This year the theme of Vigilance Awareness Week is also on the same lines i.e. “Integrity – A way of life”. As stressed by CVC, it can be achieved by inspiring the young generation to lead a life that combines righteousness and honesty and honesty can be made the way of one's life. India will be totally corruption free if 'Integrity' becomes a way of life. Integrity is not only absence of corruption, but in fact it is more than that i.e. 'High Moral Value'. Sometime we indulge in offering bribe for some services which are otherwise free. Though we know that it not morally correct, yet this is done mainly for convenience. We ignore the fact that giving the bribe is as bad as taking the bribe and we become party to the process of corruption. Now, technology is coming to our rescue and level of corruption has drastically reduced in many areas which were earlier infamous for it. By making use of all these techniques, DMRC is making all out efforts in this direction right from its inception. I hope one day this thought will spread all over the world. The theme of this year’s Vigilance Awareness Week is ‘Integrity – A way of life’. Indeed, there could not have been a more apt theme for this week, during which we reaffirm our commitment towards integrity, honesty and transparency in our sphere of work. The theme this year conveys to us that integrity should be inculcated as a way of life so that it permeates into all aspects of our existence. Over the years, DMRC has established itself as an organisation of eminence. It has set very high standards of adherence to the values such as honesty, transparency and integrity. Now, the organisation expanding to close to 14,000 people working in different parts of the NCR as well as other cities in India and neighboring countries, the need for organisational checks and balancing is all the more important. Let us resolve that we shall continue to uphold and champion these values wherever we work. Today, many cities across the country as well as abroad are approaching us to steer their Metro projects. The primary reason for this demand is our reputation as an efficient organisation, which operates in a transparent manner. Let us make integrity a core value of our day to day schedule. CASE STUDY – 3

Sub : Failure of Catenary wire/ Messenger wire during testing at 3rd party Lab.

A preventive check was carried out in one of the Delhi MRTS Phase –III works pertains to erection of over Head Equipments (OHE). During the inspection, materials were sealed and sent for 3rd party testing at independent lab to know the soundness of materials.

The sample of Cu-Cd Catenary wire/ Messenger wire (65 sq.mm.) failed in Breaking Load, tensile strength and chemical compositions parameters in 3rd party testing. Thereafter, on request of executive, two more samples of material re-tested at two different 3rd party independent Lab, wherein material again failed to meet the minimum criterion of tensile strength and chemical composition. The test result of the samples tested at 3rd party Labs were quite different from test results recorded during the (FAT) Factory Acceptance Tests conducted in presence of executive.

It was advised to replace the entire lot of failed material but executive expressed inability to replace it on account of site constraints i.e. block availability and hampering of train operations. Finally, the executive accepted the material of inferior quality from the agency and imposed a penalty of Rs. 20.6 Lacs with the approval of competent authority.

In view of multiple time failure of catenary wire, detail deliberation has been made by the executive and now, Cu-Cd Messenger wire has been replaced with Cu-Mg Messenger wire for all future works of DMRC.

CASE STUDY – 4

Sub : Testing of Lift steel Rope

Chief Technical Examiner/CVC inspected one of the Delhi MRTS phase-III electrical works. During the inspection, samples of material i.e. steel rope wire, LT cables were sealed and sent for testing at 3rd party independent lab to know the soundness of material. The steel wire rope used in elevators got failed in minimum breaking force parameter (tensile strength) during 3rd party testing. Matter was discussed with executive wherein it emerged that since the material had been procured from a reputed manufacturer, testing was not conducted by DMRC since inception of Delhi MRTS Phase-I project.

The failure report of material was shared with executive. On review of reports, executive pointed out that in the instant case the lift steel rope was tested by the 3rd party impendent Lab in accordance with IS: 2266 whereas material was manufactured as per BS EN 12385-5 and doubted the credibility of report. Executive highlighted the major difference between both the test protocols i.e. the rate at which the force is applied during the test.

As per Indian Standard (IS), the breaking force is to be increased by @ 0.7857 KN/sec whereas as per EN 12385-1, the breaking force is to be increased by @0.2795 KN/sec.

Executive contended that the lift is safe to operate by using the same steel rope as the factor of safety is 19.8 which is more than 12 mandated by EN 81 and imposed a penalty amounting of Rs. 327258/- on the agency.

In view of above, the para was dropped by CTE/CVC whereas in this instant case, executive took a bold step and decided to evaluate the performance of material as per relevant standard at 3rd party independent Laboratory. The test facilities were explored within India but no accredited testing facilities was available to conduct breaking load test of Lift steel wire rope as per EN 12385-1. Thereafter, Mechanical lab at University of Stuttgart, Germany confirmed to have sufficient facility & accreditation to conduct the breaking load test of lift wire steel rope as per BS EN 12385-1. The test was conducted at Germany as per relevant test protocol in presence of Vigilance, executive & Agency representatives wherein the Steel rope sample was successfully passed in the test with good margin.

CASE STUDY - 5

Sub : Conflict of Interest between Executive & Contractor:

On the basis of source information, a preventive check of Rail Track laying work was carried out by vigilance team wherein it was found that the work was awarded to a Firm-X, and a firm-Y was working as subcontractor to the main firm-X and executed the work having worth approx. Rs. 4.42 Cr. After perusal of credentials of subcontractor firm-Y, it was observed that two persons i.e. Mr. A & Mr. B were stakeholder in this firm-Y with 50%-50% share. Form DMRC side Mr. J & Mr. K was deputed as engineers/officers of DMRC for looking after the instant work.

In addition to this, following was observed:

1) After examining the electoral list, Aadhar Details and physically verifying the locations and records pertaining to Mr. B and Mr. J, it was observed that Mr. B (the stakeholder/Director of Firm-Y) appeared as Son of DMRC engineer Mr. J and was residing with him in same house.

2) Also, after perusal of records pertaining to email correspondences/phone calls, it is observed that Mr. K has requested/approached the employees of Firm-X for seeking the employment of his near relative in the same firm or in the partner firms of Firm-X. And finally secured a job in its partner firm-Z. Further, requested to change the location of posting too.

Keeping in view of above, clarifications from above engineers/officers i.e. Mr. J & Mr. K of DMRC were sought to know whether any prior intimation of this Father & Son relation was given by Mr. J(which is required as per Prevailing D&AR rule of DMRC) and seeking the employment of his near relative in the firm with which he is having official dealings.

In reply to the above clarifications, both the engineers/officers of DMRC failed to substantiate their act. Thus, found responsible for above lapses and accordingly suitable action was taken as per terms of their appointments in DMRC, wherein one officer i.e. Mr. J was terminated from services of DMRC and Mr. K was issued minor penalty charge sheet.

While submitting the QPR to the CTE's Organisation, the following contractors or other agencies are not being reported to the CTE. points may be kept in mind :- Such works should also be reported to the CTE's organisation by

the concerned departments.a) The cost of the work relates to the accepted/tendered value of the work and not the extimated cost. g) The purchase of ready-built properties, material and stores, if not

purchased on DGS&D approved rates or at the rates approved by b) If the work has been entrusted by one Ministry/deptt/ Undertaking of any other Govt. Agency, may also be treated as works for the the Central Govt., for execution, it may be included in the return to purchase of inclusion in the Quarterly Progress Reports. However, be submitted by the executing Organisation and also in the return of cases in which the supplier is Central Govt. Department or Central concerned Ministry/ Department/Undertaking of the Central Govt. Undertakings need not be included.Government entrusting the work to such executing organisaiton.

IMPORTANT CIRCULARS FROM CVC

CVC Circular No.PVC/18/01 dated 18.12.18

Sub: Timely payment to the contractos /suppliers/service providers – Preventive Measures – reg.

Please refer to the Commission's Circular No. 02/04/18 dated 03.05.2018 vide which the Commission had advised CVOs to examine from vigilance angle all cases of inordinate delay (in violation of the prescribed timelines) in the payment of bills during the last three years in their organizations.

2. It has been noted with concern by the Commission that although the report was sought within three months, many of the organizations have not submitted their report even though more than seven months have elapsed. Moreover many of the reports received are cursory and or interim reports that do not serve the purpose.

3. Further, it has been observed from the reports received by the Commission that some CVOs have taken up a sample study from the bills for the purpose of ascertaining reasons for delay in payment of bills. In most cases, it has not been indicated whether there is any vigilance angle in the delay of payments. There is no mention as to whether any employee has been found to be responsible. There is also no clear cut indication as to whether the principle of FIFO has been applied in the payment of bills.

4. While some CVOs have indicated the existing systems and procedures regarding payment of bills to the contractors/suppliers/ service providers, some organizations have sent cryptic replies in which no mention has been made of the systems and procedures prevalent in the organization.

5. All CVOs are therefore, advised to accord due seriousness to the issue of timely payment of bills and apprise the Commission about the steps taken by them to arrest cases of delay and furnish a comprehensive report to the Commission covering all aspects elaborated in the Commission's Circular dated 03.05.18 within a month positively.

6. It may be noted that the Commission is closely monitoring this area of work and non compliance may be adversely viewed by the Commission.

Sub: Expeditious disposal of cases involving public servants due to retire shortly.

The Commission vide its circulars referred to above had directed CVOs of all Ministries/Departments/Organizations to ensure expeditious finalization of disciplinary proceedings/ action, particularly in respect of officials likely to retire shortly. The Commission had specifically impressed upon the vigilance functionaries as well as administrative authorities concerned the need to prioritize their activities of conducting investigations and completion of disciplinary action well in advance so as to avoid such late references to the Commission. Further, it was also conveyed that such instances of undue delays on part of administrative authorities, in dealing with vigilance matters/ disciplinary cases, will be viewed very seriously by the Commission and it would be constrained to take an adverse view of CVOs/Administrative authorities for such avoidable delays.

2. Despite, these instruction, references are still being received in the Commission particularly from CPSUs and Public Sector Banks after the middle of the month, the officer is due to retire which is not acceptable. The Commission has taken a serious note of such lax attitude on the part of CVOs/DAs and would again reiterate that all such retirement cases should be received by the first week of the month of superannuation of the officer(s) concerned cases/references received for advice after the first week of the month would be returned back to the Department/organization without advice of the Commission and action recommended against the concerned authority (ies)

CASE STUDY – 1

Sub : Taking exorbitant illegal charges at Parking lot

A complaint was received via mail containing allegation of parking overcharging. The complainant who was a Top Officer of a renowned University informed that he parked his vehicle bearing No. 0598 in the morning of 22nd March 2019 at Parking lot of a Metro Station. In the afternoon of the same day, he was charged with Rs. 600/- as parking charge. On demand, a receipt bearing no. 000646 was also issued to complainant. Vigilance Department contacted the complainant telephonically on his mobile number. During telephonic discussions, he informed that no parking slip was issued to him at the time of parking of vehicle and when he came back, Rs. 600/- was demanded from him on a plea of fewer parking spaces. Parking slip was issued on insisting. No Electronic slip was issued at that time.

A preventive check was conducted at the parking site where; it was found that Zero value receipt (which is normally issued only to DMRC staff for their vehicle parking) bearing No. 000645 and 000647 were available in the bunch of counterfoils whereas Zero value receipt bearing no. 000646 was not available. “0” was cut from most of the receipts in the bunch from “Rs. 0/- Value” printed in the slip (Fig 1.). No record of parking of vehicle no. 0598 was available in the Entry-Exit register maintained in the parking lot for 22.03.2019. Whereas, Slip for the same vehicle was issued on the said date as (Fig 1.). Zero value parking slip which is meant for Staff parking was issued to the passengers. Even, Cutting of “0” from “Rs 0/- value” mentioned in the slip implies that this is done intentionally malpractice of charging exorbitant amount.

The complaint was also forwarded to Operations Department for enquiry. Operations Department called the complainant for a

meeting where the attendant was identified. Based on submissions of complainant, Operation department concluded that issue of zero value parking slip and cutting of “0” from Zero value receipts and issuance of receipts not in sequence tantamount that the parking attendant was having malafide intention of overcharging. Therefore, a penalty of Rs. 27917/- as per contract provision was realized from the parking contractor.

CASE STUDY – 2

Sub : Case Study of Overcharging at Metro Station (Ops)

A complaint was received via e-mail to Vigilance Department regarding overcharging at the Customer Care Centre at one of the Metro Station. The passenger alleged that he requested for recharging of Amount Rs. 300/- each in his two nos. DMRC contactless smart cards at Vishwavidyalaya metro station. He gave currency note of Rs. 2000/- for payment of Rs. 600/- but got back balance of Rs.1100 only. When the complainant asked for the remaining balance. The Operator told that he has charged Rs. 600 and advised complainant to refer the receipt. Complainant thought that one of his two cards has been recharged with Rs. 600. The complainant did not check the balance in the cards and later on, the complainant found that the total amount recharged in his two Smart Cards was Rs. 600/- only. He lodged a complaint to Vigilance regarding the same. The matter was investigated.

The Operator concerned in his statement refused to accept that any overcharging was done by him and submitted that Rs.200/-were left at his counter by a passenger on that day during his duty hours and he has deposited it in EIB (Excess in Booking) to on duty Station Controller while depositing the cash at the end of his shift.

The Operator mentioned the EIB of Rs.200/- on the back side of his Shift Abstract Form (SAF). The Station Controller who collected the cash on the day of incident, denied in his statement of deposition of Rs. 200/- as EIB from the operator. The Operator did not mention any EIB in EIB column of SAF (Shift Abstract Form).

On further investigation, the Station Controllers revealed that the said Operator had come to the Station Control Room and requested for TOM Operator Register. Station Controller allowed him and got busy in station working. Meanwhile the accused Operator tampered the records related to the day of the complaint and added remarks regarding deposit of Excess in Booking amount of Rs.200/-. This mischievous act of the Operator was later proved since, the Station Controller /Vishwavidyalaya had already sent copy of the records to Fig 1. (Parking receipt issued to the passenger)

IMPORTANT CIRCULARS FROM DMRC VIGILANCE

Cir. No. DMRC/VIG/06/2019/Sys. Imp./08 dated 31.07.19

Sub : Quality of reply to the paras raised by CTE/CVC

The Technical wing of CVC i.e CTE/CVC routinely conducts Intensive Examination of 'Works Contracts' in DMRC. During the year 2018, three such Examinations were carried out in the major works of Civil and E&M. It covers all the stages of 'works' starting from Estimate preparation and includes Tender finalization, execution of works, variations, sanction of NS items, off-loading of certain works and Termination if any.

The above Examination is quite comprehensive. Observations of the Commission are communicated in the form of 'Paras' which are to be replied by the executives. This is a stage when the 'Para' can be closed easily if the reply is satisfactory and the vigilance is also convinced. In case, it is not closed then it is referred to vigilance for detailed 'Investigation'

with reasons. If required by the Engineer, the goods or materials may be retested. Also, the Engineer have the authority to instruct the Contractor to remove from the site and replace any materials which are not in accordance with the Contract.

This provision is also mentioned in Clause 1.1.10(d) of Outline Construction Specifications for Civil Works. However, time period in which the rejected/non-conforming material is to be removed from site is not mentioned in any of these documents.

Hence, to avoid tendency of Contractor to use rejected material in the works, it has been decided that any rejected/non-conforming material shall be removed from site within 72 hours by the Contractor provided no retesting of material has been permitted by the Engineer in terms of GCC Clause 7.6

Sub: Consideration of stamped work experience certificate in tender evaluation.

It is noted that, at times, work experience certificate submitted by the bidder do not have name and designation of officer who is signing on behalf of the client.

As an extra precaution, it has been decided that all work experience certificate submitted by the bidder should have stamp of Name and Designation of officer along with the Name of client.

As the practice of stamping may not be prevalent in some of the Organizations and if any experience certificate has already been issued by the client, the bidder may have difficulty in getting it stamped. Hence to avoid such practical difficulties , following to be provided in tender document regarding stamping of work experience criteria:

• Only work experience certificate having stamp of Name and Designation of officer along with the Name of client shall be considered for evaluation. However, if any work experience certificate has been issued prior to 01.07.2019, same shall be considered for evaluation even if it is not stamped.

Sub: Consideration of only fully completed work for meeting work experience criteria in tenders having value up to Rs.25 crores.

As per above two DMRC circulars, for all tenders of Civil, Electrical and S&T works, successfully completed portion of ongoing works shall also be considered for qualifying work experience criteria, though as per guidelines of CVC, only fully completed works are to be taken into consideration for meeting work experience criteria in tenders.

It is noticed that for smaller value of Contracts (up to Rs.25 crores), normally adequate no of bidders are available, who are having work experience of fully completed works, but for Contracts of large value (more than Rs.25 crores), tenderers having relevant work experience of only fully completed works are lesser which is primarily due to longer completion period/having multiple sections in a Contract apart from time overrun due to delay in processing variation, claims. etc.

Hence, in partial modifications to the Circulars referred above, it has been decided that :

I. Only fully completed works shall be taken into consideration

for meeting work experience criteria in tenders of value up to Rs.25 crores and

II. For tenders having value more than Rs.25 croes, the existing practice of taking into consideration both the successfully completed portion of any on-going work and fully completed works shall continue for meeting work experience criteria.

Sub : System Improvement pertaining to filing system

CTE/CVC during the inspection of one of the DMRC works observed that the page numbering of sensitive documents like contractual/procurement files had not been done properly and advised to improve the filling system.

Accordingly, Vigilance vide circular dated 15.10.2010 advised al l concern to maintain and paginate the contractual/procurement files. However, it has been observed that the filling system adopted in most of the department is not satisfactory & the files are not being paginated.

It is responsibility of custodian to maintain/up-date the file under their possession. It is needless to mention that the name of custodian and file number is indicated when the file is created. Therefore, it is advised to all concerned that all the files should be page numbered immediately.

This is for strict compliance.

Sub: Adherence to DMRC Conduct Rules in the matter of Employment of Near Relatives etc.

Attention is invited to the following provisions, contained in the DMRC Conduct Rules and also the General Conditions of Contract (GCC), Clause 4.31

“Rule-6 EMPLOYMENT OF NEAR RELATIVES OF THE EMPLOYEES IN ANY CORPORATION OR FIRM ENJOYING PATRONAGE OF THE CORPORATION.

6.1 No employee shall use his position or influence directly or indirectly to secure employment for any person related whether by blood or marriage to the employee or to the employees wife or husband, whether such a person is dependent on the employee or not.

6.2 No employee shall except with the previous sanction of the Competent Authority permit his son, daughter or any member of the family to accept employment with any company or firm with which he has official dealings or with any Company or firm, having official dealings with the Corporation, the employment may be accepted provisionally subject to the permission of the Competent Authority to whom the matter shall be reported forthwith.

6.3 No employee shall in discharge of his official duties deal with any matter or give or sanction any contract to any company or firm or any other person, if any member of his family is employed in that Company or firm or under that person or if he or any member of his family is interested in such matter or contract in any other manner and the employee shall refer every such matter or contract to the superior official and the matter or the contract to the superior official and shall thereafter be disposed of according to the instructions of the Authority to whom the reference is made”

It may also be borne in mind, that as per Rules-13 regulating Private Trade or Employment clear instructions have been laid down, guiding the matter. Special attention is invited to Sub-rule 13.2 which lays down that “Every employee of the Corporation shall

report to the Competent Authority if any member of his family has engaged in a trade or business or owns or manages an insurance agency or commission agency.”

Further as per the GCC Clause No.4.31 it has been provided as under:

4.31 Disclosure of Relationship

If the Contractor or any partner of the Contractor or Director of the contractor's company is closely related to any of the officers of the employer or the Engineer, or alternatively, if any close relative of an officer of the Employer or the Engineer or alternatively if any close relative of an officer of the Employer or the Engineer has financial interest/stake in the Contractors' firm, the same shall be disclosed by the Contractor at the time of filling his tender. Any failure to disclose the interest involved, shall entitle the Employer to rescind the Contract, without payment of any compensation to the contractor.

Any instance of violation of the provisions of the conduct Rules and or the General Conditions of contract in the subject matter which come to notice henceforth shall be dealt with severely, under the Discipline and Appeal Rules, of the Company.

Sub: Stoppage of Publication of Advertisement in Newspapers for Works/Services & Store Supply Tenders

and dealing of Tenders.

The amended General Finance Rules (GFR) 2017 have done away with the need for publishing advertisement in newspaper for procurement of Goods & Services. Hence, following instructions are issued for dealing of Works/Services & Stores Supply Tenders :

I. No advertisement for any Tender Enquiries/NIT for any Works/Services or Stores Supply Tenders of DMRC are to be issued for publication in Newspaper by any Executive with immediate effect, however a common advertisement for Works/Services Contract and Stores supply Contracts will be published fortnightly by Contract Department of DMRC regarding stoppage of publication of NITs in the Newspaper. However if need is felt for publication of advertisement in newspaper for any specific tender, the approval of concerned Director may be obtained after recording reasons.

II. The Tender Notice Period as referred in both the DMRC Procurement Manual for Contracts and for Supply Contracts shall be reckoned from the date the tender is published at DMRC website www.delhimetrorail.com. A screen shot of NIT published on DMRC website to be filed in tender file for this purpose.

This is issued with approval of MD.

It has been observed that in most of the cases where the officers involved in the works have moved out and the new incumbent on the post furnishes the reply, which sometimes is evasive and casual. In some of the cases, it is even factually incorrect also. This results in repeated back references to the executives, and the process is delayed.

The matter has been discussed with MD. In future, any factually incorrect reply will be viewed seriously. Therefore, all concerned are kindly advised to furnish the reply with due care.

Sub: Removal of rejected/non-conforming material from site.

As per GCC Clauses 7.6, any goods or material found to be defective or not in accordance with the Contract after testing, the Engineer may reject the same by giving notice to the Contractor

CVC Circular No.PVC/18/01 dated 18.12.18

Sub: Timely payment to the contractos /suppliers/service providers – Preventive Measures – reg.

Please refer to the Commission's Circular No. 02/04/18 dated 03.05.2018 vide which the Commission had advised CVOs to examine from vigilance angle all cases of inordinate delay (in violation of the prescribed timelines) in the payment of bills during the last three years in their organizations.

2. It has been noted with concern by the Commission that although the report was sought within three months, many of the organizations have not submitted their report even though more than seven months have elapsed. Moreover many of the reports received are cursory and or interim reports that do not serve the purpose.

3. Further, it has been observed from the reports received by the Commission that some CVOs have taken up a sample study from the bills for the purpose of ascertaining reasons for delay in payment of bills. In most cases, it has not been indicated whether there is any vigilance angle in the delay of payments. There is no mention as to whether any employee has been found to be responsible. There is also no clear cut indication as to whether the principle of FIFO has been applied in the payment of bills.

4. While some CVOs have indicated the existing systems and procedures regarding payment of bills to the contractors/suppliers/ service providers, some organizations have sent cryptic replies in which no mention has been made of the systems and procedures prevalent in the organization.

5. All CVOs are therefore, advised to accord due seriousness to the issue of timely payment of bills and apprise the Commission about the steps taken by them to arrest cases of delay and furnish a comprehensive report to the Commission covering all aspects elaborated in the Commission's Circular dated 03.05.18 within a month positively.

6. It may be noted that the Commission is closely monitoring this area of work and non compliance may be adversely viewed by the Commission.

CVC Circular No.019/VGL/026 dated 23.07.19

Sub: Expeditious disposal of cases involving public servants due to retire shortly.

Ref : (i) Commission's Office Order No.34/9/07 dated 27.09.2007

(ii) Commission's Circular No. 03/03/11 dated 11.03.2011

The Commission vide its circulars referred to above had directed CVOs of all Ministries/Departments/Organizations to ensure expeditious finalization of disciplinary proceedings/ action, particularly in respect of officials likely to retire shortly. The Commission had specifically impressed upon the vigilance functionaries as well as administrative authorities concerned the need to prioritize their activities of conducting investigations and completion of disciplinary action well in advance so as to avoid such late references to the Commission. Further, it was also conveyed that such instances of undue delays on part of administrative authorities, in dealing with vigilance matters/ disciplinary cases, will be viewed very seriously by the Commission and it would be constrained to take an adverse view of CVOs/Administrative authorities for such avoidable delays.

2. Despite, these instruction, references are still being received in the Commission particularly from CPSUs and Public Sector Banks after the middle of the month, the officer is due to retire which is not acceptable. The Commission has taken a serious note of such lax attitude on the part of CVOs/DAs and would again reiterate that all such retirement cases should be received by the first week of the month of superannuation of the officer(s) concerned cases/references received for advice after the first week of the month would be returned back to the Department/organization without advice of the Commission and action recommended against the concerned authority (ies)

3. All CVOs/Administrative Authorities should ensure strict compliance to the above instructions.

CASE STUDY – 1

Sub : Taking exorbitant illegal charges at Parking lot

A complaint was received via mail containing allegation of parking overcharging. The complainant who was a Top Officer of a renowned University informed that he parked his vehicle bearing No. 0598 in the morning of 22nd March 2019 at Parking lot of a Metro Station. In the afternoon of the same day, he was charged with Rs. 600/- as parking charge. On demand, a receipt bearing no. 000646 was also issued to complainant. Vigilance Department contacted the complainant telephonically on his mobile number. During telephonic discussions, he informed that no parking slip was issued to him at the time of parking of vehicle and when he came back, Rs. 600/- was demanded from him on a plea of fewer parking spaces. Parking slip was issued on insisting. No Electronic slip was issued at that time.

A preventive check was conducted at the parking site where; it was found that Zero value receipt (which is normally issued only to DMRC staff for their vehicle parking) bearing No. 000645 and 000647 were available in the bunch of counterfoils whereas Zero value receipt bearing no. 000646 was not available. “0” was cut from most of the receipts in the bunch from “Rs. 0/- Value” printed in the slip (Fig 1.). No record of parking of vehicle no. 0598 was available in the Entry-Exit register maintained in the parking lot for 22.03.2019. Whereas, Slip for the same vehicle was issued on the said date as (Fig 1.). Zero value parking slip which is meant for Staff parking was issued to the passengers. Even, Cutting of “0” from “Rs 0/- value” mentioned in the slip implies that this is done intentionally malpractice of charging exorbitant amount.

The complaint was also forwarded to Operations Department for enquiry. Operations Department called the complainant for a

meeting where the attendant was identified. Based on submissions of complainant, Operation department concluded that issue of zero value parking slip and cutting of “0” from Zero value receipts and issuance of receipts not in sequence tantamount that the parking attendant was having malafide intention of overcharging. Therefore, a penalty of Rs. 27917/- as per contract provision was realized from the parking contractor.

If the Contractor or any partner of the Contractor or Director of the contractor's company is closely related to any of the officers of the employer or the Engineer, or alternatively, if any close relative of an officer of the Employer or the Engineer or alternatively if any close relative of an officer of the Employer or the Engineer has financial interest/stake in the Contractors' firm, the same shall be disclosed by the Contractor at the time of filling his tender. Any failure to disclose the interest involved, shall entitle the Employer to rescind the Contract, without payment of any compensation to the contractor.

Any instance of violation of the provisions of the conduct Rules and or the General Conditions of contract in the subject matter which come to notice henceforth shall be dealt with severely, under the Discipline and Appeal Rules, of the Company.

Sub: Stoppage of Publication of Advertisement in Newspapers for Works/Services & Store Supply Tenders

and dealing of Tenders.

The amended General Finance Rules (GFR) 2017 have done away with the need for publishing advertisement in newspaper for procurement of Goods & Services. Hence, following instructions are issued for dealing of Works/Services & Stores Supply Tenders :

I. No advertisement for any Tender Enquiries/NIT for any Works/Services or Stores Supply Tenders of DMRC are to be issued for publication in Newspaper by any Executive with immediate effect, however a common advertisement for Works/Services Contract and Stores supply Contracts will be published fortnightly by Contract Department of DMRC regarding stoppage of publication of NITs in the Newspaper. However if need is felt for publication of advertisement in newspaper for any specific tender, the approval of concerned Director may be obtained after recording reasons.

II. The Tender Notice Period as referred in both the DMRC Procurement Manual for Contracts and for Supply Contracts shall be reckoned from the date the tender is published at DMRC website www.delhimetrorail.com. A screen shot of NIT published on DMRC website to be filed in tender file for this purpose.

This is issued with approval of MD.

It has been observed that in most of the cases where the officers involved in the works have moved out and the new incumbent on the post furnishes the reply, which sometimes is evasive and casual. In some of the cases, it is even factually incorrect also. This results in repeated back references to the executives, and the process is delayed.

The matter has been discussed with MD. In future, any factually incorrect reply will be viewed seriously. Therefore, all concerned are kindly advised to furnish the reply with due care.

CVC Circular No.PVC/18/01 dated 18.12.18

Sub: Timely payment to the contractos /suppliers/service providers – Preventive Measures – reg.

Please refer to the Commission's Circular No. 02/04/18 dated 03.05.2018 vide which the Commission had advised CVOs to examine from vigilance angle all cases of inordinate delay (in violation of the prescribed timelines) in the payment of bills during the last three years in their organizations.

2. It has been noted with concern by the Commission that although the report was sought within three months, many of the organizations have not submitted their report even though more than seven months have elapsed. Moreover many of the reports received are cursory and or interim reports that do not serve the purpose.

3. Further, it has been observed from the reports received by the Commission that some CVOs have taken up a sample study from the bills for the purpose of ascertaining reasons for delay in payment of bills. In most cases, it has not been indicated whether there is any vigilance angle in the delay of payments. There is no mention as to whether any employee has been found to be responsible. There is also no clear cut indication as to whether the principle of FIFO has been applied in the payment of bills.

4. While some CVOs have indicated the existing systems and procedures regarding payment of bills to the contractors/suppliers/ service providers, some organizations have sent cryptic replies in which no mention has been made of the systems and procedures prevalent in the organization.

5. All CVOs are therefore, advised to accord due seriousness to the issue of timely payment of bills and apprise the Commission about the steps taken by them to arrest cases of delay and furnish a comprehensive report to the Commission covering all aspects elaborated in the Commission's Circular dated 03.05.18 within a month positively.

6. It may be noted that the Commission is closely monitoring this area of work and non compliance may be adversely viewed by the Commission.

CVC Circular No.019/VGL/026 dated 23.07.19

Sub: Expeditious disposal of cases involving public servants due to retire shortly.

The Commission vide its circulars referred to above had directed CVOs of all Ministries/Departments/Organizations to ensure expeditious finalization of disciplinary proceedings/ action, particularly in respect of officials likely to retire shortly. The Commission had specifically impressed upon the vigilance functionaries as well as administrative authorities concerned the need to prioritize their activities of conducting investigations and completion of disciplinary action well in advance so as to avoid such late references to the Commission. Further, it was also conveyed that such instances of undue delays on part of administrative authorities, in dealing with vigilance matters/ disciplinary cases, will be viewed very seriously by the Commission and it would be constrained to take an adverse view of CVOs/Administrative authorities for such avoidable delays.

2. Despite, these instruction, references are still being received in the Commission particularly from CPSUs and Public Sector Banks after the middle of the month, the officer is due to retire which is not acceptable. The Commission has taken a serious note of such lax attitude on the part of CVOs/DAs and would again reiterate that all such retirement cases should be received by the first week of the month of superannuation of the officer(s) concerned cases/references received for advice after the first week of the month would be returned back to the Department/organization without advice of the Commission and action recommended against the concerned authority (ies)

3. All CVOs/Administrative Authorities should ensure strict compliance to the above instructions.

CASE STUDY – 1

Sub : Taking exorbitant illegal charges at Parking lot

A complaint was received via mail containing allegation of parking overcharging. The complainant who was a Top Officer of a renowned University informed that he parked his vehicle bearing No. 0598 in the morning of 22nd March 2019 at Parking lot of a Metro Station. In the afternoon of the same day, he was charged with Rs. 600/- as parking charge. On demand, a receipt bearing no. 000646 was also issued to complainant. Vigilance Department contacted the complainant telephonically on his mobile number. During telephonic discussions, he informed that no parking slip was issued to him at the time of parking of vehicle and when he came back, Rs. 600/- was demanded from him on a plea of fewer parking spaces. Parking slip was issued on insisting. No Electronic slip was issued at that time.

A preventive check was conducted at the parking site where; it was found that Zero value receipt (which is normally issued only to DMRC staff for their vehicle parking) bearing No. 000645 and 000647 were available in the bunch of counterfoils whereas Zero value receipt bearing no. 000646 was not available. “0” was cut from most of the receipts in the bunch from “Rs. 0/- Value” printed in the slip (Fig 1.). No record of parking of vehicle no. 0598 was available in the Entry-Exit register maintained in the parking lot for 22.03.2019. Whereas, Slip for the same vehicle was issued on the said date as (Fig 1.). Zero value parking slip which is meant for Staff parking was issued to the passengers. Even, Cutting of “0” from “Rs 0/- value” mentioned in the slip implies that this is done intentionally malpractice of charging exorbitant amount.

The complaint was also forwarded to Operations Department for enquiry. Operations Department called the complainant for a

meeting where the attendant was identified. Based on submissions of complainant, Operation department concluded that issue of zero value parking slip and cutting of “0” from Zero value receipts and issuance of receipts not in sequence tantamount that the parking attendant was having malafide intention of overcharging. Therefore, a penalty of Rs. 27917/- as per contract provision was realized from the parking contractor.

CASE STUDY – 2

Sub : Case Study of Overcharging at Metro Station (Ops)

A complaint was received via e-mail to Vigilance Department regarding overcharging at the Customer Care Centre at one of the Metro Station. The passenger alleged that he requested for recharging of Amount Rs. 300/- each in his two nos. DMRC contactless smart cards at Vishwavidyalaya metro station. He gave currency note of Rs. 2000/- for payment of Rs. 600/- but got back balance of Rs.1100 only. When the complainant asked for the remaining balance. The Operator told that he has charged Rs. 600 and advised complainant to refer the receipt. Complainant thought that one of his two cards has been recharged with Rs. 600. The complainant did not check the balance in the cards and later on, the complainant found that the total amount recharged in his two Smart Cards was Rs. 600/- only. He lodged a complaint to Vigilance regarding the same. The matter was investigated.

The Operator concerned in his statement refused to accept that any overcharging was done by him and submitted that Rs.200/-were left at his counter by a passenger on that day during his duty hours and he has deposited it in EIB (Excess in Booking) to on duty Station Controller while depositing the cash at the end of his shift.

The Operator mentioned the EIB of Rs.200/- on the back side of his Shift Abstract Form (SAF). The Station Controller who collected the cash on the day of incident, denied in his statement of deposition of Rs. 200/- as EIB from the operator. The Operator did not mention any EIB in EIB column of SAF (Shift Abstract Form).

On further investigation, the Station Controllers revealed that the said Operator had come to the Station Control Room and requested for TOM Operator Register. Station Controller allowed him and got busy in station working. Meanwhile the accused Operator tampered the records related to the day of the complaint and added remarks regarding deposit of Excess in Booking amount of Rs.200/-. This mischievous act of the Operator was later proved since, the Station Controller /Vishwavidyalaya had already sent copy of the records to Fig 1. (Parking receipt issued to the passenger)

IMPORTANT CIRCULARS FROM DMRC VIGILANCE

Cir. No. DMRC/VIG/06/2019/Sys. Imp./08 dated 31.07.19

Sub : Quality of reply to the paras raised by CTE/CVC

The Technical wing of CVC i.e CTE/CVC routinely conducts Intensive Examination of 'Works Contracts' in DMRC. During the year 2018, three such Examinations were carried out in the major works of Civil and E&M. It covers all the stages of 'works' starting from Estimate preparation and includes Tender finalization, execution of works, variations, sanction of NS items, off-loading of certain works and Termination if any.

The above Examination is quite comprehensive. Observations of the Commission are communicated in the form of 'Paras' which are to be replied by the executives. This is a stage when the 'Para' can be closed easily if the reply is satisfactory and the vigilance is also convinced. In case, it is not closed then it is referred to vigilance for detailed 'Investigation'

with reasons. If required by the Engineer, the goods or materials may be retested. Also, the Engineer have the authority to instruct the Contractor to remove from the site and replace any materials which are not in accordance with the Contract.

This provision is also mentioned in Clause 1.1.10(d) of Outline Construction Specifications for Civil Works. However, time period in which the rejected/non-conforming material is to be removed from site is not mentioned in any of these documents.

Hence, to avoid tendency of Contractor to use rejected material in the works, it has been decided that any rejected/non-conforming material shall be removed from site within 72 hours by the Contractor provided no retesting of material has been permitted by the Engineer in terms of GCC Clause 7.6

Sub: Consideration of stamped work experience certificate in tender evaluation.

It is noted that, at times, work experience certificate submitted by the bidder do not have name and designation of officer who is signing on behalf of the client.

As an extra precaution, it has been decided that all work experience certificate submitted by the bidder should have stamp of Name and Designation of officer along with the Name of client.

As the practice of stamping may not be prevalent in some of the Organizations and if any experience certificate has already been issued by the client, the bidder may have difficulty in getting it stamped. Hence to avoid such practical difficulties , following to be provided in tender document regarding stamping of work experience criteria:

• Only work experience certificate having stamp of Name and Designation of officer along with the Name of client shall be considered for evaluation. However, if any work experience certificate has been issued prior to 01.07.2019, same shall be considered for evaluation even if it is not stamped.

Sub: Consideration of only fully completed work for meeting work experience criteria in tenders having value up to Rs.25 crores.

As per above two DMRC circulars, for all tenders of Civil, Electrical and S&T works, successfully completed portion of ongoing works shall also be considered for qualifying work experience criteria, though as per guidelines of CVC, only fully completed works are to be taken into consideration for meeting work experience criteria in tenders.

It is noticed that for smaller value of Contracts (up to Rs.25 crores), normally adequate no of bidders are available, who are having work experience of fully completed works, but for Contracts of large value (more than Rs.25 crores), tenderers having relevant work experience of only fully completed works are lesser which is primarily due to longer completion period/having multiple sections in a Contract apart from time overrun due to delay in processing variation, claims. etc.

Hence, in partial modifications to the Circulars referred above, it has been decided that :

I. Only fully completed works shall be taken into consideration

for meeting work experience criteria in tenders of value up to Rs.25 crores and

II. For tenders having value more than Rs.25 croes, the existing practice of taking into consideration both the successfully completed portion of any on-going work and fully completed works shall continue for meeting work experience criteria.

Sub : System Improvement pertaining to filing system

CTE/CVC during the inspection of one of the DMRC works observed that the page numbering of sensitive documents like contractual/procurement files had not been done properly and advised to improve the filling system.

Accordingly, Vigilance vide circular dated 15.10.2010 advised al l concern to maintain and paginate the contractual/procurement files. However, it has been observed that the filling system adopted in most of the department is not satisfactory & the files are not being paginated.

It is responsibility of custodian to maintain/up-date the file under their possession. It is needless to mention that the name of custodian and file number is indicated when the file is created. Therefore, it is advised to all concerned that all the files should be page numbered immediately.

This is for strict compliance.

Sub: Adherence to DMRC Conduct Rules in the matter of Employment of Near Relatives etc.

Attention is invited to the following provisions, contained in the DMRC Conduct Rules and also the General Conditions of Contract (GCC), Clause 4.31

“Rule-6 EMPLOYMENT OF NEAR RELATIVES OF THE EMPLOYEES IN ANY CORPORATION OR FIRM ENJOYING PATRONAGE OF THE CORPORATION.

6.1 No employee shall use his position or influence directly or indirectly to secure employment for any person related whether by blood or marriage to the employee or to the employees wife or husband, whether such a person is dependent on the employee or not.

6.2 No employee shall except with the previous sanction of the Competent Authority permit his son, daughter or any member of the family to accept employment with any company or firm with which he has official dealings or with any Company or firm, having official dealings with the Corporation, the employment may be accepted provisionally subject to the permission of the Competent Authority to whom the matter shall be reported forthwith.

6.3 No employee shall in discharge of his official duties deal with any matter or give or sanction any contract to any company or firm or any other person, if any member of his family is employed in that Company or firm or under that person or if he or any member of his family is interested in such matter or contract in any other manner and the employee shall refer every such matter or contract to the superior official and the matter or the contract to the superior official and shall thereafter be disposed of according to the instructions of the Authority to whom the reference is made”

It may also be borne in mind, that as per Rules-13 regulating Private Trade or Employment clear instructions have been laid down, guiding the matter. Special attention is invited to Sub-rule 13.2 which lays down that “Every employee of the Corporation shall

report to the Competent Authority if any member of his family has engaged in a trade or business or owns or manages an insurance agency or commission agency.”

Further as per the GCC Clause No.4.31 it has been provided as under:

4.31 Disclosure of Relationship

CASE STUDY – 3

Sub : Failure of Catenary wire/ Messenger wire during testing at 3rd party Lab.

A preventive check was carried out in one of the Delhi MRTS Phase –III works pertains to erection of over Head Equipments (OHE). During the inspection, materials were sealed and sent for 3rd party testing at independent lab to know the soundness of materials.

The sample of Cu-Cd Catenary wire/ Messenger wire (65 sq.mm.) failed in Breaking Load, tensile strength and chemical compositions parameters in 3rd party testing. Thereafter, on request of executive, two more samples of material re-tested at two different 3rd party independent Lab, wherein material again failed to meet the minimum criterion of tensile strength and chemical composition. The test result of the samples tested at 3rd party Labs were quite different from test results recorded during the (FAT) Factory Acceptance Tests conducted in presence of executive.

It was advised to replace the entire lot of failed material but executive expressed inability to replace it on account of site constraints i.e. block availability and hampering of train operations. Finally, the executive accepted the material of inferior quality from the agency and imposed a penalty of Rs. 20.6 Lacs with the approval of competent authority.

In view of multiple time failure of catenary wire, detail deliberation has been made by the executive and now, Cu-Cd Messenger wire has been replaced with Cu-Mg Messenger wire for all future works of DMRC.

CASE STUDY – 4

Sub : Testing of Lift steel Rope

Chief Technical Examiner/CVC inspected one of the Delhi MRTS phase-III electrical works. During the inspection, samples of material i.e. steel rope wire, LT cables were sealed and sent for testing at 3rd party independent lab to know the soundness of material. The steel wire rope used in elevators got failed in minimum breaking force parameter (tensile strength) during 3rd party testing. Matter was discussed with executive wherein it emerged that since the material had been procured from a reputed manufacturer, testing was not conducted by DMRC since inception of Delhi MRTS Phase-I project.

The failure report of material was shared with executive. On review of reports, executive pointed out that in the instant case the lift steel rope was tested by the 3rd party impendent Lab in accordance with IS: 2266 whereas material was manufactured as per BS EN 12385-5 and doubted the credibility of report. Executive highlighted the major difference between both the test protocols i.e. the rate at which the force is applied during the test.

As per Indian Standard (IS), the breaking force is to be increased by @ 0.7857 KN/sec whereas as per EN 12385-1, the breaking force is to be increased by @0.2795 KN/sec.

Executive contended that the lift is safe to operate by using the same steel rope as the factor of safety is 19.8 which is more than 12 mandated by EN 81 and imposed a penalty amounting of Rs. 327258/- on the agency.

In view of above, the para was dropped by CTE/CVC whereas in this instant case, executive took a bold step and decided to evaluate the performance of material as per relevant standard at 3rd party independent Laboratory. The test facilities were explored within India but no accredited testing facilities was available to conduct breaking load test of Lift steel wire rope as per EN 12385-1. Thereafter, Mechanical lab at University of Stuttgart, Germany confirmed to have sufficient facility & accreditation to conduct the breaking load test of lift wire steel rope as per BS EN 12385-1. The test was conducted at Germany as per relevant test protocol in presence of Vigilance, executive & Agency representatives wherein the Steel rope sample was successfully passed in the test with good margin.

CASE STUDY - 5

Sub : Conflict of Interest between Executive & Contractor:

On the basis of source information, a preventive check of Rail Track laying work was carried out by vigilance team wherein it was found that the work was awarded to a Firm-X, and a firm-Y was working as subcontractor to the main firm-X and executed the work having worth approx. Rs. 4.42 Cr. After perusal of credentials of subcontractor firm-Y, it was observed that two persons i.e. Mr. A & Mr. B were stakeholder in this firm-Y with 50%-50% share. Form DMRC side Mr. J & Mr. K was deputed as engineers/officers of DMRC for looking after the instant work.

In addition to this, following was observed:

1) After examining the electoral list, Aadhar Details and physically verifying the locations and records pertaining to Mr. B and Mr. J, it was observed that Mr. B (the stakeholder/Director of Firm-Y) appeared as Son of DMRC engineer Mr. J and was residing with him in same house.

2) Also, after perusal of records pertaining to email correspondences/phone calls, it is observed that Mr. K has requested/approached the employees of Firm-X for seeking the employment of his near relative in the same firm or in the partner firms of Firm-X. And finally secured a job in its partner firm-Z. Further, requested to change the location of posting too.

Keeping in view of above, clarifications from above engineers/officers i.e. Mr. J & Mr. K of DMRC were sought to know whether any prior intimation of this Father & Son relation was given by Mr. J(which is required as per Prevailing D&AR rule of DMRC) and seeking the employment of his near relative in the firm with which he is having official dealings.

In reply to the above clarifications, both the engineers/officers of DMRC failed to substantiate their act. Thus, found responsible for above lapses and accordingly suitable action was taken as per terms of their appointments in DMRC, wherein one officer i.e. Mr. J was terminated from services of DMRC and Mr. K was issued minor penalty charge sheet.

While submitting the QPR to the CTE's Organisation, the following contractors or other agencies are not being reported to the CTE. points may be kept in mind :- Such works should also be reported to the CTE's organisation by

the concerned departments.a) The cost of the work relates to the accepted/tendered value of the work and not the extimated cost. g) The purchase of ready-built properties, material and stores, if not

purchased on DGS&D approved rates or at the rates approved by b) If the work has been entrusted by one Ministry/deptt/ Undertaking of any other Govt. Agency, may also be treated as works for the the Central Govt., for execution, it may be included in the return to purchase of inclusion in the Quarterly Progress Reports. However, be submitted by the executing Organisation and also in the return of cases in which the supplier is Central Govt. Department or Central concerned Ministry/ Department/Undertaking of the Central Govt. Undertakings need not be included.Government entrusting the work to such executing organisaiton.

Integrity should always be the way of life. This year the theme of Vigilance Awareness Week is also on the same lines i.e. “Integrity – A way of life”. As stressed by CVC, it can be achieved by inspiring the young generation to lead a life that combines righteousness and honesty and honesty can be made the way of one's life. India will be totally corruption free if 'Integrity' becomes a way of life.

Integrity is not only absence of corruption, but in fact it is more than that i.e. 'High Moral Value'. Sometime we indulge in offering bribe for some services which are otherwise free. Though we know that it not morally correct, yet this is done mainly for convenience. We ignore the fact that giving the bribe is as bad as taking the bribe and we become party to the process of corruption.

Now, technology is coming to our rescue and level of corruption has drastically reduced in many areas which were earlier infamous for it. By making use of all these techniques, DMRC is making all out efforts in this direction right from its inception. I hope one day this thought will spread all over the world.

The theme of this year’s Vigilance Awareness Week is ‘Integrity – A way of life’. Indeed, there could not have been a more apt theme for this week, during which we reaffirm our commitment towards integrity, honesty and transparency in our sphere of work. The theme this year conveys to us that integrity should be inculcated as a way of life so that it permeates into all aspects of our existence. Over the years, DMRC has established itself as an

organisation of eminence. It has set very high standards of adherence to the values such as honesty, transparency and integrity. Now, the organisation expanding to close to 14,000 people working in different parts of the NCR as well as other cities in India and neighboring countries, the need for organisational checks and balancing is all the more important. Let us resolve that we shall continue to uphold and champion these values wherever we work. Today, many cities across the country as well as abroad are approaching us to steer their Metro projects. CASE STUDY – 3

Sub : Failure of Catenary wire/ Messenger wire during testing at 3rd party Lab.

A preventive check was carried out in one of the Delhi MRTS Phase –III works pertains to erection of over Head Equipments (OHE). During the inspection, materials were sealed and sent for 3rd party testing at independent lab to know the soundness of materials.

The sample of Cu-Cd Catenary wire/ Messenger wire (65 sq.mm.) failed in Breaking Load, tensile strength and chemical compositions parameters in 3rd party testing. Thereafter, on request of executive, two more samples of material re-tested at two different 3rd party independent Lab, wherein material again failed to meet the minimum criterion of tensile strength and chemical composition. The test result of the samples tested at 3rd party Labs were quite different from test results recorded during the (FAT) Factory Acceptance Tests conducted in presence of executive.

It was advised to replace the entire lot of failed material but executive expressed inability to replace it on account of site constraints i.e. block availability and hampering of train operations. Finally, the executive accepted the material of inferior quality from the agency and imposed a penalty of Rs. 20.6 Lacs with the approval of competent authority.

In view of multiple time failure of catenary wire, detail deliberation has been made by the executive and now, Cu-Cd Messenger wire has been replaced with Cu-Mg Messenger wire for all future works of DMRC.

CASE STUDY – 4

Sub : Testing of Lift steel Rope

Chief Technical Examiner/CVC inspected one of the Delhi MRTS phase-III electrical works. During the inspection, samples of material i.e. steel rope wire, LT cables were sealed and sent for testing at 3rd party independent lab to know the soundness of material. The steel wire rope used in elevators got failed in minimum breaking force parameter (tensile strength) during 3rd party testing. Matter was discussed with executive wherein it emerged that since the material had been procured from a reputed manufacturer, testing was not conducted by DMRC since inception of Delhi MRTS Phase-I project.

The failure report of material was shared with executive. On review of reports, executive pointed out that in the instant case the lift steel rope was tested by the 3rd party impendent Lab in accordance with IS: 2266 whereas material was manufactured as per BS EN 12385-5 and doubted the credibility of report. Executive highlighted the major difference between both the test protocols i.e. the rate at which the force is applied during the test.

As per Indian Standard (IS), the breaking force is to be increased by @ 0.7857 KN/sec whereas as per EN 12385-1, the breaking force is to be increased by @0.2795 KN/sec.

Executive contended that the lift is safe to operate by using the same steel rope as the factor of safety is 19.8 which is more than 12 mandated by EN 81 and imposed a penalty amounting of Rs. 327258/- on the agency.

In view of above, the para was dropped by CTE/CVC whereas in this instant case, executive took a bold step and decided to evaluate the performance of material as per relevant standard at 3rd party independent Laboratory. The test facilities were explored within India but no accredited testing facilities was available to conduct breaking load test of Lift steel wire rope as per EN 12385-1. Thereafter, Mechanical lab at University of Stuttgart, Germany confirmed to have sufficient facility & accreditation to conduct the breaking load test of lift wire steel rope as per BS EN 12385-1. The test was conducted at Germany as per relevant test protocol in presence of Vigilance, executive & Agency representatives wherein the Steel rope sample was successfully passed in the test with good margin.

CASE STUDY - 5

Sub : Conflict of Interest between Executive & Contractor:

On the basis of source information, a preventive check of Rail Track laying work was carried out by vigilance team wherein it was found that the work was awarded to a Firm-X, and a firm-Y was working as subcontractor to the main firm-X and executed the work having worth approx. Rs. 4.42 Cr. After perusal of credentials of subcontractor firm-Y, it was observed that two persons i.e. Mr. A & Mr. B were stakeholder in this firm-Y with 50%-50% share. Form DMRC side Mr. J & Mr. K was deputed as engineers/officers of DMRC for looking after the instant work.
