Antitrustregulationsaredefinedbyfederallaw.Pleasenotethatviolationofantitrustregulationscanbepunishablebyseverefinesandevenjailtime.ViolationofantitrustontheDivision42ListservputsAPAandallofourcolleaguesinjeopardy.

TheantitrustpolicyofAPAexplicitlystates(SectionA.2):“Generallyapplicablefeessetandannouncedbyinsurersorotherthirdpartypayorsmaybediscussed-- aslongasthediscussionisnotaccompaniedbyanycommentarystatingor implying:(a) thatotherpsychologistsshouldnotaccepttherateorshouldnotdealwiththe payor...or(b)whattherateshouldbe.

Postingaboutpsychologist fees,reimbursementratesfrominsurancecompaniesandbeginningadiscussionregardingboycottingparticular insurancecompaniesisclearlyinviolationofantitrustregulations.

"ThebanoncommercialuseofthelistsisbasedinlegalrequirementsthatflowfromAPA'sstatusasa501(c)(3)organization.APAanditsdivisionsenjoyexemptionunder501(c)(3)oftheInternalRevenueCode,whichisthemostfavorabletaxstatusavailabletoanyUnitedStatesorganization;itisthesametaxexemptionheldbyuniversities,churches,andcharitablefoundations.Becauseofthisstatus,amongotherthings,APAanditsdivisionspaynofederalincometaxonrevenuesfromcarryingoutexemptactivities;voluntarycontributionsaretaxdeductiblebydonorsascharitablecontributions;andtheyareexemptfromsomekindsoflocaltaxes.WiththeseadvantagescomesignificantrestrictionsonhowAPAcanconductitsbusiness,includingsuchrestrictionsastakingnoroleinpoliticalelections,restrictinglobbyingandusingresourcesfortax-exemptpurposes.

WhathappenswhenaDivisionmemberbreaksthelistservrules?Wehavemadeitquitedifficultforpeopletoget“removed”fromthelistservandthishashappenedveryinfrequently.Sometimes,ifasituationonlistisperceivedbymembersorthemoderatorstobethreateningourcollegialcommunity,membersmaybesentaprivateemailwitha“friendlyrequest”totaketheconversationoffthelisttoprivateemail.

Ifsomeonecontinuallybreakstherules,themoderatormayrequestthatthelistservreviewteampleasereviewthemember’sconductandcomeupwitharemedialplan.Thememberwillbenotifiedbythelistmoderatorthatthemember’sbehaviorisbeingreviewedbythelistservreviewteam.

ThecurrentmembersofthisteamareDr.LuisMoralesKnight,Dr.AimeeYermish,andDr.KeelyKolmes.Newteammembersmaybeaddedorrotatedbyappointmentofthecurrentlistservmoderator(s)orthestandingPresidentoftheDivision.Themoderatorwillnotbeonthisreviewteamsoastoreducebias.Ifacurrentmemberofthereviewteamhasaconflictofinterestwithreviewingthismember’sactions,theywillnotifythemoderatorthattheyshouldsitoutofthereviewprocess.

Thereviewteammayrecommendanyofthefollowingactions:

2ndoffense:Aprivateformalwarningwillbesenttothememberandherorshewillbeinformedthatiftheinfractionisrepeated,therewillbemoreseriousactiontakenandarecordwillbekeptofthiswarning;

3rdoffense:Ifsimilarbehaviororotherdisruptivebehaviorisenactedwithin60days,themembermaygetasecondformalwarningandarecordwillbekeptofthis.Thememberwillbetoldthatthisisasecondformalwarningandfurtherdisruptivebehaviorcouldleadtosuspensionfromthelist;

4thoffense:Atthispoint,theindividualwillbesentanoticethatduetomultipleinfractions,thememberwillbesuspendedfromthelistforaperiodofsixmonths;

Returningmembers:Ifamemberreturnsfromthelistandcontinuestoenactthesamenegativebehavior,themembermaybeinformedthattheyneedtoavoidrepeatingtheinfractionsthatgotthemremovedfromthelistinitiallyforalimitedtimeperiodspecifiedbytheReviewTeam.Behaviorconsistentwithlistservrulesforthistimeperiodwill“resettheclock”forthatmember.Failuretocomplywithlistrulesduringtheirwelcomebackperiodmayresultintheirbeingremovedfromthelistservforaoneyearperiod.

Permanentremoval:Incasesinwhichthesamememberhasgonethroughthisprocessmorethanonce,themembermaybenotifiedwhentheyarewelcomedbacktothelistthatiftheycontinuetocreateproblemsforourlistservcommunity,theyriskpermanentremovalfromourlistserv.

Elasticclause:Incertainegregiouscases,theModeratorsmayfeeltheneedtomoveupthisdisciplinaryladdermorequickly,inordertomaintainappropriate

collegialrelationshipsandlegalprotectionsonthelist.Ifthreemoderatorsconcurbyemail,theprocessmaybeescalatedtoahigherdisciplinelevelmorequickly.

TheEnforcementCommittee,willdiscussthecase(3commentingmembersconstitutingaquorum),typicallybyemail.Discussionswilltakeplaceovernolongerthanoneweek,andshouldbeexpeditedifpossible,particularlyiftheruleviolationiscreatinglegalorinterpersonalproblemsonthelistserv.

TheEnforcementCommitteewilldelegateamembertocommunicatethedecisiontotheModerator,whowillinturncommunicateittothepersonwhohasviolatedtherules.TheModeratorwillthenenactandmonitorthesanction.
