An Ordinance of the City of Los Angeles ordering the necessary electroliers and appliances in certain public streetsand places in the City of Los Angeles, to be maintained and electric current to be furnished for lighting said electroliers.

THE PEOPLE OF THE CIry OF LOS ANGELES DO ORDAIN AS FOLLOWS:

Section 1. Pursuant to the provisions of Sections 6.95 - 6.127 of the Los Angeles Administrative Code, and to therequirements of Section 53753 of the California Government Code, the Council of the City of Los Angeles hereby orders thatthe necessary electroliers and appliances be maintained and electric current be furnished for the period of 12 months endingJune 30, 2007 for the lighting of those certain streets and places described in the ordinance hereinafter referred to:

Ordinance No. Designation

Tramonto Drive and Los Liones Drive Lighting District

The ordinance enumerated is the ordinance of intention heretofore adopted by the City Council for the district.Reference is hereby made to the ordinance and the report of the Board of Public Works mentioned therein for furtherparticulars in connection with the improvement.

Sec. 2. The assessments for the lighting of the district designated in Section 1 of this ordinance, made and filed by theBoard of Public Works pursuant to the provisions of the Sections 6.95 - 6.127 of the Los Angeles Administrative Code, arehereby approved and conflrmed; and said assessments are hereby ordered to be levied upon the lots or parcels of land withinsaid district heretofore declared by the City Council to be the district to be benefitted by said improvement.

Sec. 3. The Board of Public Works is hereby authorized and directed to cause the said improvements to be made inaccordance with the plans and specifications therefor and, as may appear to said Board to be necessary, to issueinterdepartmental or other purchase orders for each of such improvements or for portions thereof, pursuant to said sections ofthe Los Angeles Administrative Code.

Sec.4. The City Clerk shall certify to the passage of this ordinance and have it published in accordance withCouncil policy, either in a daily newspaper circulated in the City of Los Angeles or by posting for ten days in three publicplaces in the City of Los Angeles: one copy on the bulletin board located at the Main Street entrance to the Los Angeles CityHall; one copy on the bulletin board located at the Main Street entrance to the Los Angeles City Hall East; and one copy onthe bulletin board located at the Temple Street entrance to the Los Angeles County Hall of Records.

RECOMMENDATIONS:

That this report be adopted by your Board and fonryarded, together with the transmittals, to thecity clerk and city council with your Board's recommendations that:

a Council adopt this report and the Ordinance of lntention and that the proceedings beconducted in accordance with Sections 6.95 - 6.127 of the Los Angeles AdministrativeCode, Section 53753 of the California Government Code, and Proposition 218 (ArticlesXlll C and Xlll D of the California Constitution). This includes Council holding a PublicHearing for the district.

b Upon Council adoption of the Ordinance of lntention, the City Clerk be instructed to: 1)Mail notices of the assessment ballot proceedings, 2) Mail assessment ballots (asrequired by Prop. 218) prepared by the Bureau of Street Lighting and the City Clerk, tothe property owners in the lighting district, and 3) Conduct the assessment ballotproceedings.

Upon completion of ltem b above, the City Clerk be instructed to count, certify andreport the results of the assessment ballot proceedings to the council.

Following the conclusion of the final public hearing, if a project has weighted "YES"votes equal to or in excess of weighted "NO' votes, Council deny the appeals, confirmthe maintenance assessments, and adopt the Final Ordinance levying theassessments. lf weighted "NO" votes are in excess of weighted 'YES' votes, Councilwill abandon the lighting district and proceedings in accordance with Proposition 218,and the affected street lighting system will be removed from the project area.

That a copy of this report be provided to each affected Council office and the Mayor's Office ofEconomic Development.

This is a resubmittal of a lighting district to the Board for adoption of assessment hearings. Thislighting district was originally adopted by the Board on 9127104, and the Ordinance of lntention wasadopted by the council on 3/18/05. The assessments for this project were defeated by a majority "NO"vote by the property owners who voted during the ballot proceedings as provided by froposiiion2tA.

This is a private development project. This lighting district proposes to install 3 new streeflightswithin the lighting district. 3 streetlights along Tramonto Drive, from g91'SM/ Los Lionei to616'S/W Los Liones Drive. This project is proposed to assess 42 parcels for operation andmaintenance.

The proposed annual assessment amounts for the lighting district are as follows

lf levied, the administration of this district may be combined with that of another district or districts inthe future as provided in the Ordinance of lntention.

The passage of Proposition 218 on November 5, 1996, requires a vote of the property owners prior tocouncil confirming and levying the assessments for maintenance.

Upon adoption of the transmitted Ordinance of lntention, the Council will set a date for hearingappeals and the last day to receive completed assessment ballots. A hearing to be held by yourBoard will be scheduled at least one week prior to the date of the public hearing before the

Council to review and resolve any appeals concerning the proposed maintenance assessments. lf theassessment ballot proceeding as required by Proposition 218 approves these assessments, the CityCouncil may confirm and levy the assessments.

ln accordance with Council Policy adopted on December 11,1998, the Bureau of Street Lighting willcast ballots in favor of the assessments for all Council controlled public properties in the district.

Tramonto Drive and Los Liones Drive Lighting District does not include public parcel.

The protests that are received, as described in the Administrative Code, are for the consideration ofthe Council, but are not binding. Only a majority vote against the assessment is binding.

An Ordinance pursuant to the provisions of Sections 6.95 - 6.127 of the LosAngeles Administrative Code, Section 53753 of the Califomia Govemment Code, andProposition 218 (Articles Xlll C and Xlll D of the California Constitution), declaring theintention of the Council of the City of Los Angeles to order the necessary street lightingsystems to be operated, maintained, and repaired, includinQ fumishing electric energy, forthe cunent Fiscal Year of 2005-2006, for the lighting of that certain district designated asthe:

TRAMONTO DRIVE AND LOS LTONES DRTVE (RE-BALLOT)LIGHTING DISTRICT

THE PEOPLE OF THE CITY OF LOS ANGELES DO ORDAIN AS FOLLOWS:

Section 1. The public interest and convenience require, and it is the intention of theCouncil of the City of Los Angeles to orderthe following improvement to be made, to wit:

That the necessary street lighting equipment be operated, maintrained and repairedand that electric energy be fumished for the cunent Fiscal Year of 2005-2006, for thelighting of:

TRAMONTO DRIVE,

from 991'SM/ Los Liones Drive to 616'SM/ Los Liones Drive,

in the City of Los Angeles (see Plan for details). The street or portions of streets to beimproved, and the district to be assessed to pay the costs and expenses of theimprovement, shall be known for all proceedings hereunder as:

Section 2. All of the said work shall be done in accordance with the report of theDirector of the Bureau of Street Lighting adopted by the Board of Public Works, therefore,approved by the City Council and on file in the office of the City Clerk. Reference to saidreport is hereby made for a full and detailed description of the proposed improvement andof the assessments to be levied.

Section 3. The said Council hereby makes all the costs and expenses of saidimprovement, including incidental expenses, chargeable upon the district to be benefitedthereby, with no additional portion of the costs to be paid out of the City Treasury.

Section 4. The Council hereby determines and declares that the district whichreceives special benefit from said improvement, and is to be assessed to pay the costsand expenses thereof, is described by the diagram with City page numbers 12713 andaccompanying assessment roll included by reference in the said report of the Director ofthe Bureau of Street Lighting adopted by the Board of Public Works, which diagramindicates by a boundary line the extent of the tenitory included within the assessmentdistrict. Reference is hereby made to said report and diagram for a full and completedescription of said district, which diagram shal! govem for all details as to the extentthereof. All public streets and alleys or portions thereof are hereby excepted there from.

Section 5. That the proceedings for the said improvement shall be had and takenunder and in accordance with Sections 6.95 - 6.127 of the Los Angeles AdministrativeCode, Section 53753 of the Califomia Govemment Code, and Proposition 218 (ArticlesXlll C and Xlll D of the Califomia Constitution).

Section 6. The Board of Public Works shall prepare notices and ballots of saidimprovernent to be mailed by the City Clerk to each property owner affected by theassessment, and have the notices to be published in newspapers of general circulationpublished and distributed in the several areas of the City in the manner and form andwithin the time required by law.

Section 7. The City Clerk shall conduct an assessment ballot proceeding for thislighting district, as required by Proposition 218 (Article Xlll D of the Califomia Constitution).Ballots shal! be mailed with the hearing notices. The Clerk shall count, certiff, and reportthe results to the Council. The Council shall not impose the proposed assessment if thecount of the weighted "no" votes is greater than the weighted 'Yes" votes, and the specifiedlighting system will not be constructed. ln tabulating the ballots, the ballots shall beweighted according to the proportional financial obligation of the affected property due tothe improvement.

Section 8. The proposed street lighting maintenance assessments referencedherein are intended to be in addition to or in replacement of the existing assessment, asspecified in the Enginee/s Report. Where the proposed assessment is to be in addition tothe existing assessment, whether the proposed assessment is levied or abandoned, theexisting assessment shall not be affected. Where the proposed assessment is to be inreplacement of the existing assessment, if the proposed assessment is not levied, theexisting assessment shall not be affected.

Section 9. For each year following the first year of the assessment, the amountsof the assessments designated in the assessment roll may be increased annually, withoutfurther notice or ballot, by no more than the annual Consumer Price lndex (CPl) for LosAngeles-Anaheim-Riverside CA, provided by the U.S. Dept. of Labor (Bureau of LaborStatistics). ). The annual Consumer Price lndex (CPl) will be calculated from the calendaryear (January 1-December 31) just prior to the assessment period affected (July 1-June30).

Section 10. The administration of this district may be combined, without furthernotice or ballot, with the administration of any other district or districts, for which authorityfor such administrative combination is provided in the establishing ordinance. Suchcombined districts, for all administrative purposes including but not limited to, assessment,diagram, revenue and expenditures, notice and balloting, may be treated as a singledistrict.

Section 11. Notwithstanding that the assessments specified in the assessment rotlare imposed for the 2005/06 fiscal year, only if the street lighting system is energized on orbefore July 1, 2006 shall those assessments be transfened to the 2005/06 property taxrolls and collected. lf the system is not energized on or before that date, the assessmentsapproved herein, may be levied in the fiscal year following the year in which the system isenergized, without further notice or ballot.

Section 12. Thatrdrn o z N6 at the hour of 10 o'clock a.m. is the time,

and the Council Chamber on the third floor in City Hall the City of Los Angeles is the place,when and where a public hearing on the proposed improvement and assessment will beheld by the City Council. Any person objecting to their assessment may file a writtenprotest or appeal with the City Clerk at any time prior to the hearing by the City Council.Any person may also present written or oral comments at the City Council hearing on thismatter. Such protest must contain a description of the prope$ in which each signerthereof owns an interest, sufficient to identify the property, and be delivered to the CityClerk, and no other protests than those presented within the time specified will beconsidered.

Ballots are due to the City Clerk at any time prior to or on the day of the hearing by CityCouncil. The City Clerk sha!! prepare a report of the assessment ballot proceeding resultsto the City Council.

Section 13. ,The City Clerk shatl certify to the passage of this ordinance and have it

The Bureau of Street Lighting, for the Board of Public Works, administers and operatesthe street lighting system of the City. This includes managing the financing of theslptem. By Council Policy, about 80o/o of the steetlights are financed through streetlighting maintenance assessments to beneftting properties, and the rest through theI.ADWP.

Proposition 2'18, section 4 (b), requires that'...All assessments shall be supported by adetailed enginee/s report prepared by a registered professional engineer certified by theStrate of Califomia...' lt further requires in section 4 (f) that '...in any legal actioncontesting the validity of any assessment, the burden shall be on the agency todemonstrate that the property or properties in question receive a special benefit over andabove the benefits confened on the public at large and that the amount of any contestedassessment is proportional to, and no greater than, the benefib confened on the propertyor properties in question..."

1 SUMMARY

On November 5, 1996 the voters of Califomia approved Proposition 218, which became part ofthe Califomia Constitution. lt imposes additlonal requirements on local govemment whenassessments for steet lighting maintenance are proposed. This enginee/s report will explaln themethodology for the calculation of the assessmenb, the Citt's policy between special andgeneral benefit and information about the subject projecrt.

City funding is provided for street lighting, which light hrnnels, bridges, and minimal traffic safetylighting installed on wooden power poles. Under City Policy, funding for permanent streetlighting, which directly benefits nearby properties, is financed by assessments only.

2. SPECIAL BENEFIT AND GENERAL BENEFIT STREET LIGHTING

Speclal Beneflt is the direct street lighting benefit to a property, and to its owner or users, basedon the existence of the nearby street lighting systems that is designed to illuminate the roadwayand sidewalk adjacent to the specific property at night. When there is a single streetlight in frontof or near the property in question, there is speclal beneftt to the extent that the roadway andsidervalk are llluminated, notwithstanding that the sbeet lightlng system for the block is lncomplete.Proposition 218 allows the assessment of properties which receive special benefit, to the extentthat the assessment is not greater than the reasonable cost of the proportional special benefitconfened on those parcels.

General Beneflt is defined as a benefit to properties in the surounding community or a benefit tothe public in general resulting from the improvements, activities or services to be provided by theassessment levy. These benefits include the benefit fom street lighting s)Etems for locations thatdo not benefit specific properties, as well as interim lighting for minimal traffic safety on woodenpower poles and permanent lighting at intersections with mast arm or traffic vehicular heads. Anyspecial benefit from these lights will be intangible and not quantifiable in relation to their GeneralBenefit use. Proposition 218 requires the City to finance general benefrt costs trom other thanproperty assessments. These costs are financed from public funds.

The types of lighting that fall into these benefit categories are further outlined below.

3. STREET LIGHTING TYPES AND FINANCING

There are three types of street lighting in the City of Los Angeles, each with different purposes,physical characteristics and financing modes. The following is a brief description of each:

A SPECIAL BENEFIT - Special Benefit street light slptems are permanent streetlightsystems designed to meet City standards of illumination which provide special benefit tonearby properties. These are generally systems with steel or concrete poles, undergroundwiring, intended to be part of a complete system providing a designed level of illuminationand uniformity on the roadway and sidewalk areas. These systems are generally installedthrough either, assessmentrs to nearby benefiting propertles, grants or through requlrementson private developments, and are owned by the Departnent of Public Works. The financingof their entire costs of operation and maintenan@ is through the annual assessment ofnearby properties that are determined to receive special benefit. All general benefits, if any,to the sunounding community and public in general from these special benefit streetlightsystems are intangible and are not quantifiable.

B. GENERAL BENEFIT - General Benefit lighting systems are permanent street light systemand which illuminate vehicular and pedestrian bridges and tunnels; intersections with mastarm or haffic vehicular heads; and other locations where there are no adjacent or nearbyproperties which receive direct, special benefit. These are part of a complete system for thestruc'ture, or street, providing a designed level of illumination and uniformity on the roadwayand sidewalk areas. The financing of their entire costs of operation and maintenance isthrough public funds and/or Department of Water and Power funds. These slptems aregenerally installed with public funding, and owned by the Departnent of Public Works.

C. LffiLlTARIAhI LIGHTING - Utilitarian Lighting is a general benefit type of steet lighting thatis instralled, operated and maintained by the Department of Water and Power. These lightrsare mounted on wooden power poles, and do not have a designed average level of uniformityor illumination. These lights are considered interim, minimal safety lighting for specificlocations where there are no permanent street lighting systems. The costs of operation arefinanced through the Department of Water and Power.

4. HOW MAINTENANCE ASSESSMENTS ARE CALCULATED

Based on Council Policy, Los Angeles Administrative Code, annual City Budgets, andassessment proceedings, assessments are for the total estimated amount of the cost of operationand maintenance.

All costs of street llghting malntenance and operation for the subJect llghtlng sletsms areto be assessod-[ono are to be flnanced with publlc funds.

The total estimated amounts of revenues and operating costs for previously assessed parcels areshown in the annual reports for the Los Angeles City Street Lighting Maintenance AssessmentDistrict (LACLD). The assessment rates are based on these estimates, which rely on actualcosts for previous years, and on historic relationships between the different rates.

Proper maintenance and operation of the streetlight infastructure benefits all properties within theDistict by providing security, safety, and community character and vitality.

ln addition, Proposition 218, the 'Right to Vote on Taxes Acf which was approved on theNovember 1996 statewide ballot and added Article XlllD to the Califomia Constitution, requiresthat a parcel's assessment may not exceed the reasonable cost for the proportional specialbenefit confened on that parcel. Article XlllD provides that only special benefits are assessableand the City must separate the general benefits fom the special benefib. lt also requires thatpublicly owned properties. which benefit from the improvements, be assessed.

Methodoloov

The calculation method takes into account the following:

Beneflt Zones - The tpe of street lighting system that is installed. These will beidentified as benefit zones. These zones may indicate a modem system that providesthe minimum illumination levels adopted by the City or may include pedesfian lighting.Each zone requires a certiain avenage energy usage, maintenance and evenfualreplacement.

Equlvalent Dwelllno Unlts - The calculation will take into account the different landuses on the properties for comparative purposes. (E.g.A vacant property vs. a multiplefamily property \rs. a @mmercial property.)

Beneflt Factors - Benefit Factors will deftne the special benefit assoclated with the useof the property. Special Benefit Factors will be applied to properties that demonstrate adifferent use pattem.

Partlal Llshtlnq Factorc - Partial Lighting Factors will define the amount offrontage lit by the streetlights.

Rates - The cunent rates have been set due to the Bureau's cunent maintenancedistrict. These rates include energy, maintenance, administration and eventualreplacement at the end of lffe.

All these factors will be evaluated and formulated into Benefit Units, utilizing Equivalent DwellingUnits and Benefit Factors, which will then be multiplied by the conesponding rate per the BenefitZone. The following explains each factor in more detail.

Beneflt Zones

Beneftt Zones are used to differentiate between the different types of lighting service parcelsreceive. All parcels served by a similar kind of lighting slrstem spaced a similar distrance apartmight be considered to be in the same Benefit Zone.

Each benefit zone will have a specific Assessment Rate associated with it, and a parcel can be inmore than one benefit zone.

fut area with a very high level of lighting, with twice the number of lights installed, could be in aspecific benefit zone that would be charged twice the rate of those types of lights. lf that areaalso included pedestrian lights, it could be in two zones of benefit. Zones may be adjusted due toany identified general benefit component.

For parcels on comers with more than one lit side, the parcel will be zoned per the side that theproperty trakes access.

We have determined that there are fre (5) different levels of benefit within the District, and theseare distinguished by different zone designations.

The zones identified below are assumed to utilize energy efficient lamps. Any request for lampsthat are not energy efficient or require additional maintenance will need to be evaluated and therate will need to be adjusted accordingly.

Equlvalent DwelllnE Unlts

The medlum denslty slngle-famlly resldentlal parcel has been selected as the baslc unlt forcalculailon of assessmonB; therefore, the medium density single-family residential parcel isdefined as one Equivalent Dwelling Unit (EDU). A methodology has been developed to relate allother land uses to the medium density single-family residential land use.

The calculations take into account two factors that impact the land use and density of the affectedparcel. These include: size of the parcel in relation to a Sinole Family Residential and land use ofthe oarcel in relation to SFR.

Size of the parcel

All non SFR properties are converted to EDUs using the City of Los Angeles'averagesize for a SFR lot. Based on the data that we have reviewed, the average SFR lot isapproximately 7,500 sq. ft, or approximately 6 dwelling units per acre. Therefore, parcelsare assigned 6 EDU per acre or any portion thereof. The relationship of the size of theparcelto a SFR provide a base to adjust that is related to the maintenance and operationexpenses of the public improvement.

Land Use of the oarcel

The final EDU is adjusted in accordance with the land use of the property. The factorassigned is related to the approximate use/ trips generated for a particular property t1pe.For example, multiple family residences with many units will have more use of theproper$ and of the street lighting slptem while vacant properties and agriculturalproperties have extremely limited use. A factor of .25 is used to distinguish an increasein use ftom one property to another. The land use adjustment determines theproportional special benefit that the parcel derives from the use of the street lightingslptem within the vicinity.

Table 1, below, shows the various land uses EDU rates assigned.

Single Family Residential (SFR) Parcels

A mediumdensity SFR lot equals 1 EDU. All SFR parcels with lot sizes equalto 1/8 acreand up to 114 acre (5,45 sf and 10,890 s0 are considered medium density SFR's.

SFR parcels larger than 114 acre are considered low density SFRs. Since these parcelsare larger than the medium density SFR's, and occupy more street frontage per parcel, inorder to meet the minimum design lighting requirements, more street lights areassociated with these larger parcels; therefore, low density SFR's are assigned 1.25EDU.

SFR parcels smaller than 1/8 acre are considered high density SFR's. Since theseparcels are smaller than the medlum density SFR's, and occupy less street fontage perparce!, in order to meet the minimum design lighting requirements, fewer street lightsassociated with these smaller parcels; therefore, high density SFR's are assigned 0.75EDU.

Other Residential Prooerties

The equivalencies of other residential land uses, such as multi-family residence (MFR) orcondominiums (CDO), are determined by multiplying the number of dwelling units oneach parcel by EDU Factors that are based on the relative population density of theseresidential land uses. These fiactors are based on trip generation rates and etimatedwastewater usage, which are both related to population density.

Non-Residential Parcels

Non-residential properties are converted to EDU's using the City of Los Angeles'averagesize for a SFR lot. A.s stated above, the average SFR lot is approximately 7,500 sl whichis approximately 6 dwelling units per acre, wlrich relates the size of the parcel to a SFR.Non residential properties are adjusted by a .25 factor to distinguish between the variousland use of the parcels as it relates to their special benefit.

Non-residential properties include commercial, industrial, and insttfutional uses (such asschools, churches and hospitals). Utility properties are assessed the same as non-residential property, and Govemmental properties are assessed based on how they areused (this could be residentialor non-residential).

Vacant Parcels

Vacant property consists of parcels with few or no improved structures. Based upon theopinions of professional appraisers, appraising cunent market property values for realestate in Southem Califomia, the land value portion of a propefi typically ranges from 20to 30 percent of the propety's total value. Additionally, the utilization of vacant property issignificantly less than improved propefi and vacant property has a traffic generation rateof 0. Therefore, va@nt SFR lots (including park and agricultural parcels) will be assignedbenefit at the rate of 25o/o of the non-residential rate, or 1.5 EDU per acre or any portionthereof.

Beneflt Factors

The EDU rates are modffied by Benefit Factors that relate to how a particular land use benefitsfrom streetlighb

The amount of benefit received will vary with the different land use on the property. There aretwo categories from which the total benefit of a parcel is derived:

1. Securlty and Safety Beneflt. The prevention of crime and the alleviation of the fear ofcrime at the assessed properties, and the prevention of local pedestrian and trafficaccidents related to the assessed properties.

2. Communlty Character and Vltallty Beneflt The promotion of social interaction,promotion of business and industy, and the contribution to a positive night time visualimage for the assessed properties.

To assign the benefit factors, each land use is compared to residential properties. Residentialproperties are the base properties and are assigned benefit factors of 1 for both the "Security andSafety Benefif and the "Community Character and Mtality Benefff.

Commercial and Parks benefit similarly to residential propefi and therefore are assigned thesame benefit factors.

lndustial and utility properties receive benefits from added security and safety, but really receiveno benefrt for community character and vitality, as the nature of these properties do not promoteeither.

Likewise, vacant and agriculfure properties receive benefitrs trom added securtty and safety,although not at nearly the level of developed property, but really receive little beneftt fromadditional community character and vitality.

Table2 provides a summary of the Benefit Factors that are applied.

Partial Liqhtinq Factors

The EDU rates are further modified by Partial Lighting Factors that take into consideration theamount of frontage lit by the streetlights. lf almost the entire frontage of a parcel is lit, then thePartial Lighting Factor is 1.0. lf the frontage of a parcel is not fully lit, then a Partial LightingFactor of 0.75, 0.50 or 0.25 will be applied depending on the percentage of frontage lit.

5. ASSESSMENT RATES

Based on 2005/06 estimated annual budget, the following table provides the MaximumAssessment Rates for each of the Zones:

*The maximum annual maintenance assessment rates will be increased each year by 2%, not toexceed the annual change in the Consumer Price lndex (CPI) for all Urban Consumers for theLos Angeles, Riverside, Orange County Areas.

WORK TO BE DONE. The work and improvement b be done shall be the operaton, lncluding fumishingelectric energy and flmlng/slruitching; maintenance, includirg lamp changing, emorgency servlces, pole painting,fixture cleaning and glas$rare replacement, and rehabilitration, which includes modemhaUon and replacement ofsystems; repairs, lncludlng poles, conduit wiring and fusing, and fixfi,rres repair and replacement; management of thefunds, records, engineering, equlpment approval and testng, adminlstation and assessmenb, buildings, vehlcles,equipment and materials; and related acffvities for the street lighting system designated herein under the'MAINTENANCE ASSESSMENT DISTRICT,'forthe fiscal year ending June 30, 2006, in accordance wlth the reportof the Board of PublicWorks therefiore, on file in the offce of the City Clerk.

AUTHORITY. The said vuork and improvement is to be made under and ls to be govemed in allparticulars by the Charter of the Ctty of Los Angeles, Section 580 and other sections; the Los Angeles AdministativeCode, Section 6.956.127; Proposltlon 218 (Artlcles Xlll C and Xlll D of the Califomia Constitution), and theOrdinance of lntention to be hereafter adopted therefore.

In accordance with Proposition 218, the City of Los Angeles provided notice to the property owners of the parcelsin the proposed Tramonto Drive and los Liones Drive Lighting Distict, as specified in the subject Council File.Along with that notice, each property owner received an assessru€nt ballot weighted by the amount of the parcel'sproposed assessment. I have tabulated the asscssment ballob delivered to my office by the final hearing date ofAugust 3,2005.

The proposed assessnrent distict faile4 because it received a weighted majority of "no" ballots as defined inArticle )Otr D (Proposition 218) of the State Constitution. As a result, the City may not inpose an assessnent forthe inprovement and maintenance of lighting in the proposed distict. The certified results of the tabulations areattached. I have also forwarded a copy of these resulr b the pe,partment of Public Works, Bureau of StneetLighting, for their information.

RECOMMEI{DATIONS FOR COI,'NCIL ACTION:

In accordance with C.ouncil policy adopted on Deccmber 19, 1997 (Cf 97{843) and the report of the Board ofPublic Works adopted by the Cor.rncil on lvlay 9, 1998:

l. FIND that a majority protest exists in the Steet Lighting Maintemance Assessment Dstrict andtherefore the proposed assessment carmot be enacted.

2. ADOPT the abandoning Ordinanoe attached to the Cormcil File.3. INSTRUCT the Director, Bureau of Steet Lighting, to assure that tlre steetlights are not installed

or are re,moved from service if previously insta[eq in accordance with Cormcil polioy.

An Ordinance pursuant to the provisions of Sections 6.95 - 6.127 of the LosAngeles Administrative Code, Section 53753 of the Catifomia Govemment Code, andProposition 218 (Articles Xlll C and Xlll D of the Califomia Constitution) declaring theintention of the Council of the Gity of Los Angeles to order the necessary street lightingsysterns to be operated, maintained, and repaired, including fumishing electric energy, forthe cunent Fiscal Year of 2OM-2005, for the lighting of that certain district designatid asthe:

TRAMONTO DRIVE AND LOS LIONES DRIVE LIGHTING DTSTRICT

THE PEOPLE OF THE CITY OF LOS ANGELES DO ORDAIN AS FOLLOWS:

Section 1. The public interest and convenience require, and it is the intention of theCouncil of the City of Los Angeles to order the following improvement to be made, to wit:

That the necessary street tighting equipment be operated, maintained and repairedand that electric energy be fumished for the cunent Fiscal Year of 2OM-2005, for thelighting of:

ln the City of Los Angeles (see Plan for details). The street or portions of streets to beimproved, and the district to be assessed to pay the costs and expenses of theimprovement, shall be known for all proceedings hereunder as:

Section 2. All of the said work shall be done in accordance with the report of theDirector of the Bureau of Street Lighting adopted by the Board of Public Works, therefore,approved by the City Council and on file in the office of the City Clerk. Reference to saidreport is hereby made for a full and detailed description of the proposed improvement andof the assessments to be levied.

Section 3. The said Council hereby makes all the costs and expenses of saidimprovement, including incidenta! expenses, chargeable upon the district to be benefitedthereby, with no additional portion of the costs to be paid out of the City Treasury.

Section 4. The Council hereby determines and declares that the district whichreceives special benefit from said improvement, and is to be assessed to pay the costsand expenses thereof, is described by the diagram with City page numbers 12425 andaccompanying assessment roll included by reference in the said report of the Director ofthe Bureau of Street Lighting adopted by the Board of Public Works, which diagramindicates by a boundary line the extent of the tenitory included within the assessmentdistrict. Reference is hereby made to said report and diagram for a full and completedescription of said district, which diagram shall govem for all details as to the extentthereof. All public streets and alleys or portions thereof are hereby excepted therefrom.

Section 5. That the proceedings for the said improvement shall be had and takenunder and in accordance with Sections 6.95 - 6.127 of the Los Angeles AdministrativeCode, Section 53753 of the Califomia Govemment Code, and Proposition 218 (ArticlesXlll C and Xlll D of the Califomia Constitution).

Section 6. The Board of Public Works shall prepare notices and ballots of saidimprovement to be mailed by the City Clerk to each property owner affected by theassessment, and have the notices to be published in newspapers of general circulationpublished and distributed in the several areas of the City in the manner and form andwithin the time required by law.

Section 7. The City Glerk shall conduct an assessrnent ballot proceeding for thislighting district, as required by Proposition 218 (Article Xlll D of the Califomia Constitution).Ballots shall be mailed with the hearing notices. The Clerk shall count, certif,, and reportthe results to the Council. The Council shall not impose the proposed assessment if thecount of the weighted 'no" votes is greater than the weighted Yes" votes, and the specifiedlighting system will not be installed. ln tabulating the ballots, the ballots shall be weightedaccording to the proportional financial obligation of the affected property due to theimprovement.

Section B. The proposed street lighting maintenance assessments referencedherein are intended to be in addition to or in replacement of the existing assessment, asspecified in the Enginee/s Report. Where the proposed assessment is to be in addition tothe existing assessment, whether the proposed assessment is levied or abandoned, theexisting assessment shall not be affected. Where the proposed assessment is to be inreplacement of the existing assessment, if the proposed assessment is not levied, theexisting assessment shall not be affected.

Section 9. For each year following the first year of the assessment, the amountsof the assessments designated in the assessment roll may be increased annually, withoutfurther notice or ballot, by no more than the annual Consumer Price lndex (CPt) for LosAngeles-Anaheim-Riverside CA, provided by the U.S. Dept. of Labor (Bureau of LaborStatistics). ). The annual Consumer Price lndex (CPl) will be calculated from the calendaryear (January 1-December 31) just prior to the assessment period affected (July l..June30).

Section 10. The administration of this district may be combined, without furthernotice or ballot, with the administration of any other district or districts, for which authorityfor such administrative combination is prwided in the establishing ordinance. Sucircombined districts, for all administrative purposes including but not limited to, assessment,diagram, revenue and expenditures, notice and balloting, may be treated as a singtedistrict.

Section 11. Notwithstanding that the assessments specified in the assessment rollare imposed for the 2004/05 fiscal year, only if the street lighting system is energized on orbefore July 1, 2005 shall those assessments be transfened to the 2OO4l05 property taxrolls and collected. lf the system is not energized on or before that date, the assessmentsapproved herein, may be levied in the fiscal year following the year in which the system isenergized, without further notice or ballot.

Section 12. That AUG 0I 2005 at the hour of 10 o'clock a.m. is the time,and the Council Chamber on the third floor in City Hall the City of Los Angeles is the place,when and where a public hearing on the proposed improvement and assessment wilt beheld by the City Council. Any person objecting to their assessment may file a writtenprotest or appeal with the City Clerk at any time prior to the hearing by the City Council.Any person may also present written or oral comments at the City Council hearing on thismatter. Such protest must contain a description of the property in which each signerthereof owns an interest, sufficient to identifo the property, and be delivered to the CityClerk, and no other protests than those presented within the time specified will beconsidered.

Ballots are due to the City Cterk at any time prior to or on the day of the hearing by CityCouncil. The City Clerk shall prepare a report of the assessment ballot proceeding resultsto the City Council.

Section 13. The City Clerk shall certiff to the passage of this ordinance and haveit published in accordance with Council policy, either in a daily newspaper circulated in theCity of Los Angeles or by posting for ten days in three public places in the City of LosAngeles: one copy on the bulletin board located in the Main Street lobby to the City Halt;one copy on the bulletin board located at the ground level at the Los Angeles Streetentrance to the Los Angeles Police Department; and one copy on the bulletin boardlocated at the Temple Street entrance to the Los Angeles County Hallof Records.

RECOMMENDATIONS:

That this report be adopted by your Board and fonararded, together with the transmittals, to theCity Clerk and City Councilwith your Board's recommendations that:

Council adopt this report and the Ordinance of lntention and that the proceedings beconducted in accordance with Sections 6.95 - 6.127 of the Los Angeles AdministrativeCode, Section 53753 of the California Govemment Code, and Proposition 218 (ArticlesXlll C and Xlll D of the Califomia Constitution). This includes Council holding a PublicHearing for the district.

b. Upon Council adoption of the Ordinance of lntention, the City Clerk be instructed to: 1)Mail notices of the assessment ballot proceedings, 2) Mail assessment ballots (asrequired by Prop. 218) prepared by the Bureau of Street Lighting and the City Clerk, tothe property owners in the lighting district, and 3) Conduct the assessment ballotproceedings.

Upon completion of ltem b above, the City Clerk be instructed to count, certify andreport the results of the assessment ballot proceedings to the Council.

Following the conclusion of the final public hearing, if a project has weighted "YES"votes equal to or in excess of weighted 'NO' votes, Council deny the appeals, confirmthe maintenance assessments, and adopt the Final Ordinance levying theassessments. lf weighted 'NO' votes are in excess of weighted 'YES" votes, Councilwill abandon the lighting district and proceedings in accordance with Proposition 218,and the affected street lighting system will not be constructed.

That a copy of this report be provided to each affected Council office and the Mayor's Office ofEconomic Development.

lf levied, the administration of this district may be combined with that of another district or districts inthe future as provided in the Ordinance of lntention.

The passage of Proposition 218 on November 5, 1996, requires a vote of the property owners prior toCouncil confirming and levying the assessments for maintenance.

Upon adoption of the transmitted Ordinance of lntention, the Council will set a date for hearingappeals and the last day to receive completed assessment ballots. A hearing to be held by yourBoard will be scheduled at least one week prior to the date of the public hearing before the CityCouncil to review and resolve any appeals conceming the proposed maintenance assessments. lf theassessment ballot proceeding as required by Proposition 218 approves these assessments, the CityCouncil may confirm and levy the assessments.

ln accordance with Council Policy adopted on December 11, 1998, the Bureau of Street Lighting willcast ballots in favor of the assessments for all Council controlled public properties in the district. TheTramonto Drive and Los Liones Drive Lighting District includes no public properties.

The protests that are received, as described in the Administrative Code, are for the consideration ofthe Council, but are not binding. Only a majority vote against the assessment is binding.

Abstract: The Bureau of Steet Lighting, for the Board of Public Works, administers and operatesthe street lighting system of the City. This inoludes managing the financing of thesystan. By Council Poliry, about 80% of the sheetlights are financed though streetlighting maintenance assessme,nts to benefiting properties, and the rest through theLADWP.

Proposition 218, section 4 (b), requires that "...All assessments shall be supported by adetailed engineer's report prepared by a registered professional engineer certified by theState of California..." 1. ST]MMARY

On November 5, 1996 the voters of California approved Proposition 218, which became part ofthe Califomia Constitution. It imposes additional requirerne,nts on local government whenassessments for stueet lighting maintenance are proposed. This engineer's report will explain themethodology for the calculation of the assessments, the City's policy between special and gene,ral

benefit and information about the subjectproject.

City furding is provided for steet lighting, which light tunnels, bridges, and minimal taffrcsafeff lighting installed on wooden pow€r poles. Under City Policy, funding for permanent stneet

lighting, which directly benefits nearby properties, is financed by assessments only.

Special Benefrt is the direct benefit to a property, and to its owner or users, based on the existenceof the nearby steet lighting systems that is designed to illuminate the roadway and sidewalkadjacent to the specific property at night. When there is a single sfreetlight in front of or near theproperty in que3tion, there is special benefit to the extent that the roadway and sidewalk areilluminated, notrrithstanding that the street lighting qystem for the block is incomplete.Proposition 218 allows the assessment of properties which receive special benefit, to the extentthat the assessmexrt is not greater than the reasonable cost of the proportional special benefitconfered on those parcels.

General Benelit is defined as a benefit to properties in the surrounding community or a bnefit tothe public in ganeral resulting from the improvemants, activities or services to be provided by theassessment lely. These benefits include the benefit from street lighting systems for locations thatdo not benefit specific properties, as well as interim lighting for minimal traffic safety on woode,npow€r poles and permanent lighting at intersections with mast arm or traffic vehicular heads. Anyspecial benefit from these lights will be intangible and not quantifiable in relation to their GeneralBenefit use. Proposition 218 requires the City to finance general benefit costs from other thanproperty assessments.. These costs are financed frompublic funds.

The tlpes of lighting that fall into these benefit categories are further outlined below.

3. STREET LIGHTING TYPES AI\D FINAI\CING

There are tlree tlpes of street lighting in the City of Los Angeles, each with different purposes,physical characteristics and financing modes. The following is a b,rief description of each:

A. SPECIAL BEI\IEITI - Special Benefit street light systems are perrnanent steetlight systemsdesigned to meet City sandards of illunrination which provide special benefit to nearbyproperties. These are generally systems with steel or concrete poles, urderground wiringintended to be part of a complete systsrn providing a designed level of illumination andmiformity on the roadway and sidewalk areas. These systems are gene,rally insalled througheither assessme,nts to nearby benefiting properties, grants or through requirernants on privatedevelopments, and are owned by the Departrrent of Public Works. The financing of theire,ntire costs of operation and mainte,nance is tlrouglt the amrual assessment of nearbyproperties that are determined to receive special benefit. All general benefits, if any, to thesurrormding community and public in general from these special benefit streetlight qystems

are intangible and are not quantifiable.

B. GEI\ERAL BEIYEFIT - General Benefit lighting systuns are permane,nt steet light systemand which illuminate vehicular and pedestian bridges and tunnels; intersections with mast armor traffic vehicular heads; and other locations whene there are no adjacent or nearby propertieswhich receive direct, special benefit. These are part of a cornplete qystern for the stnrcture, Gsteet providing a designed level of illumination and udformity on the roadway and sidewalkareas. The financing of their entire costs of operation and maintenance is through public fundsand/or Departnent of Water and Power fimds. These systerns are generally installed withpublic funding, and owned by the Department of Public Worls.

C. UTIIITARIAI\ LIGHTING - Utilitarian Lighting is a general benefit tlpe of stneet lightingthat is installe4 operated and maintained by the Departrnent of Water and Power. These lightsare mormted on wooden power poles, and do not have a designed average level of uniformityor illumination.

These lights are considered interinq minimal safety lighting for specific locations where thereare no permanent street lighting systerns. The costs of operation are financed through theDepartne,nt of Water and Power.

4. HOW STREET LIGHTING MAINTENAI\ICE ASSESSMENTS ARE CALCTJLA*TED

GeneralBased on Council Policy, Los Angeles Administative Code, annual City Budgets, andassessment proceedings, assessments are for the total estimated amount of the cost of operationand maintenance.

AII costs of street Iighting maintenance and operation for the subJect lighting qrrstems are tobe assessed-none are to be linanced with public funds.

The total estimated amounts of reve,nues and operating costs for previously assessed parcels areshown in the annual re,ports for the Los Angeles Clty Steet Lighting Maintenance AssessmentDistrict (LACLD). The assessment rates are based on these estimates, which rely on actual costsfor previous years, and on historic relationships between the different rates.Proper maintenance and operation of the streeflight infrastructure benefits all propertieswithin the District by providing security, safety, and community character and vitality.

In additiorU Proposition 218, the "Right to Vote on Taxes Acf' which was approved on tleNovember 1996 stat€vdde ballot and added Article )flIID to the Califomia Constitution, requiresthat a parcel's assessment may not exceed the reasonable cost for the proportional special benefitconferred on that parcel. Article )gID provides that only special benefits are assessable and theCity must separate the general benefits from the special benefits. It also requires that publiclyowned properties, which benefit from the improvements, be assessed.

MethodolowThe calculation method talces into account the following:

Benefit Zones - The tpe of steet lighting system that is installed. These will be identified asbenefit zones. These zones rnay indicate a modern system that provides the minimumillumination levels adopted by the City or may include pedestrian ligbting. Each zone requires acertain average energy usage, maintenance and eventual replacernent.

Equivale,nt Dwelling Units - The calculation will take into account the different land uses on theproperties for comparative purposes. (ex. A vacant prop€rty vs. a multiple family property vs. acommercial prop€rty.)

Benefit Factors - Benefit Factors will define the special benefit associated with the use of theproperly. Special Benefit Factors will be applied to properties that demonstate a different usepattern.

Partial Lighting Factors - Partial Lighting Factors will define the amount of frontage lit by thestreeflights.

Rates - The current rates have been set due to the Bureau's curent maintenance district. Theserates include ffiffgy, mainte,::ance, administration and eventual replacernent at the end of life.

All these factors will be evaluated and formulated into Benefit Units, utilizing EquivalentDwelling Units and Benefit Factors, which will then be multiplied by the corresponding rate perthe Benefit 7ane. Tlte following explains each factor in more detail.

Benefit ZonesBenefit Zones are used to differentiate behveen the different t1ryes of lighting service parcelsreceive. All parcels served by a similar kind of lighting system spaced a similar distance apartmight be considered to be in the same Benefit Zone.

Each benefit zone will have a specific Assessment Rate associated with it, and a parcel can be inmore than one benefit zone.

An area with a very high level of lighting, with tw'ice the number of lights installeq could be in aspecific benefit zone that would be charged twice the rate of those tlpes of lights. If that areaalso included pede.stian lights, it could be in trvo zones of benefit. Zones may be adjusted due toany identified general benefit corrrponant.

For parcels on comers with more than one lit side, the parcel will be zoned per the side that theprop€rty takes access.

We have determined that there are five (5) ditrerent levels of beirefit within the Distric! and theseare distinguished by different zone designations.

The zones id€rltified below are assumed to utilize en€rgy efficient larnps. Any request for lampsthat are not e,nergy efficient or require additional maintenance will need to be evaluated and therate will need to be adjusted accordingly.

Zane | - This zone is an orname,ntal lighting system on residential steets. This lighting systemgenerally is used to illuminate the roadway and sidewalk areas.

Tnne 2 - This zone is a modern lighting system on residential steets.

7-one 3 - This zone is a mode,m lighting system on arterial streets.

7-one 4 - This zone is applied to lighting systems that require additional maintenance or e,lrergy

than energy efficient lamps. This will apply to metal halide lamps and the zone will becombined with another zone.

Zonei- This zone is for special stand alone pedestrian electroliers on arterial steets. Thelighting system provides illumination for pedescrian use only. This Zone would be inaddition to Zone's 1,2,3 or 4.

Zane 6 - This zone is for special pedestrian systems that are attached to existing roadwayelectoliers. This Zone would be in addition toTnne's 1,2,3 or 4.

Eouivalent Ilwelline Units

In order to allocate benefit fairly between the parcels, an Equivalent Dwelling Unit @DU) methodologyis proposed which equates different residential and non-residential land uses to each other, therebyallowing a tmiform method of assessmeirt.

The EDU method uses the single-family home as the basic unit of apportionment. The average single-family residential parcel for the City of Los Angeles has a lot size of approximately 7,500 square feet (sf).This is considered a medirmtdensity single-family residantial parcel and has been selected as the basic

unit for calculation of assessments; therefore, the medium density single-family reside,ntial parcel isdefined as one Equivale,ntDwelling Unit (EDII).

Single Family Residential (SXR) Parcels.

A mediumdensity SER lot equals I EDU. All SFR parcels with lot sizes equal to l/8 acre and up to l/4Lcr.e (5,45 sf and 10,890 sf) are considered medium density SFR's.

SER parcels larger t}rrn ll4 acre are considered low density SFR's. Because these parcels are larger thanthe medium density SER's, and occupy more steet frontage per parcel, it makes se,nse that there are moresteet lights associated with these larger parcels; therefore, low dansity SFR's are assigned 1.25 EDU.

SFR parcels smaller than l/8 acre are considered high density SFR's. Because these parcels are smallerthan the medium density SFR's, and occupy less steet frontage per parcel, it makes sense that there are

fewer steet lights associated with these smaller parcels; therefore, high density SFR's are assigned 0.75EDU.

Other Residential Properties.

The equivalencies of other residential land uses are determined by multiplyrng the number of dwellingunits on each parcel by EDU Factors that are based on the relative population density of these residentialland uses. These factors are based on trip generation rates and estimated wastewater usage, which are bothrelated to population densrty.

Multi-family Residential G!mR) parcel (Apartnents and Condominiums) equivale,ncies are determinedbymultiplyng the nunrber of dwelling units on each parcel by a factor, which is used to approximate therelative population density of these gpes of dwelling units and reduced unit size as compared to thetlpical density and size of a SFR. The MFR parcels are b,roken into thnee density categories as follows:

MFR parcels with 1 - 4 dwelling rmits (duplexes, triplexes, 4-plexes and condominiuns) are consideredlowdensity MFR's and are assigned EDU's based on a factor of 0.75 EDU per Dwelling Unit (DI).

MFR parcels with 5 to 15 dwelling unis on the property are considered medium density MFR. For theseproperties, the first 4 DU's are assigned 0.75 EDU/DU and the next 5 to 15 units are assigned 0.5EDU/DU.

MER parcels with 16 or more dwelling units on the property are considered to be highdensity MER. Thebreak betlveen medium densrty and high density is considered to be at 15 dwelling units, because after 15

dwelling units apartnent complexes must have a manager on the prernises at all times. For theseproperties, the first 4 DU's are assigned 0.75 EDU/DU, the next 5 to 15 units are assigned 0.5 EDUIDU,and units over 15 are assigned 0.25 EDU/DU.

Mobile Home Park equivalencies are determined by multiplying the number of dwelling rmits on eachparcel by 0.5 due to the relative population density of these tlpes of dwelling units and reduced unit sizecompared to the tlpical density and size of a SER

Non-Residential Parcels

Non-residential properties aie converted to EDU's using the City of Los Angeles' avemge size for a SFRlot. As stated above, the average SER lot is approximately 7,500 sf, which is approximately 6 dwellingunits per acre. Therefore, non-residential parcels are assigned 6 EDU per acre or any portion thereof.

Non-residential properties include corun€rcial, industial, and institutional uses (such as schools,churches and hospitals). Utility properties are assessed the same as non-residential prop€rty, andGovernmental properties are assessed based on how they are used (this could be residential or non-residurtial).

Vacant Parcels.

Vacant property consists of parcels with few or no improved sfuctures. Based upon the opinions ofprofessional appraisers, appraising current market property values for real estate in Southern California,the land value portion of a property $rpically ranges from 20 to 30 percent of the property's total value.Additionally, the utilization of vacant property is significanfly less than improved property and vacantproperty has a traffic gane,ration rate of 0. Therefore, vacant SER lots will be assigned 0.25 EDU, and allother vacant parcels (including park and agricultural parcels) will be assigned benefit at the rate of 25Yo ofthe non-residential rate, or 1.5 EDU per acre or any portion thereof.

Table 1, below, shows the EDU rates assigned to the narious land uses.

The EDU rates are modified by Banefit Factors and Partial Lighting Factors, and the overall benefit toeach property is defined as follows:

The amount of benefit received will vary with the diftererrt land use on the property. There are twocategories from which the total benefit of a parcel is derived:

l. Security and Safety Benefit The prevention of crime and the alleviation of the fear of crime at theassessed properties, and the prevantion of local pedestrian and traffic accidents related to the assessedproperties.

2. Community Character and Vitality Benefrt. The promotion of social interaction, promotion ofbusiness and industry, and the contribution to a positive night time vizual image for the assessedproperties.

To assign the benefit factors, each land use is compared to residential properties. Residential propertiesare the base properties and are assigned benefit factors of I for both the "Security and Safety Benefit" andthe'Conrmunifi CJwracter and Vitality Benefif'.

Commercial and institutional properties benefit similarly to residential property and therefore are assignedthe same benefit factors. Parks, which are assessed as vacant lan{ also benefit similarly to reside,lrtialproperty.

hdustrial and utility properties receive benefits from added security and safety, but really receive nobenefit for comrnrmity character and vitality, as the nature of these properties do not promote either.

Likewise, vacant and agricultrne properties receive benefits from added security and safety, although notat nearly the level of developed property, but really receive no benefit from additional communitycharacter and vitality.

Table2 provides a summary of the Benefit Factors that are ap,plied.

The EDU rates are fr:rther modified by Partial Lighting Factors that take into consideration the amount offrontage lit by the streetlights. If almost the entire frontage of a parcel is lit, then the Partial LightingFactor is 1.0. If the frontage of a parcel is not fully lit, then a Partial Lighting Factor of 0.75, 0.50 or 0.25will be applied depending on the percentage of frontage lit.

5. ASSESSMENT RATES

Based on2004105 estimated annual budget, the following table provides the Maximum Assessment Ratesfor each ofthe Zones:

*The maximum annual maintenance assessment rates will be increased each year by 2Yo, not to exceedthe annual change in the Consumer Price Index (CPD for all Urban Conzumers for the Los fuigeles,Riverside, Orange County Areas.

The actual assessments levied in any fiscal year will be as approved by the City Council and may notexceed the maximum assessment rate without receiving properly owner approval for increase.

The actual annual assessment rates for ach Tnne will be calculated each year based on the estimatedcosts of operating and maintaining the steet lighting systsm in the following fiscal year.

IN THE CITY OF LOS ANGELESFOR 2004-05

WORK TO BE DONE. The work and improvemant to be done shall be the operation,including furnishing electric energy and timing/switching; maintenance, including lamp changing,emergency sernrices, pole painting, fixttre cleaning and glassware replacernent and rehabilitation, whichincludes modernization and replacement of systems; repairs, including poles, conduit wiring and fusing,and fixtures repair and replaceme,nt; nranagement of the funds, records, engineering equipment appnoval

and testing, administafion and assessments, buildings, vehicles, equipment and materials; and relatedactivities for the street lighting system designated herein uder the'MAINTENANCE ASSESSMENTDISTRICT," for ttre fiscal year ending Jrme 30, 2005, in accordance with the re,port of the Board ofPublic Worts therefore, on file in the office of the City Clerk

AUTIIORITY. The said work and improvement is to be made rmder and is to be govemed inall particulars by the Charter of the City of Los Angeles, Section 580 and other sections; the Ios AngelesAdministrative Code, Section 6.954.127; Proposition 218 (Articles )iltr C and )([U D of the CaliforniaConstihrtion), and the Ordinance of Intention to be hereafter adopted therefore.

LIGHTING SYSTEM. The street lighting system consists of electroliers, luminaires,and lamps, together with the necessary conduits, cables, wires and other appurtenances. Plansshowing the location and description of said equipment are on file in the office of the Bureau ofStreet Lighting and are hereby referred to and made apmt of these specifications. The propertiesto be be,nefited by the work 41d improvement are designated in the assessme,nt diagrams on filein the office of the Bureau of Steet Lighting; Assessment Engineering Division, and are herebyreferred to and made apart of the specifications.

OPERATION SCIIEDULES. The lighting systan shall be lighted in accordance with the AllNight and 1:00 a.rn schedules of operation, and minor exceptions, as agreed upon by the Departnent ofPublic Works and the Deparhent of Water and Power, or otherutility suppliers.

ELECTRIC ENERGY. It is contermplated that the City of Los Angeles, through its Deparunentof Public Worls, will purchase electric energy as it may deem necessary from the Departnent of Waterand Power, or other utility suppliers, in accordance with the tams, conditions, and rates prescribed for inzuch seirrices as have been agreed upon by the Board of Public Works and the utility supplier, andapproved by the City Council.

MAINTENANCE. The Departnent of Public Works will itself perform the work, or willcontact for certain work with the Deparbnent of Water and Power, or private companies, in providingnormal maintenance for the following distric(s), in accordance with the terms, and conditions asprescribed for in such services as have been agreed upon by the Board of Public Works and the supplier,and approved by the City Corurcil.
