INTRODUCTION

I, the Chairman of the Committee on Subordinate Legislation, having been

authorized by the Committee to present the Report on its behalf, do hereby present this

One Hundred and fifty fifth Report of the Committee.

1.2 The Committee considered and adopted the Report in its meeting held on the 17th

March, 2005.

1.3 The notifications containing Rules/Regulations, etc. laid on the Table of the Rajya

Sabha during its 202nd session (July --- August, 2004) have been perused by the

Committee in the light of the provisions of the Acts under which these were framed and

also with a view to seeing whether these have been laid properly and within the prescribed

time-frame. The Committee's observations/recommendations are contained in the report

that follows.

I

LAYING OF STATUTORY ORDERS ON THE TABLE OF RAJYA SABHA

During the 202nd Session of the Rajya Sabha, 593 Statutory Orders were laid on the

Table of the House by various Ministries/Departments. The details of the Gazette

Notifications in which these were published and the date of their laying on the Table of

the Rajya Sabha have been indicated in the Ministry-wise statement (Annexure). Out of

the 593 notifications that were laid there has been a delay in laying of 53 notifications as

per the details given below :

2. During the course of scrutiny of these Notifications/Orders, the Committee has noted

some cases of abnormal delay ranging from 2 to 6 years between the date of notification

of the Order and the date of its laying. The annexed statement also indicates the period

of delay in cases where notifications have not been laid as per the schedule prescribed by

the Committee and also whether such notifications were accompanied by any statement

indicating the reasons for the delay in laying. The observations/recommendations of the

Committee in respect of the specific Ministries/Departments are as follows:----

(i) Ministry of Environment & Forests

The Committee notes with regret that the Ministry of Environment and Forests have

delayed the laying of 6 of their notifications (Sl. No. 35-37 and 41-43) out of the 17

notification laid by them during the 202nd Session. The delay ranges between 10 months

and 1 year 4 months. Further, the Ministry have appended the delay statement with 3

notifications (Sl. No. 41-43) only and the remaining 3 notifications (Sl. No. 35-37) were

not accompanied by delay statements. The Committee recommends that the Ministry of

Environment & Forests should strictly adhere to the time schedule as recommended by

it in its 131st Report in laying of the Subordinate Legislation before Parliament and in

case of any delay in laying of the notifications, a delay statement should also invariably

be appended therewith.

(ii) Ministry of Finance

The Committee is unhappy to note that out of the 320 notifications laid by the

Ministry of Finance during the 202nd Session, there has been a delay in laying of 27

notifications listed at Sl. Nos. 51-55, 131-138, 139, 140-143, 144, 145-146, 147, 148-151 and

152 of the Annexure. The period of delay range from a minimum of 9 months to the

maximum of 3 years and 6 months. The Committee views with serious concern that in

spite of its repeated recommendations regarding the timely laying of subordinate

legislation, there has not been any appreciable improvement in the position.

The Committee further notes that all the delayed notifications pertain to the

Department of Economic Affairs (Banking Division). The reasons for delay which have

been appended with some of these notifications, such as, “copies of the notifications were

not received in time” are also not plausible enough to justify the delay that range between

1-3 years. The Committee notes with regret that the Ministry of Finance have again failed

to strictly adhere to the time schedule as prescribed in its 131st Report. The Committee

hopes that the Ministry of Finance would put an effective mechanism in place to eliminate

such instances of delay in future, particularly on account of delay in receiving printed

copies of the notifications. The Committee hopes that the Ministry of Finance would be

able to plug the loopholes so that delays do not recur in future.

(iii) Ministry of Information and Broadcasting

The Committee notes that the Ministry of Information and Broadcasting laid two

notifications (Sl. Nos. 392 and 393) and both were delayed by more than one year.

Further, the Ministry did not append any delay statement with these notifications. The

Committee recommends that the Ministry of Information and Broadcasting should take

note of the time schedule as prescribed by it for laying of the Subordinate legislation and

take necessary corrective steps so that such instances do not recur.

(iv) Ministry of Personnel, Public Grievances and Pensions

The Committee notes with regret that the Ministry of Personnel, Public Grievances

and Pensions delayed the laying of 11 notifications (Sl. Nos. 409-419) out of 16 laid by

them during the 202nd Session. Further, none of the delayed notification was accompanied

by a delay statement. The period of delay was also substantial, ranging between 1 to 2

years. The Committee recommends that the Ministry of Personnel, Public Grievances

and Pensions should take necessary corrective steps in the right earnest so that they are

able to lay their Subordinate Legislation on time. The Committee further recommends

that the Ministry should invariably apprise the House about the reasons for delay

through delay statement in case they are unable to lay any ‘Order’ on time.

3. The Committee also notes that there has been delay in laying of one notification each

by the Ministries of Health and Family Welfare (Sl. No. 371), Home Affairs (Sl. No. 376),

Human Resource Development (Sl. No. 386), Labour and Employment (Sl. No. 394),

Railways (Sl. No. 444), Shipping, Road Transport and Highways (Sl. No. 538) and Urban

Development (Sl. No. 593). In case of notification at Sl. No. 538 (Ministry of Shipping,

Road Transport and Highways) the delay is of 6 years and 11 months. Further, the

notifications at Sl. Nos. 386, 394 and 593 were not accompanied by delay statements. The

Committee hopes that these Ministries would devise appropriate measures to cut on the

delay in laying of the notifications. They should also be particular to append delay

statement in case the laying of Subordinate Legislation is delayed.

4. Besides, the timely laying of Subordinate Legislation, the Committee has been

consistently reiterating that each notification should have a distinctive number so that

the same is identifiable. However, during the 202nd Session the Committee has came

across three instances where the notifications were laid without a distinct number. These

notifications pertain to the Ministry of Communications & Information Technology (Sl.

No. 19), the Ministry of Finance (Sl. No. 132) and the Ministry Human Resource

Development (Sl. No. 390). The Committee reiterates that every notification should have

a distinctive number to give it a separate identity. The Committee recommends that such

instances should not be repeated and Ministries/ Departments should ensure that every

notification is assigned a distinct number so that the same is identifiable at any later stage.

5. The Committee impresses upon all the Ministries/Departments to take immediate steps

to ensure timely and proper laying of subordinate legislation. The Committee,

accordingly, wishes to bring to the notice of all Ministries/Departments of the

Government of India, particularly, the defaulting ones, the following recommendations,

as contained in its 131st, 135th and 152nd Reports:

“Orders required to be laid before the House should be laid

(i) if the House is not in Session, during the Session immediately following the date

of publication of the Order in the Official Gazette and (ii) if the House is in Session,

on the date of the publication of the Order, during its continuance and in case the

time lag between the date of publication and the date of the closing of the Session is

less than 15 clear days, before the expiry of the Session immediately following the

said Session. All the Ministries/Departments of Government of India should

henceforth comply with this schedule in the matter of laying of the Orders issued

under various Acts of Parliament on the Table of the Rajya Sabha.”

“The Committee has, time and again, emphasized that it is essential that in case there

is a delay in the laying of Statutory Orders, the concerned Ministry/Department

should invariably append a delay statement along with the notifications being laid so

as to apprise Parliament of the causes of delay. The Committee desires all

Ministries/Departments to take a note of this, since the intension is that through the

process of formulation of a delay statement the Ministry is able to introspect,

identifying bottlenecks and devise remedial

measures”. (135th Report)

“In the opinion of the Committee, every notification should be assigned a distinctive

number in order to give it a separate identity and similarly, no notification should be

published/laid which does not carry a notification number. The Committee expects

all Ministries/ Departments of Government of India to exercise caution in this regard.

In case where there are more than one notification under a single file, the Ministries/

Departments should ensure that the file number on each notification should be

suitably distinguished from one another.
