This Edict may be cited as the Robbery (Special Provisions) Edict, Interpre- 1968. tation. 2,—(1) In this Edict— ‘armed patrol” means any patrol comprising either both armed members of the Nigeria Police Force and armed members of the Nigerian Army or only armed members of the Nigeria Police Force, according as may be directed by the Military Governor for the purposes of patrol duties in respect of particular areas of the State; “assault” means striking, touching, moving or otherwise applying force, including heat, light, electrical force, gees odour, or any other ‘substance or thing whatever, if applied in such a degree as to cause injury or personal discomfort to the person of another, either directly or indirectly without his consent, or with his consent if the consent is obtained by fraud, or any bodily act or gesture, amounting to an attempt or threat to apply force of any kind as aforesaid to the person of another withouthis consent, in such circumstances that the person makingthe attempt or threat has in fact or apparently a present ability to effect the purpose ; “firearm” includes any canon, gun, rifle, carbine, machine-gun, cap-gun, flint-lock gun, revolver, pistol, or other firearm, whether whole or in detachedpieces; “offensive weapon” includes an air gun, air pistol, bow and arrow, spear, cutlass, matchets, dagger, cudgel, or any piece of wood, metal, glass or stone capable of being used as an offensive weapon, but does not includea firearm ; “robbery” means stealing anything, and at or immediately before or after the time of stealing it, using or threatening to use actual violence to any person or property in order to obtain or retain the thing stolen or to prevent or overcomeresistance to its being stolen or retained ; “steal” means to take or convert to one’s use or the use of any other person, anything other than an immovable property, with any of the following intents :— (a) an intent permanently to deprive the owner ofthe thing ofit:; (5) an intent permanently to deprive any person who hasany special property in the thing of such property, the term ‘special property’ here including any charge or lien upon the thing in question and any right arising from or dependent upon holding possession of the thing in question, whether by the person entitled to such right or by some other person for his benefit ;

THE MILITARY GOVERNOR OF LAGOS STATEhereby makesthis Edict as follows :—

1. This Edict may be cited as the Robbery (Special Provisions) Edict, Interpre-1968. tation.

2,—(1) In this Edict—‘armed patrol” means any patrol comprising either both armed members

of the Nigeria Police Force and armed members of the Nigerian Armyor only armed members of the Nigeria Police Force, according as maybe directed by the Military Governor for the purposes of patrol dutiesin respect of particular areas of the State;

“assault” means striking, touching, moving or otherwise applying force,including heat, light, electrical force, gees odour, or any other ‘substance

or thing whatever,if applied in such a degree as to cause injury or personaldiscomfort to the person of another, either directly or indirectly withouthis consent, or with his consent if the consent is obtained by fraud, orany bodily act or gesture, amounting to an attempt or threat to applyforce of any kind as aforesaid to the person of another withouthis consent,in such circumstances that the person makingthe attempt or threat hasin fact or apparently a present ability to effect the purpose;

“firearm” includes any canon, gun,rifle, carbine, machine-gun, cap-gun,flint-lock gun, revolver, pistol, or other firearm, whether whole or indetachedpieces;

“offensive weapon” includes an air gun, air pistol, bow and arrow,spear, cutlass, matchets, dagger, cudgel, or any piece of wood, metal,glass or stone capable of being used as an offensive weapon, but does notincludea firearm ;

“robbery” means stealing anything, and at or immediately before orafter the time of stealing it, using or threatening to use actual violenceto any person or property in order to obtain or retain the thing stolenor to prevent or overcomeresistance to its being stolen or retained ;

“steal” means to take or convert to one’s use or the use of any otherperson, anything other than an immovable property, with any of thefollowing intents :—

(a) an intent permanently to deprive the owner ofthe thing ofit:;

(5) an intent permanently to deprive any person who hasany specialproperty in the thing of such property, the term ‘special property’ hereincluding any charge or lien upon the thing in question and any rightarising from or dependent upon holding possession of the thing inquestion, whether by the person entitled to such right or by some otherperson for his benefit ;

(c) an intent to use the thing as a pledge orsecurity;

(d) an intent to part with the thing on a condition as to its returnwhich the person taking or converting it may be unable to perform ;

(e) an intent to deal with the thing in such a mannerthat it cannotbe returned in the condition in which it was at the time of taking orconversion ;

(f) in the case of money, an intent to use it at the will of the personwhotakes or converts it, although he may intend afterwards to repaythe amountto the owner;

“the tribunal” means a tribunal constituted under section 6 of thisEdict for trial of offences.

(2) The Interpretation Act 1964 shall apply for the interpretation ofthis Edict as it applies for the interpretation of an enactment.

3.—(1) Any person who commits the offence of robbery shall beliableupon summary trial and conviction under this Edict to imprisonment fornot less than twenty-one years.

(2) If—

(a) any offender mentioned in subsection (1) above is armed with anyfirearms, or any dangerous or offensive weapon or instrument or is incompany with any other person so armed ; or

(b) at or immediately before or immediately after the time of the robbery,the said offender woundsor uses any other personal violence to any person,

the offender shall be liable upon summary trial and conviction under thisEdict to sentence of death.

4.—(1) Any person who, with intent to steal anything, assaults anyother person and at or immediately after the time of the assault, uses orthreatens to use actual violence to any other person or any property in orderto obtain the thing intendedto bestolen shall be liable upon summary trialand conviction under this Edict to imprisonment for not less than fourteenyears.

(2) If(a) any offender mentioned in subsection (1) above, is armed with any

firearms or any dangerous or offensive weapon or instrument, or is incompany with any other person so armed; or

(b) at or immediately before or immediately after the time of the assault,the said offender woundsoruses any other personal violence to any person,

the offender shall be liable upon summary trial and conviction under thisEdict to imprisonment for life, with whipping in such manner and to suchextent not exceeding twenty-four strokes of the whip, as the tribunal maydecide.

(3) Any person found in any public place in possession of any armg,whetherreal or toy or imitation, and in circumstances reasonably indicatinsthat the possession of the arms is with intent to the immediate or eventualcommission by that person or any other person, of any offence undersection3 or 4 of this Edict, shall be liable upon summary trial and conviction underthis Edict to imprisonment for not less than fourteen years.

5. An armed patrol may arrest without warrant any person reasonablysuspected of having committed or attempting to commit any offence underthis Edict, and the armed patrol may use such force, including the use offirearms, as may be reasonably necessary to effect the arrest of that personor to prevent his escape.

6.—(1) The Military Governor may, either generally or in respect ofoffences committed in particular areas or in respect of particular offences,constitute a tribunal or tribunals for thetrial of offences under this Edict.

(2) Subject to subsection (3) below a tribunal constituted under sub-section (1) above (hereafter in this Edict referred to as “the tribunal”) shallconsist of—

(a) an officer of the Judicial Department of Lagos State not below therank of a Chief Magistrate, (who shall be chairman),

(5) an officer of the Nigerian Army not below the rank of Captain ;

(c) an officer of the Nigeria Police Force not below the rank of Superin-tendentof Police ; as the Military Governor may designate.

(3) Noofficer of the Nigerian Army or of the Nigeria Police Force whohas taken part in the search for, pursuit or apprehension of, any person to betried under this Edict or whohas taken part in the investigation of the offencecommitted by that person shall sit as a memberofa tribunal constituted forthe trial of that person for that offence.

7.—(1) Subject to the provisions of this Edict, the trial of offencesunder this Edict shall commence by way of application miadeto the tribunalin that behalf by the Director of Public Prosecutions of Lagos State, or bysuch officer of Public’ Prosecutions Division of the Ministry of Justice ofthat State as he may authorise so to do.

(2) An application, under subsection (1) above shall be supported byevidenceonaffidavit.

(3) Where after perusal of the application and the evidence on affidavitor any further evidence in such form as the tribunal may consider necessary,the tribunalis satisfied that any person appears to have committed any offenceunder this Edict, it shall cause notice to be served on that person calling uponhim to show cause why heshould not be punished for that offence.

(4) Where no causeor no sufficient cause under subsection-(3) aboveisshown by the person on whom

a

notice is served under that subsection, toits satisfaction the tribunal mayafter such inquiry as the tribunal may con-sider necessary, convict that person of the offence and impose upon him anappropriate sentence in accordance with the provisions of this Edict.

(5) The procedure to be followed upon an application to the tribunalunder subsection (1) of this section shall be in accordance with such rulingsas the tribunal may makeeither generally or for the purpose ofa particulartrial ; and in relation to and for the purposesof the roceetings of the'tribunalthe tribunal shall have the same powers, whether of compelling the attendanceof persons and the production of documents or otherwise, as the High Courtof the State has in the exercise of its ordinary jurisdiction.

(6) For the avoidance of doubt, it is hereby declared that any personcharged with an offence under this Edict shall be entitled to defend himselfeither in person or by personsof his own choice whoare legal practitioners,

and to examinein person or by his legal representative,if he or they so wish,

any person whose evidence, whether onaffidavit or otherwise, forms part of

the case against the first mentioned person.

8.—(1) The Military Governor shall have powerto confirm or disallow

any conviction, or sentence, imposed bythe tribunal;

(2) Any sentence imposed underthis Edict shall not take effect unless

and until the conviction and sentence are confirmed by the Military Governor,

under subsection (1) above, and pending such confirmation the convicted

offendershall be keptin such place ofsafe custody as the tribunal may decide.

(3) Where undersubsection (1) above the Military Governor disallows—

(a) a conviction, whether upon representation made by the convicted

offender or from other circumstances, he shall order the release of the

person convicted by the tribunal;

(b) a sentence, he may substitute a less severe form of punishment for

any punishment imposed on anoffender by the tribunal.

THE MILITARY GOVERNOR OF LAGOSSTATEhereby makesthis Edict as follows :— mo

1.—(1) This Edict may be cited as the Lagos State (Applicable Laws)Edict 1968 and shall come into force on Ist May 1968. ;

(2) In this Edict “State law’ means any law in force as law ofLagosState whether being a law mace by the Military Governor of Lagos State orhavingeffect as if it were so made. oe

(3) Nothing in this Edict shall affect any proceedings pending imme-diately before the commencementof this Edict, and any such proceedingsmaybe continuedas if this Edict had not been passed.

(4) The Interpretation Act 1964 shall apply for the interpretation ofthis Edict as it applies for the interpretation of an enactment.

2. The enactments specified in Schedule 1 to this Edict (being enact-ments which byvirtue of the provisions of section1 (5) of the States (Creationand Transitional Provisions) Decree 1967 and.the provisions;of section 12of the Constitution (Suspension and Modification) Decree 1966 have effectas State laws and form part of the laws of Lagos State or any part thereof)shall, on the commencementof this Edict have effect throughout Lagos Stateexcept as otherwise specified in column 3 of that Schedule and subject tothe modifications and amendments mentioned in relation thereto in the saidcolumn.

3. The enactments specified in Schedule 2 to this Edict being enactmentwhich—

(a) by virtue of the provisions aforesaid have effect as State laws andform part of the laws of Lagos State or any part thereof ;

(6) have becomeobsolete, unnecessary or spent shall, on the commence-mentofthis Edict, cease to have effect in LagosState or any part thereof,

4.—(1) Where by virtue of the provisions of section 2 of this Edict,any enactment has effect in Lagos State or any part thereof as a State lawand any word, phrase, section or reference therein needs to be amendedforthe purposeof bringing that enactment into conformity with the Constitutionof the Federation or the LagosState (Interim Provisions) Decree 1968 thenuntil the enactment is so amended by the MilitaryGovernor of LagosState,the word, phrase, section or reference shall be read and construedwith anysuch modifications, adaptations, qualifications and exceptions as may benecessary to bring the enactmentinto conformity with the Constitution of theFederation or the Lagos State (Interim Provisions) Decree 1968.

(2) The Military Governor of Lagos State may by Order make such

changes in the text of any such enactmentasis mentionedin subsection (1)

of this section as he considers appropriate for the purpose of bringing that

enactment into conformity with the provision of that subsection, and the

validity of an Order so made by the Military Governor of Lagos State in

the exercise or purported exercise of the power conferred by this subsection

shall not be impugned on the ground that any change made by the Orderis

inconsistent with the provisions of subsection(1)ofthis section.

5. Any court of law, authority or office which was’ established, any -

appointriient, election or other selection which was made or held, and any

other thing whatsoever which was done in pursuanceof any provision which

on the commencement of this Edict ceases to have effect in,Lagos State or

which was deemed by any suchprovision to be so established made, held or

done, shall on the commencement of this Edict, and as ‘respects Lagos

State, be deemed— = ——

(a) to have been duly established, made, held or donein pursuance of

the corresponding provision of the appropriate enactment mentioned in

Schedule 1 to this Edict, whether or not the corresponding provision

differs from the provision to whichit corresponds;and -=

(6) so far as relevant, in the caseof an appointment, election, selection

or other thing, to have been so made or done in pursuance of the corres-
