P R E F A C E I, the Chairman of the Committee on Papers Laid on the Table, Rajya Sabha, having been authorised by the Committee to present the report on its behalf, do present this 121st Report to the Rajya Sabha. 2. The Committee took up for consideration the various papers, particularly the Government Notifications/Orders and Annual Reports and Audited Accounts of Government Companies/Organisations laid by the various Ministries/Departments on the Table of the House during the 214th Session of Rajya Sabha and examined the factors leading to delay in the laying of the papers. 3. The Committee considered and adopted the report in its meeting held on the 19th November, 2009.

REPORT

The Committee on Papers Laid on the Table (COPLOT), Rajya Sabha took up for

detailed consideration the Notifications/Orders and the Annual Reports and Audited Accounts of

Government Companies/Organisations laid by the different Ministries on the Table of the House

during the 214th Session of the Parliament. The lists of such Notifications/Orders and Annual

Reports and Audited Accounts of Government Companies/Organisations laid by the

Ministries/Departments and examined by the Committee are placed at Annexures I and II

respectively.

2. During the 214th Session of Rajya Sabha, a total of 395 Notifications/Orders and 687 Annual

Reports and Audited Accounts of Government Companies/Organizations were laid on the Table of

the House by various Ministries/Departments. Based on the Notifications/Orders and Annual

Reports and Audited Accounts of Government Companies/Organizations laid by the various

Ministries/ Departments, a Ministry-wise analysis of the delay in laying of these papers is as under: -

3. It is evident from Table No. 1 that a total of 395 Notifications/Orders were laid by the

different Ministries/Departments of the Government of India during the 214th Session of the

Rajya Sabha. Out of these 395 Notifications/Orders, 286 were laid within the stipulated time and

the remaining 109 were laid beyond the stipulated time. The belatedly laid 109

Notifications/Orders include 17 of Ministry of Finance, 1 of Ministry of Home Affairs, 79 of

Ministry of Shipping, Road Transport and Highways, 6 of Ministry of Corporate Affairs, 4 of

Ministry of Consumer Affairs, Food and Public Distribution and 2 of Ministry of Environment of

Forest.

4. As per the recommendations of the Committee on Subordinate Legislation, the

Notifications/Orders are required to be laid before the House (i) if the House is not in

Session, during the Session immediately following the date of publication of the Order in

the official Gazette and (ii) if the House is in Session, on the date of the publication of the

Order, during its continuance and in case the time lag between the date of publication and

the date of the closing of the Session is less than 15 clear days, before the expiry of the

Session immediately following the said Session. The Committee is of the view that all the

Ministries/ Departments are expected to follow the said time schedule. The Ministries of

Corporate Affairs, Finance, Health and Family Welfare, Consumer Affairs, Food and

Public Distribution, Environment and Forests and Shipping, Road Transport and

Highways are requested to strictly adhere to the prescribed time schedule.

5. The Committee impresses upon the Ministries that in case of delay in the laying of

Government Notifications/Orders, a comprehensive delay statement explaining the reasons

in detail for the delay in laying of the papers on the Table of the House from the date of

publication of the Notification/order in the Gazette to the actual date of laying on the Table

of the House, mentioning the time frame, if any allowed in the Statute should invariably be

laid.

6. The Committee also notes that out of the 687 Annual Reports and Audited Accounts of

the Government Companies/Organisations 525 were laid within time and remaining 162 were

laid on the Table of Rajya Sabha after a delay which ranges from 2 months 22 days to 5 years 11

months 15 days. The Committee takes a serious note of the recurring delay in the laying of

the Annual Reports and Audited Accounts by the concerned Ministries/Departments and

directs them to take necessary steps to ensure that the Annual Reports and Audited

Accounts of the Companies/Organisations functioning under their control are laid on the

Table of Rajya Sabha within nine months of the closure of the Annual Accounts.

7. The Committee took up for close scrutiny the reasons that led to the delayed laying

of the Annual Reports and Audited Accounts of some of these Companies/Organisations

under a few Ministries where delay involved was more than 1 year and the findings of the

Committee are indicated in the succeeding paragraphs.

8. Ministry of Agriculture

The Ministry of Agriculture laid 37 Annual Reports and Audited Accounts on the Table

of Rajya Sabha during the 214th Session, 27 of Department of Agriculture & Cooperation, 5 of

Department of Agricultural Research and Education and 5 of Department of Animal Husbandry,

Dairying and Fisheries. Out of 37 Annual Reports and Audited Accounts laid on the Table of the

House, 17 were laid beyond the stipulated time. The Delay ranges between 9 months 23 days to

4 years 11 months 11 days. The Committee took up the following organizations for detailed

consideration:-

8.1 Central Agricultural University, Imphal (Department of Agricultural Research and Education)

8.1.1 The chronological detail of the Annual Reports and Audited Accounts of the Central

Agricultural University, Imphal for the year 2002-03 onward laid on the Table of Rajya Sabha is

as follows:

8.1.2 The Annual Reports and Audited Accounts of the Central Agricultural University, Imphal

for the years 2002-03 to 2004-05 were laid on the Table of the House after a long delay ranging

from 4 years 11 months 11 days to 2 years 11 months and 11 days. The Ministry did not submit

delay statements alongwith the Annual Reports and Audited Accounts for the years 2002-03 and

2003-04. The delay statement laid alongwith the Annual Report and Audited Accounts for the

years 2004-05 of the Central Agricultural University, Imphal, Manipur has mentioned the

reasons of delay as under:-

1. Approval of the Board of management of the university for annual accounts at the instance of A.G. Manipur, Imphal.

8.1.3 The Committee is not satisfied with the reasons given for delay by the Ministry in

the delay statement laid along with the Annual Report of the Central Agricultural

University, Imphal for the year 2004-05. The Committee also noted that the Ministry has

not laid delay statements alongwith the Annual Reports for the years 2002-03 and 2003-04.

8.1.4 The Committee understands that the University has taken comparatively long time

in completion of various stages in preparation of Annual Report and therefore urges that

the University should take effective steps to improve the procedure of preparation of

Annual Report and the entire work should be completed within the stipulated time of 9

months from the close of the financial year.

8.1.5 The Committee reiterates its recommendation that in case of delay, statement giving

reasons for delay containing information, in chronological order setting forth the dates of

accounts, their submission to Audit, receipt of draft Audit Report, replies given to audit

queries, receipt of final Audit Report, translation and printing of Accounts and their

submission to the Ministry for laying on the Table of the House, should be laid along with

the Annual Report and Audited Accounts.

8.1.6 The Committee further recommends that a comprehensive review covering broad

performance of the organizations and a brief description of the critical areas should be laid

along with the Annual Reports and Audited Accounts as the Parliament being preoccupied

sometimes with important legislative business may not find sufficient time to go through

the Annual Report and Audited Accounts and therefore, a review on the working of the

organization may enable it to have cursory look on the functioning of the organization.

8.1.7 The Committee impresses upon the Ministry of Agriculture that in case of delay in

laying the Annual Reports and Audited Accounts of any organisation under its

administrative control, the Ministry/Department should approach the Committee

sufficiently in advance for extension of time by explaining the reasons for doing so. A

reference should be made to the extension given by the Committee in the paper when laid.

8.1.8 The Committee is of the view that the Ministry should take early steps for not only

clearing the arrears but also ensure the timely laying of Reports in future.

9. Ministry of Social Justice and Empowerment

The Ministry of Social Justice and Empowerment laid 15 Annual Reports and Audited

Accounts on the Table of Rajya Sabha during the 214th Session. Out of 15,10 were laid beyond

the stipulated time, i.e., within nine months of closure of accounts. The delay ranges from 11

months 14 days to 2 years 11 months 14 days. The Committee took up the following

organizations for detailed consideration: -

9.1 National Institute of Social Defence (NISD), New Delhi

9.1.1 The chronological detail of the Annual Reports and Audited Accounts laid on the Table

of Rajya Sabha of National Institute of Social Defence (NISD), New Delhi for the year 2003-04

onward is as follows:

9.1.2 The Annual Report and the Audited Accounts of the National Institute of Social Defence

(NISD), New Delhi for the year 2004-05 was required to be laid on the Table of both the Houses

of Parliament within nine months of the closing of the financial year i.e. by December 31, 2005.

This could not be done because the CAG Audit of the Institute for the year 2004-05 was

conducted by DGACR only in February/March, 2007 and Audit Report was made available to

the Institute in the middle of June, 2007. Thereafter, replies to the Audit paras were

communicated to the office of the Director General of Audit, Central Revenue, CAG. On receipt

of acceptance Report from the CAG on Audit paras in the first week of April, 2008, the report

was translated in Hindi and some time was also taken for printing and thereafter the same was

incorporated in the Annual Report. The report was ready for laying on the Table of the House in

May, 2008.

Hence, the Annual Report of National Institute of Social Defence (NISD), New Delhi

together with Audited Accounts for the year 2004-05 was laid on the Table of the House on

15.12.2008.

9.1.3 The Committee observes with concern that the Statutory Auditors have taken unduly long

time in auditing the accounts of the National Institute of Social Defence (NISD), New Delhi.

However, the Committee was not apprised about the details of the dates of the preceding stages

as when the Annual Report was placed before the General Council of the Institute for seeking its

approval. The Committee reiterates its recommendation that in case of delay, statement

giving reasons for delay containing information, in chronological order setting forth the

dates of accounts, their submission to Audit, receipt of draft Audit Report, replies given to

audit queries, receipts of final audit Report, translation and printing of accounts and their


the Annual Report and Audited Accounts so that the House may identify the stages, causes

and intent of delay and suggest remedial measures wherever required.

9.1.4 The Committee reiterates its recommendation that in case of delay in laying the

Annual Report and Audited Accounts of National Institute of Social Defence (NISD), New

Delhi, the Ministry of Social Justice and Empowerment should approach the Committee

sufficiently in advance for extension of time by citing cogent reasons for doing so. A

reference should be made to the extension given by the Committee in the papers when laid.

The Ministry should adhere to this recommendation without failure in future.

9.1.5 The Committee hopes that the National Institute of Social Decence (NISD), New

Delhi, and the Ministry of Social Justice and Empowerment would clear all the arrears in

the shortest possible time.

9.2 Working of Scheduled Castes and Scheduled Tribes

(Prevention of Atrocities), Act, 1989 for the year 2006. 9.2.1 The chronological detail of the Annual Reports laid on the Table of Rajya Sabha of for

the calendar year onward is as follows:

9.2.2 The delay statement laid by the Ministry along with the Annual Reports for the calendar

year 2006 stated, inter alia, as follows:-

As per Rule 18 of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities)

Rules, 1995, the State Government shall every year, before the 31st March, forward the report to

the Central Government about the measures taken for implementing provisions of the Act and

various schemes/plans framed by it during the previous calendar year.

For preparation of the Annual Report for the calendar year ending 31st December 2006,

the Ministry of Social Justice and Empowerment initially addressed the State Governments and

Union Territory Administrations on 3rd January, 2007 for sending the material for the Annual

Report and thereafter they were reminded several times to expedite the information. In some

cases where the information received initially was, either incomplete or inconsistent, it had to be

referred back to the concerned State Government/Union Territory Administration for obtaining

complete information. The requisite information from the State Governments and Union

Territory Administrations of Andhra Pradesh, Arunachal Pradesh, Bihar, Chhattisgarh, Goa,

Gujarat, Haryana, Himachal Pradesh, Karnataka, Kerala, Madhya Pradesh, Maharashtra,

Meghalaya, Mizoram, Nagaland, Orissa, Punjab, Rajasthan, Tripura, Uttarakhand, Uttar Pradesh,

West Bengal, A&N Islands, Chandigarh, Daman & Diu, Delhi, Lakshadweep and Punducherry

was received during April, 2007 to November, 2007. Likewise the requisite information from the

State Governments of Assam, Sikkim and Tamil Nadu was received during December, 2007-

May, 2008. The information was, however, not received from States/UTs of Jharkhand, Manipur

and Dadra & Nagar Haveli, despite having given them the deadline to furnish it. Further the

National Crimes Records Bureau, Ministry of Home Affairs had furnished the data for the

Annual Report under the Act during the January, 2008.

9.2.3 The Committee expresses its displeasure of the delayed laying of the Annual Reports

and is of the view that the Ministry of Social Justice and Empowerment could have

expedited the follow up with the Ministries/Departments of the Central Government/State

Government/Union Territory Administrations to avoid the inordinate delay of 1 year 2

months and 14 days in case of Annual Report of the Annual year 2006. The Committee

observes that the Ministry took comparatively a longer time in compilation of data given by

the National Crimes Records Bureau. The Committee, therefore, feels that there is a need

for strengthening the compiling mechanism in the Ministry so that such delays do not occur

in future.

9.2.4 The Committee directs that the Ministry should chalk out a time bound programme

so that the arrears are cleared within a reasonable time.

10. Ministry of Human Resource Development

The Ministry of Human Resource Development (Department of School Education and

Literacy) laid 23 Annual Reports and Audited Accounts on the Table of Rajya Sabha during the

214th Session. Out of these, 19 Reports were laid beyond the stipulated time. The delay ranges

from 11 months 14 days to 3 years 11 months 14 days. The Committee took up the following

organization for detailed consideration: -

10.1 Sarva Shiksha Abhiyan (SSA), Gangtok, Sikkim 10.1.1 The chronological detail of the Annual Reports and Audited Accounts laid on the Table

of Rajya Sabha of Sarva Shiksha Abhiyan (SSA), Gangtok, Sikkim for the year 2003-04 onward

is as follows:

10.1.2 The delay statement laid by the Ministry of Human Resource Development in respect of

Sarva Shiksha Abhiyan for the year 2003-04 has stated that the report could not be laid within a

period of 9 months as the same were received late from the Human Resource Development

Department, Gangtok, Sikkim. The delay statement laid by the Ministry along with the Annual

Reports and Audited Accounts of the Sarva Shiksha Abhiyan (SSA), Gangtok, Sikkim for the

year 2004-05 stated, inter alia, as follows:-

"……..The Annual Report and Audited Accounts of the Sarva Shiksha Abhiyan

for the year 2004-05 could not be laid due to unavoidable circumstances such ascorrection in

utilization certificate and reprinting of report. In future, all efforts will be made to ensure the

laying of these documents on the Table of the House by the due date.”

10.1.3 As regard laying of review statement of the Annual Report and Audited Accounts of the

Sarva Shiksha Abhiyan, Gangtok, Sikkim the Ministry of Human Resource Development

(Department of School Education & Literacy) has stated that they are in agreement with the

Annual Report and Audited Accounts in respect of the Sarva Shiksha Abhiyan, Gangtok, Sikkim

for the year 2004-05 of Human Resource Development Department of Sikkim. Hence no review

is being laid alongwith the Annual Report.

10.1.4 Sarva Shiksha Abhiyan (SSA), a national programme to achieve the universalisation of

Elementary Education, was introduced in Sikkim in the year 2001. Sarva Shiksa Abhiyan

programme has completed the 3rd year of its implementation in west District while 2nd year in

rest of the districts in the State in the year 2003-04. Hence 1st report of the Sarva Shiksa Abhiyan

programme has been laid in the House on 15.12.2008 with a delay of 3 years 11 months 14 days.

As stated above, the delay in laying the Annual Report and Audited Accounts for 2003-

04 and 2004-05 of the papers Sarva Shiksa Abhiyan, Gangtok, Sikkim is mainly due to late

receipt of the Annual Report and further delay in making corrections in utilization certificate and

reprinting of report.

10.1.5 The Committee is concerned with the delay caused due to late receipt of the papers

from Human Resource Development Department, Gangtok, Sikkim. Laying of the Annual

Report and Audited Accounts with regard to a programme by the Ministry is not merely a

formality to be observed. Its purpose is to ensure the accountability of such programme to

Parliament and as such it has the right to be apprised of the activities thereof to know

whether the purpose for which the said programme was constituted is being fulfilled or not.

It is, therefore, imperative that the documents with regard to such an important

programme are laid before the Parliament in time and complete in all respects.

10.1.6 The Committee, therefore, desires that the Human Resource Development

Department, Gangtok Sikkim should take effective steps to furnish information to the

Ministry of Human Resource Development (Department of School Education & Literacy)

so that the timely laying of the documents on the Table of the House is ensured.

10.1.7 The Committee directs that in case of delay, a comprehensive statement giving


accounts, its submission to Audit, receipt of draft Audit Report, replies given to audit

queries, receipts of final audit Report, translation and printing of accounts and their




10.1.8 The Committee also directs that in case of unavoidable delay in the laying of the

papers, the Ministry should request for extension of time giving reason for delay well in

time before expiry of the stipulated time of 9 months.

10.1.9 The Committee has observed that the Ministry of Human Resource

Development (Department of School Education and Literacy) have not laid the Annual

Reports and Audited Accounts of Sarva Shiksha Abhiyan/DPEP in respect of most of the

States and particularly of Andhra Pradesh, Jammu & Kashmir, Assam, West Bengal,

Manipur and Karnataka. The laying of Annual Reports with regard to some other States

is also not within stipulated time. In some cases the Ministry have not approached the

Committee for extension of time before the expiry of stipulated time. In recent past, the

Committee visited the States of West Bengal, Assam and Meghalaya and heard the

representatives of Sarva Shiksha Abhiyan of these States and directed them to submit all

the pending reports. The Committee also directed them to seek extension of time in case of

any delay in laying the Reports. If delay occurs due to non-availability of Hindi translation

in a State the Committee advised them to seek assistance from the Ministry in getting the

Reports translated in Hindi.

10.1.10 The Committee is hopeful that the Ministry will take all possible steps to

ensure that all the pending Reports are being laid on the Table of the House as early as

possible.

11. Ministry of Tourism

The Ministry of Tourism laid 25 Annual Reports and Audited Accounts on the Table of

Rajya Sabha during the 214th Session. Out of these 4 Reports were laid beyond the stipulated

time. The delay ranges from 9 months 20 days to 1 year 9 months 20 days. The Committee took

up Assam Ashok Hotel Corporation Limited, Guwahati for detailed consideration: -

11.1 Assam Ashok Hotel Corporation Limited, Guwahati

11.1.1 The chronological detail of the Annual Reports and Audited Accounts laid on the Table

of Rajya Sabha of Assam Ashok Hotel Corporation Limited, Guwahati for the year 2002-03

onward is as follows: -

11.1.2 The delay statement laid by the Ministry of Tourism in respect of Assam Ashok Hotel

Corporation Limited, Guwahati for the year 2005-06 has stated that the report could not be laid

within a period of 9 months because the Annual Accounts for the year 2004-2005 were adopted

by the shareholders in the AGM held on 1.2.2006. As a result, the draft Annual Accounts for the

year 2005-06 were delayed and put up before the Board of Directors for their approval on

7.8.2006. But due to certain clarifications sought by the member of Board, the accounts could

not be approved in the Board. Due to some unavoidable circumstances, the 87th and 88th Board

Meeting was adjourned. The 87th and 88th Board meeting was convened along with 89th Board

meeting on 27.06.2007. Thereafter, the Board in its 89th Meeting approved the accounts for the

year 2005-06 on 27.06.2007. The audit report was received from statutory auditors on 16.11.07

after a gap of five months. The Annual Accounts along with statutory reports were submitted to

C&AG on 17.11.07 and AGM was held for adoption of accounts by the shareholders on

17.12.07. Therefore, the Report was laid on the Table of Rajya Sabha in 214th Session. The

Ministry has further stated that the delay was entirely un-intentional and requested to kindly

condone this delay.

11.1.3 The Committee has seen that the Ministry of Tourism has not approached the Committee

for seeking extension of time for laying the papers of Assam Ashok Hotel Corporation Limited

on the Table of Rajya Sabha and the Committee was not apprised about the reasons leading to

the delay. This is in contravention of the recommendation of the Committee. The Committee,

therefore, directs that the Ministry of Tourism should approach the Committee sufficiently

in advance for seeking extension of time giving cogent reasons for delay.

11.1.4 The Ministry of Tourism is further directed to chalk out a time bound schedule for

finalization of the Annual Reports and Audited Accounts of all the seven subsidiary

companies of ITDC. The Ministry should monitor the progress of preparation of Annual

Report and Audited Accounts every month and ensure timely laying of the Reports of all

the subsidiary companies.

11.1.5 The committee has gone through the delay statement attached along with the Annual

Reports and Audited Accounts for the year 2004-05 and 2005-06 of Assam Ashok Hotel

Corporation Limited, Guwahati and found that there was an excessive delay of nearly 2 months

and 5 months respectively in obtaining comments of the C&AG. The Committee is of the

opinion that comparatively less time may be taken in obtaining comments from C&AG and

giving replies on those by the Corporation. In future, Corporation should take all steps to

avoid such delays.

12. Ministry of Water Resources

The Ministry of Water Resources laid 5 Annual Reports and Audited Accounts on the

Table of Rajya Sabha during the 214h Session. All the 5 Reports were laid beyond the stipulated

time of 9 months. The delay ranges from 9 months 20 days to 5 year 11 months 15 days. Out of

these 3 Reports belong to Kerala Land Development Corporation Limited, Thriuvanthapuram

and 1 Report from Andhra Pradesh State Irrigation Development Corporation Limited,

Hyderabad. The remaining 1 Report belongs to Brahmaputra Board, Guwahati.

12.1.1 The Committee heard the Director, Ministry of Water Resources and the representatives

of Kerala Land Development Corporation Limited, Thiruvanthapuram in its meeting held on

16th December, 2007 and sought clarifications on the various issues related to the delay in laying

of the papers. At that time seven Reports from 2001-02 onwards were pending. The Committee

directed the Ministry that all possible steps should be taken to ensure laying of all the pending

reports at the earliest. The Committee has covered this Organisation in its 119th Report presented

on the Table of the House on 9th June, 2009. The Ministry of Water Resources have laid 3

reports i.e. for the year 2001-02, 2002-03 and 2003-04 in 214th Session of Rajya Sabha.

12.1.2. Similarly, the mater relating to the delay in laying of Annual Reports and Audited

Accounts of Andhra Pradesh State Irrigation Development Corporation Limited (APSIDC),

Hyderabad has already been examined and included in the 119th Report of the Committee. The

Committee heard the Principal Secretary, Ministry of Water Resources and the representatives of

Andhra Pradesh State Irrigation Development Corporation Limited (APSIDC), Hyderabad in its

meeting held on 18th December, 2007. At that time, the Committee sought clarification on

various issues related to the delay in laying of the papers of the Corporation. The Ministry of

Water Resources has laid 2 reports i.e. for the years 2004-05 and 2005-06 after the visit of

Committee.

12.2. Brahmaputra Board, Guwahati

12.2.1. The Brahmaputra Board set up under the Act of Parliament (46 of 1980) had started

functioning w.e.f. 11.1.1982 and since then it has been performing its statutory function relating

to planning and development of Water Resources of the Brahmaputra and Barak valleys. The

Board has carried out detailed planning and documentation of the enormous water Resources of

the North Eastern Region and related problems and potentials which includes preparation of

Master Plan. Survey, Investigation and preparation of Detailed Project Reports of multipurpose

projects and drainage congested areas and Anti-Erosion Schemes and their execution.

12.2.2. As per the recommendations of the Committee on Papers Laid on the Table, Rajya Sabha,

the Annual Reports and Audited Accounts of the Brahmaputra Board, Guwahati are required to

be laid on the Table of the House within nine Months from the date of closure of their Annual

Accounts. Since the Annual Accounts of the Board close on 31st March every year, hence the

papers are required to be laid on the Table of the House by 31st December every year.

12.2.3. The laying position of the Annual Reports and Audited Accounts of the Board over the

past few years is as under: -

12.2.4. The delay statement laid by the Ministry of Water Resources in respect of Brahmaputra

Board, Guwahati for the year 2006-07 has stated that the report could not be laid within a period

of 9 months because the Audit Certificate was received late from Principal Accountant General

(Audit), Assam. The Ministry in case of nonlaying of the papers is supposed to lay the delay

statement with reasons of delay within the stipulated time. The Committee observed that the

Ministry failed to seek extension of time well in advance for laying of the papers as per its

recommendation and also failed to lay the statement giving the reasons for not laying the

Reports within stipulated time. The Committee, therefore, directed that Ministry should

note this for strict compliance in future.

12.2.5. The Ministry of Water Resources has not furnished the details of various stages involved

in preparation of Annual Report, 2005-06 of the Board. It appears that the Ministry has not

framed any time schedule to ensure the timely completion of various stages of report. The

Ministry, however, advised the Board that Annual Accounts be prepared immediately after the

completion of the financial year and put up the same in the Board meeting for approval. This has

not been considered sufficient. The Committee, therefore, recommends that in case of delay

the Ministry should furnish the statement of reason for delay which should invariably

contain information in chronological order about the date of finalisation of Annual

Accounts, appointment of auditors, forwarding the accounts to the auditor, completion of

audit, submission to C&AG, adoption of report by AGM, completion of translation,

printing and forwarding of the papers to the Ministry. Such a statement should necessarily

be laid along with the Report on the Table of the House so as to enable the Committee to

identify the stages, causes and extent of delay and suggest remedial measures, wherever

required.

SUMMARY OF RECOMMENDATIONS 1. As per the recommendations of the Committee on Subordinate Legislation, the

Notifications/Orders are required to be laid before the House (i) if the House is not in

Session, during the Session immediately following the date of publication of the Order in

the official Gazette and (ii) if the House is in Session, on the date of the publication of the

Order, during its continuance and in case the time lag between the date of publication and

the date of the closing of the Session is less than 15 clear days, before the expiry of the

Session immediately following the said Session. The Committee is of the view that all the

Ministries/ Departments are expected to follow the said time schedule. The Ministries of

Corporate Affairs, Finance, Health and Family Welfare, Consumer Affairs, Food and

Public Distribution, Environment and Forests and Shipping, Road Transport and

Highways are requested to strictly adhere to the prescribed time schedule.

2. The Committee impresses upon the Ministries that in case of delay in the laying of

Government Notifications/Orders, a comprehensive delay statement explaining the reasons

in detail for the delay in laying of the papers on the Table of the House from the date of

publication of the Notification/order in the Gazette to the actual date of laying on the Table

of the House, mentioning the time frame, if any allowed in the Statute should invariably be

laid. (Para- 5)

3………The Committee takes a serious note of the recurring delay in the laying of the

Annual Reports and Audited Accounts by the concerned Ministries/Departments and

directs them to take necessary steps to ensure that the Annual Reports and Audited

Accounts of the Companies/Organisations functioning under their control are laid on the

Table of Rajya Sabha within nine months of the closure of the Annual Accounts.

4. The Committee took up for close scrutiny the reasons that led to the delayed laying

of the Annual Reports and Audited Accounts of some of these Companies/Organisations

under a few Ministries where delay involved was more than 1 year and the findings of the

Committee are indicated in the succeeding paragraphs.

(Para-7)

Central Agricultural University, Imphal (Department of Agricultural Research and Education), Ministry of Agriculture 5. The Committee is not satisfied with the reasons given for delay by the Ministry in

the delay statement laid along with the Annual Report of the Central Agricultural

University, Imphal for the year 2004-05. The Committee also noted that the Ministry has

not laid delay statements alongwith the Annual Reports for the years 2002-03 and 2003-04.

(Para-8.1.3) 6. The Committee understands that the University has taken comparatively long time

in completion of various stages in preparation of Annual Report and therefore urges that

the University should take effective steps to improve the procedure of preparation of

Annual Report and the entire work should be completed within the stipulated time of

9 months from the close of the financial year. (Para-8.1.4)

7. The Committee reiterates its recommendation that in case of delay, statement giving


accounts, their submission to Audit, receipt of draft Audit Report, replies given to audit

queries, receipt of final Audit Report, translation and printing of Accounts and their


the Annual Report and Audited Accounts. (Para-8.1.5)

8. The Committee further recommends that a comprehensive review covering broad

performance of the organizations and a brief description of the critical areas should be laid

along with the Annual Reports and Audited Accounts as the Parliament being preoccupied

sometimes with important legislative business may not find sufficient time to go through

the Annual Report and Audited Accounts and therefore, a review on the working of the

organization may enable it to have cursory look on the functioning of the organization.

9. The Committee impresses upon the Ministry of Agriculture that in case of delay in

laying the Annual Reports and Audited Accounts of any organisation under its

administrative control, the Ministry/Department should approach the Committee

sufficiently in advance for extension of time by explaining the reasons for doing so. A

reference should be made to the extension given by the Committee in the paper when laid.

(Para-8.1.7) 10. The Committee is of the view that the Ministry should take early steps for not only

clearing the arrears but also ensure the timely laying of Reports in future.

National Institute of Social Defence (NISD), New Delhi 11…….The Committee reiterates its recommendation that in case of delay, statement

giving reasons for delay containing information, in chronological order setting forth the

dates of accounts, their submission to Audit, receipt of draft Audit Report, replies given to

audit queries, receipts of final audit Report, translation and printing of accounts and their




(Para-9.1.3) 12. The Committee reiterates its recommendation that in case of delay in laying the

Annual Report and Audited Accounts of National Institute of Social Defence (NISD), New

Delhi, the Ministry of Social Justice and Empowerment should approach the Committee

sufficiently in advance for extension of time by citing cogent reasons for doing so. A

reference should be made to the extension given by the Committee in the papers when laid.

The Ministry should adhere to this recommendation without failure in future.

(Para-9.1.4) 13. The Committee hopes that the National Institute of Social Decence (NISD), New

Delhi, and the Ministry of Social Justice and Empowerment would clear all the arrears in

the shortest possible time. (Para-9.1.5)

Working of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities), Act, 1989 for the year 2006. 14. The Committee expresses its displeasure of the delayed laying of the Annual Reports

and is of the view that the Ministry of Social Justice and Empowerment could have

expedited the follow up with the Ministries/Departments of the Central Government/State

Government/Union Territory Administrations to avoid the inordinate delay of 1 year 2

months and 14 days in case of Annual Report of the Annual year 2006. The Committee

observes that the Ministry took comparatively a longer time in compilation of data given by

the National Crimes Records Bureau. The Committee, therefore, feels that there is a need

for strengthening the compiling mechanism in the Ministry so that such delays do not occur

in future. (Para-9.2.3)

15. The Committee directs that the Ministry should chalk out a time bound programme

so that the arrears are cleared within a reasonable time. (Para-9.2.4)

within stipulated time. In some cases the Ministry have not approached before the

Committee for extension of time before the expiry of stipulated time. In recent past, the

Committee visited the States of West Bengal, Assam and Meghalaya and heard the

representatives of the State Implementing Societies SSA/DPEP of these States and directed

them to submit all the pending Annual Reports and Audited Accounts. The Committee

also directed them to seek extension of time in case of any delay in laying the Reports. If

delay occurs due to non-availability of Hindi translation in a State the Committee advised

them to seek assistance from the Ministry in getting the Reports translated in Hindi.

21. The Committee is hopeful that the Ministry will take all possible steps to ensure that

all the pending Reports are being laid on the Table of the House as early as possible.

22. ……….The Committee, therefore, directs that the Ministry of Tourism should

approach the Committee sufficiently in advance for seeking extension of time giving cogent

reasons for delay. (Para-11.1.3)

23. The Ministry of Tourism is further directed to chalk out a time bound schedule for

finalization of the Annual Reports and Audited Accounts of all the seven subsidiary

companies of ITDC. The Ministry should monitor the progress of preparation of Annual

statement giving the reasons for not laying the Reports within stipulated time. The

Committee, therefore, directed that Ministry should note this for strict compliance in

future. (Para-12.2.4)

26. …………The Committee, therefore, recommends that in case of delay the Ministry

should furnish the statement of reason for delay which should invariably contain

information in chronological order about the date of finalisation of Annual Accounts,

appointment of auditors, forwarding the accounts to the auditor, completion of audit,
