Limited (MDL) certify that:

a) The Project is in compliance with all applicable E & S Requirements as described in the investment agreements, and all actions required to be undertaken pursuant to the Environmental and Social Action Plan (ESAP) and any subsequent supplemental action plans. (where applicable: with the exception made for those that have been disclosed in Section VI in this report).

b) In relation to the Project there are no:

Circumstances or occurrences that have given or would give rise to violations of E&S and labor Laws or E&S and labor Claims;

Social unrest, local population disruption or negative NGO/media/activist campaigns or activities against the project.

Throughout the Construction phase, MDL ensure both the Project Management Services Company (SPADPS) and the Main Works Contractor (BTJV) have acquired adequate human resources to manage health & safety and environmental & social aspects of the Project. During the reporting period, the Contractor’s OH&S team has expanded to 15 personnel (covering day and night shifts) closely working together with 6 SPADPS dedicated OH&S personnel. Along with total 21 OH&S personnel, there are a total of 5 E&S personnel. Organisation charts of OH&S and E&S units are provided in Appendix 1. With construction activities becoming more complex, the Main Works Contractor has been providing site supervisors and workers with adequate relevant safety trainings covering a wide range of topics from general ‘safety induction’ to very task-specific training such as ‘erection & dismantling of tower cranes’, ‘confined spaced training’ and ‘lifting operations’. In addition to safety training, a positive

additional practice in this project is that environmental topics are combined into Safety Induction making all workers well aware of good environmental practices. A summary of HSE training is provided in Appendix 2. During the reporting period there were 2 significant incidents, and these are:

a. On 18 January 2020, an argument between 2 workers led to a fight and one worker was stabbed by the other. While not seriously injured, the police were called, and upon further investigation and legal action was conducted by the relevant authorities. Both of the involved workers contracts were terminated as per Labour Law due to grave misconduct. The Main Works Contractor’s Incident Report is given is provided in Appendix 3.1.

b. On 31 March 2020, the last day of this reporting period, a Workers’ demonstration occurred at/on site. The number of workers involved are estimated to be between 700 and 800 workers, of more than 2000 present that day. The issue was managed well with full support from local authorities and resolved in the same day. The site activities resumed in the afternoon and the Main Works Contractor’s Incident Report is given is provided in Appendix 3.2.

Throughout the reporting period, numerous consultations were undertaken with affected communities in the surrounding area of the Project which are St. Gabriel’s Church, residents to the north of the site, Sule Shangri-La Hotel and Bogyoke Aung San Market. The following table provides a summary of the major correspondence undertaken with those affected communities.

Whilst mitigation measures which had been reported as initiatives in the previous AMR are implemented on an ongoing basis, YCP underwent a number of new E&S initiatives this year. The list below provides a summary of key initiatives:

- Cleaning road and pedestrian walkway around the site every day by reinforcing manual sweeping every day.

- Cleaning the storm drain that wraps up the site along Bogyoke Aung San Road and Alan Pya Pagoda Road till at the point where it connects to the drain under rail tracks.

- Completed installation of acoustic fences to the West boundary. - Banned betel-nut chewing and smoking within site compound. - Include environmental awareness section in Safety Mass Toolbox Meeting which is usually

held up first day of the week. - Numbers of toilets are increased and installed on the site. - Cleaning of the storm drain wrapped up the site along Bogyoke Aung San Road and Alan Pya

Pagoda Road till at the point where it connects to the drain under rail tracks. - YCP submitted for Design Audit to obtain Preliminary EDGE green building certificate.

During the reporting period, only one complaint regarding construction noise was received and logged under the Grievance Redress Mechanism. Appendix 4 should be referenced for more details. It is to note that grievance #034 that was logged on 19th Mar 2019 remained open at the end of previous reporting year, and thus it was included in this year’s appendix just for record purpose only.

PS2. Labor and Working Conditions

During the reporting year, MDL made a few changes to its Human Resources (HR) policies and working conditions. In the beginning of 2020, the annual leave cycle that previously ran from January to December (calendar year) was altered to the new leave cycle from April to March next year. In response to Covid-19, MDL announced work from home guidelines on 18 March 2020 and started trialing work from home arrangements to all direct employees depending on the nature of works. MDL identified and arranged staffs who are at a higher risk of contracting the virus (aged over 70, pregnant women and those with underlying health issues) either to work from home or placed on paid leave if the staffs are unable to work from home due to the nature of work. For this reporting period, the average monthly number of employees working for YCP (excluding PYN Project workforce) was reported 1,814, and it is predicted that the number of employees on site will reach to its peak level in Q4 2020. The following table provides the monthly information about the Project workforce:

Gender Equality Measures Out of 1,814 number of total average employees, the average number of women employees is 163. Although it gives only 9% women employees in total which seems quite low, the higher percentage is exposed in terms of office jobs (as high as 63%) when the total number is broken down into ‘Office’ and ‘Site’ workforce as below.

Due to the Construction status of the Project, it can be seen from above table that it is difficult to create minimum 40% women employment in site-based jobs. Instead, MDL is making a concerted effort to address this gender imbalance by encouraging SPADPS and BTJV to employ more women for office jobs.

In terms of operational phase, MDL had officially signed with Marriott as business hotel operator to which we had already shared Gender Equality targets last year. On retail side, the same information will be shared with the mall operator which is yet to be selected. Status is summarized in the following table:

Ensure all workers involve installing formwork systems are to be adequately train by the manufacture. Workers to be adequately supervise and must be given proper instruction and the correct/safe method on performing their tasks. Ensure worker using lifting gears revives training on the proper and safe use. Delegated only operatives who have received training from the formwork manufacturer. Always consider ergonomics by ensure adequate working space at work location.

BTJV 7 A scaffolding sustained a left thumb fracture injury after his finger accidently trapped between the base plates of two shoring props (E55).

Reminder to all about paying attention to the task being undertaken and to check around while moving stuffs/materials. To be carried out on daily pre-task talk.

PS3. Resource Efficiency and Pollution Prevention

1. Liquid Effluent

Construction run-off and storm water are channeled to sump pits from which the water is pumped out to respective final treating systems that are concrete sedimentation tanks (which are denoted as discharge points in the figure below). Domestic wastewater from site offices and workers’ toilets is collected and treated by the temporary septic system. The sewage effluent is regularly collected by YCDC septic pumper trucks 2-3 times every week.

The Main Contractor has been carrying out monthly water testing as usual. Water samples are collected from final discharge points depending on the season of the year and the drainage plan. There were three discharged points according to the former site drainage plan (1, 2 and 6). The second drainage plan added three new points (3, 4 and 5). Point 6 is the treatment plant and moved twice within the reporting period. Baseline water sample was collected and tested from an upstream point in Jul’19. Starting from Jan’20, the baseline water quality testing (which is denoted as “Reference Bogyoke Manhole-2 (New)”) has been carried out every month as well. Locations of water quality monitoring points are shown in the map below.

In terms of annual averages, discharge point 6 (treatment plant) meets the wastewater quality standard in all parameters. For the remaining five samples (1, 2, 3, 4 and 5), the discharged wastewater meets the standards in all parameters except TSS. However, if we take a closer look at monthly results which are attached in Appendix 5, it can be seen that there were a number of failures to meet the standard quality

that amounted to 33 out of 288 times (about 11.46%). To keep all parameters meet the wastewater quality standard during the raining season, especially for TSS, it is understood that the Main Works Contractor will have to implement new and better developed site wide drainage plan for the upcoming year. The Project manager has notified the Contract formally reminding the Main Works Contractor formally of its obligations. The Contractor also tested samples taken from an upstream point in July 2019, January 2020, February 2020 and March 2020 to understand the quality of the existing water quality. The results advised that 4 of 6 testing parameters are significantly worse than the wastewater quality standard, as can be seen in Sample 7 of the above table. Comparing with these results, wastewater discharge from YCP is not considered to add a negative impact to the ambient water quality. In preparation of the upcoming rainy season, the Contractor has to implement the “2020 Site Drainage Plan” in which they propose the use of filtration screens in each partition of mobile sedimentation tanks. In order to improve the flow of storm water, the Contractor carried out the cleaning of the storm drain that wraps up the site along Bogyoke Aung San Road and Alan Pya Pagoda Road till at the point where it connects to the drain under rail tracks. The works started on 23rd Apr 2019 and completed on 5th Jun 2019. Next annual storm drain cleaning work is scheduled to be started in April for the year 2020. 2. Ambient Noise

Ambient noise is being continuously monitored by Bureau Veritas, which is appointed by the Contractor, at three points (shown in Figure 2 below) that represent the surroundings as follows:

LM1 (16°46'49.21"N, 96° 9'23.66"E) – Located in the Church compound to the west of the site to represent the Church.

LM2 (16°46'45.18"N, 96° 9'30.97"E) – Located at the SW corner of the junction of Sule Pagoda Road and Bogyoke Aung San Road to represent the hotels and residents on BAS Road.

LM3 (16°46'52.94"N, 96° 9'26.20"E) – Located in the residential area to the north of the site across railway to represent Yaw Min Gyi residents.

The average noise levels at LM1 and LM3 are within the permitted noise level while the level at LM2 is not. Because LM2 is located near one of the major crossroads in the city and because even the noise level at the nearest point LM1 is below the limit, we believe that the exceedance of noise level at LM2 is attributed to high vehicular traffic noise on roads. Therefore, it can be broadly agreed that the quality of noise was affected by the increase number of vehicles on the road. The Contractor’s current noise mitigation measures include:

Use of mobile noise barriers around noisy machinery/equipment and activities.

Revised method of cleaning pile boring bucket in place of shaking the bucket which makes a loud clanking sound.

Use of hydraulic cutting method for pile head cutting.

Placement of container offices on the site boundary as a further means of noise barrier.

Installation of insulated enclosure and cover to the on-site batching plant.

Erection of 4.5 to 7 meter high sound attenuating fences completed in the north and west boundaries.

Mitigation measures are reviewed on an ongoing basis in response to any non-compliance.

3. Ambient Air During construction phase, there is no point source air emissions on the Project site. However, MDL appointed Eguard from April 2019 to June 2019 and then switched to Environmental Quality Management Co. Ltd. (EQM) from July 2019 onwards to monitor the ambient air quality at three locations every month over 24hr period so as to provide an indication of whether it is impacted by the Project’s construction activities. Locations of air monitoring stations are the same as noise meters (see Figure 2 above). Monthly averages of third-party monitoring are arithmetically averaged to provide annual averages that are given in the table below. Appendix 7 should be referenced for more details.

In terms of annual averages, NO2 concentration in ambient air is well below the guideline values at all monitoring points. PM10 concentration is below the limits at LM1 and LM3 points and is very slightly over the limit at LM2. SO2 concentration exceeded the guideline values at LM2 and LM3 where both locations are affected by traffic fumes from vehicles and trains. If monthly monitoring values are referenced in Appendix 7, it can be seen that the concentration of particulate matters, especially PM2.5, is significantly increased in the ambient air in dry season. Nevertheless, as reported in the ESIA report, PM2.5, PM10 and SO2 levels at all three points were much higher than the guideline values when the baseline air quality was measured in February 2015 (Table 5.9, section 5.5 Air Quality, ESIA Report – Sep 2018). This implies that the ambient air quality in downtown Yangon has long been affected even before the Project construction works were commenced.

The Contractor’s current air mitigation measures include:

Spray water throughout the site regularly and set up dust control cannons for demolition works.

Covers and water misting have also been installed over the batching plant and storage areas to minimize the spread of fugitive dust.

Around the site, concrete roadways or compacted sand has been installed to reduce the amount of dust produced from the soil movement.

During the reporting period, we conducted one fire drill, the full report of which is attached in Appendix 8.5. Since the Project is in construction phase, we do not expect community participation in our drills. More information on Life & Fire Safety measures is given in the table below. Since the site was handed over to the Main Works Contractor in December 2017, the Contractor has taken charge of the site security. The site is fully secured with hoardings, and both pedestrian and vehicle access in/out are strictly controlled by security guards at each entrance.

Investigation Report – Site Demonstration 31/03/2020

Executive Summary

The reason for this demonstration appears to come from some workers information from the internet

that some garment factories and small business/site closed their premises temporarily, due to risk in

spread of coronavirus, from 01 to 30 April with full pay of their wages. Workers are also concerned that

they may not be able to access public transportation to go home and may face 14 days quarantine at

their arrival in their village.

Because of that information, some of the BYMA workers are afraid to come the site and would like to

their villages.

BYMA would like to advise the following:

The concerns and requests of the workers have been heard and understood. With the full support from

the local officials, parliament delegates, Assistant Director of General Administrative Department, Police

Officers and Immigration Officer from Pabedan Township, we have discussed and explained the

different nature between a construction site and other factories.

The following chronologically details key events:

1. 30 March 2020

The BYMA HR Department received phone calls from some foremen representing and

advising that almost all of the workers are planning to go back to their villages before

Water Festival holidays.

The BYMA site Superintendent has discussed with the foremen and workers zone by

zone and he requested them to stay and work on site. The workers accepted.

BYMA management issued a MEMO relating to the Precaution and Guideline of COVID

– 19 by 4:30 PM and posted on the noticeboards. The MEMO requested careful

consideration about traveling out of Yangon during water festival and potential risk to

be quarantined before being allowed to rejoin the project. (See appendix – 1).

2. 31 March 2020

Some workers came to BYMA Head Office to enquire of HR whether the site would be

closed or not. During this meeting, some workers were already gathering at the worker

assembly area.

As some workers request clarification about the MEMO, the HR Department clarified

the MEMO details.

Details of the Incident on 31 March 2020:

7:45 - Some workers came to Head Office and requested to close the site for 1

month with full payment to each worker, due to COVID – 19.

8:00 - Site superintendent, HR and workers discussed the situation on site and HR

requested workers to elect 7 – 8 workers’ representatives to meet the project

management.

9:00 - Worker representatives of around 7–9 people had meeting with the BYMA

management and requested to close the site one month from 01 – 30 April with full pay

to each worker.

9:12 - BYMA Operations Director called the Employer’s Representative of the

project.

9:30 - Operations Director informed the Regional Manager to contact the Employer,

to keep him informed.

9:35 - BYMA Management and worker representatives started negotiation process

and made a first proposal. (see detailed information in ‘Negotiation’).

10:00 - Worker representatives discussed the BYMA proposal with the workers and

some didn’t agree to the proposal. Some workers stopped their work and came out on

public road to demonstrate their disagreement.

10:30 - BYMA Management informed Pabedan Township Police station and the local

Government representatives of the situation and requested to have their support to

calm the demonstration.

11:00 - The Government representative arrived at the project site. The Government

representative encouraged the workers to go back onto the site and invited BYMA and

the worker representatives to meet at the BYMA Head Office.

11:20 - Discussion and negotiation between BYMA Management, the Government

Representative and Worker Representative (see detailed information in ‘Negotiation’)

11:35 - BYMA Management requested the Government representative to have a face

to face meeting:

1. BYMA confirmed their motivation to keep the site open and as much as

possible in order to allow people that need salary for work and to avoid as

much as possible the spreading of Coronavirus within the Site and potentially

through Myanmar.

2. The Government representative fully understood and accepted the strategy.

3. BYMA then proposed to incentivize the workers with double pay under certain

conditions.

4. The Government representative accepted the proposal and proposed to make

the offer to the workers.

12:00 - The Government representative presented BYMA proposal to worker

representative.

12:15 - The Government representative announced the tri-party agreement (BYMA

Management, the Government representative and worker representatives) on the

worker assembly area where all workers were assembled.

12:45 - The Government representative and BYMA management openly asked all

workers face to face whether they agreed to the agreement.

13:00 - Asking all workers three times whether they still have any questions on the

agreement or not and they said “No Question, All clear.” Then again, asking all

workers to wave their hand if they agreed on the agreement and all workers loudly cry

out “We all agreed on the agreement” and waving their hands.

13:10 - All workers went back to their respective working zone and started their work

safely.

13:15 - The BYMA PR Manager stated the situation and the agreement in interview(s)

with the Media.

As we have been seen on the Media and Internet, it is estimated that the number of

workers involved are estimated to be between 700 and 800 workers.

4. The Government Representative involvement at the Request of BYMA

The Management kindly requested some Government representative to give support.

BYMA/BTJV have a strong support from the Government representative. The

representatives are as follows:

6. The Negotiation Process

Phase -1: The Management and Worker Representative

Worker requested BYMA close the site one month 01 to 30 April 2020 with full pay for

every worker.

Based on their concerns and requests, the management, to avoid the closure of the

project proposed the following statement:

1. The Site will be closed from 08 to 21 April 2020 with full pay.

2. Workers who would like to go home can take leave (Annual + Casual Leave)

from 01 to 07 April 2020 with full pay, workers without enough leave will be

allowed to take unpaid leave.

3. Workers who could not rejoin the site from 22 to 30 April 2020 will be allowed

to take unpaid leave.

4. Despite an agreement with most of the worker representatives, workers further

demonstrated and went on strike.

Phase – 2: The Government Representative, the Management and Worker Representative

Based on worker’s concerns and requests, after discussion with the Government Representative, the Management proposed the following:

1. The right to every worker to make their own decision whether they will continue

to work on site or stop

2. Double pay to those workers who are working from 01 to 09 April 2020 and

from 20 to 30 April 2020.

3. Full pay to all workers during public holiday (Water Festival) from 10 to 19 April

2020.

4. 50% of salary to workers who could not rejoin on site from 20 to 30 April 2020.

5. Workers who would like to go home can submit their leave form for 01 to 09

April 2020. BYMA will check their leave balance and will give full pay to those

workers who have leave balance and will permit unpaid leave to those workers

who don’t have leave balance.

6. Advance payment of salaries due to 19 April 2020 will be calculated and their

respective amount will be put into their bank account before 09 April 2020.

7. The Agreement

BYMA/BTJV and our workers have reached a satisfactory agreement with the strong

support of the Local Government representatives. (See Appendix - 2)

had interviewed with The Voice Journal regarding the demonstration by the workers at the Full

Rail way Building Site situated in the corner of BOGYOKE AUNG SAN Road on March 31st.

TVJ – Relate the latest situation for the demonstration of the workers in the site?

UTHU – It has been settled. In the beginning, the demand by the workers were different from

one another. Meaning that they wanted full payment and stay home for April. On the part of

the company, it was not possible to send back all workers as the government has not made any

announcement for the closure of the work site.

That is why the company requested the authorities of district council and Police to join in and

discuss with six or seven leaders of the workers and settle the dispute. The demands of the

workers which was to stay home in April and start work in May. We have to discuss like this

because their claim are not stated clearly in Labour Law.

TVJ – How was they settled?

UTNU – We have regular working days in April. To work till April 9th then Thingyan Holidays.

This start work in 20th.

The terms laid down by the Company was the choice to work during working days and earn

double payment of their basic wages. For example the normal payment of 4,000 will receive

8,000. The 8,000 normal payment will receive 16,000.Double their work charge.

Workers who will take leave can apply for leave. He will receive hale his daily wages. The

normal payment of 8,000 will receive 4,000. 4,000 workman will receive 2,000.

This wages is an example I am giving. I do not know exactly how much they are paid. This is the

way the Company had adjusted.

TVJ – Can they come back to work after Thingyan?

UTNU – Yes, work now and continue after Thingyan and will receive double payment of daily

wages. If they don’t come, they get have the 50% of their daily wages. For the previous day,

they had worked for and up to 19th April of Thingyan Holidays, their wages will be transferred to

their bank card. In that way the agreement was reached.

The discussion between the workers was practical with the calendar laid down in front of them

to which they did not understand clearly. The workers raised question to which they did not

understand clearly and finally the PR of the Company agreed to the final proposals after

reconfirming three times.

The final was those who want to go back home can apply for leave and go. Those who want to

work carry on with double payment.

TVJ – What about after April?

UTNU – They can continue work after April. They will not be fired or terminated. It will be

regular.

TVJ – Just to clear and one thing. Day after Thingyan, if they come for work after 20th April will

they be paid double?

UTNU – Yes, double. During April those who work the whole month will be received double and

there on leave half payment.

TVJ – How many workers?

UTNU – Over One thousand. About 1,800 I cannot count exactly.

TVJ - I heard the workers do not have sufficient masks for all.

UTNU - Nope, they did not demand on these purpose. We also alert them to stay social

distance during the time.

TVJ – Have you seen the workers were wearing mask there?

UTNU – Yes, some workers were wearing mask but some were not wearing mask so we also

alert them to ware it and be stay carefully.

Eleven Media

With the ongoing COVID 19 Virus, the construction workers of the BYMA Myanmar Company

demonstrated and demanded to close down for the month of April with full payment. Finally

the two sides sat down for discussion and an agreement was reached.

The construction workers of BYMA Myanmar Company situated in the corner of Bogyoke Road

and Sule Pagoda Road previously the Myanmar Railway Building now under renovation had a

demonstration 31st March Morning. The workers demanded that due to the ongoing COVID 19

Virus, the work site temporarily be closed in April receiving full wages.

On 31st March Morning around about 8am, the workers of BYMA Myanmar gathered in the

compound without working and demanded that the work site be temporarily shut down the

whole month of April with work given full pay.

Regarding to the demand of the workers, some leaders of the workers and the company

officials met and had discussions of closing down for the whole month of April, the work site

will be officially regarded on holiday from April 7th to 21st.

As the workers did not receive their full demand, they walked out of the compound onto the

Bogyoke Street and demonstrated for the closure of the whole of April.

A meeting between the Company officials and the workers was held and the local authorities

namely Yangon Division Parliament Member for Pabetan Township two members, Township

Council official, immigration official and Township police official were invited to attend.

Although a full wedge agreement of the workers was not met, understanding between the two

sides was achieved.

they cannot agree to all that we demanded. The mean fact that they were in a position to sit

down side by side and discuss the situation made by the workers satisfied with the outcome.

Of course there were a few facts which were in disagree e t. But ot u h. We, workers

a ted the full o th rest ith full pay.

Instead of the demand of the workers of closure of work with full pay for the month of April,

they will be entitled for leave from 1st to 9th April with application. If workers enter for work

they will be paid double wages. From April 10th to 19th as it is Government Official Holiday. For

the New Year they will be entitled full pay holiday.

From April 20th to 30th if the workers wish to rest, they will be entitled half pay only. If the

workers wish to work during this period they will have privileged with double pay wage.

An officer responsible for BYMA stated that the workers had agreed to the offers and the

meeting ended with the acceptance of both sides. He also mentioned that those who return for

work will not be expelled.

PR Manager Salai Van Zum Piang stated that, the orkers ere afraid of the spread of the COVID 19 virus and wanted to retrain from work. And we or our side tried our best to find a

solutio .

mason works, carpenters, iron and fittings and other labors.

• Level 1: Partial lock down of the city / heightened risk of Covid-19 spread as cases in Myanmar increases

• Level 1A: Partial lock down of the city / heightened risk of Covid-19 spread as cases in Myanmar increases Construction Site Closed, Office Open

• Level 1B: Partial lock down of the city / heightened risk of Covid-19 spread as cases in Myanmar increases Construction Site Open, Office (Sakura Tower) Closed

• Level 2 (Code Red): Lock down of the city / pandemic in Myanmar/ real risk of community spread.

1. Any staff working in any location.• If any positive criteria refer to hospital & recommend person returns home;

1. Employees: details recorded and added to YCP Covid-19 data log and YL data log (maintained by YL HR).2. Recommend individual visits hospital / self-isolation.

• Meetings: No meetings other than for Covid 19, safety, security, high risks and planning return to normality.

Business Continuity Plan (25 March 2020)

Business continuity plan Applicable for all BYMA areas 

I- Levels of Alert  

4 Levels of alert anticipated:

♣ Level 1:  Local transmission of the virus with several cases growing every day, Temporary closure measures in place eg. Schools closed, work from home arrangements in place.

Families of staff who wish to return to their place of origin or special place arranged by BOUYGUES May do so at the companies’ expense.

♣ Level 2: Major infectious outbreak occurs and families of staff mobilized by the company will be instructed to return to their place of origin or special place arranged by BOUYGUES. The business continuity plan is developed.

♣ Level 3: Rampant epidemic and staff will be gradually returned to place of origin in line with Business Continuation Plan.

♣ Level 4: Business closure: the employer/Engineer instruction or the authorities decide to lock down, few staff are kept during few days, to ensure the protection of our equipment and installations

II- Conditions to operate within the company :

- Level 1:

a) Weekly external informative meeting during tool box meeting of all the

workers b) WhatsApp management group need to be created for future purpose

related to Covid-19.

c) Bouygues  to  create  a  dedicated  APAC  security  team  to  manage  any 

Covid‐19 situation and is available 24/24. 

d) Myanmar has a specific WhatsApp group to engage with this team which 

includes the APAC CEO.

e) No Check hands

f) Hand sanitizer is available at the site main entrance

g) Mask are available at the workplace

h) Daily body temperature control are done at the entrance of projects and

offices. Anybody with fever (38 and more) or respiratory symptoms is not

allowed to enter the office or site and is requested to seek immediate

external medical advice as per authority requirement. If someone is

experiencing the above symptoms at any time (between daily

temperature checks) he will also be ask to seek the same medical advice

as mentioned above.

i) Training about hand washing are implemented

j) Corona virus Communication implementation

k) Quarantine period in line with Authority’s requirement are implemented

(up to now mainly from China with 4 peoples involved).

l) Limitation of large meeting, long meeting in confined environment,

training, events and gathering.

m) Informative session and training done by SAMITIVEJ.

- Level 2 :

a) Strengthening of our work places and collective space disinfection and/or

cleaning by using specialized company

b) Social distance of at least 1m to be respected

c) In all offices Interdepartmental trips must be limited as much as possible.

d) meetings outside the company's premises, are to be limited to what is

strictly necessary for the continuation of the activity

e) Rotating meal times to be implemented when possible.

f) The projects directors to submit for approval to Operation Director and

CFO their alternate  communication  plan  that will be submitted to the

Engineer on or before the 30 of March.

g) Possible home working and/ or split of the team to ensure continuity,

h) All travels for business, visa or training are suspended until further notice.

i) All personal travel abroad must be suspended or a mandatory quarantine

period respected after return (Quarantine period in line with Authority’s 

requirement are implemented). 

j) All staff coming from abroad will stay at Myanmar home/hotel during a

quarantine period. No contact with BYMA staff. Medical certificate from

SAMITIVEJ Hospital (11th floor) or ISOS to be granted and presented to

Bernie PUSUNG and Julien DELACOURT that will confirm access

authorization to site.

k) In case of Covid 19 staff infection suspicion the concerned staff may be

directed to SAMITIJEV Hospital or ISOS clinic for diagnostic.

l) Daily body temperature control are done at the entrance of projects and

offices. Anybody with fever (38 and more) or respiratory symptoms is not

allowed to enter the office or site and is requested to seek immediate

medical advice to accredited hospital in line with the health insurance. If

someone is experiencing the above symptoms at any time (between daily

temperature checks) he will also be ask to seek the same medical advice

as mentioned above.

m) Notice that the Work Force accommodation (WFA) will be closed during

THYINJAN and will be limited to BYMA workers after this period. The

families that include dependents (spouse and children) to return to their

villages as soon as possible. For the current period, BYMA will make sure 

the present rules are fully implemented in the labour camp. 

n) The following rules will be progressively implemented on the labor camp:

1 room is for 1 person  1 building for 1 zone (1 zone = T1 or T2 or TSCC,etc)  No mixes of zone on buses  Coloured tee shirt per zone to facilitate control  Temperature control at the entrance/exit  Plan to deliver food (due to families’ departure)  Special building for suspected case ( 1 people per room)  Heath management: Management protocol for COVID‐

19 to be strictly following ( produce by DoMS: Department of Medical Services, updated as of 6 March 2020. 

o) Hand scan system is shutdown, Site card are controlled

p) Access to site will be strictly limited to BYMA, SPA and YOMA staff, and

existing subcontractors.

q) Access to BYMA site office will be strictly limited to BYMA staff and existing

subcontractors.

r) Cancellation of all the training in confined environment

s) To avoid gathering and give priority to work with small groups.

t) Limitation of large meeting in confined environment :

i. 10 peoples maximum,

ii. Less than 1 hour,

iii. no face to face talk with less than 2 meter in between people

(equivalent to one seat out of three)

iv. The cleaning of meeting rooms is to be reinforced and controlled

by the management before any meeting

u) Meetings should be tentatively organized by videoconference, by

telephone conference or by means of the available collaborative tools

(teams, etc.).

v) All Foreigner’s staff families (children’s and spouse only) are instructed to

leave MYANMAR with the support of the administrative team.

w) Employees who have laptop are instructed to keep it with them when they

are absent from their workstations.

x) The existing WhatsApp management group need to be used for any

communication purpose related to Covid-19.

y) Engineers  of  YCP  and  PYN  to  create  emergency  WhatsApp  group  for 

urgent decisions.

z) Evacuation plan with ISOS support.

aa) Following zoning are anticipated to separate staff and workers accordingly

is applied on projects :

bb) The workers housed at the WFA are separate through different building to

achieve the same zoning.

- Level 3 :

a) key functions and staff required to secure the site(s) are identified and the

list is shared with the Engineers (Refer to staff demobilization plan)

b) In case of infection of 1 or few employees,

i. A meticulous inquiry is done, the staff (contractor, Subcontractor

and Engineer) that entered on contact are identified and

immediately placed under quarantine as per Authority’s 

requirement. 

ii. All new recruitment of staff or workers are stopped

iii. Subcontractors are instructed not to mobilize further workforce

iv. The zone or place where the infected employees were working

is/are disinfected and stopped for a duration of 14 days.

v. 3 sterilisation to be done in this area(s) before reopening.

vi. As long as stock are available, mask Covering  the  nose  and 

mouth are distributed at the workplace (both  in offices and on 

sites), particularly if working face to face, during meetings or in 

crowded areas. 

vii. In case of workers infection an assessment will be made in order

to decide with the Employer if the WFA should be closed and

related transportation by BYMA stopped

viii. BYMA will share his own record with the Engineer/Employer

c) Pandemic analysis on all sites is assessed by BYMA:

i. Then full quarantine of all staff/workers of the company will be 

ordered in line with Authority’s requirement.

ii. BYMA equipment and site are prepared and secured for a long-

term stoppage (refer closure action plan)

iii. Staff/workers will gradually return to place of origin.

iv. BYMA will share his own record with the Engineer/Employer

Level 3 c) will be ended only when the Pandemic sanitary situation of Yangon is considered as over by the Authorities.   

- Level 4 :

a) key functions and staff required to secure the site(s) are identified and the

list is shared with the Engineers (Refer to staff demobilization plan)

b) All activities are shutdown.

c) BYMA equipment and site are prepared and secured for a long-term

stoppage (Refer to closure action plan)

d) Staff return to place of origin

 Level 4 will be ended only with the cancellation of the received instruction(s) from the employer/Engineer or the authorities and the sanitary situation in the country of origin of our staff.   BYMA will have a local and oversea witness of the situations to organize the welcome and progressive return of staff and workers.  Activity will progressively restart with the return of staff and workers.  YOMA have decided to create, as a precautionary measure a quarantine location where BYMA/BTJV can put people if there is a suspected cases.  

III- General recommendations for all staff:

 - People are strongly advised to avoid crowded public places and unnecessary

travel, except to work, food or emergency.

- To stay away from people gathering,

- Social distance 1 m minimum

 IV- Communication to staff/employees/clients/Subcontractors

Any change of corona virus update or alert level will be communicated as follow: - Staff and employees will be advised by memo to be post on each office 

and sent by e‐mail to everybody. All manager will be informed through the existing WhatsApp’s group. 

- Clients and subcontractors will be informed as per contract requirement. The emergency WhatsApp’s group will be used too.

‐ It seems that it is a Business Stoppage Plan and not a Business Continuity Plan. There is no detail on restart. Please ensure you include this. 

 Answer: The level 3 explain how we will manage with re‐opening/ restart after infection if 1 or few zones.  As explained multiple scenario exist for the “after level 4”.I have updated our presentation to consider a remobilization to be done starting with the cancellation of the instruction in Myanmar and the situation in the country of origin of our staff. 

‐ It appears the strategy will be to close the site at Thingyan if not before, send the workers home (incl from the Workers Camps) and not restart after Thingyan. This is predicated on moving to Risk Level 3 which you intimated was imminent and then Level 4. Please clarify your intentions. 

 Answer: That is not what has been presented and clarified following Philippe CARDOT question. Please refer to the Conditions to operate within the company of BYMA Business continuity plan and more especially to the chapter level 2 part K and level 3 part b.vii  

‐ Issuing instructions to stop work can come from 3 sources – Employer/Engineer, Gov’t and the Contractor. Your presentation omitted BYMA (BTJV) from this and I was surprised by this as mentioned today. As custodian of the site(s) you also have the obligation to make decisions to close the site if necessary. This should be an option in your BCP but it is not. 

 Answer: As shown during our presentation of BYMA business continuity plan held on 18  March 2020, BYMA stoppage can occur at level 3 for a single zone (or department for office) or various zones (or department  for  offices)  depending  of  our  capacity  to  justify  that  only  a  group  of  people must  be quarantine.  

‐ During lockdown can you identify the key functions and staff required to secure the site(s)? There was no detail in this Plan. 

 Answer: refer to item V and VI of the business continuity plan. This information is prone to evolve, it will be shared and progressively revised with the Engineers if level 3 or level 4 are reached. 

‐ Also let me know if you need any Engineer support in this – it was missing. For example what records will be provided to the Engineer, etc etc to validate at closedown. 

 Answer: Please to refer to the Conditions to operate within the company of BYMA Business continuity plan and more especially to the chapter level 3 and 4 

Also BYMA would like support of YOMA, as local joint venture partner, to share information and facilities (i.e PUN HLAING hospital and any other business core owned by YOMA group susceptible to facilitate any action in relation with this crisis. 

A private partner with ISOS/Pun HLAING could, for example, be developed. BYMA having contract related to health and security in place with ISOS.

‐ The was no breakdown or plan between the different locations i.e. YCP (incl PYL), laydown at  SC  Zone  C  and  any  other  storage  locations.  Some may  work  for  a  while  after  other locations close down.  You did mention there could be partial shutdown of the main site. Please clarify. 

 Answer: all actions highlighted are applicable for all location/areas of BYMA. Please to refer to the Conditions to operate within the company of BYMA Business continuity plan and more especially to the chapter level 3. 

‐ What is the alternate communication plan i.e. main and deputies? We need this ready, and will overlay the YCP plan for this. 

 Answer: As presented into our BCP, this will be detailed and informed by Vincent and Marie Clotilde for the project teams. For the supporting teams I will be the one to inform. Our presentation highlight the 30th of March as informative date. Please to refer to the Conditions to operate within the company of BYMA Business continuity plan and more especially to the chapter level 2 J. 

‐ It was surprisingly lacking in specific detail for our project and while I hope we do not get to site closedown we need to be better prepared. This document was not fully baked and leaves large gaps in contingency planning. 

Answer:  SPA,  as  the  DSPL  partner  and  the  Employer  having  various  business  (including  in  health sector) are well aware and conscious about MYANMAR environment and also worldwide situation. 

Based on this knowledge,  it  is time for our  local partner, SPA, to strongly support BYMA locally by sharing those information and work together. 

BYMA Business continuity plan has been for the time being only prepared by DSPL and is based on an assessment  on  the  country  condition  that  included  health  infrastructure  capacity,  confinement capacity and sanitary condition. If Yoma could help with some information and commitment in term of health capacity (e.g. pun hlaing hospital), we could then give more specific details. 

As specific details example (that I highlighted) about the mobilization of gel and mask for our employee and  subcontractor. Our  stock  represent  23 % of Myanmar national  reserve. While  it  seems  to  be important it is only 25 days of production full speed and the available stock in Myanmar is currently half a day. We do not expect improvement. 

Based on our current information and situation, there is no further specific details can be committed. 

Note that the current Business continuity plan is elaborate based on previous successful plan that has been developed recently in HKG and many other countries.  

‐ What is the BTJV communication plan for changes in Risk Level? This is both within and outside your organization.

‐ Who are the responsible staff in the event to site(s) are closed down. What are their specific tasks? Who do we liaise with?

IPAs will continue to be issued based on works done, preliminary progress and any other costs that become due to this event. 

‐ How much day labour do you have and how are they tracked? 

 

This number evaluate on daily basis, we have on 24 March 2020, 2980 day labour. Each day labor have a contract that is signed with MOL and BTJV.  Human resources are tracking matricul, name, starting date, position, group, name of the leader, name of the foreman, Project, superintendant, date of birth, skill range, NRC, father and mother name, spouse name, number of children, phone number, address and salary and increase history   

Handscan has been shut down as per level 2 action plan and substitute by increase of time keeper number done by Site ID control. 

 ‐ What are you arrangements to pay the workers and day labour if they are sent home? 

Workers are paid through bank transfer. As per the law BYMA will at minimum pay during 4 months: 

o 13 days/month for daily contracts o 15 days/month for monthly contracts 

 

‐ Where are the site(s)? Last week I advised you some of these have no security in place.

What is the BYMA WFA crisis management plan (how do they self‐isolate, how do they test workers, how do they manage suspected cases, what type of health service are they offering)

Movement in and out of star city will begin to be restricted as the YOMA risk level increases to Level 1, BYMA needs to come sit down with TED management to understand how this will impact their business     

Please let us know the name of the responsible person with should meet with and few date options and share the risk level definition and action.  

BYMA needs to add extra security guards at TED main entrance and WFA entrance to ensure all temperature checking is being completed, unit the WFA is closed  

BYMA is doing temperature checking when workers arrive on site and arrive in the labor camp. People that stay in the labour camp for any reason are controlled 2 times a day.  We can however discuss with TED the best place for the temperature check, either at TED gate or at labour camp entrance.   

BYMA needs to communicate the exact numbers of people living inside of WFA, how many will return after Thingyan  

Labour camp is housing 518 peoples which include 120 dependents and 398 workers.  As of 25th of March, 35 % of the dependants already departed with BYMA support. All workers shall return back to the labour camp after THYINGAN.  

What is the expected date WFA will be closed  

If we close the thyingan (we are studying to keep the projects open during that period), then the labour camp will be close from the 10 of April up to the 17th of April. During that period a sanitization is paned to be done.  

BYMA needs to confirm a exact date that all workers will be removed from the WFA  

As mentioned above 10th of April but we are studying the possibility to work during Thingyan.  

  BYMA needs to ensure that if the WFA is closed that there is not 900 people left homeless 

that are in star city, all people living in the WFA must be removed from the Star City Estate by BYMA

Permanent closure is not intended. However as revised on the BCP, an assessment will be made in order to decide with the Employer if the WFA should be closed and related transportation by BYMA stopped 

  How is the logistics of transporting over 900 people going to work, this will all need to be 

done within the next 7‐14 days. BYMA needs to communicate a clear plan  

No change, will continue as per the last 2 years. 7 buses are permanently mobilized to this end and have done since 2018 without issue.  

  BYMA needs to issue a fully detailed security plan, if star city shuts down BYMA is 

responsible to protect their storage and sites  

Yes the 3 storages area and the WFA are under responsibility of BYMA. Please refer to revised BCP.  In case of shutdown of the YCP sites, site security will be reorganized to assist all sites (BYMA and MEP subcon) 

  

If there are any people that will be remaining in star city to protect assets a full guard list for all of the sites located in Star City is required to be shared with TED. If the security guards are not registered with TED they will not be allowed into the estate

Minute of the meeting following the call in between Stephen PURVIS, Iain FAIRBAIRN, Pierre Eric SAINT‐ANDRE and Denis AVERLAN in relation with Coronavirus, dated on 18th of March 2020 

1) Iain will create an emergency WhatsApp group in case we need to take urgent decision  2) Only 3 situations which can lead to a partial or full lockdown: 

a. The law: hardly probable given the poverty of the country b. The Employer instruction c. One case on our site: 

i.  the case in contained in a specific place after a meticulous inquiry (BYMA close the specific area, people working in this area in quarantine 14d, 3 sterilisation to do of the area before reopening) 

ii. pandemic analysis on all sites, we will order a full quarantine   3) BYMA need to make sure our rules are fully implemented in the labour camp (which is the most 

critical and sensitive area): social distance (1m min), no gathering even for diner, cleaning strongly reinforced plus regular sterilisation, hand washing with soap extensively. 

 4) YOMA wants to know how BYMA will know if there is a case? BYMA will organise a visit to see ISOS doctor or an accredited one by BYCN in order to check the symptoms and make a diagnosis. Follow up to be done (like it is currently done in France where most of the people are not anymore tested with a kit).  5) BYMA will share with YOMA the business continuity plan of BYMA/BTJV. YOMA will make sure 

BYMA is aligned with the one YOMA is doing. All parties agreed that there is no commercial background in this request.  

 6) YOMA have decided to create, as a precautionary measure a quarantine location where 

BYMA/BTJV can put people if there is a suspected case.

Grues Mettre sous tension

Attendre 15 minutes au moins avant de faire tout mouvement

Nettoyer et huiler l’arbre de la poulie baladeuse en sortie de treuil Effectuer un graissage général de la machine et nettoyer (graissage intérieur et extérieur de la couronne d’orientation) Faire descendre le moufle à très petite vitesse sur la demi-hauteur de la grue

Vérifier que le moufle descend

Dans la négative, contrôler qu’il n’y a pas de bloc de graisse figée dans la gorge des poulies

Vérifier en même temps que le câble ne saute pas des poulies

Faire effectuer plusieurs allers-retours du chariot sur la flèche – Vérifier les poulies : graisse figée

Si le câble du chariot « prend du mou » ne pas continuer la manœuvre et faire appel au Service Matériel

Orientation : faire 2 tours à droite et à gauche très lentement

Translation : dégriffer la machine et faire un essai sur 1 m Recommencer plusieurs fois (flèche dans l’axe de la voie) Essais de changement de vitesse du treuil de levage. Faire plusieurs passages en PV – GV à vide

Essais de frein de levage en petite vitesse :

Les remises en route des grues à tour et des compresseurs doivent être effectuées de la même façon après un week-end en hiver (risque de gel) et après un arrêt pour intempéries.
