THAT, aware that devolution was meant to devolve governance and public services across the country, including access to basic services like acquisition of identity cards, passports, birth certificates, voters cards, among others; further noting that currently all registration of national identity cards only happens at one centre in Nairobi; cognizant of the fact that this delays the acquisition of identity cards, thus denying Kenyans their right to employment, ability to vote, access to public funds like Uwezo Fund and other crucial services, this House resolves that the Government decentralizes the registration of national identification cards and passports to the county level to expedite the process and allow Kenyans to access public services in a timely manner.

THAT, aware that Article 54 (c) of the Constitution provides that a person with disability is entitled to reasonable access to all places, public transport and information; further aware that Section 21 of the Persons with Disability Act, 2003 provides that persons with disabilities are entitled to a barrier-free and disability-friendly environment to enable them have access to buildings, roads and other social amenities, assistive devices and other equipment to promote their mobility; concerned that over the years, persons with disabilities have not been given the right to enjoy all their fundamental freedoms; cognizant of the fact that accessibility is vital in increasing the mobility of these individuals and reducing the ratio of dependency on people; this House urges that the Government develops a clear plan of action to ensure the necessary structural adjustments to all public buildings and that the National Construction Authority only approves designs for new public structures that are compliant with the minimum accessibility standards (KS 21542) for persons with disability.

THAT, aware that many learners with disabilities are not able to attend school due to various barriers such as, negative attitudes from the society, poverty and depravity; concerned that only 2% of learners with disabilities are enrolled in learning institutions as per research conducted by the United Nations Educational and Socio-Cultural Organization (UNESCO); noting that the completion rates of learners with disabilities from primary, secondary and university education remains low; cognizant of the fact that teachers of learners with disabilities require more time to teach students with disabilities than other children; mindful that they do this without due assistance whatsoever for

THAT, aware that there are many talents amongst the youth of this country; having noted that this talents have been severally displayed through various inventions and innovations by the youth in platforms such as the Science Congress and the Annual Youth Innovation Week; concerned, that most of these discoveries do not go beyond making sensational newspaper and electronic media stories; noting that most of these innovations are aimed at addressing the problems that afflict us as Kenyans on a daily basis; further concerned that there is inadequate enabling legislation and administrative measures to support these innovations; cognizant of the fact that the Kenya Vision 2030 seeks to make our country an industrialized middle-income economy in the next 14 years; aware of the immense potential for wealth creation and job opportunities that such innovations would generate if well-developed and commercialized; also recognizing that our imports are well in excess of Kshs. 1.3 billion shillings, a gap that would be narrowed if we had our own local production, this House urges the Government to support youth innovation by creating an

RECOGNIZING THAT, universal equal suffrage is a fundamental right recognizable under international law and enshrined under Article 38 of the Constitution of Kenya; recalling that voter registration is a crucial exercise in the electioneering process, and that to register as a voter, one requires a National Identification Card; noting that thousands of Kenyans are yet to be issued with Identification Cards due to the long and tedious process involved in the processing of these Cards and are still holding serialized waiting cards with serial numbers that also appear on the identity cards once issued; concerned that those Kenyans in possession of serialized waiting cards may miss out on the ongoing voter registration; cognizant that Section 5 sub-sections 3(A) and 3(B) of the Elections Act, 2011 requires the Independent Electoral and Boundaries Commission (IEBC) to register all Kenyans who have attained the age of eighteen (18) years, have applied for issuance of Identity Cards and are in possession of serialized waiting cards, pending issuance of the Identity Cards; now therefore, this House calls upon the Independent Boundaries and Electoral Commission to immediately allow all persons who were successfully vetted and issued with serialized waiting cards to register as voters in the ongoing and future voter registration exercises in accordance with Section 5 of the Elections Act, 2011.

aware that in Kenya, the disease ranks third among the main causes of death after infections and cardiovascular diseases and accounts for up to 18,000 deaths annually, with over 82,000 new cases reported annually; noting that over one-third of cancer patients experience clinical anxiety and depression, profoundly affecting the families psychologically and economically; cognizant of the fact that some of the patients travel up to 600 kilometers to Kenyatta National Hospital (KNH), the only public hospital that hosts most of the oncologists in Kenya; further cognizant of the fact the remaining small number of oncologists are mainly based in Nairobi; deeply concerned that only a few patients get admission or outpatient treatment due to monetary constraints; this House resolves that the Government mitigates the situation by offering scholarships to at least one (1) Medical Masters student per County to study oncology, and signing contractual agreements with them to serve in designated cancer treatment and management centres; building partnerships with existing medical institutions in local public universities for provision of training opportunities; and emphasizing on the use of telemedicine and E-Medicine to eliminate distance barriers and improve access to medical services.

THAT, aware that cattle rustling is a major menace and security threat in the South and North Rift regions and other regions in the country; noting that cattle rustling leaves behind destruction of property and loss of lives; deeply concerned that the menace has since left irreparable and negative socio-economic impact which include but are not limited to increased number of widows, widowers, orphaned children, defiled/rape victims, poverty, displacement of people leading to the emergency of Internally displaced persons (IDPS), disruption of educational programmes and other economic activities owing to the destruction and/or closure of educational, health and other institutions; deeply concerned that the people living in the affected regions have been denied the enjoyment of their social, economic and political rights as guaranteed to them under the Bill of Rights as enshrined in Chapter Four of the Constitution; this House urges that the National Government declares cattle rustling as a national disaster and establishes a Special Fund to be used in mitigating the losses suffered by and in compensating all victims of cattle rustling and resettle all Internally displaced persons across the country created by the menace.

have led to the general acidification of the soils and consequently drastic decline in food production per unit area; concerned that the current Government food security strategy is focused mainly on increasing food production through intensified use of traditional chemical fertilizers regardless of their type and long-term impact on the soils; aware that the Government plans to establish a fertilizer factory in order to fast-track the achievement of the said strategy; further aware that there is increasing use of organic rather than chemical fertilizers in food production; this House resolves that the Government formulates policies for undertaking of a comprehensive national soils survey to determine their current status which will then inform the types of remedial measures to be taken to improve soil fertility and what types of appropriate fertilizers can be used to sustainably improve the production of diversified food crops in different areas.

THAT, aware that the Government banned the importation of Genetically Modified Organisms (GMO) imports in 2012; further aware that the Ministry of Health which initiated the ban has consistently maintained that GMO foods are not safe for human and animal consumption; considering that no tangible evidence on the same has been provided; cognizant of the fact that local and international scientific institutions and stakeholders have consistently endorsed the use of GMO foods as a necessary measure for the present and future food security in the Country; concerned that the National Bio-Safety Authority (NBA) established under Bio-Safety Act was not involved in the decision to ban the use of GMO foods in the country; concerned that the Country continues to lose millions of shillings monthly in lost business opportunities related to GMO products; further concerned that research on bio-technology and bio-safety has stalled; this House Resolves to establish a

108 THAT, aware that the Kenya Police Medical Examination (P3) form is a legal document that is produced in a court of law as evidence in cases which involve body injury; noting that victims are required to have the P3 form completed by a certified public medical officer; further aware that the victims are charged a fee for this service by the hospitals attending to this particular service; concerned that most citizens are financially challenged hence the medical fee charged by the hospitals, is in contravention of Article 48 of the Constitution on access to justice; deeply concerned that if the situation is left unchecked, it may lead to continued abuse of the poor, delayed justice and possible incidents of unrest; this House urges the Government to ensure that completion of P3 forms is offered free of charge at all public healthcare facilities.

144 THAT, aware that the betting and gambling industry in Kenya has attracted a lot of public interest in the recent past, leading to its exponential growth; further aware that the services of betting companies like Sportpesa, Elibet, Betway, Betin Kenya and mCheza, among many others are now easily accessible via online and mobile platforms; deeply concerned that the industry is facing a myriad of challenges such as weak and insufficient regulatory and institutional frameworks, proliferation of betting and gambling activities and attendant negative societal impacts; also cognizant of claims of tax evasion, tax avoidance and money laundering in some of the betting, gaming and casino businesses; appreciating the fact that the Government has a role in strengthening the licensing and collection of tax revenues from the industry while ensuring its sustainability; further noting that although the Fourth Schedule of the Constitution has devolved the functions of betting and gambling to the county governments, Articles 95(2), 189(2) and 191(1) and (2) of the Constitution allow the national Government, through Parliament, to resolve issues of concern to the people and pass law to ensure uniformity of action across the country; mindful of the fact that in several developed jurisdictions, betting and gaming activities are regulated in the same manner as other financial

147 THAT, aware that incidences of buildings in public boarding secondary schools being torched by unruly students are on the rise; concerned that most perpetrators of the dastardly acts of arson in schools go unpunished due to the difficulty in establishing a nexus between them and the acts; deeply worried that students behind arson in various schools evade responsibility by seeking admission in other schools where they transfer similar vices; afraid that if left unabated, this trend will turn dormitories in public boarding secondary schools to death traps for innocent students and expose school properties to the risk of arbitrary destruction by riotous students; cognizant of the duty to preserve the lives of innocent students and school properties from the incessant threat of arson; appreciating the role of Information and Communications Technology (ICT) in enhancing security surveillance; this House urges that the Government speedily rolls out installation of Closed Circuit Television (CCTV) cameras in strategic locations in all public boarding secondary schools as an enhanced security mechanism for surveillance of students’ activities; makes provisions for regular and mandatory checks to confirm compliance and enforcement of the mechanism; and enforces strict admission criteria, including maintenance of a profile of alleged perpetrators of arson to ensure that they do not escape liability by

deeply concerned that the same National Health Report highlights that 2.6 million Kenyans fall into poverty every year due to the burden of medical expenses, this House urges the Government to provide National Hospital Insurance Fund (NHIF) cover to all Kenyans aged 65 years and above to reduce the heavy burden on families, increase the productivity of Kenyans, ensure healthy lives and promote well-being for Kenyans of all ages in line with the Sustainable Development Goals of the United Nations.
