Threadbarediscussion was held on sanita-tion, traffic regulation, parking,health care facilities, supply of es-sential commodities, sale of sacri-ficial animal, drinking water,electricity etc. ADC directed PDDand PHE to ensure uninterruptedpower supply besides adequatewater supply to the habitants ofthe district during Eid celebra-tion especially during prayertime. The Kargil region today wit-nessed heavy rush in the shopsand other business establish-ments with people thronging en-thusiastically for Eid-u-Azhashopping. Asserting that therewas ambiguity in the Thirdschedule of the J&K Re-or-ganization Act 2019, Mr.Harsh Dev Singh JKNPPChairman and FormerMinister today called for astatement from the UnionGovt and the UnionMinistry for law and jus-tice rather than using stateofficers to browbeat themedia and to crush thosewho had the temerity toquestion. He was referringto the statement ofDivisional Commissionermade in the media whereinthe latter had hinted atPolice action against themedia and others who werespreading reports of re-or-ganization of Districts anddeletion of certain districts

during the process of re-cent re-organization ofJ&K.

Calling upon the UnionGovt to take note of the am-biguity in Third scheduleunder sec 14 (5) of J&K Re-organization Act, Mr.Harsh Dev Singh pointedout that the names of EightDistricts created in 2006-07were conspicuously miss-ing.

He said that despite theThird schedule subtitled as“Amendments to theDelimitation of Assemblyconstituencies order, 1995”with a further sub headingof “Union Territory ofJammu and Kashmir”, thenames of several Districtsincluding Samba, Reasi,Ramban and Kishtwarwere not mentioned in theTable creating genuine ap-

prehensions that these dis-tricts had been disbandedin the process of Re-organi-zation of state.

And whereas the Re-or-ganization Act in the footnote of the said third sched-ule had given clarificationwith regard to Tehsils,Patwar circles and NACsforming a part of variousAssemblies, no such clari-fication had been givenwith respect to Districts,revealed Mr. Singh. He re-gretted that rather thanUnion Govt making a state-ment on the subject, thestate bureaucrats were be-ing used by BJP to silencethe voice of people.

Maintaining furtherthat the J&K Re-organiza-tion Act 2019 having beenpassed by both Houses ofParliament in the present

form, the DivisionalCommissioner had no pow-ers to rectify the anom-alous situation.

He said that mere me-dia statement and hurlingof threats by the DivisionalCommissioner did not suf-fice to address the concernsof the people who had gen-uinely pointed out certainabstruse and incongruousaspects in the Re-organiza-tion Act.

He said that the anom-alous situation could haveinadvertently crept in thesaid schedule but could berectified only by theParliament as theDivisional Commissioneror any other authority hadno powers to add or deleteany provision in a Billpassed by the UnionLegislature.

The chairman ofBidhannagar MunicipalCorporation (BMC) KrishnaChakraborty was sworn in asmayor of the corporation onSaturday.

The post of mayor has beenlying vacant after SabyasachiDutta, the first mayor of thecorporation which was formedin 2015, resigned from the poston July 18 following differ-ences with the party leadershipand a majority of councillorsexpressing no confidenceagainst him.

Chakraborty said she ishappy that the party leader-

ship has reposed faith in herand she will do her best to liveup to the expectations of thepeople.

"During preliminary questioning,these Bangladeshi illegal intruders revealed that theycame into India with the help of Bangladeshi touts,"the statement, issued on Saturday, said.

The arrested persons have been handed over to re-spective police stations for further legal action, itadded.

Speaking about air and roadconnectivity, he said, "The roadand air connectivity in the statehas improved compared to pre-vious years. The work on build-ing 11 new airports, includingthe international airport atJewar, has also been expedited."

He said the work on buildingPurvanchal Expressway hasbeen expedited and it will beopened for public in 2020.Similarly the BundelkhandExpressway and other express-ways will be made operationalin time.

The chief minister said alldistrict headquarters in thestate have been linked by four-lane roads.

UP CM stresses on associating youths with tourism

Two staffers of private car-rier GoAir have been booked forallegedly abetting the suicide ofa 19-year-old employee of theairline here, city police said.

Manthan Chavan, whoworked as GoAir's trainee rampofficer at Nagpur airport, hadallegedly committed suicide athis home in Nagpur on May 30,police said. In a statement is-sued on Friday, Ajni police saidthat an offence was registeredagainst Akshay Patil, managerof GoAir (Nagpur) and NilayJanbandhu, senior officer oframp operations, under IPC sec-tions 306 (abetment of suicide)and 34 (common intention) onThursday.

"During the investigation, itwas found that the deceased,Manthan Chavan, was on sickleave (when the incident hap-

pened). However, he was undermental pressure as he was con-stantly getting calls and mes-sages from Akshay Patil andNilay Janbandhu, who askedhim to resume duty, whichdrove him to commit suicide,"the police said. According to po-lice, Chavan hanged himselffrom an iron rod of a ventilatorat his home in ChandramaniNagar. His father, MahendraChavan, had later lodged a com-plaint saying that Manthan wasnot keeping well and sufferingfrom jaundice. He had been onleave since 10 to 12 days beforethe incident, he had said.

In the complaint, he had alsoalleged that his son might havetaken the extreme step due towork stress. Police hadlaunched a probe into the casebased on his complaint.

Meanwhile, the Mumbai-headquartered budget airline

has said that police have"wrongly booked" two of its em-ployees. It also said that its legalteam was "ascertaining thefacts" and will decide about the"next course of action". "GoAirhas extended full cooperationand support to the investigatingauthorities in the 19-year-oldemployee Manthan MahendraChavan suicide case," the air-

line said in a statement issuedon Friday. "Chavan was work-ing with GoAir as a traineeramp officer at Nagpur airportfor about nine months. GoAirshall obtain a copy of the FIRfiled by Nagpur Police, in whichtwo employees Akshay Patiland Nilay Janbandhu havebeen wrongly booked," it added.

Nagpur police had recorded

the statements of GoAir em-ployees on two different occa-sions in the past and all requi-site information related to thematter had been handed over tothe authorities, as requested, itsaid. "The initial enquiry wasconducted and the authoritiesdid not find any complicity ofthe employees in the incident.

Our legal team is ascertain-ing the facts and after taking aconsidered view, we will decidethe next course of action," itadded. "GoAir deeply regretsthe demise of Chavan who left asuicide note, where he wishedhis mother a happy birthdayand apologised for committingsuicide. Our hearts go out to theparents and family members ofyoung Manthan. With immedi-ate effect GoAir had releasedhis dues and other compensa-tion as per the Company poli-cy," it said.

The Centre has declared twowildlife sanctuaries near Mumbai as'Eco-Sensitive Zone'(ESZ), accordingto Union Minister for EnvironmentPrakash Javadekar.

The two wildlife sanctuaries inMaharashtra are TungareshwarWildlife Sanctuary (TWLS) and TansaWildlife Santuary (TWS), both lushgreen areas spread across several hun-dred square kms in Palghar and Thanedistricts adjoining Mumbai. They alsoserve as the catchment areas for lakesand reservoirs supplying drinking wa-ter to the country's commercial capi-tal."I have approved the final ESZ noti-fication in respect of TWLS inMaharashtra. This will help scientificconservation of eco-systems and at thesame time will give relief to farmers,artisans, rural people, small business-es in the area between final ESZ and 10km from the protected areas, whichwas banned earlier," Javadekar said intweets on Friday.

The total protected area of theTWLS is around 86 sq km and will havethe ESZ of 67 sq km. For the TWS, thetotal protected area would be around305 sq kms with the ESZ of around 490sq km which will also include 150 vil-lages.

Both the TWLS and TWS are

ranked as major habitats for severalwildlife, including leopards.

The Sanjay Gandhi National Parkin Borivali, which is sprawled acrossMumbai's north-east and north-west-ern suburbs, itself is home to around 45leopards, different varieties of deer,Sambar, four-horned Antelope, RhesusMacaque, Bonnet Macaque, monkeys,grey Langur, Indian Flying Fox, spot-Striped Hyena and a large number ofbirds and insects.ation in respect ofTWLS in Maharashtra.

Experts said that declaring an ESZ,or a buffer zone, around a wildlife re-serve would help conserve the ecosys-tem since only agriculture, a few smallscale industries and minor infra-works are permitted within the ESZ.

It is time forPakistan to see the new reality and stop interfering ininternal matters of India. Pakistan is being clearly toldthat the onus for maintaining peace and stability in theregion is on them. This is what the US andother major players are working on to prevent Pakistanfrom unleashing non-state actors. The US is in a mission mode to end the war inAfghanistan and pull back its troops from the war-torncountry. The Trump administration, is not buying thePakistani argument that the road to peace in Kabul goesthrough Kashmir and would hold Islamabad account-able if its seen jeopardising the ongoing Afghan peacetalks. There is a clear understanding inside the Trumpadministration that Pakistan will try and use the devel-opments in Kashmir to calibrate US response. India'smove has taken away from Pakistan a basis for it to in-ternationalize the issue of Jammu and Kashmir and thisrealisation is reflected in the frustration by seniorPakistani officials when they reach out to their counter-parts in other countries. Pak must understand thatKashmir is an internal affair of India and it should stayaway from Kashmir in future.

The younger lot of leaders, some of whom arebelieved to be of Rahul Gandhi’s camp, like Jyotiraditya Scindia,Deepender Hooda and Milind Deora, are clearly looking for a changed axisin a Modi-fied and Naya India and want their voices heard as newCongressmen. So all of them publicly endorsed the revocation of Article 370contrary to the stance of senior Congress leader Ghulam Nabi Azad in theRajya Sabha. The less said about the forked tongue approach in the LokSabha the better with CLP leader Adhir Ranjan Chowdhury going to theother extreme of classifying Kashmir as not an “internal” matter. There are already signs that theKulbhushan Jadhav case betweenPakistan and India might return tothe ICJ. The publication of theInternational Court of Justice’saward in the Kulbhushan Jadhavcase on July 17, 2019 was heraldedby both India and Pakistan as a vic-tory to their side; the truth proba-bly lies somewhere in between. Theaward vindicated India’s claims onmerit, concurring that Pakistanwas guilty of multiple violations ofthe Vienna Convention onConsular Relations (VCCR): by fail-ing to inform Mr. Jadhav of hisrights under Article 36 of the treaty,by neglecting to notify India of hisarrest without delay, and by deny-ing him consular access.Nonetheless, the ICJ rejectedIndia’s claims on two crucialgrounds: fair trial rights and reme-dy. The bedrock. Much of India’scase hinged on Article 14 of theInternational Covenant on Civiland Political Rights (ICCPR),which guarantees individuals theright to a fair trial. By convictingMr. Jadhav through a military tri-bunal, using video evidence of aconfession obtained under coercivecircumstances, and by denyingIndian consular officers the oppor-tunity to arrange for his legal repre-sentation, India argued that thePakistani state had employed anunjust procedure in his trial.Predictably, however, the ICJchose to hinge its jurisdiction inthis case on Article 1 of the OptionalProtocol to the VCCR, which grants

the ICJ compulsory jurisdiction on-ly over disputes arising out of theapplication or interpretation of theConsular Convention. The unfortu-nate consequence of this choice wasthat disputes pertaining to viola-tions of other international lawnorms, such as the human rightsobligations under the ICCPR, wereruled to be outside the remit of theICJ’s jurisdiction. India’s attemptsto have the ICCPR piggyback on theVCCR, by claiming that the latterwas also, in essence, a humanrights treaty and by asserting thatthe inclusion of the ICCPR was nec-essary for an effective remedy,were rejected out of hand.

Issue of remedies : The moretroubling aspect of the ICJ’s award,from the Indian perspective, con-cerns the ICJ’s decision on reme-dies. It denied India’s prayer to setaside Mr. Jadhav’s conviction bythe military tribunal, and for his re-lease. Instead, it ruled that the ap-propriate remedy would be forPakistan to carry out an “effectivereview and reconsideration” of the

tribunal’s conviction and sentence.What this means, in simpler terms,is that Pakistan will have to pro-vide Mr. Jadhav a judicial mecha-nism to assess the prejudice causedto him by a denial of consular ac-cess, and to reconsider (and possi-bly alter) his sentence and convic-tion based on its findings.

While not entirely unforesee-able, this decision is worrying forseveral reasons. First, this remedycarries a fraught history: it has on-ly ever been used before by the ICJin LaGrand and Avena, which in-volved an identical denial of con-sular access to nationals ofGermany and Mexico, respectively,by the United States. Crucially, theunsatisfactory implementation ofthis remedy and the weak reviewmechanisms provided by the U.S.in response to the ICJ’s decision inboth cases have been widely notedin academic literature. Second, theremedy does little to account for theviolation of Mr. Jadhav’s fair trialrights. This means that the reviewprocedure Pakistan opts for might

well be one carried out by a mili-tary tribunal, and also one that con-tinues to rely on the allegedly-forced video confession. But per-haps the most troubling aspect ofthis remedy, and the one thatmakes it most ripe for further liti-gation, is that it is intrinsically am-biguous. Apart from asserting thatthe review and reconsideration ofMr. Jadhav’s conviction “must beeffective”, the ICJ has offered littleguidance on how it must be carriedout. It is known, from the Avenajudgment, that providing Mr.Jadhav access to a clemency peti-tion (as Pakistani law does) is an in-sufficient form of review, since itdoes not entail the use of a judicialmechanism. The PakistaniSupreme Court, in Said ZamanKhan v. Federation of Pakistan,ruled that the state’s civilian courtscould only review the decision of amilitary tribunal on the narrowgrounds of coram non judice (i.e.,an absence of jurisdiction) or malafides(bad faith). It is unlikely thatMr. Jadhav’s denial of VCCR rightsfalls under either category.However, the decision in SaidZaman Khan is under review, fol-lowing the Peshawar High Court’sattempts to widen it in 2018, in theAbdur Rashid case. Heading backto The Hague? The outcome of thelatter case may well portend the useof a civilian review mechanism forMr. Jadhav’s case. Even if theRashid case fails, Pakistan couldpotentially be required to altertheir laws to provide a more effec-tive review mechanism for deci-

Two incidents overthe last few days embody a deeplydisturbing and distressing fallout ofthe muscular leadership in the polit-ical space degenerating into gendertriumphalism in the social space.One that automatically assumesmuscularity and decisiveness as ad-mirable male traits and everythingelse as supine and feminine frailties.Is “toxic masculinity” then the newnational character? Now codified al-most? The first case was of theUnnao rape accused KuldeepSengar, now expelled by the BJP,wishing a speedy recovery for thesurvivor with not even a twitch ofemotion or even betraying hispredatory nature, one that he hadused to hound, scare and subjugateher for two years. The girl, whosefamily was neutralised or eliminat-ed through means foul and his in-timidation, had to threaten self-im-molation in front of the UP ChiefMinister’s residence for her ulti-mate appeal to justice. And a nation-al conscience. Sengar is in custody,

booked under serious charges andnow even guilty by evidence, butthat hasn’t stopped him fromsquashing his female victim whereit hurts the most. As she fights forevery breath of her life in a hopelesssituation, Sengar publicly insultedher effort by “wishing her well,” thefinal blow to her dignity, patronis-ing in dispensing grace while beingthe perpetrator of her humiliation.Some distorted charity that hethinks will earn him clemency.Sadly, it has for the last two years.

The second instance was evenmore belly-churning. As the govern-ment road rolled its way into chang-ing the character of Jammu andKashmir by abrogating Article 370and bifurcating the State into UnionTerritories, a majority of reactionson social media were about howevery Indian male could now marry“fair Kashmiri girls,” buy propertyand settle down in the Valley, theimplication reeking of feudal con-quests of the darkest ages of civilisa-tion, where women were traded asspoils of war. A forceful integrationamounts to a war on people overland. Nobody even stepped in to con-demn such irresponsible and crasshumour, which was relished bymany. And considering that a cer-tain level of awareness, power andeducation can be assumed of onlinecitizenry, this truly was a new low,no different from the mentality of aninvading, occupation force of themedieval era. Since when were

Kashmiri women prevented frommarrying outside the State? Manyhave already done that out of freewill, knowing full well that it wouldentail relinquishing claims to theirfamily inheritance. Of course, to theavaricious male, she can now be en-titled to her birth heritage. Is thatthe implication? Also did anybodyask why Kashmiri women wouldagree to marry outsiders, particu-larly in challenged circumstancesas now? With the kernel of theInformation Act under threat, theindependence of the informationcommission is in peril. When we de-scribe India as a democracy what dowe really mean? Are we referringmerely to a system of popular sover-eignty founded in universal adultfranchise? Or are we suggestingsomething more perhaps an assur-ance, grounded in the Constitution,of a set of rights, of the rights, amongothers, to a freedom of expression,life and personal liberty, and equalopportunity and status? These arequestions, as Astra Taylor argues inher remarkable newbook,Democracy May Not Exist, ButWe’ll Miss It When It’s Gone, that wemust perpetually ask ourselves. Ifnothing else to remind oneself thatwhile there can be reasonable dis-agreements over how a republicought to be structured, seeingdemocracy as purely an enforce-ment of majoritarian will, where theonly end in mind is the selection of arepresentative government, leads toself-rule “becoming not a promisebut a curse”. Evidence throughouthistory has shown us that just re-sults do not necessarily follow froma simple guarantee of equal statusenshrined in a right to vote. Thewealthy and the dominant classesfind uncanny ways to ensure con-

centration of power. Democracy,therefore, has to percolate beyondthe bare promises of formal politicalequality. It is to this end that India’sConstitution provides a frameworkfor governance by pledging to peoplea set of inviolable guarantees. Butrealising the full value of those guar-antees at times requires a parleywith the state. It was one such longbattle, fought over nearly twodecades, driven by the unstinting ef-forts of the Mazdoor Kisan ShaktiSangathan, that resulted in the en-actment in 2005 of theRight toInformation Act (RTI Act). By anyaccount, the law proved transforma-tive to India’s democracy; it revolu-tionised the citizen’s ability to en-gage with the state, arming people

with a mechanism to ferret out someof the truth from the government’sotherwise secretive operations.

Deep-reaching amendmentsToday, though, the kernel of the

RTI Act is under threat. New amend-ments have been passed withoutsubjecting the draft law to scrutinyby a parliamentary committee. Afeature common to every law enact-ed by Parliament in its present ses-sion, this portends the reduction ofgovernance to a form of democracyby crude acclamation. The changesmade include an alteration to theterm in office of the informationcommissioners (ICs) and to the man-ner of determination of theirsalaries. In place of the existing five-year term accorded to the Central

Information Commissioner (CIC)and the various ICs the law grants tothe Uniongovernment the power tonotify their terms through execu-tive regulations. What is more, theamendment deletes the RTI Act’smandate that the salary paid to theCIC and the ICs ought to be equiva-lent to that paid respectively to theChief Election Commissioner andthe Election Commissioners (ECs).Now, the salary, allowances, andterms and conditions of service ofthe CIC and the ICs will be deter-mined by executive guidelines. Onits face, a reading of these amend-ments might not strike us as beingespecially harmful. The changesmay appear to be nothing more thanmatters of legislative niceties. Butthe RTI Act is not an ordinarystatute. It is a law that enlivens andanimates the basic right to freedomof information. Although such aright is not enumerated in theConstitution, the Supreme Courthas repeatedly affirmed its positionas intrinsic to the right to freedom ofexpression (for example, in PUCL v.Union of India, 2004). It might be dif-ficult to see the merit in this findingif we take democracy to mean gover-nance by the many and nothingmore. But as the courts have wiselyrecognised, information often actsas a great leveller; it helps anchordemocratic action. Therefore, for

ing of primal instincts. But male behaviour in the millen-nial era has considerably changed organically, lendingheft to the definition of metrosexuality. This then is not la-tent expression but an adjunct of hardening politicsworldwide, where sexism and gendered violence are be-ing redefined as a masculine privilege of power. In theIndian context, it is about inequality of political powerand the way it is dispensed. It is about a certain male chestsize which can be the nation’s armoured shield like noother. One has only to look at the way political decision-making process has converted the democratic process asa fait accompli. Nowhere is this totalitarian might moreevident than in Parliament, where productivity is aboutsteamrolling legislation and the consultative, coopera-tive process is seen as wasting time and energy, where op-position is about anti-nationalism and considered opin-ions are national deterrents to possibilities, where plural-ity is pointless and negotiation an extinct tool of trade. Ina system, where monotheistic and simplistic decision-making is blurring out layers and complexities, and pow-er flowing from an iconised perception of maleness, itmust follow that society will react to it. For it is only reallife conditions and forces that sustain popular culture, inour case a brainwashed sort. One where institutions andpurveyors perpetuate the sentiment rather than politicalthought. This explains why the Hindi film Kabir Singh,which celebrates toxic masculinity and a subjugation ofgender roles, finds crores of takers in the 21st century and isfrighteningly endorsed by the youth in middle and small townIndia. This is so different from the “angry young man” of the70s, who was fighting the establishment against suchruthless toxicity of power. What confounds the discourseis attributing male superiority to our cultural DNA whenfact is an eco-system has been created to foster an old con-struct for easier acceptance. A study conducted in the USon alcoholism may be cited here to explain the context.

The alcohol industry there had funded research to denythe relationship between alcohol and violence and in-stead blamed “masculinity” and “cultures of drinking.”But the study uncovered strong evidence that the densityof liquor shops in a given geographic area increased thelocal rate of domestic violence and recommended thatany serious framework for preventing violence againstwomen would have to address alcohol availability as wellas sexist mindsets. In other words, such a mindset is beingengendered by systematic and selective blanking out ofexisting narratives and pushing convenient ones withbrute force. The problem with this approach in our socie-ty is that we have still not begun to respect women’s rightsas evolutionary but as an imposition of grace by a male or-der. We have not been able to pass the Women’sReservation Bill at a time when it was required to ensureproportional representation that would ensure inclusiveparticipation and policy-making, not even now when aflurry of other Bills have made the cut. All women andchild-friendly schemes of the government are bestowedrather than earned. The very act of “empowerment” as-signs the agency to an external power of dole rather thanclaiming rights. And with so much muscularity of pur-pose on display, embracing the virtues and strength offemininity as a man upsets operable binaries. If reason,counsel and civility are now emaciating characteristics,then the idea of power automatically gets slotted in theprivileged domain of a raw, hunter-gatherer masculinity.The otherness gets lumped in baskets of minorityism, lib-eralism or feminism. Of these, feminism is the easiest to target asthe tide of opinion still favours men. Generations of women inIndia have worked tirelessly to rebalance the equation be-tween sexes, often mistakenly acquiring masculine quali-ties and benchmarks to do so. Now they have a far tougherpolitical context of endowment to battle, one where hu-maneness is predicated on the dehumanisation of others.

Kashmir as an integral part of India and just criticising theNDA government’s lack of a democratic and consultativepolitical process behind the reorganisation of Jammu andKashmir. Hooda and Deora are facing Assembly electionsin their States and do not want to go against the nationalsentiment while seeking votes. Younger leaders likeSachin Pilot are also living down their dynastic entitle-ment and working towards creating their personal legacieswith practical logic. With all of them now 40ish and mid-dling, they want to take a last shot at credibility than perishaway into extinction. Of course, sen-ior leaders are still prevailing on Congress matriarch

Sonia Gandhi, warding off elections for fear of being side-lined. After all, their undisputed runs in the party havemeant that they have carved their own fiefdoms too and le-gitimised their continuity by virtue of maintaining theseturfs and votebanks. Truth be told, most senior leaders inthe CWC have not fought elections in a long, long time andare out of depth with ground reality. For example, one ofthe names for CWC president, Mukul Wasnik, last won anelection in 2009. Were they to contest now, they would losetheir deposits. So they don’t want to let go of their statusquo in the Congress, hoping their posts would still length-en their political careers. What the Gandhis need to under-stand is that egoistic dramas have run their course and it istime to either hand over charge fully or rescue it upfront.The Congress leadership, which is either calculatedly orhelplessly driving the party to disaster, better value its po-litical relevance over selfish interests. Because when theformer is gone, even the latter won’t be of any consequence.If all this is part of an elaborate attempt to create an irre-trievable mess where the Gandhis would look like supremesaviours, then one could also look at a consensus candidatewho is accepted in their presence. And that would be an an-ti-climax.

sions of military tribunals: a fact alluded to by the ICJ,which stated that “Pakistan shall take all measures to pro-vide for effective review and reconsideration, including,if necessary, by enacting appropriate legislation” [em-phasis added]. Ultimately, though neither state will admitit, the Jadhav decision will be a bitter pill to swallow forboth India and Pakistan. For Pakistan, making a signifi-cant alteration to its legal system would amount to an ad-mission that the ICJ’s judgement was a public admonitionof Pakistan’s judicial review mechanism: a prospectPakistan is unlikely to welcome. For India, any reviewmechanism that fails to acquit Mr. Jadhav will be seen asprocedurally unsound, and an attempt by Pakistan to fur-ther shirk its international legal responsibilities. It doesnot help that both countries have dug themselves into

holes by thoroughly politicising the ICJ’s verdict. Thelikely consequence is that, irrespective of what reviewmechanism Pakistan implements, both nations will besoon be back, knocking on the door of the InternationalCourt: the ICJ’s Statute allows parties to approach thecourt again, asking it to interpret its judgment. Signs ofthis outcome can already be witnessed, with Pakistan re-fusing India unimpeded access to Mr. Jadhav through anote verbale issued mere weeks after the ICJ’s decision.India’s counsel, Harish Salve, has publicly stated that thestate will not hesitate to return to the ICJ if Pakistan’sconduct proves to be unsatisfactory. It is increasinglylikely that we haven’t heard the last of the Jadhav litiga-tion. For now, however, the ball remains in Pakistan’scourt.

In the spirit of the Enlightenment, many inFrance began calling for the public display of the royalcollections. Denis Diderot, the French writer and philoso-pher, was among the first to propose a national art muse-um for the public. Although King Louis XV temporarilydisplayed a selection of paintings at the LuxembourgPalace in 1750, it was not until the outbreak of the FrenchRevolution in 1789 that real progress was made in estab-lishing a permanent museum. On August 10, 1793, the rev-olutionary government opened the Musée Central desArts in the Grande Galerie of the Louvre. The collection atthe Louvre grew rapidly, and the French army seized artand archaeological items from territory and nations con-quered in the Revolutionary and Napoleonic wars. Much

of this plundered art was returned after Napoleon’s defeatin 1815, but the Louvre’s current Egyptian antiquities col-lections and other departments owe much to Napoleon’sconquests. Two new wings were added in the 19th centu-ry, and the multi-building Louvre complex was completedin 1857, during the reign of Napoleon III. In the 1980s and1990s, the Grand Louvre, as the museum is officiallyknown, underwent major remodeling. Modern museumamenities were added and thousands of square meters ofnew exhibition space were opened. The Chinese American ar-chitect I.M. Pei built a steel-and-glass pyramid in the center of theNapoleon courtyard. Traditionalists called it an outrage.In 1993, on the 200th anniversary of the museum, a rebuiltwing formerly occupied by the French ministry of financewas opened to the public. It was the first time that the en-tire Louvre was devoted to museum purposes.

democracy to be valuable, citizens must possess a right tofreely express themselves. It ought to follow then that it isonly when citizens have a right to know what the state isup to, where governance is transparent, can their speechhave genuine meaning; only then can they constructivelyparticipate in the veritable marketplace of ideas.

It was with a view to giving effect to these constitution-al promises that the RTI Act was formulated. Extensivedebate was held both in Parliament and within parliamen-tary committees before it was decided that public authori-ties ought to be mandated by law to making a series of vol-untary disclosures on their structure, their functioning,and their financial management. Besides this basic direc-tive, citizens are also empowered under the RTI Act toseek and obtain any information from public authorities,barring a few exempted categories such as informationwhich might affect the sovereignty of the country or pri-vate information which might have a bearing on a per-son’s right to privacy. Ferreting out the truth. This free-dom to secure information that the law provides has, inmany ways, redesigned the structure of India’s democrat-ic governance. It has helped open the government up togreater scrutiny. For example, it was through a responseto a request made under the RTI Act that it was discoveredthat between 2006 and 2010 more than •700 crore had beendiverted from Delhi’s special component plan, intendedfor the development of Scheduled Caste communities, toprojects related to the Commonwealth Games. More re-cently, an exposé by Rohini Mohan into the horrifyingprocesses of the “Foreigners Tribunal” in Assam wasmade on the back of securing information through the RTIAct. Even there, as Ms. Mohan has pointed out, only fiveout of the 100 functioning tribunals replied to requests for

copies of the orders delivered. It is when a plea for infor-mation goes unheeded that the CIC and the ICs play an es-pecially vital role. Should the initial request for informa-tion made to a public information officer, designated byeach public authority, fail, the petitioner is entitled tolodge an appeal to an authority within the departmentconcerned. Should that entreaty fail too and it often doessince this is a virtually illusory remedy a further appealcan be made to the office of the CIC or the StateInformation Commission. Until now, the RTI Act grantedan acceptable level of independence to ICs. By placingtheir terms of service on a par with those of the ECs thelaw insulated the ICs from political influence. This protec-tion was not dissimilar to the autonomy accorded to mem-bers of the higher judiciary. The basic idea remained thesame: security in office is imperative if members must in-tervene without fear or favour to ensure that the law’smandate is met. It could well be argued that the RTI Act, inits original form, was far from flawless, especially in thatit did not do enough to open up public authorities to com-plete scrutiny. But the present amendments, far fromstrengthening the existing regime, subvert the independ-ence of the information commission. The delegation of thepower to fix the tenure and the salaries of the CIC and theICs to the political executive places the information com-mission’s autonomy in a state of peril. With the witheringof that independence, the right to freedom of informationalso begins to lose its thrust. Ultimately, therefore, thenew amendments represent a classic piece of totalitarianlegerdemain. Democracy, to borrow the Americanphilosopher Cornel West’s conception, demands a “leap offaith”. If the new amendments are allowed to stand, mak-ing that leap becomes all the more implausible.

In a statement issuedon Friday, Ajni police saidthat an offence was regis-tered against Akshay Patil,manager of GoAir (Nagpur)and Nilay Janbandhu, sen-ior officer of ramp opera-tions, under IPC sections306 (abetment of suicide)and 34 (common intention)on Thursday. "During theinvestigation, it was foundthat the deceased,Manthan Chavan, was on

sick leave (when the inci-dent happened). However,he was under mental pres-sure as he was constantlygetting calls and messagesfrom Akshay Patil andNilay Janbandhu, whoasked him to resume duty,which drove him to com-mit suicide," the policesaid. According to police,Chavan hanged himselffrom an iron rod of a venti-lator at his home inChandramani Nagar. Hisfather, Mahendra Chavan,had later lodged a com-plaint saying that Manthanwas not keeping well andsuffering from jaundice.He had been on leave since10 to 12 days before the inci-dent, he had said. In the com-plaint, he had also alleged thathis son might have taken theextreme step due to workstress. Police had launcheda probe into the case basedon his complaint.

Meanwhile, theMumbai-headquarteredbudget airline has said thatpolice have "wronglybooked" two of its employ-ees. "By doing so, it damaged strategic stability formedafter the Cold War and that contributed to the creatingnecessary conditions for progressive, positive develop-

ment of cooperation between Moscow and Washingtonon a wide range of international security issues," saidGatilov, a former Deputy Foreign Minister.

"The new situation has increased the risks to inter-national stability because the INF was one of the pillarsof strategic stability." While withdrawing from the INFTreaty, Washington declared that the US-Russian bilat-eral nuclear disarmament era had ended.

"Russia is still keeping the door open for substantive,constructive and goal-oriented dialogue with the UnitedStates on all issues of strategic stability, based on mutualrespect, and due consideration of each other's interests,as well as of those of the international community," saidGatilov. The INF Treaty was signed in 1987 between theformer Soviet Union and the US on the elimination ofground-based intermediate-range and shorter-rangemissiles. The scrapping of the treaty threatens to dragthe two major military powers back into a Cold-War-style arms race. He said the US move was a "sad" one andthat judging by recent statements from Washington, "itis ready to resume production, and at a later stage the de-ployment of missiles previously banned by the treaty".Instead of returning to the legal framework of the INFtreaty and discussing the problematic issues within themechanism provided for by accord, Gatilov said the USlaunched "a propaganda campaign against Russia".

Thar Express fromPakistan reached India onSaturday afternoon, whilethe Karachi-bound train ison its way to the neighbour-ing country, officials said.

The Thar Express fromPakistan started from thestation zero point at 17.20hours and reached Indianstation Munabao at 17.40hours with 165 passengers --62 Indians and 103Pakistanis -- on board, rail-ways said. The Thar linkExpress from India is on itsway to Karachi. Pakistan

Among the 165 passen-gers, 81 are Indians, who arevisiting their relatives inPakistan. Eighty-fourPakistan nationals are re-turning to their country af-ter completion of their visalimit in India, a railway offi-cial has said.

As the passengersboarded the train at Bhagatki Kothi station, there wereconcerns that the journeycould even end at Munabaoin Barmer district, amid un-certainties over strainedties between the two coun-tries.

The Editors Guild ofIndia expressed deep con-cern on Saturday over thecontinued shutdown in com-munication links with theKashmir Valley and the con-sequent "curtailment of themedia's freedom and ability"to report fairly on the devel-opments there.

The guild's statementcame days after the govern-ment revoked the provisionsof Article 370 of theConstitution in Jammu andKashmir to withdraw thespecial status given to thestate and bifurcated it intotwo Union territories --Jammu and Kashmir andLadakh.

The guild said whilesome visiting journalistsmight be able to file their re-ports once they were out ofthe Valley, the lockdown wasalmost "total and draconian"for the vibrant local mediaorganisations that were thefirst eyes and ears on theground.

The government knewvery well that it was impossi-ble to process and publishnews now without the inter-net, it said. The governmentowed it to the people of thecountry, including those inJammu and Kashmir, to al-low the press, a vital institu-tion of democracy, to func-tion freely, the guild said.

It added that it wasdeeply concerned over thecontinued shutdown in com-

munication links with theKashmir Valley and the con-sequent "curtailment of themedia's freedom and ability"to report fairly and accurate-ly on current developments.

In a situation such as thatprevailing in Jammu andKashmir at present, the roleof a free media, unhinderedby such restrictions, be-comes critically importantin helping in disseminationof news and in its democraticduty of keeping a watch oninstitutions of the govern-ment and security, the guildsaid.

"The Guild underlinesthe imprudence in creatingan unfair distinction in thetreatment: for access, curfewpasses, communication be-tween local journalists and

those coming in to reportfrom outside. All journalistsand all Indian citizens areentitled to equal freedom,"the statement said.

The guild urged the gov-ernment to take immediatesteps to restore normalcy forthe media's communicationlinks. Media transparencyhad always been and shouldbe India's strength, not fear,it said.

The guild also expressedits appreciation for and soli-darity to all journalists re-porting from the ground de-spite unprecedented chal-lenges.

"The Guild requests all,especially the government,to ensure their safety andfreedom of movement," thestatement said.

In a LPA filed by Imtiyaz AhmadMalla against the judgment of WritCourt whereby Writ Court dismissiedthe petition seeking quashment of anorder No. 2580 of 2017 dated 31st July,2017 whereby the respondents have re-jected the claim of the appellant for re-instatement in service as a Constablewith the Jammu & Kashmir Police withconsequential benefits. A DivisionBench of State High Court comprisingChief Justice Gita Mittal and JusticeRashid Ali Dar allegations on which acriminal prosecution rests and the cir-cumstances leading to the acquittaltherefrom would be different in each in-stance. So far as suitability for recruit-ment into the police is concerned, theappointing authority is required to ef-fect a strict scrutiny into each individ-ual candidate's background. Therefore,merely because the respondents mayhave recruited some individuals whowere acquitted from their criminalprosecutions, would not ipso facto enti-tle the appellant to the same. Nothingwould also turn on the respondents hav-ing offered appointment to some per-sons who stand acquitted in a criminalcaseand refusing it in another case. Wehave no material regarding the natureof the charges against those persons orthe reasons for their acquittal. DB fur-ther observed that we found that it hascarefully noted the scrutiny by theDirector General of Police.It has beenrightly observed that as per the applica-ble principles and law only personswith impeccable character can be al-lowed to make entry into the policeforce which is a disciplined one. It hasbeen observed that the importance ofthe integrity and high standard of con-duct in police force has to be taken intoconsideration in the matter of formingan opinion whether his retention in thepolice force is or is not justifiable.

DB further observed that in thisbackground, the Single Judge was alsoof the view that the Director General be-ing the highest functionary in the po-lice hierarchy is the best judge to con-sider the suitability of the applicant forinduction into police force. Given theabove factual background, it has beenheld that such decision cannot be calledinto question especially as the same hasbeen arrived at after giving due applica-tion of mind to the relevant facts. Theseobservations are in consonance withthe binding principles laid down in thejudicial precedents extracted above,are legally correct and cannot be fault-ed.
