1 COMMUNITY MEETING REPORT Petitioner: Halley Douglas, Inc. Rezoning Petition No. 2021-031 This Community Meeting Report is being filed with the Office of the City Clerk and the Charlotte- Mecklenburg Planning Commission pursuant to the provisions of the City of Charlotte Zoning Ordinance. PERSONS AND ORGANIZATIONS CONTACTED WITH DATE AND EXPLANATION OF HOW CONTACTED: David W. Murray, a representative of the Petitioner, mailed a written notice of the date, time and location of the Community Meeting to the individuals and organizations set out on Exhibit A attached hereto by depositing such notice in the U.S. mail on March 18, 2021. A copy of the written notice is attached hereto as Exhibit B. Although not required, on March 31, 2021, I mailed a second notice containing the same information as the first which is attached hereto as Exhibit C. DATE, TIME AND LOCATION OF MEETING: The Community Meeting was held virtually on Zoom on Tuesday, April 6, 2021, at 6:00 p.m. The Zoom link was https://zoom.us/j/6616329209?pwd=NUdNTU1zSUpaUEI5TExTdnZBMll4QT09. A call- in number was also provided. PERSONS IN ATTENDANCE AT MEETING (see attached copy of sign-in sheet): The Community Meeting was attended by three (3) community members and one (1) City Council member identified on the Zoom attendee list attached hereto as Exhibit D. The Petitioners were represented at the Community Meeting by David W. Murray (agent and attorney for Petitioner), Doug Heidinger (representative of Petitioner) and Reza Nikrooz (owner). Mr. Murray sent Zoom meeting links to Lynn McConnell and Braxton Winston, City Council At-Large, pursuant to their requests; however, neither Ms. McConnell or Mr. Winston attended. SUMMARY OF PRESENTATION/DISCUSSION: Mr. Murray prepared opening statements to introduce himself, Doug Heidinger and Reza Nikrooz. He also introduced Gregory Phipps, City Council At-Large, who was present for the whole presentation. All people present for the virtual meeting stayed the entire meeting. A copy of the PowerPoint presentation is attached hereto as Exhibit E. The presentation began at approximately 6:10 p.m. and was complete at approximately 6:30 p.m. The Petitioners indicated that they proposed to rezone an approximately .232 acre site (the “Site”) from R-5 to R-8(CD). The Petitioners explained the rezoning process in general and stated that the purpose of the meeting was to discuss the rezoning request and the conditional site plan and respond to questions and concerns from nearby residents and property owners. The Petitioners informed the attendees that the site would have a new house that would be a duplex, but that it would attempt to retain a single-family feel by only having one entry door facing S. Laurel Ave. The Petitioners showed the attendees the submitted site plan and advised attendees that they could email comments to [email protected]. One e- mail was received from Christy Smith which is attached hereto as Exhibit F. The Petitioners pointed out that Mr. Nikrooz owned the house two doors down and that the quality of construction would be high.

The Petitioners asked if any of the attendees had any comments about the proposed plan and Christy Smith commented that she would like to see as much brick as possible. Councilmember Phipps asked generally about the plan and wanted to ensure it fit with the neighborhood. He was also interested in the site given the current discussion in City Council involving the new zoning ordinance. The Petitioners gave the attendees the City’s the rezoning case number so that they could know when to attend the public hearings or review the comments from staff online.

We are assisting Halley Douglas, Inc. (the “Petitioner”) in connection with a Rezoning Petition it has filed with the Charlotte-Mecklenburg Planning Design & Development Department seeking to rezone an approximately .232 acre site (the “Site”) located on the north side of S. Laurel Ave., east of Providence Road and west of Randolph Road from R-5 zoning district to R-8(CD) zoning district. The purpose of this Rezoning application is to allow for the use of the property to construct a single-family duplex as a transition use between the existing multifamily and duplex structures located around the property.

In accordance with the requirements of the City of Charlotte Zoning Ordinance, the Petitioners will hold a Community Meeting prior to the Public Hearing on this Rezoning Petition for the purpose of discussing this rezoning proposal with nearby property owners and organizations. The Charlotte-Mecklenburg Planning Department’s records indicate that you are either a representative of a registered neighborhood organization or an owner of property that adjoins, located across the street from, or is near the Site.

Due to unprecedented circumstances and federal and state executive orders directed at preventing the spread of COVID-19, the Official Community Meeting will be held virtually in accordance with guidance provided by the Charlotte Planning Design & Development Department. • Conventional rezonings do not require a site plan and are limited only by the zoning ordinance.

• Initial comments by planning staff have viewed applicant’s site as being located in a transition area between R-22MF and the single-family residential uses on S. Laurel Ave.

• Thus a duplex use between multifamily and other legally non-conforming duplexes is a logical use for the site.

Rezoning Proposal

Notable Conditions

• Limited to single-family duplex use. No triplex, no quadraplex. (Site is not large enough under City zoning to support a triplex or quadraplex)

• Architectural standards include high quality materials

• Building materials include: brick, cedar shake, wood siding, fiber cement siding, stucco, and masonry.

• Roof materials include: asphalt , composition and wood shingles, tin, standing seam metal and wood shakes.

• Only one entry door to the principal structure shall front S. Laurel Ave in order to promote the appearance of a detached dwelling.

• Setback will be to match existing street frontages.
