Dependency on developer dollars varied greatly among the 13 candidates, with some candidates appearing to try to hide the extent of their reliance on development money. Four candidates took at least 32 percent of their money from real estate and construction interests. They were led by former Council Member Jimmy Flannigan, whom voters retired in 2020, and District 2 candidate David Chincanchan, at 38 percent apiece. Other candidates enjoying heavy developer support were Council Member Greg Casar and District 10 candidate Robert Thomas. By contrast, researchers tied less than 10 percent of the money raised by three candidates to the real estate and construction industries. They were Council Member Vanessa Fuentes, District 7 candidate Morgan Witt, and District 10 candidate Pooja Sethi. REPORT Half of Austin’s 10 city council seats were up for grabs in 2020, with 17 candidates raising campaign funds to pursue one of those five seats. This study analyzes the sources of almost $1.7 million in contributions that the 13 best-funded candidates raised. They did so in amounts ranging from $17,709 to $335,907 apiece.1 Researchers identified interests behind 88 percent of the money given to the 13 candidates studied here.2 This identification rate varied. Candidates who drew more money from a newer pool of smaller dollar donors were more challenging than those who drew on relatively larger contributions from the usual suspects at City Hall. Researchers identified the source of 80 percent or more of each candidate’s campaign money based on a good-faith review of the contribution reports and Internet searches. Austin limits an individual to giving no more than $400 per candidate in the general, and $400 more in a runoff. With individuals giving $400 to numerous candidates—and $800 to runoff candidates—some couples contributed thousands of dollars to the candidates studied here.3

The resulting numbers show what many Austinites suspect: The real estate and development industry is the biggest funder of Austin City Council races. Real Estate interests supplied at least 16 cents of every 2020 campaign dollar. The No. 4 construction industry supplied at least 9 percent more of the money. So at least one quarter of city council campaign money comes from one side of Austin’s heated battles over land use, gentrification and displacement. This figure understates developer influence since researchers only identified the source of 88 percent of the money. In addition, many leading donors from Austin’s finance, legal and lobbying professions specialize in servicing development interests, yet they are not classified as “developer interests” here.

Developer money is even more concentrated in the accompanying list of the biggest contributors to Austin’s best-funded council candidates. More than half of the biggest council contributors hail from the real estate or construction industries. The only other industry in that league is lawyers and lobbyists. And every top donor from that industry worked for Austin’s leading developer lobby firm: Armbrust & Brown. If you counted Armbrust & Brown employees as the development-industry donors that they are, then development interests would account for 32 of Austin’s top 39 council contributors. Other major employment sectors scarcely appear on this list, including computers, health, and federal, state and local government. Their donations appear farther down the contributor food chain, along with a smattering of endangered-species checks from artists and musicians. In another gauge of developer influence, the accompanying table shows the top total contributions by employer to the 13 top council candidates. Employers considered for this table came from two groups. First, any employer that had an employee on the list of top overall council contributors above. Second, all employers on the Austin Chamber of Commerce’s list of the area’s top 33 employers (they each employ from 2,000 to 64,000 local workers). Just six of the Chamber’s top area employers rank among the top council contributors by employer (listed in italics below). Such leading employers as Samsung and Apple were elbowed off the list by much smaller firms concentrated in the real estate and construction industries. Council candidates took more money from a couple dozen employees at Armbrust & Brown, Endeavor Real Estate, and Journeyman Construction than they received in direct contributions from every major Austin-area employer but one: The City of Austin itself.

Developer influence on local elections almost certainly would be more pronounced if not for Austin’s $400 campaign contribution limits. On May 1 voters have an opportunity to further counter developer influence through Proposition H, which would use public funds to provide every registered voter with two $25 Democracy Dollar vouchers to contribute to a mayoral and a council candidate of their choice. Austin’s $400 contribution limits do not constrain most Austinites. A 2019 U.S. Federal Reserve study found that it would impose economic hardship on 40 percent of Americans to cover a hypothetical $400 unexpected expense. Yet $400 limits do restrict wealthy Austinites. This is particularly true of city lobbyists, who are subject to an even more stringent contribution cap of $25 on each lobbyist and on each lobbyist spouse. The following table shows contributions made by a prominent Armbrust & Brown developer lobbyist and his wife since 2016. Note that Richard Suttle alone made all the state contributions, shown in italics, apart from Alison Suttle’s lone contribution to local state Judge Julie Kocurek. By contrast, most Suttle contributions to city candidates came from Alison alone or from Alison and Richard together, with their joint contributions invariably listing her name first. The majority of the state contributions mention “Armbrust & Brown,” but only about a third of the local ones do. Possible explanations include that Austin counsel candidates are sensitive about reporting Armbrust & Brown contributions. Or perhaps Alison Suttle has a more-exclusive interest in local politics than does her lobbyist spouse.

In a less-Suttle case of developer-disclosure amnesia, not one of the four candidates bankrolled by Presidium Group President of Development Mark Farrell reported his employer’s name. And, as a herd, they all substituted the humdrum term “Executive” for Farrell’s more descriptive title of “President of Development.”

Finally, then-Council Member Jimmy Flannigan reported receiving a routine $250 contribution from Endeavor Real Estate’s Luke Phillippi on June 17, 2020. The very next contribution that Flannigan disclosed in that report—dated the following day—was $250 from “Phillippi NEEDS TO BE IN WIFE’S NAME, Luke.” Flannigan’s report duly ties that contribution to “Endeavor Real Estate Group.”

One day later, however, Flannigan filed a corrected report. The stated rationale for the correction was that, “This amended report includes the spouse’s name of a donor that was missing on the original report.” In this revised report the $250 from “Phillippi NEEDS TO BE IN WIFE’S NAME, Luke” is now attributed to “homemaker” Alina Mihailescu at the same address as Endeavor’s Luke Phillippi.

A day earlier, all Flannigan’s campaign seemed to know about this $250 was that it was related by marriage to Endeavor Real Estate’s Luke Phillippi. In the illusionist corrected report, that same $250 reappears immaculately scrubbed of any reference to Endeavor Real Estate. While Flannigan’s first disclosure reported these Phillippi-tied contributions consecutively, the corrected report estranges the Phillippi-Mihailescu household. Betwixt its alphabetical sheets, 22 other contributors come between Luke and Alina, who now appear 11 cold pages apart. While no major council candidate steered totally clear of development dollars, some leaned on these generous donors more than others. The appendix provides fundraising profiles of each of the 13 best-funded 2020 candidates. They list the top donors to each candidate, as well as a breakdown of each candidate’s campaign funds by industry or interest group. We would prefer for these top-donor lists to contain the same number of contributors for each candidate. However, some top-donor lists include numerous $400 donors, for example, and researchers didn’t want to arbitrarily include some of those $400 contributors while excluding others.
