We wouldlike to bring some majorburning issues for your kindconsiderations and urgentaction as belowEven after spendingthousands of crores throughIRCON the power crises andunscheduled power cuts thattoo in peak summers havemade the life of commonman miserable as also thetraders and the industrialistshave to spend more onGensets and other suchgadgets which also lead topolluting the air in Jammuprovince.That the Chamber of

Commerce & Industry andevery common citizen ofJammu had excepted somerelief by through new MasterPlan which could come up asper the practicalrequirements of the presentscenario but nothing suchhappened leading to noticesoff and on to the peopleregarding the construction ofhouses or businessestablishments thathappened in the past. Tawi, the DPR and fundingof which was sanctioned bythe Union Ministry.That Chamber of Commerce& Industry expresses seriousconcern over the slow pacefor creation of AIIMS thatwas sanctioned long timeback and because of thisslow pace the health care issuffering badly in Jammu.That we have been made tounderstand that Chamber'sdemand of Parade by BSF atSuchetgarh on the pattern ofWagha on our side of borderhas been sanctioned by theUnion Ministry, but we seenothing happening towardsthe development ofinfrastructure at Suchetgarhas this project could attractthousands of tourists forborder tourism.That we question thedepartments like Housingand Jammu DevelopmentAuthority towards creatingnew residential colonieswhich are need of the hourbecause of souring prices ofland and their inefficiency todo so.The Chamber of Commerce& Industry demands that thegovernment must announcea specific deadline forcompletion of ongoingdevelopmental projects likeartificial lake over river tawi,development of river Tawion the pattern of Sabarmati,the restoration works ofMubarak Mandi, theGandola Project in Jammuand Patnitop and also fix theresponsibility andaccountability measures onthe departments who areundertaking theseprestigious projects. We alsodemand that the religiouscircuit of Mata VaishnoDevi, Shahdra Sharief,Nangali Sahib and BudhaAmarnath in Jammuprovince be promotedthrough special Ad campaignand proper infrastructure becreated for the facilities ofthe pilgrim tourists. A large part of thecountry's food and waterdirectly depends on theHimalaya and its products.In 9 states Himalaya spreadacross 17% area of thecountry, out of which 67%area is reserved for forestland. 30 Great peaks extendto a height of 7,000 meters inthe form of Snow Mountain.1.3% of forest and 3.8% ofhuman population of thecountry lives in the vicinityof Himalaya. In the last fivedecades, we have tamperedHimalaya in many ways toget as much as possible fromthis vulnerable system.Deteriorating condition ofHimalaya is creating manytypes of crisis. Himalayaneeds attention not only forits wellbeing but for all thosewho are connected to this

great entity directly orindirectly.During The Himalayan Daycelebration an extemporesketch competition on"Contribution of Himalaya

& our Liabilities" wasorganised in the BotanicalGarden of the Universitywhich was followed by apopular lecture by Prof. R.K. Ganjoo, and eminentprofessor of QuaternaryGeology and Director,Institute of Glaciology, PGDepartment of Geology,University of Jammu. Prof.Ganjoo spoke on "MIGHTYHIMALAYA: THE GAMECHANGER" wherein duringhis interaction with thestudents, scholars andfaculty, he exhorted upon theyounger generation to revisitthe subject carefully becausethe origin of Himalaya isvery complicated and itssustenance is required for thelife of whole of the Indiansub-continent. Further, hedeliberated upon the role ofHimalaya in speciesendemism and speciesmigration particularly fromEurasian plate. He put hisemphasis on the availability

of water, pure air and soil inIndia because of the presenceof Great Himalaya as aboundary to the country innorth. In addition to thecontribution of Himalaya insetting the ecology andenvironment of thesubcontinents, Prof. Ganjoosaid that now this is the timeto own our liabilities towardsthe Himalayan ecosystem.Prof. Namrata Sharma in-charge Head of theDepartment whileintroducing the speaker tothe audience said that Dr.Ganjoo is working on theHimalayan Glaciers andmigration of fauna throughHimalayan Corridor fromlast more than 30 years.Others who were presentduring the celebration wereDr. Veenu Kaul, Dr. SikanderPal, Dr Geeta and Dr. HarishChander Dutt.

Bhalla on the occasion alsoslammed state government'smove to close down about1,300 government schoolsin the Jammu province inthe name of"rationalisation". He stategovernment move to closedown schools under the planof rationalisation hascreated hardships tochildren and parents in ruralareas.He said the move toclose down more than 1,300schools in the Jammuprovince was "arbitrary" andagainst the overall interestof students and people, asmost of these schools wereopened as per the norm ofthe Central Government of"the availability of schoolsin nearest locality at thedistance of about onekilometre" in order toachieve the total literacytarget and check dropoutrate. Describing the move ashighly retrograde, he saidthat it has adversely affectedthe educational activityespecially in the remote andfar flung areas of the statewhere thousands of school

going children were forcedto discontinue their studies.The Chairman emphasisedon the importance of qualityeducation, sound health andmoral values in the holisticdevelopment of children. Twenty-nine patients havetested positive for dengue andswine flu here, a seniorgovernment official said,while assuring that necessarymeasures had been taken toprevent the spread of thediseases."While 24 patients havetested positive for dengue,five others are being treatedfor swine flu," Director,Health Services, Jammu,Gurjeet Singh, told PTI.Asserting that there was nodeath reported either fromdengue or swine flu, he saidnecessary measures likefumigation had been taken.Six women and four children

were among the 24 denguepatients who have recoveredfully after treatment atdifferent hospitals.Of the dengue cases, thehighest at 17 had beenreported from Jammu, twofrom Samba and one eachfrom border districts ofRajouri and Poonch, Doda,Udhampur and Kathua, hesaid.All five swine flu cases werereported from Jammu and thepatients were under treatmentand stable, he said.Singh said there was no needto panic as the situation is not"alarming"."We are on the job and thesituation is well undercontrol," the director said.PTI

The Union Government has alreadysanctioned Rs.63,000 crores for the various projects, whichamounts to 78 percent of the total cost of the PMDPpackage. An amount of nearly Rs.22,000 crore has beenreleased.Nearly two years after the PMDP-2015 was announced, fiveof the 63 projects have been completed. These include theprestigious Chenani-Nashri tunnel costing Rs.781 crore,announcement of remuneration to Special Police Officers(SPOs) from Rs.3,000 per month to upto Rs.6,000 permonth as well as assistance provided for Pucca andKuchcha houses damaged during the 2014 flood.The land acquisition in respect of semi-Ring Roads inJammu and Srinagar will be completed within two months.The four-laning of Jammu-Udhampur section of NationalHighway, NH-1A, is nearing completion. Nineteen roadconnectivity projects costing about Rs.43, 000 crore areunder implementation in the State, which are progressingsatisfactorily.An investment of about Rs.5,810 crore under Power Sectoris being made to improve the transmission and distributionnetwork in the state. Besides, the Central Government issupporting the State with an investment of Rs.3,790 croreon Pakaldul hydroelectric project.For the construction of AIIMS at Awantipora and Jammu,Rs.2,000 crore each are being made available and anamount of nearly Rs.91 crore has been released. Besides,IIT Jammu and IIM, Jammu have already startedfunctioning from temporary campus and the setting up ofpermanent campus is under progress. Similarly under theHealth Sector, Rs.900 crore is available for completion ofongoing health infrastructure. Rs.200 crore has beenutilized. The work on the comprehensive management ofJhelum was reviewed and found satisfactory.The DPR for Phase-II is being prepared. The rehabilitationplan for migrants of Jammu, PoK and Kashmiri Pandits wasalso reviewed. It was noted with satisfaction that theprojects are progressing satisfactorily. Witnesses said that a residential house in which themilitant was trapped was razed to ground by security forcesduring the gunfight.Clashes erupted between protesters and government forcesnear the site of a gunfight.Reports said that youth from adjacent villages of Hadiporaand Chetlora tried to march towards the gunfight site todisrupt the operation.The protesters pelted forces with stones as they marchedahead.Reports said that a huge protest rally was taken out from theReban village. On the other hand, India asked for appointment of a neutralexpert to look at the issues, contending the concernsPakistan raised were "technical" ones.Following this, the international lender had in November2016 initiated two simultaneous processes--for appointingneutral expert and establishment of court of arbitration--tolook at technical differences between the two countries inconnection with the project.The simultaneous processes, however, were halted afterIndia objected to it.After that, representatives of the World Bank held talkswith India and Pakistan separately to find a way out. Thefirst and the upcoming second round are being consideredas part of the same effort by the World Bank.

Progress on digitization ofrevenue records reviewed

POONCH, SEP 09A meeting of revenue officers and officials was held todayin Poonch to review the status of scanning, qualitychecking and updation of revenue records in TehsilHaveli.Regional Director Survey and Land Records Pir Panjalchaired the meeting. The Lok Adalat was held under the overall administrativesupervision and guidance of Principal District and SessionsJudge, Rajouri, Shahzad Azim.During day-long proceedings, 261 cases were disposed ofon spot which included criminal cases, traffic and civilmatters. Fine to the tune of Rs. 36,100 was also realised.The Lok Adalat witnessed an encourging response fromlitigants._Referring to Alternate Dispute Resolution (ADR)methods of solving disputes, which are alternatives forlitigation in the courts, as less costly and more expeditious,Malik urged the litigants/potential litigants to resolve theirdisputes amicably through ADR mechanism._ ADR method can be used in commercial and labourdisputes, divorce actions, in resolving tax-claims and inother disputes that would likely otherwise involve courtlitigation. POONCH, SEP 09A National Lok Adalat was held at district court complexPoonch under the chairman ship of Zubair Ahamad RanaChairman District Legal Service Authority Poonch Pr.District Session Judge Poonch. During the proceedings fivebenches were constituted for taking up cases of matrimonialact, land acquisition, criminal compoundable, electricitybills, bank recovery, etc. Total 718 cases were taken up outof which 633 cases were disposed of through reconciliationand arbitration and total amount of 493000 was realised asbank recoveries while an amount of Rs 1480000 has beenawarded in motar vehicle accident claims and total 10 caseswere settled in this regard. For petty offences an amount ofRs 25,740 was realized.In addition to these 650 number of pre litigation cases weretaken up & disposed of by reconciliation settlement .Bar members litigants, staff members and other prominentcitizens attended the lok adalat.

The Government of India has stated inunequivocal terms that RohingyaMuslims are illegal immigrants and

will be deported. The central government has issueddirections to the affected state governments to prepare themodalities for their deportation. Meanwhile, the matter hasbeen dragged to the Supreme Court of India based on apetition filed by two Rohingya immigrants which haschallenged the decision on various grounds including thatit violated international human right conventions.Meanwhile, there have been protests in Kashmirmasterminded by the separatists. Mutahida Majlis-e-Ulma(MMU) headed by leading separatist Mirwaiz UmarFarooq and all other religious organisations of Kashmirincluding Jamaat e Islami, Jamait-e-Ahlihadith,Anjumann-e-Share Shian and Islamic Study Circle gave ajoint call for observing 8th September, Friday as aSolidarity Day with Rohingyas to condemn their allegedpersecution and ethnic cleansing in Myanmar. What aparadox? The Kashmiri Muslim leadership (mainly Paksponsored and financed separatists) are expressing concernabout the alleged ethnic cleansing of foreigners in a distantland but had turned a blind eye to the persecution andethnic cleansing of Hindu Kashmiri Pundit communityfrom their ancestral land by blood thirsty, slogan shouting,gun trotting locals to convert Kashmir from a multi-ethnic,peace loving, multi-religious society to a monolith. Rohingyas have a link with global jihadi outfits. Even AlQaeda supremo Osama Bin Laden in an interview to aKarachi based newspaper Umma had referred to Burmawhere a strong jihadi force existed. Therefore, it is notsurprising that Rohingyas have also received support fromKashmiri terrorists. Zakir Musa, self- styled commander ofAl Qaeda affiliate Ansar Gazwat-ul-Hind in a 10 minuteaudio message released on YouTube channel AnsarGhazwa warned the government against deportingRohingya Muslims in Jammu. He also threatened to"liberate" India from the rule of "cow -worshipping" PMModi and Hindus. Incidentally, Rohingyas are alsoaffiliated to a Bangladesh based outfit Islami ChhatraShibir (ICS), a militant arm of the Bangladesh Jamaat-e-Islami (JeI) and have been responsible for launching

violent street demonstrations, attacking security forces,secular political rivals and secular individuals. ICS is alsonotorious for anti-Hindu violence in Bangladesh. Hence, itwould not be wrong to assume that Rohingya jihadis alsoharbour anti-Hindu sentiments. Their illegal migration toIndia and decision to settle in which part of India is beingmasterminded by a core-group created by Pakistan's ISI inCox Bazar in Bangladesh. ISI's intention is two-fold:firstly; to spread fundamentalism in the areas they settleand thereafter use them for Pan Islamisation of the region,secondly; to foment serious political and religious fights toforce the exodus of Hindus to alter the regionaldemography.Well before the advent of Petro-Islam (Saudi WahabbiRadical Islam) and Al Qaeda, the Rohingyas in Rakhinestate of Burma (former name of Myanmar) in 1948 hadstarted a jihadi movement for establishment of an IslamicState. Prior to that in 1940, they started a separatistmovement for merger of their region with proposed EastPakistan much to the annoyance of local Buddhistpopulation. In 1948, at the time of Burma'sindependence, they approached Muhammad Ali Jinnahto incorporate the Western Burma region with EastPakistan due to geographical proximity and theirreligious affinity. Jinnah rejected the proposal due to fearof annoying the British. A few months later NorthArakan Jamaat-e-Islami was formed which spearheadedthe movement for a separate Islamic nation in the region.The movement was financed and supported by EastPakistan based radical outfits. They committed atrocitiesagainst the local peace loving Buddhists and alsoresorted to burning and looting. The Buddhists ratherthan being cowed down decided to retaliate and ensuredthat the Rohingya Muslims are unable to change thegeography of the region. Having failed to realise theirdream of a separate nation, Rohingya Muslims startedseeking Burmese citizenship. However, after the 1962coup d'etat the situation became bad for the Rohnigyas.Later the Rohingyas were declared a non-national raceand denied Burmese citizenship. A crack-down waslaunched against them in 1992 which led to their fleeingto Bangladesh and other Islamic countries which werealso reluctant to host them. In refugee camps in CoxBazar and other parts of Bangladesh they became a

cannon-fodder for global jihadi organisations dulyfinanced by Saudi Arabia. In a well hatched conspiracyand masterly executed plan they were also infiltratedillegally to India through porous border withBangladesh. One of the destinations of RohingyaMuslim illegal immigrants was Jammu, a sensitiveHindu-majority border town already facing the brunt ofa demographic invasion from North of Pir Panjal and ISIsponsored jihadi terror in Jammu & Kashmir. The reasonfor selecting Jammu was in consonance with earlierstated two-fold mission of ISI.Jihadi groups in Pakistan and Saudi Arabia are recruitingand training Rohingyas to fuel insurgency in Rakhineprovince of Myanmar. Petro dollars are being used tofinance these terrorist groups. The main Rohingyaterrorist group goes by the name of Harakat-ul-Yaqeenwhose leaders are based in Saudi Arabia, all of whom areof Rohingya origin. They are well connected inBangladesh and Pakistan and have visited Bangladeshand northern Rakhine state over the last many years. Aprominent name among the jihadists is reported to beAtaullah (alias Ameer Abu Amar, Abu Amar Jununi).Born in Karachi, he is the son of a Muslim Rohingya andgrew up in Mecca and was indoctrinated and radicalisedin Madrasas in Saudi Arabia. He disappeared fromSaudi Arabia in 2012 and is reported to have gone toPakistan and received training in practical guerrillawarfare and terrorism. He is reported to be Emir ofArakan Rohingya Salvation Army (ARSA), the terroristorganisation responsible for the attacks on theMyanmar's Border OutpostsAnother name that has surfaced in reports is that ofAbdus Qadoos Burmi, a Pakistani national based inKarachi. Burmi, as his name suggests, is also aRohingyaMuslim. He is chief of an organization Harakatul Jihad al-Islami-Arakan (HUJI-K) and is reported tohave very close links with Lashkar-e-Toiba (LeT)/Jamaat-ud-Daawah (JuD) and Jaish-e- Mohammad(JeM), the ISI-sponsored jihadi terrorist organizationswhich are very active in India as well. The LeT andJeM have connections with Al-Qaida and operatefreely within Pakistan which has long acquired thedubious distinction as the epicentre of global Jihaditerrorism. Operatives from these terrorist tanzeems are

reportedly training and arming terrorists in refugeecamps in Bangladesh and Thailand and insideMyanmar. The likelihood of them having infiltratedinto Kashmir to train the Rohingyas settled in Jammucan not be ruled out. One of the two militants killed inSouth Kashmir in October 2015 named Abdur Rehmanal Arkani alias Chotta Burmi was also a Rohingya. The jihadi mind-set of the Rohingyas is wellestablished. It is therefore no denying the fact that theirpresence in India is a threat to national security more soin the sensitive Jammu region and their earlydeportation is in national interest. In the plea before theSupreme Court it has been stated, "Proposeddeportation is contrary to the constitutional protectionsof Article 14 (Right to Equality), Article 21 (Right toLife and Personal Liberty) and Article 51(c) of theConstitution of India, which provides equal rights andliberty to every person. This act would also be incontradiction with the principle of 'Non-Refoulement',which has been widely recognised as a principle ofCustomary International Law." The Constitution of anynation is written to protect its sovereignty and integrity. Noconstitution will permit any action that is prejudicial tonational security. "Application of Mind" is a well-established practice while interpreting legal andconstitutional provisions. Some may argue that allRohingyas are not Jihadis and why should the innocent bedeported. The fact is to distinguish between the two is well-nigh impossible. In any case one bad fish spoils the wholepond. All of them are illegal immigrants. Their jihadi linksare well established. In the interest of national securityRohingyas need to be deported post haste. Whatever, maybe the outcome of the plea before Supreme Court, their exitfrom Jammu is mandatory. US President Donald Trump’s latest move towardsnullifying process of the pro-immigration policy inAmerica by repealing the Deferred Action for

Childhood Arrivals (DACA) has seriously threatened abouteight lac immigrants and put more than 20,000 Indian-Americans at risk of immediate deportation.Though this was expected of Trump, such action is indeedbad news for many long-time immigrants who have acceptedUS as their home for ever. Over 27,000 Asian Americans,including 5,500 Indians and Pakistanis, have already receivedDACA protection.An additional estimated 17,000 individuals from India and6,000 from Pakistan respectively are eligible for it, as per anestimate. DACA was an attempt to guarantee protection fromdeportation for some “low-priority” immigrants. It wasdesigned to help a generation of immigrants known as‘DREAMers,’ after the DREAM Act, a recurring proposal toallow unauthorised immigrants who grew up in the US togain legal status and eventually apply for citizenship.In November 2014, the then President, Barack Obama,announced he was building on DACA with new executiveactions to protect groups of immigrants. He proposedloosening DACA’s age restrictions, so that people who hadarrived in the US as older teenagers or who had been too oldto qualify for DACA in 2012 could apply for protection. Andhe announced a similar, but much larger, program calledDeferred Action for Parents of Americans — which wouldgive the same protections as DACA to immigrants whosechildren were US citizens or permanent residents.Just as Trump has reversed many other Obama decisions, hehas in effect put the clock back on this one. The newexecutive actions would have expanded the pool ofunauthorised immigrants eligible for protection to 4.5 million— nearly half of the unauthorised population of the US.Consequently, Republicans were not pleased. The SupremeCourt ultimately deadlocked on the issue in 2016, and theexecutive actions were put on hold. With President Trumptaking a hard line on immigration, the axe was bound to fallon Obama’s deferred order.

In the fall of 1950,PN Kaul, a youngcolonel, was posted

in Leh. In his memoirs, he wroteabout his life in Ladakh andmentioned a curious incident. Hesaw thousands of refugeesarriving from Xinjiang (thenSinkiang or Eastern Turkestan):"(They) came with what little theycould carry on their ponies. Manyhad lost family members in theirjourney over Karakoram orneighbouring passes. I had a hardtime trying to see that they weren'tfleeced by those connected withtheir evacuation from Leh."ConsequencesThey were fleeing Kashgar, whicha few months earlier had beentaken over by the People'sLiberation Army (PLA). Kaulrecalls, "Our consul general inKashgar, Captain RD Sathe of theIndian Foreign Service and an ex-army officer, and his wife alsoarrived in Leh during the winterof 1950, after their difficultjourney from Kashgar."This small sentence is fascinating,because the closure of the Indianconsulate in Kashgar is one of theleast-known historical facts, butwhich had tremendousconsequences. Strangely, nothingcan be found in the Indianarchives about it.However, I once came across acable from KM Panikkar, theIndian ambassador in Beijing, toKPS Menon, the foreign secretary.

Dated August 14, 1950, afew months before CaptainSathe reached Leh;Panikkar writes, "Re-opening of the consulate inKashgar may takeconsiderable time. In fact, Ihave serious doubtswhether the Chinesegovernment will agree to aconsulate there, as even theSoviet have not so far beengiven permission to re-establish their consulategeneral. If we press for it,multiple-month negotiationswill be unavoidable."Does it mean that in August 1950,the Indian Consulate in Sinkiangwas already closed? Incidentally,in Kashgar, India and Pakistanshared the same building, theerstwhile British consulate.To figure the background of theclosure of the Indian Consulate inKashgar, one has to fish into theJohns Hopkins University'sarchives in the US.On November 14, 1950, Isa YusufAlptekin, the former secretarygeneral of the defunctGovernment of Turkistan, at thattime a refugee in Srinagar, wroteto Owen Lattimore, an influentialAmerican scholar.The Uyghur leader explained,"Lue Meng Cheng (LiuMengqun), who was secretarygeneral of the headquarters formilitary and political affairs,joined hands unofficially with theChinese communists in 1949.General Tao Chih Yao (Tao

Zhiyue), commander-in-chief ofthe nationalist army in Turkistanalso joined hands with him andbecame party to his activities.Governor Burhan (Shahidi) alsojoined them."It means that the main nationalistleaders defected to thecommunists, who were receivedwith open arms in Sinkiang;Alptekin said, "This surrendermeant Russian control over ourland again, the consequences ofwhich were still fresh in ourminds."He had no alternative but toescape to India over the mostarduous pass, the Karakoram.The Uyghur leader reached Lehon December 12, 1949. "Afterreaching Ladakh we came toknow that 789 of our countrymenhad also reached Ladakh asrefugees after surrendering arms,ammunition, valuables and extraclothing to the ruthless Chinesesoldiers at the border."

COMMUNIST RULEIn the followingyears, tens ofthousands ofrefugees would fleethe communist rule.It's probably at thistime that the newleadership inSinkiang decided toclose the Indian,Pakistani andSoviet missions.The latter wouldsoon be reopenedand by 1953, it wasthriving with 300

"advisors" directing operations inthe New Dominion; India'sconsulate, however, would neverreopen.It was only in December 1953 thatNehru declared in Parliament,"Some major changes have takenplace there (Kashgar). But whenthese revolutionary changes tookplace there, it is also perfectly truethat the Chinese government,when they came to Tibet, told usthat they intended to treatSinkiang as a closed area."The communists' decision,accepted by India, had tremendousimplications: The entire trade withCentral Asia from Srinagar andLeh, the lifeline of these regions,suddenly ended. When Beijingtoday speaks of the One Belt OneRoad, or an Economic Corridor, itomits to mention that there was aflourishing commerce which wasdeliberately closed by China itself.Construction

According to a CIA report of July15, 1953, the PLA was busy withroad construction (across theIndian territory in Aksai Chinarea). "In late 1952, the 2 CavalryRegiment, commanded by HanTse-min, had its headquarters atGartok (Western Tibet). Thisregiment had 800 camels. A unitof this regiment, with 150 men,was garrisoned at Rudok (near thePangong lake). Han Tse-min saidwhen these roads were completed,the Chinese communists wouldclose the Tibet-Ladakh border totrade. The Chinese communists inSinkiang were telling the peoplethat Ladakh belongs to Sinkiang."It was definitively a premeditatedaction to close down the Indianconsulate in Kashgar and then, thetrade between Sinkiang andKashmir and central Asia.The conclusion? First, it's ironicBeijing pretends to be upset aboutIndia's non-participation to itsOBOR project when the century-old Silk Road was closed morethan 60 years ago and remains sotoday.Next, like in 1950, China puts itsneighbours in front of faitaccomplis and later announcesthat it's ready to "talk"; though inthat particular case, the Indianconsulate in Kashgar never cameto the negotiating table. It'sperhaps high time it does.And finally, why can't Delhideclassify these old files, whichwould show the world how Chinaacted and still acts?

rationalists and secularists such asNarendra Dabholkar, MM Kalburgi andGovind Pansare were not made part ofan unrelenting campaign, though thisissue was raised repeatedly in someareas, spasmodically in others.And then two days ago, secular andoutspoken journalist Gauri Lankeshwas shot dead. The Karnataka Policefound that the bullets that killed Gauri,were fired by the same type of weaponthat was used to kill Dadholkar,Kalburgi and Pansare. This was a7.65mm countrymade revolver. (TheIndian Express, September 7). Theconcentrated and targeted killing of foursecularists can only be a carefully

planned and executed attack.What does this indicate and what doesrecent history tell us?There has been much talk about fascismin India for decades. From June 1975 toMarch 1977, lndira and Sanjay Gandhiwere called fascists over the minute butham-handed censorship of the press.Jaya Prakash Narayan (JP) led amovement against corruption,demonising Prime Minister IndiraGandhi, who had refused to resign fromher office over violation of electionrules, and was thereby liable to bebarred for six years from contesting fora Lok Sabha seat. Using an ambiguousdecision from the Supreme Court, shestuck to power.The Supreme Court headed by ChiefJustice of India Y Chandrachud, ruledthat the right of habeous corpus couldnot prevail during the National

Emergency. The poor were forciblyherded out by the Congress regime thatwanted to "prettify" the capital. PoorMuslim residents were driven out fromthe city. To control the populationgrowth, tens of thousands of mainlypoor people in urban and rural areaswere forcibly sterilised. The much-loved singer, Kishore Kumar, whorefused to sing in support ofsterilisation, was banned from publicmedia.Gauri Lankesh was shot at herdoorstep.When JP ironically told his supporterswho were accused by the CPI, whichwas then supporting Emergency, that ifthe sangh parivar was fascists, he toowas fascist. The CPI took him at hisword and accused JP of being fascist.Many such strange things happened.The sum total of the criticism of the

Emergency was that it was widelyconsidered by non-partisan people asbrazenly authoritarian, if not fascist.Unfortunately, the Janata governmentthat followed the post-EmergencyGeneral Elections in 1977, was anabsolute disaster, bringing back theCongress.Unfortunately, the Janata Partyimploded and among otherdevelopments the Jana Sangh wasrenamed Bhartiya Janata Party. After theJanata Party collapsed due to internalfissures, Indira Gandhi-led Congressreturned to power. The term fascism wasused much less. But the spate ofcommunal riots that followed includingthe Bhagalpur and Meerut/Hashimpurariots of 1987, in which the Congress wasimplicated, apart from numerous riots inwhich the BJP was involved, led tomultiple accusations of fascism.

Communalism against minorities,including the post-Babri demolition,riots in which both the sangh and PVNarasimha Rao government wereinvolved, became the benchmark forfascism.As several secular activists and scholarshave repeatedly pointed out, Right Wingauthoritarianism is not an equivalent offascism. It may have as a section of theLeft argues, "fascistic" tendencies butthat is yet to be conclusively decided byIndian/foreign scholars and activists.There are, however, increasinglyworrying signs. Prominent andoutstanding secular universities such asJNU, University of Hyderabad andAllahabad University are undersustained attack.The rules enshrined in the parliamentaryacts of these universities are flouted byvice chancellors nominated by the NDA

government.Sangh members and sympathisers arebeing brought in by hook or crook inorder to de-secularise universities.The secular parties, including thelargest secular party Congress, havedone very little to reinstate the secularcharacter of the universities andschools. An increasing number ofschool textbooks have become aregurgitation of sangh history, politicsand culture.The sangh claims a major role in thenational movement, which was exposedin the post-Independence period bynumerous scholars. But many secularstates are yet to update their socialscience textbooks.It is difficult to deny that the threats andattacks on secularism and rationalistsare growing. Democracy is underthreat.

The protests bythe families of the pilgrimsat the Srinagar InternationalAirport highlighted theGovernment's insensitivitytowards the Hajis and their

The NC Chief Spokespersonsaid the unprecedentedabsence of the ChiefMinister in receiving thefirst batch of Hajis wasextremely condemnable anddemonstrated her lack ofempathy and sense ofresponsibility as the Head ofthe State Government. "Itappears the Chief Ministerchose not to go to the airportto receive the first batch ofHajis due to themismanagement by herGovernment. Jammu, Sep 09It refers to Union Transport Minister rightly stressing onproduction of e-cars while hinting on a ban on cars withpetrol and diesel engines. Union government shouldimplement towards eco-friendly policy in phases with atotal ban on production of diesel-cars by say 01.01.2018.Thereafter only CNG-fitted petrol cars may be allowed tobe manufactured. With procurement-price of petrol anddiesel being almost same, diesel is kept cheaper for keepingprices of travel in public-transport and transportation ofgoods cheaper. Allowing use of economical diesel forluxury cars is as such totally unjustified. Centralgovernment should also adopt a taxation policy toencourage manufacture of small cars, because costly bigcars use much more space for parking and roads. It can bedone by having double rate of GST on cars with ex-factoryprice rupees ten lakhs and above, rather than havingdifferent GST rates according to length or engine-capacity.

Patna:Patna Rashtriya Janata Dal(RJD) president Lalu Prasadand his son, former Bihardeputy chief ministerTejashwi Prasad Yadav, onSaturday told the CentralBureau of Investigation(CBI) that they would not beable to appear before it forquestioning in the hotels-for-land scam on Monday andTuesday, respectively, as theywere “preoccupied”.The CBI had on Thursdayasked he RJD chief to appearbefore it in New Delhi onSeptember 11 and Tejashwion the next day in connectionwith irregularities inawarding contracts duringPrasad’s tenure as the railwayminister (2004-09).Prasad’s lawyers on Saturdayinformed the CBI that theRJD chief would not appearbefore the probe agency as he

was preoccupied attendingtrial in fodder scam cases hewas facing. “Prasad will be

busy with court proceedingsnext week when defencewitnesses are likely todepose,” the lawyers saidTejashwi, at present leader ofopposition in Biharlegislative assembly, hasrequested the CBI forexemption from questioningon September 12 as he had tofulfill some “prior political

commitments”.The father-son duo, who laterleft Patna for Bhagalpur by

train, have sought more timeto appear before the CBI forquestioning.Prasad – convicted in afodder scam case – continuesto face legal troubles. One ofthe five fodder cases has beenreopened. New Delhi:The CBI has registered a caseagainst 19 companies whichhave sent over Rs 424 crorein foreign remittances

through about 700transactions, suspecting it tobe a case of moneylaundering through shellcompanies.It is alleged that during theyear 2015, unidentifiedofficials of Punjab NationalBank (PNB), Mint Streetbranch, Chennai, entered intoa criminal conspiracy with 19accused companies whichwere account holders in thebranch.“...in furtherance of theconspiracy, the above saidcompanies were sendingforeign exchange to HongKong without any genuinebusiness transactions,” theFIR, registered last evening,alleged.It said the accounts thusopened were used for thepurpose of sending advanceforeign remittances.“The modus operandi wasthat the customers gotremittances from variousother banks to their accounts

by way of RTGS (real timegross settlement). Thecustomer presented theirrequest with a quotationissued by foreign suppliers

for 100 per cent advanceremittances,” it said.The customer made requestfor remittance to foreignsupplier based on thequotation, it alleged.“The remittance amount waskept in such a way that itwould not exceed thethreshold limit of $ 1 lakh foreach remittance in order tocircumvent the regulatoryrequirements andapplicability of the RBI,” itsaid.The CBI said there were 700advance remittances madefor imports through variouscurrent accounts openedduring the period fromJanuary 2015 to May 2015totalling to Rs 424.58 crore.“All the advance remittanceswere routed throughNOSTRO (account held byPNB with a foreign bank in aforeign currency) accountmaintained with HSBC, NewYork,” it said.The bank had found that

none of units werefunctioning at the availableaddress.The RTGS credits emanatedmostly from some creditcooperative societies, atMumbai and other places.The RTGS transactions weremade by the remitter throughfictitious persons in whosenames accounts could haveopened in the co-operativesocieties in Mumbai.The remittances were sent inthe name of foreign supplierswho had opened accounts invarious banks in the UAE,Hong Kong and Taiwan. Theremittances were routedthrough HSBC, New York tothese banks, the CBI alleged.“It is clear that this is a caseof money laundering throughshell companies and therehas been loss of foreignexchange to the tune of Rs421.58 crore to the country,”it alleged.

CBI, premises searchedThe CBI on Saturday carried out searches at the

premises of former environment minister Jayanthi Natarajanafter registering an FIR against her in connection withclearance given during her tenure for diversion of forest landfor mining in alleged violation of laws.The agency has registered its FIR against Natarajan, UmangKejriwal, the then managing director of Electrosteel CastingLimited, and the company besides other unidentifiedpersons. The case pertains to clearance given for diversion offorest land in Saranda Forest, Singhbhum District inJharkhand to mining company Electrosteel in allegedviolation of Forest (Conservation Act) in 2012.The permission was rejected by the minister of state forenvironment Jairam Ramesh but when Natarajan took thepost, she allegedly cleared it.“Jayanthi Natarajan, the then Minister of State forEnvironment and Forests accorded the approval for diversionof 55.79 hectares of forest land for non-forestry use to ECL,though the same had been rejected by the earlier Minister ofState...without any change in the circumstances afterrejection,” the CBI FIR alleged.It said this approval had been accorded without adhering tothe advice of director general forests and directions ofSupreme Court in this regard. New Delhi:More than a year aftersuggesting bright line testsfor ascertaining ‘control’ ina listed company, Sebi hasdecided not to tweak theexisting takeover norms asit received feedback thatsuch a move could be“prone to misuse”.“Considering the currentregulatory environment, ithas been decided tocontinue with the practiceof ascertaining acquisitionof ‘control’ as per theextant definition in thetakeover regulations,” Sebisaid on Friday.In March 2016, thewatchdog had launched apublic consultation fordefining control by way ofbright-line tests andproposed fixing 25%voting rights as athreshold.A bright-line rule or abright-line test generallyrefers to a simple and basicstandard that can be

applied to removeambiguity and resolvecontentious issues.Under Sebi regulations,control is based on certaindefined principles ratherthan on rules and therehave been cases when amultitude of opinions giverise to differentassessments of control overa listed company.In a statement on Friday,Sebi said that while anumber of comments werereceived from variousstakeholders, includingindustry bodies andintermediaries, no

particular option garneredoverwhelming supportamong the stakeholders.Among others, theregulator received viewsfrom the Reserve Bank ofIndia (RBI).“The Ministry of CorporateAffairs and a few otherstakeholders have opinedthat changing the currentdefinition of ‘control’ mayreduce the regulatory scopeand may be prone to abuseand that the currentdefinition of ‘control’ maynot be changed and itwould be more appropriateto take decisions on a case-

to-case basis,” it said.The ministry implementsthe Companies Act.The Justice BhagwatiCommittee, set up in 1995,to review the Sebi(Substantial Acquisition ofShares and Takeovers)Regulations, 1994, hadrecommended a broaddefinition of control.The panel had also opinedthat it should be left to Sebito decide whether there hasbeen an acquisition ofcontrol on the basis of factsof each case.The view of the panel wasreiterated by the TakeoverRegulations AdvisoryCommittee (TRAC) in itsreport in July 2010.“It is felt that any changeor dilution in the definitionof control would have far-reaching consequencessince a similar definition of‘control’ is used in theCompanies Act, 2013 andother laws,” the statementsaid.

Acquisition of control: Sebi to continue with existing norms

New Delhi:The failure to stop dodgy cash comingback into the banking system afterdemonetisation has likely burdened theReserve Bank of India with additionalinterest payments running into tens ofthousands of crores, former governorof the central bank Raghuram Rajansaid Thursday.Latest Reserve Bank of India datashows that all but 1% of the high-valuebank notes demonetised on November8 last year have returned to the bankingsystem, meaning black money hoardersfound ways to legitimise their cash thatnow earns interest. Rajan estimates thisburden could be as high as Rs 24,000crore a year, if one assumes there wasabout Rs 4 lakh crore worth illegal cashat the time of the note ban.“One of the costs which people haven’tpaid enough attention to is (that) thiswas money sitting, if you believe it wasblack money, it was sitting in people’ssafes or in their basement. It wasn’tearning any interest,” Rajan toldHindustan Times in an interview.“Once it gets into the formal system, ifyou haven’t identified it as bad money,these are people gaining interest on it,”he said, referring to short termeconomic costs of demonetisation.

Flushing out black money was a keyobjective of the decision to demonetisehigh-value bank notes worth Rs 15.46lakh crore, or 86% of the total cash incirculation at that time. Thegovernment had hoped that at least Rs3 lakh crore of this, held asunaccounted-for cash, would not returnto the system. That would have reducedthe RBI’s liability and boosted itsprofits, allowing it to transfer morefunds to the government for newinvestments and development work.That didn’t happen. As a result, the

RBI, which has had to absorb most ofthis now-legit cash, pays interest on it,Rajan said, adding it probably played arole in almost halving the centralbank’s profit through FY 2016-17 froma year earlier. The RBI’s financial yearruns from August to July.“I point this out because this issomething that people misinterpret.They are saying we have formalised thesavings. The savings were there. Theywere just financing the governmentfree of cost,” Rajan said.Rajan refused to reveal the specifics ofa note the RBI wrote to the governmenton arrangements required fordemonetisation. He, however, said thatbefore such an exercise, a monetaryeconomist would like to seepreparedness to replace all the currencywithdrawn. “We have seen the cashdemand is now tapering off, but youshould have been ready with that sortof cash on the day we did it. The lessyou are ready, the more you have toprint in order to roll out the currency,the more economic life is disrupted.”Rajan was talking to Hindustan Timeson his new book – I do what I do – inwhich he has said neither he nor theRBI under his watch favoureddemonetisation.

India, China to set up workinggroups to promote exports

Mumbai:Tata Motors and itstemporary workers at theJamshedpur plant who wereon a strike since Tuesdayagreed to end the four-dayimpasse on Saturday.The ice-breaker came in

after the unions agreed tothe management offer totake 200 of the over 4,500temporary workers on to therolls annually. At thereconciliation meeting heldon Friday, the workers hadturned down instead askedfor upgrade of at least 500workers annually.Following the settlement,the company said, the planthas resumed normalproduction. The plant makesaround 400 units ofcommercial vehicles a day,which had come down to 60-70 during the strike.“We’ve successfully

concluded our discussionswith the workersrepresentatives and they’veappreciated our offer ofproviding permanency to200 workers per year aswe’ve been following in thepast.

“Following this, the sectionof the temporary workers,who were instigated andmisguided by the vestedparties have ended theagitation and the matterstands resolved,” TataMotors told PTI through anofficial statement.When contacted workersalso confirmed thedevelopment and said a 10-member team representingtheir cause met with themanagement and resolvedall the issues earlier in theday. The plant is functioningnormally and to partly meetthe production of around

700 units, the union hasdecided to work on Sundayas well.Around 4,500 temporaryworkers, around 600 of themwomen, with active supportof a union of the Jamshedpurplant were on strike from

Tuesday protesting non-payment of revised three-year wage agreement signedwith permanent workers’

union early last month andhigher incentives on parwith the permanent workersand making at least 500 ofthem into rolls annually.According to union leaders,the strike so far has resultedin production loss of around700 vehicles a month. Theplant makes around 9,000units a month in three shifts.As per union, while around4,500 permanent workers atthe plant were given a wagehike of Rs 12,500 per month,the temporary workers’ weregiven only Rs 1,500-2,000.But when the wages werepaid early this week, thepermanent workers got onlyRs 6,500 extra whereas thetemporary ones were paid asper the now-defunctagreement, they claimed.A permanent worker on anaverage gets Rs 30,000-32,000 a month, while atemporary worker gets Rs12,000-13,000, the sourcessaid.

New Delhi:The ambitious project toconduct paperless assessmentfor income tax payers rose by78 per cent over the last threeyears, prompting thedepartment to roll out theregime pan-India by the endof this financial year. Thegovernment initiative waslaunched in October 2015 bythe I-T department’s policy-making body--the CentralBoard of Direct Taxes(CBDT)--in select metrocities with an aim to reducethe visit by assesses to taxoffices and their interfacewith the taxman, therebycurbing instances ofcorruption. A latest blue printprepared by the departmenton the subject states that thenumber of paperless or e-assessments over the internethas seen growth in the lastthree years. “During thefinancial year 2015-16, a total

of 1,014 cases werecompleted under the pilotproject (e-assessment). “Thesame was completed inapproximately 14,000 casesduring the 2016-17 fiscal. Inthis fiscal (2017-18), till July31, assessment orders inaround 4,100 such cases hasbeen passed in the sevenmetro cities and e-assessments are pending inaround 74,000 cases,” theblue print accessed by PTIsaid. A simple analysis of thefigures states that the growthin the number of cases beingprocessed in an e-environment has jumpedslightly over 78 times.The blue print adds that forcases which “are selected forscrutiny during the 2017-18fiscal and onwards, the Board(CBDT) has decided to utilisethe e-proceeding facility forconduct of assessment onpan-India basis.”

The case pertains toclearance given fordiversion of forest land inSaranda Forest, Singhbhumdistrict in Jharkhand, tomining companyElectrosteel in allegedviolation of the Forest(Conservation Act) in 2012.The permission was rejectedby the Minister of State forEnvironment JairamRamesh but when Natarajan

The day-long meeting of theGST (Goods and ServicesTax) Council being presidedover by Union FinanceMinister Arun Jaitley beganamidst tight security in theHyderabad InternationalConvention Centre atMadhapur near here today.The meeting being attendedby 160 delegates includingfinance ministers of statesand Government officials issignificant in more than oneway as it will constitute astanding committee besidesstate-level screeningcommittees for nationalanti-profiteering authority.This will be the thirdmeeting of the GST Councilsince the launch of theGoods and Services Tax onJuly 1, and the 21st since itwas set up in September lastyear. The Council will alsodiscuss tax rates for about

70 goods and commoditiesand modalities to ensure thatthe GST benefits werepassed on to consumers.The Telangana Government,which is hosting the Councilmeeting, will reiterate itsdemand to scrap or reduceGST to five per cent onongoing projects in theState. Chief MinisterK.Chandrasekhar Rao hadalready briefed Mr.Jaitleyduring the former’s recentvisit to Delhi about thedifficulties the state wouldface if the tax slabs finalisedfor the ongoing projectswere continued.

According to state FinanceMinister Etala Rajender,though the Centre hadagreed to reduce the impactby slashing tax on ongoingprojects from 18 to 12 percent, the state would stillface a burden of Rs.9,000crore.Mr Jaitley will hear thearguments of all the statesand take a final call on thetax slab for all Governmentworks.The State Government willhost a dinner for visitingdignitaries at the iconic TajFalaknuma tonight.(AGENCIES)

The GST Council todayexempted artisans and folkartists with an annual turnoverof up to Rs 20 lakh fromregistration under the justintroduced Goods and ServicesTax (GST).West Bengal Finance MinisterAmit Mitra said besides

exempting artisans, the 21stmeeting of the highest decisionmaking body of the GSTexempted clay idols from thetax.Also, no registration would berequired for inter-state jobworks, he said.“For artisans, artists, folk artsand tribal arts, no registrationwill be required up to Rs 20

lakh (turnover). Clay idols areexempt now,” he said, addingthat “job work inter-state, youdon’t need any registrationnow up to Rs 20 lakhturnover.”On Government work contract,the tax rate has been reduced to12 per cent from 18 per cent.“That will save Government alot of tax.” (AGENCIES)
