have full elbow room toconduct an independent foreign policy,despite success in developing our strategiccapabilities on our own.That we are one of the world's largest armsimporters shows how we have mismanagedvital aspects of our defence preparedness.Russia has been our biggest defence partnerand has contributed in significant ways tomake us more secure, but we have not beenable to leverage that relationship to build agenuine domestic defence manufacturingbase, one going beyond licensemanufacturing.The almost $15 billion (Rs 96.7 thousandcrore) worth of arms we have bought fromthe US in the last few years has given us toolsto defend ourselves better against threats toour security, but this has created anotherexternal dependency.PartnerThat we have been declared a major defencepartner by the US should ideally mean thatwe will be assisted to develop an indigenousdefence manufacturing base and not merelyhave easier access to high-quality Americanarms on a par with US allies. So far, it doesnot appear that Trump's remark, that Indiaand the US as the world's largest democraciesshould also have the strongest militaries,means anything more than expectations that

India will buy more US weapons.We have had a long-standing defencerelationship with major European countriessuch as France, UK and Germany, but thishas not resulted in the establishment of ourown capacity to produce the weapons weneed. Technology transfer remains a bighurdle, not to mention our own inadequateindustrial capacity and R&D as well as lackof skilled manpower. We ourselves are toblame for this highly unsatisfactory state ofaffairs.Leaving aside the failure of policy all theseyears to develop an indigenous defencemanufacturing base, even our polices toprocure defence equipment from abroad havebeen in shambles. The many scandalsassociated with defence acquisitions in thepast continue to cast a shadow on newcontracts that we enter into.Since we are one of the largest markets in theworld for arms, competition among defenceequipment suppliers is intense and all means,fair or foul, are used either to win contracts ordeny them to rivals. Controversies aregenerated around contracts by alleging

irregularities inprocessing them andoften the political classis used to channel suchaccusations which,however motivated theymay appear to be,compel the bureaucratsand their politicalsuperiors to repeatedlyreview them, if only toprotect themselves frominvestigations later onfor complicity in someform whengovernments change. It

is already well known how acquisitions ofneeded equipment have been inordinatelydelayed because of these infirmities in ourdefence procurement system.ControversyAll this is relevant to the controversy beinggenerated by the Rafale deal, which isunfortunate for many reasons. Our Air Forcehas been clamouring for urgent action toaddress the issue of its depleting squadronstrength which could no longer be ignored.Dassault had won the tender for 126 combataircraft, outcompeting international rivals onboth technology and price counts, but thecontract could not be concluded despiteprolonged negotiations.The Modi government had to make thedifficult choice of scrapping the contractaltogether - at the cost of our strategicpartnership with France - and ignoring thedistress of the Air Force or meet its urgentrequirements partially by purchasing only 36aircrafts off the shelf on condition that theoverall terms would be improved anddelivery would be accelerated, for which anintergovernmental agreement was signed.

These facts are on public record. If purchasesfrom the US under governmental agreementshave avoided controversies over possiblyinflated costs, etc, the Rafale contract under asimilar agreement with France shouldpreclude any such controversy too.PrivateThe involvement of the private sector infulfiling some aspects of the Rafale contractis consistent with the Modi government'sdeclared policy of involving the privatesector in defence manufacturing as part of theMake in India programme. Broadening thebase of defence manufacturing in the countrywill require reducing the already overloadedpublic sector units and increasing theparticipation of the Indian private sector,which is why foreign defence firms are beingasked to build partnerships with them.Lockheed Martin and Boeing have tied upwith Indian private firms and so has Airbus todemonstrate their commitment to the Makein India programme. Dassault's tie-up with anIndian company is within this policyframework too. Opposition parties should,therefore, avoid generating controversiesover defence procurement where facts do notjustify this and consider the adverse impactof such politicking on our relations with ourstrategic partners.The French have been forced to counter theallegations being made as it affects thecountry's reputation, besides unnecessarilyaffecting potential follow-on orders. It is alsoagainst national security and the commercialinterests of foreign companies as well toreveal the details of defence contracts beyonda point. Our political actors should becautious in wanting to make electoral capitalout of sensitive defence issues.

After much hue and cry by the Opposition mainlyCongress for convening special session of theParliament to take on affront the Modi government

on many issues, the Government, at last, has called thewinter session of Parliament. A brief session from 15December to 5 January was announced by theParliamentary Affairs Minister Ananth Kumar last Friday.This should obviate the need for the Congress leaders topetition President Ramnath Kovind to direct theGovernment to summon Parliament. Now that the sessionhas been called, we will await Rahul Gandhi and othergreat parliamentarians to unspool their debating talents inthe House.Had the Congress leaders bothered to google the schedulesof the previous winter sessions, they would have learnt thatthey too had likewise delayed the summoning ofParliament to the third or fourth week of December at leaston two occasions.In the present case, clearly the Government was keen not tohave Parliament in session till after the end of the polling inGujarat which ends on 14 December. The winter session isset to begin the next day.This in a way makes sense. Despiteits superiority in numbers,military conquest ofPakistan is beyond India'smeans.With the nuclear dimension,an all-out war will certainlyresult in major damage forIndia, though Pakistan maywell cease to exist. In thisJinnah harnessed religionby creating a false scare of'Islam in danger'. Pakistanwas created by the Muslimelites for the elites. DespiteJinnah's secularpretensions, Pakistan wasdestined to be a religionbased state as the genie ofreligious fanaticism onceunleashed refused to goback into the bottle! Thelast 70 years of Pakistan'shistory shows that it isfaithfully following theDelhi Sultanate model ofgovernance. Peace has notbeen an interlude in70 yearsof Pakistani history.Once India understands thepermanent nature ofPakistani hostility and itslogic, we can work out ourstrategies to deal with it.Peace with Pakistan is notpossible due to structuraland ideological reasons.The best course for India isto wait out the implosionthat is bound to take placesooner than later. We haveto be prepared to ensure thatthe fallings debris from acollapsing state do notdamage us.

Themeeting was informed thatabout 75% dumping hasbeen completed in 90 rationdepots of the district whichremain cut off during thewinter months and the restwill be completed soon.

While directing theconcerned officers, to keeptheir men and machineryready for snow clearanceduring winters, the DDCstressed them to work incoordination to deal with anyexigency. He directed themto maintain close liaisonwith the District DisasterManagement Cell.It was also given out thatMechanical EngineeringDepartment has deployed 10snow clearance machines forclearing of 954 km roadlength, besides R&B andMunicipal officials were alsodirected to ensure snowclearance of roads fallingunder their jurisdiction.During the meeting, the

action plan alreadyformulated was discussed indetail and the DDC urged allconcerned to implement theplan in letter and spirit andensure prioritization duringclearance works.The DDC directed PDDauthorities to ensure promptrestoration services in caseof breakdown oftransformers and exerciseprudence in maintainingrevolving buffer of electrictransformers. Similarinstructions were passed onto PHE authorities.He also directed the revenueauthorities to ensurepunctuality of staff in theoffices and directedconducting of regular

inspections to check theattendance of officials.While directing the officersto conduct sensitizationprogrammes for their grassroot level workers, the DDCordered constitution ofVillage Level Teamscomprising VAEA, VLW,Patwari, GRS, Linemen ofPDD, PHE, Numberdar,Chowkidar, Food StoreKeeper, etc who would bemobilized to conduct tour ofvillages during exigency andreport the ground position tothe higher-ups in the districtadministration. market for onion -- arrivalshave dropped by 47 per centto 12,000 quintal today from22,933 quintal on the sameday a year-ago.Onion at Lasalgoan is beingsold at Rs 33 per kg today asagainst Rs 7.50 per kg ayear-ago, as per the datamaintained by the Nasik-based National HorticulturalResearch and DevelopmentFoundation (NHRDF).Meanwhile, the Centre hasasked state-owned MMTC toimport 2,000 tonnes of onionand directed Nafed andSFAC to source 12,000tonnes locally to boostsupplies.A minimum export price ofUSD 850 per tonne has beenimposed to restrict outboundshipment of onion.

While 32 percent of people who don'twear seatbelts said weak lawenforcement 'encourages'them to 'drive free', 27 percent of them said it impactstheir image and a significantof 25 per cent said seat beltsruin their clothes. Another23 per cent did not evenconsider it as a safety device.While the World HealthOrganisation has recognisedseat belts as a primaryrestraint system that can

reduce the risk of fatality byup to 60 per cent, Indians arestill rather ignorant of itsimportance. And that can befatal in a country where,according to data collectedby Ministry of RoadTransport and Highways,5638 accident deathshappened last year alone."Seat belt is a primary safetysystem in a car and severalstudies show that its regularuse can bring down injuriesand fatalities in roadaccidents," said KenichiAyukawa, MD and CEO,Maruti Suzuki. BSE had sought clarificationfrom RelianceCommunications Ltd aftermarket hours yesterday withrespect to news that ChinaDevelopment Bank filesinsolvency case against it.In a clarification to BSE,Reliance Communicationsspokesperson yesterday said,“The company has not beenserved any notice of theapplication filed by ChinaDevelopment Bank withNCLT, as reported in themedia.”However, in the interest ofall stakeholders, thespokesperson said: “Thecompany is engaged throughthe JLF (joint lenders forum)

with all its lenders for asuccessful resolution of theSDR process. The ChinaDevelopment Bank has alsobeen actively participating inthe JLF.”The company is therefore,surprised by the untimelyand premature action of theChina Development Bank offiling an application atNCLT, the spokespersonadded.The company continues toremain engaged with alllenders including the ChinaDevelopment Bank and isconfident and committed toa full resolution with thesupport of all the lenders.

An FIR has been lodgedagainst e-commerce giantFlipkart’s founders and afew other company officialsfor allegedly “cheating” abusinessman to the tune ofRs 9.96 crore, police said.The case pertains to non-payment of dues by Flipkartto C-Store Company forlaptops it supplied, officialsat the Indiranagar policestation here said.They said an FIR has beenregistered against Flipkart’sSachin Bansal, BinnyBansal and a couple ofcompany officials, based onthe complaint by C-StoreCompany’s Naveen Kumar.According to the complaint,C-Store had entered into acontract with Flipkart forsupply of laptops along

with other electronic goodsfor its sale, and hadsupplied about 14,000laptops, police said.Flipkart, which returnedabout 1,480 units,did notpay for the remaining, thecomplainant said, addingthat the other charges,including shipping had alsonot been paid.The complaint alleges thatthere has been cheating tothe tune of Rs 9.96 crore,police said.A case has been bookedunder different sections ofIPC, including cheating andcriminal breach of trust, anofficial involved in theinvestigation said.When contacted for it’sreaction, Flipkart said it didnot wish to respond fornow.

The Income Tax Departmenthas slapped notices on 1.16lakh individuals and firmswho made cash deposits ofmore than Rs 25 lakh in bankaccounts post note ban butfailed to file returns by thedue date, CBDT chairmanSushil Chandra said.Besides, large cash depositby people who have filed I-Treturns are also under closescrutiny, he said.The tax department hascombed as many as 18 lakhpeople who had depositedjunked 500 and 1000 rupeecurrency notes of over Rs2.5 lakh each postdemonetisation.

Out of them, individuals andcompanies who have still notfiled their I-T returns weresegregated into twocategories - those depositingmore than Rs 25 lakh in bankaccounts and those putting inRs 10-25 lakh each.“There are 1.16 lakh peoplewho have deposited morethan Rs 25 lakh in cash afterdemonetisation in oldcurrency notes but still notfiled their returns,” he toldPTI.“So we have asked them tofile their IT returns within 30days,” he said.Chandra said 2.4 lakh peoplehad made cash deposits ofRs 10-25 lakh who have notfiled returns so far.

“They will also get notices inthe second phase,” if theydid not file the returns, hesaid.The notice is under section142(1) of I-T Act. Theofficial further said thenumber of people prosecutedfor violating the I-T law hasmore than doubled to 609 inApril- September this yearfrom 288 in the same periodlast fiscal. The totalcomplaints filed are 1,046 asagainst 652 in the last year.Also, convictions have goneup to 43 from 13 last year,Chandra said. “So courtshave given judgementconvicting people. So those43 people will facesentences given by courts”.According to the officialdata, 17.73 lakh suspiciouscases involving Rs 3.68 lakhcrore have been identified bytaxmen in 23.22 lakh bankaccounts postdemonetisation. Responsesfrom 11.8 lakh people for16.92 lakh bank accountshad been received by thedepartment online.

I-T department issues 1.16 lakh noticesfor cash deposits over Rs 25 lakh

Expressing concern over theloss of lives and damage topublic property duringagitations, the SupremeCourt on Tuesday asked theCentre to create courts inevery state and unionterritory to fix accountabilityfor vandalism andcompensate the victims ofsuch violent protests.The top court suggested tothe Centre that one or moredistrict judges should begiven responsibilities inconsultation with respectiveHigh Courts to prosecuteand fix civil liabilities onthose responsible for suchmayhem.It favoured criminal actionagainst leaders of suchorganisations or politicalparties, whose memberswould indulge in destructionof public or private

properties.A bench of Justices AdarshKumar Goel and U U Lalitsaid although guidelineshave been framed by theapex court in 2007, whichinclude videography of suchagitations, but there existsno mechanism to deal withthe damages to be paid to thevictim."These agitations, whichresult in damage to life andproperties, are nowhappening very often. If it isto be dealt by High Court orSupreme Court, then it willbecome very difficult. Thereshould be some forum wherepeople can go and seekremedy as per law," thebench said.The bench's order came on aplea filed by advocateKoshy Jacob, who soughtimplementation of 2007guidelines of the apex courtwith regard to the procedure

to be adopted byadministration during suchagitations and submitting ofreport to the High Courtsand Supreme Court.The top court said althoughthe Constitution has giventhe right to people toassemble freely and peacefulprotest, but no one has beengiven the right to damagepublic property and indulgein violence which result inloss of lives."Those who fail to maintainpeace shall be heldaccountable and those whosuffer must be compensated.At prevention level, policecan do it throughvideography as stipulated inthe guidelines issued by theapex court in earlierjudgement," the bench said.Attorney General K KVenugopal, appearing forCentre, agreed with thesuggestion and said thegovernment has taken stepsto amend the Prevention ofDamage to Public PropertyAct in consultation with theMinistry of Law and Justice.He said a draft of the Billhas been prepared andpublished on the website ofMinistry of Home Affairs

(MHA) seeking commentsof public and otherstakeholders.The AG said severalcomments have beenreceived, which were beinganalysed by the MHA andfurther steps will be takenaccordingly."We hope the suggestions ofthe court will be consideredby government andincorporated in the law thatis being proposed," thebench said.Venugopal said there can becivil liability on those whoindulge in violence, besidescriminal action.Referring to the recentagitation in Darjeeling inWest Bengal, the AG saidthings became difficult forthe local people as suppliesof food and petrol were cutand the Centre had to rushten companies of para-military force to allow thetrucks to enter Kalimpong."People were forced tosuffer for no fault due to theGorkhaland agitation. Thisshould not be done. Thoseresponsible for the chaosneed to be heldaccountable," the benchsaid.

We are steadilyworking towards a less casheconomy and have launcheda Unified Payment InterfaceApp called BHIM. owner of this law firm, toldPTI today that his law firmhad recently filed the petitionin the UN."My law firm has filed thepetition on Hafiz Saeed'sbehalf at the UN seekingremoval of his name from itslist of designated terrorists.My son Haider Rasul who isdirector of this firm islooking after this case," hesaid.Saeed, who is accused ofhaving masterminded theNovember 2008 Mumbaiattack that killed 166 people,was placed on the terrorismblack list by the UnitedNations under UN SecurityCouncil Resolution 1267 inDecember 2008.To a question about anyprogress in the case so far,Mirza said: "We have justfiled the petition."Mirza was AdditionalAdvocate General of PunjabGovernment (1993-1996)and Prosecutor General for

The Supreme Court onTuesday found no illegality inthe appointment of Gujarat-cadre IPS officer RakeshAsthana as special director ofthe CBI on October 22."Wecannot question the decisiontaken by the selectioncommittee which isunanimous and before takingthe decision, the director,CBI, had participated in thediscussions and it is based onrelevant materials andconsiderations," a bench ofJustices R K Agrawal andAbhay Manohar Sapresaid.The court also reiteratedthat once there is consultation,it is beyond the scope ofjudicial review, though lack ofeffective consultation could

be examined.The courtdismissed a PIL filed by NGOCommon Cause throughadvocate Prashant Bhushan,which contended thatAsthana, a 1984-batch officer,had reportedly been named ina secret diary recovered fromthe Income Tax raid in aSurat-based firm for havingregularly received bribes.Hisson was claimed to haveworked with M/s SterlingBiotech, the firm under theinvestigation of the CBI. Itwas also claimed that hisdaughter's marriage cocktailparty was organised at afarmhouse of M/s SandesaranGroup ofcompanies.Rejecting thearguments, the court said inthe FIR filed by the CBI onAugust 30, 2017, Asthana's

name has not been mentionedat all. "Thus, lodging of FIRwill not come in the way ofconsidering Asthana for thepost of special director, aftertaking into consideration hisservice record and work andexperience," it said.Aftergoing through the minutes ofthe selection committeemeetings provided byAttorney General K KVenugopal, the court alsofound the news reports asfactually incorrect whichstated that no meeting hadtaken place on theappointment of specialdirector on October 21.Thecourt noted that the selectioncommittee has even discussedthe secret and an unsignednote was produced by the CBIdirector.
