NOTE FROM THE SECRETARIAT.

This cable, signed by , • Arilcs, Political epresentative of New

Guinea, conveys a telegraphic protest received by him from Hollandia,

New Guinea, against the attitude of Mr. etebosy, who claims to represent

the population of New uuinea but has no standing whatever and cannot be

deemed to represent that population. '!'he population of that territory

requests implementation of the princ~ples of -Linggadjati and the lienville,

of the right of self-determination of peoples, of democratic government,

of opposition to imperialism. A similar protest was addressed to Dr. Drees,

Minister van Maarseveen, the Chairman of the Round Table Conference, the

UNCI, the United Nations, the FCA, the Republican Delegation, President

Sukarno, President sukawati, High commissioner of the Crown, and to both

the foreign and national press . The protest from Hollandia was signed

by a number of f olloyre~s of Mr . Ariks, wh-ci claims full support from the

population of New uuinea.

To the President and the members of the United· Nations Organisat1on at Lake Success.

'l1he Irian Political Representing Body, t hereunto. autho­rized by the greater majority of the Irian political and spi­ritual leaders of the Irian population in North, South, East and Uest Irian (Netherlands New Guinea), which belongs to the territory of Netherlands-Indies (Indonesia) which by virtue of article I of the six Additional Articles of the Renville-agree­ment and the treaty of Linggardjati is under the sovereignty of the Netherlands-Indies, until this sovereignty will be transferred, requests, especially with a view to the Hague Round Table Con­forence,the attention of the High Assembly for the under men­tioned.

In an official declaration dated 27th May 1949 under No. · 10625/AGQO 6 of the Netherlands Government it has been expounded, that the Government makes the future status of New-Guinea depen­dent upon the result of the deliberations already held or yet to be held between Netherlanders and •Indonesians, however not be­tween Netherlanders and Irians. In this statement of th"e'"l'Jether­land Government it is said, that she cannot deviate from this line of conduct, because this would be contrary to the Netherland constitution, in which this deliberation has been dictated as binding.

We make known to your High Council, that this is unaccep­table to the people of Irian and that our people deny the Indo­nesians every and any direct or indirect right to exercise the slightest influence whatsoever upon the political position of Irian or to arrogate to themselves in any way rights over Irian.

Suchlike deliberations with the exclusion of the popula­tion of Irian, as is now taking place at the Hague Round Table Conference, is evidently undemocratic and a procedure which is in flagrant violation of the right of self-determination of the peoples.

When deliberations have to be held regarding the future of I rian, this ought to (as, with refere.p.ce to enclosure 1 1 has already been intimated to ' the Unci) - take place between Nether­landers and the Representatives of Irian, who are quite competent to intimate their desires as to the relations which will be esta­blished in the future · between themselves, Hetherland and the Republic of the U.S.I. ·

Repeatedly - (reference:enclosures No. 1 to) we have in­timated our wish to remain allied to the Kingdom of the Nether­lands and anyhow, under no condition to be incorporated in the Republ. of the u.s.I. under construction.

A condominium is unacceptable to us, because experiences with a condominium in other territories of the world do not tempt us to imitate such a joint· government. \ le do not wish the people of Irian to suffer for it. ·( In this connection we may as well refer you to enclosure No. 1).

We have in the past, even before there was any talk of a political shaping of Indonesia on a basis of the federal principle (already in beginnin8 of 1946), repeatedly applied to the Netherland Government with the request to fix the status of Hew Guinea and · to deliberate on this matter with the people of Irian. However, notwithstanding our repeatedly pressing the necetsity of it, the Net~rland Government has not passed on to that.

In this connection we may once more refer to our letter · to the Unci of 15th June 1949, as contained in the enclosure No .• l.

Therefore we address ourselves to your High council in virtue of Article 3 of the Atlantic Charter and Article 73 b of the Charter of the United Nations, in which the right of self­determination of the nations has expressly been acknowle4ged a? the basis of a Political worldorder, with the earnest but urgent request that your Council may effect, that also to the people of Irian the real practising of thB right of self-determination is to be made possible and assured.

Explanatory Statement.

To support this request vre have the .honour to bring the undermentioned to your attention.

The isle of New Guinea, although partly belonging to the territory of the Netherlands-Indias, does in no resp~ct whatso,ver belong to the Malay or Indonesian :Archipelago. Irian, the Net­herland part of Hew Guinea, forms, just like the Australian part of this island,.an independent geographic unity, shD. rply distin­guished from·the Malay Archipelago as well as from the Continent of Australia, what in the end should find expression also in its political formation and status.

This development, which cannot be averted, also is a logical consequence· of the i:;reat ethnographic differences with the Indonesian race. As may be considered sufficiently known, the peoples · of the r-~alay Archipelago, notwithstanding differences in history, language, religion and customs, all belong to the In­donesian race. There· exists among them a certain feeling of 11belonging together11 •

The f uture has yet to show whether it will be possible to unite t he se peoples in an independent state under a national government.

But it is unquestionable that the differences between the Irians and Indonesians arc so great as to make every thought of incorporating us in the national union of an Indonesian state absolutely impossible.

For the Irians belone; to a wholly different race, with physical and mental qualities quite apart from those of the Indonesians, while there having never been historical ties be­tween the Irians and the Indonesians, which might have smoothed over the differences in the course of time.

On the contrary,. the cont,ta·ct with Indonesians has led to an intensifying of the contrast. Now Irian has not been taken into the colonial sphere until quite recently through which she has come into contact with world traffic. This happened at a point of time, when the colonial powers, and among them Netherland, became more and more conscious of the moral obligations they had

towards the peoples committed to their cares and protection. Rather f r om the very start, so from the beginning of the

twentieth century, the Netherland government has therefore - at any rate in I rian - principally allowed themselves to be led by their educational task and their endeavours have chiefly been aimed at the gradual ado.ptation of the population, men­tnlly as well as mat erially, to.the worldcivilization,in which as regards t he spritual shaping, Christian mission has had a beneficial and still fast growing influence. It may therefore be expected that Irian will in 25 or 50 years, time be entirely a christiun country , through which the contrasts between Irians and Indonesians will be int ensified even more,

On account of t he Netherland administration having had from the very beginning a protecting and educational character in Irian and as colonial exploitation or imperialism is out of the question in this island with its - just as in Australian New Guinea - for the present yet extremely unfavourable condi­t ions of economic development, intimate relations of coopera­tion and confidence have beerr created between the Netherland administration and t he Iria ns, This sphere of cooperation has never existed between Irians and Indonesians and it is not probable, that - at any rate in the near future - a change will be brought about i n this.

Naturally also the Irian people longs for the moment when as an independent state she will be able to occupy n place in the Circle of nations and she will exert itsclf10the utmost to nccelerate this moment. But the Irian people wishes to con­tinue t he process of development to that goal along the safe road, along which it has so far proceeded in cooperation and under leadership of Uestern Netherland.

She t herefore for t he present ~rishes to become part of the renewed Kingdom of the Netherlands.

Irian, however, opposes with all her might the imperialis­tic inclinations of a number of Indonesian political leaders, which aim at bringing our country and our people under the domi­nation of a f ore ign people and a foreign state with which it has never ke pt up friendly relations and relations of coopera­tion of any kind. She determinedly and resolutely refuses, · to be negotiated a s an piece of· merchandise, without being heard, to the Re public of t he U. 3 .I. and to become parLof it.

It is sometimes 11 doubted'•1 whether the Irian people has to be deemed capable of exercising the right of self-determina­t ion .

But t his pretext is being adduced by said Indon. politi-· cal leaders in order to bring us under their imperialistic yoke. And also the Netherland Government evidently likes to make use of this argument, so as to be able to use Irian as a pawn at the Hotherland-Indone sian chessboard.

It is true , that a large part of tho people of Irian has not yet reached the standard of civilisation, at which a consultation about· its future may be tried succesfully with the whole Irian people.

But the same holds good with nearly all other peoples of the former IJet herlands-Indies. Have the tens of millions of illiterates of Indonesia perhaps reached a standard of civilisa­tion which makes them fit to consider pplitics independently.

The wellknown Republ ican journalist Rosihan Anwar wrote on this subject in the Republican paper .iip•edoman11 , published in Batavia, with a view to the Hague n.T.c. the following article: nFor the people 11 - according to Anwar - are not yet politi­cally conscious and still see in the leaders, the ndoro-ndoro ( great gentlemen) of yore·, with their fetjdal power and their yellow pajongs (umbrella). Indonesian society has in essence · kept its fe ttdal character and as such republican as well as B.F.O~­leaders have a decisive influence,as they are acknowledged by the people as 11 fetldal lords\'; Terms as 11 complete, real and unconditional independence 11 cannot be understood.by the people. The people will not leave its apathetic attitude, if in the future it would~ come about, that the changes held out to them now do not come true. ··

It· will bear its fate passively as a predestined disaster of Nature. May the ndoro-ndoro presently in the Hague take this to heart·, said Rosihan Anwar in the influential Republican paper Pedoman.

Is it not ·a wellknown fact, that the Christian Irians are at a higher level of development than tens of millions of illiterates in Java and elsewhere?

Therefore is it not the same everywhere in the Archipe­lago, that only a small intellectual 11 elite 11 is able to form' .7 an opinion about the range of the right of self-determination.

And in many regions of the Archipelago the r~tio be­tween the very small intellectual "upperten11 and the large mass of the population is even more unfavourable than in Irian. For that matter, has there ever in the Republic and the other· politically organised Indonesian territories (so-called B.F , O. territories) taken place a plebiscite~ from which could be de­duced the real will of the population.

And will not the sovereignty be transferred there too into the hands of a very small elite of university men and men with a secondary'·schooltraining; who altogether do not com­prise more than0~0035 percent of the whole Indonesian popula­tion?

Why then ·should the as yet small part of our people, _ which is able to take thought of its future , not as everywhere else have the right to speak for their compatriots who are as yet less educated / · \lhy should the intellectually more developed part of the Irians not have the right to demand that their aspira­tions, of which ·mention has been made in Article 73 sub J2. of the Uno charter, are taken into account in case of the develop­ment to self-government?

Is it because those who refuse it, wish to realize their own imperialistic designs with our country and people. One thing is certain! · t

All sons of Irian, who have reached a mental stand , ard through which they have become politically conscious, ref se determinedly to accept.their being degraded to a colony at a moment in worldhistory, where colonial fetters are being loosened. . ..

And a colony moreover of a state which has not yet shown to be able to exercise a decent government over its own peoples, let alone over a foreign p~ople such as Irian.

It is upon these grounds, which we are prepared further to elucidate either by word of month or in writing, that we urgently request your High Council to turn into a reality the basic principle of the Charter of the United lJ2tions: ·•1the right of selfdetermin2.tionn acknowlsqged everywhere.

We declare as our wish to r emain for the time being under the Netherland Crown and we add to this, that we will never subject ourselves to the yoke of Indonesia, when this will be forced upon us against our will, neither will we ac­cept a possible condominium •

I herewith have the honour to acquant your Comm.ission of' the following:

a. in an officinl announcement of the Nethe rlancl s Government; dated De.t avia 27th M:ay 1949 and bearing the number 10625/AGGO 6, it was made knovm that the Netherlands Government must let the destination and status of Irian (New Guinea) depend on · the results of deliberation already made or get to be made, where with deliberation were obviously meant deliberations with Indonesian representatives. ·

b. in t he communication of the Netherlands Government, as meant re§:, it was further noted that She cannot take a one­sided decision as to the status of New Guinea, as this wo~ld be contrary to article 209 of the Netherland Constitution, which stipulates that the Government is bound by the results of deliberation with the party or parties concen1ed.

c. from well informed source it was heard, that the Net­herlands Government would favour a joint Netherland-Indonesian Government of New Guinea, the plans for which would be in an advanced stage.

On account of the above I beg to inform your Commission the :following :

1. as regards chapter§_: The results of such a delibera­tion cannot be deemed acceptable to my people as my people cannot-either dire ctly or indirectly - acknowiedge any right of the Indonesians to· mix in any matter concerning the future of Irian (New Guinea). ·

It is evi dent, th~t a simular deliberation, clad with whatever motives, can never be stamped as a democratic and legal procedure,. · ·

If the Netherlands Government, rightly for that matter, accepts the standpoint, that by taking any poJ.itical decision concerning the new legal forms deems herself bound by the re­sults of deliberations made or yet to be made, that as far · as Irian (New Guinea) is concerned these deliberations had to be made with r'epresentatives of the people of Irian (New­Guinea) itself.

If the Netherlmids Government asserts, that the Irian people 11 cannot have an opinion of their ovm 11 , which assertion for that matter has only in very limited measure any foundation of truth, that is in the measure that the Irian people is to my own convictim not yet ripe for full independence, but she is quite able to give her opinion regarding any ties with Fede­ral Indonesia, then she ought to have refrained from any action against and intimidation of Irian leaders of the people, who have through a sufficient process of emeneipation to be able to voice opinions whibh represent the real wishes of the people,

2. One may feel surprised that tho Netherlands Government hinders the Irian people in the exercise of their democratic rights altbug.p the Netherlands Government is quite well informed of the fact, that Irian People values, a cooperation with the Netherlands, for the present as a part of the renewed and a democratic Netherland Kingdom.

In the light however of the Netherland intentions to create a 11 condominium·' vii th · a view to various economic and above all financial advantages, this attitude of the Netherl ands Govern­ment need not call forth surprise~

She is trying, by the line of conduct following up to now, to make the Irian people accept a condominium unconditionally by foreign a 11 blitzkriegi7 down her throat. . 3. Re chaptc.r b;. ~J1e_ term ·•1onesided decision11 , as inserted in the letter conce:rHed of the Netherlands Government, is ob­viously meant to underline her 11 democratic 17 intentions. As an explanatory statement must be added that the letter in question was addressed to a number of Eurasian organisations, whith ad­vocats transmigration of Eurasians to Irian (New Guinea), from · which organisations I got a copy of said letter. It is evident, that the sincerity of the Netherlands Government as regards Irian (New Guinea) has been sufficiently explained by this term, as even before any politicdl shape of Indonesia was under con­sideration (before the Malino -conference) I have approached the Netherland Government· with regards to the fixing of the status of Irian ( Now Guinea) •

Via.reever I have repeatedly urged the Netherlands Government to take up deliberat~ons with the representatives of the people of Irian, without the Net ·herlands Government paying any atten-tion to these requests. ·

A onesided decision of the Netherlands Governmemt , would if such a decision would violate the wishes of the Irian people, never be acknowledged aqd accepted by me, as for a decision of the Netherlands Government which would be accepted ty ·me and my people naturally deliberations with the population, or at any rate a proceeding in .accordance With the voiced opinions of tho people would have been a thing understood.

Tho Netherlands Goven1ement however has scrupulously avoided every and any deliberation with the people under the motif ,;·those· people are too great blockh'eads yet, they are pure sa­vages 11 . And suchlike intimidations.

4. Re chapter c~ with regards to chapter c it is evident that a ponsililc participation of an Irian delego.tion in the l1ound Table Conference shortly to be held will not produce favourable

results, as there are symptoms pointing to the fact, that an own delegation in spite of its presence at the conference to set forth and explain her standpoint will yet be dictated a 17 solution11 contrary to its original wish.

That deliberations between the Netherlands Government and Indonesian representatives for the Irian people cannot bring any satisfactory solution is evident, when one knows that the Netherlands Government which principally wish to hold on to the results of the deliberations already made with the Indo­nesian representatives ,'·as amongLis clearly shown in article 65 of the B.I.0.-decree. ·

\Jith a view to above I request your Commission to take the necessary steps in order to prevent that the Netherlands Government goes on following the same · procedure in the policy with regards to my people as hitherto, which procedure is diametrically opposed to the principles of the Charter of the United Nations including the right of·self-determination.

I would further greatly appreciate, if your Commission would give notice to the Netherlands Government, that the status of Irian (New Guinea), either at ·the coming Round Table Conference - or outside this Conference, should exclusively depend on the results of the results of the deliberations with the representatives of the people of Irian, to be held under the supervision of the United Nations .

It is my innermost wish to voice the hope that yuur Com­mission; ~s the representative of the United Nations in these countries, will be given to your Commission to do justice to my people. ·

The Irian Political Representing Body, thereunto authorized by the greater majority of the Irian political and spiritual leaders of the Irian population in North, South , East and 1/est Irian (Netherlands New Lruinea) , which belongs to the territory of Netherlands-Indies \Indonesia) which by virtue of article I of the six Additional Articles of the Renville-agreement and the treaty of Linggardjati is under the sovereignty of the Netherlands­lndies, until this sovereignty will be transferred, requests, especially with a view to the Hague Round fable Gonference, the attention of the High Assembly for the under mentioned .

In an official declaration dated 27th May 1949 under No . l0625/AG80 6 of the Netherlands u0vernment it has been expounded, that the Lrovernment makes the future status of New uuinea dependent upon the result of the deliberations already held or yet to be held between Netherlanders and Indonesians, however not between Netherlanders and Irians . 1n this statement of the Netherland u0vernment it is said, that she cannot deviate from this line of conduct, because this would be contrary to the Netherland constitution, in which this deliberation has been dictated as binding .

we make known to your High council, that this is unacceptable to the people of lrian and that our people deny the Indonesians every and any direct or indirect right to exercise the slightest influence whats6ever upon the political position of Irian or to arrogate to themselves in any way rights over Irian.

Suchlike deliberations with the exclusion of the population of Irian, as is now taking place ~t the Hague Round Table Conference , is evidently undemocratic and a procedure which is in flagrant violation of the right of self-determination of the peoples .

When deliberations have to be held regarding the future of Irian, this ought to (as , with reference to enclosure 1, has already been intimated to the Unci) - take place between Netherlanders and the Representatives of Irian, who are quite competent to intimate their desires as to the relations which will be established in the future between themselves , Netherland and the Republic of the U.s.r .

Repeatedly - (reference: enclosures No . l to) we have intimated our wish to remain allied to the Kingdom of the Netherlands and anyhow, under no condition to be incorporated in the Republ. of the u.s.r. under construction.

A condominium is unacceptable to us , because experiences with a condominium in other territories of the world do not tempt us to imitate such a joint government. We do not wish the people of Irian to suffer for it . (In this connection we may as well refer you to enclosure No . l) .

'.'le have in the past, even before there was any talk of a political shaping of Indonesia on a basis of the federal principle (already in beginning of 1946) , repeatedly applied to the Netherland Government with the request to fix the status of New Guinea and to deliberate on this matter with the people of Irian. However, notwithstanding our repeatedly pressing the necessity of it , the Netherland Government has not passed on to that.

In this connection we may once more refer to our letter to the Unci of 15th June 1949, as contained in the enclosure No.l.

Therefore we address ourselves to your High council in virtue of Article 3 of the Atlantic Charter and Article 73 b of the Charter of the United Nations, in which the right of self-determination of the nations has expressly been acknowledged as the basis of a Political world order, with the earnest but urgent request that your Council may effect, that also to the people of Irian the real practising of the right of self-determination is to be made possible and assured.

Explanatory Statement.

To support this request we have the honour to bring the undermentioned to your attention.

The isle of New Guinea, although partly belonging to the territory of the Netherlands-Indies, does in no respect whatsoever belong to the Malay or Indonesian Archipelago. lrian, the Netherland part of New Guinea, forms , just like the Australian part of this island, an independent geographic unity , sharply distinguished from the Malay Archipelago as well as from the Gontinent of Australia, what in the end should find expression also ,in its political formation and status.

'l'his development, which cannot be averted, also is a logical consequence of the great ethnographic differences with the Indonesian race. As may be considered sufficiently known, the peoples of the Malay Archipelago, notwith­standing differences in history, language, religion and customs, all belong to the Indonesian race. There exists among them a certain feeling of "belonging together" .

The future has yet to show whether it will be possible to unite these peoples in an independent state under a national government .

But it is unquestionable that the differences between the Irians and Indonesians are so great as to make every thought of incorporating us in the national union of an Indonesian state absolutely impossible .

For the Iria.ns belong to a wholly different race , with physical and mental qualities quite apart from tb6se of the Indonesians , while there having never been historical ties betvrnen the Irians and the Indonesians , which might have smoothed over the differences in the course of time .

on the contrary, the contact with Indonesians has led to an intensifying of the contrast . Now Irian has not been taken into the colonial sphere until quite recently through which she has come into contact with world traffic . This happened at a point of time , when the colonial powers, and among them Netherland, became more and more conscious of the moral obligations they had towards the peoples committed to their cares and protection.

Rather from the very start, so from the beginning of the twentieth century, the Netherland govern~ent has therefore - at any rate in lrian - principally allowed themselves to be led by their educational task and their endeavours have chiefly been aimed at the gradual adaptation of the population, mentally as well as materially, to the world civilization, in which as regards the spiritual shaping, Christian mission has had a beneficial and still fast growing influence . It may therefore be expected that Irian will in 25 or 50 years , time be entirely a christian country, through which the contrasts between Irians and Indonesians will be intensified even more .

On account of the Netherland administration having had from the vecy beginning a protecting and educational character in Irian and as colonial exploitation or imperialism is out of the question in this island with its -just as in Australian New Guinea - for the present yet extremely unfavourable conditions of economic development, intimate relations of co-operation and confidence have been created between the Netherland administration and the Irians . This sphere of cooperation has never existed between Irians and Indonesians and it is not probable, that - at any rate in the near future -a change will be brought about in this .

Naturally also the Irian people longs for the moment when as an independent state she will be able to occupy a place in t he Circle of Nations and she will exert itself to the utmost to accelerate this moment. But the Irian people wishes to continue the process of development to that goal along the safe road, along which it has so far proceeded in cooperation and under leadership of ;estern Netherland . ·

She therefore for the present wishes to become part of the renewed Kingdom of the Netherlands.

Irian, however, opposes w-ith all her might the imperialistic inclinations of a number of Indonesian political leaders, which aim at bringing our country and our people under the domination of a foreign people and a foreign state with which it has never kept up friendly relations and relations of co-operation of any kind. She determinedly and resolutely refuses, to.1be negotiated as an piece of merchandise, without being heard, to the liepublic of the U.S.I. and to Qecome part of it. 1

It is sometimes 11doubted11 whether the Irian people has to be deemed capable of exercising the right of self-determination.

But this pretext is being adduced by said Indon , political leaders in order to bring us under their imperialistic yoke . And also the Netherland Government evidehtly likes to make use of this argument, so as to be able to use Irian as a pawn at the Netherland-Indonesian chessboard.

It is true, that a large art of the people of Irian has not yet reached the standard of civilisation, at which a consultation about its future may be tried successfully with the whole Irian people.

But the same holds good with nearly all other peoples of the former Netherlands-Indies. Have the tens of millions of illiterates of Indonesia erhaps reached a standard of citilisation which makes them fit to consider

politics independently . 'l'he well known Republican journalist Rosihan Anwar wrote on this subject in the Republican pa er II edoman" , published in Batavia, with a view t o the Hague R,T.C. the following article:

11 For the people" - according to Anwar - are not yet politically conscious and still see in the leaders, the ndoro-ndoro (great gentlemen) of yore, with their feudal power and their yellow pajongs (umbrella) . Indonesian society has in essence kept its feudal character and as such republican as well as B. r· .o . leaders have a decisive influence, as they are acknowledged by ham the people as "feudal lords 11 • Terms as 11 complete, real and unconditional independence 11 cannot be understood by the eople. The people will not leave its apathetic attitude, if in the future it would come about, that the changes held out to them now do not come true .

It will bear its fate passively as a predestined disaster of Nature . May the ndoro-ndoro resently in the Hague take this to heart, said Rosihan Anwar in the influential Republican paper . edoman.

Is it not a well kno·.m fact, that the Christian Irians are at a higher level of development than tens of millions of illiterates in aava and elsewhere ?

Therefore is it not the same everywhere in t he Archipel ago, that only a small intel lectual 11elite 11 is abl e to form an opinion about the r ange of the right of sel f-determination ?

And in many regions of t he Archi pelago t he ratio between the very small intellectual 11upper ten" and the large mass o'f the population is even more unfavourable than in Irian . For that matter , has t here ever in the Republic and the other olitically organised Indonesian territories (so- calle~ B.F.O. territories) t aken l ace a l ebiscite, f r m hich could b deduced t he real will of the population.

And will not the sovereignty be transferred there too into the hands of a very small elite of university men and men with a secondary school training, who altogether do not comprise more than 0 .0035 per cent of the whole Indmnesian population?

v'Vb.y then should the as yet small part of our •. people, which is able to take thought of its future, not as everywhere else have the right to speak for their compatriots who are as yet less educated?

fuy should the intellectually more developed part of the Irians not have the right to demand t hat their aspirations, of which mention has been made in Article 73 sub E. of t he Uno charter, are taken into account in case of the development to self-government?

Is it because t hose who refuse it, wish to_.realize t heir own imperialistic with. our country and people. One thing is certain t

All sons of Irian, who have reached a mental standard through which they have become politically cqnscious , refuse determinedly to acce~t their peing degraded to a colony at a moment in world history , where colonial fetters are being loosened.

And a colony qi.oreover of a state which has not yet shown to be able to , exercise a decent government over its ovm peoples, let alone over a foreign

It is up6p these grounds, which we are pre,ared further to elucidat e either by word of mouth or in writing, tbat \Ve urgently request yo'Ur High Council to turn into a reality the basic principle of t,he Charter of the United Nat i ons : 11The rigl;lt of self determinat i on11 acknovrledg~d everywhere .

vve declare as our wish to remain ior the time being under the Netherland Crown and we add to this , that we will never subject ourselves to the yoke of Indonesia, when this will be forced upon us against our will , neither will we accept a possible condominium.

I herewith have the honour to acquaint your Commission of the following:

a. in an official announcement of the Netherlands Government, dated Batavia 27th May 1949 and bearing the number 10625/AGGO 6, it was made known that the Netherlands Government must let the destination and status of Irian (New Guinea) depend on the results of deliberation already made or get to be made, where with deliberation were obviously meant deliberations with Indonesian representatives .

b. in the comnrunication of the Netherlands Government, as meant re!, it was further noted that She cannot take a one-sided decision as to the status of New Guinea, as this would be contrary to article 209 of the Netherland Constitution, which stipulates that the Government is bound by the results of deliberation with the party or parties concerned.

c . from well informed source it was heard , that the Netherlands Government would favour a joint Netherland-Indonesian Government of New Guinea, the plans for which would be in an advanced stage .

On account of the above I beg to inform your Commission the following: 1 . as regards chapter a: The results of such a deliberation cannot be deemed

acceptable to my people, as-my people cannot-either directly or indirectly -acknowledge any right of the Indonesians to mix in any matter concerning the future of Irian (New Guinea) .

It is evident, that a similar deliberation , clad with whatever motives , can never be stamped as a democratic and legal procedure .

If the Netherlands Government , rightly for )'hat matter , accepts the standpoint, that by taking any political decision concerning the new legal forms deems herself bound by the results of deliberations made or yet to be made, that as far as Irian (New Guinea) is concerned these deliberations had to be made wihh representatives of the people of Irian (New Guinea) itself.

If the Netherlands Government asserts, that the Iriah people 11 cannot have an o inion of their ownn , which assertion for that matter has only in very limited measure any foundation of truth , that is in the measure that the Irian

eople is to my own conviction not yet ri e for full independence, but she is quite able to give her opinion regarding any ties with Federal Indonesia, t hen she ought to have refrained from any action against and intimidation of Irian leaders of the people, who have through a sufficient process of emancipation to be able to voice opinions which represent the real wishes of the people.

2. One may feel surprised that the Netherlands liOverrunent hinders the Irian people in the exercise of their democratic rights although the Netherlands liOVernment is quite well informed of t he fact , that lrian People values, a cooperation with the Netherlands, for the present as a part of the renewed and a democratic Netherland Kingdom.

In the light however of the Netherland intentions to create a 11 condominium11 with a view to various econoznic · and above all financial advantages, this attitude of the Netherlands uovernment need not call forth surprise.

She is trying, by the line of conduct following up to now, to make the Irian people accept a condominium unconditionally by foreign a 11blitzkrieg11

down her throat.

J. Re chapter b: the term 11onesided decision", as inserted in the letter concerned of the Netherlands uovernment, is obviously meant to underline her 11democratic 11 intentions. As an explanatory statement must be added that the letter in question was addressed to a number of Eurasian organisations, which advocates transmigration of mrasians to Irian (New Guinea), from which organisations I got a copy of said letter. It is evident, that the sincerity of the Netherlands uovernment as regards Irian (New Guinea) has been sufficiently explained by this term, as even before any political shape of Indonesia was under consideration (before the Malino-conference) I have approached the Netherland uovernment with regards to the fixing of the status of Irian ,New uuineaJ.

Moreover I have repeatedly urged the Netherlands uovernm.ent to take up deliberations with the representatives of the people of Irian, without the Netherlands uovernment paying any attention to these requests.

-CABLED TEXT OF A LETTER, DATED AUGUST 13th, 1949, FROM THE NETHEm.ANDS

DELEGATION TO THE UNITED NATIONS COMMISSION FOR INDONFSIA.

"Sir,

I have the honour to inform you that the Government of Indonesia have received information of following infringements of cease tire agreement by Republican armed forces.

1. Since August 7th at daybreak Republic81l armed forces have started armed disturbances in town of' Surakarta (Solo), which developed into a coordinated action on a large scale amounting to an attempt to disturb order in town and possibly to occupy to'Wll before cease f'ire entered into f'orce. These disturbances continued intermittently until entry into force on midnight of August 10/11. Firing t)len died down, but af'ter that Republican armed forces continued to commit hostilities in sense of' art. 3 of' "manual" by mine laying and putting up barricades, which in course of next day (August 11th) were gradually pushed forward up to centre of town. Although Netherlands troops would have been entitled to take defensive action against these hostilities they displqed a great self restraint in withholding tire in fac e of this provocative action. Contact was at last established with local TNI CoDJDander, Lt. Col. Slamat Riadi, lilo declared, that he was not in possession of regulations for implementation of cease tire agreement. Lt. Col. Slamat Riadi was finally persuaded to withdraw his troops trom tolll..

2. .lt the same time the following event occurred in and near Surabaya. On August 11th, 1949, at about 01.00 hours, f'rom direction of Maganti (12 to 15 km. West of Surabaya) units of 107 Battalion Division I TNI under coDID8lld of Major Djarot seized a motor vehicle of' the Royal Dutch Shell group (BPM). A group or said llllits consisting of about 65 men drove to the to-wn ot Surabaya and dispersed in Eastem quarters ot town. At same time about 200 men of same ba'lkl.ion appeared in groups in centre and Western sector ot town. Nearly all of these men, including their Commanding Officer, Major Djarot, were taken into custody.

3. At Modjokerto Republican armed forces the 11th August penetrated and infiltrated into town, thus improving their positions in relation .to Netherlands troops in contravention ot cease fire agreement.

4. Netherlands military authorities have furthermore received several indications that similar tactics amounting to violation ot status quo are being applied at different places throughout East Java. Written

orders and several other documents proving the above contentions were found on members of Republican armed forces concemed who were apprehended by Netherlands t,:,pppe. From foregoing facts following conclusion must be drawn.

I. Information received up to now by Netherlands armed forces and corroborated both by eyewitness accounts and by captured documents prove that at least in Sura.karta, in Surabaya and in Modjokerto, Republican armed forces have after entry into force of cease f'ire agreement tried to improve their positions at expense of Netherlands forces, either by pushing forward their posi ti.one or by penetrating into Netherlands..held to1111s, thus violating status quo and acting in contravention of cease fire agreements. These infringements were rendered possible by the fact, that Netherlands troops did not retaliate by firing as they wuld have been entitled to do.

II. From facts mentioned, conclusion must be drawn that these events do not constitute il!IOlated incidents but fonn part of a wider scheme to be applied at other places in East and Central Java. This conclusion is substantiated by documentary evidence f'olllld on commander of penetrating elements at Surabaya, photostatic copies of which can be procured. Up to now Netherlands .forces have withheld fire in face of these facts, which could reasonably be expected to provoke them; they have done so in order from their side to contribute their utmst to prevent a resumption of firing. It need not be emphasized however that situation created is highly explosive and requires inmediate action on part of the UNCI. Hence the Netherlands Delegat Soa urgently requests you as Chairman of UNCI and Chairman of Central Joint Board in interest of preservation or cease fire and in order to prevent dangerous developments to take following action forthwith:

To instruct military observers in East and Central Java, and particularly in towns mentioned, to render themselves on spot, to observe facts mentioned above and to report thereupon;

B. To instruct said IIUita.ry observers wherever these facts are f Olllld to be correct to take ilmnediate measure to put an end

In view of' serious situation which has arisen I regret to have to inform you that in order to keep in constant tioath with course of events it is impossible for me to attend meeting ot the Central Joint Board, scheduled tor todq, l3 August 1949 at Jogjakarta, I would greatly appreaiate though, if you would be kind enough to arrange for a meeting ot Central Joint Board at Batavia if at all possible on today 13 August 1949 or otherwise on Sunday, August 14th, in order to discuss above events, I must moreover bring to your knowledge that,

In night or lcYll August 1949 20 desah-heada together with 13 ot their clerks were kidnapped by TNI units in area of delta of Sidohardjo. It should be particularly noted that 18 of these were led over the Kali Perong after 111.dnigbt (August ll zero hours). In night of' 11/12 August another 3 Iuras (desah-heads) and two Tjariks (clerks) were also kidnapped. It should be noted that these acts ot terrorism took place in area Perong, where peaceful conditions had prevailed during the last few years.

I would highly appreciate if you wuld conmunicate the above to the Chairman of' the Republican Delegation.
