As per G.O.Ms. No.95 Annexure, IDA Pashamylaram is one of the Industrial

Development Area (Page No: 5, Under Medak District) in which Permanent Ban on

EstablishmenU Expansion of certain polluting industries.

Sanozen Pharma Private Limited is an existing unit located in IDA Pashamylaram

(lDA GO enclosed as Annexure-2) and obtained consent to manufacture Bulk Drug

lntermediate.

Subsequently, the Environment, Forest, Science and Technology (Env) Department,

Govt. of Andhra Pradesh, has issued Amendment stating that "Provided that theexpansion of production of all types of existing Bulk Drug and Bulk DrugIntermediate manufacturing units are permitted, subject to the instatlation ofZero Liquid Discharge (ZLD) facilities by such units" vide G.O.Ms.No.64 dated

25-07-2013 (Copy Enclosed as Annexure- 3)

Sanozen Pharma Private Limited is having valid consent (CFO Copy Enclosed as

Annexure-4) to manufacture Bulk Drug Intermediate. To meet the requirement as per

above mentioned G.O, we will install Zero Liquid Discharge system for our proposed

expansion.

Hence, as per G.O.Ms.No.64 dated 25-07-2013, we (Sanozen Pharma Private

Limited) may be permitted to go for expansion of existing unit subject to installation

of Zero Liquid Discharge System.

In view above information, kindly consider our project for the Grant of Terms of

Reference as early as possible.

In the reference In read above, the Andhra Pradesh Pollution Control B oard has issued a !'Joti~catio~ imposing Ban on the establishment/expansion of certain categories of polluung mdustnes m all the Industrial Estates/Industrial Development Areas and other industrial areas as mentioned in the annexure to the notification and 1 km around these industrial areas of Medak, Rangareddy, Mahaboobnagar and Nalgonda districts. 2) In the reference 2"d read above, orders were issued by the Government making permanent the Ban imposed by the Andhra Pradesh Pollution Control Board in their Notification dated: 14-10-1996 on the establishment/expansion of certain categories of polluting industries in all the Industrial Estates/Industrial Development Areas and other industrial areas io the Districts ofMedak, Rangareddy, Mahaboobnagar and Nalgonda.

3) The Andhra Pradesh Pollution Control Board vide Resolution No.l668 of ll31h Board Meeting held on 27-12-2006 had constituted a Sub-Committee to deftne the industries falling under "Highly Water Polluting Industries" category of the ban notification to have clarity. The sub-committee submitted a report. The Andhra Pradesh Pollution Control Board in its I 15th Board meeting held on 21-03-2007 vide resolution No.1682 had agreed to the recommendations of the sub-committee to include only WI and W2 categories of water polluting industries, as defined by Central Pollution Control Boatd (CPCB) in the criteria issued in 2004 for preparation-of Zoning Atlas for siting of industries, in the ban area. The Member Secretary, Andhra Pradesh Pollution Control Board, has been authorized to communicate the same to Environment, Forests, Science & Technology Department for issuing necessary amendments to the ban notification vide G.O.Ms. No.62, dated: 28-04-1999. Accordingly, the Member Secretary, Andhra Pradesh Pollution Control Board vide reference 4th read above has communicated the report of the sub-committee and the resolution of the Board to the Government.

4) The Government, after careful examination of the matter, have decided to issue a fresh notification by superseding the notifications issued in the matter. Accordingly, the following notification shall be published in the next extra-ordinary issue of the Andhra Pradesh Gazette:

In exercise of the powers conferred under section 19 of the Water (Prevention and Control of Pollution) Act, 1974 (Central Act No.6 of 1974) and section 19 of the Air (Prevention and Control of Pollution) Act, 1981 (Central Act No. 14 of 198 I), and in supersession of the notification issued by the Andhra Pradesh Pollution Control Board, Hyderabad, dated 14-l0-1996 and the notification issued by the Government in G.O.Ms.No.62, Environment, Forests, Science & Technology Department, dated: 28-4-1999, the Government of Andhra Pradesh., on the recommendations of the Andhra Pradesh Pollution Control Board, Hyderabad, hereby impose restrictions on establishment/expansion of the following categories of industries in all the Industrial Estatesl!ndustrial Development Areas and other industrial areas as mentioned in the annexure appended to this notification and I K.M. ar~und these industrial areas i.n the Districts of Medak, Rangareddy, Mahaboobnagar and Nalgonda, subject to out come of W.P. \9661/02, pending before the Hon'ble High Court:

Corporation Limited, as Local Authority as provided under section 147 of the Andhra Pradesh Panchayat Raj Act, 1994 {Act No. 13 of 1994) and publication of a Gazette Notification for transferring the powers and functions as provided under section 147 of the said Act. to the Andhra Pradesh Industrial Infrastructure Corporation for maintenance of Industrial Estates/Industrial Development Areas/Autonagars, etc. developed by the Corporation falling under the purview of the Local Authority (PR) that helps the speedy development of Industries in Andhra Pradesh.

2. Keeping in view of the above provision and the proposal rec..ei ved from the Chairman and Managing Director, Andhra Pradesh Industrial Infrastructure Corporation Limited, all the District Collectors were requested in the reference 3rd read above to furnish their replies and suggestions by 25.11.1997 which was subsequently extended upto 20.1.1998 by giving time bound notices to the Gram Panchayats to file their objections and suggestions. They were also informed that if nothing is heard by such date, it will be construced that there is no objection to transfer the functions of local authority in these areas to the Andhra Pradesh Industrial Infrastructure Corporation Limited.

3. Some Gram Panchayats have objected the proposals on the ground that there would be financial loss to the Gram Panchayats etc.

4. The Government after careful consideraLion of the matter reject all the objections as the object of this proposal is to ensure prompt and better maintenance of the industrial areas. The. Governme·nt have also decided to share the revenue in the ratio of 35:65 between the concerned Gram~ Panchayats and the Andhra Pradesh Industrial Infrastructure Corporation Limited.

Ban - Permanent Ban on Establishment of certain Polluting Industries in Medak, Ranga Reddy, Mahaboobnagar and Nalgonda Districts- Amendment Notification- Orders-Issued.

In the G.O. 1" read above, Ban was imposed on the establishment/expansion of certain categories of polluting industries in all the Industrial Estates/Industrial Development Areas and other industrial areas as mentioned in the Annexure to the notification and lkm around these industrial areas of Medak, Rangareddy, Mahaboobnagar and Nalgonda districts.

(2) · In the representation 2"' read above, the Bulk Drug Manufacturer's Association (BDMA), Hyderabad requested the APPCB to allow the expansion of existing Bulk Drug and its Intermediate Manufacturing Units with Zero Liquid Discharge Facilities and Industries who could send less contaminated non-process water such as domestic, cooling tower and boiler blow down to Common Effluent Treatment Plants (CETPs) and to consider pollution load at Point of Discharge instead of Point of Generation before installation of pollution control systems as provided in Water (Prevention and Control of Pollution) Act, 1974 and Air (Prevention and Control of Pollution) Act, 1981. They enumerated ~he improvements in the technology adopted by them such as Zero Liquid Discharge (ZLD) I Zero Process Liquid Discharge (ZPLD) process comprising of latest equipment such as Stripper, Multiple Effect Evaporator, Agitated Thin Film Drier (ATFD) and Reverse Osmosis (RO) etc, to control water pollution through considerable reduction in High Total Dissolved Solids (HTDS) discharges and also to bring down emission of gaseous substances mainly Volatile Organic Compounds (VOC) to control Air Pollution.

3) The Principal Secretary to Government, Industries and Commerce (CIP) Department offered his views on the present state of pollution control measures implemented by Bulk Drug and Bulk Drug Intermediates industrial units. Keeping the fact that Hyderabad attained the status as International Capital of Pharmaceutical industry, a level playing field is a dire necessity to maintain its leadership position without compromising on pollution control. As there is overall improvement in water pollution control measures adopted by the industry, a suggestion has been made to permit the increase in production capacity to enable them to compete in the international market and to assess the pollution load at the point of discharge.

4) In the order 3'' read above, the Hon'ble A. P. Pollution Control Appellate Authority observed that there is much improvement in the environmental conditions after industries implemented better pollution treatment techniques and Ministry of Environment and Forests (MoEF) has lifted moratorium in establishment of industries in the earlier notified industries. Imposing ban or restrictions on the industries through Administrative Orders is not justifiable and such ban and restrictions are against the Statutory provisions under (Section 2, Rule 5) of Environment (Protection) Act, 1986. The Hon'ble Appellate Authority disposed the appeals filed by the Bulk Drug and Intermediate industries with the direction that the State Government shall take a decision on the representation made by the Bulk Drug Manufacturers Association in the light of the orders passed by MoEF and the Statutory position as explained above within three months from today.

5) In the resolution 4" read above, the Andhra Pradesh Pollution Control Board in its Resolution No.l949 of 130" Board meeting resolved to recommend to the Government, the recommendations of the High Level Expert Committee (HLEC) constituted to study the request of Bulk Drug Manufacturer's Association (BDMA) to amend the G. 0. Ms. No. 95, dated 21-09-2007. The Committee in their report stated that the requisite treatment facilities are in place and Ministry of Environment and Forests (MoEF), Government of India has withdrawn the moratorium in Patancheru -Bollaram area after implementation of Joint Action Plan. The High Level Expert Committee recommended to the Andhra Pradesh Pollution Control Board that the expansion of capacities could be considered subject to the availability of water resources, Ambient Air Quality including Volatile Organic Compounds (VOC), Capacity of Treatment, Storage and Disposal Facility (TSDF) & Common Effluent Treatment Plants (CETP's) and their performance and scope for using organic waste in cement plants for co-processing.

6) In the letter 5'" read above, the Andhra Pradesh Pollution Control Board communicated the Agenda with minutes of the 130t11 Board meeting of Andhra Pradesh Pollution Control Board and the report of the High Level Expert Committee with their recommendations from the technical point of view. The Andhra Pradesh Pollution Control Board recommended the expansion of existing industries on a case to case basis in relaxation of ban order issued vide G. 0. 1" read above, based on legal advice. The recommendations of the Andhra Pradesh Pollution Control Board is based on four parameters namely (i) Availability of Water resources, (ii) Ambient air quality including Volatile Organic Compound (VOC) (iii) Capacity of Treatment, Storage and Disposal Facility (TSDF) & Common Effluent Treatment Plant (CETP) and their performance and (iv) Scope for using organic waste in cement plants for co-processing. The Andhra Pradesh Pollution Control Board recommended comprehensive Zero Liquid Discharge (ZLD) for large industries with effluent generation above 25 KLD and partial ZLD I common ZLD for small industries with effluent generation below 25 KLD of total effluent. The Andhra Pradesh Pollution Control Board recommendation includes the transportation of low TDS effluent generated by the industries to the Common Effluent Treatment Plants (CETPs), meeting the inlet standards stipulated by the Andhra Pradesh Pollution Control Board.

7) In the letter 6'" read above, Commerce Secretary, Government of India stated that the share in exports of Drugs and Pharmaceutical Industry from A. P. State is about 35% of the total exports from the Country. He recommended for expansion of existing units subject to compliance of pollution control norms in order to give further boost to the exports from this sector.

8) The Learned Additional Advocate General, High Court of Andhra Pradesh in his letter dated 28-03-2013 has opined that the Government may

consider to amend the condition of restriction imposed on expansion of existing industries in G. 0. Ms. No.95, dated 21-09-2007, so far as expansion of production of the existing units.

9) The Government after careful examination of the matter, have decided to issue an amendment to the G. 0. Ms. No.95, Environment, Forests, Science & Technology (ENV) Department, dated: 21-09-2007 to enable the expansion of production of the existing Bulk Drug and Bulk Drug Intermediates manufacturing units only subject to the installation of Zero Liquid Discharge (ZLD) facilities by such units and to assess the Pollution load at the Point of Discharge, as provided in Water (Prevention and Control of Pollution) Act, 1974 and Air (Prevention and Control of Pollution) Act, 1981.

10. Accordingly, the following notification will be published in the Extra­ordinary Issue of the Andhra Pradesh Gazette dated 25-07-2013:

NOTIFICATION

In exercise of the powers conferred by section 19 of the Water (Prevention and Control of Pollution) Act, 1974 (Central Act No.6 of 1974) and section 19 of the Air (Prevention and Control of Pollution) Act, 1981 (Central Act No.14 of 1981) the Government of Andhra Pradesh on the recommendations of the A. P. Pollution Control Board, Hyderabad hereby makes the following amendment to the notification issued in G. 0. Ms. No.95, Environment, Forests, Science & Technology (ENV) Department, dated: 21-09-2007.

AMENDMENT

In the said notification, after the existing Note, the following shall be added namely:-

"Provided that the expansion of production of all types of existing Bulk Drug and Bulk Drug Intermediate manufacturing units are permitted1

subject to the installation of Zero Liquid Discharge (ZLD) facilities by such units and subject to the outcome of cases pending in the National Green Tribunal, Southern Zone, Chennai or in any other court. The Pollution load of industrial unit shall be assessed at the Point of Discharge, as provided in Water (Prevention and Control of. Pollution) Act, 1974 and Air (Prevention and Control of Pollution) Act, 1981."

SCHEDULE -A

The applicant shall make applications through online for renewal of consent (under Water and Air Acts) and authorisation under HWM Rules atleast 4 months before the date of expiry of this consent order, along with prescribed fee under Water and Air Acts for obtaining Consent & HW authorisation of the Board along with detailed compliance report against the conditions stipulated in the CFO & HWA order issued.

The industry shall immediately submit the revised application for consent to this Board in the event of any change in the raw material used, processes employed, quantity of trade effluents & quantity of emissions etc.

a) All the fugitive emissions shall be controlled with proper measures.

b) The applicant shall also install the equipment such as wind speed recorder and wind direction recorder.

A good house keeping shall be maintained both within the factory and in the premises. All hoods, pipes, valves, sewers and drains shall be leak proof. Floor washings shall be admitted into the effluent collection system only and shall not be allowed to find their way into storm drains or open areas.

The applicant shall submit Environment statement in Form V before 30th September every year as per Rule No.14 of E (P) Rules, 1986 & its amendments thereof.

The applicant shall comply with the directives/orders issued by the Board in this consent order and at all subsequent times without any negligence on his part. The applicant shall be liable for such legal action against him as per provisions of the Law/Act in case if non-compliance of any order/directive issued at any time and/or violation of the terms and conditions of this consent order.

The applicant shall furnish to the visiting officer and I or the Board any information regarding the construction, installation or operation of the effluent treatment system/ air pollution control equipment and such other particulars as may be pertinent for preventing and controlling pollution.

The industry is liable to pay compensation for any environmental damage caused by it, as fixed by the Collector and District Magistrate as Civil liability.

The industry shall provide a minimum stack height (H) to the DG sets as per the following formula.

H = h + 0.2 ~ KVA

KVA =Total generation capacity, h = Height of building where DG Set is installed.

10. All the rules & regulations notified by Ministry of Environment, Forests & Climate Change (MoEF&CC), Government of India in respect of management, handling, transportation and storage of hazardous chemicals and wastes shall be followed.

11. The industry shall carryout monthly environmental monitoring by a National Accreditation Board for Laboratories (NABL) and Ministry of Environment, Forests & Climate Change (MoEF&CC) approved laboratories only and shall submit monthly reports to the concerned Regional office by marking a copy to the Zonal Office.

12. The industry shall comply with emission limits for DG sets of capacity upto 800 KW as per the notification G.S.R.520 (E), dated 01.07.2003 under the Environment (protection) Amendment Rules, 2903 and G.S.R.448 (E), dated 12.07.2004 under the Environment (protection) secqnd Amendment Rules, 2004. In case of DG sets of capacity more than 800 KW' shall comply with emission limits as per the notification G.S.R.489 (E), dated 09.07.2002 at serial No.96, under the Environment (Protection) Act, 1986.

13. All the rules & regulations notified by Ministry of Law and Justice, Government of India regarding Public Liability Insurance Act, 1991 shall be followed.

14. The applicant shall at his own cost get the effluent samples collected both before and after treatment I samples of emissions collected and analysed from the TSPCB or any other Laboratories which are established as per the guidelines and norms of MoEF & CC, GOI and CPCB, New Delhi, every month for the parameters indicated in the Condition No.1 and condition No. 4 of Schedule B and shall submit in duplicate the report thereof to the Board.

15. The applicant shall provide appropriate Rain Water Harvesting systems on the available upstream portion of the plant site.

16. All Solid wastes arising in the premises shall be properly classified and disposed off to the satisfaction of the Board by:

i) Controlled incineration, wherever possible in case of combustible organic material. ii) Vermiculture I composting, in case of biodegradable material.

iii) Secure land fill in case of non-biodegradable, chemically active/ hazardous solid waste. Care shall be taken to ensure that the material does not give lechate, which may percolate into ground water or carried away with storm run-off.

17. At any time during the inspection of Pollution Control Board Officers or any other licencing I servicing authorities I if it is observed that the industry is not complying with any of the above conditions leading to pollution problems, this consent is liable for cancellation without further notice and all the services rendered by the servicing departments shall be withdrawn without further notice.

18. All the rules & regulations notified by Ministry of Environment, Forests & Climate Change (MoEF&CC), Government of India in respect of microorganism, geoetically engineered organisms or cells shall be followed.

19. The applicant shall exhibit the consent order of the board in the factory premises at a prominent place for the information of the inspecting officers of the different departments.

20. Not withstanding anything contained in this conditional letter or consent, the Board hereby reserves to it the right and power under Section 27(2) of the Water (Prevention & Control of Pollution) Act, 197 4 and its amendments thereof and under section 21 of Air (prevention & Control of Pollution) Act, 191 and its amendments thereof to review any and I or all the conditions imposed herein above and to make such variations as deemed fit for the purpose of the Act by the Board.

21. The applicant shall put up two black boards of size 6ft by 4ft at the main entrance to their plant. One board shall contain the specific CFE and CFO conditions, in sufficiently large font size so that it can be read easily from a distance of 10 ft to a normal eye, and other board shall carry, again in sufficiently large font size so as to be able to read from a distance of 10 ft, the latest Water, Air, Noise and solid waste monitoring data as well as the maximum vulnerable zone.

22. The industry may explore the possibility of tapping the solar energy for their energy requirements.

23. The following rules and regulations notified by the MoEF&CC, GOI shall be implemented.

a) Hazardous and other wastes (Management and Transboundary Movement) Rules, 2016.

b) Manufacture, Storage and import of Hazardous Chemicals Rules, 1989. c) Batteries (Management & Handling) Rules, 2001.

d) E-Waste (Management & Handling) Rules, 2016. e) Plastic Waste (Management & Handling) Rules, 2016.

24. Any person aggrieved by an order made by the State Board under Section 25, Section 26, Section 27 of Water Act, 1974 or Section 21 of Air Act, 1981 may within thirty days from the date on which the order is communicated to him, prefer an appeal as per Andhra Pradesh Water Rules, 1976 and Air Rules, 1982, to such authority (hereinafter referred to as the appellate Authority) constituted under Section 28 of the Water (Prevention and control of Pollution) Act, 197 4 and section 31 of Air (Prevention and control of pollution) Act, 1981.

25. The Board reserves its right to modify above conditions or stipulate any additional conditions including revocation of this order in the interest of environment protection.

26. Concealing the factual data or submission of false information I fabricated data and failure to comply with any of the conditions mentioned in this order may result in withdrawal of this order and attract action under the provisions of relevant pollution control Acts.

27. As per the provisions of the Section 19 of the (TS-iPASS) Act, 2014 (Act No.3 of 2014), the applicant shall be penalized with fine as prescribed by the government from time to time as well as rectification of the defect if he I she or the organization as the case may be fails to comply with the conditions or undertaking in self certification given to the Nodal Agency.

2) A sampling port with removable dummy of not less than 15cm diameter shall be provided to the stack at a distance of 8 times the diameter of the stack from the nearest constraint such as bends etc. A platform with suitable ladder shall be provided below 1 meter of sampling port to accommodate three persons with instruments. A 15 AMP 250 V plug point shall be provided on the platform.

5) The industry shall not manufacture new products I excess capacity beyond the permitted capacity mentioned in this order without obtaining CFE /CFO of the Board.

6) The industry shall provide above ground level RCC tanks for collection I storage of trade effluents and arrest ground water pollution due to leaks/crack of pipes, tanks and spillages etc.

7) The industry shall not cause any spillages I discharges of chemicals/ effluents on ground. The drums containing chemicals & wastes shall be stored on elevated platform provided with leachate/spillages collection pit. In no case the drums shall be stored on naked ground.

8) The industry shall take membership with Common ETP immediately as committed by the industry letter dated 26.09.2017 and lift the pre treated effluents to M/s PETL, Patancheru, Sangareddy District for further treatment and safe disposal.

9) The industry shall store the coal & coal ash in closed rooms only. The industry shall not store the coal & coal ash openly.

1 0) The industry shall regularly operate Air Pollution Control Equipment i.e., cyclone separator installed to the coal fired boiler of capacity 2.0 TPH.

11) The industry shall obtain membership from M/s TSDF, Dundigal and lift the hazardous waste generated from the process to M/s TSDF regularly.

12) The industry shall dispose the boiler ash to brick manufacturing industries.

13) The industry shall not cause any air pollution I dust nuisance in the surrounding environment and shall provide suitable control equipments to control process emissions.

14) The industry shall not discharge any waste water outside the plant premises under any circumstances.

15) The industry shall pay the balance water cess dues, if any.

16) The industry shall develop greenbelt such that it shall not be less than 33% of total area, preferably along the all sides of industry site, with width of not less than 5 mtrs greenbelt.

17) The industry shall install digital flow meters with totalizer to measure the actual water consumption, waste water generated, treated & disposed and maintain a log register as per the meter readings.

18) The industry shall provide separate energy meter to the air pollution control system and maintain a log register to record the readings.

19) The industry shall take all precautionary and safety measures during process operations.

20) The industry shall maintain good house keeping within the plant premises.

21) The industry shall comply with all the directions issued by the Board from time to time.

SCHEDULE- C

{See rule 6(2)] [CONDITIONS OF AUTHORISATION FOR OCCUPIER OR OPERATOR

HANDLING HAZARDOUS WASTES]

1. The industry shall comply with the provisions of the Environment (Protection) Act, 1986, and the rules made there under.

2. The authorization or its renewal shall be produced for inspection at the request of an officer authorized by the State Pollution Control Board.

3. The industry shall not rent, lend, sell transfer or otherwise transport the hazardous and other wastes expect what is permitted through this authorization.

4. Any un-authorized change in personnel, equipment or working conditions as mentioned in the application by the person authorized shall constitute a breach of his authorization.

5. The industry shall implement Emergency Response Procedure (ERP) for which this authorization is being granted considering all site specific possible scenarios such as spillages, leakages, fire etc. and their possible impacts and also carry out mock drill in this regard at regular interval of time;

6. The industry shall comply with the provisions outlined in the Central Pollution Control Board guidelines on "Implementing Liabilities for Environmental Damages due to Handling and Disposal of Hazardous Waste and Penalty".

7. It is the duty of the authorized person to take prior permission of the State Pollution Control Board to close down the facility.

8. The hazardous and other waste which gets generated during recycling or reuse or recovery or pre-processing or utilization of imported hazardous or other wastes shall be treated and disposed of as per specific conditions of authorization.

9. An application for the renewal of an authorization shall be made as laid down under these rules.

10. Any other conditions for compliance as per the Guidelines issued by the Ministry of Environment, Forest and Climate Change Government of India or Central Pollution Control Board, New Delhi from time to time.

11. Annual return shall be filed by June 301" for the period ensuring 31 '1 March gf the

year.

12. The industry shall give top priority for waste minimization and cleaner production practices.

13. The industry shall not store hazardous waste for more than 90 days.

14. The industry shall store used I used oils and Used Lead Acid Batteries in a secured way in their premises till its disposal.

15. The industry shall not dispose used oils to the traders and the same shall be disposed to the Board's authorized Re-processors I Recyclers.

16. The industry shall not dispose spent solvent I mixed spent solvents to the traders.

17. The industry shall take necessary practical steps for prevention of oil spillages and carry over of oil from the premises.

18. As per Rule 17 of Hazardous and other wastes (Management and Transboundary Movement) Rules, 2016.

i) The industry shall ensure that the hazardous and other wastes are packaged in a manner suitable for safe handling, storage and transport as per the guidelines issued by the Central Pollution Control Board from time to time. The labelling shall be done as per Form 8 of the Hazardous and other wastes (Management and Transboundary Movement) Rules, 2016.

ii) The label shall be of non-washable material, weather proof and easily visible.

19. As per Rule 18 of Hazardous and other wastes (Management and Transboundary Movement) Rules, 2016. i) The transport of the hazardous and other waste shall be in accordance with

the provisions of these rules and the rules made by the Central Government

under the Motor Vehicles Act, 1988 and the guidelines issued by the Central Pollution Control Board from time to time in this regard.

ii) The occupier/industry shall provide the transporter with the relevant information in Form 9, regarding the hazardous nature of the wastes and measures to be taken in case of an emergency and shall label the hazardous and other wastes containers as per Form 8.

iii) In case of transportation of hazardous and other waste for final disposal to a facility existing in a State other than the Telangana State where the waste is generated, your industry shall obtain 'No Objection Certificate' from the State Pollution Control Board of both the States.

iv) In case of transportation of hazardous and other waste for recycling or utilisation including co-processing, your industry shall intimate both the State Pollution Control Boards before handing over the waste to the transporter.

v) In case of transit of hazardous and other waste for recycling, utilisation including co-processing or disposal through a State other than the States of Telangana and destination, the sender shall give prior intimation to the concerned State Pollution Control Board of the States of transit before handing over the wastes to the transporter.

vi) In case of transportation of hazardous and other waste, the responsibility of safe transport shall be either of this industry or the receiver whosoever arranges the transport and has the necessary authorisation for transport from the concerned State Pollution Control Board. This responsibility shall be clearly indicated in the manifest, by the sender industry or receiving industry.

vii) The authorisation for transport shall be obtained either by the sender or the receiver on whose behalf the transport is being arranged.

20. As per Rule 19 of Hazardous and other wastes (Management and Transboundary Movement) Rules, 2016.

i. The sender industry of the waste shall prepare seven copies of the manifest in Form -10, comprising of colour code indicated below and all seven copies shall be singed by the sender industry. ·

ii. The sender shall forward copy 1 (white) to the State Pollution Control Board, Head Office with a copy to concerned regional office and in case the hazardous or other wastes is likely to be transported through any transit State, the sender shall intimate State Pollution Control Boards of transit States about the movement of the waste.

iii. No transporter shall accept waste from the sender for transport unless it is accompanied by signed copies 3 to 7 of the manifest.

iv. The transporter shall submit copies 3 to 7 of the manifest duly signed with date to the receiver along with the waste consignment.

v. The receiver industry, after acceptance of the waste shall hand over copy 4 (orange) to the transporter and send copy 5 (green) to his State Pollution Control Board and send copy 6 (blue) to the sender and the copy 3 (pink) shall be retained by the receiver industry.

vi. The copy 7 (grey) shall only be sent to the State Pollution Control Board of the sender, if the sender is in another State.

21. The industry shall maintain good house keeping & maintain proper records for hazardous and other wastes stated in authorization.

22. The industry shall maintain proper records, for hazardous waste stated in Authorisation in FORM-3 i.e., quantity of incinerable waste, land disposal waste, recyclable waste etc., and file annual returns to TSPCB in Form-4 as per Rule 6(5) of the Hazardous and other Waste (Management, Handling & Transboundary Movement) Rules, 2016 and amendment thereof. ··

23. The industry shall conform to the co-processing guidelines of CPCB in sending wastes to co-processing for cement plants.

The industry shall submit the condition wise compliance report of the conditions stipulated in Schedule A, B & C of this Order on half yearly basis to Board office, Hyderabad, Zonal Office RC Puram and concerned Regional office.
