CORRIGENDA

1. The First Schedule to the Customs Tariff Act

No. 60 of 1958 as published in the Legal Notice No. 91of 1964 is amended:

(a) By deleting the word ‘“‘highe”’ in line 8 ofitem I/2 (3) (c) and substituting the word“higher?;. |

“(6) By deleting the word “each”in line 2 ofitem1/3 (3) and substituting “the pair”;

(c) By deleting the word “‘serving” in line 3 ofitem 1/56 and substituting “sewing’’.

2. The First ScHedule to the Customs Tariff ActNo. 60 of 1958—L.N. 91 of 1964 as amended byL.N. 131 of 1964 is amended :—

(a) By deleting ‘“‘each’’ in line 4 of item 1/49 (1)(a) and ingerting ‘“‘the square yard”;

(a) By deleting the word “portable”in column 2of item II/6 (4) and substituting ‘“‘potable’’;

(6) By deleting in item II/8 the expression —“meansrefined gold orsilver in lumps, barsor amalgam

ENTRY oF PREMISES.’ (a) A manufacturer is required to make and deliver to the Board, an entry ofhis premises showing detailed particulars ofall rooms, plant, machinery or equipmént used in connectionwith storage and rhanufacture. Theentry is to describe in detail the precise use to which every room, machine,,.etc. will be put. No storage of materials or products, and no manufacture, is permitted in any room, plant,etc. which is not included on the entry.

’ (8) Officers of Customs and Excise are legally empowered to have access:at any time to.the ‘“‘entered’’premises. .

(c) After entry has been made and delivered to the Board, a manufactureris not to alter thesize, shape,position or capacityofany“entered” room,plant, machineryor equipmentwithoutfirst obtaining the approval:of the appropriate Chief Collector, who mayrequire a newentry to be made when thealterations have beencompleted.

(d) Signatories to entries. Everyentryis to be signed bythe person to whom the relevant excise licenceis to be issued. If the licenceis issued to a body corporate, the entry is tobe signed by a director, generalmanager, secretary or other similar official and, except «where authority for that person to sign has beengiven under the seal of the bodycorporate, the signing is to be done under the seal of the body corporate.

_ (@) Form of entry. (#) An entryis to be prepared in accordance with form Sale 41 shown in Annex “A”,and three additional copies marked “copy” which may*not besigned are to be submitted.

11. Sicn Boarp. (a) A manufacturer is required to erect a sign board at the main entranceto hislicensed premises showing the business name of the manufacturing business licensed. 12. Bonpor Deposit. Before approvingtheissue of an excise licence, the Board requires a maniifacturerto make a cash deposit or enter into a bond on form Sale*32 to “Secure Excise Duty’’. Theamount ofdepositor penalty of any such bondis ordinarily not to be less than twice the estimated monthly excise dutypayableand is subject to official review. . :

13. Licence. (a) Application. At the time of request for Final Approval (see paragraph 3 (t) above), amanufacturer is required to make written application through the appropriate Area Chief Colle ttorfor theissue of an excise licence. Theapplicationis to be signed by the proprietorofthe firm or in the cage of:a. bodycorporate, by a director, general manager, Secretary or other similar official. :

(6) Issue-of Licence.—An excise licence is issued by the Area Chief Collector after the Board’s grant ofFinal Approval. .

ee(c) Validity of licence—~An excise licence is issued in respect of one set of premises only and expires on

PART IIJ—REcorps OF MANUFACTURE

17. Marertars Recister. (a) A manufacturer is required to keep a Materials Register to’ show thequantity of each type of material received and delivered for use in the factory. At the close of each workingday the balance on hand,of each kind of material, is to be set forth. Providing a manufacturer’s own recordsare sufficiently comprehensive and contain the required information, they will be acceptable but they are tobe madeavailableat all times for inspection bythe properofficer. :

(6) All materials received are to be accompanied by full supplier’s invoices which are to be retained hy.the manufacturer for at least twelve months andare to be produced to the properofficer on request.

18. Propucts Recister. (a) Every manufactureris required to provide and make up daily a ProductsRegister to show details of all excisable goods manufactured, particulars of all goods delivered and a dailybalance of stock on hand. : : . :

' (6) The layoutofthe Products Register may differ in detail according to trade. A Precedentofa ProductsRegister Form Sale 70 is shown at Annex “B”. In respect of particular trades, the “quantity” to|be shownin columns 3, 6 and 13 of the precedent.is to be expressed in accordance with the actual norma} “unit, ofmanufacture”, (e.g. the numberofpairs in the case of footwear, square yards in the case of cottan fabrics; 'pounds weight in the case of knitted fabric, and so on). ‘ , ( <

(c) In factories manufactuging more than one line or brand of goods, separate entries are to bemadein the Products Register for each Ime or brand or, alternatively, separate openings are to be used.

19. Opzrations Recister. Every manufacturer is required to keép an Operations Register to correlateall the materials recorded in the Materials Register as in stock and as used in manufacture with the excisablegoods produced therefrom, as recorded in the Products Register. Providing a manufacturer’sown recordsshowthis itifoymation adequately, they will be accepted but they are to be madeavailable at all times foririspection ‘bythé properofficer. .

20. Notice oF INTENTIONTO MANUFACTURE.—A manufactureris required to give to the proper officerwritten notice of his intention to manufacture on anyparticular day and such noticeis to give full details ofthe materials to be used and the excisable goods to be produced therefrom. A manufacturer whois consis-tently usingthe same materials to produce the same goods day by day may apply in writing to the Board for

22. DEFECTIVE FinisHEeD Goovs.—(a) Excisable goods found to be defective and unsaleable at anystage-prior to the time the accountfor duty is taken maybe destroyed orreturned for re-manufacture at themanufacturer’s option. . Such goods are deemed not to be “manufactured” and are not liable to duty. Anotice of the defect, including quantity: and the value of the goods involved, as well as the intended methodof disposal, is to be given in writing to the proper officer and the defective goods are to be produced to theofficer for examination prior to disposal.

If the goods are not to be destroyed or returned for re-manufactu reimmediately, they are to be kept in the Products Store or other approved secure place, segregated from anyother goods. -.

Part IV.—AssessMENT AND PAYMENT oF DUTY

24, EXCISABLE ARTICLES FOR FURTHER MANUFACTURE.—(a) Excisable articles for use as materials formanufacture of other excisable goods, sold to approved licensed manufacturers are exempt from duty, dutybeing paid onthefinal productonly. , re

_ (6) A manufacturer who wishes tu avoid the incidence of double excise duty is required, beforetakingdelivery of the goods, to inform the appropriate Area Chief Collector in writing of the name, address, excisefactory number and excise licence number of the manufacturer supplying the gogds, and full particulars ofthe goods. The excise duty on such materials will be waived only where any conditions imposed by the ChiefCollector are fully satisfied. . ‘ . :(c) All orders for excisable articles for use as materials for further manufacture by licensed manufacturersare to clearly show the purchaser’s excise factory numberand excise licence number.(d)} Goods on which duty will not be paid are to be entered in the Products Register in the normal wayand the item noted with the name-and excise factory numberofthe consignee. The amountofexcise dutyinvolved is to be deducted from the monthlydutyliability.

ExamiNaTION aT Facrory.—(a) Where goods are examined before delivery from the manufac-turer’s premises, all packages opened for official examination are to be re-packed immediately under thesupérvisioni ofthe proper officer, and, where practicable, all packages are to be wired or stringed forofficialplumbing orsealing. . ,

_ (8). Ifit is not practicable to have the packagesofficially sealed or plumbed asdirectedin sub-paragraph(a),the packages are to be gross-weighed by the proper officer and the manufactureris required to mark eachpackage indelibly with its gross weight. . : . :

. ?32. Pre-ENTRY.—The manufacturer is required to pre-enter the goods:— .

“ (a) in the case of exports and stores, by submitting the entry to the cashier in the Long:Room at theport or place ofexportation or loading as aircraft or ship stores and producing the goods to the properofficer for examination at the time of shipment; .(8) in the case of deposit in a bonded warehouse, by submitting the entry to the cashier in the LongRoom at the port or place of warehousing and forwarding the goods to the warehouse keeper. vs

33. DELIVERIES TO DIPLOMATIC AND OTHER PRIVILEGED PERSONS “AND ORGANISATIONS.—(a), Theentry (Form Sale 57) is to bear the following form of receipt, certified by the Privileged Person or authorisedsignatory: of the Privileged Organisation concerned :— : :“Received into my/our own premises the goods entered overleaf for use only for the duty-free purposesdeclared on this entry.” ‘ : : |(6) The directions of paragraph 30 (a) are to be followed and on completion oftheofficial examinationthe manufacturer is required to despatch the goodsdirect to the Privileged Person or Organisation.(c) .The manufacturer is also required to despatch, with the goods, the relevant entry fornis for the-receipt from the “consignee to furnish—on all copies—the prescribed declaration that the goods Have béenreceived into his.premises for use only for the duty-free purposes declared.(d) On return ofthe receipted forms, the manufacturer is required to present the entry to the cashier. inthe Long Room at the nearest Custom House.

34. CERTIFICATE OF LanpING.—(a) Where goods are exported overland or by inland waters the manu-facturer is required to produce

a

certificate of landing to the proper officer within three.months from the dateof delivery of the goods from the factory.

(6) If the manufacturer fails to produce the certificate of’landing within the prescribed period andisunable to give a satisfactory explanation for such failure, the goods in question will be deemed to have beenput to dutiable home use and credit for duty (see paragraph 35) will be disallowed. :

35. AccouNTING PRocepurEe.—(a) All deliveries (whether for normal home use or for duty-free pur-poses) are to be entered in the Products Register and included in the Monthly Return of Excise Duty (see’ paragraph 25). Credit for dutyin respect of duty-free deliveries is to be effected by deduction on the monthlyReturn of Excise Duty for the month during whichentries with relevantcertificates of shipment, etc., arereturned to the properofficer.() ‘The manufactureris required to enter on the Monthly Return of Excise Duty particulars of entriesbearing satisfactory certificates of shipment, etc., and deduct the total duty of such deliveries from the dutydue for the month. Particulars of the entry numberand date are to be quoted in each case. °

36. SPECIMEN SIGNATURES OF PRIVILEGED PERSONS AND AUTHORISED SIGNATORIES ON BEHALF OF_ ORGANISATIONS.—(a) The names of persons and Grganisations entitled to receive duty-free goods under theDiplomatic Immunities and Privileges Act, 1962, are published monthly by the Ministry of External-Affairs ina booklet entitled “Diplomatic and Consular List”. s5) Privil eged Persons and organisations approved by the Board in accordance with paragraph 27 who' intend to avail themselves of duty-free deliveries are to forward to the appropriate Area Chief ‘Collector. Specimen ‘signatures on form Sale 79—“Specimen Signatures of Privileged Persons and Authorised Sig-natories on behalf of Organisations Entitled to Receive Excisable Goods Duty-Free” (see Annex “G”),
