Executive summary

Over the past thirty years, Yemen has been plagued with a number of conflicts (1962-1969; 1970-1983; and in 1994) that have resulted in a significant and deadly legacy of landmines and other explosive remnants of war. Yemen is committed to the complete elimination of landmines and other explosive remnants of war. The National Mine Action Committee (NMAC) was established in June 1998 to formulate policy, allocate resources, and develop a national mine-action strategy. Furthermore, the Yemen Executive Mine Action Centre (YEMAC) was established in January 1999 as the implementing body of the NMAC with the primary responsibility of coordinating all mine-action activities in the country. The aim of the current Strategic Mine Action Plan is to put an end to the suffering and casualties caused by anti-personnel landmines. A nationwide Landmine Impact Survey (LIS) was completed in July 2000. The LIS identified a total of 1,078 mined areas with a reported surface area of 922,726,881 square metres, mainly in the central and southern regions of the country. In 2002, 7 additional mined areas with a total size of 100,400 square metres were identified. In 2006, 3 additional mined areas with a total size of 505,000 square metres were identified. Hence, in total 1,088 areas totalling 923,332,281 square metres have been of concern to Yemen. By January 2008, 631 areas totalling 710,103,911 square metres had been released, with 108,974 anti-personnel mines destroyed and 457 areas totalling 213,228,369 square metres remained to be addressed. Humanitarian, social and economic implications: The LIS recorded a total of 4,904 casualties in the years leading up to the survey, of which 2,560 were killed and 2,344 injured. Since entry into force, annual rates of recorded casualties have not come anywhere near these numbers. Nevertheless, between 1999 and 2007 there were 129 recorded casualties of explosive remnants of war including 5 deaths and 47 injuries resulting from anti-personnel mines. Completing Article 5 obligations during the extension period will result in no new casualties. The LIS identified 18 mine-affected governorates out of the 19 governorates in Yemen. In total, 592 communities in 95 districts were found to have a landmine and/or UXO problem. An estimated 828,000 people were living in those affected communities. In addition, in 2002 three additional affected communities were identified. As a result of work undertaken by Yemen, by the end of 2007 it was estimated that the total affected populations was 580,212 persons. Fulfilling Article 5 obligations during the extension period will result in the population affected by anti-personnel mines being reduced to zero. The landmine and UXO problem has had a serious impact on access to critical resources, blocking access to grazing land, agricultural land and water sources for drinking and irrigation. It has also impeded infrastructure development and the implementation of social development projects in affected communities. Impeding circumstances: While Yemen had planned to fulfil its obligations by March 2009, it will be unable to do so because of the following circumstances:

Extent of the challenge + competition for scare development resources: At entry into force, Yemen was one of the most mine-affected countries in the world with over 1,000 suspected hazardous areas identified. The ability of Yemen to address its widespread implementation challenge has been complicated by the fact that Yemen is a country with one of the world’s lowest human development scores. A high population growth rated of (e.g., 3.02% in 2004) has compounded Yemen’s development challenges with population growth meaning increased demand for water, employment, education and primary health care. Insufficient funding: While Yemen is a poor country, it has provided more than 50 percent of the resources obtained for Yemen to implement Article 5 through in-kind contributions of staff, facilities and social benefits for the national staff. The amount of external funding required to complement Yemen’s national contribution often has not kept pace with demands. Shortages in funding have occasionally forced Yemen to stop or delay some activities until receiving the funding. For example, an unexpected shortfall of funds caused delays in work in some years affected the ability of Yemen to replace equipment, delay planned deployments of clearance and explosive ordnance disposal units and quality assurance and monitoring / evaluation team, and delaly the planned restructuring of clearance units. Lack of technologies: Yemen has lacked the latest demining technology to deal with magnetic and iron soils. This type of soil is located in 4 mined areas with a total area of 10,945,000 square metres in two governorates. Yemen also faces a problem with deep buried mines, covered by up to two to six metres of sand dunes. These mines are located in four areas in three governorates with a total area of 41,480,000 square metres. Geography and climate: Yemen’s geography places challenges on demining operations as mined areas are in mountain areas, deserts and areas where shifting sands are prevalent. Moreover, windy and rainy season restrict mine clearance operations in some regions. The duration of the proposed extension: Yemen strived to fulfil its obligations by its 1 March 2009 deadline and thereby contribute to putting an end to the suffering and causalities caused by anti-personnel mines and other explosive remnants of war in all mine-affected areas by March 2009. However, as a result of the above mentioned obstacles, progress in implementation was slowed. A six year extension of Yemen’s deadline (to 1 March 2015) will enable Yemen to complete implementation of Article 5.

1. Origins of the Article 5 implementation challenge During the past 30 years, Yemen has witnessed a number of conflicts, each leaving behind a significant number of explosive remnants. These conflicts are:

1. 1962-1975 conflict between republicans and royalists in the north 2. 1963-1967 the war of independent in the South 3. 1970-1983 the war in the central Governorates between South and North (before

unification) 4. May-July 1994 the war of separation

As a result of these conflicts, a significant amount of area contaminated by mines and unexploded ordnance remained. Combatants laid mines arbitrarily and haphazardly in sand dunes and fields and alongside roads without marking their locations. 2. Nature and extent of the original Article 5 challenge: quantitative aspects

A nationwide Landmine Impact Survey (LIS) was completed in July 2000. The LIS identified a total of 1,078 mined areas with a reported surface area of 922,726,881 square metres, mainly in the central and southern regions of the country. In 2002, 7 additional mined areas with total size 100,400 square metres were identified. In 2006, 3 additional mined areas with a total size of 504,000 square metres were identified. Hence, in total 1,088 areas totalling 923,331,281 square metres have been of concern to Yemen.

3. Nature and extent of the original Article 5 challenge: qualitative aspects The LIS identified 592 mine-affected villages in 18 out of the country’s 21 governorates. (Between 2002 and 2006, three additional mine-affected communities were identified bringing the total of affected communities to 595). Of the communities identified as mine-affected by the LIS, 14 communities (with a combined population of 36,000) were designated “high impact” and 578 communities (with a combined population of 791,400) were considered to have a “medium impact” or “low impact”.

The landmine and UXO problem had an impact on infrastructure development (roads, schools, housing, etc.) and denied people access to economic opportunities. This problem also blocked access to critical resources, including water and grazing land. It had the effect of further reducing the use of limited arable land (only 2.6 percent of the country) and frequently resulted in the death or disabling of farmers, herders (often children) and livestock essential for agricultural production and the resumption of basic economic activities. The government was unable to implement social-development projects within these affected communities due to the presence of landmines and other ERW. The LIS reported four major areas to which access was blocked due to the presence or suspected presence of landmines or UXO: pasture, farmland, and forest; roads and trails; water, and, housing. Pastureland was the most frequently reported mine-impacted resource type. In part, this is due to the nature of armed conflict prompting combatants to mine areas around strategic hillsides and mountaintops that were barren land used for grazing animals only. Human suffering and economic loss due to landmines and other ERW in Yemen was significant. The LIS recorded a total of 4,904 victims in Yemen in the 10 years leading to up to the conclusion of the LIS, of which 2,560 had killed and 2,344 injured. The most frequent victims were farmers and herders.

4. Methods used to identify areas containing AP mines

As noted, the LIS was used to derive a baseline from which to estimate the size, location and other characteristics of the implementing challenge and to measure progress. The methods used to conduct the LIS are contained in the survey report, which has been publicly accessible for several years. Yemen identified the mined areas in addition to those identified by conducting the LIS as a result of mine risk education (MRE) efforts. Technical survey, undertaken in accordance with international standards, is used to identify and verify the precise location of mined areas.

5. National demining structures Yemen’s national demining structures include the following components: The National Mine Action Committee (NMAC): The NMAC is the governmental body,

which, with the support of the United Nations Development Programme, is responsible for policy making, resource allocation, controlling the government’s mine action funds, and, approving national mine action strategies.

The Yemen Executive Mine Action Centre (YEMAC): YEMEC is the national

implementing body, responsible for coordinating and implementing all mine action activities, preparing strategic plans, annual plans, and day to day operations.

While Yemen has two non-governmental organizations involved in mine action, they are not involved in mine clearance or related activities. (See Section 18 for an overview of Yemen’s clearance capacities.) 6. Nature and extent of progress made: quantitative aspects

A total of 201,514 explosive remnants of war have been destroyed, including 108,974 anti-personnel mines. The table below summarises progress made in each of Yemen’s governates.

7. Nature and extent of progress made: qualitative aspects

Since 1999, YMAP has made a huge reduction in number of casualties, as the number of casualties before start of the program was 27 monthly. The increase in the numbers of casualties in 2007 was due to an anti-tank mine that detonated, injuring or killing 10 civilians. below up a vehicle with civilians. Below is table that shows the number of casualties of mines and other explosive remnants of war. A more detailed overview is contained in Annex II.

Also in terms of progress made, while the LIS estimated that over 828,000 individuals were impacted by the presence or the suspected presence of mines, it is now thought that the number has been reduced to approximately 248,000.

8. Methods & standards used to release areas known or suspected to contain AP mines

As noted above, technical survey is used to identify and verify the precise clearance task. Clearance is then undertaken using, in accordance with international and Yemeni standards, manual methods, mine detection dogs and backhoe machines. Through the use of technical survey, Yemen has also made huge reductions in the size of the suspected hazardous area. In the governate of Hadramoun, for example, which represented 42.41 percent (391,616,640 square metres) of the LIS estimate of suspected hazardous area, 91.6 percent ( 368,816,640 square metres) has been released in accordance with international standards. No area identified as potentially hazardous is ever released without some form of survey activity and without visits by quality assurance teams.

9. Methods & standards of controlling and assuring quality

The survey team and clearance unit that is going to complete and clear a mine suspected area or a minefield must inform Yemen’s Quality Assurance section adequately in advance of the appropriate completion date of the area. The survey teams or clearance unit must attend a hand-over gathering involving local leaders and representatives from the local administration and conduct a demonstration in the cleared minefields in front of the people. The quality assurance officer must brief the local authority about the cleared area using a map and report on the minefield / suspected area and proceed with a physical demonstration such as walking over the cleared land. At the end of the demonstration, a completion certificate is signed and stamped by the leader of the community and the representative from the local administration for the receipt of the area. The quality assurance officer presents documents to the sheiks or local authorities to sign and stamp, confirming that they had witnessed that land has been cleared and received the land. These documents are signed by the director of YEMAC and NMAC chairman for presentation to the government.

10. Efforts undertaken to ensure the effective exclusion of civilians from mined areas

Mine risk education (MRE) is major component of the programme as it helped to reduce casualities from 27 per month prior to the LIS to one to three casualties monthly. MRE targets men, women, girls and boys. The most common methods of information transmission are posters, signs, brochures and school presentations. Until end of 2007, 38,113 men and boys and 331,935 women and girls had been trained in MRE. In addition, Yemen is implementing a marking system to ensure the safety of civilians from mined areas, through permanent marking and temporary marking in accordance with international standards. 11. Resources made available to support progress made to date Yemen has provided at least US$ 3,500,000 annually since 1999, covering soldiers’ salaries, insurance, social security, compensation and field allowances, food and premises. A number of parties have also provided support. Yemen’s national contributions have totalled over US$ 35 million between 1999 and 2008. Contributions made by a wide range of external partners have also been instrumental in assisting Yemen in implementing Article 5 with over US$ 14.5 million obtained from external sources between 1999 and 2008. A complete overview of resources obtained by Yemen between 1999 and 2008 can be found in Annex III. 12. For example, an unexpected shortfall of funds caused delays in work in 2003 and 2005 and affected the ability of Yemen to replace equipment, which in turn resulted in the delay in planned deployments in 2005 of eight clearance units, three explosive ordnance disposal units, three quality assurance teams and one monitoring / evaluation team, the planned restructuring of six clearance units into independent platoons to operate using a one-deminer-in-one-lane method and the planned addition of 5 technical survey teams. Examples of financial shortfalls in 2005 and 2006 can be seen in the table below.

In 2007, Yemen received a expected donor contribution very late in the year. This caused a delay in the replacement of equipment until 2008, thus affecting the operational work due to the lack of necessary equipment. Lack of technologies

Yemen also faces a problem with deep buried mines, covered by up to two to six metres of sand dunes. These mines are located in four areas in Abyan, Lahij and Hadhramoot governorates with a total area of 41,480,000 square metres, as can be seen in the table below.

Yemen’s geography places challenges on demining operations as mined areas are in mountain areas, deserts and areas where shifting sands are prevalent. Moreover, windy and rainy season restrict mine clearance operations in some regions. 13. Humanitarian, economic, social and environmental implications Due to the nature of the climate and terrain in Yemen, the amount of agricultural land is already extremely limited (2.6% of total land area). Landmine contamination continues to deny access to water and reduce the amount of arable and grazing land available for use. Population pressures are forcing farmers and herders (who are frequently children or women) into areas that are unsafe, resulting in casualties to humans and to animals. In some instances, mine and UXO pollution has hindered access to areas listed for oil exploration especially in Hadarmout, where most of the uncleared areas remain. A number of other development projects are similarly affected. 14. Nature and extent of the remaining Article 5 challenge: quantitative aspects

As noted, of the 1,088 areas totalling 923,332,281 square metres have been of concern to Yemen, 631 areas totalling 710,103,911 square metres have been released. Therefore, 457 areas totalling 213,228,369 square metres remain to be released. As noted, a complete overview of the mine affected area originally of concern to Yemen and its current status can be found in Annex II. A summary of the information contained in this table is as follows:

The last portion of technical survey work will be completed between April and December 2009, covering the 45,438,386 square metres of suspected hazardous area in Shabwah governorate, Al Qardhi Wadi community and Khal Asaker (Ramlet Lkhaisham) mined area. A summary of the area subject to technical survey, the remaining clearance task and a schedule for clearance can be found in the table below.

15. Nature and extent of the remaining Article 5 challenge: qualitative aspects As noted, some of the remaining mined areas are in Hadramout governorate where there is a great potential for oil exploration. Completing implementation will remove a barrier to this important development initiative and help reduce Yemen’s dependence on imported oil. Also the remaining mines are blocking agricultural lands, irrigation sources and grazing areas. Implementing Article 5 will eliminate these blockages. Finally, with Yemen classified as one of the poorest countries in the region, with more than 41.8 percent of its population below national poverty line, clearance operations are expected to have a significant economic impact in poverty reduction.

16. Amount of time requested and a rationale for this amount of time A six year extension of Yemen’s deadline (to 1 March 2015) will enable Yemen to complete implementation of Article 5. This proposed extension period is based on a calculation of the Yemen Mine Action Centre’s survey and clearance rates, which in turn are based on experience to date, the number of available personnel, the type of terrain and mine fields, and a realistic expectation of financial resources. While Yemen’s plan foresees completion by September 2014, Yemen’s experience has shown that funding shortfalls could result in some work being delayed.

17. Work plan for the period of the requested extension April 2009 to December 2009

One affected community in Shabwah governorate with 45,438,386 square metres of suspected hazardous area will undergo technical survey. It is expected that approximately 1,540,361 square metres of this will be marked as requiring clearance. Of a total of 7,658,734 square metres marked from pervious years for clearance, a total of 1,370,388 square metres will be cleared in Lahij, Ibb, Hadhramoot, Al Dhalee, Shabwah and Amran.

The plan for this year is to clear an additional 2,055,582 square metres in Ibb, Hadhramoot, Al-Jawf, Mareb and Shabowah.

January 2014 to September 2014 The plan for 2014 is to clear the remaining mined area in Yemen – an aproximate total of 1,661,961 square metres in Ibb, Hadhramoot and, Mareb. During the extension period the programme will ensure land is released according to the International Mine Action Standards. It is estimated that implementation of Article 5 during the extension period will cost US$ 31,216,667 with Yemen’s contribution expected to total approximately US$ 18.8 million, resources from donor countries expected to be approximately US$ 10.5 million and approximately US$ 1.9 million expected from other sources.

Risks factors that may affect completion in accordance with the plan described above include less funds received than projected. While Yemen is confident that if the resourses are mobilised as described above, completion will be possible. Shortfalls, however, could delay work. In addition, inflation could affect implemention of Yemen’s plan. A 10 percent rate of inflation has been taken into account in Yemen’s budget. However, if the inflation rate in Yemen is too high, there will be a need to do an annual review of budgets and ensure that higher costs are taken into consideration. 18. Institutional, human resource and material capacity available YEMAC is responsible for implementation of demining work in Yemen. With the cooperation of the UNDP, Yemen has one of the best demining programmes in the world, having been in operation for nine years. There are currently almost 1,096 deminers working in the field. YEMAC has 8 clearance units, 5 platoons, 1 backhoe operator, 7 explosive destruction teams, 5 MRE, 3 victim assistance teams, 27 medical support teams, 12 mine deduction dogs teams, 2 monitoring and inspection teams, 11 technical survey teams and 5 quality assurance teams. Personnel working for Yemen’s mine action programme are seconded from the military, so they are obligated to continue with the programme until implementation is completed. The programme aims to keep the same personnel during the extension period. The survey teams will be re-structured in small clearance platoons after finishing the survey work in 2009.
