A. Definition. Relief from the strict application of the provisions of this chapterwhen, owing to special conditions or exceptional situations, a literalinterpretation of this chapter will result in exceptional practical difficulties to theproperty owner.B. Required findings. Pursuant to 22 Del. C. § 327(a)(3), the Board ofAdjustment shall determine whether each variance application meets thefollowing criteria:

(1) The variance relates to a specific parcel of land, and the hardship isnot shared generally by other properties in the same zoning district andvicinity.Resgonse: the variance relates only to the garage behind 324Savannah Road(2) The variance can be granted without substantial detriment to thepublic good.Resgonse: the variance would improve the public good by relocatingthe garage to a safe distance from the alley(3) The benefits from granting the variance would substantially outweighany detriment.Response: the benefit of granting the variance would be to improveparking safety around the garage, provide additional maneuver room toaccess the garage across the alley, and be more consistent with thestyle and period of the home. The exiting garage is a ContributingStructure with a utilitarian design that does not mirror any architecturalcharacteristics of the house or the period of its construction. There is noclear evidence that the existing structure is the same structure as theNational Park Service description of an “early 20”‘Century, one-story,two-bay, gable-front, gable-roofed frame garage.” A 1953 painting ofthe garage shows a different placement of windows, door and roof pitchthan the current structure.(4) Approval of the variance would not substantially impair the intent andpurposes of the Comprehensive Plan or this chapter.Resgonsez the replacement would adhere to the design, materials andorientation requirements contained in the City Code while attempting tofurther the intent and purpose of the Comprehensive Plan and theHistoric Preservation of Lewes

C. Additional considerations. The Board of Adjustment shall also consider thefollowing factors in reaching its decision on each variance application:

(1) Nature of the zone where the property lies.
