Introduction:

Tricycle it is useful for the people don’t have own vehicle for

carrying baggage or groceries. Tricycle is a light vehicle is use for

day to day travel. Tricycles are form of the auto-rickshaw and built

in a variety of styles which differ from city to city. One variety has

a cab completely enclosing the motorcycle and rider. These accommodate

three to four passengers and goods can be placed on the roof. One

passenger sits next to the driver and up to three passengers can be

seated in two bench seats in a compartment behind the rider and front

seat. These can be completely enclosed in plastic during rainy

weather.

The first tricycle was built in 1680 for a German paraplegic named

Stephan Farffler (Oct. 24, 1689), who lived near Nuremburg. He was a

watch-maker and the tricycle had gears and hand cranks.

Article III – Rules and Regulations in the Operation of MotorizedTricycle-For-Hire (MTFH)

Section 48. Rules of Entry – Only Filipino Citizens, Partnershipor corporations seventy percent (70%) the capital of which are ownedby Filipino citizens are qualified to operate tricycle – for – hirewithin the City of Vigan. (Ordinance No. 05, Series of 1992 asamended)

Section 50. Operation System and Procedure for Tricycle – for –Hire

a) TFH must be equipped with muffler with silencer installation ofair horns is absolutely prohibited.

b) TFH operators shall be prohibited to employ drivers without avalid professional driver’s license. TFH drivers are not allowedto wear short pants, sleepers / sandals, and sleeveless shirts inoperating a tricycle.

c) The TFH operators and drivers are encouraged to form and operatecooperatives as a way of promoting the welfare and well – beingof and to police and impose discipline among members.

d) No TFH driver is allowed to discriminate against passengers.Any acts of discourtesy against passengers are hereby punishable.

e) Overloading – No TFH shall be allowed to carry passengers outsideof the tricycle passenger cab and more than it is designed for.Only one (1) passenger shall be allowed at backseat of the TFHdriver and other passengers shall be inside the TFH. (Ord. No. 2-a, Series of 1994)

f) Exemption – a tricycle – for – hire driver shall hereby beexempted, in cases of emergency, calamity or other compellingreasons, from the prohibition under Section 50-b of Article III,Chapter of this pants, slippers, sandals and sleeveless shirts.

g) Delegation of Authority – The authority of the SangguniangPanlungsod to review, grant and be delegated to the SangguniangPanlungsod Committee on Transportation composed of SanguniangPanglungsod members.

h) The annual registration fee prescribed in the Vigan Revenue Codeas Amended shall be the source of the automatic appropriation forthe making of stickers, plates, painting of tricycle sidecars, orany otherexpenditures/requirements for Tricycle – for – Hires(TFHs) in Vigan City.

Section 51. Administrative Systems and Procedure:

Fare:

1. The Sangguniang Panlungsod shall determine, fix and/orprescribe and periodically adjust fares or rates relative toTFH service after public hearing and which shall be inconsonance with LTO / DOTC rates.

2. Each existing TFH association shall adopt a Table of Fares tobe duly approved by the Sangguniang Panlungsod after which thesame shall be posted prominately at designated TricycleParking Terminals as herein prescribed and on the frontinterior of the tricycle sidecar.

Section 55. Mscellaneous Provisions. No TFH operator shallarbitrary increase tricycle fare without first filing a petitionbefore the Sangguniang Panglungsod of Vigan which is hereby authorizedto render a decision after public hearing.

Article VI – Guidelines For The Supension, Cancellation and Awardingof Tricycle Franchise

Section 65. There is herein an established guidelines regardingthe suspension, cancellation and awarding of tricycle franchise issuedby the City Government of VIgan plying within its territorialjurisdiction. (Ordinance No. 11, Series of 2003)

Section 66. List Of Violations:

Section 67. Conditions in Suspension, Cancellation and Awardingof Franchise. Tricycle Franchise issued by the City Government ofVigan may be suspended, cancelled and awarded on the followingconditions:

a) Tricycle Franchise will be cancelled it found havingthree (3) violations in one (1) year.

1. Cancelled Tricycle Franchise holder cannot reapplyfor a tricycle franchise reapplying for a tricyclefranchise within a period of one (1) year from thedate of cancellation.

2. Cancelled tricycle franchise will be awarded to anapplicant preferably to a resident of Vigan.

3. Failure to renew franchise (2) months after itsexpiration will be automatically cancelled.

b) Canclled Tricycle Franchise will be awarded to anapplicant who is not a holder of any tricycle franchiseissued by the City Government of Vigan. Violationsincurred for the year 2003 onwards shall be covered inthis Article.

Ariticle VIII – Schedule of Fares

Section 72. There is hereby adopted the Schedule of Fares forTricycle – for – Hire Operating within the territorial jurisdiction ofVigan, Ilocos Sur from 5:00 AM to 8:00 PM. (Amended by Ordinance No.01, Series of 2011 – See Appendices)

Section 73. Scope and Limitations – the schedule of fares shallbe as follows:

a) Poblacion to Nagsangalan, Capangpangan, San Julian Norte, SanJulian Sur, Tamag, San Jose, Ayusan Sur, Ayusan Norte, Paoa,Bulala, Pantay Daya, Beddeng Laud, vice versa.

Fare shall be - P8.00

Fare for Student/Senior Citizen (with ID) shallbe - P6.00

b) Poblacion to Rugsuanan, Purok a Bassit, Purok a Dackel,Cabraoan Laud, Cabaroan Daya, Camanggaan, Bongtolan,Cabalangegan, Pantay Fatima, Pong-ol, Beddeng Daya, Salindeg,Barraca, Paratong, vice versa.

Fare shall be - P9.00 Fare for Student/Senior Citizen (with ID) Shall be

Following Circumstances:

1. whenever he is in imminent danger of being seriouslyharmed by any person or persons by reason of theaccident:

2. whenever he reports the accident to the nearest policestation or any public officer charged in the enforcementand maintenance of peace and order;

3. Whenever he has to summon a physician or nurse to aid thevictim.

Chapter SIXFinal Provisons

Article I – General Penal ProvisionsSection 85. Penalties

a) For Violation of any of the provisions stated in Chapter TwoArticle I to X, there is hereby imposed a penalty as follows:First Offense – Five Hundred Pesos (P500.00)Second Offense – Seven Hundred Fifty Pesos (P750.00)Third Offense – One Thousand Pesos (P1, 000.00) andcancellation of the Mayor’s permit:

g) For Violation of the provisions stated in Chapter ThreeArticle III, there is hereby imposed a penalty of fine of FiveHundred pesos (P500.00) or an imprisonment of one (1) day tothirty (30) days or both at the discretion of the court. Ifthe violator is a juridical person, a fine of Two ThousandFive Hundred pesos (P2,500.00), and shall be a ground for thecancellation of the mayor’s permit and MTOP (franchise);

h) For Violation of the provisions stated in Chapter ThreeArticle IV, there is hereby imposed a penalty as follows:

Impounding of the sidecar for an indefinite period until allgovernment requirements for a tricycle – for – hire shall have beenpaid. Provided, however that in case the limitations on the number ofTFHs shall no longer allow such CTFH to be granted a permit and afranchise, the owner / operator shall sign and submit a duly notarizedaffidavit indicating a pledge that the same owner – violator shallcease and desist from operating any CTFH, unless otherwise grantedwith government permit and franchise here for at some future date andopportunity and within the limits prescribed by the ordinanceaforementioned.

A minimum impounding period with corresponding fees shall be metedaccording to the following:

i) For the violation of the provisions stated in Chapter Three ArticleV and Article VI, there is hereby imposed a penalty of Five Hundredpesos (P 500.00);

j) For the violation of the provision stated in Chapter Four ArticleII, there is hereby imposed a penalty of One thousand pesos (P 1,000.00);

K) For the violation of the provision stated in Chapter Five, there ishereby imposed a penalty of Five Hundred Pesos (P 500.00)

If the violations is committed by any juridical entity, thePresident, General Manager, of any person entrusted with theadministration thereof at the time of the commission of the offenceshall be held responsible or liable thereof.

SECTION 86. Imposition of Penalty. Any person who commits anoffence which is punishable under the provisions of this article butnot punishable under R.A 4136 as amended, shall be penalized onlyunder the provisions hereof. If the offence committed is punishableboth under the provisions of this Article and that of R.A. 4136, asamended, it shall be prosecuted only under either but not in both,otherwise the offender will be twice put in jeopardy of punishment forthe same offence which is prohibited under Section 21, Article III ofthe Philippine Constitution.

Section 87. Penalty for Other Offences - The conviction of anyperson for any offence under this Chapter shall not bar hisprosecution for any other offences which may have been committed bysuch person concurrently with the commission of the offence for whichhe was convicted or in doing the act of series of acts whichconstituted for which he was convicted.

Section 88. –Voluntary Payment of Administrative Fine. Any personcaught violating any of the provisions of this Code May voluntary payat the Treasurer’s Office. The administrative fine as the provided forin the Section 85 of the Code in settlement of the penalty for thecorresponding violation, provided that the conditions hereunder statedare complied with:

1. The offence committed does not involve fraud.

2. the payment of the penalty of fine shall not relieve theoffender from the payment of the corresponding tax, fee or chargedue from him as provided under existing tax ordinance;

3. No other third party shall be adversely affected by thevoluntary payment of fine.

THIRD CITY COUNCILORDINANCE NO. 18Series of 2008

SECTION 1. Section 1 of Ordinance No. 6 Series of 2008 is herebyamended to wit; the following shall be the revised schedule offares for tricycles for hire within the territorial jurisdictionof the City of Vigan during daytime from five o’clock in themorning to eight o’clock in the evening.

1.1 Poblacion to Nagsangalan, Capangpangan, San JulianNorte, San Julian Sur, Tamag, San Jose, Ayusan Sur, AyusanNorte, Paoa, Bulala, Pantay Daya, Beddeng Daya, Salindeg,Barraca,Paratong, vice versa.

Fare shall be -P9.00

Fare for Students/Senior Citizens (with I.D) shall be- P7.00

1.2 Poblacion to Rugsuanan, Purok a Bassit, Purok a Dackel,Cabaruan Laod, Cabaruan Daya, Camanggaan, Bungtolan,Cabalangegan, Pantay Fatima, Pong-ol, Beddeng Daya,Salindeg,Barraca, Paratog, vice versa.

SECTION 3. REPEALING CLAUSE

All ordinances, rules and regulations or any part thereoffound in conflict or inconsistent with any provisions of thisordinance are hereby repealed and modified accordingly.

SECTION 4. EFFECTIVITY

This ordinance shall take effect upon approval andpublication in any local publication.

Enacted on FEBRUARY 7, 2011.

Assessments:

Some of the drivers are choosing their passengers to limit their gas

consumption and ask for a higher fare to gain more profit or by the

gas consumption of the destination.

Hypothesis:

Therefore conclude that all the tricycle here in Vigan must be all

require for register to make sure travel here whatever they go. They

must follow the Ordinance that had made and pay for the violence and

penalties. They must not ask for a higher fare to make it sure they

will not report to the municipality.

Research Design:

The research used is the answer the question by yes or no and to check

the level of the fair on different destination to gather the fact by

surveying.

The respondents of the study are the Tricycle Drivers in Vigan City

and the Students commuters in Vigan City

researcher to know what is needed. There are two sets of questionnaire

answered by the Tricycle Driver and Students. There is 3 parts of

questionnaire in Tricycle Driver the 1st part is the personal profile

of the respondent, 2nd part to answer the question by YES or NO and the

3rd part is to know the level of fare they ask for student. In the

questionnaire for students there is two parts in 1st part is the

personal profile of the respondent and the 2nd part to know the level

of fair had ask to them.

Interpretation Analysis

On table 1.0 data gathered most of the Tricycle Driver in Vigan at the

age of 51 – 60 years old has the percentage of 32% follows 31 – 40

years old and 41 – 50 years old at the percentage of 24% and 21 – 30

years old at the percentage of 8% and most of them had been married

have the percentage of 80% and 16% for the Single and 4% for the

widowed.

On table 1.2 data gathered 64% percent said Yes and 36% said No if

they choose their passenger according to distance of destination. And

in the next question if they asking for the higher amount of fare if

the destination is far has the percentage of 60% said Yes and 40% said

No and the next question 60% said No and 40% said Yes if they ask for

a higher amount of fare if the passenger is only one.

On the table 1.3 data gathered the most fare asked from Poblacion to

different Barangay in VIgan City is P11 – 20 have the percentage of

40.9% and followed by P5 – 10 has the percentage of 37.16% and P21 –

30 have the 17.81% and have the less percentage is P31 – above has the

4.13%

On table 2.0 data gathered by the questionnaire most of the student

have 68% of Female and 32% for the Male most of them at the age of 18

– 19 years old in the percentage of 52% and 24% for 20 – 21 years old

followed by 16 – 17 years old in the percentage of 20% and 22 – 23

years old have only 4%.

On table 2.2 data gathered to know the level of fare of the student

from Poblacion to different Barangay of Vigan City. The highest amount

of fare is P11 – 20 have 57.55% and followed by P5 – 10 had the

percentage of 23.22% and P21 – 30 have the percentage of 17.55% and

P31 – above have only 1.68%

Conclusions:

Based on the findings of the study, the following conclusions were

drawn.

1. The Tricycle Driver in Vigan City had the minimal no. that is

choosing their passenger according to distance of destination.

And they are asking for higher amount of fare if their

destination is far. Some of the Tricycle drivers are not

following the Ordinance of the City.

2. The Student and Tricycle driver are having the same level of the

amount of fare. According to data most of the drivers are not

following the amount of fare that has been made in the Ordinance

of the City.

Recommendation:

From the findings and conclusions draw in this study, the researchers

recommend:

The Ordinance of the City should be strengthened particularly to the

students who are in budget their allowance and the Penalty must be

increase so that the Drivers are afraid to dis obey the ordinance and

having a site or free text to report who is dis-obeyed the ordinance.
