- PARTICULARS OF CLAIM1. The Plaintiff brings this action as the person authorised by law to prosecute and defend claims onbehalf of the. Federal Government of Nigeria. .2. The Plaintiff’s claim against the defendantis for the sum of 33123.05 (one hundred and twentythreenairaand five kobo) being the balance remaining unpaid:outof a total of 3323.05 (three hundred andtwentythree naira and five kobo) indebtedness to the Federal Government. .3. The defendant applied for Federal Government Scholarship in 1970 to pursue a course of study leadingto B.Sc. Economic at the University of Ibadan. The Scholarship was awarded to the defendant in 1971.During the 1971-72 session the defendant changed his course of study from Economics to Political Sciencewithout the prior approval of the Federal Scholarship Advisory Board.4, In the Letter of Award. reference No. ED/Sc. 7975/9 of 29th April, 1971 sent to the defendant, para-graph 2 stated that :

“If you take a course other than theone specified above without a prior approval from this Ministry you__ will be called upon to refund such amount of money of discovery.”?The defendant acknowledgedthe receipt of the said Letter of Award and accepted the conditions statedin it. . ,5. A total of 8323.05 was spent on the defendant during the 1971-72 session at the University of Ibadan,6. ‘The defendant has paid part of the said 2¥323.05 but has refused to pay the balance of N123.05 to theplaintiff in spite of repeated demands. :Whereofthe Plaintiff claims the said amounts of 2¥123.05 and.costs. .

2. Mode of Entry :

(1) The Chief Registrar post. is open to legalpractitioners who have notless than 10 years’ post-callexperience. :

(2) Forthe Deputy Chief Registrarpost, candidatesshould be from the cadre of Senior Magistrate orSenior State Counsel and should be of the highestintegrity and exemplary character. They must bebarristers or solicitors who must have practised atthe Bar for over a period of seven years. There areprospects of promotion to the posts of Judge orChief Nagistrate.

(3) Candidate for the Principal Registrar posts—@) must be legally qualified te practise in

Nigeria and.must possess at least 5 years’ post-callexperience ; OR

(i) must’ have shown marked progress asRegistrars in the Magistrates Court, High Courtor even the Courts of Appeal and must be conver-sant with Criminal and Civil Procedure ; or

(ii) must be qualified Barristers or Solicitors ofat least five years’ standing at the Bar. ‘(4) Candidates for Senior Registrar post:@) must be legally qualified to practise in

Nigeria and must have at least 3 years’ post-callexperience with the knowledge of Lawreportingand aptitude for research and sound knowledge ofCourt procedure ; oR

Gi) must have had some years’ experience asCourt Registrars or be required to be Barristers or

+ Solicitors with at least five years’ practice at the Bar.(5) Candidates for Higher Registrar Post—Must

have served as Registrars for at least a period of fiveyears or possess professional qualification with atleast two years’ practice after being called to the Bar.Those currently in the post of Registrar could also beconsidered. , .

3. Duties 3(1) Chief Registrary—Successful candidate will

perform the duties assigned to him underthe FederalCourt of Appeal Decree. In addition, he will be

ead the administration of the FederalCourt ofAppeal andbe responsible for the day to dayrunning of the Department, formulating newproposals and policy for the running of the Depart-ment under the direction of the President. He is,among other things, the Accounting Officer of theJudicial Department, Sheriff Taxing Master and theAdmirality Marshall,

(2) Deputy Chief Registray.—In charge of mattersrelating to personnel and establishmentofprofessionaland non-professionalstaff. Formulation of policy andgeneral administration. Law reporting. Indentingfor Law Books. To deputise for the Chief Registrarwhen on leave or absent from office with his soundknowledge of court procedure.

(3) Principal Registrary.—In charge of Record ofappeal to the Supreme Court. Preparation of recordsand checking. Settlement of record. In charge ofalljudgments delivered in all the Judicial Divisionsin the Federation. To see that all records of appeal arepromptly despatched. :

(4) Senior Registrars—In chargeof :

(@) editing judgments for law reporting,research in case laws which will be available toJudges to facilitate writing judgment ; or

(#2) Assessment of papers filed and collectionof fees and fines. Auditing Queries. Exhibits andReceipt for money paid out of Court to party.Bond for security for charges. Commissioners forOaths, Admiralty matters. To initial papers forfiling.

(5) Higher Registrars.—

(z) Required to workin the Litigationand Manage-ment sections of the Court and take part in the dayto dayadministration ofthe Court as will bedirectedby the President and the Chief Registrar ; or

(#) To sit in Court, Bail Bond, warrants. Warranttocarryoutsentence. Warrantto production, warrantwherewitnesshasnotobeyedsummons,etc. Drawingup of Court orders. Commissioners for Oaths.

4. Condition of Service.—All posts are pensionable. ©Other conditions are as applicable in the FederalPublic Service.
