PERSONAL ASSETS INSURANCE POLICY GENERAL SECTION (2/10) MAY 2011

Constantia Insurance Company Limited Reg. Nº 1952 / 001514 / 06 (the insurer) agrees to indemnify or compensate the insured by payment, replacement, reinstatement or repair (at the option of the insurer) in respect of the insured perils and defined events provided in terms of this policy during any period of insurance for which it accepts a premium.

The proposal and declaration made by the insured named in the schedule are the basis of and form part of this policy.

GENERAL SECTION

GENERAL DEFINITIONS

1. DEFINITIONS

a) You/your/yours/yourself means the insured named in the schedule, other insured(s) and/or other parties to whom cover in terms of the sections of this policy has been provided.

b) We/us/our means the insurer Constantia Insurance Company Limited.

c) The ‘Premises’, ‘Risk address’, ‘Insured Premises’ mean the physical address(s) as specified in the schedule.

d) Standard construction means buildings constructed with walls of brick, stone and/or cement roofed with slate, tile, cement or metal.

e) Anniversary date means the day, generally the 1st day of the month, not more than 12 months from the start date of the policy.

GENERAL PROVISIONS

1. INTERPRETATION

The schedule and any endorsements thereto and the policy wording shall be read together and any word or expression to which a specific meaning has been given in any part thereof shall bear such meaning wherever it may appear.

2. SUMS INSURED LEFT BLANK IN SCHEDULE

If the sum insured, limit of liability or benefit in the schedule is:

a) left blank or no amount is stated against it;

b) is shown as “nil” or “0”, as “N/A” or “not applicable”, as “not insured” or as “No” or “not included”

it means that the insurance cover, peril or circumstance as stated in the schedule is not insured or provided for by your policy.

3. DISCLOSURE PERMISSION GRANTED BY YOU

By taking out this policy, you have acknowledged that the sharing of claims and underwriting information (including credit information) by insurers is essential to enable the insurance industry to underwrite policies and assess risks fairly and to reduce the incidence of fraudulent claims, in the public interest and with the view to limiting premiums.

On your behalf and on behalf of any person that you represent herein, you hereby waive any right to privacy in any insurance information provided by you or on your behalf in respect of any insurance policy or claim made or lodged by you and you consent to such information being disclosed to any other insurance company or its agent.

You also acknowledge that the information provided by you may be verified against other legitimate sources or databases.

You also waive any rights of privacy and consent to the disclosure of any information relevant to any insurance policy or claim concerning you.

GENERAL CONDITIONS

1. COMPLIANCE WITH TERMS AND CONDITIONS OF THE POLICY

Unless you have complied with all policy terms and conditions we will not accept any liability under this insurance.

2. CARE OF ITEMS INSURED - PREVENTION OF LOSS

You must take all reasonable precautions to prevent loss or damage, accidents and bodily injury. You should make reasonable emergency repairs, as provided for in terms of Section 10 – Assistance – Service Programmes of this policy, to your property to prevent further damage.

3. FRAUD

If any claim in terms of this policy is in any respect fraudulent or if any fraudulent means or devices are used by you or anyone acting on your behalf or with your knowledge or consent to obtain any benefit under this policy or if any event is caused or contributed to by the wilful act or with your connivance the benefit afforded under this policy in respect of any such claim shall be forfeited.

4. MISREPRESENTATION, MISDESCRIPTION AND NON-DISCLOSURE

We may declare this policy or any part of it as void or voidable and of no binding effect if details provided by you or on your behalf, whether requested by us or not, which affect the terms of acceptance or continuation of any risk by us are not disclosed or are misrepresented or not fully and accurately described or if you do not advise us of any change in the risk.

5. MORE THAN ONE POLICY

If, at the time of any event giving rise to a claim under this policy, insurance exists with any other insurers covering the insured against the insured events, the company shall be liable to make good only a rateable proportion of the amount payable by or to the insured in respect of such event. If any such other insurance is subject to any condition of average, this policy, if not already subject to any condition of average, shall be subject to average in like manner.

6. NO RIGHTS TO OTHER PERSONS

Unless otherwise provided, nothing in this policy shall give any rights to any person other than the insured. Any extension providing indemnity to any person other than the insured shall not give any rights of claim to such person, the intention being that the insured shall claim on behalf of such person. Payment to you shall in every case be a full discharge by us.

7. CLAIMS PROCEDURE, REQUIREMENTS AND CONDITIONS

a) If an event giving rise to or likely to give rise to a claim comes to your knowledge you must, at your own expense, notify us within 30 (thirty) days and as soon as practicable provide to us:

i) written details of the event ii) such proofs, information and sworn declarations we may require from time to time iii) any document or details of any communication received in connection with a claim iv) particulars of other insurance covering the same event.

b) No admission, statement, offer, promise, payment or indemnity may be made or accepted by you without our written consent.

c) The theft or loss of, or malicious damage to any insured property including all motor vehicle accidents must be notified to the police immediately.

d) If repairs have not commenced within 60 (sixty) days after authorisation by us due to your actions, all benefits in respect of such claim will be forfeited unless otherwise agreed in writing by us.

e) We may take over and conduct the defence or settlement of any claim and have the right to use your name for this purpose.

f) You must give all information, documentation and assistance required by us to obtain indemnity from other parties.

g) You must notify us immediately you become aware of any impending prosecution or inquest or any other legal action in respect of any event which may give rise to a claim.

h) i) If we reject a claim or dispute the quantum of any claim made under this policy you must make representations to us within a period of 90 (ninety) days after the date of receipt of the notice of rejection or dispute.

ii) You have 6 (six) months after expiry of that 90 (ninety) day period for the institution of legal action, failing which we will be relieved of liability.

i) We will not be liable under more than one section of this policy in respect of liability, loss or damage arising from the same event in respect of the same liability, loss or damage.

j) In respect of any section of this policy under which an indemnity is provided for liability to third parties, we may, upon the happening of any event, pay you the limit of indemnity provided in respect of such event or any lesser sum for which the claim or claims arising from such event can be settled and we shall thereafter not be under further liability in respect of such event.

k) If, after payment of a claim in respect of lost or stolen property, the property (the subject matter of the claim) or any part thereof is located, you will render all assistance in the identification and physical recovery of such property if called on to do so by us, provided that your reasonable expenses in rendering such assistance will be reimbursed by us. Should you fail to render such assistance in terms of this condition when called upon to do so, you will immediately become liable to repay us all amounts paid in respect of the claim.

l) In the event of a claim for which we become liable to provide indemnity for the maximum amount payable under any item(s) or section of the policy, no refund of premium for the unexpired period of insurance will be made.

8. OUR RIGHTS AFTER AN EVENT

On the happening of any event in respect of which a claim is or may be made under this policy, we and every person authorised by us may, without thereby incurring any liability and without diminishing our right to rely upon any conditions of this policy:

a) Take or keep possession of or enter any damaged property and deal with it in any reasonable manner. This condition shall be evidence of your leave and licence to us to do so. You shall not be entitled to abandon any property to us whether taken possession of by us or not.

b) Take over and conduct in your name the defence or settlement of any claim and prosecute in your name for our own benefit any claim for indemnity or damages or otherwise and shall have full discretion in the conduct of any proceedings and in the settlement of any claim. No admission, statement, offer, promise, payment or indemnity shall be made by the insured without our written consent.

c) You will, at our expense, do and permit to be done all such things as may be necessary or reasonably required by us for the purpose of enforcing any rights to which we shall be, or would become, subrogated upon indemnification of you whether such things shall be required before or after such indemnification.

9. REINSTATEMENT OF SUM INSURED AFTER A CLAIM

The sum insured will not be reduced by the amount of any claim. We may request you to pay a premium on the amount of the claim from the date of the loss or damage to the expiry of the period of insurance.

This condition applies separately and only to:

a) Section 1 - Buildings

b) Section 2 - Contents

c) Section 4 - All Risks – Unspecified Items

10. FIRST AMOUNT PAYABLE

Except where provided for specifically in any section, the amount payable under this policy/section for each and every loss, damage or liability shall be reduced by the first amount payable shown in the schedule for the applicable defined event.

11. CANCELLATION

This policy or any section may be cancelled by:

a) You at any time in writing and we will be entitled to retain the short period premium or minimum premium.

b) Us by giving the requisite notice to you in writing at your last known or nominated address and we will retain a short period premium. Notice shall be deemed to have been received by you after 10 days of the dispatch of the notice unless proven by you to the contrary.

12. PREMIUM PAYMENTS

a) If you put a stop payment on your premium this policy will automatically be cancelled from the date that the premium was due to be paid.

b) We may decide to change the amount of premium payable under this policy at any time and if we do we will give you 30 (thirty) days notice of a change in premium.

MONTHLY POLICY / PREMIUM PAYMENTS

c) If according to the schedule this is a monthly policy, this policy is valid for one calendar month provided that

(i) The policy is automatically renewed for a further month every time you pay your premium which must be paid on the due date as agreed.

(ii) If we do not receive your premium by the due date or within 15 (fifteen) days after the due date (save in the first month) the policy shall automatically terminate from 24:00 (midnight) on the last day of the month for which premium was actually received by us.

(iii) The premium is payable in advance and you will only be covered for that period in respect of which your premium has been paid.

(iv) Non-payment of the premium shall result in the policy terminating.

(v) If we do not receive your first premium (in the first month) the policy will be void from the inception date.

ANNUAL POLICY / PREMIUM PAYMENTS

d) If according to the schedule this is an annual policy, this policy is valid for one year provided that

(i) The policy may be renewed on the annual renewal date if you pay your premium on or before the annual renewal date, which date will be the due date for payment of the premium.

(ii) If we do not receive your premium on the due date or within 15 (fifteen) days after the due date, you will not have any cover and the policy shall lapse from 24:00 (midnight) on the last day of the 12 (twelve) month period for which premium was actually received by us.

(iii) If we do not receive your premium the policy shall be void from the first inception date.

(iv) The premium is payable in advance and you will only be covered for that period in respect of which your premium has already been paid to us.

(v) If we do not receive your first premium (in the first month) the policy will be void from the inception date.

(vi) If there is a total loss any remaining unpaid annual premiums paid monthly that are still due and payable, must be paid alternatively the unpaid premiums shall be deducted from the indemnity paid. If the full annual premium has been paid, no pro-rata refund of premium shall be payable to you.

13. JURISDICTION

This policy is subject to the jurisdiction of the courts of the Republic of South Africa.

14. RIOT AND STRIKE EXTENSION (excluding cover which is available and provided by the South African Special Risks Insurance Association and Namibian Special Risks Insurance Association)

Notwithstanding anything to the contrary contained in General Exception 2:

a) This policy is extended to cover loss of or damage to property directly occasioned by or through or in consequence of:

i) civil commotion, labour disturbances, riot, strike or lockout ii) the act of any lawfully established authority in controlling, preventing, suppressing or in any

other way dealing with any occurrence referred to in a) i) above

b) This extension does not cover loss of or damage to property:

i) occurring either within the territorial limits of the Republic of South Africa or Namibia or beyond the territorial limits specified in the policy

ii) resulting from total or partial cessation of work, or the retarding or cessation of any process or operation

iii) occasioned by permanent or temporary dispossession resulting from confiscation, commandeering or requisition by any lawfully constituted authority

iv) related to or caused by any occurrence referred to in General Exception 2.ii), 2.iii), 2.iv), 2.v), 2.vi) or 2.vii) or the act of any lawfully established authority in controlling, preventing, suppressing or in any other way dealing with any such occurrence.

If we allege that by reason of b) i), b) ii), b) iii), b) iv), loss or damage is not covered by this extension, the burden of proving the contrary will rest on you.

c) Notwithstanding any provision of this policy including any exception, extension or other provision not included herein which would otherwise override a general exception, this policy does not cover loss of or damage to property or expense, of whatsoever nature directly or indirectly caused by, arising out of or in connection with any act of terrorism regardless of any other cause or event contributing concurrently or in any sequence to the loss, damage or expense.

For the purposes of this exception c) an act of terrorism includes, without limitation, the use of violence or force or the threat thereof whether as an act harmful to human life or not, by any person or group of persons, whether acting alone, or on behalf of or in connection with any organisation or government or any other person or body of persons, committed for political, religious, personal or ideological reasons or purposes including any act committed with the intention to influence any government or for the purpose of inspiring fear in the public or any section thereof.

If we allege that by reason of exception c), loss of or damage to property is not covered by this policy, the burden of proving the contrary shall rest on you.

15. COMPLIANCE WITH LEGISLATION

There will be no cover under any section of this policy if you do not comply with all the rules, regulations, legislation, laws and by-laws of the countries within the territorial limits as stated in the schedule.

GENERAL EXCEPTIONS

1. GENERAL

We will not be liable for: i) any First Amounts Payable as stated in the policy or schedule or endorsement ii) any claim which is in any way fraudulent iii) loss, damage or bodily injury deliberately caused by you or any person acting in collusion with you iv) loss or damage resulting from, caused by or attributable to the deliberate withholding or

reconnection, including associated power surges, of any public utility supplier such as but not limited to electrical supply load shedding unless such withholding is caused by damage to the utility

v) power surges unless they are caused by an insured peril such as fire or lightning.

2. WAR RIOT TERRORISM

a) We will not be liable for loss of or damage to property related to or caused by:

i) civil commotion, labour disturbances, riot, strike, lockout or public disorder or any act or activity which is calculated or directed to bring about any of the foregoing

ii) war, invasion, act of foreign enemy, hostilities or warlike operations (whether war be declared or not) or civil war

iii) mutiny, military rising, military or usurped power, martial law or state of siege, or any other event or cause which determines the proclamation or maintenance of martial law or state of siege

iv) insurrection, rebellion or revolution v) any act (whether on behalf of any organisation, body or person or group of persons)

calculated or directed to overthrow or influence any State or Government or any provincial, local or tribal authority with force or by means of fear, terrorism or violence

vi) any act which is calculated or directed to bring about loss or damage in order to further any political aim, objective or cause, or to bring about any social or economic change, or in protest against any State or Government or any provincial, local or tribal authority, or for the purpose of inspiring fear in the public or any section thereof

vii) any attempt to perform any act referred to in exceptions 2.v) or 2.vi) above viii) the act of any lawfully established authority in controlling, preventing, suppressing or in any

other way dealing with any occurrence referred to in exceptions 2.i), 2.ii), 2.iii), 2.iv), 2.v), 2.vi) or 2.vii) above.

If we allege that, by reason of exceptions 2.i), 2.ii), 2.iii), 2.iv), 2.v), 2.vi), 2.vii) or 2.viii) of this exception, loss or damage is not covered by this policy, the burden of proving the contrary shall rest on you ix) loss or damage caused directly or indirectly by or through or in consequence of any

occurrence for which a fund has been established in terms of the War Damage Insurance and Compensation Act, 1976 (No. 85 of 1976) or any similar Act operative in any of the territories to which this policy applies.

b) Notwithstanding any provision of this policy including any exception, extension or other provision not included herein which would otherwise override a general exception, this policy does not cover loss of or damage to property or expense, of whatsoever nature directly or indirectly caused by arising out of or in connection with any act of terrorism regardless of any other cause or event contributing concurrently or in any sequence to the loss, damage or expense.

For the purposes of this exception 2.a) an act of terrorism includes, without limitation, the use of violence or force or the threat thereof whether as an act harmful to human life or not, by any person or group of persons, whether acting alone, or on behalf of or in connection with any organisation or government or any other person or body of persons, committed for political, religious, personal or ideological reasons or purposes including any act committed with the intention to influence any government or for the purpose of inspiring fear in the public or any section thereof.

If we allege that by reason of exception 2.a) loss of or damage to property is not covered by this policy, the burden of proving the contrary shall rest on you.

3. NUCLEAR

Except as regards the Personal Accident Section, this policy does not cover any legal liability, loss, damage, cost or expense whatsoever or any consequential loss directly or indirectly caused by or contributed to by or arising from:

a) ionising, radiations or contamination by radio-activity from any nuclear fuel or from any nuclear waste from the combustion or use of nuclear fuel

b) nuclear material, nuclear fission or fusion, nuclear radiation

c) nuclear explosives or any nuclear weapon

d) nuclear waste in whatever form

regardless of any other cause or event contributing concurrently or in any other sequence to the loss.

For the purpose of this exception only, combustion shall include any self-sustaining process of nuclear fission.

4. COMPUTER LOSS

Notwithstanding any provision of this policy including any exception or extension or other provision not included herein which would otherwise override a general exception, this policy does not cover:

a) loss or destruction of or damage to any property whatsoever (including a computer) or any loss or expense whatsoever resulting or arising therefrom.

b) any legal liability of whatsoever nature

c) any consequential loss

directly or indirectly caused by or contributed to by or consisting of or arising from the incapacity or failure of any computer, correctly or at all:

i) to treat any date as the correct date or true calendar date, or correctly or appropriately to recognise, manipulate, interpret, process, store, receive or to respond to any data or information, or to carry out any command or instruction, in regard to or in connection with any such date

or ii) to capture, save, retain or to process any information or code as a result of the operation of

any command which has been programmed into any computer, being a command which causes the loss of data or the inability to capture, save, retain or correctly to process such data in regard to or in connection with any such date

or iii) to capture, save, retain or to process any information or code due to programme errors,

incorrect entry or the inadvertent cancellation or corruption of data and/or programmes or iv) to capture, save, retain or to process any data as a result of the action of any computer virus,

or other corrupting, harmful or otherwise unauthorised code or instruction including any Trojan horse, time or logic bomb or worm or any other destructive or disruptive code, media or programme or interference.

A computer includes any computer, data processing equipment, microchip, integrated circuit or similar device in computer or non-computer equipment or any computer software, tools, operating system or any computer hardware or peripherals and the information or data electronically or otherwise stored in or on any of the above, whether your property or not.

Specific Extension to the above General Exception 4

a) Loss or destruction of or damage to the insured property by fire, explosion, lightning, earthquake or by the insured events referred to in b) below or indemnified by the Personal Accident or Motor sections is not excluded by this General Exclusion.

b) The insured events that are not excluded for the purpose of this Specific Extension are damage caused by:

i) storm, flood, wind, rain, hail or snow excluding loss or damage to property in the open unless

the property is designed to exist or operate in the open ii) sudden damage to any building caused by impact

These Insured Events do not cover wear and tear or gradual deterioration.

c) This Specific Extension will not insure any loss, destruction, damage or consequential loss if it would not have been insured in the absence of this Computer Loss General Exclusion and this Specific Extension.

d) This Specific Extension shall not apply to any Personal Legal Liability indemnity.

5. ASBESTOS

The following general exception is applicable to the following covers:

i) The Property Owners as provided under Section 1 - Buildings ii) The Tenants Liability as provided under Section 2 - Contents iii) Section 5 – Personal Liability

Notwithstanding any provision of this policy including any, exception or extension or other provision not included herein which would otherwise override a general exception, this policy does not cover loss of or damage to property or expense of whatsoever nature directly or indirectly caused by, arising out of or in connection with any gradual or sudden effect of the inherent properties of asbestos regardless of the amount involved or any other cause or event contributing concurrently or in any sequence to the loss, damage or expense.

6. CONFISCATION AND/OR DETENTION

We will not be liable for loss or damage caused by detention, confiscation or requisition by customs or other officials or authorities or by any process of law.

7. CONSEQUENTIAL LOSS

We will not be liable for consequential loss or damage except as specifically provided for.

PERSONAL ASSETS INSURANCE POLICY BUILDINGS (1/9) MAY 2011

SECTION 1 - BUILDINGS DEFINITIONS For this section:

a) You/your/yours/yourself means the insured named in the schedule. b) The private residence shall mean the building and outbuildings, landlord’s fixtures and fittings,

water, sewerage, gas, electricity and telephone connections, paths and driveways constructed of brick, concrete, pavers, asphalt or stone (not gravel), walls, gates and fences (excluding hedges), swimming pools (other than pools that are built above ground level and vinyl lined pools) including fixed filtration plant, pool safety nets and covers, water-pumping machinery (not automatic pool cleaners), tennis courts, sauna and spa baths belonging to you and situated at the risk address stated in the schedule.

c) Reinstatement means, if the private residence is i) damaged, we will repair the damaged portion ii) destroyed, we will rebuild it as nearly as possibly to its condition when new.

COVER SCOPE

1. INSURED EVENTS

The insured events are: a) Fire, lightning, explosion. b) Malicious damage excluding loss or damage caused by or arising from theft or attempted theft. c) Storm, wind, water, hail, snow or flood excluding loss or damage:

i) to property insured caused by a process which necessitates the use or application of water ii) to gates and fences other than metal palisades and any motor attaching thereto iii) to retaining walls iv) directly caused by movement of the land supporting the private residence even if such

movement is directly or indirectly caused by storm or flood. This exception will not apply to the removal of land supporting the private residence by flowing surface water

v) caused by wear and tear or gradual deterioration

d) Earthquake. e) Bursting, leaking or overflowing of water apparatus (including geysers) or fixed oil-fired heating

apparatus, including the apparatus itself (which includes geysers). f) Theft or attempted theft provided that if the private residence is unoccupied there is forcible

and violent entry or exit. g) Impact by animals, vehicles, falling trees or parts of trees, aircraft and other aerial devices or

articles dropped therefrom. h) Breakage or collapse of fixed radio or television aerials, satellite dishes or masts.

2. SUBSIDENCE AND LANDSLIP (LIMITED COVER) We cover loss or damage by subsidence or landslip. However, we do not cover loss or damage: a) to drains, water courses, boundary walls, garden walls, screen and retaining walls, gate posts,

gates and fences, driveways, paving, swimming pools or tennis courts, patios, terraces, septic or conservancy tanks; solid floor slabs or any other part of the private residence resulting from the

movement of such slabs unless the foundations supporting the external walls of the private residence or outbuildings are damaged by the same cause at the same time;

b) to work necessary to prevent further loss or damage to subsidence, heave or landslip except

where appropriate design precautions were implemented during the original construction of the private residence and any subsequent additions thereto;

c) caused by the contraction or expansion of soil due to its moisture or water content, as

experienced in clay and similar soil types; d) caused or made worse by faulty design, insufficient compacting of filling, poor construction,

materials or workmanship or the removal or weakening of support to any private residential structures;

e) caused by structural alterations, additions or repairs to the private residence; f) caused by surface or subterranean excavations other than those performed in the course of

mining operations; g) caused by normal settlement, shrinkage or expansion of the building. If we require it, you must prove that the loss or damage being claimed for was caused by subsidence of landslip. First Amount Payable In respect of each and every claim under this extension you will be responsible for the first amount payable up to an amount as stated in the schedule.

3. REINSTATEMENT VALUE CONDITIONS Following loss of or damage to the private residence arising from or caused by an insured event: a) we may choose by payment or by reinstatement or by repair to indemnify you, provided if at

the time of the loss or damage the value of the private residence including the cost of demolition and professional fees insured by this section amount to more than the sum insured you will be your own insurer for the difference and will bear a rateable proportion of the loss; or

b) you may choose within 6 (six) months of the date of loss or damage to personally reinstate the

private residence on the same site (or on another site and in the way you want subject to our liability not being increased) as nearly as possible to its condition when new, provided:

i) the reinstatement must be started and finished in a reasonable time otherwise we will

settle in terms of a) ii) we will not be liable for the costs of reinstatement exceeding the cost which would have

been payable in terms of a) until such cost has been incurred by you if at the time of reinstatement the cost including the cost of public authorities

requirements, public supply or mains connections, fire brigade charges as well as demolition and professional fees insured by this section which would have been incurred in reinstating

the private residence had it been totally destroyed exceeds the sum insured on the private residence at the time of loss or damage you will be your own insurer for the difference and will bear a rateable proportion of reinstatement.

4. LOSS OF WATER BY LEAKAGE

We will indemnify you for the costs of water lost through leakage from pipes in the private residence or on its grounds where you are responsible to pay the charge for such water provided that: a) the loss of water exceeds the average monthly consumption for the twelve months prior to the

loss being discovered by 50% (fifty percent) or more up to an amount of R5,000 (Five Thousand Rand) for not more than 2 (two) separate incidents in any 12 (twelve) month period of insurance;

b) we will not be liable for more than two separate incidents in any 12 (twelve) month period of insurance up to R5,000 (Five Thousand Rand);

c) it shall be a condition precedent to liability under this extension that you shall upon discovery of a leak (by physical evidence or on receipt of an abnormally high water account) take immediate steps to repair the pipe(s) affected and provide us with written proof of the expenses incurred in making such repairs.;

d) this extension does not cover the costs of locating the leak/s and all remedial and repair costs; e) if cover in terms of Section 1 – Buildings and Section 2 - Contents is included under this policy

we will only indemnify you under one section and the limits of indemnity as stated in 4.a) and 4.b) above shall apply as if only one of the sections is in force.

We shall not be liable for claims occurring:

i) as a result of leaking and/or overflowing taps, geysers, toilet systems and swimming pools; ii) whilst the private residence is unoccupied for a period in excess of 30 (thirty) consecutive

days; iii) where the water level of a swimming pool has to be topped up as a result of a leaking inlet

or outlet pipe.

5. RENT If the private residence becomes temporarily uninhabitable as a result of an insured loss or damage we will pay you up to 20% (twenty percent) of the sum insured on the private residence. The amount payable will be based on the period necessary for reinstatement and a) the actual rent you receive on the buildings at the time of the loss or damage;

or b) the annual rental value of the unfurnished private residence if you occupy the residence.

6. GLASS AND SANITARYWARE

In the event of accidental breakage in the private residence (except when it is unoccupied) of: a) fixed glass; b) fixed sanitary ware excluding chipping, scratching or disfiguration we will pay for or choose to

repair or replace it.

7. WATER-PUMPING MACHINERY

In the event of accidental loss of or damage (not directly or indirectly due to wear and tear) to fixed filtration plant or water-pumping machinery (excluding consumables and automatic pool cleaners) in domestic use we will pay for or choose to repair or replace it up to a maximum amount of R5,000 (Five Thousand Rand) any one claim.

8. PUBLIC AUTHORITIES REQUIREMENTS

We will pay costs necessarily incurred in repairing or rebuilding in accordance with the requirements of public authorities following loss of or damage to the private residence by an insured event excluding the requirement of public authorities relating to defective workmanship, design, plan or specification.

9. PUBLIC SUPPLY OR MAINS CONNECTIONS

In the event of accidental loss of or damage to water, sewerage, gas, electricity or telephone connections belonging to you or for which you are responsible between your private residence and the public supply we will pay for or may choose to repair them.

10. FIRE BRIGADE CHARGES

If the authorities charge you with the cost of fire extinguishing following fire damage to the private residence we will indemnify you for the actual cost incurred.

11. DEMOLITION AND PROFESSIONAL FEES

We will pay costs necessarily incurred by you with our written consent: a) in demolishing the private residence, removing debris from the site and erecting hoardings

required for building operations; b) for architects’ quantity surveyors’ and consulting engineers’ fees; c) for local authorities’ scrutiny fees following loss of or damage to the private residence by an

insured event.

12. SECURITY GUARD

We will indemnify you for costs reasonably and necessarily incurred in employing a security guard following loss or damage caused by an insured event up to an amount of R5,000 (Five Thousand Rand) any one claim.

13. REMOVAL OF FALLEN TREES

We will pay costs necessarily incurred by you with our written consent for the removal of fallen trees belonging to you from the private residence following an insured event up to an amount of R5,000 (Five Thousand Rand) in any 12 (twelve) month period of insurance.

14. GARDEN DAMAGE We will pay the reasonable and necessary costs incurred by you limited to R5,000 (Five Thousand Rand) in respect of the replacement of trees, shrubs and plants at the premises of the domestic building damaged as a result of fire necessitating the action of a fire brigade, fire fighting services, explosion, impact by vehicles other than your own, aircraft or articles dropped therefrom, malicious damage other than by you members of your family guests or tenants excluding damage caused by theft or attempted theft.

15. PROPERTY OWNERS LIABILITY

a) Indemnity to you

If you become legally liable to pay compensation as owner of the private residence stated in the schedule for accidental death, bodily injury or illness or accidental loss of or damage to property occurring during the period of insurance we will indemnify you up to the amount stated in the schedule for any one accident or series of accidents arising out of one event including costs and expenses recoverable by any claimant from you and incurred with our written consent.

b) Exceptions We will not indemnify you for:

i) compensation payable to:

(1) you or any member of your family normally resident with you; (2) any person acting in the course of their employment with you at the time of the

accident other than domestic staff; (3) your directors, members, trustees or beneficiaries or members of their families

normally resident with them if you are a Company, Close Corporation or Trust ii) compensation payable for loss of or damage to property in the custody or control of:

(1) you or any member of your family normally resident with you; (2) any person acting in the course of their employment with you at the time of the

accident; (3) your directors, members, trustees or beneficiaries or members of their families

normally resident with them if you are a Company, Close Corporation or Trust iii) compensation payable directly or indirectly due to:

(1) your employment, business or profession; (2) the ownership of land or buildings (other than the private residence insured by this

Section and land upon which they are situated provided the land is used for residential purposes);

(3) the occupation of land or buildings, other than your private residence; (4) the use of any motor vehicle, caravan, trailer, air or water craft (other than model

aircraft, surfboard or paddle ski) owned by or in the custody or control of yourself or your domestic staff

c) liability accepted by agreement which would not have attached in the absence of the agreement.

16. AUTOMATIC INFLATION INCREASE

The sum insured in respect of the property insured under this section will be increased by 1% (one percent) each month to cater for the effect of inflation. However, the Schedule will not reflect this monthly increase and no additional premium will be charged during the period of the policy but the premium will be recalculated each year on the renewal or anniversary date as shown in the schedule. However, this does not relieve you of your responsibility for establishing the sums insured and ensuring that they are maintained at levels that represent the full replacement value and we accept no liability for incorrect sums insured as determined by you.

SPECIFIC CONDITIONS TO SECTION 1 - BUILDINGS

1. AVERAGE It is important that you insure all your insured property for the correct value, which is the total, current replacement cost of your insured property. We have stated this as the sum insured on the schedule of the section. If at the time of any loss or damage, the amount which is needed to replace all your insured property with similar new property is more than the amount for which it is insured, you will be considered as if you are your own insurance company for the difference and will bear a proportional share of the loss or damage accordingly. This general condition applies separately to each item in the policy schedule. Example: a) Loss R 24 000 b) Sum Insured R 75 000 c) Replacement Value R100 000 d) Settlement R 24 000 x 75 000/100 000

= R18 000 Less the appropriate First Amount Payable (i.e. 25% underinsured = 75% payment by us)

2. FIRST AMOUNT PAYABLE

In respect of any occurrence giving rise to a claim in terms of this section other than Property Owners Liability you will be responsible for the First Amounts Payable stated in the schedule.

3. BUILDING OPERATIONS

While the private residence is being structurally altered, including but not limited to breaking out of or building and or re-plastering of walls door windows cover provided by Insured Event 1c) storm, wind, water, hail, snow or flood, 5. Glass and Sanitaryware, 4. Rent and 14. Property Owners Liability will not apply to loss, destruction, damage or liability arising directly or indirectly from such alteration.

4. MORTGAGEE

The interest of the mortgagee: a) ranks prior to your interest; b) is limited to the amount owing to the mortgagee by you on the home loan account in respect

of the insured private residence; c) will not be invalidated by any act or omission of yours if such act or omission occurs without

the mortgagee’s knowledge. 5. TENANTS

This insurance will not be invalidated by any act or omission of a tenant of yours provided you notify us as soon as such act or omission comes to your knowledge.

OPTIONAL COVER - APPLICABLE ONLY IF INDICATED IN THE SCHEDULE TO APPLY

1. SUBSIDENCE AND LANDSLIP (COMPREHENSIVE COVER) If this optional cover is selected, it replaces cover scope 2. SUBSIDENCE OR LANDSLIP (LIMITED COVER). We will compensate you for loss or damage to the private residential structures caused by subsidence or landslip, or both. However, we will not cover loss or damage: a) to drains, water courses, boundary walls, garden walls, screen and retaining walls, gate posts,

gates and fences, driveways, paving, swimming pools or tennis courts, patios, terraces, septic or conservancy tanks; solid floor slabs or any other part of the private residence resulting from the movement of such slabs unless the foundations supporting the external walls of the private residence or outbuildings are damaged by the same cause at the same time;

b) work necessary to prevent further loss or damage due to subsidence, heave or landslip except where appropriate design precautions were implemented during the original construction of the private residence and any subsequent additions thereto;

c) caused by or made worse by faulty design, insufficient compacting of filling, poor construction, materials or workmanship or the removal or weakening of support to any private residential structures;

d) caused by structural alterations, additions or repairs to the private residence;

e) caused by surface or subterranean excavations except those performed during mining

operations;

f) caused by normal settlement, shrinkage or expansion of the private residential structures.

If we require it, you must prove that the loss or damage being claimed for was caused by subsidence or landslip.

First amount payable In respect of each and every claim under this extension you will be responsible for the first amount payable up to an amount as stated in the Schedule.

2. MALICIOUS DAMAGE EXTENSION

Subject otherwise to the terms, conditions, exceptions and warranties contained therein, this section is extended to cover damage directly occasioned by or through or in consequence of the deliberate or wilful or wanton act of any person committed with the intention of causing such damage, other than damage to: a) moveable property which is

i) stolen or

ii) damaged in an attempt to remove it or part of it from any premises owned or occupied by the insured;

b) moveable or immoveable property which is damaged by thieves whilst breaking into or out of or

attempting to break into or out of any premises owned or occupied by the insured;

c) immovable property owned or occupied by the insured occasioned by or through or in consequence of:

i) the removal or partial removal or any attempt thereat of; ii) the demolition or partial demolition or any attempt thereat of the said immovable property

or any part thereof with the intention of stealing any part thereof

1) damage related to or caused by fire or explosion; 2) consequential or indirect loss or damage of any kind or description whatsoever other

than loss of rent if specifically insured; 3) damage resulting from total or partial cessation of work or the retarding or

interruption or cessation of any process or operation; 4) damage occasioned by permanent or temporary dispossession resulting from

confiscation, commandeering or requisition by any lawfully constituted authority; 5) damage related to or caused by any occurrence referred to in General exception 2 a) i),

ii), iii), iv), v), or vi) of this policy or the act of any lawfully established authority in controlling, preventing, suppressing or in any other way dealing with any such occurrence.

iii) If we allege that, by reason of proviso 1), 2), 3), 4) or 5), loss or damage is not covered by

this section, the burden of proving the contrary shall rest on the insured. If any building insured or containing the insured property becomes unoccupied for 30 consecutive days, the insurance in respect of this extension is suspended as regards the property affected unless the insured, before the occurrence of any damage, obtains the written agreement from us to continue this extension. During the period of the initial unoccupancy of 30 consecutive days, you shall become a co-insurer with us and shall bear a proportion of any damage equal to 20 percent of the claim before deduction of any first amount payable.

SPECIFIC EXCEPTIONS: We will not be liable for loss or damage directly or indirectly caused or aggravated by: 1. wear and tear, gradual deterioration or gradual operating causes; 2. the insured’s failure to take all necessary precautions for the maintenance and safety of the

buildings.

SECTION 2 - CONTENTS

DEFINITIONS

For this section:

a) You/your/yours/yourself includes members of your family normally resident with you.

b) For the purposes of this section the private residence means:

i) a building situated at the risk address stated in the schedule and in which a person resides and excludes the grounds upon which the building is situated

ii) an outbuilding which means a separate building situated at the risk address stated in the schedule and which is not inter-leading to the building defined in b)i) regardless of whether it is detached, attached to or forming part of the building defined in b)i) and excludes the grounds upon which the outbuilding is situated.

c) Property insured subject to Specific Exceptions under this Section means:

Household Contents and personal effects (including money and negotiable instruments limited to R3,000 (Three Thousand Rand) subject to forcible entry whilst in your private residence or in a building situated at the risk address stated in the schedule.

COVER SCOPE

1. INDEMNITY TO YOU

If the property insured is lost or damaged by an insured event we will pay for or may choose to repair or replace it. The amount payable will be the current replacement cost.

2. INSURED EVENTS

The insured events are:

a) Fire, lightning, explosion.

b) Malicious damage excluding loss or damage caused by or arising from theft or attempted theft.

c) Storm, flood, wind, rain, hail or snow excluding loss or damage:

i) to property insured in the open unless the property is designed to exist or operate in the open ii) to property insured caused by a process which necessitates the use or application of water or

gradual seepage of water.

d) Earthquake.

e) Bursting, leaking or overflowing of water apparatus (including geysers), pipes or fixed oil-fired heating apparatus, excluding damage caused to the apparatus or pipes or geysers.

f) Sudden damage caused by impact by animals, vehicles, falling trees, aircraft or other aerial devices or articles dropped therefrom, to the private residence.

g) Theft or attempted theft from:

i) the private residence referred to under Definition b)i) ii) that part of the private residence referred to in Definition b)ii), limited to R5,000

(Five Thousand Rand) unless there is forcible and violent entry or exit

iii) a building in which you are temporarily residing or occupying any building in which you are employed if there is forcible and violent entry or exit

iv) any furniture storage depot or a bank safe deposit if there is forcible and violent entry or exit.

h) Theft:

i) of laundry, garden and swimming pool furniture, implements and pool safety nets and covers from the grounds of the private residence up to an amount of R2,500 (Two Thousand Five Hundred Rand) for no more than 2 (two) separate incidents in any 12 (twelve) month period of insurance

ii) while being moved by professional removers during a permanent change in the risk address iii) while in transit to or from a furniture storage depot or a bank safe deposit iv) or attempted theft while in transit in your custody to or from any place of purchase, repair or

renovation following an accident to the conveying motor vehicle or theft following forcible and violent entry into the vehicle limited to R5,000 (Five Thousand Rand) any one event

i) Theft accompanied by violence or threat of violence to you or any member of your family on or about the private residence stated in the schedule.

3. LOSS OF WATER BY LEAKAGE

We will indemnify you for the costs of water lost through leakage from pipes in the private residence or on its grounds where you are responsible to pay the charge for such water provided that:

a) the loss of water exceeds the average monthly consumption for the 12 (twelve) months prior to the loss being discovered by 50% (fifty percent) or more up to the limit of indemnity as stated in the Schedule of Limits;

b) we will not be liable for more than two separate incidents in any 12 (twelve) month period of insurance;

c) it shall be a condition precedent to liability under this extension that you shall upon discovery of a leak (by physical evidence or on receipt of an abnormally high water account) take immediate steps to repair the pipe(s) affected and provide us with written proof of the expenses incurred in making such repairs;

d) this extension does not cover the costs of locating the leak/s and all remedial and repair costs.

We shall not be liable for claims occurring:

i) as a result of leaking and/or overflowing taps, geysers, toilet systems and swimming pools ii) whilst the private residence is unoccupied for a period in excess of 30 (thirty) consecutive

days iii) where the water level of a swimming pool has to be topped up as a result of a leaking inlet or

outlet pipe.

4. RENT

If the private residence becomes temporarily uninhabitable because of loss or damage caused by an insured event we will for the period necessary for reinstatement indemnify you for:

(a) rent for which you are liable

(b) any reasonable additional costs incurred in providing alternative lodging for yourself, your family and domestic staff normally resident with you

up to 20% (twenty percent) of the Section 2 - Contents sum insured.

5. DOMESTIC TELEPHONE INSTRUMENTS

If in the private residence any domestic telephone instrument (excluding cellular telephones) is accidentally damaged we will indemnify you up to R1,000 (One Thousand Rand) per instrument any one claim.

6. KEYS AND LOCKS

We will indemnify you for costs reasonably and necessarily incurred as a direct consequence of any keys and locks including card keys and remote controls for your private residence being lost or damaged limited to R5,000 (Five Thousand Rand).

7. REFRIGERATOR AND DEEP FREEZE CONTENTS

In the event of deterioration of food in any refrigerator/deep freeze unit in the private residence as a result of:

a) breakdown of or accidental damage to the unit

b) failure of power supplied by public authorities excluding deliberate withholding of power by supplier or public authority

we will indemnify you for loss of food up to an amount of R5,000 (Five Thousand Rand) per claim limited to twice in a 12 (twelve) month period.

8. DOCUMENTS

We will indemnify you for loss or damage caused by an insured event to your personal documents limited to R5,000 (Five Thousand Rand) any one claim. We will only be liable for the value of materials and the cost of labour in reinstating the documents or obtaining duplicates and not for the value to you of the content or any consequential loss or damages.

9. GUESTS

If Household Contents and personal effects excluding money and negotiable instruments not otherwise insured belonging to a guest temporarily residing with you are lost or damaged by an insured event specified in 2.a) to f) or by theft from the private residence we will indemnify the guest up to an amount of R5,000 (Five Thousand Rand) any one claim.

10. PROPERTY OF DOMESTIC STAFF

If Household Contents and personal effects excluding money and negotiable instruments belonging to your domestic staff are lost or damaged in the private residence by an insured event we will indemnify the domestic staff up to an amount of R5,000 (Five Thousand Rand) any one claim.

11. MEDICAL AND VETERINARY EXPENSES

If medical and veterinary expenses are incurred and paid for as a result of accidental bodily injury sustained by any:

a) person other than yourself caused by a domestic animal owned by you

b) guest or visitor arising from any defect in the private residence

c) domestic staff in the course of their employment by you

d) domestic animal owned by you arising from a road accident

we will pay the expenses up to an amount of R5,000 (Five Thousand Rand) per person or R1,000 (One Thousand Rand) per animal.

12. ACCIDENTAL DEATH

If you sustain accidental bodily injury while in the private residence or its grounds and die as a direct result of the injury we will pay:

a) R5,000 (Five Thousand Rand) for a person 18 (eighteen) years of age and under

b) R10,000 (Ten Thousand Rand) for a person over 18 (eighteen) and under 76 (seventy six) years of age

provided death occurs within 3 (three) months of the injury.

13. SECURITY GUARD

We will indemnify you for costs reasonably and necessarily incurred in employing a security guard following loss or damage caused by an insured event limited to R5,000 (Five Thousand Rand) per event.

14. TRAUMA

If you are the victim of a violent act of theft, attempted theft, hold-up or hijacking which necessitates professional counselling we will pay compensation up to an amount of R5,000 (Five Thousand Rand) any one claim.

15. CLEARANCE COSTS

We will indemnify you up to an amount of R5,000 (Five Thousand Rand) any one claim for costs necessarily incurred in respect of the removal of debris from the private residence or its grounds following loss or damage hereby insured.

16. TRANSIT

We will indemnify you up to an amount of R5,000 (Five Thousand Rand) per claim for damage to household contents in your custody whilst in transit to or from any place of purchase, repair or renovation or permanent change of address provided that the damage is caused by fire, collision of overturning and theft following as well as theft by forcible and violent means including hijacking of the conveying motor vehicle.

17. PROPERTY OCCUPIERS LIABILITY

a) INDEMNITY TO YOU

If you become legally liable to pay compensation as a householder occupying the private residence stated in the schedule for accidental death, bodily injury or illness or accidental loss of or damage to property occurring during the period of insurance we will indemnify you up to the amount stated in the schedule for any one accident or series of accidents arising out of one event including costs and expenses recoverable by any claimant from you and incurred with our written consent.

b) TENANTS LIABILITY

If you become legally liable as tenant and not as owner for:

i) damage to the private residence and outbuildings (including fixtures and fittings) caused by an insured event specified in this section

ii) accidental damage to fixed sanitaryware or fixed glass iii) accidental damage to water, gas, sewerage, electricity or telephone connections to the

private residence or outbuildings

we will indemnify you in terms of 17.a) above up to the amount stated in the schedule for any one accident or series of accidents arising out of one event.

c) EXCEPTIONS

We will not indemnify you for:

i) compensation payable to:

(1) you or any member of your family normally residing with you (2) any person acting in the course of their employment with you at the time of the accident

other than domestic staff (3) your directors, members, trustees or beneficiaries or members of their families normally

resident with them if you are a Company, Close Corporation or Trust

ii) compensation payable for loss of or damage to property in the custody or control of:

(1) you or any member of your family normally resident with you (2) any person acting in the course of his employment with you at the time of the accident (3) your directors, members, trustees or beneficiaries or members of their families normally

resident with them if you are a Company, Close Corporation or Trust iii) compensation payable directly or indirectly due to:

(1) your employment, business or profession (2) the ownership of land or buildings (other than the private residence insured by Section I

and land upon which they are situated provided the land is used for residential purposes) (3) the occupation of land or buildings, other than your private residence (4) the use of any motor vehicle, caravan, trailer, air or water craft (other than model aircraft,

surfboard or paddle ski) owned by or in the custody or control of yourself or your domestic staff

iv) liability accepted by agreement which would not have attached in the absence of the

agreement.

18. AUTOMATIC INFLATION INCREASE

The sum insured in respect of the property insured under this section will be increased by 1% (one percent) each month to cater for the effect of inflation. However, the Schedule will not reflect this monthly increase and no additional premium will be charged during the period of the policy but the premium will be recalculated each year on the renewal or anniversary date as shown in the schedule.

However, this does not relieve you of your responsibility for establishing the sums insured and ensuring that they are maintained at levels that represent the full replacement value and we accept no liability for incorrect sums insured as determined by you.

PERSONAL ASSETS INSURANCE POLICY CONTENTS (6/12) MARCH 2012

OPTIONAL COVER - APPLICABLE ONLY IF INDICATED IN THE SCHEDULE TO APPLY

1. ACCIDENTAL DAMAGE

For the purposes of this optional cover General Exception 1.v) dealing with power surge is deleted.

Accidental damage which includes power surges to Household Contents in the private residence provided that we will not be liable under this insured event for:

a) more than 20% (twenty percent) of the sum insured for any single item

b) more than the sum insured stated in the Schedule for any one claim

c) more than 20% (twenty percent) of the sum insured for loss or damage to any television set, DVD players, recorders, video recorders, decoders, sound reproduction equipment, satellite dishes or aerials limited to R5,000 (Five Thousand Rand) per item

d) more than 20% (twenty percent) of the sum insured for loss or damage to mirror glass or sheet

glass in or on furniture or on a domestic appliance limited to R5,000 (Five Thousand Rand) per item

e) loss or damage:

i) caused by or resulting from wear and tear, depreciation, electrical or mechanical breakdown, rust, mildew, moth, vermin, insects, your own domestic pets, any gradually operating cause, process of dyeing, cleaning or renovating, the action of light or atmospheric conditions, confiscation or detention by any process of law

ii) to furniture or domestic appliances by scratching, denting or chipping iii) to firearms, video or audio tapes iv) to personal computers, laptops, palmtops, notebooks including keyboards, monitors, printers

and other accessories thereto

f) consequential loss of any nature.

Accidental Damage cover is otherwise subject to the Specific Exceptions and Specific Conditions of this section of the policy.

2. SUBSIDENCE OR LANDSLIP

We will compensate you for loss or damage to the private residential structures caused by subsidence or landslip, or both. However, we will not cover loss or damage: a) to drains, water courses, boundary walls, garden walls, screen and retaining walls, gate posts,

gates and fences, driveways, paving, swimming pools or tennis courts, patios, terraces, septic or conservancy tanks; solid floor slabs or any other part of the private residence resulting from the movement of such slabs unless the foundations supporting the external walls of the private residence or outbuildings are damaged by the same cause at the same time;

b) work necessary to prevent further loss or damage due to subsidence, heave or landslip except where appropriate design precautions were implemented during the original construction of the private residence and any subsequent additions thereto;

c) caused by or made worse by faulty design, insufficient compacting of filling, poor construction, materials or workmanship or the removal or weakening of support to any private residential structures;

d) caused by structural alterations, additions or repairs to the private residence;

e) caused by surface or subterranean excavations except those performed during mining

operations;

f) caused by normal settlement, shrinkage or expansion of the private residential structures.

If we require it, you must prove that the loss or damage being claimed for was caused by subsidence or landslip.

First amount payable In respect of each and every claim under this extension you will be responsible for the first amount payable up to an amount as stated in the Schedule.

3. MALICIOUS DAMAGE EXTENSION

Subject otherwise to the terms, conditions, exceptions and warranties contained therein, this section is extended to cover damage directly occasioned by or through or in consequence of the deliberate or wilful or wanton act of any person committed with the intention of causing such damage, other than damage to:

a) moveable property which is:

i) stolen or

ii) damaged in an attempt to remove it or part of it from any premises owned or occupied by the insured

b) moveable or immovable property which is damaged by thieves whilst breaking into or out of or attempting to break into or out of any premises owned or occupied by the insured

c) immovable property owned or occupied by the insured occasioned by or through or in consequence of

i) the removal or partial removal or any attempt thereat of

ii) the demolition or partial demolition or any attempt thereat of the said immovable property or

any part thereof with the intention of stealing any part thereof

provided that this extension does not cover:

1) damage related to or caused by fire or explosion;

2) consequential or indirect loss or damage of any kind or description whatsoever other than loss of rent if specifically insured;

3) damage resulting from total or partial cessation of work or the retarding or interruption or cessation of any process or operation;

4) damage occasioned by permanent or temporary dispossession resulting from confiscation, commandeering or requisition by any lawfully constituted authority;

5) damage related to or caused by any occurrence referred to in General Exception 2 a) i), ii), iii), iv), v), or vi) of this policy or the act of any lawfully established authority in controlling, preventing, suppressing or in any other way dealing with any such occurrence.

If we allege that, by reason of proviso 1), 2), 3), 4) or 5), loss or damage is not covered by this section, the burden of proving the contrary shall rest on the insured.

If any building insured or containing the insured property becomes unoccupied for 30 (thirty) consecutive days, the insurance in respect of this extension is suspended as regards the property affected unless the insured, before the occurrence of any damage, obtains the written agreement from us to continue this extension. During the period of the initial unoccupancy of 30 (thirty) consecutive days, you shall become a co-insurer with us and shall bear a proportion of any damage equal to 20% (twenty percent) of the claim before deduction of any first amount payable.

PERSONAL ASSETS INSURANCE POLICY CONTENTS (9/12) MARCH 2012

SPECIFIC EXCEPTIONS TO SECTION 2 - CONTENTS

We will not be liable for:

a) loss or damage caused, sustained or incurred outside the territorial limits of the Republic of South Africa, Lesotho, Botswana, Swaziland, Namibia, Malawi, Mozambique and Zimbabwe

b) theft of money and negotiable instruments unless stolen from a building mentioned in 2.g) i) to 2.g) iv) and there is forcible and violent entry or exit

c) theft from the private residence while lent, let or sub-let unless there is forcible and violent entry or exit

d) loss of or damage to more than one gold coin, stamp and coin collections, motor vehicles, caravans and trailers including their fitted accessories, air or water craft (not a surfboard or paddle ski) and their equipment

e) injury to animals (except as provided for in Cover Scope paragraph 10)

f) any amount in excess of one-third of the Household Contents sum insured for the total value of precious metals and stones, jewellery, watches, furs, rugs and carpets. Any claim for jewellery and watches will be limited to R5,000 (Five Thousand Rand) per item unless the value of such items can be substantiated by you by means of a purchase invoice or valuation certificate which pre-dates the loss

g) any amount in excess of R10,000 (Ten Thousand Rand) in respect of all DVD and CD collections

h) any amount in excess of 20% (twenty percent) of the Household Contents sum insured for the total value of all audio and/or visual equipment including but not limited to TV sets, Plasma screens, speakers and amplifiers

i) any amount in excess of R50,000 (Fifty Thousand Rand) in respect of property insured within any garage or outbuilding

j) loss of or damage to property more specifically insured

k) theft of property from the premises occurring whilst building alterations or renovations necessitating access onto the premises or into the buildings are undertaken by building contractors, casual labour, whilst you are not at home or whilst you are temporarily living in alternative accommodation unless such theft is accompanied by visible forcible and violent entry or exit from the premises. This exception does not apply to building alterations or renovations you undertake inside your home provided that all the protections, such as but not limited to walls fences burglar bars and alarm systems are not rendered inoperative by your actions.

SPECIFIC CONDITIONS TO SECTION 2 - CONTENTS

1. AVERAGE

It is important that you insure all your insured property for the correct value, which is the total, current replacement cost of your insured property. We have stated this as the sum insured on the schedule of the section. If at the time of any loss or damage, the amount which is need to replace all your insured property with similar new property is more than the amount for which it is insured, you will be considered as if you are your own insurance company for the difference and will bear a proportional share of the loss or damage accordingly. This general condition applies separately to each item in the policy schedule.

Example:

a) Loss R 24 000 b) Sum Insured R 75 000 c) Replacement Value R100 000 d) Settlement R 24 000 x 75 000/100 000 = R18 000 Less the appropriate First Amount Payable (i.e. 25% underinsured = 75% payment by us)

2. FIRST AMOUNT PAYABLE

In respect of any occurrence giving rise to a claim in terms of this section other than Property Occupiers Liability you will be responsible for the First Amounts Payable stated in the schedule.

3. CLAIM FREE GROUP

This section is subject to a claims free group provision as follows:

(a) If no claims have been paid under this section during any one annual period of insurance, the next renewal premium will be based on the following claim free group:

Existing claim free group: 0 1 2 3 4 5 Renewal claim free group: 1 2 3 4 5 5

(b) If any claims have been paid during the period of insurance, the next renewal premium will be

based on the following claim free group:

Existing claim free group: 0 1 2 3 4 5 Renewal claim free group: 0 0 0 1 2 3

Only claims made in terms of the insured events will affect the claim free group.

4. UNOCCUPANCY

In the event of the private residence being unoccupied for more than 30 (thirty) days, there shall be no cover in respect of loss of or damage to the property insured unless such unoccupancy has been disclosed to us and written consent has been obtained from us.

Occupation of the outbuilding does not constitute occupation of the private residence.

5. REINSTATEMENT VALUE CONDITIONS

In the event of the contents insured by this section being destroyed damaged or lost the amount payable will be calculated without any allowance or deduction for depreciation subject to the following Special provisions and subject to all terms limitations exceptions and conditions of this section and the General conditions and exceptions of the policy except insofar as same may be varied hereby.

Special provisions:

(a) We shall retain the right to repair or replace property lost, destroyed or damaged at any time

instead of paying the insured its value if it so wishes.

(b) If at the time of repair replacement or reinstatement the sum representing the cost which would have been incurred in repair replacement or reinstatement if the whole property covered had been destroyed, exceeds the sum insured thereon at the commencement of any loss destruction or damage to such property by any peril insured against by this section, the insured shall be considered as being his own insurer for the difference and shall bear a rateable share of the loss accordingly.

Each item of this section (if more than one) to which this clause applies shall be separately subject to this provision.

6. BURGLAR ALARM CONDITION (if stated in the schedule to apply)

Notwithstanding anything to the contrary contained in the policy wording and schedules, this section is subject to the following Burglar Alarm Condition. It is a condition precedent to liability in respect of loss of or damage to property of the insured (or for which they are responsible) by theft or any attempt thereat from the insured building stated in the schedule that a linked alarm is to be installed and that:

(a) the installed alarm as required by us is set and armed and made fully operative whenever the

protected building/s is/are not occupied; (b) loss of or damage to property insured following the use of the keys, the keypad code or remote

control of the burglar alarm or any duplicate thereof belonging to the insured is not covered unless such duplicate key, keypad code or remote control has been obtained by violence or threat of violence to any person or by theft;

(c) if the company who installed the said alarm system operates an armed reaction unit the contract

for the said alarm shall include the armed reaction unit’s services where available; (d) such alarm shall be maintained in proper working order but the insured shall be deemed to have

discharged their liability if they have maintained their obligations under a maintenance contract with the installation/service company of the alarm system;

(e) the control panel shall have an event log and the arming and disarming of the alarm is to be

logged and after the occurrence of a claim we will be entitled to request full information of the relevant log.

Abovementioned condition(s) shall be subject to all the terms, exceptions and conditions of this section of the policy.

7. FIREARMS – SPECIAL TERMS AND CONDITIONS

Subject otherwise to all the terms and conditions of this policy and for these conditions only, “safe” shall mean a SABS approved gun safe.

Failure to comply with these terms will result in rejection of a claim in respect of any loss of or damage, irrespective of the firearms being specified or not.

a) All firearms and ammunition must be kept in a locked safe (as defined) whilst not being used or carried by the licensed owner. Failure to do so will result in the rejection of a claim in respect of any loss or damage to such firearms.

b) A copy of the current firearm licence of the owner must be provided and any other compliance to any regulation relating to the possession of a firearm will be required by us in the event of a claim.

SECTION 3 - PERSONAL COMPUTERS

DEFINITIONS

For this section

a) You/your/yours/yourself includes members of your family normally resident with you.

b) Property insured means computer(s) (including its keyboard) monitor, printer and other accessories described in the schedule that belong to you.

COVER SCOPE

1. INDEMNITY TO YOU

a) If the property insured is physically damaged and can be repaired we will pay for the cost of repair less the First Amount Payable, or the sum insured less the First Amount Payable whichever is the lesser

b) if the property insured is lost or physically damaged and cannot be repaired we will pay the current replacement value of a new item of equal performance and/or capacity or, if this is not possible, we will pay the cost of replacement of new property having the nearest equivalent performance and/or capacity to the property lost or damaged less the First Amount Payable or the sum insured less the First Amount Payable whichever is the lesser.

provided that

(1) if you are unwilling or unable to replace the property insured or fail to replace within 6 months of the date of loss or damage the amount payable will be the market value of the property insured immediately before the loss or damage

(2) if at the time of loss or damage the replacement value of the property insured as new is greater than the sum insured you will be your own insurer for the difference and will bear a rateable proportion of the loss or damage.

2. INSURED EVENTS

a) Material Damage being physical loss of or damage to the property insured described in the schedule from any cause not specifically excluded. For this purpose General Exception 1. v) dealing with power surge is deleted. The cover in respect of laptops, notebooks and palmtops only is worldwide.

b) Reinstatement of Data/Programs

Costs and expenses necessarily and reasonably incurred by the insured limited to R5,000 (Five Thousand Rand) per claim for the reconstitution or recompilation of data and/or programs recorded on or stored in data-carrying media which are lost as a result of accidental erasure (which shall include the events defined in Cover Scope 2 a) Material Damage of this section) or by theft or by the deliberate, wilful or wanton intention of causing the cancellation or corruption of data or programs as provided for in this section of the policy.

provided that

(1) the indemnity shall not extend to nor include such costs incurred due to program errors, incorrect entry or the inadvertent cancellation or corruption of data and/or programs

(2) in respect of each and every event or series of events arising out of or in connection with one original cause or source indemnifiable by this item, the insured shall bear the amount stated in the schedule as the first amount payable

(3) where the insured elects to insure programs (software), a schedule of such programs shall be lodged with the company at the commencement of each period of insurance.

c) Incompatibility Cover

We will indemnify you for costs incurred in respect of:

i) modifications or alterations to the property insured directly consequent upon loss or damage covered by insured event 2.a) of this section to ensure the operating integrity of the computer

ii) replacement of legal programs to achieve compatibility with the modified or altered computer, provided such programs have been listed herein as insured programs and a replacement value declared therefore

iii) the restoration of previously captured data which has become inaccessible due to the modifications to or alterations of the computer or in consequence of the replacement or upgrading of legal programs

provided that

1) the costs allowed for in 2.c)i), 2.c)ii) and 2.c)iii) above shall be necessarily and reasonably incurred to maintain normal working conditions

2) such additional costs shall be incurred as a direct consequence of loss or damage covered in terms of insured events 2.a) and 2.b) of this section

3) the cover afforded hereunder shall be restricted to

(i) parts or components of the computer system which are not covered by insured event;

(ii) programmes or data reinstated and not covered under insured event 2.b)

4) the amount paid hereunder, in respect of any one event, shall not exceed R5,000 (Five Thousand Rand) per claim.

SPECIFIC EXCEPTIONS TO SECTION 3 - PERSONAL COMPUTERS

We will not be liable for:

1. IN RESPECT OF MATERIAL DAMAGE

a) loss or damage provided for under any maintenance and/or lease arrangement

b) loss or damage caused:

i) by vermin, moths or gradually operating causes ii) during any process of cleaning or upgrading iii) by confiscation or detention by any process of law iv) by wear and tear, development of poor contacts, scratching of painted or polished surfaces v) by viruses, trojans, worms or other similar destructive media

c) derangement unless accompanied by physical damage otherwise covered by this section

d) parts having a short life such as (but not limited to) cathode ray tubes, bulbs, fuses or sacrificial buffer circuits. If such parts are damaged as a result of damage to other parts we will indemnify you for the residual value of these parts

e) property insured lost from an unattended motor vehicle unless the property insured was concealed in a locked boot or compartment forming part of a locked vehicle and there is violent and forcible entry to the vehicle.

2. IN RESPECT OF RECOMPILATION OF DATA AND/OR PROGRAMMES

Accidental erasure caused by programme errors, viruses, trojans, worms or other similar destructive media, incorrect entry or the inadvertent cancellation or corruption of data.

SPECIFIC CONDITION TO SECTION 3 - PERSONAL COMPUTERS FIRST AMOUNT PAYABLE In respect of any occurrence giving rise to a claim in terms of this section you will be responsible for the First Amount Payable stated in the schedule.

SECTION 4 - ALL RISKS

DEFINITIONS

For this section:

a) You/your/yours/yourself includes members of your family normally resident with you.

b) Property insured, subject to the Specific Exceptions to this Section, means:

i) Unspecified Items (1) clothing but excluding leather jackets and coats (2) personal effects normally worn or designed to be carried on or by the person (3) personal kit normally worn or used by the person participating in sport belonging to you provided that our limit of liability in respect of any one item, pair or set shall not exceed 20% (twenty percent) of the sum insured but not exceeding R2,000 (Two Thousand Rand) per item whichever is the lesser.

ii) Specified Items (1) items of personal property as described in the schedule (2) money and/or negotiable instruments up to an amount of R1,000 (One Thousand Rand) per

claim

but does not include aircraft watercraft motor vehicles trailers caravans and their accessories animals or livestock and items used by the insured for business or professional purposes such as but not limited to cameras, instruments, tools, equipment, trade goods and stock.

COVER SCOPE

1. INDEMNITY TO YOU

a) Unspecified Items

If an unspecified item of property insured is accidentally lost or damaged we will pay for it or we may choose to repair or replace it provided that such payment or replacement does not exceed the limitation in Definition b) i) above.

b) Specified Items

If a specified item of property insured is accidentally lost or damaged we will pay for or we may choose to repair or replace it provided that such payment or replacement does not exceed the sum insured stated against the item.

2. COLLECTIONS

Stamps

If a stamp collection is specified in the schedule

a) we will only be liable if one or more complete pages of the collection are lost or damaged

b) our liability for any one stamp will not exceed two-thirds of the value stated in any current recognised catalogue limited to R5,000 (Five Thousand Rand) any one stamp.

Coins

If a coin collection is specified in the schedule we will not be liable for

a) current coins

b) more than R5,000 (Five Thousand Rand) for any one coin.

3. CONTENTS OF CARAVAN

If the contents of a caravan are specified in the schedule the following apply to that item.

a) Definition

Property insured means household goods, which belong to you or are your responsibility, while in the caravan or attached side tent.

b) Indemnity to you

If the property insured is accidentally lost or damaged we will pay for or may choose to repair or replace it. The amount payable will be the current replacement cost.

c) Specific exceptions to Caravan contents

We will not be liable for: i) the permanent fittings of the caravan ii) more than R1,000 (One Thousand Rand) for any one article iii) more than R1,000 (One Thousand Rand) per claim for theft of property insured while the

caravan or attached side tent is unoccupied unless there is forcible and violent entry iv) stamp and coin collections, money, documents, jewellery, furs or any article more specifically

insured v) loss or damage caused by fraud or dishonesty by any person to whom the caravan is on loan or

hire.

4. CAR RADIOS

If sound reproduction equipment (including 1 (one) tape or compact disc) fitted in a motor vehicle is specified in the schedule specific exception b) below does not apply to that item.

5. SAFE DEPOSIT

In respect of any item indicated in the Schedule as being kept in a bank safety deposit box, insurance in terms of this section only applies while the item(s) is contained in such safety deposit in a bank.

6. HOLE-IN-ONE – GOLF

Provided that you have insured your golf equipment as Specified Items under this section and if you score a hole-in-one playing as an amateur in a game of golf in terms of the rules at any recognised golf club we will pay R1,000 (One Thousand Rand) per claim on written confirmation by the secretary of the club.

7. FULL HOUSE – BOWLS

Provided that you have insured your bowls equipment as Specified Items under this section and if you are part of a team of two, three or four which, playing as amateurs, scores a full house (that is, all eight or nine woods/bowls to count) in a game of bowls in any competition played in terms of the rules of the South African Bowling Association, at any recognised bowling club, we will pay R1,000 (One Thousand Rand) per claim on written confirmation by the secretary of the club.

8. ITEMS IN TRANSIT

If any item of property insured and groceries including cleaning materials belonging to you and in your custody is accidentally lost or damaged whilst in transit to or from any place of purchase, repair or renovation, we will pay for the item or we may choose to repair or replace it provided that such payment or replacement does not exceed R5,000 (Five Thousand Rand) per claim.

SPECIFIC EXCEPTIONS TO SECTION 4 - ALL RISKS

We will not be liable for:

a) in respect of Unspecified Items: i) reading and other glasses, contact lenses, hearing aids, prosthetics, walking aids(with value

greater than R250 (Two Hundred and Fifty Rand), medical equipment, fire arms, pedal cycles, sporting equipment such as but not limited to golf clubs, bats, cues, golf bags, specialist bags, golf carts, roller blades and skate boards whether used for professional or recreational purposes, portable personal sound equipment such as but not limited to tape and CD players, iPod, MP3 players, car radios, navigational systems and global positioning systems or appliances, furs, musical instruments, laptops and computers including accessories, valuables in a safe deposit box, items valued at more than R5 000 (Five Thousand Rand) per item, portable television sets and medal collections

ii) pedal cycles greater than R1 000 (One Thousand Rand), cellular telephones, tools, stamp and

coin collections, money and documents

iii) more than one audio compact disc, dvd or tape

iv) motor vehicles (including the accessories), trailers, caravans, hang gliders, air and water craft other than surfboards and paddle skis

v) property more specifically insured

vi) loss or damage due to theft of clothing in excess of R1 000 (One Thousand Rand) from a

washing line on the premises of your private residence

b) property insured lost from an unattended motor vehicle unless there is forcible and violent entry to the vehicle

c) wear, tear or depreciation

d) electrical or mechanical breakdown not accompanied by other damage

e) the special value which any article may have as part of a set

f) the cost of reproducing sounds, data and images on tapes, records, film or magnetic media or any other electronic media

g) Loss or damage caused: i) by vermin, insects, termites, moths, scratching, denting, chipping, defacing, damp, any process

of cleaning, dyeing, bleaching, altering, repairing, restoring or gradually operating causes such as but not limited to rust, mildew, corrosion, wet or dry rot

ii) by domestic animals and/or pets iii) by confiscation or detention by any process of law

h) Loss, theft, destruction or damage to any cellular telephone unless the blacklisting reference number as provided by the cellular telephone service provider has been submitted to us as proof that the cellular telephone has been successfully disabled

i) Property for which more specific cover is available under this policy whether such cover has been granted, selected or not.

In respect of any claim for property insured in terms of this Section, you will be responsible for the First Amount Payable stated in the schedule.

SPECIFIC CONDITIONS TO SECTION 4 - ALL RISKS

1. EVIDENCE OF VALUE

We will not be liable for more than R5,000 (Five Thousand Rand) for any watch or article of jewellery unless a professional valuation dated prior to the loss is submitted.

2. PROOF OF OWNERSHIP

In the event of a claim, before indemnity for any one item will be considered, you will be required to submit documentary proof of ownership of the item being claimed for. Photographs will not be considered to be proof of ownership.

3. INSPECTION OF JEWELLERY

Where any single item of jewellery exceeds R20 000 (Twenty Thousand Rand) in value it is a condition that the precious stoned settings and necklace/bracelet clasps are inspected by a qualified jeweller every two years and that any defects are remedied. Proof of such inspection having been made within the two year period prior to the date of loss or damage will be required from you. Failing to comply with this condition will result in the rejection of any claims for such items.

4. PEDAL CYCLES

i) Pedal cycles and accessories left unattended outside the boundary of the residence must be attached by a security device to a permanent fixed structure.

ii) We will not pay for damage to the pedal cycle arising out of racing, pacing and trial runs.

5. FIREARMS - SPECIAL TERMS AND CONDITIONS

Subject otherwise to all the terms and conditions of this policy and for these conditions only, “safe” shall mean a SABS approved gun safe.

Failure to comply with these terms will result in rejection of a claim in respect of any loss of or damage, irrespective of the firearms being specified or not.

i) All firearms and ammunition must be kept in a locked safe (as defined) whilst not being used or carried by the licensed owner. Failure to do so will result in the rejection of a claim in respect of any loss of or damage to such firearms.

ii) A copy of the current firearm licence of the owner must be provided and any other compliance to any regulation relating to the possession of a firearm will be required by us in the event of a claim.

6. CELLPHONES

We will not be liable to indemnify you against loss, theft, destruction or damage to any cellphone unless you have provided the blacklisting reference number as provided by the cellphone service provider as proof that the cellphone has been successfully blocked from further usage.

SECTION 5 – PERSONAL LIABILITY

DEFINITION

For this section:

a) You/your/yours/yourself includes members of your family normally resident with you.

COVER SCOPE

1. INDEMNITY TO YOU

If you become legally liable to pay compensation for accidental death, bodily injury or illness or accidental loss of or damage to property occurring during the period of insurance we will indemnify you up to the amount shown in the schedule for any one accident or series of accidents arising out of one event including costs and expenses recoverable by any claimant from you and incurred with our written consent.

2. CREDIT CARDS

We will pay you up to an amount of R5,000 (Five Thousand Rand) in any 12 (twelve) month period of insurance against liability or loss arising from fraudulent use of your credit, cash or SIM (Subscriber Identity Module) cards by any person who is not a member of your family or household. We will not be liable to pay you if you have not reported the loss of the card to the issuing organisation as soon as reasonably possible or complied with the conditions of issue of the card.

3. SECURITY COMPANIES/GARDEN SERVICES

Specific Exception 4 of this section does not apply to any liability assumed in terms of a written contract entered into with any organisation providing security, armed response or garden services, in respect of property insured by Section I Houseowners and Section II Householders.

4. WRONGFUL ARREST

All sums which you are legally liable to pay for compensation or damages in respect of wrongful arrest or alleged wrongful arrest by you of any person other than

a) a person under a contract of service or apprenticeship with you

or

b) a member of your family or household

which arises out of your activities as a member of a neighbourhood watch or a block watch group or of a similar voluntary non-profit organisation.

Provided that the amount payable for all compensation and damages and all costs and expenses of litigation and all other costs and expenses will not exceed R50 000 in respect of all death, injury illness, loss and damage sustained during any 12 month period of insurance.

SPECIFIC EXCEPTIONS TO SECTION 5 – PERSONAL LIABILITY

We will not indemnify you for:

1. compensation payable to:

a) you or any member of your family normally resident with you b) any person acting in the course of their employment with you at the time of the accident other

than domestic staff c) your directors, members, trustees or beneficiaries or members of their families normally resident

with them if you are a Company, Close Corporation or Trust

2. compensation payable for loss of or damage to property in the custody or control of:

a) you or any member of your family normally resident with you b) any person acting in the course of his employment with you at the time of the accident c) your directors, members, trustees or beneficiaries or members of their families normally resident

with them if you are a Company, Close Corporation or Trust

3. compensation payable directly or indirectly due to:

a) your employment, business or profession b) the ownership of land or buildings (other than the private residence insured by Section I. and land

upon which they are situated provided the land is used for residential purposes) c) the occupation of land or buildings, other than your private residence including the land or

building d) death or injury or loss caused to any occupant in any motor vehicle, caravan, trailer, air or

watercraft (other than model aircraft, surfboard or paddle ski), operated, driven, owned by or in the custody or control of yourself or your domestic staff

4. liability accepted by agreement which would not have attached in the absence of the agreement.

SECTION 6 – VEHICLES

Definitions

For this section:

a) You/your/yours/yourself means the person in whose name this policy is issued and spouse/partner

and any other person named in the schedule.

b) Private Motor Vehicle means a vehicle including private light delivery vehicles and motorised private

caravans not exceeding 3500 kg.

c) Motorcycle means a motorcycle, tricycle, quadricycle, motor scooter (with or without side-car),

cruiser, or motorcycle trailer specified in the Schedule and owned by you.

d) Caravan or Trailer means a trailer or caravan (including its permanent fittings) without means of

self-propulsion, designed to be pulled by a self-propelled vehicle specified in the Schedule and

owned by you.

e) Vehicle means any vehicle described in b), c) or d) above.

SUB-SECTION A: OWN DAMAGE

COVER SCOPE – COMPREHENSIVE

1. INDEMNITY TO YOU

a) Loss of or damage to the Vehicle

If the Vehicle or any part of it is lost or damaged we will at our option indemnify you by:

i) paying for its repair at a repairer acceptable to us or replacement less the First Amount

Payable

or

ii) paying the amount of the loss or damage, less the First Amount Payable.

If the Vehicle is the subject of an instalment sale or lease agreement any money due to you will be

used first towards the repayment of the debt under the agreement. The receipt of the owners

referred to in the agreement will be a complete discharge to us for the repayment.

b) Maximum amount payable

i) Applicable to Private Motor Vehicles only

a) If you are the first registered owner of a new Private Motor Vehicle (provided that

the mileage does not exceed 30,000 km (thirty thousand kilometres) an within 12

(twelve) months of registration it is:

i) stolen or hijacked and not recovered and physically returned to us

or

ii) damaged and the assessed cost of repairs exceeds 70% of the current new

retail price including VAT (Value Added Tax)

the maximum amount payable by us will be the current purchase price of a new Private

Motor Vehicle of the same or a similar model or the limit of indemnity stated in the

schedule whichever is the lesser, less the First Amount Payable.

b) If the Private Motor Vehicle is lost or damaged:

i) more than 12 (twelve) months after first registration

or

ii) you are not the first registered owner of the Private Motor Vehicle

the maximum amount payable by us will be the limit of indemnity stated in the schedule

or the reasonable retail value of the Private Motor Vehicle at the time of loss or damage

whichever is the lesser, less the First Amount Payable.

ii) Applicable to Motorcycles, Caravans and Trailers only

The maximum amount payable by us will be the limit of indemnity stated in the

schedule or the reasonable retail value of the motorcycle, caravan or trailer at the time

of loss or damage whichever is the lesser, less the First Amount Payable.

2. EMERGENCY REPAIRS (applicable to Private Motor Vehicles only)

If after an insured even loss or damage occurs and the Constantia Loyalty Call Centre is unable to

assist you in terms of Section 10 – Assistance Service Programmes, then you may authorise

reasonable emergency repairs to the Private Motor Vehicle up to an amount of R5,000 (five

thousand rand) less the First Amount Payable without our consent provided a detailed quotation is

immediately given to us.

3. PROTECTION AND EMERGENCY REPAIRS (applicable to Motorcycles, Caravans and Trailers only)

If insured loss or damage occurs:

a) we will pay the reasonable cost of protection and removal of the motorcycle, caravan or trailer to

the nearest repairer;

b) you may authorise reasonable emergency repairs to the motorcycle, caravan or trailer up to

R2,000 (two thousand rand) less the First Amount Payable without our consent provided that a

detailed quotation is immediately given to us.

4. MEDICAL EXPENSES (applicable to Private Motor Vehicles only)

If any occupant of the Private Motor Vehicle sustains bodily injury as a direct result of loss of or

damage to the vehicle we will pay you the medical expenses actually incurred and paid by you in

connection with the injury up to R5,000 (five thousand rand) for each occupant injured limited to

R20,000 (twenty thousand rand) per occurrence if not otherwise insured or for which you will be

reimbursed from another entity.

5. TRANSPORT COST SHARING (applicable to Private Motor Vehicles only)

The acceptance of payment for giving lifts to passengers, when it is part of a vehicle sharing

agreement for social purposes or commuting, will not be regarded as excluded under the Description

of Use conditions, provided that:

a) the passengers are not being carried in the course of a passenger-carrying business;

b) the total payments received for such journeys do not involve any element of profit.

6. BEREAVEMENT EXPENSES (applicable to Private Motor Vehicles only)

If a Private Motor Vehicle insured by this section and of which you are either the driver or the

passenger is involved in a motor accident or if the Private Motor Vehicle is involved in a theft or

hijack resulting in your death within 3 (three) months of such events we will pay up to a maximum of

R5,000 (five thousand rand) if not otherwise insured or for which you will be reimbursed from

another entity.

7. TRAUMA (applicable to Private Motor Vehicles only)

If you are a victim of a violent act of theft, attempted theft, hold-up or hijacking which necessitates

professional counselling we will pay compensation up to a maximum of R5,000 (five thousand rand)

any one claim if not otherwise insured or for which you will not be reimbursed from another entity.

8. KEYS AND LOCKS

We will indemnify you for costs reasonably and necessarily incurred as a direct consequence of any

keys and locks including the remote alarm controller and, if necessary, the re-programming of any

coded alarm system lost or damaged up to R5 000 (five thousand rand) per claim.

9. WINDOW GLASS (applicable to Private Motor Vehicles and Caravans only)

Where there has been no other damage to the Private Motor Vehicle or Caravan we will pay for

damage to window glass (including sunroof) of the Private Motor Vehicle or Caravan without

alteration of the claim free group. You will be responsible for the First Amount Payable as stated but

if the glass is repaired, you will not have to pay this amount.

10. CREDIT SHORTFALL (applicable to Private Motor Vehicles only)

a) If any Private Motor Vehicle comprehensively insured under this section is:

i) stolen or hijacked (and not physically returned to us)

or

ii) damaged and the assessed cost of repairs exceeds 70% (seventy percent) of the reasonable

retail value

we will pay to the registered finance company that financed the purchase of the Private Motor

Vehicle any difference between the reasonable retail value and the settlement balance

outstanding under a valid credit agreement subject to the total payment not exceeding the limit

of indemnity stated in the schedule less the First Amount Payable.

b) The settlement balance outstanding is defined as the payment due at any specified date that

would settle the actual debt owing to the finance company but excluding:

i) payments and or interest in arrears;

ii) any additional finance charges;

iii) early settlement penalties;

iv) any other amounts refundable to you;

v) any legal costs owing to the finance company by you.

c) Cover under this extension is subject to:

i) liability having been admitted by us for loss or damage in terms of 1. INDEMNITY TO YOU;

ii) you providing us within 30 (thirty days) of the loss or damage a copy of the credit

agreement and a statement of your account reflecting the settlement balance outstanding

as at the date of loss or damage.

11. REPATRIATION CLAUSE

In the event of any occurrence giving rise to a claim while your Vehicle(s) is outside the Republic of

South Africa, you shall at you own expense be responsible for the repatriation of the Vehicle to the

Republic of South Africa.

We will not incur any liability in terms of this section of the policy until the insured Vehicle has been

repatriated to the Republic of South Africa.

12. CLAIM FREE GROUPS (applicable to Private Motor Vehicles only)

This section is subject to a claim free group provision as follows:

a) If no claims have been paid under this section during any one annual period of insurance, the

next renewal premium will be based on the following claim free group:

b) If any claims have been paid during the period of insurance, the next renewal premium will be

SPECIFIC EXCEPTIONS TO SECTION 6 – VEHICLES SUB-SECTION A: OWN DAMAGE

1. LOSS OF OR DAMAGE TO THE VEHICLE

a) We will not be liable for:

i) any type of radio and other sound reproduction equipment other than that installed by the

manufacturer of the Vehicle when new in excess of R1,000 (One Thousand Rand) in respect

of Private Motor vehicles and R750 (Seven Hundred and Fifty Rand) in respect of

Motorcycles;

ii) depreciation in value whether arising from repairs following an insured event or otherwise,

wear and tear, gradually operating causes such as but not limited to rust, mildew, corrosion

or decay, mechanical or electrical breakdown, failure or breakage;

iii) damage to tyres caused by the application of brakes or punctures, cuts or bursts;

iv) damage to the suspension caused by the inequalities of the road or other uneven surfaces;

v) vehicle sound systems, cell phones, other telephones, global positioning systems, by

whatever name and their accessories fitted or otherwise.

b) In addition to the exclusions as described in 1a) above the following exclusions will apply to

Motorcycles. We will not be liable for:

i) theft of accessories unless the Motorcycle is stolen at the time;

ii) damage to the engine or tyres or those parts of the Motorcycle actually connected to the

engine or tyres unless some other part of the Motorcycle is damaged at the same time by

direct impact.

2. GENERAL

We will not be liable for loss, damage, injury or liability caused, sustained or incurred:

a) outside the territorial limits of the Republic of South Africa, Botswana, Lesotho, Malawi,

Namibia, Swaziland, Zimbabwe and Mozambique except of loss of or damage to the Vehicle

while in transit by water between ports in the territorial limits. Cover in Zimbabwe and

Mozambique is restricted to own damage cover only;

b) while the Vehicle is being driven or used:

i) other than in accordance with description of use as described in Specific Condition 2;

ii) by you or any other person (with our consent and knowledge) unless licensed to drive the

Vehicle and in possession of a valid driving licence in terms of legislation applying to the

territory in which the Vehicle is being used. If a licence is subject to renewal the driver must

have held and not be disqualified from holding or obtaining such a licence.

If the licence is not renewed within 6 months of due date, no claim shall be entertained

under this section of the policy.

This exception will not apply if the Vehicle is being driven by you (or any other person with

your consent) while learning drive and complying with any legislation relating to learner

drivers is being obeyed;

iii) by you or any person (with your consent and knowledge) while under the influence of

intoxicating substance or has failed a breathalyser test or whilst the concentration of

alcohol in your bloodstream exceeds the legal limit as prescribed by Section 65 of the Road

Traffic Act (or as amended) or is under the influence of drugs having a narcotic effect;

iv) in a condition which does not comply with the provisions and regulations of The Road

Traffic Ordinances of the Republic of South Africa and includes any other related legislation

or any similar legislation which applies to the territories referred to in 2.a) above;

v) on a non-public road by any person not in possession of a valid driver’s licence or while

such person is learning to drive and is not complying with the laws relating to learner

drivers.

c) while a private goods light delivery vehicle is being used to carry goods or passengers for

business or professional purposes;

d) arising out of contract or by agreement which would not have attached in the absence of the

contract or agreement;

e) whilst the Vehicle is being used or driven on a race track of any kind for whatever purpose;

f) where your Vehicle has been stolen by another party under false pretence;

g) Where loss, damage or injury has been deliberately caused by yourself or any member of your

household or family, or anybody who acts on your behalf.

OPTIONAL COVER – IF STATED IN THE SCHEDULE TO APPLY

1. THIRD PARTY, FIRE AND THEFT COVER (Applicable to Private Motor Vehicles only)

a) Indemnity To You

Loss of or damage to the Private Motor Vehicles

If the Private Motor Vehicle or any part of it is lost or damaged by fire, lightning, explosion, theft

or attempted theft we will by payment or at our choice by repair or replacement indemnify you

by:

i) paying for its repair at a repairer acceptable to us or replacement less the First Amount

Payable

or

ii) paying the amount of the loss or damage, less the First Amount Payable,

If the Private Motor Vehicle is the subject of an instalment sale or lease agreement any money

due to you will be used first towards the repayment of the debt under the agreement. The

Maximum amount payable

The maximum amount payable by us will be the limit of indemnity stated in the schedule or the

reasonable retail value of the at the time of loss or damage whichever is the lesser, less the First

Amount Payable.

b) Specific Exceptions To Third Party, Fire And Theft Cover

Loss of or damage to the Private Motor Vehicle

We will not be liable for:

i) for any type of radio and other sound reproduction equipment other than radio and other

sound reproduction equipment installed by the manufacturer of the Private Motor Vehicle

when new;

ii) depreciation in value whether arising from repairs following an insured event or otherwise,

wear and tear, gradually operating causes, mechanical or electrical breakdown, failure or

breakage;

iii) damage to the engine or tyres or those part of the Private Motor Vehicle actually

connected to the engine or tyres unless some other part of the Private Motor Vehicle is

damaged at the same time or the engine or those parts of the Private Motor Vehicle

actually connected to the engine or tyres is damaged by direct impact;

iv) Medical Expenses, Credit Shortfall, Bereavement Expenses, Trauma, Keys and Locks and

Window Glass provisions as stated under Cover Scope – Comprehensive.

2. THIRD PARTY ONLY COVER (applicable to Private Motor Vehicles and Motor cycles only)

a) Cover is limited to provide for liability to Third Parties only as described under

Section B - Liability to Third Parties.

b) The following are deleted from Cover Scope – Comprehensive: 1. Indemnity to you,

2. Emergency Repairs, 3. Medical Expenses, 4. Transport Cost Sharing, 5. Bereavement, 6.

Trauma, 7. Keys and Locks, 8. Window Glass and 9. Claim Free Groups.

SPECIFIC CONDITONS APPLICABLE TO ALL COVER SCOPES UNDER SUB-SECTION A

1. FIRST AMOUNT PAYABLE

In respect of any occurrence giving rise to a claim in respect of the Vehicle, you will be responsible

for the First Amount Payable stated in the schedule.

If we have already paid any amount that is your responsibility in terms of this condition you will

immediately repay us that amount.

2. DESCRIPTION OF USE

a) Where the Use is stated in the schedule as Private the Vehicle may only be used for social,

domestic and pleasure purposes including travel to and from usual place of work as well as to

seminars, training and conference venues. Excluding use for the business or occupation of the

insured, hiring, carriage of passengers for hire or carriage of fare-paying passengers (including lift

clubs for reward), commercial travelling, the conveyance of goods for trade purposes, driving

instruction for reward, racing, speed or other contests, rallies, trials or use for any purpose in

connection with the motor trade.

b) Where the Use is stated in the schedule as Business the Vehicle may only be used for social,

domestic and pleasure purposes and use for the business or occupation of the insured, excluding

hiring, carriage of passengers for hire or carriage of fare paying passengers (including lift clubs for

reward), commercial travelling, the conveyance of goods for trade purposes, driving instruction

for reward, racing, speed or other contests, rallies, trials or use for any purpose in connection

with the motor trade.

In respect of 2.a) and 2.b) the term “motor trade” will not invalidate any cover provided to you while

the Vehicle is in the custody or control of any member of the motor trade and used only for its

maintenance or repair.

3. TRAFFIC OFFENCES

If during the currency of this section the licence of the driver of the insured Vehicle or any driver’s

licence in favour of the insured or his authorised driver is:

a) endorsed, suspended or cancelled

or

b) charged with or convicted of reckless, negligent or improper driving

notifications shall be sent in writing to us immediately after you have knowledge of such fact.

4. CARE OF VEHICLE

You shall take all reasonable steps to protect and maintain the Vehicle in accordance with the

roadworthy requirements of any legislation applying within the territorial limits. We may examine

the Vehicle or any part of it at any time.

5. RIGHTS OF OTHERS

The provision of cover for persons other than you does not give them the right to claim. You may

claim for them and your receipt will discharge us.

6. INDEMNITY TO OTHERS

If more than one person is entitled to indemnity by this section any limitation applies to the total

amount of indemnity and you will receive priority.

7. PRE-INSPECTION OF VEHICLE

We reserve the right to require you to undertake an inspection of your Vehicle by an inspection

agent approved by us.

8. UNAVAILABLE PARTS

If a part necessary for the repair of the Vehicle is not available in the Republic of South Africa as a

standard (ready-made) part, we will pay an amount equal to the value of the part at the time when

the loss or damage occurred. The amount excludes the cost of importing the part. The value of the

part will be determined according to the price stated in the most recent catalogue or price list.

9. TRACKING DEVICES

a) Private Type and Light Delivery Vehicles with a limit of indemnity below R200 000 (including

value added tax) must be fitted with a fully operational factory fitted immobiliser or immobiliser

approved by us in writing.

b) i) Private Type and Light Delivery Vehicles with a limit of indemnity of R200,000 (including

value added tax) or more must be fitted with an Original Manufacturer’s Equipment

Transponder key or a Tracking Device.

ii) Private Type and Light Delivery Vehicles with a limit of indemnity of R350 000 (including

value added tax) or more must be fitted with a Tracking Device.

In both instances as described in b) i) and b) ii) above, the installed Tracking Device must be

active and monitored on a 24/7 basis (not by client notification or intervention or

self-monitoring) AND must be approved by us in writing.

c) The onus is on you to ensure that the service agreement with any such tracking and monitoring

company is maintained at all times and that in the event for any reason you:

i) cancel your service agreement;

ii) fail to pay any subscription due under that agreement;

iii) fail to ensure that the Private Motor Vehicle is linked up to the tracking service and that the

vehicle tracking unit is operational and armed at all times;

then we shall not be liable in respect of loss or damage arising out of theft or hijacking.

10. ADDITIONAL SPECIFIC CONDITIONS APPLICABLE TO QUADRICYCLES AND OFF-ROAD MOTOR CYCLES

ONLY

It is hereby warranted that

a) the vehicle is kept behind locked gates or a locked garage overnight and when not in use;

b) additional accessories must be declared at retail price and this will increase the value on which

premium is charged;

c) whilst the vehicle is in transit on a licensed trailer it will only be covered for accident damage.

Loss or damage as a result of loading and off-loading is excluded;

d) cover in respect of loss of or damage to third party property is limited to the vehicle being

dislodged from the trailer whilst in transit;

e) cover in respect of loss of or damage caused by fire as a result of mechanical or electrical causes

are excluded.

SUB-SECTION B: LIABILITY TO THIRD PARTIES

LIABILITY TO THIRD PARTIES

a) In the event of an accident caused by or in connection with the Private Motor Vehicle or attached

Trailer, Caravan or Private Light Delivery Vehicle (other than for reward) we will indemnify you

against all sums including claimant’s costs and expenses for which you become legally liable for:

i) death or bodily injury to any person;

ii) damage to property.

b) We will pay costs and expenses incurred with our written consent.

c) We may arrange for:

i) representation at any inquiry into death

ii) The defence of criminal proceedings arising from any act related to an indemnifiable event.

d) In terms of liability to third parties as per a) and b) above we will:

i) Indemnify any person who is driving or using the Vehicle with your permission provided such

person

(1) is not entitled to indemnity under any other policy;

(2) as though he/she were you is subject to the terms of the policy as far as they can apply;

(3) has not been refused any motor vehicle insurance

ii) indemnify you while driving a Private Motor Vehicle or a Private Light Delivery vehicle with a

gross mass not exceeding 3 500kg excluding damage thereto not:

(1) owned by you;

(2) being purchased, leased or hired by you under a credit or similar agreement.

The First Amount Payable indicated in the schedule will not be applicable in respect of indemnity provided

under this cover scope

SPECIFIC EXCEPTIONS TO SUB-SECTION B: LIABILITY TO THIRD PARTIES

We will not be liable for:

a) death of or bodily injury to:

i) a member of your family normally resident with you;

ii) an employee, other than domestic staff, of yours or your family who is killed or injured in the

course of such employment;

iii) any passenger carried outside the cab portion of any Vehicle;

iv) any person travelling on or mounting onto or dismounting from a Vehicle.

b) damage to property belonging to or held in trust by or in the custody or control of you or your family

or being carried in a caravan or trailer;

c) so much of any compensation provided or insurable in terms of any motor vehicle insurance

legislation;

The maximum limit of liability in respect of a), b) and c) above are:

i) For liability consequent on fire or explosion not more than R1,000,000 including all costs and

expenses for any one accident or series of accidents arising out of one event;

ii) Passenger liability for not more than R1,000,000 including all costs and expenses for any one

accident or series of accidents arising out of one event;

iii) Any other event not more than R2,500,000 including all costs and expenses for any one accident or

series of accidents arising out of one event.

SECTION 7 - PERSONAL ACCIDENT

DEFINITIONS

For this section

You/your/yours/yourself means the insured person/s stated in the schedule.

COVER SCOPE

1. PAYMENT OF COMPENSATION

If you sustain bodily injury directly as a result of violent, accidental, external and visible means we will in respect of such injury pay to you (or in the event of your death to your nominated representative or if no representative is nominated your estate) the sum insured stated in the schedule if such injury shall be the sole and direct cause of death or disablement within 24 months of the date of the accident.

2. COMPENSATION

The percentage of the compensation as stated in the schedule and calculated as set out in the table below.

C Temporary Total Disablement necessarily preventing you from engaging in or undertaking your usual business or occupation.

D Medical, surgical, dental, hospital, emergency rescue and transportation expenses including artificial aids and prostheses incurred as a result of bodily injury as defined above.

If the percentage disfigurement under item (1) or (2) is less than 50% (fifty percent) of the surface area we will apply to the compensation concerned a percentage based on the extent that actual disfigurement bears to 50% (fifty percent) disfigurement.

We shall not be liable under item (1) or (2) unless the extent of disfigurement under item (1) or (2) individually exceeds 10% (ten percent) or until the permanent effect of medical and/or surgical treatment has been established.

Permanent total loss of use of a limb will be treated as loss by physical separation.

Where the injury is not specified we will apply a percentage of the benefit payable which is consistent with the provisions of this table.

The aggregate of all percentages payable for permanent disablement in respect of any one accident shall not exceed 100% (hundred percent) of the amount payable under item B.

EXTENSIONS OF COVER

1. PART PAYMENTS

Temporary total disablement payments will be made to you at intervals, provided a satisfactory medical report from the attending medical practitioner is submitted to us at the time of such temporary total disablement.

2. DISAPPEARANCE

If having examined all evidence accepted by a court of law declaring you dead, have no reason to suppose based on such evidence other than that an accident has occurred, your disappearance shall be considered to constitute a claim. If, at any time after payment has been made by us in settlement of a claim, you are found to be living, any sums we have paid in settlement of the claim shall be refunded to us.

3. EXPOSURE

Death or bodily injury resulting from starvation, thirst and/or exposure as a direct or indirect result of an accident shall be considered to constitute a claim.

4. LIFE SUPPORT

The 24 (twenty four) months period stated under Cover Scope shall not include any period or periods where your death is delayed solely by the use, for a period or periods of not less than 3 (three) consecutive days, of life support machinery, equipment or apparatus.

5. REPATRIATION

We will pay in addition to the Death compensation reasonable and necessary expenses for the repatriation of your body to your normal place of residence up to R5,000 (five thousand rand).

6. TRAUMA

We will pay up to an amount of R5,000 (five thousand rand) if you are a victim of a violent act of theft, hold-up, hijacking or unlawful assault which necessitates professional counselling following bodily injury directly as a result of violent, accidental, external and visible means.

7. BEREAVEMENT EXPENSES

In the event of an accident giving rise to a death claim we will pay R5,000 (five thousand rand) to your estate as a contribution to bereavement expenses.

PROVISIONS

1. No compensation shall be payable:

a) under item C where the period of disablement is less than 7 (seven) consecutive days

b) under item D where such expenses are less than R1,000 (one thousand rand).

2. Compensation under items C and D shall cease immediately:

a) when compensation becomes payable under item A

b) when compensation becomes payable under item B provided the bodily injury which resulted in the disablement has been cured or healed as far as reasonably possible.

3. Compensation shall not be payable under more than one of the items A and B in respect of the same accident.

4. Payments under item C shall cease as soon as you are deemed medically fit or able to return to your usual business or occupation.

SPECIFIC EXCEPTIONS TO SECTION 7 – PERSONAL ACCIDENT

We will not be liable for any claim resulting from:

a) Participation by you in:

i) any sport as a professional ii) parachuting, skydiving, hang gliding, wrestling, boxing or martial arts iii) racing, speed or endurance tests on or in power driven vehicles or craft iv) flying other than as a passenger in a licensed passenger carrying aircraft piloted by a duly

qualified person v) mountaineering where the use of ropes or a guide is necessary vi) bungee-jumping, scuba-diving, steeple-chasing, water-skiing, rugby, ice hockey, winter

sports, polo, football against professional clubs vii) big game hunting viii) motor cycling or quad biking ix) digging or sinking of mine pits or shafts, underground mining activities or the manufacture or

use of explosives

b) Any physical infirmity, condition or disability which existed prior to inception of this section of the policy.

c) Death or bodily injury directly as a result of violent, accidental, external and visible means whilst you are under the influence of intoxicating liquor or has failed a breathalyser test or whilst the concentration of alcohol in your bloodstream exceeds the legal limit as prescribed by Section 65 of the Road Traffic Act (or amended Act) or is under the influence of drugs having a narcotic effect.

d) Your suicide, attempted suicide or intentional self-injury.

e) An accident caused by or attributable to:

i) your participation in any riot, civil commotion, labour disturbance, strike or lockout or public disorder or any act or activity which is calculated or directed to bring these about

ii) the performance or attempt to perform

(1) any act whether on behalf of any organisation, body or group of persons calculated or directed to overthrow or influence any State or government, or any provincial local or tribal authority with force, or by means of fear, terrorism or violence

(2) any act which is calculated or directed to bring about destruction or damage or bodily injury in order to further any political aim, objective or cause, or to bring about any social or economic change or in protest against any State or government or any provincial, local or tribal authority or for the purpose of inspiring fear in the public or any section thereof

f) The General Exceptions 2.i), 2.v), 2.vi) and 2.viii) as stated more fully under the General section do not apply to this section.

g) Your service in the military, naval, police or air service of any country.

h) Death or permanent disablement if you are younger than 16 (sixteen) years of age or older than 70 (seventy) years.

SPECIFIC CONDITIONS TO SECTION 7 – PERSONAL ACCIDENT

a) Upon payment of any claim under item A or item B for which compensation as stated in the table of permanent disablement is 100% (one hundred percent) of the basic amount insured by that item the insurance and any further liability will cease immediately.

b) You must give notice to us:

i) of any physical infirmity which, to your knowledge, affects you ii) immediately of any change to a more hazardous occupation by yourself

c) This section will not continue in force beyond the period of insurance during which you attain the

age of 70 (seventy) years.

d) On the happening of any occurrence for which Compensation is payable you must employ the services of a registered medical practitioner and undergo any treatment the practitioner deems necessary.

e) You must submit to a medical examination at our expense as often as we require.

f) Compensation under Item A Death in respect of children under the age of 14 (fourteen) is restricted to limits prescribed by statute.

PERSONAL ASSETS INSURANCE POLICY WATER CRAFT (1/11) MAY 2011

SECTION 8 - WATER CRAFT

DEFINITIONS

For this section

a) You/your/yours/yourself means the insured person stated in the schedule and spouse.

b) Vessel means the vessel named in the schedule comprising the hull, superstructure, fittings, machinery, engines, inboard motors, dinghies, gear and equipment (not electronic equipment) such as would normally be sold as one unit but not exceeding 7 (seven) metres in length with a designed speed of no more than 54 (fifty four) knots or 100 (one hundred) kilometres per hour.

c) Outboard motors, tenders launching dollies/trolleys and trailers and any radios, echo-sounders and similar type navigation and/or navigational and/or electronic equipment, any covers and safety equipment are not included unless separately declared and valued in the schedule or by endorsement.

d) Complete vessel means the hull, superstructure, fittings, machinery, engines, motors, dinghy, gear and any radar and equipment as would normally be sold as one unit.

e) Private residence means your permanent home including all land within its boundaries.

f) A vessel is said to be used as a houseboat when she is not used under way, or navigating, but used while on moorings or in her berth by the owner or others for living on board, other than during holidays or vacations.

g) Replacement value of the vessel means the:

(i) new replacement cost where the vessel is less than 4 (four) years in age

(ii) reasonable market value where the vessel is older than 3 (three) years

h) Semi-rigid vessel means a vessel using pontoons, made of rubber or other material, which are inflated under pressure with a rigid hull.

i) Nautical mile means a distance of 1,852 (one thousand eight hundred and fifty two) metres.

j) Knot means 1 nautical mile per hour. 17 (seventeen) Knots – 31 (thirty one) k.p.h.

k) Inland waters of the Republic of South Africa shall mean all inland non-tidal navigable waterways of the Republic of South Africa including lakes, rivers and dams used for sport and recreational boating and also to include the confines of Durban Harbour (not seaward of the entrance channel), Knysna Lagoon (not seaward of the NSRI station), the Kowie River (not seaward of Port Alfred Marina) and the confines of the Langebaan Lagoon.

l) Coastal waters of South Africa shall mean the territorial waters around the coastline of the Republic of South Africa.

COVER SCOPE

SUB-SECTION 1 – LOSS OF OR DAMAGE TO THE VESSEL

INDEMNITY TO YOU

1. We will by payment or at our choice by repair or replacement indemnify you in respect of damage caused by a defined event. Repair or replacement shall be as close to the original specification as possible but we will not be expected to achieve an exact restoration.

2. Our maximum liability is the sum insured stated in the schedule or the replacement value of the vessel at the time of such loss or damage, whichever is the lesser.

3. If at the time of loss or damage the cost of replacing the vessel insured as per 2. above is greater than

the limit of indemnity stated in the schedule you will be your own insurer for the difference and will bear a rateable proportion of the loss or damage.

INSURED EVENTS

Damage to the vessel caused by external accidental means, including:

a) perils of the seas, rivers, lakes or other navigable waters, stranding, sinking or collision including collision with dock or harbour equipment or installation, land conveyance, aircraft and other aerial devises or articles dropped from them

b) fire, lightning, explosion, earthquake or volcanic eruption

c) malicious acts

d) jettison

e) piracy

f) outboard motor(s) dropping off or falling overboard provided that it is securely locked and/or bolted or chained to a permanent fixture in the hull

g) loss of or damage to the vessel excluding electrical equipment, batteries and connections, motors and connections (but not strut shaft or propeller) caused by:

(i) latent defects in hull or machinery

(ii) breakage of shafts or busting of boilers (excluding the cost and expense of replacing or repairing the broker shaft or boiler)

(iii) the negligence of any person whatsoever but excluding the cost or repairing any defect resulting from either negligence or breach of contract in respect of any repair or alteration work carried out for the account of the insured or in respect of maintenance of the insured vessel

h) accidents in loading, discharging or moving stores, gear, equipment, machinery or fuel, breakage of shafts, explosions, contact with aircraft

i) theft or attempted theft of:

(i) the entire vessel or her boat(s)

(ii) the outboard motor provided it is securely locked and/or bolted onto the vessel or her boat(s) by an anti-theft device in addition to its normal method of attachment

(iii) machinery including outboard motors, gear or equipment following forcible and violent entry into or exit from the vessel or place of storage or repair

(iv) the trailer whilst parked without the vessel

j) the cost of sighting the bottom after a grounding if reasonably incurred for that purpose even if no damage be found

k) loss of or damage to personal effects in the event of the vessel being stranded, sunk, burnt or in a collision.

SPECIFIC EXCEPTIONS TO SECTION 8 - WATER CRAFT – SUB-SECTION 1

We will not be liable for loss of or damage:

a) whilst the vessel is:

i) not seaworthy

ii) let out on hire or charter

iii) being towed on water except:

(1) when in need of assistance (2) for customary towage in connection with laying up, fitting out or repairs

iv) towing or salvaging a vessel other than one in distress v) towing or salvaging a vessel (whether or not in distress) under a contract arranged prior to

commencing towing or salvaging

vi) left moored or anchored unattended off an exposed beach, shore or river bank and it becomes stranded, sunk, swamped, immersed or breaks adrift

vii) caused while the vessel is being used otherwise than in accordance with the description of use

b) due to wear, tear, deterioration from use, scratching or denting, depreciation, corrosion

c) due to mechanical or electrical breakdown of machinery, engines, motors, batteries and their connections (other than the shaft and propeller) unless caused by:

(i) accidental incursion of water into the hull

(ii) the vessel being stranded, sunk, burnt, on fire, in collision or in contact with any external substance (ice included) other than water

(iii) accidents occurring whilst machinery, engines, batteries and their connections are being removed from or placed in the vessel or from or into a place of storage

(iv) malicious acts

(v) fire or accidental damage whilst in store

d) resulting from the dropping off of outboard motors unless the motors are bolted or chained to a permanent fixture in the hull

e) to sails or protective coverings split by the wind or blown away whilst set, unless in consequence of damage to the spars to which the sails are bent or occasioned by the vessel being stranded, sunk, burnt, on fire, in collision or in contact with any external substance (ice included) other than water

f) to masts, spars, sails, standing or running rigging whilst the vessel is racing unless such loss or damage is caused by the vessel being stranded, sunk, burnt, on fire, in collision or in contact with any external substance (ice included) other than water

g) to rudder, skeg, propeller, strut, shaft, motor, electrical machinery or batteries and their connections, unless caused by:

i) the vessel being stranded, sunk, swamped, overturned, capsized, burnt, on fire or in

collision with any other vessel, pier, jetty or submerged object ii) fire in the place of storage ashore iii) theft of the entire vessel iv) theft following upon forcible entry into the vessel or place of storage v) theft of outboard motor provided it is securely locked to the vessel by an anti-theft device in

addition to its normal method of attachment

h) to any part condemned solely because of a fault in design or construction or any cost or expense incurred by reason of betterment or alteration in design or construction

i) due to any defect resulting from either negligence or breach of contract in respect of any repair or alteration work

j) to personal effects, consumable stores, nets and fishing gear, moorings, scuba and/or diving gear and any other equipment not specified in the schedule

k) as a result of theft of:

(i) the complete vessel from a boat dealer’s premises if left there for sale

(ii) the complete vessel whilst left unattended at any time unless the vessel is

(1) within the walled and securely locked confines of the insured’s residence or at a recognised place of repair or service and theft is accompanied by visible forcible and violent entry or exit unless we have agreed in writing to the contrary

(2) at a recognised marina

(iii) inflatable craft when deflated unless following forcible and violent entry into the vessel or place of storage or if stolen with the vessel. A vehicle is not considered a place of storage within the terms of this policy

l) to the vessel’s dinghy if not permanently marked with the name of the vessel

m) to the vessel if used or occupied as a house boat or permanent residence

n) due to fire or explosion to a vessel fitted with inboard machinery unless the vessel is equipped in the engine room or engine space, tank space and galley with an automatic fire extinguishing system or one having controls at the steering position

o) in respect of a glitter or decorative graded colour finish of any kind where damages require a colour match re-spray and/or repaint other than the cost of making good the surface area actually damaged

p) to water-skis, ropes and all similar sporting equipment whilst being used or left unattended during use

q) to the sheathing or repairs thereto unless damage has been caused by the vessel being stranded, sunk, burnt, on fire or in collision or contact with any substance (ice included) other than water

r) to sailboards caused by Wave Jumpers, Trickboards or similar varieties or occurring due to the roof rack coming adrift from the vehicle or the method or fastening breaking or coming undone

s) to or disappearance of sails and/or other parts whilst carried on a roof rack or roof of any vehicle or on a trailer when left unattended in the open

t) to mast wishbone or sails during use

u) to semi-rigid vessels for more than the cost of patching or repair of a tear or ripping of the fabric of pontoons to any semi-rigid vessels under any circumstance

v) to submerged objects to any semi-rigid vessel under any circumstance

w) as well as injury or liability caused, sustained or incurred while the vessel is being used for racing, speed or other contests, competitions or tests (including regattas), or trials in connection with the vessel. This exclusion will not apply if the vessel is a sailing boat or yacht and the vessel is only under sail power

x) as a result of theft of trailer or trolley or any craft on such trailer or trolley unless the trailer or trolley is fitted with an anti-theft devise or otherwise immobilised or the trailer or trolley and craft are kept in lock-fast premises

y) the cost of remedying or rectifying any fault in design or construction, or in the event of damage resulting from fault in design or construction and giving rise to a claim under the conditions of this insurance, for any additional expenditure incurred by reason of betterment or alterations in design or construction, or for the cost and expense of replacing or repairing any part condemned solely in consequence of a latent defect or fault or error in design or construction

z) in respect of jet skis or similar craft so defined excluding water damage absolutely.

SPECIFIC CONDITIONS TO SECTION 8 - WATER CRAFT – SUB-SECTION 1

1. FIRST AMOUNT PAYABLE

a) You will be responsible for the amounts as stated in the schedule in respect of each and every claim arising out of any occurrence or series of occurrences with one original cause or source during any one period of insurance.

b) An additional amount as reflected in the Policy Schedule whilst the vessel is being:

i) launched through the surf from the time the vessel enters the water until it is 100 metres beyond the wave line

ii) landed through the surf from the time the vessel is within 100 (one hundred) metres of the wave line until it is out the water.

2. CARE OF VESSEL

You must take all reasonable steps to protect and maintain the vessel in a proper state or repair ad seaworthiness.

3. IMMERSION OF MOTOR(S)

In the event of immersion of the motor(s) in water, it is your duty to ensure that such motor(s) are immediately flushed out and restarted if practicable.

4. CONVEYANCE OF VESSEL

It is a condition of this insurance that the vessel is conveyed on a properly constructed and designed trailer or in or on a suitably modified vehicle.

5. FIRE FIGHTING EQUIPMENT

It is a condition of this insurance that any vessel fitted with inboard machinery shall carry a fire extinguisher or extinguishers as required by the Merchant Shipping (National Small Vessel Safety) Regulation, 2007 properly installed and maintained in efficient working order.

6. NEW MATERIAL REPLACING OLD

In the event of loss of or damage to a glitter or decorative finish, masts, spars, protective covers, sails, standing and running rigging and motors, up to one-third in respect of new material replacing old may be deducted.

SUB-SECTION 2 - LIABILITY TO THIRD PARTIES

INSURED EVENTS

We will indemnify you or any person using the vessel with your permission or any water skier being towed or preparing to be towed by your vessel against claims resulting from your or their legal liability for:

a) any damages including costs and expenses that the insured becomes legally liable to pay arising from the use of the vessel in respect of:

(i) injury (ii) damage

(iii) the cost of any actual or attempted raising removal or destruction of the wreck of the craft or

any neglect or failure to do so

b) any legal costs incurred with its written consent for representation at any coroner’s inquest or fatal accident inquiry or for contesting liability or taking proceedings

c) all accidental damage caused by any person (other than a person operating or employed by the operator of a shipyard, marina, repair yard, slipway, yacht club, sales agency or similar organisation) navigating or in charge of the vessel with the insured’s permission provided that:

(i) indemnity will not apply to claims by any member of the same household as that person

(ii) such person is not entitled to indemnity under any other policy

(iii) such person will observe, fulfil and be subject to the terms, conditions and exceptions of this policy in the insured’s place.

Our liability in respect of this sub-section is limited to R1 000 000 in respect of any one claim or series of claims arising from one event.

SPECIFIC EXCEPTIONS TO SECTION 8 - WATER CRAFT – SUB-SECTION 2

We will not be liable for:

a) death of or bodily injury to:

i) a member of your family ii) any person employed by you in any capacity by you in connection with the vessel or

similarly employed by any person using the vessel with your permission or similarly employed by any water skier who is killed or injured in the course of such employment

b) loss or damage to property belonging to or held in trust by or in the custody or control of you or your family

c) loss, damage, injury or liability: i) arising whilst the vessel is being towed by any motor vehicle ii) involving a trailer except when intentionally not coupled to a towing vehicle iii) accepted by agreement which would not have attached in the absence of the agreement

d) indemnity to you or the permitted user or water skier against claims resulting from legal liability for:

i) death or bodily injury in respect of any person employed in any capacity by you or any other

person in connection with the vessel or similarly employed by any person using the vessel with your permission or similarly employed by any water skier

ii) accidents arising from any person engaged in kiting or other airborne sport whilst being towed by the insured vessel or preparing to be towed by the insured vessel or until safely back on board the vessel

iii) accidents arising while the vessel is in transit by mechanically propelled road vehicle, rail, ship or aircraft

iv) death or bodily injury in respect of fare-paying passengers carried in or upon entering or getting on to or alighting from the vessel and loss of or damage to their property

v) damages or penalties arising under contract vi) any liability, cost or expense arising in respect of punitive or exemplary damages however

caused vii) fines or other penalties imposed under any statutory code or common law in respect of any

offence committed viii) death or bodily injury to any person operating or employed by the operator of a shipyard,

repair yard, slipway, yacht club, marina, sales agency or similar organisation ix) accidents whilst under the influence of an intoxicating substance x) accidents by any person, with your consent and knowledge, who you know is under the

influence of an intoxicating substance.

SPECIFIC EXTENSION TO SECTION 8 - WATER CRAFT – SUB-SECTION 2

WATER SKIERS’ EXTENSION (IF STATED IN THE SCHEDULE TO BE APPLICABLE)

Specific exception 1(d) of this sub-section is deleted in respect of water skiers only. In addition we will, subject to the limitations of this sub-section, pay for legal liabilities incurred by water skiers.

SUB-SECTION 3 - GENERAL

1. DESCRIPTION OF USE

Vessel used solely for private domestic and pleasure purposes excluding hiring or carriage of passengers for hire or fare-paying passengers, racing speed or other contests, rallies or trials.

2. CRUISING RANGE

a) Inland waters only situated anywhere within the Republic of South Africa (including Durban harbour and Knysna lagoon), Namibia and Zimbabwe.

b) As above, including coastal waters subject to a maximum of 80 kilometres from the coastline.

CLAUSES

1. REPLACEMENT OF GEAR AND EQUIPMENT

You may make deductions on account of new material replacing old following loss of or damage to sails, masts, spar, standing and running rigging, protective covers, batteries and outboard motors. No settlement will however exceed the values declared in the schedule.

2. POLLUTION

Where the vessel is damaged by a defined event and subsequently becomes a pollution, hazard or threat, we will pay for any loss or damage to the vessel caused by any government authority acting to prevent or minimise such pollution, hazard or threat.

3. MEDICAL EXPENSES

If the insured sustain injury as a result of the vessel sinking or being in collision with any external object other than water we will pay the medical expenses in connection with such injury in respect of each person injured up to R2,000 (two thousand rand) per occupant but not exceeding R10,000 (ten thousand rand) any one occurrence.

4. DUTIES AS OWNER

You and all users of the vessel will:

a) take all reasonable steps to maintain the vessel, outboard motors, trailers and other insured property in a proper state of repair, seaworthiness and roadworthiness

b) exercise all due care and diligence in the crewing of the vessel

c) do everything reasonably possible to minimise or avert loss or damage. We will pay for all charges and expenses reasonable and necessarily incurred by you in complying with this requirement provided this does not increase our maximum liability.

5. SURVEYS

When the age of the vessel exceeds 10 (ten) years, we will require to see a copy of an up-to-date independent professional survey report. The survey will be undertaken while the vessel is out of the water and at your own expense. We may request subsequent survey reports at our discretion.

6. LAUNCHING THROUGH SURF

When the vessel is being launched through the surf it will be fitted with at least two motors in workable and readily usable condition.

7. BREACH OF LAW AND REGULATION

You will not use the vessel, nor will you allow or cause it to be used, in contravention of any law or regulation promulgated by any authority, including but not limited to the Department of Transport regulations in terms of the Merchant Shipping Act 1951 as amended, insofar as they relate to pleasure craft.

8. REPAIRS AND TENDERS

We will have the right to nominate the place of repair or repairing firm and may also take tenders or may require tenders to be taken for the repair of the vessel. Any additional expenses arising from compliance with its requirements will be refunded to you.

9. CONSTRUCTIVE TOTAL LOSS

In ascertaining whether the vessel is a constructive total loss the replacement value will be taken as the repaired value and the damage or break-up value of the vessel or wreck will not be taken into account. No claim for constructive total loss based on the costs of recovery and/or repair of the vessel will be recoverable unless such cost would exceed the replacement value.

10. UNREPAIRED DAMAGE

In no case will we be liable for unrepaired damage along with a subsequent total loss sustained during the period of insurance shown in the schedule.

11. OTHER VESSELS OWNED

If the vessel should come into collision with or receive salvage services from another vessel owned wholly or in part by you, you will have the same rights under this policy as you would have if the other vessel was owned by someone else. In such a case, the liability of the collision or cost of salvage services shall be referred to a sole arbitrator to be agreed upon between you and us.

12. WRECKAGE REMOVAL

This policy shall also pay the expenses, after deduction of the process of the salvage, of the removal of the wreck of the insured vessel or dinghy from any place owned, leased or occupied by you.

13. REPATRIATION

In the event of loss of or damage to the insured vessel (other than Total Loss or Constructive Total Loss) occurring outside the Republic of South Africa and covered in terms of this policy you shall, at your own expense, return the insured vessel and damaged parts thereof to the place at which it is normally kept in the Republic of South Africa and notify the Insurers immediately upon its return. In event of total loss or constructive total loss you shall make immediate reports to the Police Station nearest to the area in which such loss occurred and to the insurers.

14. FIRE EXTINGUISHING EXTENSION

Any costs not exceeding 2.5% (two and a half percent) of the total sum insured relating to the extinguishing or fighting of fire shall be deemed to be damage to the insured property and shall be payable in addition to any other payment for which we may be liable in terms of this policy, provided you are legally liable for such costs and the insured property was in danger from the fire.

SPECIFIC EXTENSIONS TO SECTION 8 - WATER CRAFT We will pay for:

1. EMERGENCY AND SALVAGE CHARGES

All charges and expenses (up to the sum insured for the item concerned) reasonably and necessarily incurred in minimising or averting a loss which would be covered by this section.

2. USE BY OTHER PERSONS

Any person other than the operator or an employee of an operator of a shipyard, repair yard, slipway, yacht club, marina or vessel sales service or similar operation using the vessel with your permission will be regarded as you provided he complies with and is subject to the terms of the policy.

SPECIFIC CONDITION TO SECTION 8 - WATER CRAFT ADHERENCE TO SHIPPING REGULATIONS All regulation with regard, but not limited, to Skipper Licences, Certificate of Competency, Certificate of Fitness, Requirements for Water Skiing and Construction Requirements as stipulated in the Merchant Shipping (National Small Vessel Safety) Regulations, 2007 (or as amended) must be strictly adhered to failing which we will not be liable for loss or damage, injury or liability caused, sustained or incurred by any defined event herein stipulated. OPTIONAL COVER (IF STATED IN THE SCHEDULE TO APPLY) 1. CREDIT SHORTFALL

If any total loss settlement is less than the amount owing to the financier under a current instalment sale or lease agreement, we will pay you an additional amount equal to the shortfall less:

a) any arrear instalments or rentals including interest payable on such arrears

b) all refunds of premium for cancellation of any insurance cover relating to your vessel

c) the increased instalments or rentals that would have been paid had there been no residual capital value at the end of the finance period, calculated to the month in which the claim is settled

d) the First Amount Payable

Provided that the amounts payable shall not exceed the maximum indemnity less the First Amount Payable

e) this cover shall not apply to an agreement whereby the amount of any single instalment other than the final residual amount after the initial payment differs by more than 10% (ten percent) from any other instalment

f) if such shortfall is as a result of a re-advance under an instalment sale or refinancing in terms of a lease the insurance by this extension shall be void.

2. RACING RISK (SAILING VESSEL)

We will indemnify you in respect of loss of or damage by an insured event to sails, masts, spars, standing and running rigging whilst racing, but our liability will be two-thirds of the costs of repair or replacement up to a maximum of two-thirds of the sum insured as specified in the schedule as applicable to such items.

Specific Exception a) vii) of Sub-Section 1 does not apply to this extension. 3. TRANSIT RISKS

a) Any loss or damage following transit by land (including loading and unloading) but excluding scratching and denting and liability to third parties. This section also extends to include claims made by third parties for death, injury or damage arising out of such loading or unloading operations.

b) We will not be liable whilst the vessel is:

i) being conveyed by a person who has no valid driving licence unless the person concerned is charged with the theft or illegal use of the vehicle used for conveying the trailer

ii) under the control of any person who is under the influence of an intoxicating substance or while the concentration of alcohol in their blood exceeds the statutory limit.

Section 9 – EXTENDED UMBRELLA PERSONAL LIABILITY POLICY

This Policy, the Schedule and any endorsements attaching hereto, shall be read together

and considered to be one contract and any word or expression to which a specific meaning

has been attached in any of them, shall bear such meaning throughout. All words in bold

typeface are to be read in conjunction with the Definitions or Sections to which they refer.

In consideration of, and conditional upon, the prior payment of the Premium by or on behalf

of You and receipt thereof by or on behalf of Us, We are hereby bound to insure in

accordance with the terms, Exclusions, Conditions and limitations contained within this

Policy or forming part of any endorsement attaching hereto.

This Policy is conditional upon and will only come into effect following payment of the

Premium by You and receipt thereof by or on behalf of Us.

Wherever any reference is made to one gender it shall refer to the other gender provided

the context may be read correctly by way of such substitution. Similarly singular may be

read as plural and plural as singular.

This Policy is subject to the law of the Republic of South Africa

1. UMBRELLA LIABILITY

We will indemnify You up to the Limit of Indemnity stated in the Schedule for all sums which You

become legally liable to pay as damages arising from any occurrence anywhere in the World, but not

in respect of any judgment, award, payment or settlement made within countries which operate

under the laws of the United States of America or Canada (or in respect of any order made anywhere

in the World to enforce such judgment, award or settlement either in whole or in part) during the

Period of Insurance to the extent that:

(i) Such liability is not indemnifiable in terms of the Insuring Clause and/or Insurable

Events Clause and/or Operative Clause of any Underlying Insurance; or

(ii) Such liability is not indemnifiable by reason of an Exclusion in any Underlying Insurance;

or

(iii) The amount of such liability exceeds the Limit of Indemnity of the Underlying Insurance and

the Underlying Insurer has paid or has admitted liability or has been held liable to pay the full

amount of the Limit of Indemnity of the Underlying Insurance, which for purposes of this Policy

is deemed to be a minimum of R1 million, but R2 500 000 in respect of Motor Liability.

2.DEFINITIONS

a)“Underlying Insurance” shall mean an existing insurance policy in force with

(i) A registered South African, Namibian, Botswana or Mozambican Insurer which covers one or

more of the following:

Personal liability

Property Owners Liability

Tenants Liability

Motor Liability

Watercraft Liability

(ii) Any Insurer in the World which covers one or more of the following:

Motor Liability

Watercraft Liability

Property Owners Liability

in respect of any property, watercraft or motor vehicle hired, leased or owned by You,

outside the territories mentioned in (i) above.

b) “Policy” shall mean this document and any attachments hereto

c) “We”, “Our” and “Us” shall mean The Hollard Insurance Company Limited

a) “You” and “Your” shall mean The Insured stated in the Schedule including Your

spouse, any members of Your immediate family who normally reside with You

and are financially dependent on You

1. COSTS AND EXPENSES

The Limit of Indemnity includes all legal costs and expenses;

(i) Recoverable by or on behalf of any third party from You

(ii) Incurred by You with Our written consent which consent will not be

unreasonably withheld

EXCLUSIONS

This insurance specifically excludes any liability:

1. Arising out of and in the course of Your employment, business or profession including

but not limited to the sale of any goods or the rendering of any service for a fee,

reward or any other consideration

2. Arising out of the letting and/or hiring out of any movable or immovable property or

part thereof for a fee, reward or any other consideration

3. The first R10 000 of any claim in relation to any property hired, leased or borrowed by

You

4. Arising out of the reckless disregard by You of the possible consequences of Your acts

or omissions

(i) of one insured party to another

(ii) to any former party in respect of an occurrence during any period when such

former party was an Insured

5. arising out of loss of or damage to property to the extent that such liability is

indemnifiable under any other insurance policy

6. arising out of the ownership or use of any aircraft other than model aircraft

7. which is the subject of statutory or similar legislation controlling the use of any motor

vehicle or trailer and in respect of which liability;

(i) You are compelled to effect insurance or to furnish security

(ii) The State or other governmental body or authority has accepted responsibility

8. For any claim in respect of Motor Liability unless such liability is indemnifiable by any

of the Underlying Insurances, other than any claim excluded solely by reason of any

territorial restrictions

9. For any claim in respect of Watercraft Liability:

(i) Unless such liability is indemnifiable by any of the Underlying Insurances, other

than any claim excluded solely by reason of any territorial restrictions

(ii) Where the overall length of the watercraft is greater than 10.5 metres

10. For loss of or damage to any self-propelled land vehicle, trailer, caravan, watercraft or

aircraft in Your care, custody or control

11. Arising out of any dishonest, fraudulent or malicious act, or acts of physical assault or

seduction committed by You

12. For the payment of any fine, penalty, multiple, punitive or exemplary damages or

arising out of liquidated damages clauses, penalty clauses or performance warranties

except to the extent that it can be proven that liability would have attached in the

absence of such clauses or warranties

CONDITIONS

1. The indemnity granted by this Policy is conditional upon there being in force at the

time of the occurrence an Underlying Insurance which substantially provides cover for

the type of liability for which indemnity is sought hereunder and upon You not being

in breach of the conditions of such Underlying Insurance

2. This Policy will be governed by the laws of the Republic of South Africa, Namibia,

Botswana or Mozambique (depending on where the original Underlying Insurance

was issued) whose courts shall have exclusive jurisdiction in any dispute between You

and Us.

3. Written notice must be given to Us as soon as possible of any event that may give rise

to a claim under this Policy and You shall furnish such further information as We may

reasonably require. Every claim, writ, summons or process and all related documents

must be forwarded to Us as soon as possible. Inadvertent failure to give notice as

aforesaid because You could not reasonably have anticipated that the event would

give rise to a claim under this Policy will not be construed as a breach of this condition

4. In respect of any claim not covered at least in part by an Underlying Insurance, We

may take over and conduct in Your name the defence and settlement of any claim or

prosecute in Your name for Our own benefit and will have full discretion in the

conduct of any proceedings and in the settlement of any claim. You will give all

necessary information and assistance as We may require.

5. If the indemnity granted by this Policy is covered by any other liability insurance We

will not pay more than Our rateable proportion of the loss.

6. If any claim under this Policy is in any respect fraudulent all benefit under this Policy

in respect of such claim shall be forfeited

7. This policy may be cancelled by either You or Us by the giving of thirty (30) days

written notice of such cancellation, provided that if the premium is paid monthly and

if it is not paid to Us within 7 days after due date this Policy may be deemed to have

been cancelled at midnight on the last day of the month for which premium was paid

unless You can show that failure to make payment was an error on the part of the

bank or other payment agent

8. The due observance and fulfillment of all provisions in this Policy that require anything

to be done or complied with by You shall be precedent to Our liability in respect of

any occurrence for which You make a claim under this Policy

9. We may pay You, in respect of any claim made, the maximum indemnity (but

deducting any amounts already paid) or any lesser sum for which the claim may be

settled and We shall thereafter have no further liability in respect of such matter

10. No admission, offer, promise or payment shall be made in relation to any claim under

this Policy by You without Our written consent. You will take all reasonable steps to

ensure that the Underlying Insurer complies with this condition and co-operates with

Us in the defence and settlement of any claim indemnifiable both by an Underlying

Insurance and this Policy, and in the exercise of any subrogation rights. The costs

incurred in exercising such rights and any amounts recovered shall be apportioned to

each party according to the sums paid or payable under the respective policies.
