Accordingly,your complaint dated 30.8.2019 againstM/s. Bharti Airtel Ltd and M/s. VodafoneIndia Ltd. receivedand forwarded tothe concernedserviceproviderfor taking appropriate action. Theaction takenreport asuploadedon TeCMSPortal by the serviceprovider is enclosed.
It is for information that TRAIhas mandated all TelecomServiceProviders toestablish a two tier complaint/grievance redressal mechanism for handlingconsumercomplaints. In termsofthis mechanism, a consumercanlodgeservicerelated complaints at the complaint centre of their TelecomServiceProviders(TSPs).In casecomplaint is not redressed satisfactorily by the serviceproviderat the complaint centre, an appeal can be registeredwith AppellateAuthority ofthe TSPs.If the consumeris stil l not satisfied with the resolution, he is free totake legal recourse. Details of Appellate Authority of the service provider areuploaded and updated on TRAI web site as and when intimated by ServiceProviders.A subscriber may also obtain details of appellate authority of hisservice provider on its website.

There is no specific rule/guideline in the Telecommunication MobileNumberPortability Regulations, 2009 dated23.09.2009 as amendedfrom time to time,relating to specificrechargesfor MobileNumberPortability. TheRegulationsareaccessibleon the TRAIwebsitewww.trai.gov.inunder the head"Regulations"in"Release/ Publication".

service providers and TATA SKY DTH service provider.
,3. Whether the TATA SKY DTH service provider had authoiitv to
provide a new OTH connection (HO) and (SO) annual subscription
package plans to the customers in the month of February 2019.
~. What was the 'time limit to the OTH service provider companies to
inform its customers regarding revised (HO) and (SO) annual
subscription package plans in the year 2019.

However, in:regardto toll free numbers, the National Numbering Plan 2003 and various ~ircularavailable on DoT website at http://dot.gov.in/access-services/national-numbering-plan-2003 and http://dot.gov.in/access-services/guidelines-for-access-services-licences, may be referred. Department of Telecommunicationshas defined 1800 series as National Toll Free Number Series/Free phone
services and are of 8 to 13-digit numbers (1800+YYY+IN number). The 1860series are called Universal Access Services and calls on these numbers arechargeable.
3&7 Information sought by you vide these points is not available in TRAI.
4to 6 TRAI·Act 1997 does not envisage handling of individual consumer complaintsby TRAI. However, complaints received in TRAI are forwarded to concerned
service providers for appropriate action.
TRAI has laid down the framework for complaint redressal by service providersthrough the Telecom Consumers Complaint Redressal Regulations, 2012 whichare available on TRAI website www.trai.gov.in. It is for information that TRAIhas mandated all Telecom Service Providers to establish a two-tiercomplaint/grievance redressal mechanism for handling consumer complaints.In terms of this mechanism, a consumer can lodge service-related complaintsat the complaint center of thE!rr-9\elecomService Providers (TSPs)through thetoll-free consumer care number or through post or e-rnail or in person. In case
complaint is not redressed satisfactorily by the service provider at thecomplaint center, an appeal can be registered with Appellate Authority of theTSPs. Details of Appellate Authority of the service provider are uploaded andupdated on TRAI website as and when intimated by Service Providers. Asubscriber may also obtain details of Appellate Authority of his Service Provideron its website. If the consumer is still not satisfied with the resolution, he isfree to take legal recourse.

Dear Sir,
My name is Vij ay Singh. I am using an Airtel Number-7499935912 since 2012. I am using the SIMfor almost 8 years. I have upgraded the SIM in 4G for almost one and a half years ago. But from20th January 2020 morning, it is showing no service. My Aadhar card is linked with thisnumber.
Ihad bought the sim in 2012 from a roadside stall (the shops which are generally installed for two-three days during the B.Tech admission process at lI T -BHU, Varanasi) in Varanasi. I had giventhe ID card of my brother as I was minor at that time(not had my own ID for SIM purchase). Butthe vendor had used the ID of some other person whom I didn't know. I was not aware of this asSIM was working fine till 20th January 2020. I came to know about this when I visited Airtel Store.They refused to swap the SlM card as the SIM is registered with a different name.
I contacted airtel social media team regarding this and they escalated the issue to process myrequest under Details Mismatch Issue. I have completed All the verific ation process required forthis and verifi ed successfully that this Number belongs to me. To my surprise, I got to know thatthe Number is MNP(Mobile Number Portability), so the request cannot be processed. But I hadbought a brand new SIM from the stall (under the banner of Airtel). My friend also bought an AirtelSIM from the stall on the same day with same starting number 74999xxxxx. So I once againcontacted the Air tel social media team they assured me that they are reviewing your issue and afterone month, on 29th February 2020, they replied that they are unable to resolve the issue.
1 have recharged the Number with an unlimited validity of 1 year on 2nd December 2019.
Based on this please provide following details
1. Is there any rule regarding issuance of SIM with same number to the person after successfulverification?
2. How many cases of this type Airtel has dealt with and out of them how many have beengiven SIM card with same number after successful verifi cation? If there is at least one casethen why my case is not considered after successful verification?
3. Non MNP number are allotted to same person under detail mismatch then why MNP-;nlmber are not 'considered under the same?
4. What is the reason of not availability of Network when the number is activated?

I am an old subscriber ofAirtel prepaid number 7726977078 sincelast 6 years, however my circles changes frequently due tome being adefence personnel. My alternate number is 9472197789 BSNL.During my previous posting at Bihar the network was poor but Icontinued Airtel service as this number was being used for most ofmy official purposes. On 28 Aug 19, the network was distributed.Considering that recharge is exhausted, I recharged it for Rs. 448 for::,months Unlimited pack. However the services were not resumed, so1recharged it again for Rs. 448 on 01 Sep 19 considering thatprevious recharge attempt isfailed. However, it reflected later thatboth recharges were successful and valid upto Feb 20. Thereafter Igot transferred to Shillong where 1 found that the network is Nil . Itried for porting out to BSNL but learnt that my recharged amount Rs.896 will lapse. Since Sep 19 tit! date, I am requesting through variousmedia/authority tor refund of amount wasted clue to poor Services andwent unutilised. but in replies I am getting 1~11seassurances, apologiesand nothing else. I raised complaint on 1211198 at least 20 times. Itwas denied to register complaint for refunds, however complaint forpoor Network was registered (C4GSP31229329640) which wasdisposed off without any improvement. 1 approached Airtel Twitterhandle vide my account dineshmalik1975 but even after more than200 messages, no refunds were provided. However I was offered talktime upto Rs. 400 which I refused as it was of no use. r approachednodal officers and appealete authority but no resolution provided til ldate. nodalofficer.jktdnn.aitel.corn and [email protected] failed to resolve the issue. 1 TRAI Act, 1997 does not envisage handling of individual consumer complaints by TRA!. The
service providers have to redress the complaint of the consumer as per the framework for
redressal of complaints by service providers laid down by TRAI through the Telecom
Consumers Complaint Redressal Regulation, 2012 dated 05.01.2012. Consumers may file a
complaint with the Complaint Centre of the service provider through the toll free
Consumer Care Number. In case, the complaint is either not resolved by the Complaint
Centre of the service provider or the consumer is not satisfied with the redressal of his
complaint, he may file an appeal with the appellate authority of the concerned service
provider for redressal of his complaint. These regulations are available on TRAI
website www.tral.gov.in.
Further, TRAI has no power to impose the penalty directly on the service providers.
However, TRAI can file a complaint with the first class Judicial Magistrate for imposition of
penalty under section 29 of the TRAI Act, 1997.

is furnished:

1 to As per the existing tariff framework, the tariff for mobile services is under forbearance except
3 national roaming. Telecom service providers are free to decide the rates for calls and condition
such as validity period on the basis of input cost, competition and other commercial
considerations.
4 TRAI Direction dated 1st September,2008, inter-alia, mandates no access provider shall provide
&6 for any condition such as the requirement of obtaining new SIM or change of telephone number,
etc., by any telecom consumer who seek to migrate across plans or across postpaid and prepaid
tariff, Provided that, the direction contained in this sub-paragraph shall be applicable in relation
to migration from prepaid platform to postpaid platform subject to operational feasibility.
5 All Telecom Service Providers (TSPs) are governed by the License Agreement entered into with
Department of Telecommunications (DoT). Matters relating to KYC relate to subscriber's
verifications. Instructions regarding subscriber's verification are issued by DoT and
implemented by the Field Units of DoT. Therefore, a copy of your application has already been
transferred to DoT online on 21.04.2020 in terms of Section 6(3) (1) under the provisions of the
Right to Information Act, 2005 for providing the information on relevant issues.
7 The Telecommunication Tariff (43rd Amendment) Order 2006 dated 01.09.2008 issued by TRAI,
inter-alia, provides that tariff plan once offered by an Access Provider shall be available to a
subscriber for a minimum period of Six Months from the date of enrolment of the subscriber to
that tariff plan. No tariff item in a tariff plan shall be increased by the access provider during the
said six month period. This amendment is available on TRAI Website.www.trai.gov.in. Telecom
service provider can change; withdraw any plan in any service area as per commercial suitability.
8 to The eligibility criteria for making parting requests; and requests for parting of mobile number
11 are stipulated in the Telecommunications Mobile Number Portability Regulations, 2009, as

all Telecom Service Providers to establish a two tier complaint/grievance redressal mechanism for
handling consumer complaints. In terms of this mechanism, a consumer can lodge service related
complaints at the complaint center of their Telecom Service Providers (TSPs). In case complaint is
not redressed satisfactorily by the service provider at the complaint center, an appeal can be
registered with Appellate Authority of the TSPs. If the consumer is still not satisfied with the
resolution, he is free to take legal recourse.

Please refer to your application dated 19.03.2020 filed online in the RTI portal of TRAI vide
registration No. TRAOI/R/E/20/00214 for providing information under the provisions of the Right to
Information Act, 2005 regarding minimum recharge related matter. In this context, the following is
furnished:

1 As per the existing regulatory framework, tariff including rates and related conditions is
under forbearance except for national roaming, rural fixed line services and leased circuits.
As per the no (43rd Amendment) 2006 subclause 5
(v)"" However, any tariff plan presented, marketed or offered as valid for any
prescribed period exceeding six months or as having lifetime or unlimited validity in lieu of
an upfront payment shall continue to be available to the subscriber for the duration of the
period as prescribed in the plan and in the case of lifetime or unlimited validity plans, as
along as the Service Provider is permitted to provide such telecom service under the current
license or renewed license. In the case of plans with lifetime validity or unlimited validity,
the service provider shall also inform the subscribers of the month and year of expiry of his
current license."
Some telecom service providers have introduced tariff plans wherein the terms. and
conditions include the condition of recharge with a certain amount at stipulated period to
continue to avail uninterrupted services and benefits of the tariff plans. Failure to comply
with the prescribed mandatory recharge will result in stoppage of service in a phased
manner.
