Structure Unfit for Human Occupancy

Dear NAME, &/or Person Occupying or Otherwise In Possession or Control of Residence/Structure

Located At: Address; Legal Description

Pursuant to Section 108.1.3 of 2015 International Property Maintenance Code this structure has been

deemed unfit for human occupancy due to any &/or all of the following but not limited to:

1. The structure is unsafe, unlawful or, because of the degree to which the structure is in

disrepair or lacks maintenance.

2. The structure is insanitary, vermin or rat infested, or contains filth and contamination.

3. The structure lacks the proper ventilation, illumination, sanitary or heating facilities or

other essential equipment required by this code.

4. The location of the structure constitutes a hazard to the occupants of the structure or to

the public.

You are hereby ordered to terminate any and all occupancy of this structure and, pursuant to Section

108.2 of 2015 IPMC, to close up, board &/or secure the structure to prevent entry. You are hereby

notified that electric and water utility services to the structure will be disconnected &/or withheld. You

must contact the City of Miami, Office of Community Development regarding any permits which

may be required to perform the work necessary to bring the structure into compliance, or to

otherwise provide the City of Miami with a plan of action to resolve any and all issues. As of the

date of this letter this structure is considered unfit for human habitation & any occupancy is unlawful.

Pursuant to City Code, please be advised that you have ten (10) days following the date of this notice to comply with this order.

Please also note that a follow-up inspection will be conducted to determine compliance. If any violation still exists a placard will

be posted on the premises declaring the structure is Condemned. In addition, a summons may be issued by the Municipal Court

or work may be done by a city abatement crew. Should the city be required to perform work, a bill will be sent to you for the use

of equipment, labor, dumping fees, and administrative fees needed to address the violation(s). If the bill for services rendered is

not paid within 30 days, a Certificate of Lien will be filed with the Ottawa County Clerk against your property for the cost due

and owing the city. Upon reoccurrence within six (6) months from the date of this letter the city may abate the violation without

further prior notification to you and costs of such abatement shall be assessed as mentioned above. The property owner has a

right to appeal this order by filing written notice of appeal with the municipal clerk within twenty (20) days after the order is
