TOR was issued to Nerloc green field integrated paint manufacturing unit in thename of Kansai Neroloc paints Pvt., Ltd.The project proponent and theconsultant KadamEnv consultants have attended the meeting and requestedamendment of TOR for waiving of public hearing and the extension of TORvalidity up to 11st August 2024 (One additional year over the four years usuallysanctioned due to relevant OM from MoEF&CC due to Covid-19). Theproponent cited that the project is located in notified industrial area and proposedproject is a permitted activity in APSEZ, which secured EC following dueprocess of law after Sep, 14, 2006, the project is a candidate for exemption ofpublic consultation / public hearing.

The Committee after examining the proposal and detailed deliberationsrecommended to issue extension of EC validity for one more year and rejected theexemption of the public hearing. Decision Of SEIAA:- Agreed with the recommendation of the SEAC for issueof extension of TOR validity for one more year i.e up to 12.08.2023 and rejectthe exemption of the public hearing.

The proposed project falls under Item No. 1(a) of the schedule of the EIANotification 2006 and its amendments thereof - (i). Mining of minerals (<100 ha ofmining lease area in respect of non-coal mine lease).The representative of proponent and their consultant K.Santosh Kumar haveattended the meeting. But as per the MOEF&CC notification S.0.1141(E) date: 29/04/2015the validity of environmental clearance order its validity is 7 years i.e. up to16/07/2020.Recently MOEF&CC issued a another notification 5.0.221(E) date: 18/01/2021 says that "Notwithstanding 2021 anything contained in this notification, theperiod from the 1 April, 2020 to ne Environmental shall not be considered for thepurpose of calculation of the period of validity o[ prior Virus(covID-19) clearancegranted under the provisions of this notification in view of outbreak of Coronaand subsequent lockdowns( Total or Partial) declared for control, however, allactivities undertaken during this period in respect of the Environmental clearancegranted shall be treated as valid." As per the previous environmental clearance order under general condition pointNo. ii which says that: The row material iron ore shall be sourced from Kurnool &Ananthapur districts.The iron ore shall not be sourced from the Mines located ot Bellary,TumkurΧtradurga districts of Karnataka state as per the instructions issued by theMOE&F Gol. Processing of 526 applications of violation cases received from MoEF&CC, NewDelhi vide letter dt 1.3 .2021.

The SEIAA has addressed letter dt 28.9.2021 to SEAC requesting toexamine the processing of the proposals( 526 applications) received from MoEF&CC keeping in view of all the Notifications and OMs issued by MoEF&CC onviolation cases including the recent OM dated 07.07.2021 issued by MoEF&CCon SOP for identification & handling of violation cases under EIA Notification,2006 and recommend the procedure to be adopted for processing of FileNo.APPCB-11033/73/2021-TEC-EC-APPCB violation proposals received fromMoEF&CC, New Delhi.

The Ministry has issued a Notification No. S.O. 804 (E) dated 14th

March, 2017 under the Environment (Protection) Act, 1986 to appraise and


regularize the projects, already taken up or under implementation withouthaving obtained prior environmental clearance in terms of the provisions of theEIA Notification, 2006 and are therefore identified in violation of the same.The said Notification had given a six months window period i.e. 14.03.2017 to13.09.2017 for submission of such proposals. Further, Hon’ble High Court ofMadras vide order dated 14.03.2018 in the matter of W.M.P.Nos.3361 and3362 of 2018 and W.M.P.No.3721 of 2018 in W.P.No.11189 of 2017, hadprovided one month additional window period i.e. 14.03.2018 to 13.04.2018for submission of such proposals.

The committee has observed that these 526 proposals are filed inbetween the two window periods. In the light of MOEF notifications 14th

March 2017, Ministry's Notification dated 8th March, 2018 and OM Nos. Z-11013/22/2017-IA.II (M) dated 15th March, 2018, OM No. 22-10/2019-IA.IIIdated 9th September, 2019 the following is recommended.

As all these proposals are filed between the two window periods and the 9 th

September 2019 notification provided for lateral entry, EDS may be raisedfor each proposal seeking

1. To file Affidavit by the each proponent 2. Proof of credible action by the appropriate authority

After receiving the above affidavit and credible action reports, the applicationswill be taken up in SEAC for appraisal. Decision Of SEIAA:- EDS may be raised for 526 applications of violation casesreceived from MoEF&CC, New Delhi, to submit the affidavit and Proof of credible action by the appropriate authority.

NABET

The NABET vide letterDt 18.10.2021 requested members of SEIAA/SEAC todiscourage the Non–accredited consultants to present their cases beforeSEIAA/SEAC meetings and make project proponents aware about not to engageNon accredited consultant in order to improve the quality of EIA/EMP reports andconserve the Environment.

The committee observed that many sand and building stone/road metal mine owners have already engaged Non accredited consultants and filed proposalonline and also some have engaged them and in the process of filing. The suddenstoppage of the RQPs/Non accredited consultants may cause scarcity of sand &gravel further resulting in unemployment of construction labour. In view of theabove, the Committee recommended the following.

1. To allow the non-accredited consultants to file their cases online up to31.12.2021 only.

2. To allow the non-accredited consultants to present before SEAC/SEIAA


meetings for the proposals submitted by them on or before 31.12.2021.

3.From 1.1.2022 only NABET accredited consultants will be permitted to file andpresent their proposals before SEAC/SEIAA committee meetings.

4. This will be notified in Parivesh website. If the proposals are submitted by thenon-accredited consultants after the notification, such proposals will bedisqualified by raising EDS.

Decision of SEIAA : Deferred.
