174. *Choudhary Faqir Ahmad: (Deferred on 25-4-2019)

Will the Minister for Law and Justice be pleased to state:    

(a) the details of lawsuits which have been filed against theNational Accountability Bureau (NAB) in InternationalCourts of arbitrations, since its inception along with presentstatus thereof separately;

    (b) the grounds of each said lawsuit upon f iled in

said Courts against the NAB along with expenditureincurred thereupon separately till now;

    (c) whether NAB has conducted internal inquires at its own to

examine failures on their part that forced the other partyto file such lawsuits in International Courts of Law; if so,the details thereof; and

    (d) the amount which has been paid by the NAB to

complainants parties as damage/fine or under the head ofany other nomenclature in view of decisions of InternationalCourts?

Minister for Law and Justice (Dr. Muhammad Farogh Naseem):(a) There is no lawsuits filed against NAB in International Court ofArbitration, however, an arbitration titled as Broadsheet LLC v. Govt. of

Pakistan (through NAB) is pending in Chartered Institute of Arbitration,London and High Court of Justice in England. The subject arbitration issub-judice before the Tribunal and the High Court of Justice in Englandand it is therefore under judicial consideration and prohibited from publicdiscussions elsewhere. Furthermore, the details asked by the Hon’blemember does fall under section 78(u) of the Rules of Procedures andConduct of Business in the National Assembly, 2007.The rule reads asunder:—

“it shall not ordinarily ask about matter pending before and statutorytribunal or statutory authority performing any judicial or quasi-judicialfunctions or any commission or court of inquiry appointed to enquireinto or investigate any matter but may refer to matters concernedwith procedure or subject or stage of enquiry if it is not likely toprejudice the consideration of the matters by the tribunal orcommission or court of enquiry”

(b) The subject arbitration is still going on and presently anapplication has been filed in the Tribunal under Section 57(3) of the UnitedKingdom Arbitration Act, 1996 and in the High Court of Justice in Englandunder section 67/68 of the United Kingdom Arbitration Act, 1996.Thereby meaning that the matter is still sub-judice and the grounds anddetails of expenditure cannot be provided. Nonetheless apart from that itis once again stated that the Government of Pakistan / NAB had signeda Confidentiality Agreement and till the matter is resolved, no furtherinformation can be divulged.

(c) NAB is in the process of conducting inquiries. Any publicdisclosure shall adversely affect the interest of public at this stage.

(d) No amount has been paid by NAB to anyone as damagesas the final decision of the Tribunal and High Court of Justice in Englandis still awaited.

114. *Mr. Mahesh Kumar Malani: (Deferred on 25-4-2019)

Will the Minister for Energy be pleased to state whether there isany proposal to provide Gas facility to Mohala Darya Khan,Laghari Town, Pangrio, Tehsil Tando Bago, DistrictBadin, Sindh; if so, the time schedule thereof?

Minister for Petroleum Division: SSGC has reported thatcurrently, no proposal for provision of gas facility to Mohala Darya Khan isunder consideration of the Company.

116. *Dr. Nafisa Shah: (Deferred on 25-4-2019)

Will the Minister for Energy be pleased to state the reasons forshut down of Gas in the country particularly in Sindh in the firstweek of December?

Minister for Petroleum Division: Sui Southern gas CompanyLimited (SSGC) has reported that the company relies only on indigenousgas and in comparison to last year there is natural depletion in differentreservoirs. In December 2018, around 80 MMCFD gas was naturallydepleted as compared to December of 2017. In 2018 total gas received inthe SSGC system was around 1200 MMCFD whereas the demand wasaround 1500 MMCFD. The deficit was managed through the LoadManagement Policy 2005 and as per the Sectorial Priority order set by theECC from time to time. In November 2018, E&P Companies faced problemsin the disposal of condensate to refineries and as a result condensate storageproblem arose and two gas fields (Kunner Pasaki and Gambat) startedcurtailing gas supplies and by the 1st week of December 2018, they curtailedapproximately 50 MMCFD gas. SSGC tried its best to manage the load ofall customers by implementing the Sectorial Priority Order of the LoadManagement Policy. The customers on least priority like CNG and CaptivePower of General Industries were affected. As soon as the problem ofcondensate storage was resolved on 15th December 2018, normal suppliesto the CNG Sector were resumed and the Captive Power of GeneralIndustries were advised to curtail their load by 50% till the end of the winter

peak and normalization of the system. There was no shut down of gashowever, due to curtailments, low gas pressure in some areas occurred andthe same was over come through load management.

It is further apprised that there was no shut down of gas in the areasof operation of SNGPL i.e. Punjab, Khyber Pakhtunkhwa and FederalCapital.

118. *Rana Sana Ullah Khan: (Deferred on 25-4-2019)

Will the Minister for Law and Justice be pleased to state:    

(a) the procedure adopted for appoint of every officerworking in the NAB at present alongwith the prescribedmethod of their recruitment;

    (b) details of each employee including their parent

departments absorbed in the bureau alongwith procedureadopted therefor;

    (c) whether educational qualifications of each employee

were verified from respective educational institutionsand regulatory bodies and such credentials wereexamined with reference to their service record; if so,the details thereof;

    (d) the irregularities reported in the process of making

appointments in the bureau and fake educationalcredentials of several employees were also found; if so,the details thereof; and

    (e) steps being taken by the Government to address the

menace of illegal appointments in the NAB and makeaccountable those who have submitted fake educationalcredentials?

Minister for Law and Justice (Dr. Muhammad FaroghNaseem): (a) As per criteria given in NAB employees Terms and Conditionsof Service (TCS) 2002 and Method of Appointment and Qualifications(MAQ) and amendments made therein from time to time annex-A.

(b) 120 employees were absorbed. Detail is at annex-C andannex-D.

(c) Yes. Details are awaited from NAB.

(d) a. 6 Officers were retired and 2 Officers were repatriated to theirparent departments in the light Of irregularities pointed out byHon’ble Supreme Court of Pakistan in SMC 13/2016.(details at annex-C).

b. One officer was dismissed by NAB due to fake degree.(details at annex-D).

c. Mr. Asad Kharal, a journalist filed a CMA No. 7544/2017 inSMC No. 13/2016 wherein he inter-alia challenged the MSC(Computer Science) degree possessed by Major (R) ShahzadSaleem, Director (BS-20) NAB. In reponse, NAB filed reportand para-wise comments in the August Court vide CMANo. 9591/2017 in SMC No. 13/2016. In addition, NABrequested Higher Education Commission for verification of saiddegree. In reponse, HEC vide letter, dated 31st December,2018 conveyed that the degree issued by Al-Khair Universityin respect of Mr. Shahzad Seleem has been attested by theHEC on 20th October, 2015.

(e) The Hon’ble Supreme Court of Pakistan in Suo Moto videSMC 13/2016 regarding illegal appointments in NAB directed NAB tocomply with the findings of committee formed under SCP’s Order.Subsequently, NAB has submitted compliance reports in the August Court.

119. *Ms. Zaib Jaffar: (Deferred on 25-4-2019)

Will the Minister for Energy be pleased to state:    

(a) the price at which petrol is being sold in the country atpresent; and

    (b) the kind of taxes being charged with detail thereof?

Minister for Petroleum Division: (a) The ex-depot sale price ofpetrol in the country is Rs. 92.89 per litre effective from 1-3-2019.

(b) Details of taxes on a litre of petrol are currently being chargedare as under:—

124. *Mr. Junaid Akbar: (Deferred on 25-4-2019)

Will the Minister for Energy be pleased to state:    

(a) whether it is a fact that most of the Gas consumers installedpressure pumps/suckers in their houses due to the low Gaspressure in winter season;

    (b) the steps being taken by the Government in this regard;

and    

(c) the number of persons found involved therein and the detailsof action taken against them?

Minister for Petroleum Division: (a) SNGPL has reported thatsome of the gas consumers in their franchise areas i.e. Punjab, KhyberPakhtunkhwa and the Federal Capital, have installed pressure pumps/suckers in their houses due to low gas pressure in winter season. Whereas,SSGC has reported that there are no such pressure/ suction pumps indomestic consumers.

(b) Vigilance teams of gas utility companies are checking thesuspected sites where compressors are used for disconnecting theconnections. Further, SNGPL has also initiated a media campaign againstusage of gas compressors for awareness and deterrence, with the messagethat gas connection of such consumers will be disconnected immediately.

(c) SNGPL has reported that as a result of campaign againstusage of gas compressors more than 1,950 cases has been identified anddisconnections have also been carried out.

131. *Mr. Riaz Fatyana: (Deferred on 25-4-2019)

Will the Minister for Energy be pleased to state:    

(a) whether it is a fact that tenure of Mr. Muhammad Hanif,GM, SNGPL, Faisalabad has been completed;

    (b) if so, when new GM will be posted in Faisalabad?

Minister for Petroleum Division: (a) Mr. Muhammad Hanif isposted as General Manager, Faisalabad (Distribution) since 07-04-2016.He has worked in Compression as well as Distribution Departments.The tenure of a Regional General Manager is not defined in terms ofminimum/ maximum number of years of posting at a place; rather anychange in posting at such a position of responsibility is made to meetoperational requirements of the Company, Therefore, tenure of a RegionalGeneral Manger continues till any change in posting is necessitated dueto the Company’s business.

(b) Posting of any Regional General Manager is not linked withany time frame. A new General Manager would be posted at Faisalabadwhenever the existing incumbent is moved to any other department orlocation depending upon the operational requirements of the Company.

141. *Syed Imran Ahmad Shah: (Deferred on 25-4-2019)

Will the Minister for Energy be pleased to state:    

(a) the expected increase in the prices of POL products incoming months, particularly with reference to getting loansfrom international lending institutions; and

    (b) the strategy of the Government to keep the prices of POL

products at affordable level for common man?

Minister for Petroleum Division: (a) The expected increase/decrease cannot be projected as the country’s oil prices are linked with theinternational prices of petroleum products published in Platts Oil Gram forArab Gulf Market.

(b) The Government takes necessary steps from time to time tokeep the prices of POL products at an affordable level through adjustingany increase in international oil prices by a corelated reduction in the rate oftaxes.

142. *Sheikh Rashid Shafique: (Deferred on 25-4-2019)

Will the Minister for Energy be pleased to state:

(a) whether the Sui Gas Department, Rawalpindi had startedlaying Gas pipelines from Mohallah Waris Khan to IJPrincipal  Road and from Railways Hospital, Rawalpindito Chak Sadar Bridge;

(b) if so, the time by which the said work will be completedkeeping in view the shortage of Sui Gas in the city?

Minister for Petroleum Division: (a) Yes.

(b) The work of laying of the above pipeline shall be completed bythe end of January 2019 unless there are operational impediments due tounforeseen circumstances.

60. *Prince Muhammad Nawaz Alai: (Deferred on 25-4-2019)

Will the Minister for Energy be pleased to state:    

(a) the time by which work of conversion of Thakot GridStation from 33 KV to 132 KV would be completed; and

    (b) whether electricity connection from Alai Power House is

included in the Thakot Grid Station Program; if so, thetime by which it will be implemented; if not, the reasonsthereof?

Minister for Power Division (Mr. Omar Ayub Khan): (a) Theconversion of Thakot Grid Station from 33 KV to 132 KV is in progressand scheduled to be completed by June, 2020.

(b) Electricity connection for Thakot Grid Station is proposed fromAlai Khwar Power House via 132 KV Besham grid station. Howeverconstruction of this transmission line could not materialize due to Right ofWay issue. The line is expected to be completed by June 2020 subject toclearance of the Right of Way issue.

64. *Malik Sohail Khan: (Deferred on 25-4-2019)

Will the Minister for Energy be pleased to state the time by whichthe facility of Gas will be provided to village Pind Sultani andsurrounding areas of Tehsil Jand, District Attock?

Minister for Petroleum Division: SNGPL has reported thatdetailed cost estimates for supply of gas to Pind Sultani and surroundingareas namely Rangli, Langer, Bhandar Karam Sher & Dhoke Loharan)

were forwarded to the Federal Government on 27-03-2018 (based onunit construction cost for fiscal year 2017-18) against which no approval/funds have been received from the concerned authorities.

65. *Mr. Ali Gohar Khan: (Deferred on 25-4-2019)

Will the Minister for Energy be pleased to state the line losses ofFESCO and the number of lines and load in Tehsil Tandlianwalaand Jaranwala and the number of more transformers requiredtherein alongwith the time by which this task will be completed?

Minister for Power Division (Mr. Omar Ayub Khan): The %ageloss of FESCO at present (Upto 02/2019) along with pervious comparisonis tabulated below:—

There is no negligence / ineffectiveness on part of FESCO, as FESCOhas already achieved the target.

66. *Dr. Mahreen Razzaq Bhutto: (Deferred on 25-4-2019)

Will the Minister for Energy be pleased to state:

(a) the steps being taken for physical safety of Linemen invarious DISCOS; and

    (b) the number of Linemen in HESCO-SEPCO who were killed

due to electrocution while performing duties during lastone year?

Minister for Power Division (Mr. Omar Ayub Khan): (a) SafetyControl Rooms have been established in all DISCOs which are workinground the clock headed by Chief Engineer to control the Fatal andNon-Fatal Accidents of the Line Staff (Annex-I). The following steps arebeing taken for safety of Linemen in all DISCOs in accordance with safetySOPS issued by PEPCO to all DISCOs:

Availability of standardized Personal Protective Equipment /Tool and Plant (PPE/T&P) to line staff.

Training for properly usage of T&P/PPE items during work.

Display of Safety Codes in field offices for motivation ofemployees and public.

Surprise visits at site of work by various officers/ officials.

Strict Disciplinary action against delinquent found involve inviolation of safety code.

Monthly PPE/T&P Parade of line staff in each sub-division.

Periodical Safety Seminars at Circle & Divisions Level.

Ensure to work on 11KV Lines with proper Permit to Work(PTW).

Restricting line staff for working during load shedding periodwithout PTW.

(b) Five Linemen in HESCO and Four Linemen in SEPCO v;eiedied due to electrocution while performing their duties during last one year.

71. *Mr. Abdul Qadir Patel: (Deferred on 25-4-2019)

Will the Minister for Energy be pleased to state:    

(a) the details of importing cargo (R)LNG orders in the countrysince January, 2018 till date;

    (b) whether it is a fact that such orders were later reduced to

half; if so, the justification thereof;    

(c) the details and name of authority which made such decisionto reduce the number of cargoes of (R)LNG;

    (d) whether it is also a fact that such reduction/cancellation/

rescheduling had forced the Government to pay millions ofdollars under the heads of rescheduling of idle terminalcharges etc. if so, the details thereof;

    (e) if the answer to parts (a), (b), (c) and (d) above are in the

affirmative, is there any plan to investigate reduce/cancel/reschedule such orders and make the responsiblesaccountable for the same; if so, action taken; if not, thereasons thereof?

Minister for Petroleum Division: (a)PSO and PLL have beenimporting LNG for the country to supply RLNG to SNGPL. Since January2018, a total of 88 LNG cargoes have been imported by PSO, whereasPLL has imported 43 LNG cargoes.

(b) The orders were not reduced to half. There have however beeninstances where LNG imports were arranged, and the cargo schedule wasrequired to be altered in order to cater for the changes in RLNG requirement.

(c) PSO and PLL are importing LNG to cater for SNGPL’sRLNG requirement. The rescheduling of cargoes (by PLL) wasnecessitated in accordance with the changes in RLNG requirement,conveyed by SNGPL. Accordingly, all such instances of reschedulinghave been implemented by PLL as per the directions of its BOD.

(d) No, it is however a matter of fact that such rescheduling hasresulted in avoidance of incidence of take-or-pay, in view of country’sinability to off-take the planned RLNG volumes. Regarding the paymentof idle capacity charges, it is clarified that terminal charges comprise oftwo major components; (i) fixed (capacity charges) and (ii) variable(utilization and flexibility charges). The capacity charges for anyinfrastructural project are linked directly with the cost of setting-up theinfrastructure and are payable regardless of its utilization. During the year2018, Terminal remained idle approximately 50% due to lowerdownstream demand.

(e) As clarified in the above paras the rescheduling was a resultof low downstream demand specially from Power Sector. However, atthe moment there is no plan or any investigation going on in the matter.

73. *Syed Hussain Tariq: (Deferred on 25-4-2019)

Will the Minister for Energy be pleased to state:    

(a) whether it is a fact that Sui Northern Gas Pipeline Limitedand Sui Southern Gas Company Limited had posted/ earnedprofit in recent years; if so, the details of last five years;

    (b) if both the entities had posted profit in recent years, the

justification of deficit of 157 billion or so, as it is claimedby the Government alongwith components of such deficitin clear terms; and

    (c) whether the amount of aforesaid deficit has been spent or

invested on some projects; if so,  the details thereof; and

(d) whether the Gas entities or Government earned profitor are expected to earn profit on such spending orinvestment in coming years; if so, the details thereof;?

Minister for Petroleum Division: (a) The profit/ loss of SNGPLand SSGC during last five years is given at Annex-I.

(b) SNGPL and SSGC earn profit on their average operating fixedassets @17.43% as per the license condition of OGRA. Their profit doesnot have a direct link with the sale of natural gas. However, the deficit, whichis Rs. 158 billion (provisional) is due to the difference between sale price andthe prescribed price. The prescribed price is determined by OGRA aftertaking into account all relevant components (details attached as Annex-II)whereas sale price is notified by OGRA after due approval of the FederalGovernment. At present, both utility companies have higher average prescribedprices and lower average selling prices.

(c) The deficit is recoverable by the Govt. of Pakistan through anincrease in the selling price of gas

(d) As explained in para (c) above.

74. *Ms. Zille Huma: (Deferred on 25-4-2019)

Will the Minister for Energy be pleased to state:    

(a) the names of the companies from whom all the DISCOs ofWAPDA procure the transformers and cables alongwiththe details thereof;

(b) the names of companies whose transformers and cablesare sub-standard and whether all the electric appliances ofpoor consumers are often burnt due to cable fluctuation; ifso, the steps being taken to control this alongwith completedetails; and

(c) the details of modern technology being adopted to controlto said line losses?

Minister for Power Division (Mr. Omar Ayub Khan): (a) Thenames and details of Companies from whom all the DISCOs procuretransformers is placed at Annex-A. Similarly, the names and details ofcompanies from whom all the DISCOs procure cables is placed atAnnex-B.

(b) All of the DISCOs follow a stringent procurement process inorder to ensure quality of material. As first step, all of the manufacturers arepre-qualified and initially educational orders for small quantities of goods areplaced, in order to access performance/ manufacturing and financialcapabilities. Subsequently, regular orders are placed after successfulcompletion of educational orders.

Further, the supplier has to develop prototype samples which aresubjected to all applicable type/ design tests at independent labs. Stageinspection is carried out during the course of mass production. Final productsare subjected lb all applicable tests as per standard specifications. This activityis performed by third party i.e. C.E. (Quality Assurance & Inspection)NTDC. The equipment is accepted only after successful clearance of alltests & issuance of inspection certificate by C.E. (QA&I) NTDC.

Secondly, all the material procured is covered under warranty clauseof purchase order.

No complaint has been received from consumers regarding poorperformance, unstable supply provision from newly installed transformersand cables.

(c) Following modern technologies are being adopted to controllines losses:

i. Advanced Metering Infrastructure (AMI).

ii. Aerial Bundled Cables (ABC).

iii. Energy Audit at distribution transformer level.

iv. Printing of meter reading pictures on monthly electricity bills.

76. *Mr. Abdul Majeed Khan: (Deferred on 25-4-2019)

Will the Minister for Energy be pleased to state:    

(a) the National Assembly Constituency-wise total number ofGas schemes approved for the province of Punjab duringthe last five years;

    

(b) the National Assembly Constituency-wise total number ofGas schemes that will be approved for the said province inthe near future; and

    

(c) the National Assembly constituency-wise details of fundsreleased for the said schemes so far?

Minister for Petroleum Division: (a) SNGPL. has reported that687 projects have been approved for the province of Punjab during the lastfive years.

So far no project has been approved during the current Fiscal Year.Govt. of Pakistan has recently launched SAP program under which schemewould be approved on identification by the concerned DC / DCO office.

77. *Mr. Saleh Muhammad: (Deferred on 25-4-2019)

Will the Minister for Energy be pleased to state the steps beingtaken by the Government to establish the Hazara Electric SupplyCompany?

Minister for Power Division (Mr. Omar Ayub Khan): (a) Thethen Secretary to PM conveyed to Power Division, vide DO letterNo. 3948/M/SPM/2017 dated 13-10-2017, the desire of the Prime Ministerfor bifurcation of PESCO and creation of Hazara Electric Supply Companyon the basic large number of consumers and service area.

PESCO BoD considered the matter in its board meeting held on18-12-2017 and constituted a technical committee to study the feasibility ofPESCO’s bifurcation. The committee’s report was discussed in 122nd boardmeeting of PESCO dated 25-01-2018 However, the board did not agreewith the committee’s report and after detailed deliberation formulated anotherhigh level committee under the convenership of Chairman BoD PESCO forassessing technical and financial viability of the matter.

Meanwhile, the Chairman BoD PESCO, Mr. Arsala Khan Hoti(Convener of the committee) resigned from the board on 13-6-2018.Similarly, secretary Energy Government of KPK being member of thecommittee has been transferred frequently due to which the committee hasyet not finalized its report.

In view of the geographical spread, customer base and otheroperational complexities, following is proposed for bifurcation of PESCO:

Peshawar, Khyber, Mardan,Bannu (circles)Hazara-I, Hazara-II, Swabi, Swat (circles)

In this regard, the consolidated working paper is being prepared.

Moreover, it is pertinent to mention here that creation/ establishmentof a distribution company through bifurcation entails certain steps includingthe following:—

Assessment of Technical / Financial & Commercial / Operationalviability.

Endorsement of proposal from Board of Directors ofDistribution Company.

Recommendation from PEPCO Board.

Approval from Power Division.

Business transfer agreement / bifurcation of assets & liabilities.

Registration of the Company with SECP.

New Distribution License from NEPRA / license modification.

Approval of Tariff from NEPRA.

78. *Mr. Shahid Ahmad: (Deferred on 25-4-2019)

Will the Minister for Energy be pleased to state:    

(a) the step taken for solution of low electricity voltage problemin District Karak; and

    (b) the time by which132 KV Grid Station will be constructed

in Tehsil Banda Daud Shah to improve low voltage?

Minister for Power Division (Mr. Omar Ayub Khan): (a) Thelow voltage problem in District Karak will be resolved upon completion of132kV under construction grid station Sabirabad. The Grid Station isexpected to be commissioned by July, 2019.

(b) At present, there is no proposal under consideration forconstruction of 132-kV Grid Station in Tehsil Banda Daud Shah, DistrictKarak.

a. Killi Morgand: In this Killi 06 x HT, 08 x LT Poles alongwith allied material (Conductor, Insulators etc) installedtransformer not installed and Killi not electrified yet.

b. Killi Jattak: In this Killi 01x HT, 10 x LT poles along withallied material installed but transformer not installed andKilli not electrified yet.

c. Killi Phalawan Zai: In this Killi 04 x HT, 11 x LT Polesalong with allied material installed but transformer notinstalled and Killi not electrified yet.

(3) Area Kishaan actually named as Killi Kishaan. In this Killi 19 xLT poles were installed with allied material, 01 HT Pole althoughinstalled but without allied material, however, transformer notinstalled and killi not electrified yet.

Above work was initiated/ identified during the year 2013-14,butcould not be completed due to unavailability of funds.

(b) No transformer is installed in said area. Moreover, the worksin the above mentioned areas/ killis could be executed once funds are madeavailable either in MNA’s fund or PSDP head for which estimates will beprepared & furnished accordingly.

(a) the price of per unit, electricity which is charged toconsumers at present;

    (b) the criteria, which is adopted to calculate electricity bills

for consumers at present;

(c) whether it is a fact that  Government has, recently changedthe methodology of calculation of electricity bills forconsumers; if so, the details thereof;

    (d) whether it is also a fact that  due to change of methodology

of calculation of electricity bills, consumers who consumeless unit, have to pay more amount of bills, as compare topayable amount of such bills as compare to payable amountof such bills previously; if so, the justification thereof; and

    (e) what steps being taken by the Government to give

maximum relief to those who use less units of electricity?

Minister for Power Division (Mr. Omar Ayub Khan): (a) Theprice of per unit electricity being charged from the consumers, notified by theFederal Government w.e.f. January 01, 2019, is attached as Annex-I.

(b) NEPRA determines tariff of each XWDISCO individually.Before the amendment of NEPRA Act, the Federal Government keeping in

view its socio economic objectives used to notify a uniform consumer endtariff by incorporating therein subsidy and surcharges for different consumercategories. However, as per the amended NEPRA Act, NEPRA has beenmandated to determine a uniform consumer end tariff. Accordingly, the FederalGovernment filed its request before NEPRA for determination of a uniformconsumer end tariff. The Authority on the request filed by the FederalGovernment issued its decision of Uniform Consumer end tariff on December19, 2018. The same was notified by the Federal Government w.e.f.January 01, 2019 along-with its terms & conditions and the consumers arebilled as per the notified tariff based on their monthly electricity consumption.Here it is pertinent to mention that domestic consumers having load less than5 kW are allowed one previous slab benefit and this practice is in place sinceOctober 2013 e.g. a consumer who consumes 225 units will be billed@ Rs.8.11 for 200 units and Rs. 10.20 for the remaining 25 units. Domesticconsumers with ToU meters having load of 5kW & above are billed as perthe peak & off-peak rates and does not involve any slab benefit.

(c) There is no recent change in the methodology of calculation ofelectricity bills for consumers recently.

(d) As stated above, there has been no change in the methodologyof calculation of electricity bills for consumers recently.

(e) The Federal Government provides subsidy to the consumerswho consume less units of electricity i.e. life line consumers, domesticconsumers having consumption upto 300 units and agriculture consumers.

Minister for Science and Technology (Mr. Fawad Ahmed): (a)Pakistan Council of Research in Water Resources (PCRWR) workingunder aegis of Ministry of Science & Technology (MoST) has established24 Water Quality Testing Laboratories including a National Water QualityLaboratory (NWQL) at its Headquarters, Islamabad and six Regional WaterQuality Laboratories at its Regional offices i.e. Lahore, Bahawalpur,Tandojam, Karachi, Peshawar and Quetta under its various R&D projects(Annexure-I).

(b) PCRWR, Islamabad (Headquarters) has been directlymonitoring the physical performance of regional and sub-regional water qualitylaboratories through monthly and quarterly progress reports. Whereas thequality assurance of water testing has been checked by the National WaterQuality Laboratory (NWQL) at Islamabad through sending audit blind samplesto these laboratories on monthly basis. The test results of these samples havebeen assessed to evaluate performance of each laboratory. The performanceof NWQL, Islamabad is being monitored regularly through monthly auditblind samples and proficiency testing participation.

Moreover, to overcome the problem of shortage of technical staff inthe above mentioned Water Quality Testing Laboratories, Ministry of Scienceand Technology will recruit technical staff as and when the recruitment rulesof PCRWR will be finalized by the Establishment Division and Law andJustice Division.

Minister for Postal Services (Mr. Murad Saeed): (a) a. PakistanPost is an attached department of Ministry of Postal services and working

under Post Office Act 1898.There is no proposal under consideration to runthe Postal Services on Public Private Partnership basis. However, in orderto take Postal Services at par with international standards and due to financialconstraints to invest in technology and other essential resources, the PrimeMinister of Pakistan during a meeting held on 29-12-2015 at GovernorHouse, Murree allowed Pakistan Post to launch initiatives on Public PrivatePartnership (PPP) basis with aim to improve the performance and revenuesof Pakistan Post Office Department.

b. Pakistan Post Logistics Services Initiative for Pakistan PostLogistic Services has been started on the basis of Public Private Partnership(PPP) model in consultation with Public Private Partnership Authorityestablished under Public Private Partnership act, 2017.The initiative waswidely published in electronic and print media. The detail of bidding processis as follows:

(i) After completion of successful bidding process the followingthree companies/firms have submitted the requisite technical86 financial proposals in response to the Requests for Proposals(RFP) for Pakistan Post Logistics initiative.

Firstly, they prepared their financial model on 60years in violation of the Request for Proposal (RFP) whichfixed it at 20 years. Secondly, they calculated PakistanPost share from Earnings Before Interest and Taxes (EBIT)as opposed to Revenue. The RFP had made it binding onthe bidders to calculate Pakistan Post share from Revenueand not from EBIT or Profit.”

(vi) Pakistan Post will now initiate case for further deliberations /course of action with PPP Authority.

(b) 1. EXPRESS SERVICES

In order to effectively compete private couriers, following measureshave been taken:—

Pakistan Post floats tender for selection air lines and presentlyPakistan post utilizes the services of PIA, Etihad airline andSaudi airline. As these air lines participated in tendering process.

We have approached Turkish air line, Emirates and Lufthansato start business with them to improve network coverage andbetter quality of service.

(a) ESTABLISHMENT OF “SMALL & SMART”EXPRESS CENTERS

31 “Small and Smart” Express Centers have been set up in theurban areas.

(b) EXPANSION OF EXPRESS POST TRACK & TRACESYSTEM (EMTTS)

Express Mail Track & Trace System (EMTTS) which isavailable at 83 General Post Offices (GPOs) and 50 DistrictMail Offices (DMOS).

Online complaint submission by Customers.

Provision of SMS intimation to sender and recipient regardingdelivery and booking of EP articles.

For prompt disposal of postal customers’ complaints and tore-dress the grievances, Pakistan Post has Established CallCenter for Customer on modern lines.

(c) INTRODUCTION OF UMS-CASH ON DELIVERYSERVICE (COD)

Urgent Mail Service-Cash on Delivery Service has beenintroduced with effect from 1st January, 2016. Packets, parcels

and printed papers prepaid with postage of UMS fee may betransmitted by the inland post as COD articles, provided thatthe amount specified for remittance to the sender in the case ofany such articles does not exceed Rs.100,000/ -

(d) ENHANCING MAXIMUM LIMIT OF FAX MONEYORDER LIMIT

For the convenience of the public and to cater the varied needsof the customers, the maximum limit of a single Fax MoneyOrder has been enhanced from Rs. 10,000/- 50,000/-. Thisstep also resulted in expansion and in scope of service.

(e) ENHANCING MAXIMUM LIMIT OF URGENTMONEY ORDERS (UMO)

To cater the varied needs of the customers and to enhance thescope of the service, maximum limit of a single Urgent MoneyOrder has been enhanced from Rs. 10,000/- to Rs. 20,000/-and for UMS-COD a single Urgent Money Order has beenenhanced from Rs. 20,000/- to Rs. 100,000/

MAXIMUM WEIGHT LIMITS:

Prior to consolidation of Express Post Service the weight limit ofUMS articles upto 1 KG. Now the weight limit of UMS articles enhancedupto 30kg the safe, affordable and accurate to transfer money within Pakistan.Currently this service is available at 90 locations (GPO/Post Offices).

Pakistan Post has taken an important initiative by introducingsame day Delivery Service to cater for the varied needs of thecustomers, especially trade and commerce, Pakistan Post isoffering a full range of Express Services which carry all thosefeatures which are offered by the private sector operatorsincluding competitive rates. “Same Day Delivery Service”(SDDS) was running as pilot Islamabad, Rawalpindi, Lahore,Multan, Peshawar, Karachi, Hyderabad, Sukkur and now ithas been formally launched in 19 new cities across Pakistanmaking the total number 26. Same Day Delivery is for specifiedlocations in a city or in nearby towns with Maximum weight of20 kilograms and delivery of a consignment at the door stepthe same day.

(g) ELECTRONIC MONEY ORDER (EMO) DOORSTEP

Pakistan Post has started a new service, “Electronic MoneyOrder Doorstep” for making payment at the doorstep of thepayee. The “Electronic Money Order” service is one of themost promising services which are provided by an instantelectronic transfer of Money. Provision of such services isbecoming more and more important, as we know the conceptof electronic Money Transfer is gaining popularity with eachpassing day. Initially the Electronic Money Order (EMO)was offered for the counter payment at the General PostOffices (GPOs) throughout the country which was known asPost - to - Post.

A new service EMO Doorstep has been launched. It will bepaid at doorstep of the payee upto value of Rs. 50,000/- for asingle Electronic Money order. It is especially useful forworkers and employees working away from their families andprovides ease to families by payment at their doorstep. Thisservice is available in 83 GPOs across Pakistan. MS notificationis sent to both Remitter and Payee.

2. INTERNATIONAL POSTAL SERVICES

Mentioned below are categories of international mail exchangedbetween UPU member-countries under the procedures contained in theUniversal Postal Convention and its Regulations (Letter Post Regulationsand Parcel Post Regulations):

(a) Foreign letter-mail service

The term “Letter-mail” includes Letters, Aerogramme,Postcards, Printed Papers, Registered News Papers, SmallPackets and Cecogrammes (Literature for the Blind) and is

subject to maximum weight of 2 kg for Letters, 10kg for PrintedPapers and Registered Newspapers and 5 kg for small Packetsintended for delivery abroad.

(b) Foreign Parcel Service

The term “Parcel Post” includes Air Parcels and Surface­air-Lifted Parcel and Surface Parcels. Minimum weight for foreignparcels is 1 kg. Maximum weight varies from country to countryas per operational information of the country concerned asappearing in the website of the Universal Postal Union.

(c) International Express Mail Service

Pakistan Post is operating Express Mail Service (EMS) on thebasis of bilateral agreement which have been concluded with104 countries. Country-specific Tariff has been prescribed forEMS items.

Pakistan Post maintains mail links with all countries of the worldexcept Israel. Air Letter-mail and parcel service is available forall destinations around the globe while surface-air­lifted parcelservice is available for twenty-eight specified countries. Pakistanmaintains surface mail links with Afghanistan, China, India andIran only. Direct airmail service is available for 165 destinations.For remaining countries to which no direct outlet is available,transit services of other countries are used.

(d) NEW PRODUCT FOR CORPORATE CLIENTS EMS-PLUS

Introduction of a new service limited to only those cities whichare export oriented and are preferably air connected. PakistanPost will ensure delivery of these packets and parcels in selectedcountries within 72 hours. As a pilot project Pakistan poststarted delivery of articles to six countries UAE, Saudi Arabia,Australia, Thailand, Japan and United Kingdom. Private couriersand logistic services providers in Pakistan are providing end to

end logistic solutions to the modern-day bulk customers. Thecrucial component of end to end supply chain is collection ofmail/merchandise in consolidated or unconsolidated form. Itreduces the cost, time and working hours of the customers. Itmakes the mail solution with option of collection from doorstepspreferred choice of customers. However, collection of mail fromdoorsteps requires resources, planning, standard operatingprocedures, monitoring, and close liaison with clients,appropriate tariff structure and medium- or long-term agreementwith customers. Any product, specifically for corporate sector,requires well calibrated and guaranteed time line.

(e) ESTABLISHMENT OF OFFICES OF EXCHANGE ATAIRPORTS

Pakistan Post is a national department which is providing basicpostal services across the nation. Pakistan is a member countryof Universal Postal Union (UPU), a United Nations organ forpostal services, and is part of global postal community. TheUPU maintains the postal supply chain in collaboration withInternational Civil aviation Organ,zation (ICAO), InternationalAirlines and Transportation Agency (IATA), and WorldCustoms Organization (WCO). Through Chicago Conventionannexure J chapter-2 (which deals with screening of mail) mailis essential component of air cargo supply chain. Incollaboration with UPU, ICAO has created a set of Standardsfor determining the security controls, including screening to beapplied to all cargo and mail prior to loading on to an aircraftengaged in commercial operations.

In recent years, security protocols and standards have beenintegrated into postal supply chain to mitigate the risk factors.The relevant standards applied on international mail operationsof Pakistan Post are given below;

Pakistan Post maintains international mail offices (offices ofexchange OE), as critical facilities for the exchange of mail withrest of the world. Compliance to the regulatory frameworks asmentioned above is mandatory for the offices of exchange.Following validations/certifications are instrumental for OEs forsmooth flow of postal mail;

1. Regulated Agent Regime (RA3 Certification)

2. S58 & S59 standards

Presently, compliance with regulatory regimes is not possibledue to inappropriate locations of the Offices of Exchange.Additionally, non compliance is adversely affecting postaloperations and revenue of Pakistan Post.

In this context, shifting of Office of Exchange at airport is onlyviable option. Civil Aviation authority is requested to providespace (preferably constructed) at following airports on rent/lease basis for shifting of the office.

3. Jinnah International Airport Karachi

Civil Aviation Authority has offered pieces of land at NewInternational Airport Islamabad and Allama Iqbal internationalAirport Lahore while our request for allocation of land at JinnahInternational Airport Karachi is under consideration. If suitablefunds are allocated and IMOs established at these airportsfulfilling regulatory framework, it will definitely enhance thequality of service.

Minister for Petroleum Division: The petroleum rates areincreased at the end of each month and are notified w.e.f. the 1st day of thenext month. This process is repeated each month of the calendar year.

During the last seven months, prices of petroleum products wereincreased/(decreased) as detailed below:

The aforementioned table reflects that most of the time, prices werereduced.

205. *Mr. Murtaza Javed Abbasi:

(a) whether it is a fact that Government has, recently, changedthe criteria to calculate Gas bills for consumers; if so, thedetails thereof;

Minister for Petroleum Division: (a) It is clarified that there is nochange in the criteria to calculate gas bills of the consumers. However, in lasttariff notification issued by OGRA dated 04-10-2018, the number of slabshave been increased from three to seven, wherein gas tariff for DomesticConsumers has also been increased w.e.f. 27.09.2018. The comparativeposition is tabulated below:-

(b) Gas bills are issued to consumers on the basis of their actualmeter reading noted at the site by applying the OGRA notified tariff. Gasconsumption increase in the Domestic Sector in winter months mainly due touse of geysers and room heaters, as compared to the summer months, whengas is used only for cooking purposes. Moreover, increased gas consumptionduring winter months also attracts the application of a high slab rate mentionedin point (a) above.

(c) An exercise regarding the verification of pressure factor appliedin bills is in process by the Gas companies. In case any anomaly is observedat the site, it is rectified by applying an appropriate adjustment.

206. *Ms. Mehnaz Akber Aziz:

Will the Minister for Human Rights be pleased to state:

(a) the steps taken by the Ministry and National Commissionfor Child Welfare and Development (NCCWD) to addressthe concerns of the United Nations, recorded and conveyedthrough concluding observations of UN Committee onPakistan’s fifth periodical report on United NationsConvention on Rights of the Child adopted by the UNCommittee at its seventy second session from 17th May to3rd June, 2016, especially the concern with respect to nonadoption of pending bills by Pakistan in the area ofchildren’s rights, allocation of enough resources foreducation, health of children  and combating malnutritionamong children; and

(b) the steps being taken by the Government and NCCWD forthe year 2019 with respect to implementation and fulfillmentof Article 24 of the UNCRC Convention, whichprovides especially the access of all children to educationhealth and nutrition?

Minister for Human Rights (Dr. Shireen M. Mazari): (a) TheNational Commission for Child Welfare and Development (NCCWD) isworking as a subordinate office under the Ministry of Human Rights. After

the 18th Constitutional) Amendment, the subject of minors has beentransferred to the provincial Governments. In this regard, the ProvincialGovernments have been requested to provide the requisite information butthe response is still awaited. However, the jurisdiction of NCCWD has beenlimited to the extent of ICT in wake of 18th Constitutional Amendment.

The Ministry of Human Rights, being the focal Ministry to coordinateimplementation of the, UNCRC, has taken/being taken various measuresparticularly enactment of pending bills on child rights/protection.

Pakistan ratified United Nations Convention on the Rights ofthe Child (UNCRC) in 1990. Pakistan’s 5th Periodic Reporton UNCRC was considered by the UN Committee during2016. The Concluding Observations of the UN Committee onUNCRC are being implemented. In this regard, acomprehensive template was developed and meetings withProvincial relevant stakeholders were also convened by theSecretary, MoHR at Provincial Headquarters for itsimplementation.

The following bills has been enacted in light of the Concerns of theUN Committee on UNCRC:

The ICT Child Protection Act, 2018 has been enacted toprovide for establishment of mechanism for rescue, care, andprotection of children at risk and establishment of a welfareFund for the children and for registration of the unattendedchildren. Under this Act, a Child Protection Institute is beingestablished shortly.

The Juvenile Justice System Act, 2018 has been enacted.It focuses on disposal of cases through diversion and social-reintegration of the child offenders. Accordingly, the Governmentof Punjab & KP has notified Child Protection Courts. The rulesof JJSO are being framed and trainings of the relevantstakeholders will be conducted shortly.

In order to effectively coordinate, monitor and promote theRights of the Child, the National Commission on the Rights

of the Child Act, 2017 has been promulgated. Under this Act,a Commission is being established which will examine existinglaws relating to child and propose new legislations related tochild rights/abuse. The selection of chairperson and Membersof said commission is in process and will be finalized soon.

The Criminal Law (Second Amendment) Act, 2016 hasbeen enacted in March 2016 to criminalize cruelty to child,human trafficking and child sexual abuse.

The following bills are recently drafted and under consideration ofthe Parliament.

The Prohibition of Corporal Punishment Bill, 2019 hasbeen drafted to prohibit all sorts of corporal punishment in anysetting. Presently, the said bill has been approved by the CabinetCommittee on Disposal of Legislative Cases (CCLC) andFederal Cabinet. The Bill is being introduced in the parliament.

The Zainab Alert, Response and Recovery bill, 2019 hasbeen drafted for establishment of Zainab Alert Response andRecovery Agency (Agency) to raise alert for missing children.Presently, the said bill has been approved by Cabinet Committeeon Disposal of Legislative Cases (CCLC) and Federal Cabinet.The Bill is being introduced in the parliament.

The NCCWD in collaboration with UNICEF has launched theNational Child Labour Survey on 25th March, 2019. ThePresident of Pakistan graced the occasion.

Two Situational Analysis/Studies on “out of school children inselected union councils of rural areas of Islamabad” and “outof school/street children in Kachi Abadis of Islamabad”were conducted to identify out of school children and tomainstream. The recommendations of the studies have also been,shared with relevant stakeholders to implement.

A situational analysis on child abuse in Kasur is finalizedand recommendations of the study were shared with relevantstakeholders for implementation.

The Minister for Human Rights launched awarenesscampaign on child abuse by conducting visits of various schoolsat ICT level.

Inter provincial meetings were conducted by the Secretary,Ministry of Human Rights with the Chief Secretaries on theissues of child protection/ abuse.

(b) Since the subject of minors has been transferred to the ProvincialGovernment in the wake of the 18th Constitutional Amendment, the ProvincialGovernments has allocated funds under the Annual Development Programs(ADP) for the protection of the children in the health and education sectors.However, the Ministry of Human Rights coordinates with ProvincialGovernments for implementation of the UNCRC.

ii. Heavy inductive load of agri tube wells exists on the system.

iii. Illegal tube well connections, using substandard material, bythe agri consumers at their own, further worsens the conditionby over burdening the system.

Field formations of QESCO have been given directions to exert allout efforts to disconnect illegal tube wells as well as those connections notpaying their dues.

Nevertheless, voltages have been improved at both District Kalatand Tehsil Mangochar after energization of 132kV capacitor bank.

Minister for Communications (Mr. Murad Saeed): (a) Thisproject was commenced on 1st February, 2008 however, the project fallsbetween District Pakpattan and District Bahawalnagar.

(b) No. As per scope of work 08 Km approach road, 04 Km oneach side being part of this contract is completed and opened for traffic sinceJuly, 2016. However, District Road on Pakpattan side beyond the approachroad is in very poor condition and needs immediate up-gradation by theconcerned department as it is not included in the scope of project of NHA.

(c) Some pending allied works pertaining to Guide Banks and roadfurniture (not affecting traffic flow) are going to start after resolving somepayment issues with the Contractor and will be completed by December,2019 subject to availability of funds in time.

215. *Rana Sana Ullah Khan:

(a) whether it is a fact that Broad Sheet LLC, an internationalfirm with whom NAB had signed an agreement in 2000and concluded in 2008 against the payment of 1.5 milliondollars, filed  a lawsuit in International Court of Arbitration(ICA) against the NAB and denied to have received 1.5million dollars as claimed by NAB; if so, the name of personto whom such amount was paid;

(b) the details and reasons of not accepting such claim of NABby the firm;

Following steps have been carried out to ensure the s supply ofuninterrupted electricity to consumers across the country in upcoming summer:

All Power Plants have been instructed to build up the FuelStock Inventory, sufficient enough to operate the Power Plantson full load during the summer season.

All Power Plants have been instructed to carry out necessarymaintenance of the machines, in order to avoid any unforeseenoutages during the summer season.

Preventive maintenance of the Transmission Lines, Transformersand Busbars is being carried out.

In order to avoid the overloading the Transformers,augmentation work is being carried out at the important GridStations and is expected to be completed before the upcomingSummer Season.

Distribution side:

Due to hectic follow up of Ministry of Energy, Power Division,DISCOs are continuously upgrading / improving their networks for ensuringsmooth distribution of electricity for the upcoming summer season.

In this respect, updated status of DISCOs constraints identified duringlast year is given below:

At 132 kV level

119 Nos constraints out of 158 Nos have been removed now.

At 11kV level

312 Nos constraints out of 365 Nos have been removed uptill now.

(a) whether it is a fact that Iran offered 3000 MW electricityto Pakistan;

Minister for Power Division (Mr. Omar Ayub Khan): (a) Yes itis a fact that Iran has offered 3000 MW electricity. A MoU was signedbetween Iran and Pakistan on 31s1 May 2012 for supply of 1000 MW toPakistan. Later. during the meeting between Iran and Pakistan dated February23, 2015, it was agreed to increase the proposed capacity to 3000 MW.

(b) In this regard it is apprised that it was decided that 1000 MWmay be treated as Phase-I of the overall project for which necessary studieshave already been completed.

However, the project got stalled due to non- availability of bankingchannels between Pakistan and Iran due to UN/US sanctions on Iran.

There is an ongoing exercise to evaluate Pakistan’s own requirementsand future of this project will be decided on the basis of outcome of thesestudies.

218. *Ch. Muhammad Barjees Tahir:

Minister for Science and Technology (Mr. Fawad Ahmed): (a)Pakistan Standards & Quality Control Authority (PSQCA) has mandate tomonitor the quality of Carbonated Beverages under SRO’s 705(I)/2001dated 10-10-2001 and Bottled Drinking Water under SRO’s 638(I)/2001.The manufacturer and imported articles shall comply with the relevant PakistanStandard (PS) i.e. PS: 1654 & PS: 4639 respectively.

Pakistan Standards & Quality Control Authority (PSQCA) hascomplete mechanism under Section 14 of Act VI of 1996 and PakistanConformity Assessment Rule 2011 to check the quality of mandatoryBeverages and other Food items in the country as per International Guidelines,practices and National Standards

The quality of local and imported beverages and bottled drinkingwater in the country is regularly being checked and monitored by PSQCAthrough quarterly inspections of the manufacturing units and marketsurveillance from time to time..

The authority deputes an inspector to conduct an inspection withregard to conformity of an article with the Pakistan Standards and Compliancewith terms and conditions.

The inspector visits the manufacturing unit/dry port/ airport and collectssamples which are further assessed in labs for conformity.

Such inspections may cover quality control system, verification oflaboratory or testing of samples or any other related matter.

The inspector has to submit a detailed report of every inspectionmade by him incorporating impression of the seal and details of theidentifications of the sample.

(b) if so, the goals and objectives achieved so far in light ofthe above mentioned Declaration?

Minister for Human Rights (Dr. Shireen M. Mazari):(a)Universal Declaration of Human Rights (UDHR) was adopted by the UNGeneral Assembly at its 3rd Session on 10th December, 1948. Pakistan wasamongst 48 countries which voted for its adoption. While not a treaty itself,the Declaration was explicitly adopted for the purpose of defining the meaningof the words “fundamental freedoms” and “Human Rights” appearing in theUnited Nations Charter, which is binding on all member states.

(b) The Declaration consists of 30 articles affirming, individual’srights, although not legally binding in themselves, have been elaborated insubsequent two core International Treaties( International Covenant on Civiland Political Rights and International Covenant on Economic Social andCultural Rights). The UDHR and these two conventions are jointly known asInternational Bill of Human Rights. The Principles of the Declaration arefurther elaborated in following core ‘human rights Conventions.

i. International Convention on the Elimination of all Forms ofRacial Discrimination.

ii. Convention on the Elimination of All Forms of Discriminationagainst Women.

iii. UN Convention on the Rights of the Child.

iv. Convention Against Torture and other Cruel, Inhuman orDegrading Treatment or Punishment.

v. UN Convention on the Rights of Persons with Disabilities.

All these conventions have been ratified by the Government ofPakistan and assigned to Ministry of Human Rights for compilation ofmandatory reports and its submission to the concerned treaty bodies throughMinistry of Foreign Affairs.

After 18th amendment in the Constitution, the implementation ofInternational Conventions at provincial level is the responsibility of therespective Provincial Governments. For this purpose, Treaty ImplementationCells have been established at Federal, Provincial level including GB & AJK.Requisite policy, administrative and legislative measures are being taken forprotection and promotion of human rights in line with constitutional guaranteesand international conventions pertaining, to human rights. It is pertinent tomention that implementation of convention is a continuous process involvingvarious measures by the Federal and Provincial Governments.

In this regard, Action Plan for Human Rights to improve human rightssituation in the country, prepared by Ministry of Human Rights is beingimplemented. Significant Progress/ achievements made, so far, is Annexed.

Minister for Power Division (Mr. Omar Ayub Khan): (a) Thefact is that two transformers exist on two HT structures on the corner of theplot (face of the plot is towards Asghar Mall Road while the structures areinstalled on the side street). These structures (I 1KV Banni Feeder) areinstalled at public property since more than twenty years and not on privateland. As per site situation, construction on the said plot is possible. Theapplicant was also contacted to provide the approved map of the plot / areafor actual measurement but he has not provided the same. Site sketch andpictures are attached at Annex-A.

(b) As per record, an estimate amounting to Rs. 4,37,032/- forshifting of structures/transformers was prepared on consumer request madeon 06-02-2019 and demand notice was issued to him vide No. 684 dated:06-03-2019 (Annex-B). Payment against the demand notice is still awaited.

The shifting work is subject to payment of above amount andclearance of right of way by the applicant.

(c) There is noproposal under consideration of IESCO to carryout the work departmentally.

(d) N/a

(e) As per Electricity Rules 1937 (clause 69 & 70), a demandnotice has been issued to the consumer since this shifting is to be done.according to applicant’s requirement and not in the interest of general public.The completion of shifting work is subject to receipt of above mentionedamount in IESCO’s account and provision of right of way by the applicant/Civic authority.

(c) The very purpose of establishment of Army Public Schoolssystem is to provide quality education to Army wards who have to movefrequently across Pakistan with their parents. In order to subsidize and facilitatethe wards of shuhada, war wounded persons, soldiers, Non-CommissionedOfficers/ Junior Commissioned Officers, teaching & non-teaching facultyetc, students are categorized as per policy. Minister for Petroleum Division: (a) Yes. SNGPL has reportedthat the transmission line from the gas sources of the Southern Districts ofKhyber Pakhtunkhwa, supplying gas to Peshawar and other parts of theprovince, passes through Dara Adam Khel area.

(b) SNGPL has reported that the Federal Cabinet in its meetingheld on 12-04-2018 approved the project. Cost to be borne by SNGPL isas under:

The work for laying of gas network in Dara Adam Khel and villagesenroute could not commence, as per the decision of the Hon’ able PeshawarHigh Court dated 17-01-2018, which stayed SNGPL from executing anyother scheme approved in Khyber Pakhtunkhwa before undertaking theproject for supply of gas to Tal & surrounding areas against which approvalof the concerned authorities is awaited.

The Company further reported that gas has not been provided toDarra Adam Khel due to the reason that the local elders protested against it,demanding that the whole of Darra Adam Khel be covered in the approvedjob, which was not possible due to lack of funding. The local leaders are notallowing the Company to start the approved pipeline construction as theyfear that the locals of the remaining villages, who feel that they are beingignored in this project, will start unauthorized / illegal off-takes from the alreadylaid supply main on their own. extending the menace of illegal pipeline networkin the tribal area of Darra Adam Khel. SNGPL can process the presentapproved jobs, if it is assured that the remaining villages will not obtain illegalgas connections by tampering with pipelines.

(a) whether Human Rights Commission of Pakistan has takennotice of hundreds of people languishing in jails even afterserving their sentences, as they are unable to pay fines;

Minister for Human Rights (Dr. Shireen M. Mazari): (a)National Commission for Human Rights and Ministry of Human Rights takenotice of the prisoners languishing in jails through visits of the jails in differentparts of the country. The Ministry of Human Rights provides financialassistance to the prisoners who are unable to pay Diyat, Arsh and Daman.For this purpose the Ministry of Human Rights has established “Diyat, Arshand Daman Fund”. The Federal Administrative Committee and ProvincialSub-Committee supervise the management of these funds.

(b) The subject of prisons relates to the Ministry of Interior andProvincial Home Departments. However, the Ministry of Human Rights hascoordinated with the Provincial Prisons Departments to collect the requisiteinformation. (c) As mentioned in part (b) of the question, the subject of prisonsrelates to Provincial Home/Prisons Departments. However, in exercise ofpowers conferred under sub-section (2) of section 338G of Pakistan PenalCode the Federal Government has established “Diyat, Arsh and Daman Fund”for the convicts, who on account of poverty and weak financial position areconfined in jails. The Ministry of Human Rights administers Diyat, Arsh and

Daman Fund to provide financial assistance to the prisoners who arelanguishing in jails on account of non­payment of Diyat, Arsh and Daman.

2. Under Rule-8 of the Diyat, Arsh and Daman Fund Rule, 2007,the grants are provided to those convicts who are incapacitated due to physicalor mental illness, women with children, orphans, juveniles prisoners andprisoners who have crossed the age of sixty years; and have undergone theirmajor portion of imprisonment but cannot pay the amount of Diyat, Arsh andDaman. In 6th Administrative Committee Meeting for Diyat, Arsh and Damanthe committee recommended to revise the age from 60 years to 40 years inorder to provide financial assistance to the convicts under Rule-8 of Diyat,Arsh and Daman Fund to expand coverage of funds to benefit maximumprisoners.

Main reason is due to delay in signing of loanagreements/ financial arrangements for the project.

(a) whether it is a fact that Karachi is economic hub of Pakistanand its production capacity is being decreased due to energycrisis; and

    (b) the time by which energy crisis will be controlled and

production would be increased?

Minister for Power Division (Mr. Omar Ayub Khan): (a) Yes, itis a fact that Karachi is the country’s industrial and economic hub.

Karachi and its adjoining areas are served by K-Electric (KE) since2005. As per agreement, KE was bound to enhance its production capacity.According to KE, it has invested over 2 billion USD across the value chain,out of which, more than 1 Billion USD is invested in power generation. KEclaims to have added 1,057 MW of generation capacity and improved fleetefficiency from 30.4% in 2009 to 37.4% in 2018. The addition replacedinefficient generation. Due to this reason KE is still fed by 650 MW fromNational Grid and KE has not invested enough to be self-sufficient in theirgeneration. In fact, they have asked the National Grid for additional powerfor KE.

However, no sizeable investment has been made in the transmissionand distribution networks. The result is extended breakdown of network.

Further, NEPRA has imposed penalties on KE owing to their failure to maintainsustained T & D network:

(b) As per KE, they plan to add around 3,000 MW to theirgeneration capacity in addition to power, purchase, in the next 5 years.

Ultimately KE expects to move from a current deficit of 400 MW toa surplus scenario by 2021.

12. Nawabzada Iftakhar Ahmed Khan Babar:(Deferred on 25-04-2019)

It is included in 7th STGProgram which is under process for approval by Development WorkingParty (DWP). However, purchase of land for construction of grid stationis under progress through Land Acquisition Collector.

(b) Said grid station will be functional within the next 02-years.

Minister for Petroleum Division: (a) SNGPL has reported thatGas network has already been laid and commissioned in most of the technicallyfeasible streets of Anwar Town and Shabbir Colony, Burewala District Vehari.

(b) In order to gasify the remaining feasible streets of above localitiesalong with other remaining parts of Burewala City, laying of 21 KM Gasdistribution network to the tune of available funds of Rs. 34.08 Million is inprogress.

(c) As stated above. However, the company reported thatprovision of gas to any further remaining streets of Burewala city will besubject to the provision of necessary funds and approvals.

Minister for Petroleum Division: (a) No. SNGPL has reportedthat these pipelines are in perfect condition and Company’s CorrosionProtection department has not reported any anomaly / defect.

(b) The Company has shifted the TBS from IJP road to Street 35,Sector I-9/4 opposite category V Blocks to augment gas pressurerequirement of the I-9/4. Currently there is no low pressure in block No. 07of category V of I-9/4. However, any individual complaints are beingaddressed as per procedure.

(c) No. The Company has reported that since there is no issue oflow pressure and pipeline integrity, hence no proposal is under considerationlo change / replace old pipe lines connected to said block at present.

Will the Minister for Energy be pleased to state whether it is afact that pressure of Gas in Islamabad and its surrounding areasis very low; if so, the steps being taken by the Government inthis regard?

Minister for Petroleum Division: SNGPL has reported that theCompany endeavours to maintain sufficient gas pressure for the domesticsector. However, demand and supply gap of indigenous gas increasesespecially during Winter season in the peak-hours. In order to bridge thisincreasing gap, various strategies are being adopted by the Company includinginjection of RLNG for high priority domestic sector, system improvementsetc.

During recent years, the rapid increase in population in the outskirtsof Islamabad / Rawalpindi is causing increase in domestic load particularly inwinter. A gap in demand and supply of natural gas has widened which led tolow pressure problems in these areas. In order to cater for the low pressureissue, following projects have been completed or in progress.

1. 16" dia line from G-10 to G-8 has been laid and commissioned.

2. 6" dia loop-line has been laid near Zero Point to resolve thelow pressure of Sectors G-6/G-7.

3. 4" dia Operational Phase has been laid and commissionedalong-with TBS. from Khanna Pul to Barma Pul.

4. 10" dia x 4.65 KMs line has been laid and SMS Nilorecommissioning under progress to resolve low pressure issuesof Lethrar Road, Chak Shahzad and Park Road.

5. In order to further enhance supply of gas to Bhara Kahu andsurrounding localities, up-gradation of SMS Bhara Kahu hasbeen approved, furthermore 2 Nos. TBS and laying of 2" dialine has also been laid and commissioned.

25. Pir Syed Fazal Ali Shah Jillani:(Deferred on 25-04-2019)

(a) whether it is a fact that cemented polls erected in 1990 invillage Gagi Wahan, Tehsil Sobbo Dero, District Sangharhave collapsed and almost 70% population is deprived ofelectricity;

    (c) the steps being taken to provide natural Gas to aforesaid

at earliest?

Minister for Petroleum Division: (a) SNGPL has reported thatthe gas meter has been installed against Account ID No. 67023182123and bill ID 870901080186, resident of Chak No. 82-JB Jagatpur,Pensera, Dijkot road Faisalabad.

(b) The Company reported that the Demand Notice againstAccount ID 9782173951 dated 03-11-2016 may not be processed soonas the above application does not fall on merit .The current merit forissuance of a Demand Notice in Faisalabad, is up to 30-06-2016.

The Company further reported that a Demand Notice againstAccount ID 2213388535 dated 09-04-2013 cannot be processed asthe gas network does not exist in front of the applicant’s house.

Issuance of a demand notice shall be considered after the layingof a gas network.

(c) Stated as above.

Minister for Petroleum Division: (a) SNGPL has reported that aproject for supply of gas to various localities of NA-98 (old) includingMohallah Gulshan-e-lmran colony was approved by the Federal Cabinet on03.01.2018 at an estimated cost of Rs. 38.253 million. Due to budgetaryconstraints and ban imposed by ECP on development schemes in wake

of the General Elections, the job numbers could not be processed inF.Y 2017- 18.

(b) The Company further reported that job numbers are being issuedduring the current Fiscal Year.

PC-I of the project Chakdara-Chitral section of N-45(130.22KM) amounting to Rs. 17,423 Million was approvedby ECNEC on 9th August, 2016. EXIM Bank Korea isfinancing the project. The project is divided into following threesections:

1. Chakdara - Timargarah Section (38.85 km)

2. Akhagram - Dir Section (43.39 km)

3. Kalkatak - Chitral Section (47.98 km)

PSDP allocation 2018-19: Rs. 542.149 Million.Completion Period: 4 Years after Commencement.

Current Status:

EXIM Bank Korea is financing the project.

The Loan Agreement for Kalkatak-Chitral Road section(N-45) (48 KM) has been signed between Government ofPakistan and The Exim Bank of Korea (Government Agencyfor the EDCF).

Currently procurement of Consultants for conducting detaileddesign for Section-I and Section-III is under process.

Chitral - Booni - Mastuj- Shindoor Road (153 Km)

PC-I of the project Improvement & Widening of Chitral-BooniMastuj-Shandoor Road (Length= 153 km) was approved by ECNEC on07-03-2018 at a rationalized cost of Rs. 16,755.50 million without FEC.

PSDP allocation 2018-19: Rs. 10 Million.

Completion Period: 24 Months after Commencement.

Current Status:Procurement of works in process.

Minister for Petroleum Division: (a) Yes. SNGPL has reportedthat it is a fact that General Manager (Gujranwala) had requested SGM(Distribution) North Head Office Lahore vide its memo dated 14-02-2016to resolve low pressure issues of localities of District Gujranwala NA-85.

(b) Yes. The Company further reported that SGM (Distribution)North Head Office vide its memo dated 21-02-2018 had requested GM(P&D) Head Office Lahore to arrange survey, feasibility and technicalevaluation of the proposed operational phase. P&D department carried outthe requisite survey etc. The said operational phase could not proceed dueto budgetary constraints and notification of Election Commission of Pakistan.

(c) As stated above, due to the non availability of budget andnotification of Election Commission of Pakistan, work could not commence.Now, the Company has planned to lay the above operational phase duringthe current fiscal year i.e. 2018-2019.

Minister for Power Division (Mr. Omar Ayub Khan): (a) Yes, itis fact that pursuant to the Judgment of Hon’ble Supreme Court of Pakistan

in the titled as Maula Bux Shaikh & others Vs Chief Minister Sindh & othersin CP No. 78-K of 2015 dated 03-10-2018 held that

“Government shall not allow or permit any person to performprofessional engineering works as defined in the PEC Act, whodoes not possess accredited engineering qualification from theaccredited engineering institution and his name is not registeredas a registered engineer or professional engineer under the PECAct.”

(b) PEPCO

As per Pakistan WAPDA Electrical Engineering Service Rule-1965(amended time to time), no non-Graduate Engineer can be f promoted asSr. Engineer/XEN. As per said service rules, following quotas have beenprescribed for the induction/promotion of Jr. Engineers:-

(i) 70% for direct induction of Graduate Engineers.

(ii) 5% for induction amongst those Upper Technical Subordinates(UTSs) who are Graduate Engineers on seniority cum fitnessbasis.

(iii) 12.5% for promotion from Diploma Holders Upper TechnicalSubordinates (UTSs) on seniority cum fitness basis.

(iv) 7.5% for Upper Technical Subordinates (UTSs) (Matriculate)on seniority cum fitness basis.

(v) 5% for promotion amongst Upper Technical Subordinates(UTSs) who process B.Tech (Hons) Electrical qualification.

In every organization, some quota is fixed for promotion formsubordinate cadre. The provision of quota for non-Graduate Upper TechnicalSubordinates has already been existing in the said service rules. and PakistanEngineering Council (PEC) has never objected to it as no non-Graduateperson can be promoted to the post of Sr. Engineer/XEN in BPS-18. InDISCOs, Matriculate UTSs have a lot of practical experience and they areusually promoted as SDO during last years of their service. At many occasions,they have been found better skilled than new entrants.

NTDC

NTDC is diligently following the provisions of Pakistan EngineeringCouncil Act 1976 (the “Act”) and also complying with the Order of AugustCourt. The NTDC specifically deputes professional engineers for the coreprofessional engineering works and no non-professional engineers have beendeputed for the core professional engineering works.

Minister for Power Division (Mr. Omar Ayub Khan): (a)Presently, it is not a fact that officials of PESCO receive money fromconsumers for repairing transformers, as all the damaged transformers arebeing repaired from PESCO’s pre-qualified private reclamation workshopsand Pakistan WAPDA Foundation Reclamation (PWF) Workshop,Nowshera.

However, earlier a practice was adopted in high loss areas / feedersof PESCO where Aggregate Technical and Commercial (AT&C) losses were

greater than 50%, the consumers were asked to pay for repair of the damagedtransformers.

Will the Minister for Human Rights be pleased to state theprogress and achievements of National Commission for ChildWelfare and Development all over the country particularly inThar Region?

Minister for Human Rights (Dr. Shireen M. Mazari): TheNational Commission for Child Welfare and Development (NCCWD) isworking as a subordinate office under the Ministry of Human Rights. Afterthe 18th Constitutional Amendment, the subject of minors has been transferredto the provincial governments. However, Government of Sindh has beenrequested to provide the report/updates on the measures taken/being takenin the Thar region for child wellbeing. The response from the Government ofSindh is still awaited.

The jurisdiction of NCCWD has been limited to the extent of ICT asconsequence of 18th Constitutional Amendment, therefore, the National

Commission on the Rights of the Child Act, 2017 has been promulgated.Under this Act, a Commission is being established which will monitor childrights violations across the country. The selection of chairperson and Membersof said commission is in process and will be finalized soon. However, the keyachievements/activities of NCCWD are as under:

Pakistan ratified United Nations Convention on the Rights ofthe Child (UNCRC) in 1990. NCCWD is the focal organizationto coordinate for implementation of UNCRC. Pakistan’s 5thPeriodic Report on UNCRC was considered by the UNCommittee during 2016. The Concluding Observations of theUN Committee on UNCRC are being implemented. In thisregard, a comprehensive template was developed and meetingswith Provincial Chief Secretaries were also convened by theSecretary, MoHR at Provincial Headquarters for itsimplementation.

The ICT Child Protection Act, 2018 has been enacted toprovide for establishment of mechanism for rescue, care, andprotection of children at risk and establishment of a welfareFund for the children and for registration of the unattendedchildren. Under this Act, a Child Protection Institute is beingestablished shortly.

The Juvenile Justice System Act, 2018 has been enacted.It focuses on disposal of cases through diversion and social-reintegration of the child offenders. Accordingly, the Governmentof Punjab & KP has notified Child Protection Courts. The rulesof JJSO are being framed and trainings of the relevantstakeholders will be conducted shortly.

The Criminal Law (Second Amendment) Act, 2016 hasbeen enacted in March 2016 to criminalize cruelty to child,human trafficking and child sexual abuse.

The Prohibition of Corporal Punishment Bill, 2019 hasbeen drafted to prohibit all sorts of corporal punishment in anysetting. Presently, the said bill has been approved by the CabinetCommittee on Disposal of Legislative Cases (CCLC) andFederal Cabinet.

The Zainab Alert, Response and Recovery bill, 2019 hasbeen drafted for establishment of Zainab Alert Response andRecovery Agency (Agency) to raise alert for missing children.Presently, the said bill has been approved by Cabinet Committeeon Disposal of Legislative Cases (CCLC) and Federal Cabinet.

The NCCWD in collaboration with UNICEF has launched theNational Child Labour Survey on 25th March, 2019. ThePresident of Pakistan graced the occasion.

The NCCWD is in process of drafting ICT Child ProtectionPolicy and Plan of Action. The draft policy will providecomprehensive roadmap to address the issues of childprotection/rights in a holistic manner.

An Interagency Protocol has been drafted by the NCCWD.The objective of the said protocol is to strengthen coordinationmechanisms among the organizations for better care servicesto the children.
