Our programme this year is the biggest yet and reflects the diverse and thriving arbitration community in the Middle East, Africa and South Asia (MEASA) region.
The week has been put together by some of the leading global arbitral bodies, organisations and practices that have operations or do business in the region, and includes over 40 conferences, symposia, working lunches/dinners, and networking opportunities. 1.The ability of the DIFC Courts to grant freezing orders in support of foreign(i.e. non DIFC) arbitrations. This remains an open question under DIFC law and may be influenced by the recent UKPC decision in Broad Idea International Ltdv Convoy Collateral Ltd (British Virgin Island) [2021] UKPC 24.
2.The ability of the DIFC Courts to grant anti-suit injunctions in respect of proceedings in other UAE courts brought in breach of an arbitration agreement (there seems to be a divided approach among current DIFC judges).

Panel 1: Is there a right to a physical hearing in international arbitration?Panel 2: Practical steps to ensure due process during virtual hearings.
The COVID19- pandemic has prompted a significant increase in digitalisation in international arbitration, particularly the reliance on virtual hearings. With no clear end in sight of pandemic-related measures, virtual hearings continue to offer a practical alternative to physical hearings. However, virtual hearings have been at the centre of heated debates and challenges over potential violations of due process. Separately, many arbitration practitioners advocate in favour of virtual hearings as an efficient and cost-effective solution regardless of travel and sanitary restrictions.
The purpose of this event is to address:- Whether arbitration regimes and procedural rules recognise a right to a physical hearing,- The ability of arbitral tribunals to order remote hearings, including against the wish of one or both parties,- Are virtual hearings here to stay, and- Practical tips to ensure due process during virtual hearings.

• The background to shariah law and its different schools;
• The relevance of shariah in different jurisdictions, particularly Kingdom of Saudi Arabia versus jurisdictions with a written Civil Code, recognising that KSA will have a Civil Code shortly;
• The impact of shariah law on common issues of dispute – for example, the right to a specific cause of action, application of good faith obligation, force majeure/hardship, impact of time bar notice provisions, abuse of rights, estoppel, enforceability of interest provisions, other issues of public policy such as gharar, etc.
State entities in arbitration As states increasingly become involved in contracts with arbitration clauses, this session looks to identify the requirements that state entities have when they are parties in proceedings. What do states really need when included in an arbitration? Can standard arbitration keep up with the unique demands that come with a dispute that involves a government or state entity? What hurdles can you expect when doing business and engaging in arbitral proceedings?
Topics the panel are expected to discuss include: • What is a state entity anyway? What qualifies as a state entity in the MENA region?• Administrative contracts – what are they, what are their implications on contracts and the rights of counterparties, how are administrative contracts treated / what legislation exists under the different jurisdictions in the Middle East?
