Issue composite pennits ~for the inter-State route or routes or areas as the case may be covered by this Reciprocal Agreement for three or more of the, signatory States, such a composite permit holder shall have' the benefit of Rule framed- under section 68(2)(hh), read with section 63(1) of the Motor Vehicles Act, 1939ij_:re", ferred to in para below; and the competent authority shall ,furnish copies of these composite ,permits (Part- B only) to other signatory States within 30 dayso~ issue,

(B) Further all the signatory States shall frame ,a -suitable TUle under section 68(2)(hh) read with section 63(1) to pJ;Ovid~that . the co~poSite pennit .so granted' shall be V'alid without countersignature_ in the 'areas of the, ,other signatory States and the. Secretary .of the State Transport Authority or -tb.e .compet~t authority as' the case may _be of, the Home State _shall .issue an authorisation in', form prescribed in,; the schedule (Annexure I).'

, - X. In the" case of the transfer of' the, composite peJ:'fujts "the authorisation granted under this _ Agreement shall' not" be "transferable except with the approval' of' the Secretary" of the State Transport Authority or the competent 'authority -of the -Home State, as the case may be.

Abstract .of C!onditions .ot ,composite permits

1. This authorises the operation of the vehicle-

(0 on any route or area in the Home State subject "to local restrictions; and

(ii) all the specified routes and areas in the other. sig­natory states chosen for operation as mentIoned in the Schedule annexed hereto.

The vehicle shall also be valid on such other National H~gh­ways and State Highways as may be notified from time to time by the Union Government or the State Governments concerned.

The vehicle shall also be authorised to deviate upto 30 km!;. on either side of the specified routes.

2. The vehicle while 'operating shall he free to operate with­out restriction of routes in the Home State and while ope­rating in any area outside the Home State goo~ sh~n' not be picked up or set down between <tny t.wo points '- m the reciprocating States, i. e., in such cases vehicles, shall be prohibited from carrying intra-State business.

3. (i) Each appJicant for a composite permit shall have to choose a minimum of ~ States, i. e., the Home State and' any two other States out of the remaining seven for ope­ration with effect from the date of this Agreement.

(ii) An option once exercised by a composite permit holde~ will not be allowed to be changed before a perJ.Od of one year.

(iii) If a comp~ite permit holder chooses to exclude a contiguous State for operation through which his vehicle must have to pass to reach any other State chosen for ope­ration within the Scheme, the holder of the permit shall ht.ve to pay full taxes to the "transit State" unless otherwise exempted.

4. The vehicle shall be painted in a deep maroon colour with zebra markings of alternate black and yellow lines _ on the front bumper and the tail board and a board' shpwip.g the following Inscription in yellow letters on black background' shall be carried prominently above the "Public Os.rrier" board: -

-The vehicle shall be. fitted with a seat across 'the fUlE. width of the Vehicle behind the driver's seat providing facili­ties for a spare driv~r to stretch himself and sleep.

5. (a), The vehicle covered by this authorisation shall not be used for the composite permit scheme and also b~teral'­agreement scheme 1n the same State at the same time.

(b) The vehicle covered by this authorisation shall not· be more than four years old on the date of grant of this autho'­risation and -more than nine years old at any time .

6. The vehicle' shall at all times ~arry the biB/bills of .lading­in the manner directed by the STA, Home State covering the­goods in the vehicle.

7. Quarterly return shall be submitted to the Secretary,. state Transport Authority of the Home State.

8.' The vehicle shall conform to and comply With all the­ptovisions of the Motor Vehicles Act,' 1939, as weU as tilE' provisions of the Motor Vehicles Rules framed by the Home· State.

9. The vehicle. shall at all times carry a valid certificate or fitness, certificate of registration and in$urance, the original penuit documents and the authorisation issued under this. Agreement. '

10. The composite perniit holder shall be, liable to pa.~ ~ annual tax of Rs. 1000/w per vehicle.in respect of the States of of Andhra Pradesh, Kerala, Maharashtra, Karnataka, Tamil Nadu and Gujarat as the 'case 'may-be (excluding the Home State) and R's. 150/- per vehicle per annum in respect ofPon­dicherry and Rs. 150/': per ,vehicle per' annum" in respect'-Of Goa in addition to the Motor Vehicles 'lax and the Goods Tax, if any, of the Home State. Such taxes shall be paid: in advance on or before the 15th March every year. irrespec­tiVe> of -the RL Wand PL W of a vehic:le. The competent Trans. port Authority of the 'Home State on collection Qf taxes shall stamp and endorse the authorisation to that effect.

The composite permit holder may, at his option, pay . the· above taxes in· two instalirtents, the first on or before 15th March (every year) for tlie period April-September and the second instalment on or before 15th Sept~mber (of the current financial year) for the period October-March.

11. A 'composite permit. holder shall be required to pay a fee of Rs. 300/- per year per vehicle for grant of an authow risation irrespective of the number of States ch?Sen for ope­ration. This sum shall be. paid in advance in full irrespective' of whether the authorisation is granted 'at the commencement of a financial year, or after the ,commencement thereof, by Bank,_ Draft to the competent authority of the Home_ State-who will 'retain the -amount; - . '

12. If the vehicle covered by the authorisation is kept under­non-use for a perio~ of six. Il}-ont}1s at a ~tretch and 15 months in all, its pennit shall be liable to pe cancelled. The Home· State where the pennit was issued will be the deciding authow rity in such cases.

13. If an operator does not pay his composite tax Within-, the prescribed period, he shan be liable to pay, in addition to the composite tax of Rs. 1000/- 3J1.d additional swn of Rs. 25/-· per month or part thereof for each of the States of Andhra Pradesh, Kerala, Maharashtl'a, Karnataka, Tamil Nadu and Gujarat in respect of which the payment is delayed and Rs. 2/- per month in respect of Pondicherry and Goa. The said amount shall be payab!e _ through crossed Bank Drafts in the name of the' designated authority of the State concerned and the Bank Draft shall l)e given to the cop.cerned authority of the Home State.

14. ~he ~_e~iproc~ -4.greement, under which the composite· permit is issued~ will be.subject to ·review and may be amendw ed by mutual agz:eement, at any stage, between the signatory­States and the operator shall be bound l~y sur.h amendments.

15.' If a composite permit holder fails to apply for renewal of authOrisation for minimum number of states_ required .to' be, '~~~en, f?t _ oJ?e~a#oI!- ,Under the, ~greement within a period ·of"one'month from the date of expiry -of previous a;uthorisa-. tion, his pennit shall be liable to be cancelled.'
