TheantitrustpolicyofAPAexplicitlystates(SectionA.2):“Generallyapplicablefeessetandannouncedbyinsurersorotherthirdpartypayorsmaybediscussed-- aslongasthediscussionisnotaccompaniedbyanycommentarystatingor implying:(a) thatotherpsychologistsshouldnotaccepttherateorshouldnotdealwiththe payor...or(b)whattherateshouldbe.

"ThebanoncommercialuseofthelistsisbasedinlegalrequirementsthatflowfromAPA'sstatusasa501(c)(3)organization.APAanditsdivisionsenjoyexemptionunder501(c)(3)oftheInternalRevenueCode,whichisthemostfavorabletaxstatusavailabletoanyUnitedStatesorganization;itisthesametaxexemptionheldbyuniversities,churches,andcharitablefoundations.Becauseofthisstatus,amongotherthings,APAanditsdivisionspaynofederalincometaxonrevenuesfromcarryingoutexemptactivities;voluntarycontributionsaretaxdeductiblebydonorsascharitablecontributions;andtheyareexemptfromsomekindsoflocaltaxes.WiththeseadvantagescomesignificantrestrictionsonhowAPAcanconductitsbusiness,includingsuchrestrictionsastakingnoroleinpoliticalelections,restrictinglobbyingandusingresourcesfortax-exemptpurposes.

TheEnforcementCommitteewilldelegateamembertocommunicatethedecisiontotheModerator,whowillinturncommunicateittothepersonwhohasviolatedtherules.TheModeratorwillthenenactandmonitorthesanction.
