EXECUTIVE SUMMARY

This is the fifth and final year of the City’s five (5) year 2009-2014 Consolidated Plan.This is also the fifth year the City has been an entitlement jurisdiction. The City receivesfederal funds from the U.S Department of Housing and Urban Development (HUD)designated to assist in the development of viable communities by supporting projectsthat provide decent housing, sustain suitable living environments, and expand economicopportunities primarily for low- and moderate-income persons. The City is required toadopt an Annual Action Plan for the use of these funds which serves as the means tomeet the application and submission requirements for four (4) entitlement formulaprograms: Community Development Block Grant (CDBG), Emergency Solutions Grant(ESG), HOME Investment Partnership Act (HOME) and Housing Opportunities forPersons with AIDS (HOPWA). The City does not receive HOME, ESG, or HOPWAfunding from HUD.

This Annual Action Plan outlines the activities that will be undertaken during theprogram year beginning July 1,2013 and ending June 30, 2014. Program and activitiesdescribed in this Action Plan are intended to primarily benefit low-income residents ofthe City of Perris, neighborhoods with high concentrations of low-income residents, andthe City as a whole.

This plan is consistent with the City of Perris 2009-2014 Five Year Consolidated Plan.Public participation included public hearings and consultation with agencies, groups,and organizations involved in the development of affordable housing, and providingsuitable living environment for low to moderate income residents, and/or provisions ofservices to children, elderly persons, persons with disabilities and homeless persons.This plan has been made available for public review and comment for a required 30-dayperiod from April 5, 2013 through May 14, 2013. The plan was advertised in the localnewspaper and the plan was available for review on the City’s websitewww.ctyofperns.orq, City’s Development Services Department — Housing Division, andthe City Clerk’s Office.

On March 4, 2013, HUD announced potential sequestration of funding for FY 2013-2014 and the five percent reduction in entitlement allocations for the CommunityDevelopment Block Grant Program. Thus, the City’s estimated FY 2013-2014 formulaentitlement allocation is $618,420.

Activities detailed in this plan will meet one of the following National Objectives:

A. Lead Agency

A completed Action Plan describes the lead agency responsible for overseeing thedevelopment and implementation of the plan. It also includes a summary of the citizenparticipation process, public comments, and efforts made to broaden public participationin preparing the plan.

The City of Perris’ Housing Division is the lead agency in the development andimplementation of the Action Plan.

B. Institutional Structure

The City has an inclusive institutional structure approach that uses severalorganizations and departments to carry out its housing, homeless, and communitydevelopment plan. Organizations include the Riverside County Continuum of Care(C0C), philanthropic organizations and other public/private agencies. The City continuesto streamline and to make improvements to the delivery system to best serve thecommunity through activities and services. As the needs of low to moderate-incomeresidents change, the demand for types of services and programs will also change.This may result in future revisions to the Action Plan through amendments, asnecessary.

The activities and accomplishment goals outlined in the Action Plan will be undertakenwith the FY 2013-2014 available funds as outlined below:

Strengths and Weaknesses in the Delivery System

One weakness may be that the City is small. Perris is an administratively smalljurisdiction with fewer than 100 employees. Therefore, the City holds regular meetingsto coordinate activities between departments. City departments are effective inadministering grant funds and will be implementing the majority of the CDBG projectsand programs comprising the five-year plan. Public service agencies that receive CDBGcontracts are integrated into planning efforts for effective program delivery. Thiscoordinated effort and “small town” approach to service delivery is Ferris’ principalstrength. Public agencies, non-profit organizations, and for-profit organizations allcontribute to the provision of affordable housing, community development, and supportservices in Ferris.

C. Summary of Objectives and Outcomes

The City’s Consolidated Plan was amended on April 12, 2011 to revise goals andobjectives to better reflect the City’s ability to achieve those goals.

Activities meet the following objectives for Community Planning and Development(CPD) Programs of the U.S. Department of Housing and Urban Development (HUD):

1. To ensure decent housing;2. To create and maintain a suitable living environment; and3. To expand economic opportunities.

D. Evaluation of Past Performance

The City of Ferris is aware that HUD had concerns about the City’s past performancewith regard to meeting its Consolidated Plan goals. More specifically, HUD stated intheir annual review letter for the City’s Consolidated Annual Performance andEvaluation Report (CAPER) for the period covering July 1, 2009 to June 30, 2010 thatthere was concern that the City’s goals were too aggressive given their overallperformance in meeting the stated goals. It was suggested that the City review its goalsto determine whether they were appropriate, given the City’s resources. The City thenimmediately responded to HUD’s concerns by reviewing the goals outlined in the planand made adjustments to bring them so that they were in line with available resources.Thus, on April 12, 2011, the Consolidated Plan goals and objectives were formallyrevised by the City of Ferris City Council. There have been no relevant issues with thesubsequent CAPERs.

Other performance issues raised by HUD were administrative in nature. The City ofPerris has since hired qualified professionals with prior CDBG experience in hopes ofimproving administrative capacity and performance. The City is striving to create asuperior CDBG Program and wants to ensure that the goals and objectives outlined inour Consolidated Plan are met in future years.

II. CITIZEN PARTICIPATION

A. Summary of the Citizen Participation Process

As required by the Department of Housing and Urban Development (HUD) Rulesand Regulations, the City complies with Regulation 24 CFR 91.105, CitizenParticipation Plan for local governments. The City has adopted a Citizen’sParticipation Plan that sets forth the policies and procedures for citizen participation.A complete copy of the Citizen Participation Plan can be found at the City’sRedevelopment and Economic Development Department.

The City’s Citizen Participation Plan regulations require that a public hearing be heldto allow citizens and public service agencies an opportunity to express their viewsconcerning the use of funds. The City allowed two opportunities for citizens tocomment on the proposed use of CDBG funds and to consider and approve theCity’s FY 2013-2014 Action Plan. After discussing the matter, and taking intoconsideration any public comment, the City Council approved the Plan on May 14,2013.

In compliance with the City’s Citizen Participation Plan and regulation 24 CFR92.105, a Public Notice was published to solicit comments from interested citizensprior to approval of the City’s FY 2013-2014 Action Plan. In an attempt to facilitatepublic comment, the City provided citizens with more than a 30-day notice, whichbegan on April 5, 2013, and concluded May 14, 2013.

Additionally, information that applies to the Plan and the City’s work in general isavailable. Requests for access to specific information must be made in advance andcoordinated with CDBG Program Staff. CDBG Program Staff will also be availableto persons or interested parties who require technical assistance in understandingthe Annual Action Plan, including the CDBG application process.

B. Summary of Citizen Comments

The City received the following written and oral public comments. Comments havebeen taken into consideration in the development of the Action Plan as part of thestrategies and activities to meet community needs.

C. Agencies/Organizations Participating in Process

A Notice of Funding Availability and Request for Applications was made available tothe general public and all agencies encouraging participation in development of theFY 2013-2014 Action Plan. Additionally, a technical assistance workshop was held onFebruary 7, 2013, to provide citizens and agencies with information regarding the typeof funding to be received, the estimated funding amount, and the eligible uses of saidfunds.

Several agencies contacted attended the workshop, including the following:

Additional Consultation

The City of Perris does not receive Emergency Solutions Grant (ESG) funds, but asrequired under new ESG regulations, the City specifically consulted with the RiversideCounty Continuum of Care (C0C) on how such funds could address homeless needs.The Riverside C0C and other partnering agencies remain committed to providingservices to those homeless or at risk of being coming homeless.

III. RESOURCES

During the FY 2013-2014, the City expects the following resources to be available tomeet the housing and community development needs identified in the Plan:

A. Federal Resources

The following represents descriptions of the Federal resources available to assist theCity of Perris in meeting community development and housing needs:

Community Development Block Grant (CDBG) ProgramCDBG funds are awarded to cities on a formula basis to develop viable urbancommunities by providing decent housing, a suitable living environment, and expandedeconomic opportunities to low to moderate-income persons.

Section 8 Housing Choice Voucher ProgramThe Riverside County Housing Authority, administers the Section 8 housing choicevoucher Rental Assistance Program, manages public housing, and provides emergencyhousing services.

The Riverside County Housing Authority provides Section 8 rental assistance vouchersto owners of market rate units on behalf of low income tenants. The vouchers areassigned to qualified County residents, including the City of Perris’ residents who mayapply them to any rental complex who will accept them in the County. A fairly largenumber of vouchers are accepted in the City of Perris.

Neighborhood Stabilization Program 3 GrantThe Neighborhood Stabilization Program (NSP3) provides grants to certain localcommunities to purchase foreclosed or abandoned homes and to rehabilitate, resell, orredevelop these homes in order to stabilize neighborhoods and stem the decline ofhouse values of neighboring homes. NSP funds are to be treated as CDBG entitlementfund and must benefit persons who earn less than 120% of the area median income(AMI).

State-Allocated HOME Investment Partnership Act (HOME) FundsThese are Federal funds allocated to the City of Perris through the State of California toincrease, improve, and preserve the supply of affordable housing.

B. Non-Federal Resources/Leveraging

In addition to the Federal resources indicated, the City uses a variety of mechanisms toleverage additional resources. In street reconstruction, other funds besides CDBG areused to fulfill the requirements of the City’s pavement management program, such asGas Tax. In public services, funds are either received as part of the program operationor CDBG funds are used with other forms of funding. In recreation facilities and otherconstruction, the City leverages funds from a variety of sources, such as Parks andRecreation Bond funds and General Funds.

The following represents descriptions of non-Federal resources that support housingand community development needs:

General FundsThe General Operating fund of the City used to account for all the general revenue ofthe City not specifically levied or collected for other City funds. Major revenue sourcesinclude property taxes, utility users and sales taxes, and motor vehicle in-lieu fees.

Gas Tax FundsThe State Gas Tax is revenue received by the City from the State of California. Thesefunds include Gas Tax revenues under sections 2106 and 2107 of the Street andHighway Code, which can be used for either street maintenance or construction.

Also, the City will continue to coordinate with the County of Riverside, which providesmany of the health and social services for the City of Perris. In recognition of the need,the County Department of Public Social Services (DPSS) has established a FamilyResource Center in the City. The Family Resource Center seeks to assist familiesdevelop within healthy communities, engage families in their own problem solvingprocess, and act as a bridge between the community and the professional serviceproviders by providing seven (7) of the core services:

• Parenting Skills• Self-Sufficiency• Community Action• Child Abuse Prevention Services• Resource Development, Information, and Referral Services• Education and Literacy• Life Skills

The Perris Family Resource Center offers space to a variety of service providers, bothpublic and private, who conduct classes, meet with residents or otherwise provideservices. Services include basic needs, shelter, utility assistance, substance abuse,child care, health and rental housing. Additionally, the center maintains a job placementboard and a phone for County residents seeking employment.

VI. GEOGRAPHIC DISTRIBUTION/ALLOCATION PRIORITIES

Geographic Distribution

During FY 2013-2014, the City’s housing and community development activities will befocused in its CDBG Target Area where at least one-half of the residents are of low ormoderate income. The Target Area is located primarily in the center of the City andincludes five (5) out of the nine (9), census tracts in the City. The Target Areaincorporates Census Tracts 426.03, 427.19, 428, 429.01, 429.04 as shown in the mapof the CDBG Target Area in the appendix. The Target Area is characterized by highconcentrations of low-income families, high employment, and deferred homemaintenance. CDBG funds will be targeted to projects that are within the Target Areas.These projects include Code Enforcement, Residential Rehabilitation, and publicservice programs.

Geographic Priorities for Investment

Projects and programs are prioritized in the Target Area because it is characterized byhigh concentrations of low-income families, high employment, and deferred homemaintenance and, therefore, have the greatest need for services. The City proposes to utilize its funding for FY 201 3-2014 to finance a variety of housing,community development, and capital improvement projects. The majority of the fundingwill be used to finance projects targeting low-income individuals and families throughoutthe City including those in the special needs categories such as elderly persons.

Percentage of Funds Allocated to Target Areas

The City of Perris plans to use 100% of the $618,420 in available CDBG funds onprojects/programs that benefit low and moderate-income individuals.

Approximately sixty-five (65%) of CDBG funds will be targeted to projects that are withintarget areas/CDBG-eligible areas, including: code enforcement and infrastructure/publicfacilities improvements. The other thirty-five (35%) percent will be used to benefit low-mod clientele.

VIII. PUBLIC HOUSING

Public housing is the jurisdictional responsibility of the Housing Authority of RiversideCounty. There are 477 public housing units in Riverside County including a 40-unitcomplex located within the City of Perris at 102-142 Midway Street in the Target Area.The County will continue to administer the public housing program and manage the onlypublic housing complex in the City.

IX. HOMELESS AND OTHER SPECIAL NEEDS ACTIVITIES

The City is a participant in Riverside County’s Continuum of Care for the Homeless. TheRiverside County Homeless Programs Unit’s primary purpose is to develop andmaintain an effective county-wide Continuum of Care. The Continuum of Care is theregions plan on organizing, delivering supportive social services, including housingoptions, which meet the specific needs of homeless individuals and families. Ultimately,the goal of the Continuum is to move homeless people toward stable housing andmaximum self-sufficiency.

The City will continue to participate in the County’s Continuum of Care and support nonprofit agencies who address homeless and other special needs of the Homeless, Non-Homeless, and Chronic Homeless. The following agencies are located on JointPowers Authority (JPA) property adjacent to the March Air Reserve Base in MorenoValley, California in Riverside County. These agencies will undertake activities to meethomeless and other special needs of Perris residents facing homelessness, includinghomeless prevention, emergency shelter, transitional housing and supportive housing:

The City of Perris also has a Resource Family Center which offers basicneeds, shelter, utility assistance, child care, health, and rental housing assistance.

The Riverside County Housing Authority provides permanent rental assistance to lowincome tenants who meet eligibility criteria.

Addressing Chronic Homelessness

Chronically homeless individuals are those who have lived in a place not meant forhuman habitation for a year, or for three or more times within four years. Additionally,chronically homeless individuals have the barrier of living with a disability. Thesecombined factors often lead to isolation and a survival mentality. Moving people fromchronic homelessness to living in and maintaining permanent housing requires multilevel efforts.

The City’s partnering agencies address reducing homelessness through outreachefforts to persons in need, assessments for medical and essential service needs,options for permanent housing and other needs.

X. BARRIERS TO AFFORDABLE HOUSING

The City has identified factors as potential barriers to affordable housing preservationand production. The City will continue to review the constraints that it has the authorityand ability to mitigate for opportunities to eliminate or improve.

Currently the City’s Anti-Poverty programs are administered by the County of Riverside.Due to its size and resources, the County is able to take advantage of economies of scaleto deliver the services in the most cost effective manner. However, it may be appropriatefor the City to participate in or administer specific programs or projects that would expandits anti-poverty and affordable housing goals. Therefore, in FY 2013-2014, the City willidentify federal, state, and county programs, projects, and financing tools that may furtherthe City’s housing and community goals. The City will also analyze the identifiedprograms, projects, and financing tools to determine the benefit to City goals andobjectives.

C. Actions to Address Lead-Based Paint

The City of Perris is committed to reducing lead-based paint hazards citywide with anemphasis on housing units occupied by low and moderate income households. TheCity will support HUD and EPA efforts to disseminate public information on the healthdangers of lead-based paint. The City will proactively disseminate information on leadhazards and new regulations to its Housing Staff, community based organizations,nonprofit organizations, and other public agencies that receive CDBG funds. The Citywill participate in and support the regional lead poisoning prevention programadministered by the County of Riverside, Department of Public Health:

b. Assist property owners and families in eliminating sources of lead from theirhomes

D. Actions to Foster and Maintain Affordable Housing

During FY 2013-2014, the City of Perris will continue to foster and maintain theprovision of affordable housing for its residents. Through the City’s HomebuyerAssistance Program, the City will assist low to moderate-income families throughhomeownership. Through the Substantial Residential Program, the City will foster andmaintain affordable housing through repair programs designed to assist low to moderateincome homeowners by providing grants and loans for rehabilitation. In addition to therehabilitation programs, the City will continue to work in partnership with developers inproviding affordable housing to low and moderate income individuals and families,including the City’s senior population.

City staff will continue to examine policies, ordinances, resolutions, and procedures, asthey are introduced, to identify and correct any potential constraints, which may inhibitthe City’s ability to foster, implement, and maintain affordable housing assistance.

E. Institutional Structure

The Housing Division of the City of Perris is responsible for administering the CDBGEntitlement grant. The division has staff that is specifically responsible for theadministration, implementation, and the monitoring of programs funded with CDBGfunds. In conjunction with other City departments, staff will continue to identify thecommunity’s greatest needs and allocate resources accordingly.

The City of Perris has a five-member City Council. The City Council holds publichearings, sets policies and priorities, adopts the City’s budget and allocates the City’sentitlement funding. The City Manager is responsible for the implementation of Councilapproved policies, resolutions, and budgets. Other City departments include PublicWorks Department, Community Services Department, Developmental ServicesDepartment and the City Manager’s Office.

CDBG staff has developed positive working relations with nonprofit organizations thatprovide services to residents, and has been able to encourage partnerships. The Citywill continue to work with Riverside County agencies such as the Department of PublicSocial Services to continue to meet the needs of the City’s special needs populations.The City encourages local nonprofit social service and health organizations to apply forgrants from private sources, and provides information and letters of support wheneverpossible and appropriate.

The City will seek new partners for economic development activities. As the economyimproves the City will look for ways to partner with the business community to expandjobs for low-income and moderate-income workers.

The City is committed to improving its compliance for all allocation and expenditurerequirements in advance of compliance deadlines in order to ensure that information isentered into IDIS reporting system on a regular basis. To ensure the City’s compliance,CDBG Staff will continue to monitor sub recipients and verify that the goods or servicesfunded have been provided and that program requirements have been met. Subrecipients are required to submit reports showing activities conducted andaccomplishments. Reports are reviewed to determine if the program is being carriedout in a timely manner and is meeting the goals and objectives established. The City’spurpose in monitoring its sub recipients is to maximize grant performance and toprovide the greatest amount of services to the residents of the City of Perris.

F. Coordination Efforts

The City will continue to improve internal processes regarding allocation andadministration of all programs by identifying structural gaps and enhancing protocols toallow for greater accuracy in reporting and monitoring. CDBG staff will followprocedures established in the CDBG Policy and Procedure Manual, such as utilizingMemorandums of Understanding (MOU) between city departments responsible foradministering CDBG funded programs, to establishing greater communication,coordination and accountability, and provide technical training to internal sub-recipients.

Managing the Process

This is the third year that the City of Perris will be implementing its CDBG Program asan entitlement jurisdiction. The initial five year consolidated plan established a simpleframework upon which a more extensive and comprehensive structure could bedeveloped in future years. It focused on the same types of activities and projects thatcomprised the City’s CDBG Program under the County of Riverside. The City reliedupon the various public agencies, non-profit organizations, and for-profit organizationsthat contributed to the provision of affordable housing. Therefore, the effectiveness ofthe programs and services offered to the community is due in large part to thecommunication among these various organizations. Non-profit organizations play a vitalrole in ensuring the adequate delivery of public and social services. The City iscommitted to promoting collaboration and partnerships among the agencies andorganizations that receive CDBG funds and among all agencies and organizations thatserve low-income to moderate-income individuals, families and neighborhoods in orderto address the national objectives and local goals.

The City will continue to support and participate in public participation processes thatencourage and assist community development. The City will continue to work with localnonprofits, residents, government agencies, and other community organizations toensure that the needs and concerns of the community are addressed. The following arethe organizations and their roles as they pertain to the housing and community servicedelivery system in the City of Perris:

1. Housinc Division: serves as the lead agency in coordinating preparationof the Consolidated Plan, Annual Action Plan, and the ConsolidatedAnnual Performance Evaluation Report (CAPER). The Departmentadministers the CDBG Program, ensures satisfactory product and servicedelivery by all grantees, and commits to meeting all HUD CDBG programregulations.

2. Public Works Department: responsible for maintaining the City’sinfrastructure including streets, traffic signals, circulation, sewers, stormdrains, and waterlines. The Department also maintains public facilitiesand manages the CDBG funded Graffiti Removal Program.

3. Community Services Department: oversees five divisions: LeisureServices, Media Services, Recreational Services, Senior Services, andSports Programming.

4. Development Services Department: includes the Divisions of Planning,Building, and Code Compliance. The Department performs all functions ofthe permitting process and the issuance of business licenses.

5. City Manager’s Office: responsible for the day-to-day operations of theCity, including financial commitments and program staffing.

6. Housing Authority: administers the Section 8 Rental Assistance Program,manages public housing, and provides emergency housing services.

7. Department of Public Social Services (DPSS: the DPSS administers thehomeless programs for the County and maintains an effective county-wideContinuum of Care. The Continuum of Care is the regions plan toorganize and deliver supportive social services, including housing options,which meet the specific needs of homeless individuals and families.Ultimately, the goal of the Continuum is to move homeless people towardstable housing and maximum self-sufficiency. DPSS also administers theAnti-Poverty programs for the County and participating jurisdictions.

8. Department of Health: administers the county-wide HIV/AIDS Programand Childhood Lead Poisoning Prevention Program. The City of Perrisdepends on the Department to protect the health of its residents.

9. Economic Development Agency (EDA): administers the County’s CDBGProgram. EDA received Neighborhood Stabilization Funds (NSP) to easeforeclosure programs in the County.

1 0. Non-Profit Organizations: Non-profits provide a network of resources thataddress a wide variety of housing and community development needs andto provide feedback to the City. The organizations also offer a valuablelink between the sub-populations in need of assistance and City Hall.

11 . For Profit Businesses: Private sector businesses and companies thatassist in implementing the Annual Action Plan include lending institutions,developers, and contractors that will work with the City on the delivery ofits affordable housing programs through the Redevelopment Agency.

Actions to Coordinate the City’s Housing Strategy with Local/RegionalStrategies

The City of Ferris supports efforts that address its transportation barriers. Buildingbetter transportation linkages between Ferris and its neighboring cities wouldsupport the potential for accessing jobs and public services for its low-moderateincome residents. Flans have been made to construct apartment complexes for low-moderate income individuals near the rapid transit system. The new transportationcenter is multi-modal inclusive of local bus and Amtrak service. Metro Link servicebegins in 2013. The transportation center is within walking distance to a variety ofpublic and neighborhood services such as: City Hall, Senior/Teen Center, FerrisFublic Library, parks and recreational facilities and downtown Ferris.

XIII. MONITORING

A. Standards & Procedures for Monitoring/Ensuring Compliance

All monitoring is the responsibility of the Housing Division. Monitoring forms andprocedures were designed by CDBG Program Staff to ensure long-term compliancewith program requirements.

The City will use various types of monitoring standards to ensure compliance withFederal regulations governing the use of CDBG funds. Monitoring procedures include:monthly desk audits, review of monthly/quarterly performance reports, review ofmonthly/quarterly financial billing, and on-site inspections.

Performance of planned projects and activities of these funds are monitored dependingon the type of program and reporting requirements. Monitoring is viewed as a way toidentify deficiencies and promote corrections in order to improve performance. Theactual activity of monitoring helps promote quality performance, as well as identify anyneed for further technical assistance. The following is a description of the types ofmonitoring performed by CDBG staff:

Monitoring includes: on-site visits, desk audits, technical assistance monitoring,interviews, telephone contacts, and reports. The Subrecipient Agreements and/orMemorandums of Understanding (MOU) are used to measure funded agencycompliance.

The City operates in accordance with the monitoring plan developed for CDBG andHOME Programs, including an annual single audit in conformance with 0MB Circular133-A. CDBG staff also monitors all activity of the program on a monthly basis, whilefinancial management is monitored jointly by the Project Monitor and the City’s fiscaldepartment.

Compliance with Housing Codes/Property Standards

In order to ensure compliance with local housing codes, the City takes the followingactions:

1. Incorporates local housing codes in written rehabilitation standards.2. Inspects work write-ups to ensure specifications meet code.3. Performs on-site property inspections to ensure property standards and local

housing codes are actually met.4. Maintains an inspection checklist in project files.

Timely Expenditure of Funds

The City will implement the following actions as a part of its policy and procedures toensure timely expenditure of CDBG funds:

1. Monthly review of project expenditure rates.2. Include provisions in annual Subrecipient Agreements and MOU5 with

subrecipients, reiterating Federal requirements for use of CDBG funds, includingtimely expenditure of funds.

3. Group infrastructure projects together for design and bidding to help expediteprocessing and ensure timely completion of projects and expenditure of CDBGfunds. The projects will be grouped together for bidding and design based onsimilar work, but tracked individually during the construction phase for status,compliance with labor standards and expenditures.

4. Evaluate infrastructure projects on a quarterly basis for status/progress andcompletion; CDBG funds will be transferred from stalled or slow-moving projects,subject to Council approval, to projects that are progressing toward construction.

CERTI FICATIONS

In accordance with the applicable statutes and the regulations governing the consolidated planregulations, the jurisdiction certi lies that:

Affirmatively Further Fair Housing-- The jurisdiction will affirmatively further fair housing, whichmeans it will conduct an analysis of impediments to fair housing choice within the jurisdiction, takeappropriate actions to overcome the effects of any impediments identified through that analysis, andmaintain records reflecting that analysis and actions in this regard.

Anti-displacement and Relocation Plaii -- It will comply with the acquisition and relocationrequirements of the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970,as amended, and implementing regulations at 49 CFR 24; and it has in effect and is following aresidential antidisplacement and relocation assistance plan required under section 104(d) of the Housingand Community Development Act of 1974, as amended, in connection with any activity assisted withfunding under the CDBG or HOME programs.

Drug Free Workplace -- It will or will continue to provide a drug-free workplace by:

I. Publishing a statement notifying employees that the unlawful manufacture, distribution,dispensing, possession, or use of a controlled substance is prohibited in the grantee’s workplaceand specifying the actions that will be taken against employees for violation of such prohibition;

2. Establishing an ongoing drug-free awareness program to inform employees about -

(a) The dangers of drug abuse in the workplace;(h) The grantee’s policy of maintaining a drug-free workplace;(c) Any available drug counseling, rehabilitation, and employee assistance programs; and(d) The penalties that may be imposed upon employees for drug abuse violations occurring

in the workplace;

3. Making it a requirement that each employee to be engaged in the performance of the grant hegiven a copy of the statement required by paragraph 1;

4. Notifying the employee in the statement required by paragraph I that, as a condition ofemployment under the grant, the employee will -

(a) Abide by the terms of the statement; and

(h) Notify the employer in writing of his or her conviction for a violation of a criminal drugstatute occurring in the workplace no later than five calendar days after such conviction;

5. Notifying the agency in writing, within ten calendar days after receiving notice undersubparagraph 4(h) from an employee or otherwise receiving actual notice of such conviction.Employers of convicted employees must provide notice, including position title, to every grantofficer or other designee on whose grant activity the convicted employee was working, unless theFederal agency has designated a central point for the receipt of such notices . Notice shallinclude the identification number(s) of each affected grant;

6. Taking one of the following actions, within 30 calendar days of receiviiig notice undersubparagraph 4(b), with respect to any employee who is so convicted -

(a) Taking appropriate personnel action against such an employee, up to and includingtermination, consistent with the requirements of the Rehabilitation Act of 1973, asamended; or

(h) Requiring such employee to participate satisftictorily in a drug abuse assistance orrehabilitation program approved for such purposes by a Federal, State, or local health,law entbrcerncnt, or other appropriate agency;

7. Making a good faith effort to continue to maintain a drug-free workplace throughimplementation of paragraphs 1, 2, 3, 4, 5 and 6.

Anti-Lobbying -- To the best of the jurisdictions knowledge and belief:

I. No Federal appropriated ftinds have been paid or will be paid, by or on behalf of it, to any personfor influencing or attempting to influence an officer or employee of any agency, a Member ofCongress, an officer or employee of Congress, or an employee of a Member of Congress inconnection with the awarding of any Federal contract, the making of any Federal grant, themaking of any Federal loan, the entering into of any cooperative agreement, and the extension,continuation, renewal, amendment, or modification of ally Federal contract, grant, loan, orcooperative agreement;

2. If any funds other than Federal appropriated hinds have been paid or will he paid to any personfor influencing or attempting to influence an officer or employee of any agency, a Member ofCongress, an officer or employee of C’ongress, or an employee of a Member of Congress inconnection with this Federal contract, grant, loan, or cooperative agreement, it will complete andsubmit Standard Form—I,LL. Disclosure Form to Report Lobbying,’ in accordance with itsinstructions; and

3. It will requre that the laiiguage of paragraph I and 2 of this anti-lobbying certification heincluded in the award documents for all subawards at all tiers (including suhcontracts, subgrants,and contracts under grants, loans, and cooperative agreements) and that all subrecipients shallcertify and disclose accordingly.

Authority of Jurisdiction —— The consolidated plan is authorized under State and local law (asapplicable) and the jurisdiction possesses the legal authority to cany out the programs for which it isseeking funding, in accordance with applicable HUE) regulations.

Consistency with plan -- The housmg activities to he undertaken with CDBG, FIOME, ESG, andHOP WA hinds are consistent with the strategic plan.

Title

Specific CDBG Certifications

The Entitlement Community certifies that:

Citizen Participation -- It is in full compliance and following a detailed citizen participation plan thatsatisfies the requirements of 24 CFR 91 105.

Comm unity Development Plan -- Its consolidated housing and comm unity development plan identifiescommunity development and housing needs and specifies both short-term and long-term communitydevelopment objectives that provide decent housing, expand economic opportunities primarily forpersons of low and moderate income. (See CFR 24 570.2 and CER 24 part 570)

Following a Plan -- It is following a current consolidated plan (or Comprehensive Housing AffordabilityStrategy) that has been approved by HUD.

Use of Funds -- It has complied with the following criteria:

I. Maximum Feasible Priority. With respect to activities expected to be assisted with CDBG funds,it certifies that it has developed its Action Plan so as to give maximum feasible priority toactivities which benefit low and moderate income families or aid in the prevention or eliminationof slums or blight. The Action Plan may also include activities which the grantee certifies aredesigned to meet other community development needs having a particular urgency becauseexisting conditions pose a serious and immediate threat to the health or welfare of thecommunity. and other financial resources are not available);

2. Overall Benefit. The aggregate use of CI)BG funds including section 108 guaranteed loansduring program year(s) (,3 (a period specified by the grantee consisting of one.two, or three specific consecutive program years). shall principally benefit persons of low andmoderate income in a manner that ensures that at least 70 percent of the amount is expended foractivities that benefit such persons during the designated period:

3. Special Assessments. It will not attempt to recover any capital costs of public improvementsassisted with CDBG funds including Section 108 loan guaranteed funds by assessing any amountagainst properties owned and occupied by persons of low and moderate income, including anyfee charged or assessment made as a condition of obtaining access to such public improvements.

However, if C[)BG funds are used to pay the proportion of a fee or assessment that relates to thecapital costs of public improvements (assisted in part with C1)BG funds) financed from otherrevenue sources, an assessment or charge may he macic against the property with respect to thepublic improvements financed by a source other than CDBG funds.

The jurisdiction will not attempt to recover any capital costs of public improements assistedwith CDBG funds, including Section 108, unless CDBG funds are used to pay the proportion of

or assessment attributable to the capital costs of public improvements financed from otherrevenue sources. In this case, an assessment or charge may he made against the property withrespect to the public improvements financed by a source other than CDBG funds. Also, in thecase of properties owned and occupied by moderate-income (not low-income) families, anassessment or charge may be made against the property for public improvements financed by asource other than CDBG funds if thejurisdiction certifies that it lacks CDBG funds to cover theassessment.

Excessive Force -- It has adopted and is enforcing:

1. A policy prohibiting the use of excessive force by law enforcement agencies within its

jurisdiction against any individuals engaged in non-violent civil rights demonstrations; and

2. A policy of enforcing applicable State and local laws against physically barring entrance to orexit from a facility or location which is the subject of such non-violent civil rightsdemonstrations within its jurisdiction;

Compliance With Anti-discrimination laws -- The grant will be conducted and administered inconfomiity with title VI of the Civil Rights Act of 1964 (42 USC 2000d), the Fair Housing Act (42 USC3601-3619), and implementing regulations.

Lead-Based Paint -- Its activities concerning lead-based paint will comply with the requirements of 24CFR Part 35, subparts A, B, J, K and R;

Compliance with Laws -- It will comply with applicable laws.
