DEMANDS

Demand No. (I) Rise·in Basic Wages: Our present basicwages are extremely low. They &re not at all consistent withthe skills'displayed by the workmen in producing the goods.The work that workmen carry out is highly skilled'W.drk andthe basic wages of workmen must be raised in sucl1 a wayso as to justify the skills required in performing the jobs.

The Union, therefore, demands that the basic wages 'ofall the workers should be raised by Rs. 500/- pei month.

Demi:md No. (2) Rise in fixed dea'rness allowmice,.: Thepresent fixed dearness allowance which the workers aregetting isthe bare minimum compared to the ever increasinginflation, whilethe basic wages are dependent on the skillsrequired to perform a job, the fixed dearness allowancedepends upon the rise in prices of essential goods neededto keep the body and soul together. The present fixed dear­ne~s allowance is not able to do justice to the aspiration ofth<> workmen. It should, therefore, be raised by Rs. 800/- pe,.month, so justice could be done,

Demand No. (3) Rise in variable dearness allo>vance~' As .the .consumer price index is ever increasing in India, espe­cially in Goa, where the li~ing standard is the highest in Iqdia.the variable dearness allowance'~ssumes sped.al significa,;,tion. If the rate at which the variable dearl1essallow~tn·ce iscalculated is sufficiently decent, then the variable de~,ness

alIbwance will increase so as to compensate for the rl'ge inprices of essential goods, and therefore, we are aspiring fora decent variable dearness allowance rate.

Keeping this mind, all the workers should be granted araise of Rs. 300/- per month in their variable dearness allow­ance, and the rate of variable dearness allowance should beRs. 3/" per point rise or fall.

Demllnd No. (4) Rise in house rent allowance: Houseaccommodation or house construction-or repairs-_-in Goa hasbecome the costliest with the land prices rising by leaps andbounds. Workmen have to pay mOre Ql1 rents atid are, also'required to pay more on house repairs;;A large part of thewages of workmen are spent on their house accommodationl

The house rent of all the workmen should, therefore, beraised by Rs. 4001- per month.

Demand No. "(5) Ri~e in conveyancesallowimce : Trans­port fares and petrol prices are revised upward in Goa almostevery year and the present transport fares ,and petrol pricesare Indeed exhorbitant. All the workmen should,;thereklre, .get conveyance allowance- consistent with the rise in trans­port fares and petrol prices. Their conveyance allowanceshould be raised by Rs. -4001" per month.

~Demand No. (6) Rise in education allowance: Educa­tional expenses are on the rise and. considering the samepresent meagre allowance paid for education is reallynegligible. It should be raised at least bo/ Rs. 3001- permorth.

~mand No. (7) Rise in special allowance: All the work­ers should be given a rise of Rs. 3001-, in their specialallow~nce.

Dem(lnd No. (8) 'Rise in washing allowance; All theworkers ,should be granted a rise of Rs. 2001- per month, intheir wa.1>ing allowance.

Deman~ No. (9) Bonus under Payment of BonusACT: 20% Bonus should be paid to all the workersirrespective\of the nature and status of their service or jobs.

Demand ilia. (10) Pay scales a~d grQdes: All the workers,should be grapted proper and suitable pay scales and gradeskeeping in vi¥w the modern service conditions.

Demand No\ (1 j) Privilege leave: Privilege leave shouldbe increased ftpm 17 days to 25 days, excluding Sundays,public and fest!yal Holidays.

Demand No.' (12) Sick leave: Minimum 7 days of sickleave should be granted, as sickness on account ofindustrialhazards is on the raise.

Demand No. (15): The present Leave Travel Allowanceof Rs. 1500/- per year, per' worker, should be increased toRs. 50001- per month, per employee, as Travel fares andaccommodation have increased manyfold during the last 3years. The increase is sought in order to·compensa~e thetremenddus rise as indicated above.

Demand No. (16) Loansfor Workers: Permanent workersshould be granted loans of Rs. 250001- per worker withoutinterest and suitable instalments should be deducted fromtheir salaries, say Rs. 5001- per month, towards, repayment.

Demand No. (17) Transfer ofworkers: Transfer of workersfrom one factory to another factory should not be made underany conditions.

Demand No. (18) Emergency/power failure: In situationemergency of power failure, the Company shOuld bear theconsequent losses. The COmpaflY should nOt force theworkers to work on Sundays or Holidays or off days or onleave days.

Demand No. (19) Overtime: Overtime;·if instructed todo, should ,be paid double the days wages',\calculated and

based upon the basic wages, FDA, VDA and all theallowances. If, Overtime is done on a Sunday or a -paidHoliday, one day off should be given, in addition to whathas been stated above.

Demand No. (20) Period of settlement: The period ofsettlement should be three years effectively from the dateyou receive this Charter of demands,

Demand No. (if) Caveat: The Union reserves the rightto delete, add or amend any demand at the time, or duringthe negotiations on' the Charter of demands.

Rules. 1992 (hereinafter referred to as the "said Rules"), theGovernment of Goa in consultation with the Goa PublicService Commission, h~reby appoints Shri Devidas M. Kerkar,to the post of Civil Judge, Junior Division, under Grade IIJunior Branch of the Civil Service (Judicial Branch), in apurely temporary capacity with effect from the date he as-.sumes charge of the post in. the paiscale ofRs. 8<\00-275;13500/- subject to the following terms and conditions:-

I) He shall be on probation fora period of two yearswhich may be reduced or extended by the competentauthority.

il) The appointment may be terminated at any time byamonth's notice given by either side, viz. the appointeeor the appointing authority, without assigning anyreason. The appointing auth.ority however, reservesthe. right to terminate the services of the appointeeforthwith or before the expiration of the stipulatedperiod of notice by making payment to him a sumequivalent to the pay and allowances for the periodof notice of,the unexpired portion thereof.

iii) The appointment carries with it the liability to servein any part of the State of Goa.

IV) . Other conditions of service will be governed by therelevant rules and orders in force,from time to time.

The appointment is Jurther subject to:-

(i) production ofa certificate offitness to the Government(Law and Judiciary Department, Secretariat Annexe)from the competent authority (viz. Medical Board!/Civil Surgeon D. M. O./Authorized MedicalAttendant).

(ii) submission of a declaration in the from enclosed(Annexure I), to the Government (Law and JudiciaryDepartment, Secretariat Annexe) and in the event ofthe candidate having more than one wife living, orbeingmarried to a person having more than one wifeliving the appointment will be subject to his beingexempted from the enforcement of the requirement

in this behalf.

(iii) taking of an oath of allegiance/faithfulness to theConstitution of India (or making of a solemnaffirmation to that effect) in the prescribed form.

(iv) production of the following original certificates tothe Government (Law & Judiciary. Department,Secretariat Annexe) (where these have not beenproduced already at the selection stage):-

(a) Degree Certificates of educational and ·otherqualifications.

(b) Certificate of Birth.

(c) Character certificates in the prescribed form(Annexure II) attested by a Distri.ct Magistrate or

Sub-Divisional Magistrate or by their SuperiorOfficers.

(d) Certificates in the prescribed form in support ofcandidate's claiming to belong to a ScheduledCaste or Tribe/Anglo-Indian Community.

(e) Discharge Certificates in the prescribed form ofprevious employment, if any.

(v) The appointment is subject to decision of Hon'blethe Supreme Court and Hon'ble High Court in therespective Writ Petitions in which the validity of therules is under challenge.

(vi) The appointment is subject to the decision ofthe Hon'bleSupreme Court and the Hon'ble High Court in theirrespective Writ Petition in which the validity of theRul,es is under challenge.

(vii) No travelling allowance will be allowed for joining theappointment. .

4. The Government further appoints under clause (c) ofsection3 of the said Act Deputy CollectorlSDO, Ponda to performthe functions of a Collector, North Goa District, Pailaji underthe said Act in respect of the said land.

Notification

And whereas in the opinion of the Government the provisionsof sub-section (I) of section 17 of the Land Acquisition Act,1894 (Central Act I of 1894) (hereinafter referred to as "thesaid Act") are applicable.

Now, therefore, the Government hereby notifies under sub­section (I) of section 4 of the said Act, that the said landis likely to be needed for the purpose specified above.

The Government further directs under sub-section (4) ofsection 17 of the said Act that the provisisotls of section 5Aof the said Act shall not apply in respect of the said land.

2. All persons interested in the said land are hereby warnednot to obstruct of interfere,with any surveyor or other personsemployed upon the said land for the purpose of the saidacquisition. Any contract for the disposal of the said landby sale, lease, mortgage, assignment, exchange or otherwiseor any outlay commenced or improvements made thereon withoutthe sanction of the Collector appointed under paragraph 4 below,after ·the date of the publication of this Notification, will underclause (seventh) of section 24 of the· said Act be disregardedby him while assessing compensation for such parts of thesaid land as may be finally acquired.

3. If the Government is satisfied that the said land is neededfor the aforesaid purpose,· a declaration to that effect undersection 6 of the said Act will be published in the Official Gazetteand in two daily newspapers and public notice thereof shallbe given in due course. If the acqulsition is abandoned whollyor in part the fact will also be notified in the same manner.

Whereas it appears to the Government of Goa (hereinafterreferred to as "the Government") that the land specified in theSchedule hereto (hereinatier referred to as the "said land") islikely to be needed for public purpose, viz. for constructionof office building for Central Water Commission at Bandorain Panda Taluka.
