Article IX :As used in this chapter, the term "water pollution" refers to any detrimental change resulting
from human conduct in the natural composition, content, or quality of the waters of an international
drainage basin.
Article X :
1. Consistent with the principle of equitable utilization of the waters of an international drainage basin, a
State:
a) Must prevent any new form of water pollution or any increase in the degree of existing water
pollution in an international drainage basin which would cause substantial injury in the territory of a
co-basin State;
b) Should take all reasonable measures to abate existing water pollution in an international drainage
basin to such an extent that no substantial damage is caused in the territory of a co-basin State.
2. The rule stated in paragraph 1 of this article applies to water pollution originating:
a) Within a territory of the State, or

b) Outside the territory of the State, if it is caused by the State's conduct.
Article XI:
1. In the case of a violation of the rule stated in paragraph 1 (a) of article X of this chapter, the State
responsible shall be required to cease the wrongful conduct and compensate the injured co-basin State
for the injury that has been caused to it.
2. In a case falling under the rule stated in paragraph 1 (b) of article X, if a State fails to take reasonable
measures, it shall be required promptly to enter into negotiations with the injured State with a view

Article 27 Pollution :
1. States shall prevent, eliminate, reduce, or control pollution in order to minimize environmental harm .
2. When there is a relevant water quality standard established pursuant to Article 28, States shall take all
appropriate measures to assure compliance with that standard .
3. States shall ensure that wastes, pollutants, and hazardous substances are handled, treated, and
disposed of using the best available techniques or the best environmental practices, as appropriate to
protect the aquatic environment. 3 Article 28: Establishing Water Quality Standards
1. States shall establish water quality standards sufficient to protect public health and the aquatic
environment and to provide water to satisfy needs, in particular for:
a) Providing drinking water of sufficiently good quality for human health;
b) Preserving ecosystems;
c) Providing water for agriculture, including irrigation and animal husbandry; and
d) Providing for recreational needs with due regard for sanitary and aesthetic requirements.
2. Standards established under this Article shall include, among others:
a) Specific quality objectives for all waters within a State’s jurisdiction or control, taking into
account the uses of the particular waters;
b) Specific quality objectives applicable to a particular basin or part of a basin.

without prejudice to their contractual obligations, States shall be under a duty to ensure that their activities
or those conducted within their jurisdiction or under their control cause no pollution in the waters of

circumstances, all measures required to:
a) prevent any new form of pollution or any increase in the existing degree of pollution; and

1. Watercourse States shall, in utilizing an international watercourse in their territories, take all
appropriate measures to prevent the causing of significant harm to other watercourse States.

2. Where significant harm nevertheless is caused to another watercourse State, the States whose use
causes such harm shall, in the absence of agreement to such use, take all appropriate measures, having
due regard for the provisions of articles 5 and 6, in consultation with the affected State, to eliminate or
mitigate such harm and, where appropriate, to discuss the question of compensation. 1 Article 10: Relationship between different kinds of uses:
1. In the absence of agreement or custom to the contrary, no use of an international watercourse
enjoys inherent priority over other uses.
2. In the event of a conflict between uses of an international watercourse, it shall be resolved with
reference to articles 5 to 7, with special regard being given to the requirements of vital human needs”. 2 Article 12: "Notification concerning planned measures with possible adverse effects Before a watercourse
State implements or permits the implementation of planned measures which may have a significant adverse
effect upon other watercourse States, it shall provide those States with timely notification thereof. Such
notification shall be accompanied by available technical data and information, including the results of any
environmental impact assessment, in order to enable the notified States to evaluate the possible effects of
the planned measures".

1 “PART IV.:PROTECTION, PRESERVATION AND MANAGEMENT: “Article 20: Protection and
preservation of ecosystems Watercourse States shall, individually and, where appropriate, jointly, protect
and preserve the ecosystems of international watercourses”. 2 “Article 21: Prevention, reduction and control of pollution:
1. For the purpose of this article, “pollution of an international watercourse” means any detrimental
alteration in the composition or quality of the waters of an international watercourse which results
directly or indirectly from human conduct.
2. Watercourse States shall, individually and, where appropriate, jointly, prevent, reduce and control the
pollution of an international watercourse that may cause significant harm to other watercourse States
or to their environment, including harm to human health or safety, to the use of the waters for any

beneficial purpose or to the living resources of the watercourse. Watercourse States shall take steps to
harmonize their policies in this connection.
3. Watercourse States shall, at the request of any of them, consult with a view to arriving at mutually
agreeable measures and methods to prevent, reduce and control pollution of an international
watercourse, such as:
d) Setting joint water quality objectives and criteria;
e) Establishing techniques and practices to address pollution from point and non-point sources;
f) Establishing lists of substances the introduction of which into the waters of an international
watercourse is to be prohibited, limited, investigated or monitored. 1 Article 22: Introduction of alien or new species: "Watercourse States shall take all measures necessary to
prevent the introduction of species, alien or new, into an international watercourse which may have effects
detrimental to the ecosystem of the watercourse resulting in significant harm to other watercourse States". 2 Article 23: Protection and preservation of the marine environment:
"Watercourse States shall, individually and, where appropriate, in cooperation with other States,
take all measures with respect to an international watercourse that are necessary to protect and preserve
the marine environment, including estuaries, taking into account generally accepted international rules
and standards".

1 Article 27: Prevention and mitigation of harmful conditions: "Watercourse States shall, individually and,
where appropriate, jointly, take all appropriate measures to prevent or mitigate conditions related to an
international watercourse that may be harmful to other watercourse States, whether resulting from natural
causes or human conduct, such as flood or ice conditions, water-borne diseases, siltation, erosion, salt-
water intrusion, drought or desertification". 2 Article 28: Emergency situations:
1. For the purposes of this article, “emergency” means a situation that causes, or poses an imminent
threat of causing, serious harm to watercourse States or other States and that results suddenly from
natural causes, such as floods, the breaking up of ice, landslides or earthquakes, or from human
conduct, such as industrial accidents.

2. A watercourse State shall, without delay and by the most expeditious means available, notify other
potentially affected States and competent international organizations of any emergency originating
within its territory.
3. A watercourse State within whose territory an emergency originates shall, in cooperation with
potentially affected States and, where appropriate, competent international organizations,
immediately take all practicable measures necessitated by the circumstances to prevent, mitigate and
eliminate harmful effects of the emergency.
4. When necessary, watercourse States shall jointly develop contingency plans for responding to
emergencies, in cooperation, where appropriate, with other potentially affected States and competent
international organizations. 1 Article 32: Non-discrimination:
"Unless the watercourse States concerned have agreed otherwise for the protection of the interests of
persons, natural or juridical, who have suffered or are under a serious threat of suffering significant trans
boundary harm as a result of activities related to an international watercourse, a watercourse State shall not
discriminate on the basis of nationality or residence or place where the injury occurred, in granting to such
persons, in accordance with its legal system, access to judicial or other procedures, or a right to claim
compensation or other relief in respect of significant harm caused by such activities carried on in its
territory".

4. It is also understood that the following provisions will be observed with regard to irrigation works of

3 First: THE PRESENT ACQUIRED RIGHTS:

1. That the amount of the Nile waters used by the United Arab Republic until this Agreement is signed
shall be her acquired right before obtaining the benefits of the Nile Control Projects and the projects
which will increase its yield and which projects are referred to in this Agreement; The total of this
acquired right is 48 Milliards of cubic meters per year as measured at Aswan.
2. That the amount of the waters used at present by the Republic of Sudan shall be her acquired right
before obtaining the benefits of the projects referred to above. The total amount of this acquired right
is 4Milliards of cubic meters per measured at Aswan. 1 Second: THE NILE CONTROL PROJECTS AND THE DIVISION OF THEIR BENEFITS BETWEEN
THE TWO REPUBLICS:
1. In order to regulate the River waters and control their flow into the sea, the two Republics agree that
the United Arab Republic constructs the Sudd el Aali at Aswan as the first link of a series of projects
on the Nile for over-year storage.
2. In order to enable the Sudan to utilize its share of the water, the two Republics agree that the Republic
of Sudan shall construct the Roseires Darn on the Blue Nile and any other works which the Republic
of the Sudan considers essential for the utilization of its share.
6. The United Arab Republic agrees to pay to the Sudan Republic 15 Million Egyptian Pounds as full
compensation for the damage resulting to the Sudanese existing properties as a result of the storage in
the Sudd el Aali Reservoir up to a reduced level of 182 meters (survey datum). The payment of this
compensation shall be affected in accordance with the annexed agreement between the two parties. 2 Third: PROJECTS FOR THE UTILIZATION OF LOST WATERS IN THE NILE BASIN:
1. The Republic of the Sudan in agreement with the United Arab Republic shall construct projects for
the increase of the River yield by preventing losses of waters of the Nile Basin in the swamps of Bahr
El Jebel, Bahr el Zeraf, Bahr el Ghazal and its tributaries, the Sobat River and its tributaries and the
White Nile Basin. The net yield of these projects shall be divided equally between the two Republics
and each of them shall also contribute equally to the costs. 3 Fourth: TECHNICAL CO-OPERATION BETWEEN THE TWO REPUBLICS:
1. In order to ensure the technical co-operation between the Governments of the two Republics, to
continue the research and study necessary for the Nile control projects and the increase of its yield and
to continue the hydrological survey of its upper reaches, the two Republics agree that immediately
after the signing of this Agreement a Permanent joint Technical Commission shall be formed of an
equal number of members from both parties; and its functions shall be:
c) above in connection with works constructed within the boundaries of Sudan and also in
connection with the Sudd el Aali Reservoir and Aswan Dam, through official engineers
delegated for the purpose by the two Republics; and the supervision of the working of the upper

Nile projects, as provided in the agreements concluded with the countries in which such projects
are constructed, As it is probable that a series of low years may occur, and a succession of low
levels in the Sudd el Aali Reservoir may result to such an extent as not to permit in any one year
the drawing of the full requirements of the two Republics, the Technical Commission is charged
with the task of devising a fair arrangement for the two Republics to follow. And the
recommendations of the Commission shall be presented to the two Governments for approval. 1 Protocol to the Agreement between the United Arab Republic and the Republic of Sudan for the full

نزاعا قابال للتحكيم أو التسوية القضائية أو اإلحالة إلى األمم المتحدة، فإذا ما تبين حدوث أو عدم حدوث األضرار بالصالح الحيوية يعتبرألي من هذه الجهات التي تنظر مثل هذا النزاع أن التصرف اإلنفرادي إلحدى الدول يمس فعال مصالح حيوية لدول أخرى فإن على الدولة
ا كانت الفوائد التي تعود عليها من المشروع أما إذا ما تبين عدم وجود هذه المصلحة المستفيدة أن تمتنع عن تنفيذ األعمال المقترحة أي فيسمح باإلستمرار في تنفيذ األعمال المقترحة مع دفع التعويض العادل.

The study talks about the principle of the obligation not to cause
significant harm as one of the customary rules governing the use of
international rivers, it discussed types of rivers pollution and it’s risk
including, organic, chemical pollution, pollution of oil and its derivatives, as
well as radioactive contamination, gases, nitrogen pollution.
It also addressed the legal rules governing the use of international
rivers, and it focus on the principle of the obligation not to cause significant
harm and it’s, It discussed the legal rules to protect the ecosystem of the
river from pollution in international conventions before 1997, and the
exerted efforts of the International Law Commission in this regard, and it
tries to explain articles about protection and preservation of in the
1997United Nations Convention.
After the United Nations Convention there are many efforts for
cooperation between the Nile Basin countries start of the Nile Basin
Initiative to agreement of Entebbe 2010, and the study suggests that
although the variation reaction of Nile Basin countries on the United
Nations Convention as it was rejected by Burundi, Eritrea, Uganda and
Congo did not participate in the voting, Egypt Rwanda and Tanzania
abstained, it was approved by Sudan and Kenya, but all these efforts adopts
the same principles of United Nations Framework Convention.
The study discuss pollution of River Nile, types and effects of it, and
efforts to protect the River Nile from pollution in the light of the provisions
of international law and obstacles face it, It also discussed the international
liability about violation of the principle not to cause significant harm.

Summary:
The importane of this study addressed the obligation not to cause significan
harm, and it consider pollution is one form of harm, it confirm that states
have to take into consideration that harm is not only about quantity of water
but it’s quality also. It also talked about international liability about violation
of the princible of not to cause significant harm, in addition to discuss
International Liability for Injurious Consequences arising out of Acts not
Prohibited by International Law.
