Sub: Establishment - TANGEDCO – Restoration of works among Financial Controller/General, Financial Controller/Revenue and Financial Controller/Purchase in the Office of Chief Financial Controller/General, TANGEDCO – Orders – Issued.

----In the proceedings first cited, orders were issued allocating the works related to

Captive Generation Plant (CGP) issues and its related court cases already dealt with by the Financial Controller/Revenue to the Financial Controller/General, until further orders.

2. Subsequently, in the proceedings second cited, the following reallocation ofworks were temporarily ordered between the Financial Controller/General and Financial Controller/Purchase in the Office of the Chief Financial Controller/General, TANGEDCO:-

i) The Financial Controller/General shall look after the works related to Resourcesand Funds Divisions.

ii) The establishment works shall be placed under the direct control of theChief Financial Controller/General/ TANGEDCO.

iii) The Central Payment Division shall be attached to the Financial Controller/Purchase, under the control of Chief Financial Controller/General, TANGEDCO.

3. Now, the Director (Finance)/TANGEDCO has proposed to restore the worksalready reallocated among Financial Controller/General, Financial Controller/Revenue and Financial Controller/Purchase in the Office of the Chief Financial Controller/General, TANGEDCO. The Chairman-cum-Managing Director/ TANGEDCO has approved the above proposal.

4. Accordingly, the following restoration of works are hereby ordered amongFinancial Controller/General, Financial Controller/Revenue and Financial Controller/ Purchase in the Office of the Chief Financial Controller/General/ TANGEDCO:-

i) The works related to Captive Generation Plant (CGP) issues and its related courtcases shall be restored to the Financial Controller/Revenue.

ii) The subjects related to Funds Division, Resources Division, Central paymentDivision and Establishment Section shall be restored to the Financial Conroller/General.

5. This order shall take with immediate effect.(By Order of the Chairman – cum – Managing Director)

Sub: ESTABLISHMENT – Education qualification – Entry of candidates with bougs educational qualification certificates – Verification of its genuineness – Certain instructions issued – Reiterated – Follow up action – Requested.

In the references cited above, instructions have been issued to all the Appointing Authorities to verify the genuineness of educational certificates of the employees for preventing the continuance of the service of the employees who entered in to TANGEDCO’s in a fraudulent manner with bogus certificate of educational & Technical qualification with the concerned Educational Institutions, and to paste a copy of the Genuineness certificate in the Service Register of the individual. Instructions have also been issued to the Inspection Teams of Secretariat Branch, Administrative Branch and concurrent Audit parties to verify the Service Registers of all the employees (Provincial and RWE)/Officers while conducting the inspection at various offices.

2. It has been brought to the notice that the aforesaid instructions have not been implemented even after fixing time limit. In view of preventing further continuance of such fraudulent cases, it has been decided to reiterate the instructions already issued.

3. All the Chief Engineer’s/Superintending Engineer’s are instructed to ensure that the verification of Educational certificate been done in respect of the left out cases at once and to paste a copy of the same in Service Register without fail. The above exercise may be completed on or before 31.05.2019.

4. Any violation of the above instructions will be viewed seriously.

ORDER: In the Government Order first read above, orders were issued for implementing

New Health Insurance scheme, 2018 for Pensioners (including spouse) / Family Pensioners with effect from 01.07.2018 and also inter alia 913 hospitals have been approved for undergoing accredited treatments/Surgeries under this scheme.

2. In the Government Order second read above, Government has constituted anAccreditation Committee consisting of the Commissioner of Treasuries and Accounts as Head of the Committee, the Director of Medical and Rural Health Services and a representative of the United India Insurance Company Limited as Members of the Committee for empanelment of accredited hospitals and also to monitor the quality of treatment covered under New Health Insurance Scheme. Further, Sub-Committees were constituted at district level consisting of Joint Director, Medical and Rural Health Services, Treasury Officer and a Representative of United India Insurance Company Limited to assist the Accreditation Committee for empanelment of private hospitals in various districts across the state under the Scheme.

3. In the letter third read above, the Principal Secretary/ Commissioner ofTreasuries and Accounts, Chennai has sent the proposal to include 74 new hospitals, deletion of two hospitals namely Gastro Care Hospital, Trichy and Ananthapuri Hospitals and Research Institute, Thiruvananthapuram, Kerala from the accredited list of hospitals and ratification of the decision for inclusion of Radiotheraphy facility under Oncology services rendered by the Harshamitra Super Speciality Cancer Centre & Research Institute Pvt. Ltd, Trichy.

4. The Government, after careful consideration of recommendation of theAccreditation Committee, have decided to include 74 (Seventy Four) additional hospitals as detailed in Annexure-I to this order for undergoing accredited treatment/surgeries, for deletion of two hospitals already empanelled as detailed in the annexure-II to this order and for inclusion of speciality of Radiotheraphy facility under Oncology services rendered by the Harshamitra Super Speciality Cancer Centre & Research Institute Pvt. Ltd, Trichy as detailed in annexure - III to this order under New Health Insurance Scheme, 2018 for Pensioners (including spouse) / Family Pensioners and issue orders accordingly.

----Attention is invited to the provisions contained in regulation 27 (12) of the Tamil

Nadu Electricity Distribution Code and the instructions issued from time to time in the communications under reference cited, the gist of which are stated below:-

(i) Electricity supply to poromboke lands/Government lands should be only basedon No Objection Certificate issued by the concerned Officer of theGovernment of Tamil Nadu not below the rank of the Deputy Tahsildar.

(ii) In addition to the said NOC, security deposit twice the normal rate should becollected and an indemnity bond in Form – 6 of the Annexure – III (referredto in regulation 27(4) of the TNE Distribution Code) should be obtained.

(iii) No electricity supply or service connection should be given to the buildingsconstructed in water bodies poromboke lands.

(iv) The expression “water bodies” is defined as “Water bodies include areas oflakes, ponds, rivers, tanks, reservoirs, areas of marsh, fen, peat land andtheir peripherals and channels, whether the same actually contain water ornot, and whether the same are above the ground or below the ground. Thesemay be natural or artificial, permanent or temporary, located in public orprivate property, with water that is static or flowing, fresh, brackish or salt.These also include areas classified as water bodies in official maps andrevenue records, even if they have been reclassified or encroached upon inany way or inlets blocked”.

(v) In G.O. (Ms) No. 320, Public Works Department (W2), dated 28.09.2007, itwas ordered under the Tamil Nadu Protection of Tanks and Eviction ofEncroachment Act, 2007 (T.N.Act No. 8/2007) that the competent authorityshall not give permission/NOC to construct the building in tanks, river bedand water course bodies poromboke lands, in order to prevent extending ofelectricity supply to the buildings constructed in water course porombokelands.

2. While so, the Hon’ble Madurai Bench of Madras High Court, in its interim order,dated 28.01.2019 in WP (MD) No. 22163 of 2018, after referring to various earlier orders of the Hon’ble High Court, inter-alia, ordered as follows:-

Despite the aforesaid statutory Provisions, Court directions and Report of the Constitutional Authorities, no tangible headway appears to have been made in the process of fully evicting the encroachers from their illegal occupation of the water bodies. As such, the situation has become imperative for this Court to take up the task of monitoring the eviction of the encroachers from the water bodies. As a first step in that regard, we issue the following directions:-

(i) Xxxx(ii) The Collectors of their respective Districts in the State shall

prepare a list of lands identified as water bodies in their revenue records and send copies of the same to the officers of the Registration Department, the Tamil Nadu Generation and Distribution Corporation Limited (TANGEDCO), the local Bodies and the District Election Officers in their respective Districts by 08.02.2019 and file an action taken report before this Court.

(iii) Xxxxx(iv) Xxxxx(v) No electricity connection shall henceforth be provided to any

building in any land which has been notified as water body in the revenue records of the State and the Chairman-cum-Managing Director, TANGEDCO shall issue necessary circular to all its officers authorized to grant electricity connection for ensuring compliance in this regard.

3. Therefore, the Chief Engineers and Superintending Engineers of theRegion/Circle concerned are directed to communicate this instruction to all Officers under their control including the Assistant Engineer/Junior Engineer I Grade in Operation and Maintenance Sections and instruct them to follow the same scrupulously and in its letter and spirit.

4. While so, it is clarified that the existing instructions issued in Memo.No.CE/Comml/EE3/AEE2/F.SC Objections/D.885/2015, dated 28.10.2015 will only apply to the cases of application seeking electricity service connection based on the documents prescribed in the TNE Distribution code, 2004 to establish the ownership and lawful occupancy of the premises. In other words, the instructions in the said Memo., dated 28.10.2015 is not applicable to the cases of application seeking electricity supply/service connection to the premises constructed in water course/bodies.

5. The Chief Engineers and Superintending Engineers of the Region/Circleconcerned shall also ensure themselves that the said instructions are followed up by all the field officers by reminding them in the periodical meetings conducted at Divisional/ Circle/Regional level, so that the genuine intending consumers need not be made to approach the Honb’e High Court for electricity service connection and that the illegal occupants of water bodies are not provided with electricity service connection in violation of the instructions/orders of the Hon’ble High Court.

With reference to the clarification sought by the Chief Engineer/Distribution/ Chennai North Region vide reference (1) cited, it is observed that M/s. Tamil Nadu Housing Board develops group housing project comprising 2394 Nos. dwelling units at S.F.Nos.492,493,494, etc in Ambattur, Chennai.

2. The Regulations 29 (12) (ii) in read with 26 (1) (f) of the TNE Distribution Code states that the developer of the property shall earmark land for establishment of 110 kV sub-station when the total demand of the group housing exceeds 10 MVA. The Chief Engineer/Distribution/Chennai North Region has stated that the total demand of the project comes around 20.76 MVA in this project. As the total demand of the project

exceeds 10 MVA, the developer has to earmark land for development of 110 kV Sub-Station.

3. The developer M/s. Tamil Nadu Housing Board had offered vacant land of 1500.72 SQMs (against the required land of 1050 SQMs) for development of 110/11 kV indoor sub-station under lease basis for a period of 99 years with payment of lease amount of Rs.1/- per year by the TANGEDCO to the TNHB.

4. Under these circumstances, approval is hereby accorded to accept 1500.72 SQMs of land from the TNHB for development of 110/11 kV indoor sub-station at the project premises of the TNHB in Ambattur, Chennai under lease for a period of 99 years with payment of lease amount of Rs.1/- per year.
