Whereas by Government Notification No. PWD/LA/1258/ /60/71 dated 11-11-1971 published on pages 241 to 243 of Series II, no. 35 of the Official Gazette dated 25-11-1971 it was notified under section 4 of the Land Acquisition Act, 1894 (hereinafter referred to as the said Act) that the land specified in the schedule appended to the notification hereinafter referred to as the said land) was likely to be needed for the public purpose viz. Construction of Pariari to Bamanpuja Road.

And whereas the appropriate Government (hereinafter referred to as «the Government») is satisfied that the said land specified in the schedule hereto is necded to be acquired for the public purpose specified above.

The PUerne Marna Coop. Bardez was registered 18-12-1963 No. RES-(c)-136-/Goa. The L;ain object of the y improve the economic condition of agriculturists to the agricultural development the area. The working 01' the said society was more or Ie,::,; normal for three yean; from the date of inception. the lvlanaging Committee the society did not take interest in the affairs of SOciety which eventually in stagnation of the working of the said society.

In view of the above the l'1anaging Committee of the said society was superseded on 9·'7,,68 and an Administrator was appointed under provisions Section 78 (1) of the Maha­rashtra Coop. Societies Act, 1960 as applied to the Union Territory of Goa, Daman and Diu to manage the affairs of the said society.

The main object of appointing an Administrator was to put the working of the society on proper and sound footing. However the Administrator could not succeed in reviving the working of the ISociety and to improve its financial position within the stipulated period. F'urther the Administrator called the special general body meeting on 7-'7-72 in order to elect the new managing committee of the society. But none of the members came forward to be represented on the Managing Committee and take the responsibility of the society.

Hence it is felt that no useful purpose would be served in continuing the affairs of the society, and the same may be wound up. Hence I pass the following order':--

,society is to encourage thrift, self help and cooperation among its members, to secure a better and maximum price for coconut and to supply seeds, manure, implements and

. other agricultural requirements to members.

As per the audit report for the Cooperative year 1970-71 it is seen that the society has remained stagnant since the last three years and the Managing Committee Members are also reluctant to take the responsibility of the society and to restart it<:l working.

Further the society vide its resolution No.4 in the general body meeting dated 3-2-72 recommended to the Registrar to sUp'ersede the Managing Committee and to appoint a committee of administrators under the provisions of clause (a) of Sub-section (1) of Section 78 of the Act.

In the circumstances a notice under Section 78(1) of the Maharashtra Coop. Societies Act, 1960 as applied to the Union Territory of Goa, Daman and Diu read with Rule 61(2) of the Coop. Societies Rules 1962 was issued to all the members of the Managing Committee of the aforesaid society requesting them to show cause as to why the Ma­naging Committee should not be superseded. None of the members had any objection to the supersession.

In view of the aforesaid, I remove the Managing Com­mittee of the aforesaid society and pass the following order.

In exercise of the powers vested in me under Section 78(1) ,of the Maharashtra Coop. Societies Act, 1960 as applied to

the Union Territory of Goa, Daman and Diu, read with Rule 61(2) of the Coop. Societies Rules 1962, I Vaman Sar­desai, Registrar of Coop. SOCieties, Goa, Daman and Diu, heveby remove the Managing Committee of Coconut Produ­cers Coop. Society Ltd." consisting of 9 members mentioned below with effect from the date of issue of this order.

Subject: Supersession of the Managing Committee under Section 78(1) of the Maharashtra Coop. Societies Act, 1960 as applied to the Union Territory of Goa, Daman and Diu, read with Rule 61(2) of the Cooperative Societies Ruks, 1962.

The Sarzora Service Cooperative Society Ltd., Sarzora­-Salcete was registered on 20-2-1965 under No. RES-(c)--183/Goa. The main objects of the society are to bring about agricultural developments in the area of operation of the society and to improve the economic conditions of the mem­bers by providing agricultural loans and requisites in cash and kind.

It is, however noticed that the working the said society is not satisfactory. It did not convene its Annual General Body meeting for the years 1969-70 and 1970-71. It is also evident from the audit report of the society for the year 1970-71 that its fair price shop was closed down for the last 2 years and the SOCiety is stagnant, No new Managing

Committee for the year 1971-72 was elected. The members of the Managing Committee are not interested in riviving the working of the society and they are not performing their duties as per the Act, Rules and Bye-laws with the result that the working of the society has come to a standstill. Since the present Managing Committee has no interest in the affairs of the society and since no new Managing Com­mittee for the year 1971-72 was elected, I am of the opinion that the Managing Committee should be superseded in order to run the affairs of the society.

In the circumstances a notice under Section 78(1) of the Maharashtra Cooperative Societies Act, 1960 as applied to the Union Territory of Goa, Daman and Diu, read with Rule 61(2) of the Cooperative Societies Rules, 1962 was issued to all the members of the Managing Committee of the aforesaid society requesting them to show cause as to why the Managing Committee should not be superseded.
