Triple talaq is cruel: Allahabad HCcustoms and social practice under the garb of personal lawpurportedly having divine sanction", the court observed."India is a nation in the making, geographical boundaries alonedo not define a nation. It is to be adjudged, amongst others, onthe parameter of overall human development and how thesociety treats its women; leaving such a large population to thewhims and fancies of a personal law which perpetuates genderinequality and is regressive, is not in the interest of the societyand the country. It impedes and drags India from becoming anation", the court remarked. The court observed that "divorce is permissible in Islam only incase of extreme emergency. When all efforts for effecting areconciliation have failed, the parties may proceed to adissolution of marriage by Talaq or by Khola"."The view that the Muslim husband enjoys an arbitrary, unilateral power to inflict instant divorce does not accord withIslamic injunctions. It is a popular fallacy that a Muslimhusband enjoys, under the Quranic Law, unbridled authority toliquidate the marriage."The whole Quran expressly forbids a man to seek pretexts fordivorcing his wife, so long as she remains faithful and obedientto him", the court said in an order dated November 5."The Islamic law gives to the man primarily the faculty ofdissolving the marriage, if the wife, by her indocility or her badcharacter, renders the married life unhappy; but in the absenceof serious reasons, no man can justify a divorce, either in theeye of religion or the law", the court said. The court made the observations while dismissing the petitionof Hina, a 23-year-old woman, and her husband who was 30years her senior and had married her "after effecting triple talaqto his wife". . The couple hailing from Bulandshahr district inwestern Uttar Pradesh had moved the court seeking a directionto the police and Hina's mother that they stop harassing thepetitioners and their safety and security be ensured. The court, however, made it clear that it was not disputing thecontention of the petitioner's counsel that the couple "are adultsand are at liberty to choose their own partner" and they "cannotbe deprived of their right to life and personal liberty" as per thefundamental rights enshrined in the Constitution."Nor difference in age is an issue", the court said, adding,"What is disturbing is that the instrument of instant divorce(triple talaq) has been used for ulterior purpose (by the man) fordivorcing his wife....first petitioner (the woman) left her familyand joined the company of the second petitioner andconsequently the second petitioner decided to get rid of his firstwife"."The question which disturbs the court is - should Muslimwives suffer this tyranny for all times? Should their personallaw remain so cruel towards these unfortunate wives? Whetherthe personal law can be amended suitably to alleviate theirsufferings? The judicial conscience is disturbed at thismonstrosity", the court noted with concern."Women cannot remain at the mercy of the patriarchal set upheld under the clutches of sundry clerics having their owninterpretation of the holy Quran. Personal laws, of anycommunity, cannot claim supremacy over the rights granted tothe individuals by the Constitution", the court held.Stating that it would "not like to say anything further for thereason that the Supreme Court is seized of the matter", thecourt added, while dismissing the petition, that "the legality ofthe marriage/divorce and rights of parties is kept open".

Anantnag district last evening after militants hiding in a housefired on the security personnel during a search operation. The security personnel had laid siege around the area followinginputs that some militants including Lashkar-e-Toiba'sKashmir chief and most wanted militant Abu Dujana werehiding there. The encounter between the militants and security forcescontinued today also and there were unconfirmed reports thatthree Lashkar militants were killed in the firefight. However, there was no official confirmation about the militant killings. As the gunfight was going on, people from adjoining areas inlarge numbers gathered near the encounter site. Chanting pro-freedom and anti-government slogans, the protestors attemptedto enter the besieged area to help the holed-up militants toescape.Sources said the security personnel fired warning shots todisperse the people. "However, when the people did notdisperse and attempted to storm the encounter site, securitypersonnel fired some rounds and tear gas shells towards themob".Locals said in the security forces firing, a youth Arif AhmadShah was killed and many others injured. The killing of youth triggered protests in the area and adjoiningareas and some other parts of South Kashmir. The protestorsclashed with the security personnel, who fired tear smokeshells and resorted to heavy baton charge to disperse them. Theclashes continued till late evening.A police spokesman confirmed the killing of the civilian."At some distance from the encounter site, a stray bullet hit theyouth, Arif. He later succumbed to injuries," he said.
Police, meanwhile, appealed people not to assemble or comeclose to the encounter sites as there is every chance that straybullets may hit them and they make get injured. Earlier, this year police had issued an advisory asking peopleliving within two kilometres from the encounter site to stayindoors."In case any encounter starts anywhere, the people particularlythe parents of young adults of the nearby area are requested notto allow their wards to move towards the encounter site. to fill up vacancies in high courts.Seeking to make the present system of appointment of judgesmore transparent, the committee said the SC Collegium shouldinform the candidates whose name it has rejected on aparticular ground. It said the government also rejects the recommendations of thecollegium "without furnishing cogent reasons...such practicesare against the principles of natural justice and leads toopaqueness in the appointment process".On the issue of hiking the retirement age of SC judges from thepresent 65 to 67 years, it said the retirement age has remainedunchanged since India became a Republic. The retirement ageof high court judges was increased fro 60 to 62 in 1963.Referring to the short tenures the CJI and chief justices of highcourts often have, the panel said in the last 20 years, 17 ChiefJustices of India have been appointed and out of those, onlythree had tenure of more than two years."Many of them had tenure of even less than one year," itobserved. It said chief justice of high courts in most cases get appointedfor a less than two years term. Some of the chief justices alsoget elevated to the bench of Supreme Court, further shorteningtheir tenure in high courts. "In many cases, the post of ChiefJustice are not filled- up simultaneously and acting ChiefJustice, appointed as a stop-gap arrangement, does not oftentake decision about names to be recommended to the UnionGovernment/Supreme Court collegium for filling-up ofvacancies in that High Court," the panel said taking a grimview. It said that ensuring a minimum tenure may resolve the issueand asked the Law Ministry "to consider ways so that a ChiefJustice in the High Courts and in the Supreme Court remains inposition for a certain minimum tenure".It also said that instead of five, a minimum of 11 judges of theSupreme Court should hear cases involving the validity of aConstitutional amendment. It also recommended the cases involving the interpretation ofConstitution should not be heard by a Bench of less than 7judges.

changed the economy of the farmers in Ramba", Bali said. Thewalnut processing has employed around 150 people includingboys and girls, he said. The owner of the unit said that walnut worth of crores ispurchased every year from local farmers for the markets inJammu, Delhi, Chennai, Gujarat."From Pogal Paristan walnut is sold from the plants which aregrown with the help of locally prepared manure," said BashirAhmed Naik an orchardist of Maligam, Ramban. Walnut trees normally give rise to fresh shoots during April andMay when new leaves sprout and flowers blossom. Theripening of crop takes place in the months of September andOctober."I purchase walnuts of crores from Gool, Sangaldan, PogalParistan, Neel, Khari, Banihal. Besides this I also collected thecrop from Doda and Kishtwar but the best quality of walnut isfound in Ramban whose kernel is good in size and taste," saidFarooq Ahmed Wani, a fruit contractor.Another fruit contractor namely Abdul Subhan told that he hadpurchased walnut from Alanbas, Maligam and Pogal and soldin the Jammu market whose kernel is of higher quality."The department authorities regularly visit the orchards andspread awareness about the methods and local ways of growingthe walnut plants", Bali said.Ramban is one of the hilly districts in the state, endowed withappropriate climatic conditions for fostering plants and trees. Out of the total land in the district, 10461.94 hectares has beenutilized for growing fruit and nut trees. In the year 2015-16,19742 metric tons of production was recorded. This shows thathorticulture sector is bringing sea change in the life of localpeople day by day, Bali said."There are four nurseries of Walnut, peach, apple and pecan nutat Gool, Sangaldan, Batote and Nowgam to promote plantationin these areas. In these nurseries better quality of plants aregrown with the help of grafting", Bali said."From these nurseries plants are provided to the people on verylow rates. Every year there is a continuous expansion inplanting different types of fruit bearing trees and now peopleare finding better financial avenues in horticulture sector", headded. Rs. 2000 crore is only a part

very encouraging gesture
from govt. side but added
that if govt's intensions are
clear, then why they
hesitate to decide the
adequate quantum of relief
compensation and its
simultaneous disbursement
in one go instead of piece
meals. The state govt.
should avail the advantage
of magnanimity shown by
Narendra Modi who
assured to provide more
funds if asked by govt. for
the said purpose.
He urged upon the govt. to
provide employment
package & reservation to
DP wards on the analogy of
Kashmir migrants as they
deserve only parity with
them. Mere sloganeering by
govt. does not make any
sense until and unless
concerted and concrete
steps are not taken to
resolve the legitimate issue
which was derailed by
previous dispensation of
both Congress and NC who
ruled the state for more
than six decades. He also
demanded that Tehsildars

The observations of the Allahabad HighCourt terming triple talaq asunconstitutional give us an insight
into the mind and mood of the judiciary. Butif we go by the judicial wisdom garnered over
the years, religious freedom, as espoused by the IndianConstitution in Article 25 and Article 26, excludes thepossibility of major reform in Muslim Personal Law.The courts have consistently held that freedom of religionunder Article 26 protects the "essential or core" of religiouspractices of both religious denominations as well as sectsthereof.India follows a system of legal pluralism that allows differentreligious communities to be governed by their own codes ofpersonal law. This has been seen as a way of protectingdistinct communal identities and safeguarding the right ofcitizens to practice their faith, as enshrined in theConstitution.Triple talaq in its presently practised form, known as instanttriple talaq, has however no religious sanction and is basicallya cultural practice. Most Muslims agree that it is antitheticalto the spirit of their scripture, the Quran. But the court justified its verdict by the logic of the Quranitself. The court observed that "divorce is permissible in Islamonly in case of extreme emergency. When all efforts foreffecting reconciliation have failed, the parties may proceedto dissolution of marriage by talaq or by khula"."The view that the Muslim husband enjoys an arbitrary, unilateral power to inflict instant divorce does not accord withIslamic injunctions. It is a popular fallacy that a Muslimhusband enjoys, under Quranic law, unbridled authority toliquidate the marriage."The whole Quran expressly forbids a man to seek pretextsfor divorcing his wife, so long as she remains faithful andobedient to him," the court said.
"Islamic law gives to the man primarily the faculty of
dissolving the marriage, if the wife, by her indocility or herbad character, renders the married life unhappy; but in theabsence of serious reasons, no man can justify a divorce, either in the eye of religion or law," the court said.To be fair, even the Bharatiya Muslim Mahila Andolan(Indian Muslim women's welfare movement or BMMA),which has been on the forefront of the movement to ban tripletalaq, is arguing for a ban on the way triple talaq is practisedin India and not on the one enjoined by the Quran. One must concede that it has not been asking for much. In fact, the BMMA looks as confused as Shayara Bano. Both of themhave asserted in court that triple talaq, as per judicial verdicts,is now counted as one and yet ask the court to hold it asunconstitutional. As a matter of fact, the BMMA is basically asking that instantoral triple talaq must end and that the Quranic procedure ofdivorce in three months, with prior efforts of reconciliationbetween spouses, be strictly followed. Thus they are not asking for revolutionary change but simplyrequesting the court for an "Islamisation" of Muslim PersonalLaw. Most liberal scholars have been making similar demands
and are against instant triple talaq. Thus the Hanafi sect, which is what the overwhelming Muslimsrepresent, and its law stand protected.Similarly, just like the All-India Muslim Personal Law Board(AIMPLB), the BMMA too, opposes the Uniform Civil Codeand has explicitly asserted in the apex court that the same is"neither desirable nor practical".The truth is that the concept of instant triple talaq is alien toIslam as it goes against the very spirit of the procedure ofdivorce laid down in the Quran. Even the Prophet, when he wasinformed about a man who gave three divorces at a time, wasso enraged that he said: "Are you playing with the Book ofAllah who is Great and Glorious while I am still among you?"Talaq is a very exceptional remedy, frowned upon even by theQuran, and has to be taken recourse to only when allreconciliatory efforts fail. The policy of Islam is that it is betterto dissolve the marriage when there is bitterness amongcouples. The Allahabad High Court reiterated this very spirit of theProphetic teaching. "Muslim law, as applied in India, has takena course contrary to the spirit of what the Prophet or the HolyQuran laid down and the same misconception vitiates the lawdealing with the wife's right to divorce," it said. The Quran lays down a three-tiered calibrated divorce, keepingin mind human frailties. Divorce cannot be pronounced in asingle sitting and must be preceded by efforts of arbitration, mediation, and reconciliation by mediators appointed by bothsides who must explore the possibility of reconciliation. It has to be pronounced before witnesses and over three sittingsover a period of three months. These months are to allow thecouple to reflect on their relationship and not come to a hastyconclusion.During this period, the woman is entitled to her right toresidence and maintenance from the husband. In case there iscohabitation during this time, the divorce would be null andvoid.Ironically, instantaneous triple talaq is banned in several
Islamic countries around the world, including Pakistan, SaudiArabia, Turkey, Tunisia, Algeria, Iraq, Iran, Indonesia andBangladesh. Many of these countries have also set uparbitration councils that try to help couples resolve theirdifferences.Muslim institutions must understand that Quranic ontologyrevolves around the principles of justice, fairness and equity, and therefore, any law that contravenes or abridges the rightsarising out of these standards of ethics automatically becomesunacceptable. But the continued refusal of the Muslim patriarchy to seereason makes it imperative to analyse the procedure of talaq inthe Quran to expose the illegitimacy of the stand of some of theclergy. But the judiciary and the State should not make sweepinggeneralisations that all Muslim practices are regressive. One ofthe reasons triple talaq has remained legal so long is the fear, propounded by Muslim community leaders, that if thegovernment is allowed to tamper with Islamic personal laws, itmight one day scrap them completely, and the majority willswallow them up. It is necessary for the State thus, that instead ofcompartmentalising social issues of the Muslim community, itevolves an integrated approach. The Quran is a comprehensivecode for Muslims and egalitarianism is its underlyingphilosophy. The writer is a researcher and development professional whohas spent four decades in the development sector. He holdsdoctorates in economics and english, and has authored bookson religion, rural finance, culture and handicrafts.

The Cassandras are out in full force.Their numbers are growing. And thechorus includes some big names - Paul
Krugman, Manmohan Singh and KaushikBasu among others. Now research from the Fitch affiliated IndiaRatings (Ind-Ra) shows that GDP forecastsneed to be lowered. It has lowered its forecastfor FY17 to 6.8 from 7.8% made in July 2016.Some research reports predict the fall to be ashigh as 3%.Ind-Ra states that the government may facelower tax collections in the second half ofFY17, due to the slowdown in economicactivity. The lower tax collection could getworse if combined with i) lower revenue thanwas budgeted from telecom spectrum auction,ii) likely shortfall in disinvestment, and iii)compensation to be paid to toll roadconcessionaire for suspending toll collectionon national highways till 2 December 2016(yet to be resolved). That, says the report, could see thegovernment staring at a significant shortfall inrevenues. However, adds Ind-Ra, "acombination of: i)higher growth in indirect taxcollection than budgeted during 1HFY17,ii)expected tax revenue garnered from IncomeDeclaration Scheme (IDS) 2016 and theproposed Pradhan Mantri Garib KalyanYojana (PMGKY) 2016, and iii)expenditurecompression, will help the government tomeet the FY17 fiscal deficit target. But there are other dark clouds ahead. Earliermost forecasts (including this author) believedthat at least Rs. 3 lakh crore of high valuecurrency notes would not get returned to thebanking system. Now it appears that thisnumber could be less. Informed sources claim
that the Reserve Bank of India (RBI) hasalready accounted for Rs.11 lakh crore. Moremoney could come in before 31 Decemberdeadline. That could mean fewer notesoutstanding. There are also the two time-bombs fromNepal and Bhutan that have yet to explode.Savvy bankers point out that while Nepal hadbanned the use of Rs.500 and Rs.1,000 Indiancurrency notes earlier, trading in suchcurrency was permitted a few years ago. Thecentral banks of these countries have yet toreconcile the total number of old high-valuecurrency notes with them, as details have yetto come in from all the branches of the banksin these countries.Reports talk of a massive launderingoperation that has been underway in Nepal(and Bhutan) by depositing old Rs.500 andRs.1,000 Indian currency notes with those
banks. The RBI has no power to refuseaccepting the notes that come infrom another central bank which wasauthorised to trade in these currencies. Thesenumbers are expected to be quite large. If the'impounded' money is significantly lowerthan the expected Rs.3 lakh crore, will thismean that the demonetisation move hasfailed? Not really. The government still benefits intwo ways. First, it has managed to breakpolitical funding, especially in Uttar Pradeshand Punjab where elections are due shortly.Second, there is no denying that hugeamounts of money has moved into thebanking system, and can now be traced, taxedand even impounded. What will be watched isthe government's impartiality and politicalresolve. Will the government act? Here the government appears to be failing.
Consider how traffic lines at toll boothserupted after a hiatus of 24 days when no tollwas collected. Ideally, the government oughtto have moved swiftly to introduce systemswhich would allow immediate and automaticdebiting of toll charges to any legitimatedebit/credit/cash card. All that was requiredwas for vehicles to put in a device whichcould 'talk' to toll gates and have theappropriate amounts debited. Singapore hassuch systems installed for over a decade.Ditto with transportation. For the past twodecades, the UK has the Oyster card (formetros and buses) which registers the place ofembarkation, and then the place ofdisembarkation, and debits the appropriateamount to the card. Unless the card's wallethas cash in it, the person cannot even enterthe bus/train.For all its vaunted IT capabilities, India hasstumbled. This could have been done onnational highways and the railways to startwith, since both are governed by the centralgovernment. Later, its application could beexpanded to other sectors as well. Clearly, bigplans aren't enough. Implementation is whatmatters. The experience on India's toll-gateslast week was a sad reminder that India isbetter at bans and stoppages than at planningmeticulously for specific projects. After all, as most people point out, globalexperience (including that of India in the past- in 1946 and 1978) shows that the impact ofmeasures like demonetisation can be veryshort-lived, even counter-productive. Tomake such measures meaningful, they need tobe backed up with follow-up execution. This will be crucial in the implementation ofGST as well. It could end up as a failure, unless some basics are taken into account. But more on that later.
Farooq’s joiningHurriyat Camp
Dr. Farooq Abdullah is a flamboyant character ofJammu Kashmir Politics who has no control overhimself when he is angry and often whimsical. He
can say anything and may appears fundamentalist. Acouple of weeks ago, Farooq wrote in a Srinagar journalthat his father Sheikh Mohammad Abdullah would havebeen happy that the Kashmiri youth had picked up thegun to support their demand for independence. I knew theSheikh well and I do not think that he would have madesuch an irresponsible statement. In his speech, he said: “I want to tell the workers ofNational Conference not be out of this struggle. I warnyou: we are a part of this struggle. We have fought everytime for the interests of this state.”Farooq will be well-advised to resign from the RajyaSabha because he cannot be with India and the Hurriyat atthe same time. In fact, It is shocking as how a person whohas been a Union minister and Kashmir’s chief ministercan make such a statement which counters theConstitution. Significantly, he addressed the gathering inKashmir.Farooq Abdullah’s biggest problem is that he alwayswants to remain in the headlines. To do so he would sayanything. Is Farooq confident that what the Hurriyat ispreaching in the interest of the people in Kashmir, muchless India? Has he ever weighed the repercussion of theValley’s separation from the rest of country? Kashmir is alandlocked territory and does not have an easy access toany place except India. The boys who are fighting against the Indian forces arevery clear about what they desire. They wanted the Valleyto be converted into an independent sovereign Islamicstate. They did not favour integration with Pakistan.Syed Ali Shah Geelani, a separatist Hurriyat leader, doesnot represent them because he now wants Kashmir to bepart of Pakistan, even at the expense of undoing thepartition arrangement. In fact, the Maharaja of Kashmir Hari Singh wanted tostay independent after the British left. But tribals lead byregular Pakistani forces attacked Jammu and Kashmirforcing Maharaja to accede to India and the raidersreached the periphery of Srinagar. They would havecaptured it if they had not stopped at Baramulla to lootand plunder. At that time, Farooq Abdullah’s father, SheikhMohammad Abdullah – released from jail on theinsistence of then prime minister Jawaharlal Nehru –organised the people’s militia during the Maharaja regimeand stalled the forces marching towards Srinagar tillregular Indian forces landed at the airport to push backthe invaders to the territory; what is now known as PoK(Pakistan occupied Kashmir).Because of constitutional provisions, J&K enjoyed thetype of autonomy which other states do not have.Subsequently, Sheikh Abdullah had the state constituentassembly pass a resolution that the state of J&K hadacceded to India irrevocably. Before doing so, he sentSadiq Sahib, who became the state chief minister later, toPakistan to assess what kind of polity Islamabad wasgoing to pursue. After hearing Sadiq’s view that Pakistan wanted to be anIslamic state, the Sheikh Sahib, a product of people’sstruggle to obtain independence from the Maharaja andthe British, took no time in joining India because hewanted the state to be pluralistic. A democratic India, where there would be religious freedom, was the obviouschoice for him. With the passage of time, the Sheikh became the onlyliberal voice which could be heard clearly in the midst ofchallenges and counter-challenges by the Hindus and theMuslims.

He may try to renegotiateexisting business deals thatinclude trade treaties with
India as well.Following the stunning victory byDonald J Trump for the presidencyof the United States, the questionmany Asian Indians are asking iswhat kind of an impact this wouldhave on the US-India relationship.Former US president George WBush was instrumental in bringingthis bilateral relationship to newheights with his open andaggressive advocacy of the Indo-USCivil Nuclear Treaty and created acontinuum through the BarackObama years to further develop andfoster the relationship into astrategic alliance.Trump is not a stranger when itcomes to dealing with Indians, andhis business undertakings in Puneand Gurgaon are clear evidence ofthat existing bond. Also, we havewitnessed a surge of support for himfrom the Indian community in theUS, spearheaded by businessmanShalabh "Shalli" Kumar, who notonly raised campaign funds for thepresident-elect but also arranged a
large gathering in New Jersey inhonour of him.At the outset, one may also wonderwhether Kumar, who is said to behaving close ties to Sangh Parivarorganisations in India, acted aloneor with blessings from those powercentres!Regardless, the election of Trumphas raised serious concerns amongthe Indian community in the USwhich overwhelmingly supportedDemocrat Hillary Clinton for thepresidency.Although Indian Americans aremostly conservative in their socialoutlook and not necessarilycleansed of their caste affiliations orprejudicial minds, Trump'sproposals dealing with issues suchas immigration and trade haveunnerved their senses. Also, many seem to have justifiableapprehensions on the possible riseof the far right movements thatcould threaten their safety and theeconomic stability of their children. Although some of those concernsare beyond the pale, the justconcluded election has itsconsequences not only for thecommunity but also for the US-India relationship, especially whenit comes to trade and immigration.Trump's "America First" populistslogan was a shot across the bow toglobalists and one that was fullyembraced by the blue collar workers
of the country. There is awidespread feeling in the US,particularly among the whiteworking class, that globalism hasdecimated the middle class herewhile creating them in countries likeChina and India.Although putting tariff and traderestrictions are anathema to theRepublican orthodoxy, Trump maytry to renegotiate many existingbusiness deals that may includetrade treaties with India as well.Trump called the H-1B visaprogramme as "unfair" andcriticised Clinton for her support foroutsourcing of jobs. Although H-1Bwas designed to provide atemporary workforce, there werewidespread allegations of abusesthat may have resulted in Americanlabour being supplanted by many ofthose foreign temporary workers. With Alabama Senator Jeff Sessionin line to take charge of the justicedepartment as the future AttorneyGeneral - considered more hawkishon immigration issues - we may seea limit on H-1B entries and newguidelines for a stricter adherence tothe law. However, it could also be aboon for India where these technicalhands may experiment with theirideas in their homeland rather thanin the Silicon Valley where 44 percent of startups have an immigrantfounder. India's software servicesaccounted for $82 billion worth of
exports to North America in 2015and only time will tell howadversely the incoming Trumpadministration would impact it. Trump has promised to reform thetax code and is calling for a taxreduction down to 15 per cent forthe corporate sector. He has vowedto bring offshore deposits of multi-national corporations back to the USto revitalise the economy and torebuild infrastructure. If he succeeds with his proposals inthe Congress, that will tantamountto a paradigm shift in tax policiesresulting in a friendlier ecosystemfor business in the US especially inthe area of manufacturing. That could reduce the appetite formany businesses to jump on thebandwagon of the "Make in India"push by Prime Minister NarendraModi. Trump is already underpressure to stop the Obamaadministration's efforts to strike adeal to build F-16 Fighting Falconsand F/A-18 Super Hornets in Indiato replace an ageing fleet ofRussian-made fighters. In the area of foreign policy, Indiamay stand to gain as Trump hasrepeatedly slammed China for itsmonetary policies and unfair tradepractices. Trump may carry on with Obama'spolicies of increased cooperationwith India in the strategic anddefence areas as a bulwark againstan aggressive and menacing Chinain the Asian theatre.Trump's tough stand against Islamicradicalism may also play into thehands of India as Pakistan hasbecome a hotbed of terrorism andstands to lose billions of dollars inaid with a change in policy. However, there is little doubt thatwith continuing US involvement inAfghanistan, Trump may not havemuch flexibility to punish Pakistanfor its protection of terroristelements in its backyard that arecreating havoc across the borderwith India.Trump's attitude towards VladimirPutin, president of Russia, and hiswillingness to cooperate with theCold War rival may lessen India'sconcern arising from the threat ofISIS or similar threats. In an interview with Forbes India, while launching his Pune project in2014, Trump had said India hadbecome a "top place" in theinternational rollout of his propertyempire.Overall, the US president-elect hasshown a positive approach to Indiaand let us hope he will continue tobuild on the improved relationshippromoted by two successivepresidents before him.

good night's sleep, it can save
When Somesh Mahajan got his sleep test done recently , it was found that the 62-year-old's blood oxygen levels went as low as 50% in sleep and he paused breathing as many as 70 times in an hour.

Tossing and turning? Get a
good night's sleep, it can save
For a healthy person, say doctors, blood oxygen levels should be in the range of 95100%, with a further variation of five percentage points being acceptable. Mahajan, diagnosed with obstructive sleep apnea, says: "I was so close to death on so many occasions. My heart could have stopped working. The brain cells could have died due to lack of
oxygen."Mahajan should count himself lucky . Sleep experts say more than 80% of people suffering
from this condition remain unaware of it and can face sudden death due to, say , a stroke. "Ten years ago, we tested 200 people per year (approx.) for sleep disorders. Now, the number has
gone up to 800-900.But there are many more who need to get this test done," says
Dr Sanjay Manchanda of Sir Ganga Ram Hospital. Manchanda is one of the pioneers in the field of sleep study in India.Doctors at Safdarjung Hospital and Fortis Escorts Heart Institute, among others, confirm the trend while stressing on the need for more awareness on sleep disorders.Sleep apnea, a disorder where breathing repeatedly stops, is of utmost concern. It puts a person at the risk of heart failure, stroke and road accidents. Here's how it occurs: a person suffering from sleep apnea has a narrowed upper airway . Further relaxation of the airway during sleep causes difficulty in breathing, resulting in a lack of oxygen in blood. So, the brain cells, sleeping till then, wake up and so does the person, briefly . The narrowing of the upper airway thus relaxes
and heshe starts breathing again. When the process is repeated time and
again, the circuit is called obstructive sleep apnea.According to Dr Arup Basu, senior chest physician at SGRH, small breathing pauses up to five times is normal; 5-10 times is borderline; if it h a p p e n s 1 0 - 3 0 times, the person could be suffering f r o m m i l d t o moderate sleep apnea. Anything above 30 times is symptomatic o f s e v e r e s l e e p apnea."Mild s leep apnea is not much of a problem. It can be corrected with lifestyle changes, such as weight reduction and avoiding alcohol. But those suffering from moderate and severe sleep apnea need to be put on CPAP or BiPAP ," says Basu.CPAP stands for continuous positive airway pressure. It releases compressed
air through a hose that is connected to the nose mask to keep the upp er airway open. BiPAP refers to bilevel or two-level positive airway pressure -when the patient inhales and exhales.
"Sleep apnea is the second most common cause of accidental death after alcohol in the UK. In India, we don't have detailed studies on the subject," says a doctor. He adds that in the long term, sleep disorders can lead to high blood pressure and stroke, particularly during winter. "When the oxygen levels are very low, the heart rate gets slower too. People die in their sleep," says Dr Manvir Bhatia, a senior neurologist and sleep specialist. In the US, Federal regulators have sought compulsory testing for sleep apnea of all passenger train operators after the engineer in September's deadly New Jersey commuter train crash was found to have the fatigue-inducing disorder. One woman was killed and more than 100 people were injured when a New Jersey Transit train slammed into Hoboken Terminal at double the 10 mph speed limit on September 29.Sleep apnea is more common among adults, particularly those who are obese or alcoholic. But sleep deprivation is another common disorders spreading like an
epidemic among the young.Dr Manjari Tripathi, pro fessor of neurology at AIIMS, blames lifestyle changes for the malaise. "Teenagers spend much of their sleeping time surfing websites or chatting with friends over phone. Young professionals often sneak out to party post-work, sacrificing their sleep. This leads to insomnia. We are seeing a significant increase in patients suffering from neurological symptoms on account of it," she says.
While Mumbaikars have yet not embraced winter, unlike the cities in the north, according to several fitness enthusiasts in the city who regularly step out for their early morning walk or run, it is increasingly getting difficult to brave the chill in the air. Shailesh Mhatre, a regular at a local park in the central suburbs says that even at 6-6.30 in the morning, it's quite dark and windy. He says, "The BMC owned park near my house usually opens up at six, but from November, the guard comes to open the gate at seven after there's sunlight. One can see people wearing soft woollens and caps
Winter-proof
while walking or jogging.""I have already starting dreading about waking up at 5.30 am and stepping out for a half-an-hour run. I not only feel the slight nip in the air, but the otherwise cold wind makes it difficult for me to run," says Shaunak Chakraborty, advertising professional. He adds, "Since I have a hectic schedule, I get back home at 10.30 at night and by then I am too tired to step out of the house. That's why the only time I get to exercise is early in the morning."So, if you are on the same boat, we suggest these
few exercises that you can do within the comfort of your home or in the park.Spiderman pushupsStart in a pushup position and then lower yourself. Pull one knee towards the same side elbow. As you rise, bring your leg back. Repeat on the other side and continue altering. Rest for 30 seconds and repeat.Siff squatStand shoulder-width apart with your feet slightly turned out. Get on your heels and stay put. Squat down and then sitting back spread your knees apart. Once you descend repeat position.Feet elevated pike pushupsFitness professional Asif Zaid says, "Get into a pike position and stretch your arms and legs straight. Keep your hips high in the air — with your feet on a bench or a small box. Slowly lower yourself and drive back up. Take rest for 60 seconds, and do this exercise in sets of four."Spot joggingStand with your feet together and slowly raise your heel to stretch your legs. Standing at one position, you can start jogging. Make sure that you do not move your body. You can simultaneously also stretch your arms or do some hand exercises while spot jogging. Take rest for 30 seconds and repeat four times. In case you start feeling a slight pain on your calf, bend your knees and rotate till the pain goes away.Wide grip pull-upsHang from a pull bar with an overhand grip, hands wider than shoulder-width apart. Squeeze your shoulder blades together and pull yourself up until your chin is over the bar. Take rest for 90 seconds and then repeat this exercise in sets of five.Fitness gear that you should invest inThink nylon, not cottonStart with a base layer top made of a sweat-wicking fabric. Steer clear of cotton, which traps moisture and draws heat away from your body. Running tights will usually keep your legs warm. Add a wind-proof breathable zippered jacket (think nylon). If you are planning to run very early in the morning, make sure you wear reflective clothes. Investing in ear caps is also a great idea. It helps keep cold wind at bay.Keep your slide slip-freeThe most important thing is to invest in shoes that will give you a firm grip and will also make running easier during this season, especially if you are running in a park or on grass. The dewdrops can make your run slippery, eventually leading to a fall. There are many shoes which are especially crafted for this season.

Psychotherapy works
If you have been trying to get over your fear of crowds or public spaces through exposure to them, try wading in early in the morning because that is when the level of cortisol, the stress hormone which helps the mind develop new reactions to fear triggers, is highest. To test this idea, researchers recruited 24 people with fear of crowds or public spaces. The participants met with therapists for 'exposure therapy' once a week for three weeks, in sessions staggered by time. In each session, they spent at least half an hour in a new setting -- public
best early in the
Morningt r a n s p o r t a t i o n , c r o w d e d supermarket or movie theatre -- and remained there until it began to feel less threatening. Before and after each meeting, the researchers gave patients surveys to assess their symptoms, and also took saliva samples to measure cortisol levels.Sure enough, the morning sessions were the ones where patients made the biggest gains. When they met with their therapists in the morning, patients reported feeling less panic and more control over their anxiety at the following meeting, compared with when they had their therapy in the afternoon. It seems a simple scheduling tweak could make mental health treatment more effective.

bridging the gap between

76 BN CRPF 0rganizes 2nd
friendly volleyball tournamentCK Vineeth has fired Kerala
Blasters’ campaign in the
Hero Indian Super League
with five goals in just six
matches, taking them
from bottom to second
behind Mumbai City
FC.
It's been a dream run
for you in the ISL
with five goals
and three
assists in six
games. Did
you expect
such a start
for you this season?
Honestly, I didn’t. I came
here to help the team make
it to the semi-finals and I
really didn’t believe I could
do something like this.
You joined Blasters from
Bengaluru FC after the
eighth game. How difficult
was it for you to adjust to
the team's requirements?
I knew it would be difficult
to adjust but everyone was
helpful and made me
comfortable. The (late) goal
against FC Goa, which
turned out to be the match
winner, helped boost my
confidence.
With such a rich vein of
form, are you playing your
best football?
Right now I am not playing
well.
Will the goals be enough for
you to get a National call-
up?
I don’t know. I am not
thinking about all that and
focusing only on the game.
I think if I continue to play
well, they will call me
definitely.
Is there added pressure on
Kerala Blasters to atleast
make it to the final because
Kochi will be hosting the
League’s final?
It goes without saying that
we need to win the ISL for
our fans because they are
the best. We must deliver
that trophy to our fans.
How much does the crowd
support play a role in
Kerala's home games?
I cannot express (in
words) how we feel
when we play in front
of this amazing
Kerala crowd.
They are
truly
amazing;
we can’t
even hear
what the players say on the
field, or when the referee
has blown the whistle.
Before the last League
game, you were fighting
tears while talking about the
fan support.
Did that emotional aspect
help you put that extra
effort?
It’s always like that. This is
my home crowd and the
best in the ISL. Not just me,
everybody thinks that. I
have always wanted to play
in front of my home fans
and I feel happy to play
here.
How is Steve Coppell as
coach? He seems to have
given you a free role to
express yourself on the
pitch.
He is the coolest coach I
have worked with. Coolest
means, he doesn’t get angry
or doesn’t say anything in
anger.
Even when we come back
to dressing room for half
time, he never loses his cool
and asks us to look forward
to the next 45 minutes. He
reminds us that fans are
watching all of us, so we
must show them all that we
have. In my time at Kerala
Blasters, I never saw him
angry. I don’t know if he is
always like that!
I am getting the goals but
not at my best yet: Vineeth
THE CHIEF Executive
Officer (CEO) of the Board
of Control for Cricket in
India (BCCI), Rahul Johri,
wanted Italian-tailored suits,
costing Rs 2.5 lakh each, for
the Men in Blue. But the
board shot down the
proposal. Besides the
reluctance of the board’s old
guard, who saw it as an
extravagance, the keen eye
of the courts on BCCI’s
spending is also seen as a
reason for the cricketers
being denied the stylised
formal attire, tailored by a
brand of international repute.
Johri floated the idea of
getting 50 new suits, for the
cricketers as well as BCCI’s
top executives, in an email to
BCCI president Anurag
Thakur, secretary Ajay
Shirke and other staff
members on November 19.
“The Indian team is in a
serious need of new sets of
formal attire. The cost per set
will be approximately Rs 2.5
lakh. And we intend to order
50 sets. Request your go-
ahead,” he wrote.
Following a Supreme Court
order, the BCCI cannot take
any decisions until the board
and state associations accept
the Lodha Committee’s
recommendations. BCCI
secretary Shirke, who
consulted board legal
counsel Abhinav Mukherjee,
pointed this out. “Am afraid
we cannot enter into any new
agreement or contract as per
the Supreme Court order,”
he said in his reply.
Mukherjee, in his mail, said
the Lodha Committee should
be consulted. “I suggest that
this issue needs to be
verified with the Lodha
Committee.
The committee, in its report,
stated that the vendor should
be appointed through a
tender process. But it seems
this is done by a private
negotiation. Ideally, we
should refer this to the
committee,” he wrote.
But BCCI president Thakur
quickly intervened to say
there was no need to consult
the Lodha Committee.
“We are not going ahead
with this,” he said in his
reply.
The CEO’s proposal has not
gone down well with the
board’s old guard, who have
opposed “corporate culture”.
“There is a big difference
between corporate culture
and BCCI culture.
The Indian Express tried to
get in touch with Shirke, but
he was not available for
comment.

the investors have bought the team
considering the risk factors involved
and with a desire to raise the standards
of the sport in India.

New Delhi: Tata Sons

once again. He said
conferment of all decision-
making power in one man
or a "high command" is
unethical, improper and
breach of trust.
Mistry, in his
representation to
shareholders contesting his
removal as the director of

said future of the Tata
Group lies in how the
trustees govern the Tata
Trusts.
He further said: "It is
critical that serious
decisions of severe
magnitude and
consequence are not taken
whimsically, without much
thought, or for unstated
collateral objectives. It is
necessary to have a strong
method of checks and
balances in the trustees'

personal benefits."
He also alleged that Ratan

states as well as the Indiahead of Boston ConsultingGroup met for the first timelast week.As startups like Paytm,MobiKwik and Freechargepush their digital wallets to aslice of smartphone users, thecommittee is focusing on twokey avenues: getting moremerchants to accept theUnited Payments Interfaceand procuring more point-of-sale devices.Rural Impact: India has alsomade it easier to make digital
payments, with the centralbank this week doing awaywith the two-stepauthentication process fortransactions of less than 2,000rupees. The impact of themoney ban, known asdemonetization, has been feltthe most in the countryside, where cash is preferred foreverything from buyingclothes and selling produce topaying for weddings. The lackof cash notes has slammed thebrakes on business in someareas.Adapting Technology: Thecommittee is expected to meetagain this week to look at howto approach those with limitedaccess to technology. WhileIndia has 250 millionsmartphone users, there are
about 350 million who onlyhave feature phones whileanother 350 million don't havea phone at all, Nilekani said. For feature phone users, thecommittee recommendsIndia's existing retail e-payments app be adapted totechnology that could berolled out within weeks. Thatwill be helped by lowercharges, with thetelecommunications regulatorslashing the charges fortransactions from 1.50 rupeesto 0.50 rupees."Each category has to have adifferent strategy" saidNilekani.'Big Target': Beforedemonetization, digitalpayments had already beenprojected to surge. Googleand Boston Consulting Groupprojected India's digitalpayments industry to grow to$500 billion and cover halfthe population only by 2020.A financial inclusion panelhosted earlier this year by thecountry's software productsthink tank, iSpirt laid out afour-year plan to go cashless. The real challenge is the 350million people withoutphones, many of whom areeconomically-challenged. Theplan is to draw those enrolledin Aadhaar, and quickly enlistthe remaining, towardmicroATMs promoted bylarge Indian lenders such asIDFC Bank and startups likeNovopay which already havea presence in 130,000 villageretail outlets or kirana stores."There is a sense of urgency,"said Nilekani. "All thestrategies have to be deployedat the same time to aim foruniversal coverage."

In a sharp attack onPakistan, the US todayasserted that the countryneeds to make a "historicshift" to stop providing safehavens to terrorists whodestabilise Afghanistan, threaten American soldiersand target India.US Defence SecretaryAshton Carter said it isimportant that Pakistan doesnot continue to offer or pro-vide a place for those whodestabilise Afghanistan, those who threatenAmerican service membersin Afghanistan and other
coalition servicemembers or thosewho support terror-ist groups, includ-ing those that targetIndia."It is important thatPakistan recognis-es, as we've all saidto them -- I havesaid to their leadersfor some time nowthat kind of terror-
ism poses a principal strate-gic danger to the Pakistanistate," Carter told reporterstravelling with him to NewDelhi from Japan."That's an historic shift. Itwould require a historic shiftin their focus. I hope they'remaking that focus overtime," he said.Striking a similar tone, theUS State Department said ithas voiced concern to thePakistani leadership over thecountry's tolerance of terrorsafe havens for AfghanTaliban groups like thedreaded Haqqani Network."We have consistentlyexpressed our concerns to
the highest levels ofGovernment of Pakistanabout their continued toler-ance for Afghan Talibangroups such as the HaqqaniNetwork operating fromPakistan soil," StateDepartment DeputySpokesperson Mark Tonertold reporters."We continue to encouragethe Government of Pakistanand Afghanistan, rather --both governments to cooper-ate in their counter-terrorismoperations and effortsbecause that's only going tocontribute to regional stabil-ity," Toner said in responseto a question.Toner's remarks came daysafter India and Afghanistanhit out at an isolated
Pakistan at the Heart of Asiaconference for sponsoringand supporting terrorism andcalled for "resolute action"against terrorists as well astheir masters.Short of naming Pakistan,Prime Minister NarendraModi, in his inauguraladdress at the Heart of Asiameet had said, "The growingarc of terrorist violenceendangers our entire region. As such, support for voicesof peace in Afghanistanalone is not enough."Afghan President AshrafGhani had accused Pakistanof launching an "undeclaredwar" against his country bycovertly supporting terrornetworks including theTaliban. —PTI

Striking a conciliatory noteamid rising tension in ties,Pakistan on Thursday said itdoes not want to live in "per-petual hostility" with India, noting time has come for thetwo neighbours to decidewhether status quo shouldcontinue or a new beginningbe made.Calling for an "uninterruptedand uninterruptable" bilater-al engagement, PakistanHigh Commissioner AbdulBasit said the two countries
must overcome the differ-ences in order to embark onan "irreversible trajectory"of cooperative relationship.Maintaining that Pakistanwas ready for comprehen-sive talks with India, Basit, however, said the desire forengagement was missingfrom the Indian side, addinghis government has patienceand was ready to wait forresumption of dialogue.“I think we have wasted 70years of our existence. Timehas now come to make upour mind on what do wewant. Whether we wouldlike to continue with the sta-tus quo or we want to makea new beginning in our ties,"Basit said. His comments at a discus-sion on Indo-Pak relationscame amid escalating ten-sion between the two coun-tries over a number of cross-border terror attacks, includ-ing at army establishmentsin Uri and Nagrota, andIndia's surgical strikes across
the LoC in September.‘It takes two to tango’"Pakistan does not wish tolive in perpetual hostilitywith India. We remain posi-tive and constructive but ittakes two to tango. There areserious problems betweenthe two countries. We cannotshy away from them but atthe end of the day we canengage in purposeful diplo-macy, we can realise resultsfor mutual satisfaction andmake a good beginning," hesaid. At the same time, he said, for Pakistan Jammu andKashmir was the core issuebetween the two countriesand finding a solution to itcould bridge the trust deficitthem."We need to move from con-flict management to conflictresolution and that obviouslycannot happen unless wetalk to each other with sin-cereity and seriousness ofpurpose," Basit said. Holding that talks may bring
down tension, Basit saidIslamabad was "positive andconstructive" in its attitude, adding the engagementshould be meaningful andaddress the core issue ofJammu and Kashmir."Whenever there is anydesire in New Delhi toengage with us, Pakistanwould respond positivelyand constructively providedthe engagement is meaning-ful and does address the coreissue of Jammu andKashmir," he said, pitchingfor diplomacy to be given a"fair chance" to deliver."The developments sinceJuly in Jammu and Kashmiryet again very clearly showthat Jammu and Kashmir isthe main issue. Islamabad'sfeeling is that unless wemove towards finding a justand fair solution to this prob-lem, it will continue to bevery difficult to bridge thetrust deficit between the twocountries."It is in our mutual interest
to have peace and also in theinterest of the region. Wehave seen what happened toSAARC summit. It couldnot take place primarilybecause of the differencesbetween the two countries,"he said.In this context, he saidPakistan was ready to movetowards projects relating toregional connectivity andintegration.Basit also rejected observa-tions at the deliberations, attended by top diplomats, representatives from Jammuand Kashmir and foreignpolicy experts, that Pakistanmay be "balkanised"."I think Pakistan has a very, very bright future. It is avery confident country. Weare moving ahead. People ofPakistan are very confident. We are destined to become aregional economic hub. Wedo not have any doubt aboutour future. Pakistan is notgoing to be balkanised," hesaid.

The World Bank has can-celled a loan of $100 milliondollars to Pakistan sanc-tioned for improving supplyof natural gas to parts of thecountry. The project — entrusted toSui Southern Gas Company(SSGC) in its distributionareas in Karachi, interiorSindh and Balochistan —was to increase supply ofnatural gas by reducingphysical and commerciallosses of gas in the pipelinesystem.A World Bank report saidthe project levels of unac-counted-for gas (UFG)remained high while thenatural resource continuedto be drained, Dawn report-ed.Illegal connections, one ofthe drivers of UFG, wereincreasing at a rate fasterthan the countervailingreduction of technical loss-es.Justifying its rating of"unsatisfactory", the WorldBank report said it shouldhave exercised caution andnot proceeded with a projectthat did not receive sus-tained interest from theboard and management ofSSGC, which had insuffi-cient ownership in the proj-ect.
Against the original com-mitment of $200m, the bankhad disbursed only $0.25m.The ministry of petroleumand natural gas was keen onreducing of UFG, which wason the rise at the time of theproject preparation andincreased further during theproject implementationphase.Oil and Gas RegulatoryAuthority (Ogra) hadimposed a penalty on gascompanies for UFG beyondthe benchmark of 4.5 percent.Bureaucratic processeswithin SSGC also con-tributed to procurementdelays and bid expiration. The SSGC managementattributed the failure of theproject to the procurementprocess. Most of UFG comes fromdilapidated or deterioratingpipelines, leaking joints, gastheft in the form of tam-pered-with metres, illegalconnections and malfunc-tioning metering equipment. The World Bank undertooka strategic review of theproject, which identifiedstrong implementation chal-lenges with no progresstowards achieving thedevelopment objectives ofthe project as well as no dis-bursement against project-related activities. — PTI
