This optional workshop will be run between 5pm and 7pm on the evening of Tuesday 8th September. It was developed because we realised that the Summer School caters for a range of levels of experience and knowledge. The workshop outlines the basic principles of employment law allowing everyone to start the Summer School the next day on a similar footing. Not only do those who have not studied employment law find it useful but many delegates attend it as a refresher to remind them of principles they have learnt before but have not used recently. The workshop is led by Stephen Taylor who is a lecturer at Exeter University.

DAY ONE WEDNESDAY 9TH SEPTEMBER 2015

Introduction and welcome to the Summer School from Sandra Wallace UK Head of Employment at DLA Piper

New developments in employment law and future reforms.

In light of the General Election on 7 May 2015 we will look at all the key updates on developments and proposals to ensure you are fully prepared for all HR legal issues, which have been introduced or are on the horizon. The Conservative party has stated its intention to make many changes to employment law especially in relation to industrial action and picketing. Flagship proposals relate to the voting thresholds, which will be needed to make strike action lawful. There are also proposals to limit the time for which a strike ballot can be effective. The Conservatives also propose a British bill of rights to replace the Human Rights Act 1998. Changes are also proposed for zero hours contracts, maternity pay for the self-employed and capping the payments which can be made to redundant public sector workers.

Labour’s pre election focus is on increasing the minimum wage, further legislation to support equal pay, increasing free child care, abolishing employment tribunal fees, bringing back the concept of 3rd party harassment (which the Conservative government removed), addressing perceived pay and conditions issues in the labour market in relation to TUPE and use of short term and fixed term contracts to avoid employment rights and promoting the living wage.

Liberal democrats will look to make improvements in the national minimum wage, increase paternity leave, inspect employers to check they comply with employment law and introduce measures to support unrepresented litigants.

UKIP would leave the EU, repeal the Human Rights Act, change zero hours contracts and legislate so employers would be entitled to discriminate in favour of young British workers.

Of course some of these pre-election proposals will never be implemented; some may be affected if there is a coalition government. In our first session we will look at the key developments, which matter and discuss their significance for practitioners.

We will cover:

• Latest proposals for Zero Hours Contracts and proposed changes.

• Agency workers including the impact of Moran and others v Ideal Cleaning Services Limited and the review of the Agency Worker Regulations

• Industrial action

• Key developments and risks for employers in holiday calculations, holiday pay assessment and historical claims for holiday pay. This session will cover all key holiday pay issues including the impact of decisions for your businesses in Lock v British Gas Trading and others and Bear Scotland v Fulton

• We will also look at the tricky issues which often arise with holiday, including holiday and sickness, part time work and Working Time Regulations holiday contrasted with contractual holiday entitlement

• Working time – is the British opt out from the 48-hour week still under threat?

• Judicial review of employment tribunal fees and the compensation cap in tribunals – what is the current state of the law, what developments can we expect and what impact have fees and the compensation cap had?

• Equal Pay and the impact of Brierley v Asda Stores Limited

• Data protection – what do you need to know about Data Subject Access Requests changes

TUPE and outsourcing

An overview, tactics, and essential update. We will use case studies to illustrate key legal issues and changes.

Case study – Sickness and incapacity and the impact of the health and work serviceManaging sickness and incapacity continues to be one of the key challenges for employers – keen to do the right thing by their employees but also to ensure proper standards of performance. In our practice we are asked regularly about disability, adjustments, the use of occupational health, what is a “reasonable employer” expected to do and when can s/he say they have exhausted their obligations and might terminate employment. The new Health and Work Service is expected to be fully implemented by the time our summer school takes place and we will look at its impact for employers including the referral service for employees who have been absent for more than 4 weeks.

This session will include a brief recap on disability law as it relates to ill health in the workplace to give context to the case study.

A UNIQUE OPPORTUNITY TO STUDY AT ONE OF OXFORD UNIVERSITY’S COLLEGES

Founded in 1624, informality and distinction have always rubbed shoulders at Pembroke. This was Samuel Johnson’s college, as well as JRR Tolkien’s and Senator J. William Fulbright’s. The College counts Lord (Michael) Heseltine and US Senator Richard Lugar among its alumni, together with more than one recent Permanent Secretary of the British Foreign Office. A string of remarkable scientists studied and taught here in the 18th and 19th centuries, among them chemist Thomas Beddoes and astronomer Nathaniel Bliss, sharing life in the College with outstanding theologians and lawyers, including John Moore who became Archbishop of Canterbury in 1783 and the celebrated jurist Sir William Blackstone. James Smithson, whose testamentary wishes led to the founding of the institution which bears his name in Washington, also studied here. Recent Masters include the neurologist and record-breaking runner, Sir Roger Bannister, senior Middle Eastern diplomat Sir Geoffrey Arthur and Professor of Law, Robert Stevens. In addition to a Governing Body of 38 Fellows and 4 Advisory Fellows (alumni who lend their professional experience to Pembroke as Trustees or non-executive members of the Governing Body), it has just under 400 Undergraduates, as well as around 30 Visiting Students from the USA and about 100 Graduate Students.

YOUR STAY AT PEMBROKE COLLEGE

All meals and accommodation are included in the price of the Summer School. Accommodation will be provided in ensuite rooms. These are the College’s student rooms and provide clean but basic accommodation. All rooms have towels (bath and hand), bedlinen, a welcome pack (containing shampoo, soap etc), and tea and coffee making facilities. Internet access is available in all of the bedrooms. Most of our meals will be taken in the College’s magnificent Great Hall which is an experience in itself.

Car Parking – There is no car park and parking in the centre of Oxford is very limited. We strongly recommend you travel by public transport, the college is within a close distance of the coach and train stations. We will send full details of car parks and maps with our joining instructions.

Social Programme – The social programme gives you the chance to meet and network with fellow delegates which, from our experience, is a hugely important part of this kind of course. As well as being here to learn we also want you to enjoy the experience of staying in such a beautiful college. This year’s optional activities include a quiz night, Ghost Tour around Oxford plus dinner at a local restaurant.

Occupational health

Dr Nerys Williams, Occupational Health Expert will give a presentation on the new “fit to work” regime and role of occupational health.

We will then look at a case study focusing on sickness incapacity and disability - including mental and physical impairments with a discussion of adjustments and the employer’s obligation.

Redundancy update

Redundancy, restructuring, reorganisation and contract change including the imapct of Woolworths. Despite changes in the economy, employers are still managing their workforces actively whether through redundancy, contract changes or reorganisation. We will look at the individual and collective consultation obligations and risk management for claims avoidance. We will use case studies to illustrate how to achieve change. We will update you on the current state of the law following the Ethel Austin and Woolworths cases in the European court and the key issue of how to calculate redundancy numbers for collective consultation in many-sited enterprises.

Grievance

Extended/Interactive case study on a grievance which leads to an internal investigation involving claims of discrimination/whistleblowing/work related stress/disability with issues around data subject access requests, privilege, confidentiality and privacy. The case study involves a female middle management employee who claims she has been sexually harassed at work in the UK and during work conferences in New York and Czech Republic by a senior manager. The case study will involve working in teams to interview various employees and juggling the need for confidentiality against business risks. The purpose is to give an in depth understanding of how to conduct a successful investigation and reach a conclusion with minimum risk of litigation from anyone.

Nerys Williams, Occupational Health Expert

Dr Nerys Williams qualified in Manchester and then worked in a number of hospital and general practice posts before qualifying as a specialist in occupational medicine. She worked for 12 years in the Health and Safety Executive latterly as a Senior Medical Inspector and Head of the Employment Medical Advisory Service before joining the Department for Work and Pensions in a strategy and health policy role as Principal Occupational Physician. She left DWP in 2011 and has since worked for Capita on DWP contracts including, currently, the new Fit for Work service. Nerys is also an Honorary Associate Professor at Warwick Medical School and the author of 3 books on occupational health topics.Her occupational health interests include the employment implications of obesity.
