Introduction This inventory has been compiled as a resource for those involved either directly in the Declama programme, or others working in the area of decentralised land management and administration. The Declama programme (Decentralised Land Management and Administration Monitoring and Support) is being developed by DFID’s Land Policy Group and is coordinated by IIED together with LandNet East and West Africa. The programme aims to mobilise knowledge on decentralised land management and administration and make this more accessible to all institutions involved in policy debates1. The inventory assembles details of institutions that provide training on land management and administration, whether as complete courses (which is rare) or as part of other courses. It has also attempted to identify land management related events, such as conferences and workshops, which will occur over the next couple of years. The primary purpose of the inventory is to provide a channel for dissemination of the knowledge and materials developed by the Declama programme. A second potential use is discussed later. The information was gathered from several West, East and Southern African countries. Not only are the Declama countries included (Burkina, Niger, Ghana, Kenya, Uganda, Tanzania, Rwanda) but also countries which either have decentralised land administration systems operating, or are in the process of implementation, or where decentralisation is the likely outcome of policy processes underway2. Information was collected in three ways: a) a short letter requesting feedback about training institutions and events was emailed to

various contacts in several African countries including members of LandNet (see appendix for contact list)3. Since many messages were returned undelivered, help in updating contact details was sought from various people, both in Africa and Europe.

b) searches on the internet. c) following up contacts and websites suggested contacts made by those who replied. This was

done by email and phone. Where little country level information was forthcoming, the earlier email requests were followed up by a second email and/or phone calls.

A major challenge for assembling information about land management and administration training is that the subject is a component of many different fields of study. Indeed, many practitioners, whether they are surveyors, valuers, administrators, managers, or, as is frequently described, ‘land officers’, and whether they are employed in the public service or private practice, come to the profession from many different backgrounds. These can range from planning, surveying, law, land economy, natural resource management, agriculture or forestry and various forms of social science. As such, land management and administration is covered within an equally wide range of courses. There are only a handful of training centres in Africa, Europe or USA that cover land management and administration as a stand-alone subject area. The details of these courses are included in full in the appendix. The subject is more commonly found in departments of planning and surveying or law, and in terms of land-use planning, also in geography, agriculture, forestry and other natural resource disciplines. In Francophone countries courses relating to land management tend to be found in Facultés des sciences juridiques et économiques. Courses in Europe with a focus on developing countries are usually found in departments of development studies, geography and planning. The quality of information available on the internet varies widely. Although most European and US institutions maintain an internet presence, how much detail they offer is not guaranteed. For African institutions, searching is much more hit and miss. Many universities sites are either not available, or access is so slow as to make maintaining a connection, and interest, difficult. Only the larger African NGOs have websites and some of these are very out of date. There is little government information available on the web. In general, there is still an enormous difference between the quality and

accessibility of internet information of northern based institutions, and southern, which makes gathering African country information and materials from outside the continent very difficult. As can be expected from the methods used, information gathered is not uniform for each country. For some countries, eg. Kenya and Burkina, quite comprehensive lists of training institutes were supplied. In other cases, regional points of contact, for example FAO in Ghana and Zimbabwe, forwarded the email request to their country contacts. This yielded both useful information and important contacts. Some of the feedback received has been included in its entirety. These responses provide a wealth of background information and insights into how training is structured in different countries. In Ghana, for example, the British system of membership of professional institutes is the mode by which specialised training in land surveying and planning is offered. This may also be true for other Anglophone countries. In Francophone countries where decentralisation is either well underway, or under discussion, various government ‘cellules’ or non-governmental organisations carry out training support. There seem to be various forms of land management and administration training currently available in Africa. The main form is a degree or diploma level course at a university or polytechnic. Those students graduating with surveying or planning degrees join professional institutes eg. Institute of Surveying, or Planning. These institutes are sometimes affiliated to international bodies such as the International Federation of Surveyors (FIG). Seminars or more structured courses are provided by the professional bodies and after a period of probation (eg.2 years) and taking exams, the graduates are eligible for full membership. Training on aspects of decentralisation is generally carried out by the Ministries of the Interior, or other ministries directly charged with decentralisation. In Francophone countries the Ecoles Nationales d’Administration (ENA) are the major support for decentralisation but many NGOs are active in this domain. In some countries eg. Mozambique and Botswana, private institutes or land agencies are providing training in collaborating with governments. Despite the diverse range of information gathered, it is clear that within Africa, there are a few major training centres that have good reputations and are mentioned by several different respondents. These are PLAAS (University of the Western Cape) and the University of Natal (Pietermaritzburg and Durban) in South Africa, Namibia Polytechnic, University College of Lands and Architectural Studies (UCLAS) in Tanzania, Makerere University in Uganda, Kwame Nkrumah University of Science and Technology (KNUST) in Ghana, and the University of St Louis, Senegal. More detail on some of these is provided in the appendix. There is also a vibrant NGO community throughout the continent which is participating not only in campaigning at a policy level, but in sensitisation at a local level. Some NGOs are collaborating with government ministries to support implementation of new land laws and land programmes. In Europe, ITC in the Netherlands has collaborative programmes with universities or institutes in Africa, eg. Ghana and South Africa. Some international donors and agencies have supported or are supporting training within decentralisation programmes, and a few of these are land related. In Germany, the MSc in land management and land tenure in urban and rural development at Munich University provides a comprehensive training programme for international students. Several short courses are also available. At Dortmund University the SPRING programme offers practitioners of rural and regional development planning and administration from developing countries, a two year course in spatial planning, one year of which will be spent in either Ghana at KNUST in Kumasi or UCLAS in Tanzania. In the UK, several universities such as Reading and University of East London are offering tailor-made short courses. In the process of gathering this information, another potential purpose of the inventory has become apparent. As well as using the training institutes for dissemination knowledge about decentralised land management, the material may be useful in discussions about training needs for implementation of decentralised systems of land administration.

A report written by Tommy Oosterberg in 20004 which was made available by FAO makes several pertinent points. As new policies of decentralised forms of land management come into effect, new skills are being demanded of existing land officers, or traditional leaders, depending on where land management and administration functions are located, whether with traditional authorities, or local government. He states “the different reforms going on in African countries, including reformation of land laws, improved and more efficient organisation, coordination and integration between different authorities, delegation of decision-making to lower levels, and recognition of customary tenure will demand land administration officers with more interdisciplinary knowledge including legislation, planning, sociology, economy and technical topics like surveying and IT. No such education programme exists today” (Oosterberg, 2000). This points to the need for more interdisciplinary training programmes either at universities or other training centres. Surveys that Oosterberg conducted in eastern and southern Africa showed a need not only for more land managers/administrators, but for complementing country level education programmes (either basic or advanced level) with regional training specific to land administration. He emphasised that decentralised land administration demands a change in attitude of existing land officers and, as such, advocates supporting continued professional development of staff involved in land administration. He also notes that new IT, including GPS, makes surveying much cheaper and easier to conduct than in the past, but that computerised systems of recording or registering land can demand considerable infrastructure to maintain, especially if operating at decentralised levels. All forms of new technology, however, require methods of training and re-training. It was clear from responses to the email requests that there is an interest in the Declama programme. Although there is weak capacity in land management and administration training in Africa generally, and especially in some countries, there is great potential for collaborations and for making the best use of the skills and human resources currently available within the continent and outside.

Ce Ministère a un service centrale qui est la Direction Nationale du Domaine et des cadastres et aussi des services régionaux et subrégionaux. Quant à la politique de décentralisation, elle est piloté par le Ministère de l'Administration territoriale et des collectivités locales. Ces administrations recrutent généralement des personnes avec une formation générale de juriste, d'économiste, etc. Elles organisent très souvent des formations de quelques jours pour une mise à niveau de leurs agents. Il peut arriver aussi qu'elles les inscrivent dans des structures de formations pour formations diplomantes. A propos des séminaires et atéliers, je dois dire qu'il y en a une multitude qui sont organisés par beaucoup d'intervenants. Il existe en effet beaucoup d'ONG qui s'occupent des divers aspects du foncier et de la décentralisation et qui organisent des séminaires et atéliers à la fois pour les autorités traditionnelles des communautés, les autorités des collectivités et les agents de l'Etat. Ces formations sont organisées dans toutes les régions du pays. Il y a des atéliers qui sont organisés par l'Etat aussi pour ses agents (au sujet des questions techniques) ou pour l'ensemble des acteurs (au sujet de questions plus sensibles ou pour préparer certaines décisions). HORN & EAST AFRICA ETHIOPIA Feedback from Wray Witten: At Mekelle University there is a department of land management in the Faculty of Agriculture. There is, to my knowledge, no institution in Ethiopia today dealing specifically with decentralization, though there used to be. Every State had a Management Institute whose job was to train local government people in management tools necessary for decentralized government. Most have closed, including the Tigray state one, but some may be operating. There is also a very large effort in the Ministry for Capacity Building but I do not know of any concrete non-ad hoc program. Otherwise, my impression is that most such specialized trainings in Ethiopia are ad hoc affairs organized by state or regional governments, often with the support of NGOs. Their timing and content are hard to anticipate. Some involve local academics to some extent. An example would be the trials of land registration in the Amhara State in Ethiopia being assisted by SIDA. One source of information about academics who have been involved might be law schools. LandNet Rwanda is at an advanced stage of preparing to engage in the process, and is a good advocate of decentralizing the land processes. The key ministry involved in training on decentralization is the Ministry of Local Government and Social Affairs (note this is one ministry). However, since 1999, when the decentralization policy was passed, almost each activity initiated in Rwanda is done through the decentralization process: be it a government initiated or NGO initiated, and training are conducted by very many and different institutions – almost every NGO in Rwanda has a resource person (s); the same thing applies in most ministries. Feedback from Harold Liversage: Planning of the following processes are under way during the finalisation and approval of the Land Policy and Land Law: a) initiating an assessment of the requirements for developing the country's land registration and land-use planning systems and procedures, especially at the district level. This will form the basis for developing an implementation strategy. The assessment will include an assessment of capacity requirements, and should, at some stage, include looking at training needs and matching these these to the development of the capacity of training institutions. b) linking up with the South African Department of Land Affairs to explore the possible role they and training institutions in South Africa could play in providing training and developing Rwanda's training capacity. c) FAO are interested in providing support in technically reviewing options and alternatives to local land administration, including roles, actors and norms of operations of decentralized commissions, approach to land registration (and possible piloting), and the codification and institutionalization of these practices. It is designed for re-skilling officials who do not have a land surveyor background. Namibia Polytec/University has a diploma course in certain aspects. In regard to these courses ITC in Holland has been extensively involved, contact Walter de Vries. FAO was thinking of starting a course (I think) in Malawi. University of Natal also had a land management course (which I used to run) on its Durban campus. There is a course in Tanzania, contact Tommy Osterberg at Swedesurvey in Gavle, Sweden. I know of no other robust land administration/management courses - instead many land surveying schools are trying to convert to this discipline but there are problems. Yet is is such a key area. Country contact: Qhobela Cyprian Selebalo : [email protected] SOUTH AFRICA Feedback from Rick de Satgé It is my perception that what (little) training around land and land management that does take place in South Africa is not framed in the same way as the Declama Programme you describe. This is partly due to the fragmented nature of policy and legislation which impacts on land rights management and administration and the fact that the policy and legislative environment is very fast moving. This makes training design very challenging, as what applies today may not apply tomorrow. There is a whole raft of policy and legislation of relevance to land and land management. This policy and legislation emanates from a variety of Departments and unfortunately is often poorly articulated and co-ordinated. Originally the Development Facilitation Act in 1995 set out to provide an interim framework for land and related planning. This was then followed a range of local government legislation - the Local Government Transition Act, the Demarcation Act, the Municipal Structures and Systems Acts which paved the way for wall to wall municipalities and institutionalized the Integrated Development Planning process at Municipal level. The National Development and Planning Commission produced a Green Paper on planning and development in 1999 which was followed by a DLA authored White Paper on spatial planning and land use management in July 2001. This was followed with a Land Use Bill that was released in April 2002 and has been back and forth ever since. Apparently it is intended to pass the Bill in this session of Parliament. There is also a variety of legislation which regulates land uses, water, forests, natural resource management and environmental impacts of development. The tenure reform dimension of the South African land reform programme has been very slow to get off the ground. The Communal Land Rights Bill aims to provide for a variety of tenure and land rights management options on State land under communal tenure. This is yet to be passed. In December 1998 the findings of an investigation into Integrated Development Planning (IDP) related training was published. The report was commissioned by the Department of Constitutional Development (now Provincial and Local Government - DPLG) and GTZ. This study was prepared by researchers at University of Natal and Pretoria and the Isandla Institute and could be useful as a base document. It highlights all the institutions providing IDP related training which included the universities of Cape Town, Stellenbosch, Pretoria, Venda, Potchefstroom, Orange Free State, Witwatersrand, Natal as well as some technikons that offer undergraduate and masters programmes in Town and Regional Planning - several of which have an emphasis on Integrated Development Planning and address land management and decentralization issues. However the information in the report is now quite dated. Some of the training providers have disappeared or are in the process of complex mergers. Different government departments and institutions like the South African Local Government Association (SALGA) have commissioned training for officials. A joint 'horizontal learning programme' between DPLG, SALGA and USAID produces the Hologram newsletter and has commissioned research into a number of local

government arena. DPLG has also been running the PIMS support programme for local municipalities, placing staff in municipalities to build their planning capacity. A joint DLA/DANCED programme focused on the integration of environmental planning into land reform providing training and producing a set of guidelines. Terms of Reference For an inventory of training institutions and events in sub-Saharan Africa

1. Context There is wide consensus among governments, development agencies, centres of expertise and civil society groups that land management and administration are key to economic growth, sustainable livelihoods, poverty reduction, sustainable natural resource management and accountable local governance. Throughout sub-Saharan Africa, important developments in land policy, legislation and programmes are under way. Experience has shown the shortcomings of centralised approaches to land management and administration. Decentralisation and formal recognition of customary rights are increasingly seen by governments and development agencies as the way forward to address these issues. A large number of countries have recently adopted new land laws and policies characterised by greater recognition of customary land tenure systems and by greater decentralisation of land management and administration responsibilities, through a wide range of institutional options. Moreover, donors as well as international and local NGOs are advocating and supporting policy change in this direction and implementing field programmes based on this approach. These developments have opened new opportunities for local democracy and raised important issues that need to be monitored and addressed. In the context of the advisory support that IIED provides to DFID through its representation in the DFID Land Policy Group, IIED is assisting DFID in the development of a Decentralised Land Management and Administration Monitoring and Support Programme (a programme labelled “Declama”), which focuses initially on East and West Africa but aims at expanding its scope to Southern Africa. The programme will consist of three main components: 1. Mobilising knowledge on decentralised land management and administration; 2. Developing best practice, to make mobilised knowledge more easily accessible to all institutions

involved in policy processes and debates; and 3. Consolidating channels for the dissemination of knowledge and for the exchange of experience

and ideas, including by channelling the materials developed by the programme into existing training institutions and events.

The inventory of training institutions and events provided for in these Terms of Reference is aimed at laying the ground for component 3 of the Declama programme. 2. Output and methodology The consultant will identify training institutions and events in sub-Saharan Africa, as well as in other relevant regions, which may be involved in Declama activities. In order to do so, the consultant will rely on a variety of channels, including the Internet, printed materials, interviews and exchanges with LandNet and other relevant persons, etc. The institutions and events identified will be presented in a document providing details on: • the nature of the institution/event; • the relevance of the institution/event to the Declama programme; • the content of the training provided by the institution/event; and • the contact details of relevant persons within the institution/event. 3. Typology of the training institutions/events to be identified The inventory will identify primarily the following types of training institutions and events: 1. Institutions providing training on land management and administration, whether in academic or

other setting; 2. Institutions training government officials and/or students who may subsequently become civil

servants or policy-makers (such as écoles nationales d’administration, universities, etc.), even where no specific training programme on land management and administration exists;

3. Institutions providing training to local land management and administration bodies, local governments and/or land-related civil society groups.

The institutions/events under 1 will be mainly located in sub-Saharan Africa, although specific attention will also be devoted to European training institutions receiving students from sub-Saharan Africa. The institutions/events under 2 and 3 will be located in the same regions, with priority being granted to those East and West African countries where Declama activities are most likely to be implemented (Burkina Faso, Ghana, Kenya, Niger, Rwanda, Tanzania and Uganda) and to relevant European institutions/events.

The Programme for Land and Agrarian Studies (PLAAS) University of the Western Cape, South Africa PLAAS focuses on:

• the land restitution and redistribution programmes initiated by the post-apartheid democratic state

• land tenure reform • emerging regimes of natural resource management • rural livelihoods and farm-household production systems • chronic poverty and rural development • processes of institutional restructuring and reorientation in support of land and

agrarian reform in South Africa. The main activities of PLAAS are research, support to national policy development, training, post-graduate teaching, and advisory, facilitation and evaluation services. Training PLAAS short course training 1995–2002 Since 1995 PLAAS, working in association with Rick de Satgé of Developmental Services, has been commissioned to design and develop a range of training short courses customised tomeet the needs of different government departments and NGOs. These courses have utiliseda wide range of participatory training methods, combined with analytic activities, scenarios and case studies and related content inputs. Certain courses have involved field-based learning sessions with participants engaging in guided fieldwork activities. Courses are briefly profiledin chronological order. Tenure basics Ben Cousins and Rick de Satgé designed a series of courses which they ran several timesand in different formats between 1996 and 1999. The training was for the Department of LandAffairs and NGOs in the land sector. The training focused on understanding tenure systems and the impacts of history and past policies on land and resource tenure, introducing essentialtenure concepts, examining emerging tenure reform policy and the challenges of implementingtenure reform. Restitution Andries du Toit designed and facilitated a series of training courses introducing the Restitutionof Land Rights Act and practical processes for handling claims for staff of the Land ClaimsCommission and NGOs in the land sector. Redistribution policy and procedures Rick de Satgé designed and facilitated a series of five-day training courses introducing DLA planners to the policy and practice of land redistribution together with a team from theDepartment of Land Affairs. The course also created a space for reflection on practical challenges faced in implementing policy on the ground and policy issues identified in theprocess. Implementing the extension of Security of Tenure Act (Esta) Rick de Satgé work with a team from the Department of Land affairs to design and deliver a series of courses five day courses on Esta and the capacity, systems and practical skills required to implement the Act. Participatory planning for effective legal entities Rick de Satgé designed and facilitated a series of three-day courses on the challenges of forming legal entities such as communal property associations (CPAs) and trusts to hold landon behalf of groups. The formation of a legal entity is required for groups of people to legallyown land acquired in terms of the land reform programme. Legal entities also provide a framework for the management of the tenure rights of members.

Land use and livelihoods Stephen Turner and Rick de Satgé designed and ran a 13-day course for the National Land Committee (NLC) in 1998 and 1999. This course combined both theoretical and practical dimensions of planning for sustainable livelihoods. Other PLAAS staff and associates madevaluable contributions to this course. The course involved fieldwork in Herschel in the EasternCape and visits to land reform projects in KwaZulu-Natal. Participants completed a number of syndicate assignments that enabled them to engage with concepts and frameworks and applyskills and knowledge gained during the course. The course also facilitated practical exchangesamongst NLC affiliates on different planning approaches and the practical use of differentfieldwork methods. The integration of environmental planning into land reform PLAAS was selected to design a deliver a large Danish Cooperation for Environment andDevelopment (Danced)/DLA training programme between 1999 and 2001. This programmeinvolved a combination of foundation courses and field-based training and learning in the Free State and Mpumalanga. Rick de Satgé was appointed as the training manager. PLAASdocumented the case studies in each province and designed and facilitated the foundationcourses. PLAAS worked in association with the Rural Action Committee (Trac) and CommonGround Consulting to deliver the field-based learning components. Foundation courses included a five day courses on ‘environmental issues in land reform’ and ‘natural resourcemanagement and sustainable resource use’. The latter was delivered by Stephen Turner andJeanette Clarke. Other courses included a focus on ‘environmental dimensions of integrated development planning’ and ‘key issues for managers’. The training process provided theopportunity to engage with and reflect on the process of guidelines development taking placewithin the DLA. A final series of courses introduced the guidelines and examined the practical implications of using them to inform land reform planning. Forest policy, legislation and participatory forest management Rick de Satgé has been involved in the design of a series of courses for the Department ofWater Affairs and Forestry on new paradigms in forest management and the practicalimplementation of forest policy and legislation. Certain of these courses utilised PLAAS staffas resource persons and drew on PLAAS research into community-based natural resource management Governance in Community Based Natural Resource Management (CBNRM) Webster Whande and Rick de Satgé designed and facilitated this five-day course for CBNRM practitioners from South Africa, Namibia, Botswana, Zimbabwe, Lesotho and Mozambique in association with IUCN and the Centre for Applied Social Studies at the University ofZimbabwe. The course was divided into four components. Component 1 introduced the theory and practice of CBNRM and drew on a range of case studies from the fisheries, forestry and wildlife sectors to highlight governance dimensions of CBNRM. Component 2 drew on case studies to examine key concepts and their practical application. Component 3 focused on key trends emerging across the region while component 4 provided a practical guide to the planning and implementation of CBNRM agreements. The course drew on a wide range of resource persons and made good use of the expertise of PLAAS staff including Ben Cousins, Mafa Hara, Lungisile Ntsebeza and Phinda Ndabula. Forthcoming training PLAAS has been asked to facilitate a six-week course on social science perspectives on natural resource management, provisionally scheduled to be run in February 2003 in CapeTown. This course has previously been run in Zimbabwe by IUCN. As the course has not been run for two years it will be redesigned and updated before it is offered to natural resourcemanagement practitioners and policy makers in the Southern African Development Communityregion.

The University College of Lands and Architectural Studies (UCLAS) became a constituent college of the University of Dar es salaam (UDSM) on July 1, 1996. It was originally founded in 1956 as a Survey Training School, located at Mgulani on the then outskirts of the city of Dar es salaam. The school was moved to the Observation Hill (its present location) in 1958. In 1972, it became Ardhi Institute and began offering tertiary level education in the areas off Land Surveying, Urban and Rural Planning and Land and management and evaluation. Later on areas of Architecture, Building Economics and Environmental Engineering were added.

The Institute of Housing Studies and Building Research (IHS&BR) which is an integral part of UCLAS, was found in 1979 as the Centre for Housing Studies (CHS) as a joint project between the governments of Tanzania and the Netherlands. Following a strategic planning exercise between the management of Ardhi Institute and stakeholders, the CHs was renamed Centre for Human settlements Studies (CHS) in 1995. While the name CHSS was short-lived, its mandate has remained essentially the same.

The long-term perspective of UCLAS is to become a fully fledged University of its kind in the region in the foreseeable future.

LAND MANAGEMENT AND LAND TENURE in Urban and Rural Development

Technische Universität München is offering a new Master’s Program in Land Management and Land Tenure in Urban and Rural Development, beginning October 2001. The 18-month postgraduate course is offered to international students with practical experience in the field of land management. The entire program will be in English. In the 1990s many international conventions and declarations underlined the importance of land rights and access to land to achieve sustainable development. At the same time, new systems of land tenure and land management have been introduced in many developing countries and countries in transition. Now, experts are needed for the implementation of these new policies. The Master’s Program ”Land Management and Land Tenure“ provides the necessary theoretical and practical background for future experts in this field. Mid-career students from all over the world are invited to enrol. COURSE OUTLINE The Master’s Program aims to qualify students in interdisciplinary approaches to land management and land tenure in an international context. One aim is to place the role of land tenure and land management in the broader context of good governance and sustainable development. Another objective is to provide students with a profound knowledge of the many aspects of land tenure and land management in the rural as well as in the urban context. All courses will combine theory and practice. Students will be trained in the application of practical methods and tools. • Examine land policies and compare land management systems; • Understand the role of land ownership in society and land registration; • Examine the concept of the land parcel as a fundamental unit in land administration and land

resource management; • Evaluate the inter-relationship between land, the environment, social, and economic issues; • Investigate the principles and technologies of land information systems in the context of a

multi-purpose cadastre; • Analyse issues of land reform.

Main Topics of Study: 1. Role of the state in land: components of land management systems; postcolonial land policy 2. Types of land tenure; common/civil law; individual, family, tribal, communal and state property

rights; boundary dispute resolution. Strata titles, condominiums and commonhold 3. Cadastre and the registration of rights and title; Torrens, the 'English' system, and socialist

systems; Tribal and communal lands. 4. Land Information Systems; multi-purpose cadastre and spatial data infrastructure 5. Demographic, social, cultural, environmental and other factors in land use; policies toward

planning, environmental and heritage protection, and green issues; economic development 6. Land Reform; Institutional processes; redistribution and restitution (urban and rural); land

fragmentation and land consolidation; agrarian reform; rural planning and rural communities; transnational comparisons This unit draws upon case studies from Europe, Africa, South America and the Caribbean
