Arbitration is constantly growing in the UAE and the MENA region. Despite its increased popularity and the adoption of the UAE Federal Arbitration Law, there remain areas for improvements. This event will address the current challenges of arbitration in the UAE and the changing dispute resolution landscape (including Federal Law No. 2021/6 on mediation of civil and commercial disputes and Decree No. 34 of 2021 concerning the DIAC). The panellists will also discuss recent key arbitration related decisions from both the onshore local courts and the DIFC Courts and share thoughts about the future of arbitration in the UAE.

Seminar: Family businesses, family offices and high-net worth individuals have specific needs when disputes arise: a ‘one-size fits all’ approach to private client dispute resolution does not work. This seminar will focus on family businesses, family offices and high-net worth individuals and will address why disputes arise and how to plan for when they do. It will also consider how the arbitral process can be tailored for families and private clients, what to do in cross-border disputes, and disputes where trusts, foundations and assets like real estate and art are involved.

Blockchain technology presents challenges and opportunities for the practice of international arbitration. Smart contracts, based on blockchain technology, have the potential to reduce the scope for disputes arising out of a contract, and in some cases to obviate the possibility of a dispute. How can blockchain be used to enhance current arbitration processes? Can blockchain be used instead of arbitration by crowdsourcing justice? Will these new methods start to encroach on the traditional territory of the courts and arbitral tribunals? How might emerging technologies like quantum computing and artificial intelligence accelerate this process? How do we maintain cybersecurity and the integrity of the arbitration process in the post-Covid virtual age?

ICC YAF Panel (hosted by Freshfields) – Behind the Screens: Virtual Hearings and Due Process Paranoia

Panel 1: Is there a right to a physical hearing in international arbitration?Panel 2: Practical steps to ensure due process during virtual hearings.

The COVID19- pandemic has prompted a significant increase in digitalisation in international arbitration, particularly the reliance on virtual hearings. With no clear end in sight of pandemic-related measures, virtual hearings continue to offer a practical alternative to physical hearings. However, virtual hearings have been at the centre of heated debates and challenges over potential violations of due process. Separately, many arbitration practitioners advocate in favour of virtual hearings as an efficient and cost-effective solution regardless of travel and sanitary restrictions.

The purpose of this event is to address:- Whether arbitration regimes and procedural rules recognise a right to a physical hearing,- The ability of arbitral tribunals to order remote hearings, including against the wish of one or both parties,- Are virtual hearings here to stay, and- Practical tips to ensure due process during virtual hearings.

WEDNESDAY,17th NOVEMBER 2021

12:40 pm – 1:40 pm The panel are expected to discuss:

• The background to shariah law and its different schools;

• The relevance of shariah in different jurisdictions, particularly Kingdom of Saudi Arabia versus jurisdictions with a written Civil Code, recognising that KSA will have a Civil Code shortly;

• The impact of shariah law on common issues of dispute – for example, the right to a specific cause of action, application of good faith obligation, force majeure/hardship, impact of time bar notice provisions, abuse of rights, estoppel, enforceability of interest provisions, other issues of public policy such as gharar, etc.

State entities in arbitration As states increasingly become involved in contracts with arbitration clauses, this session looks to identify the requirements that state entities have when they are parties in proceedings. What do states really need when included in an arbitration? Can standard arbitration keep up with the unique demands that come with a dispute that involves a government or state entity? What hurdles can you expect when doing business and engaging in arbitral proceedings?

Topics the panel are expected to discuss include: • What is a state entity anyway? What qualifies as a state entity in the MENA region?• Administrative contracts – what are they, what are their implications on contracts and the rights of counterparties, how are administrative contracts treated / what legislation exists under the different jurisdictions in the Middle East?

•Administrative decrees – what are they and how should tribunals deal with administrative decrees rendered in the context of contracts or otherwise? Are there any issues of jurisdiction, admissibility, etc?

The enduring Covid19- claim and post-crisis arbitration The pandemic has wreaked havoc on supply chains and ongoing contracts – particularly in the construction sector. As economies open up after more than a year of Covid19- restrictions, we may see different types of business issues arise. What do we see for the arbitration landscape moving forward given the pandemic?

The panel are expected to cover: •Covid19- claims in construction disputes – are they succeeding and if not / so, why? •Valuing the impact of Covid19- on a contractual bargain – tip and traps •Given everyone has been impacted by Covid19- in some way, can tribunals really be neutral considering Covid19- related claims? •What types of disputes (and hence arbitration) do we see on the horizon as result of economies opening up?
