The Court announced its award on 28th Novomber, 1X 3. Inthis award the Court had set out the departments, the number ofemployees asected in each department, the deïails of the out-going bonus scheme agreement and the parties' respedive poso onin respect of that particular deparM ent and fmally the Couz'taward.

The Court would like to make it clear at tho very outset thatduring the hearing the parties at no time suggested that there wasany disputo as to the sections which were to- be considereed aspart of any one particular department. Further the paries hadduring negotiations come up to certain posiitions particularly inregard to the minimum standard output for each den rtmentbeyond which thoy could not move. It was on tho H sis of thisinformation and submissions made in 'rospect thereof that theCourt proceeded to mélce its award.

On 17th December, 1973, tlze Respondenf.s applied for inter-pretation of the Court award in resmct of item 14 (Jl-WaitingTime, only. W hen the parties were called beforo tlle Judge forfxing the hearing dato for the interpretation application theClaimants pointed out that they were also anxious to put forwardsome furlher information before the 'Court alzd were also keen toseek further clarifications on a few matters contained ill theaward. Accordingly it was decided that the parties wottld pùtfolward their respective diKculties for consideration by tlle Court.

Special Conditions1 . No buildings shall bo ereded on the land nor shall addi-

tions or external alterations be made to any buildings otherwisethan in conformity with plans and speciscations previouslyapproved in writing by the Commissioner of Lands and theloeal authority. The Commispioner shall not give his approvalunless he is satissed that the proposals are such as to developthe land adequately and satisfactorily.

the said roads to be constructed to a higher standard thegrantee shall pay to the Commissioner on demand such propor-tion of the cost of such construction as the Commissioner mayaSSeSS. '

4. 11 . Should the Commissioner of Lands at any time requirethe saïd roads to be constructed to a higher standard thegrantee shall pay to the Commissioner on demand such propor-tion of tlle cost of such construction as the Commissioner mayaSSeSS.

1 . Th: grant will be made under the Registered taand Act(Cap. 300). The term of tlle lease will be 33 years from thefirst day of the month following the notlcation of the approvalof the lease.

Special Conditions

1. No buildings shall be erected on the land nor shall addi-tions or external alterations be lnade to any buildings otherwisethan in conformity with plans and specécations previouslyapproved in writing by the local authority. The lessor shall notgive his approval unless he is satisfed that the proposals aresuch as to develop the land adequately and satisfactorily.

2. Thc lessee shall within six months of the commencement oftho term submit in triplicate to the local authority plans(including block plans showing the position of the buildingsand a system of drainage for the disposal of sewage, surfaceand sullage wa.ter), drawings, elevations and spedticatfons ofthe buildings the lessee proposes to erect on the land and shallwithin 24 months of the commencement of the term, completethe erection of such buildings and the c' onstruction of thedraiaage system in conformity with such plans, drawings, eleva-tions and specilications as amended (ïf such be the case) bythe lessor :

Provided that if default shall be made in the performance orobservance of any of the requirements of this condition, itshall be lawful for the lessor or any person authorized by himon behalf of the County Council to re-enter into and upon theland and the term hereby crtated' shall cease but withoutprejudice to any right of action or remedy of the CountyCouncil or the Commissioner in respect of any antecedentbreach of any conditfon herein contained.

3. The lessee shall maintain in good and substantial .repairand condition a11 buildings at any time erected on the land.

Council that he fshe/ they ls pare unable to complete the buildingswithin the period aforesaid, the County Council shall (at thelessee's expense) accept a surrender of the land comprisedtherein :

Provided further that if such notice as aforesaid shall be given(1) withfn 12 months of the commencement of the term, theCounty Council shall refund to the lessee 50 per centum ofthe stand premium pafd in respect of the land, or (2) at anysubsequent time prior to the expiration of the said buildingperiod, the County Council shall refund to the lessee 25 percentum of the said stand premium. In the event of notice bemggiven after the expiration of the said building period, no refundshall be made.

THE Commissioner of Lands on behalf of the MasakuCounty Council gives notice that plots in Machakos Townshipas described in the Schedule hereto, are available for alienationand applications are invited for direct grant of the plots.

2. A plan of the plots may the omce of theMasaku Town Council.

3. Applications should be submitted to the Clerk of theCotmcil, P.O. Box 262, M achakos. Applications must be sentso as to reaeh the Clerk of the Council not later than noon on29th July, 1974.

4. Applicants must enclose with their applications a sum ofSh. 1,000 in cash or send a postal order, money order orbanker's order made payable to Town Couneil as deposit whichwill be dealt with as f ollows :-

(tz) lf the applicant is offered and takes up and pays for theplot within a period of 14 days, as required in para-graph 5 below, the deposit will be credited to him.

(bj lf the applicatfon is unsuccessful? the apglïcant's depositwill be refunded to him.

(c) lf the application is successful and the applicant fails totake up and pay for the plot offered to him within aperiod of 14 days as required in paragraph 5 below, tlkeCommlssioner of Lands may declare the deposit forfeitedand the applicant shall have no further claim thereto.

5. The allottee shall pay to the Masaku Town Council within14 days of notification that his application has been approvedthe assessed stand premium and proportion of annual rent,together with the fees payable in respect of the preparation andregistration of the lease and the stamp duty. In default ofpayment within the specified time, the Commissioner of Landsor the Town Coundl may cancel the aliocatfon and the applf-cant shall have no further chim to the lease of the plot.

8. The lessee shall not sell, transfer, sublet, charge or partwith the possession of the land or any part thereof or anybuilding thereon except with the prior consent in writing ofthe Commissioner of txands ; no application for such consentexcept in respect of a loan required for building purposes willbe considered until Special Condition No. 2 has been performed.
