1. Sau khi co k~t qua danh gia sa bQnang hrc, kinh nghiem cua cac nha d~utu, So' KH&DT dang tai danh sach nha d~u tu dap irng yeu c~u tren H~ thongmang dftu th~u quoc gia.

2. Truong hop chi co mot nha d~u tu dap ling yeu c~u, tnroc khi dang taithong tin thea quy dinh tai khoan 1 Muc nay, So' KH&DT bao cao Chu tich Oyban nhan dan cftp tinh xem xet, quyet dinh thea mot trong hai plnrong an sau day:

a) Phuong an 1: Thong bao va huang dftn nha d~u tu nQPh6 sa trinh quyetdinh chu tnrong d~u tu thea quy dinh cua phap lu~t vS d~u tu, phap lu~t khac colien quan thea quy dinh t~i khoan 5 DiSu 13Nghi dinh s6 25/2020/ND-CP.

Department of Planning and Investment of Bac Lieu province would like toinvite the interested investors to submit the application for registration of projectimplementation of Green Park New Urban Area, Ward 8, Bac Lieu City, with thefollowing information:

1. Investment objective and investment scale of the project:

1.1. Investment objective:_ Invest in building a new residential area synchronously in term of social

and technical infrastructure, meet the living needs of urban residents, converge thehigh-quality human resources, and ensure the quality of living environment for theexisting residents. Harmoniously connect with the urban landscape architecturesystem of the neighboring functional areas and the technical infrastructure system.

_ Form a new urban area to contribute to the implementation of socio­economic development in the process of economic restructuring from agricultureto industry and services. Create conditions for exploitation and promotion of thevalue and role of urban roads in the economic development.

2. Project information:2.1. Investment objective:

- Invest in building a new residential area synchronously in terms of socialand technical infrastructure, meet the living needs of urban residents, convergethe high-quality human resources, and ensure the quality of living environmentfor the existing residents. Harmoniously connect with the urban landscapearchitecture system of the neighboring functional areas and the technicalinfrastructure system.

Section 2. PRELIMINARY REQUIREMENTS ON CAPACITY ANDEXPERIENCE OF THE INVESTORS

Preliminary requirements on capacity and experience of the investorsinclude requirements on financial capacity and experience. Detailed content isaccording to Chapter II.

Section 3. CLARIFYING PRELIMINARY REQUIREMENTS ONCAPACITY AND EXPERIENCE OF THE INVESTORS

1. In case the investor wants to have their preliminary requirementsclarified on capacity and experience, the investor must send a request forclarification to Department of Planning and Investment in writing or through thenational bidding network system at least 05 working days before the deadlinedate for submitting project implementation registration documents forconsideration and handling.

2. After receiving the written request for clarification within theprescribed time limit, the Department of Planning and Investment shall clarifyand post it on the National Bidding Network System within at least 02 workingdays before the deadline date for submitting project implementation registrationdocuments, in which describing the content requested for clarification but not

name the investor requesting for clarification. In case the clarification leads tothe modification of preliminary requirements on capacity and experience, theprovisions in Section 4 of this Chapter shall be followed.

Section 4. AMENDING PRELIMINARY REQUIREMENTS ONCAPACITY AND EXPERIENCE OF THE INVESTOR

1. In case of modification of the preliminary requirements on capacity andexperience, the Department of Planning and Investment shall post it on thenational bidding network system and decide to amend it together with therevised contents before the deadline date for submitting project implementationregistration documents at least 10 days.

2. In case the time for notification of modification of preliminaryrequirements on capacity and experience does not meet the requirements atSection 4.1, the Department of Planning and Investment shall implement thecorresponding deadline for submitting the application for registration of projectimplementation to ensure compliance with regulations mentioned above. Theextension shall be complied with the provisions of Section 6.3.

Section 5. LANGUAGE IN USEThe application for registration of the project implementation and all

documents and papers discussed between Department of Planning andInvestment and the investors related to this interest invitation must be written inthe following language: Vietnamese.

Section 6. APPLICATION FOR REGISTRATION OF PROJECTIMPLEMENTATION AND DEADLINE FOR SUBMISSION

1. The application for registration of project implementation prepared bythe investor must include the forms and relevant documents as prescribed inChapter III.

2. The investors shall submit the application for registration of projectimplementation to Department of Planning and Investment of Bac Lieu provincebefore: ..... o'clock, day..... month .....year 2021;

3. Department of Planning and Investment may extend the time forsubmitting the application for registration of project implementation in case thepreliminary requirements for investor's capacity and experience are modified asprescribed in Section 4 of this Chapter, need to increase number of investors asprescribed at point b, clause 2, Section 9 of this Chapter or other necessarycases. Upon extension, the Department of Planning and Investment shall notifyon the National Bidding Network System and send a notice to all investors whohave submitted the application for registration of project implementation (if any)on the deadline for submitting the application for registration of projectimplementation.

Section 7. AMENDING AND REPLACING THE APPLICATIONFOR REGISTRATION OF PROJECT IMPLEMENTATION

After submission, the investors can replace or amend the application forregistration of project implementation by submitting additional relevantdocuments and papers on the National Bidding Network System before thedeadline date for submitting the application for registration of projectimplementation.

Section 8. CLARIFYING THE APPLICATION FORREGISTRATION OF PROJECT IMPLEMENTATION

The investor is responsible for clarifying the application for registration ofproject implementation at the request of Department of Planning andInvestment. All requests for clarification and investor's feedback are made onthe National Bidding Network System.

Section 9. NOTICE OF THE RESULTS OF PRELIMINARYASSESSMENT ON CAPACITY AND EXPERIENCE OF THEINVESTORS

1. After having the results of preliminary assessment on capacity andexperience of the investors, the Department of Planning and Investment shallpost the list of qualified investors on the National Bidding Network System.

2. In case only one investor meets the requirements, before publishinginformation as prescribed in clause 1 of this Section, the Department of Planningand Investment shall report to the Chairman of the Province People's Committeefor consideration and decision according to one of the following two options:

a) Option 1: Notify and guide the investor to submit the application fordecision on investment policy in accordance with the provisions of the law oninvestment and other relevant laws as prescribed in cause 5, Article 13 of DecreeNo. 25/20201ND-CP.

b) Option 2: Extension of time for project implementation registration.The extension time is decided by the Chairman of the Province People'sCommittee and will be announced on the National Bidding Network System.The Investors who have met the requirements will not have to resubmit theapplication for project implementation registration.

After the extension, if there are more investors who have met thepreliminary requirements on capacity and experience, the clause 3 of thisSection shall be applied. If there are no more investors who have met thepreliminary requirements on capacity and experience, the provisions of point aof this clause shall be applied.

3. In case there are two or more qualified investors, the selection ofinvestors will be carried out in the form of open bidding as prescribed at point a,clause 4, Article 13 of Decree No. 25/2020 IND-CP. Bidding documents arewidely released to investors, including investors outside the list of investors whohave met the preliminary requirements on capacity and experience.

The investor who submits the preliminary application for capacity andexperience registration commits to bear all costs and risks if the project is notapproved by the competent authority for project implementation.

Note:(1) Based on the scale, nature and field of the project, other financial

indicators may be adjusted or added such as: net asset value, revenue, profit,...In case the investor is a newly established organization in the year, the financialcapacity of the investor is assessed on the basis of financial statements auditedby an independent audit unit from the date of establishment to before thedeadline date of submitting application for project implementation registrationup to 28 days.

(2) The investor's equity is determined on the basis of the investor'sfinancial data updated within a maximum period of 28 days before the deadlinedate of submitting application for project implementation registration andcommitments to equity mobilization of the investor. Investor must declareinformation and provide documents on financial capacity according to attachedFormNo. 02.

- Investor's remaining equity =Total equity - Litigation-related expenses -the committed equity for ongoing projects and other long-term investments (ifany) - the retained equity as prescribed (Equity used exclusivelyfor allocation oraccording to the legal requirements setforth for the Investor; the retained equityaccording to the special provisions for possible cases; the other equity iscommitted to be refunded and not usedfor dividend declarations, etc.).

(3) For projects in a new field or with a large investment scale, there is noinvestor with experience in implementing similar projects, we may consider,based on the data on the implemented projects, the ability of investmentdivergence of the project under consideration to determine the investor'sexperience requirements.

In this case, the investor's experience requirements can be adjusted to belower than the guideline but must be consistent with the reality as well as theproject implementation requirements. In addition, during the review andassessment process, the investor must ensure that the investor has sufficientfinancial and technical capacity to implement the project. The projectimplementation requirements in the bidding documents as well as the contract

must ensure full provisions of the investor's responsibilities as well as handlingmeasures (sanctions, compensation for damage, and handling in the nextperiod). In case the investor implementing the project does not meet therequirements on progress and quality. And, the competent person may stipulatethat the contract performance security value is greater than 3% but not morethan 10%of the total investment capital of the project.

(4) Investor is only allowed to cite their experience in implementing asimilar project once.

Partners to jointly implement the project include: Financial providers;Building contractors; Operation and management contractor.

Method of converting projects: project of type 2 is equal to 0.5 project oftype 1, and project of type 3 is equal to 0.5 project of type 1; In case the numberof converted projects is odd, the rounding according to the principle from 0.6 ormore will be counted as 01 project.

(5); (6); (7); (8) For projects that have not yet clearly determined the totalinvestment value in the approval documents and project contracts, the investormust provide supporting documents to determine this value.

Based on the Circular No. 03120211TT-BKHDTdated April 09, 2021 of the Ministryof Planning and Investment, stipulating the form of documents and reports related toinvestment activities in Vietnam and investment from Vietnam to abroad and investmentpromotion;

Based on the Decision No. 278IQD-UBND dated June 22, 2021 of the ProvincePeople's Committee approving the investment policy of the Green Park New Urban AreaProject, Ward 8, Bac Lieu City;

Considering the proposal of the People's Committee of Bac Lieu City at Report No.159ITTr-UBNDdated June 29, 2021; Director of Department of Planning and Investmentat Report No. 60ITTr-SKHDT dated July 16, 2021 and Official Letter No. 10111SKHDT­KTDN dated July 21, 2021.

PEOPLE'S COMMITTEE OF BAC LIEU PROVINCE

DECIDED:Article 1. To approve the preliminary requirements on capacity and experience of the

Investor registering implementation of project of Green Park New Urban Area, Ward 8, BacLieu City (details in the attached Appendix).

Article 2. Director of Department of Planning and Investment to implement thefollowing contents:

1. Announce the list of projects according to the provisions of point c, clause 1,clause 4 of Article 4 and clause 2, Article 5 of Decree 25/2020/ND-CP dated February 28,2020 of the Government detailing the implementation a number of articles of the BiddingLaw on investor selection (amended and supplemented at clause 5, Article 108 of DecreeNo. 31120211ND-CPdated March 26, 2021 of the Government detailing and guiding theimplementation of a number of articles of the Law on Investment).

2. After the term for registration of project implementation is expired, Department ofPlanning and Investment shall organize a preliminary assessment on capacity andexperience of investors who have submitted the application for project implementationregistration on the National Bidding Network System.

3. Based on the results of preliminary assessment on capacity and experience of theinvestors who have submitted the application for project implementation registration,Department of Planning and Investment shall advise and submit to the Chairman of theProvince People's Committee for decision on organization of next steps implementation asprescribed by law.

Article 3. Chief of Office of Province People's Committee; Director of Departments:Planning and Investment, Finance, Construction, Natural Resources and Environment,Agriculture and Rural Development, Chairman of Bac Lieu City People's Committee, Headof relevant agencies and units, base this decision for the execution.

This Decision takes effect from the date of signing.

The investor who submits the preliminary application for capacity and experienceregistration commits to bear all costs and risks if the project is not approved by thecompetent authority for project implementation.

Note:(1) Based on the scale, nature and field of the project, other financial indicators may

be adjusted or added such as: net asset value, revenue, profit, ... In case the investor is anewly established organization in the year, the financial capacity of the investor is assessedon the basis of financial statements audited by an independent audit unit from the date ofestablishment to before the deadline date of submitting application for projectimplementation registration up to 28 days.

(2) The investor's equity is determined on the basis of the investor's financial dataupdated within a maximum period of 28 days before the deadline date of submittingapplication for project implementation registration and commitments to equity mobilizationof the investor. Investor must declare information and provide documents on financialcapacity according to attached Form No. 02.

- Investor's remaining equity = Total equity - Litigation-related expenses - thecommitted equity for ongoing projects and other long-term investments (if any) - theretained equity as prescribed (Equity used exclusively for allocation or according to thelegal requirements set forth for the Investor; the retained equity according to the specialprovisions for possible cases; the other equity is committed to be refunded and not usedfordividend declarations, etc.).

(3) For projects in a new field or with a large investment scale, there is no investorwith experience in implementing similar projects, we may consider, based on the data on theimplemented projects, the ability of investment divergence of the project underconsideration to determine the investor's experience requirements.

In this case, the investor's experience requirements can be adjusted to be lower thanthe guideline but must be consistent with the reality as well as the project implementationrequirements. In addition, during the review and assessment process, the investor mustensure that the investor has sufficient financial and technical capacity to implement theproject. The project implementation requirements in the bidding documents as well as thecontract must ensure full provisions of the investor's responsibilities as well as handlingmeasures (sanctions, compensation for damage, and handling in the next period). In casethe investor implementing the project does not meet the requirements on progress andquality. And, the competent person may stipulate that the contract performance securityvalue is greater than 3% but not more than 10%of the total investment capital of the project.

(4) Investor is only allowed to cite their experience in implementing a similar projectonce.

Partners to jointly implement the project include: Financial providers; Buildingcontractors; Operation and management contractor.

Method of converting projects: project of type 2 is equal to 0.5 project of type 1, andproject of type 3 is equal to 0.5 project of type 1; In case the number of converted projects isodd, the rounding according to the principle from 0.6 or more will be counted as 01 project.
