the Government of Goa, being satisfied that it is
necessary in the public interest, hereby directs
that all licensed premises “for the sale of liquor”
located within the jurisdiction of ward No. 1 of
the village panchayat of Curti Khandepar,
Ponda-Goa, shall be closed from 21-09-2013 to
23-09-2013 in view of Bye-election to vacant ward
of village panchayat Curti Khandepar, Ponda-Goa.
The licensed premises having license for “Bar
and Restaurant” may be allowed to keep the
restaurant open for serving food only. However,
the Bar counter shall be closed and no liquor shall
be allowed to serve on the said days. The owners
of the license premises having “Bar & Restaurant”
shall also display a board in the premises that no
liquor will be served and that the restaurant will
be open for serving food only.

In exercise of the powers conferred by sections
5 and 8 of the Goa Excise Duty Act, 1964 (Act 5 of
1964) (hereinafter called the “said Act”), the
Government of Goa hereby prescribes that,
notwithstanding anything contained in the
Government Notifications No. Fin (Rev.)/2-35/SE/
/6/68/(A) dated 29-2-1972 and No. Fin (Rev.)/2-35/
/SE/6/65/(B) dated 29-2-1972, the following shall
be the maximum quantity of liquor which can be
transported from one place to another within the
jurisdiction of Ward No. 1 in village panchayat of
Curti Khandepar, Ponda Taluka, Goa by any person
or which can be possessed by any person within
said area without a permit issued in accordance
with the provisions of the said Act and the Rules
made thereunder, from 21-09-2013 to 23-09-2013.
(a) Three quart bottles of Indian made foreign
liquor other than beer and six bottles of beer
for any person including his family.
(b) Three quart bottles of country liquor for any
person including his family.
This Notification shall remain in force only from21-09-2013 to 23-09-2013. In view of Bye Election
of village panchayat of Curti Khadepar, PondaTaluka, Goa.

Competent Authority carried out a surprise
inspection of the office of the Notary;
And whereas, during such inspection, the
Competent Authority noticed that the certificate
of practice was not exhibited in the chamber/office
of the Notary, the exhibition of which is mandatory
as per rule 15 of the Notaries Rules, 1956;
And whereas, the Competent Authority furthernoticed that the rates of fees to be charged by theNotary were not displayed in conspicuous placeinside as well as outside the chamber/office of theNotary, the display of which is mandatory as per rule10(2) of the Notaries Rules, 1956;
And whereas, the Competent Authority further
noticed that the fees and charges realized by theNotary were not shown in the notarial registerwhich amounts to violation of rule 11(9) of theNotaries Rules, 1956;

And whereas the Competent Authority also no-ticed that the notarial registers were not maintainedproperly and entries against some serial numbers ofthe notarial registers were kept blank whichamounts to violation of rule 11(2) of the NotariesRules, 1956;
And whereas, the Competent Authoritysubmitted the inspection report to the Government(hereinafter referred to as the “Inspection Report”);
And whereas, the Government, after consideringthe Inspection Report, has decided to issue aShow Cause Notice to the Notary;
And whereas, Show Cause Notice bearingNo. 8-40-2012-LD(Estt)(4)/735 dated 10-05-2013has been issued to the Notary calling upon histo show cause as to why action as deemed fitshould not be initiated against him for his failureto comply with the provisions contained in theNotaries Act, 1952 (Act 53 of 1952) and the NotariesRules, 1956, within a period of fifteen days from thedate of receipt of the Show Cause Notice (hereinaf-ter referred to as the “said Show Cause Notice”);
And whereas, in response to the said ShowCause Notice, the Notary filed his reply dated05-06-2013 (hereinafter referred to as the “saidReply”);
And whereas, the Government after consideringthe said Reply of the Notary and parawise commentsof the Competent Authority on the said Reply ofthe Notary has decided to suspend the Notary frompractice for a period of 6 months;
Now, therefore, in pursuance of rule 13(12)(b)(ii)of the Notaries Rules, 1956, the Government ofGoa hereby suspends the Notary from practice for aperiod of 6 months with immediate effect.

appointed Shri Yves Emanuel Carmo Jose Martinho

a period of three years with effect from 25-10-1993
in Bardez area (hereinafter called as the “Notary”);
And Whereas, on 15-03-2013 at 10.45 a.m., theCompetent Authority carried out a surpriseinspection of the office of the Notary;

And Whereas, in response to the said Show CauseNotice, the Notary filed his reply dated28-05-2013 (hereinafter referred to as the “saidReply”);
And Whereas, the Government after consideringthe said Reply of the Notary and parawise commentsof the Competent Authority on the said Reply ofthe Notary has decided to let off the Notary with awarning, according to the nature and gravity of themisconduct of the notary proved;
Now, therefore, in pursuance of rule 13(12)(b)(iii)of the Notaries Rules, 1956, the Government of Goahereby let off the Notary with a warning, accordingto the nature and gravity of the misconduct of thenotary proved.

This shall dispose of Show Cause Notice dated09-04-2012 issued to the legal heirs of lateShri Vaikunth M. Kadnekar on three grounds namelythat:
1) The application for condonation of delayfor applying for renewal was made beyondpermissible time limit.
2) There was discrepancy in the name of theConcessioner as it appeared in the Goa,Daman & Diu Mining Concessions (Abolition& Declaration as Mining Leases) Act, 1987 andnamely in the surname of the Concessionerand application of the Condonation of delay.
3) There was discrepancy in details of produc-tion for the year 2010-11.
Reply to Show Cause Notice was received in thisoffice on 02-05-2012 & 04-05-2012. Notice for PersonalHearing was given to the Legal Representatives of
late Shri Vaikunth M. Kadnekar for giving their sayalongwith Book of Accounts, audited statementsfor last 3 years and Income Tax Returns and returnsfrom Commercial Tax Department and they wereheard on 31-08-2012.
In replies dated 2nd May and 4th May, 2012, theLegal Representatives of late Concessionercontended that their late father was granted twoconcessions and in both the concessions name oflate father was shown as “Voicunta Canencar”. Thenames during Portuguese Regime were spelt//written in Portuguese style. Like instead of Kamatit was written as Camotin. As such, Kadnekarwas spelt as Canencar. In the passport of Shri AjitKadnekar, the name is mentioned as “Ajit VaikunthKadnekar” alias “Ajit Kumar Canencar” and fathersname as “Voicunta Canencar”. As such, theycontended that T.C. No. 12/53 stands in the name of“Voicunta Canencar” instead of Voicunta Kadnekar.
It is further mentioned that as surnameKadnekar has been accepted by this Departmentin all correspondence and the same is confirmed byan Order dated 30-03-2000 passed by the Controllerof Mining Leases of India. He further contended thatreference of Canencar in First Schedule of AbolitionAct is merely an inadvertent typographical mistakeand since there was no dispute or issue withGovernment, there was no occasion in past forthe Legal Representative’s of Voicunta Kadnekarfor correction. It is also pointed out that allnecessary permission/approvals etc. were obtainedin favour of legal representatives of the Concessioner.
With regards to Condonation of delay, the LegalRepresentatives submitted that their Applicationdated 30-10-2000 requesting Condonation of delay,is in respect of T.C. No. 12/53. It is contended thatafter demise of Shri Vaicunth M. Kadnekar, one ofhis sons, Shri Shivanand Kadnekar was solely lookingafter the affairs of the estate of the said late VaicunthKadnekar and that Shri Shivanand Kadnekar hasfiled Form J and paid challan on 19-11-1987, atMargao Branch. The other relevant documentsincluding Form ‘J’ were not submitted because ofill health of Shri Shivanand Kadnekar who expiredon 31-12-1996. Shri Ajit Kadnekar has also allegedthat they had challenged the validity and viresof the Abolition Act in Hon’ble High Court andagainst Order of same Special Leave Petition ispending in Supreme Court.
It is alleged that non-submission of the Form ‘J’ forrenewal came to knowledge of Legal Representativesof late Concessioner only in the month of October,2000 because of which, fresh Form J dated30-10-2000 with Affidavit dated 16-10-2000, challan

dated 19-11-1987, Form ‘J’ dated 19-11-1987 copyof Affidavit dated 20-11-1987 were submitted. It isalleged that as nothing was heard from theDepartment, a representation dated 12-09-2006 wasmade for renewal of lease by condoning the delay.
It is mentioned that, Government decisions weremade on 30-10-2006 because of which a letter dated31-10-2006 was issued to Shri Ajit Kadnekar. It isalleged that Condonation was done on basis ofprecedent in the case of Shri Antonio David D’Souza.It is alleged that since a decision in condoningdelay was a reasoned decision with properapplication of mind there is no need for openingup this issue afresh.
Since all the documents were allegedly keptready by late brother Shri Shivanand Kadnekar atrelevant time, it is contended that they had clearintention to submit the same to the Department. Itis further contended that the Second RenewalApplication is applied in time and pending forrenewal.
Shri Ajit Kadnekar further contended that basedupon renewal necessary permissions/consentswere obtained and substantial foreign exchangeis earned by nation and since mining operationare carried out for more than 4 years and jobopportunities are created, the Government maynot dwell on this issue afresh.
With regards over production it is alleged thatT.C. No. 12/53 has EC limit is 5,00,000 MT per annum.
It is alleged that Production limit of +50% Fe IronOre (ROM) as per approved Modified Mining Planfor the year 2010-11 is 2,78,853 MT.
It is alleged that the production of 50% Iron Ore(ROM) from the Mining Pit was 84, 442 MT whichwas well within the limit of IBM approved MiningPlan.
It is alleged that the Mine had started operationduring 2007-08 and upto 2009-10, it has generatedRejection (Below 50%Fe) of 11,63,503 MT, whichwas in accordance with the approved miningplan limit. A portion of this rejection was dumpedon the northern side of the Pit No. 1.
It is alleged that the Director General of MinesSafety vide their letter under No. D(G) 40-550/GI-08--10/2013 dated 13-09-2001 had directed LegalRepresentatives of erstwhile Concessioners toshift the said dump which was exiting on thenorthern side of the Pit No. 1 to a distance of morethan 100 mtrs. from the edge of the Pit No. 1.
It is alleged that, while shifting the dump, theLegal Representatives of erstwhile Concessioners
have recovered 247554 MT of low grade iron ores (lessthan 50% Fe) from that said dump. Even includingthis dump in production, the total Iron Ore genera-tion from the said TC No. for the year 2010-11 was331996 MT which was well within EC limit of500000 MT.
It is also alleged the details are available in therecord of the office and are also evident from theAnnual Returns submitted by the Legal Represen-tatives of erstwhile Concessioners to this Departmentas well as IBM and other documents viz. approvedmining plan, EC etc.
It is alleged that there is no discrepancy in theproduction details furnished to the Department inrespect of T.C. No. 12/53 and that the above explana-tion fully suffices in clarifying the same.
As such, it was contended that the Show CauseNotice may be withdrawn/revoked and PersonalHearing may be granted. Accordingly, personalhearing was granted to Legal Representatives ofConcessioners on 31-8-2012 with liberty to filewritten submissions on 04-09-2012.
It is submitted in written submissions that theAbolition Act was brought in to force on 01-10-1963.The Act is not published in Official Gazette so far.As such interested persons were/are not aware andprovisions of Section 4 of the Act, towards correctionof any error, omissions or misdescription in relationto any particulars of mining concessions, or nameand residence of any concession holders specifiedin the first and second schedule for provisions oferror etc., because of which Legal Representatives oflate Concessioners could not take recourse beingaware of provisions of the Act. Apart from sayingthe matter is subjudice invoking the provision ofsub-section (3) of Sec. (4) of the Act, 1987 wouldnot be on sound footing and as such requestedto close the proceedings initiated vide the ShowCause Notice.
Some of the documents given by the LegalRepresentatives of late Shri Ajit M. Kadnekar areplaced in file alongwith their letter. Agent of the minehas also placed details of production and sale for last3 years which is also part of the record of the file.
As regards issue of Condonation of delay isconcerned, the Application for condonation of delaywas filed by one Shri Ajit M. Kadnekar vide letterdated 30-10-2000.
It is pertinent to note that The Goa Daman & DiuMining Concessions (Abolition & Declaration asMining Leases) Act, 1987 has abolished all theConcessions given by erstwhile Portuguese Regimeand the Concessions were declared to be deemed

leases and the Act mandated that the Applicationfor renewal should be filed within 6 months fromthe date of accent to the Act from President ofIndia which ended on 22-11-1987. The CentralGovernment under Proviso to Rule 24 (A) 8 of theMineral Concession Rules, 1960 empowered StateGovernment to allow extension of time to fileapplication for renewal of mining lease for amaximum period of 1 year which ends on 22-11-1988.
As such there was no power given to theState Government to condone the delay in fillingthe renewal of mining lease. As a result, miningConcession bearing T.C. No. 12/53 stood abolishedw.e.f. 22-11-1987.
Since there was no power vested in StateGovernment for condoning the delay, as such theAct of Condonation of delay by the then Minister ofMines purportedly acting on behalf of Governmentof Goa on 25-04-2006 is therefore without Authorityof Law, as such the Act of Condonation of delay isillegal void ab initio in terms of Section 19 of MMDRAct, 1957. Section 19 of MMDR Act, 1957, declaresmining leases contravening the MMDR Act to bevoid and of no effect as such, all subsequentactivities undertaken by the Legal Representativesof late Shri Vaikunth Kadnekar become illegal voidab initio including mining operations carried outwithin T.C. No. 12/53 based upon illegal condona-tion of delay in filing received Application formining lease and grant thereof based upon suchillegal condonation.
As regards, discrepancy in surname i.e. Kadnekar& Canencar is concerned, on one hand Shri AjitKadnekar states in letter dated 4-9-2012 that sinceAbolition Act of 1987 was not published in OfficialGazette, interested person were not aware ofSection 4 which provided for correction of error//omission or misdiscription and because of the samethe Legal Representatives of late Shri Ajit M.Kadnekar could not get the mistake in surnamecorrected. However, on the other hand the statementmade by the legal representatives of late Shri AjitKadnekar in letter dated 02-05-2012 more particu-larly with regards to issue No. 2. It is mentioned bythem that, that validity of Abolition Act, 1987 waschallenged in Writ Petition by them. i.e. LegalRepresentatives of late Shri Vaikunth Kadnekar. Assuch it cannot be said that the legal representativesof late Shri V. M. Kadnekar were not aware ofSection 4 of the Abolition Act, 1987.
As regards over production though the E.C. Limitfor T.C. No. 12/53, 0.5 million tons per annum as perletter dated 27-06-2007 from Ministry of Environment& Forests. The Mining Plan shows saleable ore to
the tune of 158922 and 250958 m tons for the year2009-2010 and 2010-11 respectively. Whereas, as perletter dated 14-09-2011 from the legal representativesof late Shri V. M. Kadnekar to Deputy Controller ofMines the production for the years 2009-10 and2010-11 is shown to be 167252 m tons and ROM 84442+ dump 247553 m tons totaling to 331995 m tonsrespectively. As such, at least as per the detailsand other documents submitted, there is an excessproduction to the tune of 9252 M tons for the year2009-10 and 33,995.6 M tons for the year 2010-11. Theissue of violation of Mining Plan, no doubt fallswithin purview of Indian Bureau of Mines office butsince the production was taken based upon illegalCondonation of delay in filing Renewal Applicationtotal ore extracted becomes illegal.
As such even if the production is increased overand above the limits prescribed in mining planthough within the EC Limit the same is undertakenwithout any modification in the mining plan aboveall based upon illegal Condonation of delay in filingrenewal Application. Though the legal representa-tives of Shri V. M. Kadnekar have producedproduction and sale figure, they had failed toproduce other books of Accounts and Income TaxReturns and Commercial Tax Returns filed withrespective Authorities.
In view of all the above, the lease bearing T.C.No. 12/53 is hereby declared to have been abolishedw.e.f. 22-11-1987 by operation of Law. Since the actsof Legal Representatives of Late Vaikunth Kadnekarand that of the then Minister for Mines are againstMMDR Act, 1957 the same are void ab initio in termsof provision of Section 19 of the MMDR Act, 1957.
The Acts of commission and omission of the LegalRepresentatives of late Shri Vaikunth Kadnekar andthat of the officers/officials of Mines Department andthe then Minister for Mines are therefore deemedto be also in violation of sub-section 1 & 1 (A) ofSection 4 of MMDR Act, 1957, in addition to Section19 of the MMDR Act, 1957.
Therefore, the State Government hereby confis-cates all the ore/mineral from T.C. No. 12/53 andalso from T.C. No. 75/52 granted to late Shri VaikunthKadnekar. The details of loss of revenue caused toState shall be assessed and recovered from the LegalRepresentatives of late Vaikunth Kadnekar and theamount so recovered from the Legal Representativesof late Vaikunth Kadnekar and all the personresponsible for such acts and the amount recoveredfrom sale proceeds of confiscated material shallbe adjusted against the dues to the Governmentfrom Legal Representatives of late Shri VikunthKadnekar and other persons involved in such

illegalities. The details about production etc. shallbe prepared by Mines Department within 6 monthsfor recovery of losses and put up the same to theGovernment.

Whereas, by Government Notification No. 23/
/2/2012-RD dated 10-07-2012 published on
Series II No. 16 of the Official Gazette, dated
19-07-2012 and in two local newspapers namely
“Gomantak Times” dated 13-07-2012 and
“Sunaparant” dated 13-07-2012, it was notified
under Section 4 of the Land Acquisition Act, 1894
(Central Act 1 of 1894) (hereinafter referred to as
“the said Act”), that the land specified in the
Schedule appended to the said Notification
(hereinafter referred to as the said land), was
needed for public purpose, viz. Land Acquisition
for improvement of the existing road and widening
of the bottle neck from NH4-A to Gaundalim ferry
ramp via fun School in Corlim Village of Tiswadi
Taluka (addl. area).
And whereas, the Government of Goa
(hereinafter referred to as “the Government”) after
considering the report made under sub-section (2)
of Section 5-A the said Act is satisfied that the
land specified in the Schedule hereto is needed
for the public purpose specified above (hereinafter
referred to as “the said land”).
Now, therefore, the Government hereby
declares under the provisions of Section 6 of the
said Act that the said land is required for the
public purpose specified above.
The Government also hereby appoints under
clause (c) of Section 3 of the said Act, the Deputy
Collector (Revenue), Collectorate North, Panaji
to perform the functions of the Collector for all
proceedings hereinafter to be taken in respect of
the said land and directs him under Section 7 of
the said Act to take order for the acquisition of
the said land.
A plan of the said land can be inspected at the
office of the Deputy Collector (Revenue),
Collectorate North, Panaji till the award is made
under Section 11.

No. 23/23/2013-RD
Whereas it appears to the Government of Goa
(hereinafter referred to as “the Government”) that
the land specified in the Schedule hereto
(hereinafter referred to as the “said land”) is likely
to be needed for public purpose, viz. Land
Acquisition for the construction of Pilgao-Narve
distributory of Sakhali Branch Canal of LBMC of
TIP from ch. 4.850 kms. to ch. 12.330 kms. in Pilgao
& Narve villages of Bicholim Taluka (Phase-II).
Now, therefore, the Government hereby notifies
under sub-section (1) of Section 4 of the Land
Acquisition Act, 1894 (Central Act 1 of 1894)

(hereinafter referred to as “the said Act”) that said
land is likely to be needed for the purpose specified
above.
2. All persons interested in the said land are
hereby warned not to obstruct or interfere with
any surveyor or other persons employed upon the
said land for the purpose of the said acquisition.
Any contract for the disposal of the said land by
sale, lease, mortgage, assignment, exchange or
otherwise or any outlay commenced or
improvements made thereon without the sanction
of the Collector appointed under paragraph 4
below, after the date of the publication of this
notification, will under clause (seventh) of Section
24 of the said Act be disregarded by him while
assessing compensation for such parts of the said
land as may be finally acquired.
3. If the Government is satisfied that the said
land is needed for the aforesaid purpose, a
declaration to that effect under Section 6 of the
said Act will be published in the Official Gazette
and in two daily newspapers and public notice
thereof shall be given in due course. If the
acquisition is abandoned wholly or in part, the fact
will also be notified in the same manner.
4. The Government further appoints under
clause (c) of Section 3 of the said Act the
Special Land Acquisition Officer (North), GTIDC,
Karaswada, Bardez-Goa to perform the functions
of a Collector, under the said Act in respect of the
said land.
5. The Government also authorizes under
sub-section (2) of Section 4 of the said Act, the
following Officers to do the acts, specified therein
in respect of the said land.
1. The Collector, North Goa District, Panaji-Goa.
2. The Special L. A. Officer (N), GTIDC,Karaswada, Bardez-Goa.
3. The Executive Engineer, W.D. VI GTIDC,Sarvan, Bicholim-Goa.
4. The Director of Settlement and Land Records,Panaji-Goa.
6. A rough plan of the said land is available for
inspection in the Office of the Special Land
Acquisition Officer (North), GTIDC, Karaswada,
Bardez-Goa for a period of 30 days from the
date of publication of this Notification in the
Official Gazette.

Ministry of Social Justice & Empowerment,Government of India, Shashtri Bhavan, New Delhidirected the State Government to conduct theservey of Manual Scavangers in Statutory Townsin the State of Goa, in order to eliminate ManualScavengers and to carry out rehabilitation ofManual Scavengers in alternative dignifiedoccupation.
In view of the above the Government herebydeclared 14 statutory towns mentioned below asa self declaration centre for the purpose of ManuelScavenger.
