CELEBRATING ARCHITECTURE WITH THE PEOPLEOnce again the Kuala Lumpur Architecture Festival is here for the promotion of better architecture in our cities. The two month long festivities themed ‘CHANGES RE:Position’ maintained a similar format as last year, opening up our celebration across the city at venues such as the National Art Gallery, RUANG by ThinkCity and at White Box Publika in Hartamas.

The festivities kicked off with the launch of KLAF 2018 by KLAF Royal Patron, YAM Tengku Zatashah binti Sultan Idris Sharifuddin Shah at the National Art Gallery earlier this month.

KLAF not only aims to promote the awareness of good architecture but it also promotes the underlying worth and value of us, architects, to the public. As the main organiser, PAM has always been committed to deliver the best, and put its best foot forward in the effort to elevate PAM and our profession during this annual event. Now that the event has grown to such scale and prestige, it is members’ golden opportunity to strategically place architects as leaders in the industry.

I call upon members to support our festival, not just by attending DATUM for its design knowledge and CPD offerings but also to take it as an opportunity to bring friends and family members closer to a deeper understanding of what architecture can do in shaping our urban environment and our lives.

As part of our festivities this year, the ‘KL Chair-ity’ is a unique charity drive cum open design competition to search for a chair that could embody the city of Kuala Lumpur. The chair designs that made it to the final round will be put under the hammer and proceeds from the auction will go to charity selected by our Royal Patron.

The KL Chair exhibition is now on at KLAF Box at the National Art Gallery and runs until 12 August 2018. Visit the exhibition and vote for your favourite KL Chair finalist! Bids for the chair is also open to all and if you win the bid, you will get to own a piece of history.

Apart from KLAF, I am happy to note that beginning this month, PAM started conducting a program that is crucial to architects professional development, specifically on the structured course for preparation of the Part 3 professional examination. The course is organised by Pusat Teknologi PAM or PT PAM and is held twice a week for 6 weeks. We welcome enquiries from our Graduate and Student Members who would like a head start in preparing to become a professional architect.

Another knowledge sharing program conducted this month is the PAM BIM Summit 2018 which was held on 20 July 2018 at Fakulti Alam Bina, Universiti Malaya. This program is in line with one of the Construction Industry Transformation Plan (CITP 2016-2020) initiative to promote BIM usage to boost our construction industry. Read further on the summit inside.

A boost to our profession came with the appointment of Datuk Ar. Raja Kamarul Bahrin Raja Ahmad who was sworn in as the new Deputy Minister for the Ministry of Housing and Local Government on 17 July 2018. With this appointment, PAM anticipates a better understanding and cooperation from our local authorities and Ministry of Housing and Local Government, at least for the next five years.

We hope there will be light at the end of the tunnel on our struggle in dealing with planning submission, building plan approval and partial CCC for Vacant Possession for housing development. From our various level of engagements, it was really an uphill battle dealing with institutions and individuals with preconceived mindset that refuse to open for objective discussion in search of permanent solutions. As we had arrived at a dead end through these engagements, it is timely to have a new strategy to educate and increase understanding of the regulators and stakeholders on the industry issues. They have to understand that the only losing party in this conundrum is the general public.

With the various changes that are upon us and challenging us on a daily basis, I urge everyone to be well prepared in terms of knowledge and capability. From time to time, our Professional Practice Committee together with PAM Education Committee will come up with programs for members’ benefit. Do keep well informed through Berita Akitek and emails sent by PAM to all members.

Before I end, I would also like to invite all members to visit the newly opened PAM Resource Centre located at the Lower Ground Level of PAM Centre. The resource centre is still in its teething stage and would love to hear feedback from users. See you around!

KLAF 2018 OFFICIAL OPENING CEREMONY2 JULY 2018

The Kuala Lumpur Architecture Festival (KLAF) 2018 was launched by KLAF Royal Patron, YAM Tengku Zatashah Sultan Idris Sharifudin Shah on Monday, 2 July 2018. In line with our effort to extend KLAF to the public, this year’s launching was held at the National Art Gallery in Kuala Lumpur.

Prof. Dato’ Dr. Mohamed Najib bin Ahmad Dawa, National Visual Arts Development Board Director General, in his welcome notes, conveyed his pleasure at KLAF organiser’s foresight to collaborate with the National Art Gallery as part of its annual architecture celebration.

With the theme ‘CHANGES – Re:position’ KLAF seeks to explore the new roles architecture and design play in the (re)configuration of environments accelerated by shifting urban conditions, design economy, social structures and digital realms.

PAM President Ar. Ezumi Harzani Ismail, in his speech, emphasised that KLAF is the perfect opportunity to deepen our discussions and deliberate on how we can unleash the full potential of the ‘CHANGES’ for a more engaging architecture to improve our cities.

KLAF is one of the major annual programmes for Pertubuhan Akitek Malaysia (PAM) and since last year, we had expanded and enlarged the programme, with a view to bring architecture out to the public domain. KLAF2018 is a festival for everyone to appreciate and to embrace architecture in our daily lives.

The launching simultaneously unveiled a much anticipated exhibition, displaying the top finalists of the Kuala Lumpur Chair Open Competition. The search for the KL Chair is a combination of a search of identity for what represents our much beloved capital city, embodied by the chair, and it is also a ‘chair-ity’ event. All the finalist chairs displayed in the exhibition will be auctioned off and the proceeds shall go to charitable causes chosen by PAM.

A special section was allocated for KLAF in the National Arts Gallery called the KLAF Box. Apart from the KL Chair exhibition, KLAF Box is also where you can marvel at the aerial video essay of KLAF Artist-in-Residence, Mariana Bisti. Her works literally give audience a different point of view of what KLites would otherwise see every day.

DATUM:KL 2018 FEATURES NEW ADDITION

Since its inception in 2003, DATUM:KL has grown to be known as a platform to showcase creativity as well as innovation in architecture and design. DATUM:KL comprised of a series of forums and conferences related to architecture, and the supporting disciplines that contributes to architecture such as industrial design, interior architecture and landscape, to name a few. DATUM:KL had undergone a few name changes before settling on its current nomenclature of ‘DATUM’, referring to the singular noun for ‘data’.

Aligning with the KLAF2018 principal thematic of CHANGES, this year’s DATUM:KL seeks to explore in parallel the agency of RE:POSITION as a means to deal with a contingent and changing landscape for architectural practice and discipline.

The DATUM series of conference and forums kicked off with DATUM:Edu – the International Architecture Education Conference on 4 July 2018. It is a full day forum and is a new addition for DATUM:KL, which aims to showcase the evolution of architectural education as experienced by selected architecture schools and how it addresses the dynamics of architecture education in the face of new shifting conditions within and external to the profession. DATUM:Edu is a collaborative effort between Board of Architects Malaysia (LAM) and PAM in bringing Architectural Education to a higher level.

DATUM:Edu line-up featured speakers from around the region and also international speakers including the UIA 2017 UIA Jean Tschumi Prize for Excellence in Architectural Education and Criticism award recipient, Professor Ashraf Salama from University of Strathclyde and Professor Erwin Viray from the newly set-up Singapore University of Technology and Design as the main Keynote Speakers.

DATUM:Edu opening speech was delivered by LAM President, Ar. Zairul Azidin Badri. At this inaugural conference, LAM Council of Architectural Accreditation and Education Malaysia (CAAEM) also took the opportunity to share LAM accreditation and validation process and procedure with participants.

DATUM:Green and DATUM+PLUS were both held on the second day of the DATUM series, occupying a half-day session each. In DATUM:Green, Tony Ip of Tony Ip Green Architects Hong Kong spoke about ‘Green Neighbourhood in High-Density High-Rise Context. Participants were also enlightened by Tang Hsiao Seak and Steven Ngu from Garis Architects (Malaysia), Mathieu Meur from DP Façade (Singapore) and Paulus Mintarga from Timtiga (Indonesia).

DATUM+PLUS participants were treated with a rare glimpse of what goes into the design and curating process of a leading art and design museum, the Victoria & Albert Museum, by its Senior Design Curator, Brendan Cormier. Others who presented were Anne Geenen of Case Design (India) and Stanislaus Fung of CUHK (Hong Kong). From Malaysia, we have Ar. Mei Chee Seong from aLM Architects (Penang) and Ar. Ng Chee Wee from IDC Architect (Sarawak) who shared their experience and thought in the design symposium.

Ezumi Harzani Ismail in his opening speech welcomed everyone to what is now among the leading architecture conference in the region. Each year, the KLAF organising committee looked for speakers who could inspire participants with their innovative methods and ideas to address current concerns in architecture.

Also happening during DATUM:KL was the conferment of the PAM Student Awards 2018 winners, now known as the PAM Silver Medal (for Part 2 students category) and PAM Bronze Medal (for Part 1 students category). The PAM Student Awards is the highest award for Malaysian architectural students and it continues from the previously known PAM-Tan Sri Chan Sau Lai Awards.

Benefactor of the PAM Student Awards, Tan Sri Ar. Hj Esa Mohamed gave away the prizes. We are grateful to have Tan Sri Esa, our own member of PAM to sponsor the cash prize and other cost for the award conferment. It is the intention of the institute to have our own members to contribute back to the profession through architecture students scholarship and awards programme to encourage students to pursue architecture education at local universities and oversea.

Apart from the awards ceremony, a book launching by PAM Sarawak Chapter also took place during DATUM:KL. Authored by John H.S. Ting, ‘The History of Architecture in Sarawak Before Malaysia’ covers the architectural history in Sarawak up to the period just before the formation of Malaysia.

Among the speakers for DATUM:KL are Yossapom Boonsom from Thailand who shared his inspiring experience rejuvenating Chao Phraya river with floating park and public spaces based on Bangkok river community, Fred Holt (Copenhagen), Rapahel Lafargue (Germany), Piet Eckert (Switzerland), Shunri Nishizawa (Japan), Chris Precht (Austria), Jinhee Park (South Korea) and Christ & Gantenbein (Switzerland). From Malaysia, we are proud to have the winners of PAM Awards 2018, Ar. M.J Kanny and Ar. Ng Wai Keong, to present their winning projects in a special showcase on Day 2 of DATUM:KL.

The PAM Student Awards is the highest award for Malaysian architectural students. It seeks to promote scholarship, innovation, merit and excellence in the youth towards the study of architecture. It also demonstrates the commitment of both PAM and the award’s benefactor, Tan Sri Ar. Hj. Esa Mohamed, towards architectural design excellence in our future architects by awarding outstanding achievements at Part 2 and Part 1 level architecture graduates.

The new 5-year cycle of the PAM Student Awards continues from the PAM Tan Sri Chan Sau Lai Awards, 2012-2016. This year’s 2018 edition, the first of a new 5 year cycle, was open to all Malaysian graduating students completing their coursework in 2017.

The PAM Student Awards sets out to recognise and reward outstanding Malaysian talents from amongst the upcoming architectural graduates entering the next phase of their journey. PAM Silver Medal and Bronze Medal Award are the highest accolade for architectural graduates.

KLAF:BOX KL CHAIR EXHIBITION@ NATIONAL ART GALLERY 28 JUNE – 12 AUGUST 2018

The 2018 edition of Kuala Lumpur Architecture Festival - KLAF2018 features its first series exhibition programme titled KLAF:BOX which marks the beginning of KLAF 2018 on 28 June 2018.

Earlier this year, KLAF2018 launched a two-staged open competition to find the best designer chair from all spectrums of Malaysia creativity. KL Chair competition is a journey set out to unearth the best design of a functional object embedded with the essential qualities of Kuala Lumpur, the capital city.

Open to all Malaysians from all walks of life, backgrounds and fields, the KL Chair competition comprises two stages. Out of the 83 entry submissions received, 18 shortlisted designs are constructed on a full working and functional 1:1 scale. These actual size prototype are exhibitied for public viewing and voting at National Art Gallery, Jalan Tun Razak, Kuala Lumpur until 12 August 2018.

The shortlisted designs each strongly portray the designers’ perception and interpretation of Kuala Lumpur city, its people, culture and history, and the distialtion of their techniques, innovations and style into a new medium.

Most of the shortlisted designs also showcase creative exploration of material usage beyond the norms in chair constructions. Materials such as mud collected from the banks of the Klang River, recycled plastic and steel waste, rattan weaving and, rebars and plywoods are among those used in the designers’ intentions to convey their idea of the life of Kuala Lumpur.

Befitting the theme of KLAF2018, CHANGES and REPOSITION, the KL Chair competition and exhibition proves to be a fruitful platform for architects and the public to view the meaning, symbolism and construction

of chairs in the light of change with these remarkable designs. All 18 fabricated chairs are currently on exhibition until 12th August 2018 as part of the KLAF:BOX exhibition at Balai Seni Negara.

An on-going bidding auction entitled ‘CHAIR-ITY’ is also being held concurrent with the KL Chair exhibition. The shortlisted chairs are being put up for auction during the exhibition period with a minimum reserve price of RM 3,500 per chair. RM 2,500 will be returned to the participant as cost, RM 500 will be retained by Organiser as administrative expenses and the rest donated to a charity organisation.

Due to popular demand, the voting period for the People’s Choice Award has been extended until 8th August 2018. One of the lucky voters will stand a chance to win an iPad in our lucky draw contest. The announcements for both KL Chair Jury’s Award and People’s Choice Award will be made on 10th August 2018.

KLAF2018 is a festival for everyone to appreciate and to embrace architecture in our daily lives. The exhibitions and forums held throughout the festival are meant to reach out to the public people from different backgrounds, and across generations. The KL Chair design competition and exhibition is one of the examples of our efforts to engage everyone in creating art as well as experience a diverse range of art forms.

In the long run, the winning KL Chair design could possibly be developed as a product of our national artwork that can generate wealth and create job opportunities to our people.

Can the original copy of PAM Contract 2006 Form be used by parties (Employer & Contractor) when the contractor administrator is not an Architect?

If we have signed the agreement, is there any issue on LEGALITY of the agreement?”

“Recently, we have a project for lift modernisation job and the contract administrator is the M&E Engineer.

They have adopted the PAM Contract 2006 Form but have modified the form by adding the Article 9 on page 7 mentioning that the party name “Architect” shall be substituted with “M&E Engineer”

WITHOUT PREJUDICE

We advise as follows:1. Standard Form Contracts aim to minimize

the time and cost of negotiating contracts.

2. You have indicated that the PAM Contract Form has been adopted and that Article 9 on page 7 has been modified by substituting “Architect” with “M&E Engineer”. As such the contracting Parties have agreed that the role of the contract administrator to confirm that the role of the Architect for valuation of variations, issue instructions and certificates is undertaken by the “M&E Engineer” for the intended scope of work.

3. The Parties ‘agreement’ is reliant on documents referred to in Clause 3 of the Agreement and Conditions of PAM Contract 2006.

4. As to legality of the ‘agreement’, please be advised to seek clarification from a legal counsel in accordance to Sections 10 and 11 of the Contracts Act 1950.

Entitled ‘Mission BIM:Possible – Change Before Self-Destruct’, the summit was organised by Pertubuhan Akitek Malaysia (PAM) in collaboration with Institute of Engineers Malaysia (IEM) and Royal Institute of Surveyor Malaysia (RISM).

The event was also fully supported by CIDB, who is actively pursuing and promoting the use of BIM, in line with one of the Construction Industry Transformation Plan (CITP 2016-2020) initiative to promote BIM usage to boost our construction industry.

The one day event fielded eleven local and international speakers who spoke about BIM, its usage, benefits and applications. The aim of this inaugural summit was two-pronged; to promote the adoption of BIM in the architectural, engineering and construction (AEC) industry and to showcase BIM practice in architectural, engineering and survey firms.

During the opening speech, Ar. Ezumi Harzani shared his own experience exploring building 3D model in the old 3D Studio DOS version more than 25 years ago, and how his firm, Arkitek MAA Sdn Bhd started to invest in BIM 15

years ago. Today, it is proven that they have made the right decision to migrate to BIM which allows the firm to handle bigger and more complex projects more efficiently.

Ar. Latifah Abu shared a similar experience when her firm, LA Architect fully migrated to BIM and is able to handle bigger and more challenging works with fewer manpower as the work efficiency has improved tremendously.

The other speakers for the summit are Ir. Dr. Julian Lee from New Zealand, James Hadden, Jorge Gil Saurez from Hong Kong, En. Muhammad Khairi Sulaiman from JKR, Mr. N.V. Kumaran of Bina Initiatives, Abi Sarwan from 3DTech Parametric, Ir. Kesavan from AECOM, Tim Sin from Sinar BIM and Nur Aizat A Hamid.

Among the interesting applications highlighted in the event are the usage of virtual reality, augmented reality and drones to supplement BIM. The Q&A session was moderated by Ar. Abu Zarim, the convener for this summit.

PRESS CONFERENCE FOR WCSC 2018

On 3rd July 2018, a press conference was held for the launching of the 10th International Conference on World Class Sustainable Cities 2018 (WCSC 2018) at Wisma REHDA, Kelana Jaya.

The conference will be held on Thursday, 27 September 2018 at InterContinental Hotel, Kuala Lumpur. The theme for this year is “KUALA LUMPUR: TODAY AND BEYOND”. This year’s conference will explore how Kuala Lumpur and other cities in Malaysia can prepare for today’s and tomorrow’s challenges, to be more liveable, resilient, inclusive and sustainable, through better planning, technology and social innovations towards implementing the New Agenda for all.

The conference is jointly organised by the Malaysian Institute of Architects (PAM), the Real Estate and Housing Developers’ Association Wilayah Persekutuan KL (REHDA KL) and the Malaysian Institute of Planners (MIP). It is also supported by Kuala Lumpur City Hall (DBKL).

Cities today are at a crossroad, faced with challenges and pressures for further economic growth and stronger competitive advantage. At the same time, cities are expected to provide for better quality of life in an improved urban environment. This includes a conducive and affordable living environment, excellent connectivity and ample outdoor public spaces set within a greener, and therefore, cooler urban setting.

The present challenges facing every city including Kuala Lumpur today is how to balance the need to provide a sustainable infrastructure and environment within the city, and the affordability gap that meets the unwavering trend of continuous migration and growth of population in the city.

Cities therefore need to reinvent themselves to implement and rethink policies and innovative solutions for all issues concerning cities, to achieve the global goal of sustainable development and to implement the universal New Urban Agenda for all.

Since its inception in 2009, the WCSC has been a constructive platform for networking among professionals, city managers and citizen groups to exchange ideas, experiences and challenges. WCSC is also aimed at providing a constructive platform to increase the knowledge of city administration, city stakeholders, industry players, government agencies and the general public on integrated urban solutions and the challenges in transforming our cities into sustainable human settlements that meet the needs of the present and of the future.

WCSC 2018 will showcase an exciting lineup of distinguised international World-Class and local speakers including panelists from South Korea, United States of America and also from Malaysia. These speakers are globally renowned for their innovative ideas and solutions towards present and future urban planning issues and challenges in providing a better and sustainable quality of city life.

Among them would be the Mayor of Seoul Park Won-Soon (South Korea), Senior Associate Principal of Kohn Pedersen Fox Associates, Heejin Kim (South Korea), and CEO of Avanath Capital Management and Past Chairman of the National Multifamily Housing Council 2018, Daryl Carter (USA).

The organising committee expects over 550 delegates including architects, town planners, city managers, government agencies, residents groups, non-governmental organisations and city stakeholders.

The in-depth insight from the sharing of knowledge and experiences by past WCSC international conference speakers have had a positive and influential impact in knowledge sharing on the various benefit and challenges faced in becoming a world class sustainable city.

Among the project being implemented in Kuala Lumpur, having adapted from successful projects undertaken in other cities, include the transformation of Cheongyecheon River restoration in Seoul, Korea that was a great prelude to Kuala Lumpur’s River of Life project; Brazil’s Curitiba experience for its exemplary city transportation solutions; Hong Kong and Singapore’s pedestrianisation projects that include covered walkway system also served as a footprint for Kuala Lumpur’s elevated pedestrian network project.

As part of WCSC 2018 program, concurrent events and activities to be organised include Technical Site Visits and Masterclass sessions for architects, city planners and city hall staff led by our speakers to study and deliberate the opportunities and challenges in transforming the city of Kuala Lumpur based on specific case studies.

A photo contest was also launched at the press briefing, which aims to explore the future of living from all angles of view with the theme “City Living in the Future”. A Collateral Event of KLAF:BOX's AIR/SPACE, an on-going exhibition at the National Art Gallery Malaysia until 12th August 2018.

KLAF's first Artist In Residency, Mariana Bisti, shared her previous experiences in relation to the works she delivered for the Kuala Lumpur Architecture Festival 2018, ‘The 14th Resolution’. This discussion was held in the Auditorium, National Art Gallery Malaysia, on the 8th July 2018.

Bisti introduced herself in a very comprehensive format to the audience to understand how she ended up in Kuala Lumpur. Her storyline on photography started in 2011 in Athens, when she decided to document the street life with her iPhone.

Originally trained as an architect and conservator, Bisti moved to London in 2014 to pursue a MFA in Fine Art Media at the Slade School of Fine Art. Her take on places and their political situations were expressed as artworks and performing art pieces, and her works at the Slade which was particularly relevant to the political unrest in Greece and Brexit were explained at the discussion.

Bisti further shared her experiences on both drone videography and the cities of Hong Kong, Taipei and Kuala Lumpur. Her insights, observations and comparisons of these Asian cities was of much interest to

the audience as she shared her technical methods, ways of mobilising and discovering places, observing people and taking notice of local cultural norms. At times throughout this session, Bisti’s aerial stills of Kuala Lumpur created ‘pop quiz’ moments as the audience tried to guess their locations.

The discussion ended with a 30-minute Q&A session. When asked of her experiences, views and opinions of Kuala Lumpur, Mariana concluded “the city is ugly, but I love it. Its beautiful that way.”

’The 14th Resolution’ is a two-channel video of Kuala Lumpur and a part of ‘AIR/SPACE’, on screening in the KLAF:BOX exhibition, REKA Gallery, National Art Gallery Malaysia, alongside her previous drone videos namedly ‘Wěndìng Fánróng’ (Hong Kong) and ‘In Tandem’ (Taiwan). KLAF:BOX Exhibition is currently ongoing until 12th August 2018.

The KLAF residency started on 14th May 2018 and concluded on 15th July 2018, and were supported by a grant from GDP Architects Sdn. Bhd.

NO PARTIAL CERTIFICATE OF COMPLETION ANDCOMPLIANCE FOR NOTICE OF VACANT POSSESSION

On 23 July 2018, a Focus Group in Dealing with Construction Permit (FGDCP) meeting chaired by Dato' Sri Haji Mohammad bin Mentek, Secretary General of Ministry of Housing and Local Government was held in Putrajaya to discuss the issues concerning stratified housing development in multi phases.

In a multi blocks development with different phases of completion, some blocks maybe completed ahead of other blocks on a shared podium. For a multi-phase development of a single building complex (single Building Plan approval), Partial CCC (Form F1) may be issued at the completion of each phase, subsequently CCC (Form F) shall be issued upon completion of all phases.

Provision for Partial CCC in Uniform Building By Laws – Bylaws 27

“27(1) The principal submitting person may issue a partial certificate of completion and compliance in Form F1 as set out in the Second Schedule in respect of any part of a building partially completed subject to any condition imposed by the local authority which it deems necessary for reasons of public health and safety:

Provided that no such certificate shall be issued unless all the essential services, including access roads, landscape, car parks, drains, sanitary, water and electricity installation, fire hydrant, sewerage and refuse disposal requirements and, fire lifts where required, serving the partially completed portion of the building have been provided.

27(2) A partial certificate of completion and compliance once issued shall remain effective until the whole of the building is completed and a certificate of completion and compliance is issued in pursuant of by-law 25.”

Nevertheless, in a housing development project, the issuance of Partial CCC is not acceptable to satisfy the requirement for CCC as one of the condition for issuance of Notice of Vacant Possession. Therefore, in the eyes of Jabatan Perumahan Negara (JPN), vacant possession cannot be issued with Partial CCC.

Section 3 (Interpretation) of the Housing Development Act (Act 118) states:

“Certificate of Completion and Compliance” means the certificate of completion and compliance given or granted under the Street, Drainage and Building Act 1974 [Act 133] and any by-laws made under that Act certifying that the housing accommodation has been completed and is safe and fit for occupation but does not include Partial Certificate of Completion and Compliance.”

In a multi-phase mixed-development complex, Partial CCC may be issued for the earlier phase, however, the present regulation does not allow for delivery of Notice of Vacant Possession for residential components. This is expressly stated in Schedule H of Housing Development (Control and Licensing) Regulation 1989. Notice of Vacant Possession can only be issued after the issuance of CCC.

Provision for CCC in Uniform Building By Laws – Bylaws 25

“25(1) A certificate of completion and compliance in Form F as set out in the Second Schedule shall be issued by the principal submitting person –(a) when all the technical conditions as imposed by the local

authority have been duly complied with;(b) when Forms G1 to G21 in respect of stage certifications

as set out in the Second Schedule have been duly certified and received by him;

(c) when all the essential services, including access roads, landscape, car parks, drains, sanitary, water and electricity installations, fire hydrants, sewerage and refuse disposal requirements and, fire lifts where required, have been provided; and

(d) when he certifies in Form F that he has supervised the erection and completion of the building and that to the best of his knowledge and belief the building has been constructed and completed in accordance with the Act, these By-Laws and the approved plans.”

With reference to By-law 25, it is clear that CCC cannot be issued for a partially completed building. CCC can only be issued when all the technical conditions and essential services are complied and provided in full.

When CCC system was introduced in 2007, it was the government’s objective to cut down on red-tape and to ensure that house buyers and building owners get to move in as soon as the building is completed and without compromising their safety and health. It is also in line with the government’s intention to encourage professional self-regulation in practice. However, by not accepting partial CCC for vacant possession, the house buyers cannot move in to their completed house although partial CCC has been issued.

On 20 December 2017, Ministry of Housing and Local Government has issued a letter informing that CCC can be issued for partially completed building, which is rather confusing. This is to allow vacant possession to be issued with ‘CCC’ for partially completed building. The contents of the letter that allow CCC to be issued for partially completed building contradict by-law 25, which states that CCC can only be issued when ‘all’ the technical conditions and essential services are complied and provided in ‘full’.

Our members are advised to be careful in issuing the certification for completion and compliance, and be very sure if the certification is for the whole building as per the approved plan or to certify only for partially completed building using form F1. Wrongful certification may lead to legal implication that PSP may need to deal with in later days after the issuance of vacant possession.
