PURPOSEOF : CONSTRUCTION OF MEDICALACQUISTION COLLEGE IN VILLAGE SAYLI.

INTRODUCTION:

These proceedings are under provision of Section 23 of the Right to

Fair Compensation and Transparency in Land Acquisition, rehabilitation and

Resettlement Act, 2013 for determination of compensation in respect of net

area of land proposed to be acquired admeasuring 4985 Sq.mt. for

Construction of Medical College in village Sayli, Da&a and Nagar Haveli. The

land acquisition proceedings were initiated with the publication of

Preliminary Notilication under section 1 1 of the Right to Fair Compensatiorr

and Transparenry in Land Acquisition, rehabilitation and Resetflement Act,

2013.

The Dtector, Medical and Health Services had submitted a lartd

acquisition proposal for Construction of Medial college in village Sayli, Dadra

and Nagar Haveli.

2. PUBLICATION OF NOTIFICATION AND ISSUE OF NOTICES:

S R Asia, Ghaziabad was notified u/s 4 of the Right to Fair

Compensation and Transparency in Land Acquisition, Rehabilitation and

Resettlement Act, 2013 for conducting Social Impact Assessment (SIA) study

vide no. L,i{Q/Med-coll/P.tl26l2ol8 /319 /2019 dated 15.O6.2O19. S R Asia

submitted a draft SIA report and a public hearing was conducted in Sayli

Panchayat on 09.08.2O19 at 10:30 am. Final SIA report was submitted by S

R Asia on 13.08.2019. The SIA report was then submitted to the Multi-

Disciplinary Expert Group for appraisal constituted vide notification no.

LAQ/ RFCTLARR/ ExpertGroup I 9 / 20 18 I 62 / 123 / Rev(S) dated 26.03.20 la.The Multi-Disciplinary Expert Group submitted its Recommendation.

The SLA report and the recommendation of Multi-Disciplinary Expert

Group was tJlen approved by the Appropriate Govemment i.e. Honble

Administrator, Dadra & Nagar Haveli and Daman & Diu and a Preliminary

Notification no. l,AQ/Med-Co11 lP.I/26 /2018 /461lRev(S)/2O 19 dated

26.09.2019 was issued u/s I I of the Act stating that the land described in

the schedule thereto (thereafter referred to as the said land/lands) was

needed or likely to be needed for the public purpose. The notification was

issued for inviting objections within 60 days, authorizing Survey and

Settlement Officer and his stalf for conducting survey u/s 12 of the Act. The

Resident Deputy Collector (Silvassa) was also appointed as Administrator for

Rehabilitation and Resettlement.

Since, No objections were received, Appropriate Government i.e.

Administrator, Dadra & Nagar Haveli and Darnan & Diu, Silvassa granted

approval to proceed with acquisition process. Resident Deputy

Collector(Silvassa) / Administrator for Rehabilitation and Resettlement vide

LAQ/Med-Coll /P.l/2612018/558/Rev(S)/ 19 dated,27.11.2O 19 submitted draft

scheme for Rehabilitation and Resettlement Scheme u/s 16 of the Act.

Objections were heard during public hearing on draft scheme in Sayli

Panchayat on 18.12.2O19. After complete verification of the objections, final

report/ recommendation was submitted by the Administrator for Rehabilitation

and Resettlement/ Resident Deputy Collector (Silvassa). The same was

approved by the Commissioner for Rehabilitation and Resettlement/ Advisor to

Hon'ble Administrator, Dadra & Nagar Haveli and Daman & Diu.

Further, on approval of Appropriate Government i.e. Honble

Administrator, Dadra & Nagar Haveli and Daman & Diu, Declaration u/s 19 of

the Act was issued vide No. LAQ/Med-Coll |P.I/2612OL8182 /Rev(Sl /2O2O

dated O4.03.2O2O stating that the said lands were required for the public

purpose narnely for the Construction of Medical College in village Sayli.

In connection with acquisition of total land admeasuring 4985 sq.mt. for

Construction of Medical College in village Sayli, Dadra and Nagar Haveli, tJre

Administration of Dadra & Nagar Haveli and Daman & Diu intended to takepossession of the land, the particulars of which were given in the declaration

u/s 19(1) of the Right to Fair compensation & Transparency in Land

Acquisition Rehabilitation and Resettlement (RFCTLARR) Act, 2013.

To facilitate causation of the above requirements, Notice no. LAQ/Med-

Coll/P.l/26 /20 18/83/Rev(S)/ 2O2Q dated 04.O3.2O2O was served undersection 2l of the RFCTLARR Act, 2013 stating that a.ll persons having interest

in the said land may submit their objections within 30 days and may appear

personally or by agent or advocate before the Collector, Dadra and Nagar

Haveli on 02 /04 l2O2O at I 1:00 am.

Under Section 2l of the RFCTLARRAct,2Ol3, the Government intended

to take possession of the land in 3O days from the date of issue of the Notice

and claims to compensations and rehabilitation and resettlement for all

interests in the land, had to be submitted to the Collector for disposal within

30 days from the date of issue of the Notice. No objections in ttris regard is

received till date.

4. JOINT MEASI'REMENI

The Collector, Dadra and Nagar Haveli had directed for joint

measurement of the land through the Survey and settlement Department. The

joint measurement of land was carried out by Survey and Settlement

Department along with officials of PWD-I(Building), Silvassa' The valuation of

damage structure and trees were submitted by PWD-I (Building) ald Forest

Department resPectivelY.

6. SITUA?ION AND DISCRIPTION OF THE LIIND

The l-and under acquisition is agriculture as well as non-agriculture

lands and situated in Sayli village of Dadra and Nagar Haveli.

7. LOCATION OF THE LAND

The total acquired land admeasuring 4985 Sq.mt. situated in Sayli

village of Dadra ald Nagar Haveli.

8. VALUATION THE LAND

The principal for assessing the amount of compensation to be awarded

has been laid down under section 26 (1) of the Right to Fair Compensation and

Transparenry in Land Acquisition, Rehabilitation and Resettlement Act, 2013

and accordingly the market value of the land was determined for further

determination of Compensation.

9. TION OF ON

As per the provision of Section 30 of the Right to Fair Compensation andTransparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013,1o0% of the compensation Amount (includes market value of land multipliedby Multiplication Factor) is to be awarded as Solatium as has been determinedin the Awa-rd statement.

The compensation of land is to be paid to land interested persons. Thetotal amount of award has been worked out to be Rs. 615616grg17/- (RupeesSix Crore Fifty Six Lakh Sixty Eight ?housand Eight Hundred Seventeen only).77-

name of Medical and Heatth Services/ shri Sarkar Hastak Road consequent to

taking over possession of tJle said land and the payment of the compensation

to the concerned interested parties'

14. CORRECTIONS OF THE RECORD IN THE RDCORD OF RIGHTS

The Marnlatdar, Silvassa shall carry out necessary mutation in the

Records of Rights in the name Medical and Hea-lth Services/ Shri Sarkar

Hastak Road in respect of the larrd so acquired as per the enclosed Award

statement.

Survey and Settlement Oflicer, Silvassa shall allot separate numbers to

the acquired larrd and a-lso make necessary changes on the official map.

Pa5rment will be made according to the latest entries in the Revenue

Record. In case of any dispute, which is not settled within reasonable time, the

arnount of compensation will be remitted to the Court under section 64 of theRight to Fair Compensation and Transparency in Land Acquisition,Rehabilitation and Resettlement Act, 2013 for jurisdiction.

The land under acquisition is free from all encumbrance sand it hasbeen mentioned in the Award statement.
