Tainted J&K cop claimsthreat to lifeSRINAGAR: Tainted Jammu andKashmir police officer Davinder Singhand four others, including two Hizb-ul-Mujahideen (HM) militants, and theirtwo alleged “over-ground workers”were on Friday sent to 15-day judicialcustody by a special NationalInvestigation Agency (NIA) court inJammu. Two surveys, one released onWednesday and another earlier onMonday, clearly suggest that theAAP will not be able to retain all 67seats it won in the 2015 elections,but will be able to form the govern-ment on its own. They give 10 to 14seats to the BJP. But home ministerAmit Shah has claimed his partywill be winning more than 45 seats.The saffron party won in just threeconstituencies in 2015, where theCongress couldn’t retain one seat.

According to the ABP News-CVoter survey, Arvind Kejriwal’sAAP is predicted to win 42 to 56seats. The IPSOS-Times Now sur-vey, based on a sample size of 7,321voters, says the AAP is likely to getanything between 54 and 60 seats,the BJP 10 to 14 seats, while theCongress may draw a blank or win,at best, two seats. Tight securitymeasures have been put in placeacross the city, especially sensitiveareas like Shaheen Bagh, for peace-ful polling in which Delhi’s 1.47crore voters will decide whetherMr Kejriwal gets another term aschief minister for the developmentwork done and promised, or theBJP, which campaigned aggressive-ly on the “anti-Shaheen Bagh” na-

cant as they will also set the stagefor elections in six states in the next18 months — Bihar in the secondhalf of this year, and Kerala, TamilNadu, Puducherry, West Bengaland Assam in 2021. These polls arean acid test for the BJP which in therecent past lost elections in Jhark-hand and was unable to form thegovernment in Maharashtra after itsally Shiv Sena joined hands withthe Congress and NCP. In Haryana,the party could form governmentonly after taking the support ofDushyant Chautala’s JJP.

For Mr Kejriwal, these polls arenot only a test of his credentials asthe head of a city government, butalso important for the political fu-ture of the AAP, whose votesharedropped from 54 per cent in 2015Assembly polls to just 18 per centin last year’s Lok Sabha polls. TheAAP, which swept the 2015 Assem-bly polls, lost all three municipalbodies in the city to the BJP in2017, in which it got just 26 percent votes, about 10 per cent lessthan the saffron party. This time, the

AAP is again facing a tough contestfrom the BJP in 10 seats which ithad won by a margin of less than 10per cent votes in the earlier polls. Ofthese seats, the victory margin ofthe AAP was even less than five percent in Shakurbasti, Najafgarh,Lakshmi Nagar and Krishna Nagar.The party, however, seems to behaving a clear edge over the BJP inall the 12 reserved seats it had wonin the previous polls. The 2020election also poses a big challengefor the Congress, which could notwin even a single seat in the last As-sembly elections. The party camesecond only in Badli, Mangolpuri,Matia Mahal and Mustafabad. Butthe grand old party surprised oneand all by securing four per centvotes more than the AAP across theseven seats in the last Lok Sabhaelections.

Both the AAP and the BJP hadbeen trying hard to seek support ofPurvanchali voters — migrantsfrom eastern Uttar Pradesh, Biharand Jharkhand — who compriseabout 30 per cent of the total elec-torate. The AAP has even gone tothe extent of promising to get Bho-jpuri included in the Eighth Sched-ule of the Constitution.

The BJP, which has kept its 32-plus per cent voteshare since 1993,has been focusing more on its tradi-tional voters from upper caste Hin-dus, who account for 40 per cent ofthe electorate — 12 per cent Brah-mins, seven per cent of PunjabiKhatris and Rajputs, six per centeach of Jains and Baniyas and eightper cent of the rest. Punjabi voters,who make up around 25 per cent ofthe electorate, can influence theelection outcome in 20-odd seats.

SDM AnilSabkale was found to be in cahootswith director of Shri Krishna UniversityPushpendra Singh Gautam, who didnot want another private university tocome up in the area, the police said.Abhay Singh Bhadoria had purchasedland for setting up his KhajurahoUniversity in the district. Gautam, withSabkale's help, got the land declaredas government property and filed acase against Bhadoria, said ChattarpurSuperintendent of Police (SP) TilakSingh. The case was to come up forhearing on February 5, and Bhadoriawas expected to file an application foranticipatory bail, the official said.To establish that Bhadoria was adangerous character and should notbe granted pre-arrest bail, Sabkaleallegedly conspired with Gautam andhad his own office attacked.The SDM then lodged a complaintagainst unidentified miscreants, SPSingh said. The police, while trackingcall records of suspects, realised thatGautam and Sabkale were in touchwith each other before and after theattack. Based on Call Detail Records,the police zeroed in on Gautam,Sabkale and the BJP's minority cellleader Javed Akthar, the official said.It was Akthar who allegedly arrangedgoons for the attack, he said.The SDM tried to establish in the courtthat Bhadoria and others were behindthe attack on his office as he hadlaunched a drive against land mafia.The court, however, granted pre-arrestbail to Bhadoria. in accordance with its people’s willthat has priceless sacrifices at itsback.” It added that this would be the“best way” to pay tribute to “our mar-tyrs” including Guru and Bhat.

The separatist parties and theirleaders, including the Mirwaiz, choseto maintain a complete silence on thegovernment’s August 5, 2019 movesand related developments. In the past,both he and separatist patriarch SyedAli Shah Geelani would almost ondaily basis make statements on vari-ous issues including ‘sanctity’ of Ar-ticles 370 and 35A of the Constitutioneven when under house arrest.

But post August 5 last year, theyhave been conspicuous by their re-maining quiet on the vital issue.

Prior to Friday’s statement fromthe Mirwaiz-led Hurriyat Conference,

the only statement that was issued onhis behalf during past six months wasto deny media reports that he hadsigned a bond stating that he wouldnot indulge in any political activityover the issue to secure his release af-ter being detained by the police on theday when Parliament approved theresolution abrogating special status toJ&K under Article 370 and a bill forsplitting the State into two UTs.

However, his aide Syed-ur-Rehman Shams was quick to deny itand while quoting the politician-cler-ic, he had said that the Hurriyat Con-ference faction headed by him (Mir-waiz) “stands firm by its principledstand on the issue of Jammu andKashmir and stands by the people inthis unprecedented situation that allare facing”. He had claimed that “allthe means and avenues to communi-cate with the people have beensnatched” from the Mirwaiz and,therefore, he was unable to communi-cate with the outside world.

Nevertheless, the separatist lead-ers’maintaining silence flabbergastedtheir many supporters and even com-mon Kashmiri. Are symbols eternal? Emblems defy time because theyrepresent ideas, and ideas, history has shown, can en-dure in spite of such adversaries as time and tyrants. In-

deed, the march of human civilization has been predicated onthe timelessness of all that is represented by ideas. The discus-sion on the deathlessness of ideas and, consequently, symbol-ism has been invigorated in present-day India, which has beena witness to spontaneous public protests across large swathesof the country against the Citizenship (Amendment) Act, whichhas sought to, in violation of constitutional imperatives, grantselective citizenship to specific constituencies on the basis ofreligious identity. Most of these demonstrations have beenmarked by the joyous display of symbols that are, in fact, codesfor India’s pluralist ethic. Thus, the Tricolour, has been om-nipresent at these sites of protest against a legislation thatthreatens the inclusive fabric of India. The national flag is,however, only one element in this inventory of bona fide na-tionalism. Texts signifying the original idea of the republic —the Constitution and its Preamble — and songs and poetry richin pluralist symbolism — Rabindranath Tagore’s “Jana GanaMana”, a shorter version of which is India’s national anthem,Muhammad Iqbal’s “Saare Jahan se Achha”, the verses of FaizAhmed Faiz’s “Hum Dekhenge” — have lent to this collectivecondemnation of a discriminatory law a degree of poignancyas well as potency.

The public invocation of the content of ideas is of immenseimportance. This is because while it is true that ideas are im-mortal, they are particularly vulnerable to erosion. In otherwords, ideas and symbols can be corrupted in the hands ofregimes and New India, being built one brick at a time by theBharatiya Janata Party, bears ample evidence of such a trans-gression. T.M. Krishna, an exponent of classical music, said recent-ly that there is an urgent need to “recapture” the national an-them. The wisdom of this observation cannot be dismissed. Asingular threat to the Idea of India is the the inversion of theidea itself at the hands of a vigorous, majoritarian force. Eventhe sanctity of the Constitution has been brought under a cloud.Shrill nationalism has succeeded — almost — in hammeringthe old, humane republic out of shape. The fightback againstthis manipulation must use ideas as weapons. But for that totake place, ideas and emblems advocating the republic’s origi-nal charter must be nursed back to health. Their healing wouldenable India to rid itself of the toxin of sectarianism.

Desperation begets desper-ation. Some of the reaction thatthis rather desperate-lookingattempt at masterminding along-distance flight for MsMaryam Nawaz is reflective ofthe disastrous mindset in thePTI camp right now. One quotefrom a more vocal ministerfrom the same story would suf-fice.

The worthy minister saysthat allowing Ms Maryam toleave at this stage would be likestriking the last nail in the PTI’s

accountability pledge. It could-n’t have been more damningthan this.

It would seem that a largenumber of people had long gotthe drift. In various commen-taries, it has been discussedhow the government would befar better off dispatching thewhole Sharif clan across thefence. The absence, it is sub-mitted with a lot of reliance oncommon sense, would help thegovernment claim there was adeal behind this escape by theformer ruling family.

The removal of as manySharifs as possible, the pointgoes, would free the ImranKhan government to concen-trate on development. The intended alarm in thelatest statement by Mian Shah-baz Sharif signifies the begin-ning of another, stronger pushby the PML-N to carry MsMaryam Nawaz across the line.In the hours and days to come,the thrust is likely to intensify.More reports of a long silentMian Sahib stubbornly shakinghis head in rejection to all try-ing to persuade him to undergoa cardiac procedure we are toldhe ought to have undergone along time ago, could increasepressure on the accountability-obsessed government.

Indeed the governmentmay be too single-minded. Thiscould spark some very tensemoments in the emotionallycharged Pakistani politics. Ifthe past is any guide, a growing

number of commentators maybe swayed by the human sideof it to call upon Prime Minis-ter Imran Khan to make this de-parture.

If you still had any doubtsthat the “queer move-ment” in India is a right-

wing, neoliberal, hellish ag-glomeration, the events of thelast few days should have set-tled them.

First, there was the sin-gling out of protesters whoexercised the democraticright to protest against CAA-NPR-NRC as part of BombayPride. And they were singledout and reported by membersof the “queer community”.Ashok Row Kavi, well-known, rabid, right-wingamma of the LGBTs, reducedthem to “Left-Islamist non-sense” and claimed that theircolleges were easy to “comband search”.

Several queers took to thesocial media to condemn theprotesters and claim “queer”space and Pride March spaceas apolitical. The organisingbody of the march distancedthemselves from the protest-ers, condemning pro-Sharjeelslogans as harming the “in-tegrity of India”, even as theyclaimed allegiance to theConstitution and law, both ofwhich they clearly knownothing about.

Kris Chudawala, a transstudent from TISS who exer-cised a democratic right is injail under sedition chargesand was denied anticipatorybail (along with 50 others).This for raising a slogan in a

protest march and reading thePreamble of the Constitution.The “queer community” isdelighted with this arrest.They had written to the Mum-bai police asking for the ar-rests.

These queers embrace thestate and are bending overbackward to kick their own tothe kerb. These Pride archesare about apolitical frolic andparties at five-star hotels later.

If “queer” lost its politicaledge long ago in the US (onceit was co-opted by US acade-mia), its circulation across theworld through the globals-peak of NGOised sexual gov-ernance had little more thanan assimilationist and inclu-sivist rhetoric going for it. Buteven that is gone from thenew (or were they alwaysthat, but it is only now thattheir fangs are bared?), right-wing Hindu-fundamentalistqueers who are now decidingwhich queers get to be Indianand which don’t.

As a child magician, shereceived several awards forher talent. Years later, sheintroduced the concept ofmentalism, a concept ofhuman psychology that isalso considered as magic.While the subject has beenunderstood mostly withskepticism and mystery, DrParekh clears the air.

“Mentalists are peoplewith highly intuitive powersand an ability to understandthe nuances of human mind.

While many think that weperform tricks, it is mostlyabout understanding theindividual’s psyche andresponding through ourmental bond,” she said.During a workshop organisedby FICCI FLO, she madepeople aware of her work.

An engineering graduate,Kruti’s first-ever mentalismproject was her mother. “She

never sat and thought in frontof me after our experience,”she joked. “But mentalism isused for therapeutic process,mostly with mental healthpatients. So, it is not aboutmagic or any othersupernatural element, but amind control tool that is usedto help people,” she said.Most of her patients varyfrom children to elderlypeople. “Around 60% ofpeople today are sufferingfrom depression and are notaware about it. Through ourtechniques we understandtheir problem and help findsolutions through mind tricksand activities.”

She has held lectures andworkshops across the globeand said more professionalsin the field was the need of

the hour. “There are nolimitations to what you cando except the limitations ofyour mind,” she said.

Apart from her session,Dr Vinod Hasal, who hasinnovated the concept of de-stressing by opening a chainof Drum Cafés across theworld, also conducted aworkshop. He was addressingthe ‘3rd International Conference onArbitration in the Era ofGlobalisation”. The CJI said judgesaimed to resolve a dispute butdissatisfaction resulted in ahierarchy of appeals.Unenforceability of an agreementarrived at a mediation will ensureefficiency and also reduce the timependency for parties as well ascourts. “Judging can be a difficulttask and judges do what everybodyavoids doing, i.e take decisions.Popularity is a mirage for judges.The idea is to resolve a dispute. Butdissatisfaction with the outcomeresults in a hierarchy of appealswhich cannot be avoided.”Highlighting the importance ofalternative dispute resolution, hesaid the judiciary had no controlover it and it should not interferewith awards given by arbitrators.The CJI mooted the idea of acomprehensive law for “compulsorypre-litigation mediation” to ensureefficiency and reduce pendency. Hesaid a robust “arbitration bar” wascritical to developing institutional

arbitration in India as it wouldensure availability and accessibilityof practitioners with knowledge andexperience. “The pre-institutionmediation and settlement asmentioned in the CommercialCourts Act would pave the way formany more institutions to emphasiseon the need for pre-litigationmediation, considering its verymany benefits. I think the time isripe to devise a comprehensivelegislation which containscompulsory pre-litigation mediationand a remedy for the biggestdrawback in a mediation agreement,that is to say the unenforceability ofan agreement arrived at a mediationwould ensure efficiency."Maintaining that arbitration playedan essential role in globalinfrastructure of international trade,commerce and investment, he saidas an integral member of the globalcommunity and a trading andinvestment giant, how India engageswith international arbitration.

The West Bengal Crime In-vestigation Departmentgrilled Bharatiya Janata PartyLok Sabha Member of Parlia-ment from Ranaghat con-stituency Jagannath Sarkar inconnection with its ongoinginvestigation into the killingof Trinamool Congress Mem-ber of Legislative AssemblySatyajit Biswas, sources said.

The BJP leader wasgrilled for nearly four hourson Saturday at Bhabani Bha-ban, the CID headquarters inthe city, they said. In January,a Division Bench of the Cal-cutta High Court grantedSarkar an interim protectionfrom arrest till February 28.The high court, however,while hearing his anticipatorybail plea, directed Sarkar tocooperate with the CID in its

probe into the murder ofBiswas. Satyajit Biswas, whowas a TMC MLA from Krish-naganj Assembly Constituen-cy in West Bengal’s Nadiadistrict, was shot dead duringa cultural programme there inFebruary last year.

The family members ofBiswas had lodged complaintagainst 43 people includingBJP leaders Mukul Roy andJagannath Sarkar.

Seven firemen injured in blazeat Navi Mumbai high-rise

Seven firemen were injured during afirefighting operation after a majorblaze broke out in a 21- storeyresidential building in Navi Mumbai onSaturday morning, officials said.

The fire, which was triggered by anexplosion of a gas cylinder, broke out ina duplex flat located on the top twofloors of Sea Home Apartment inSeawoods near Palm Beach Road, theofficials said.

All the seven injured were admittedto the National Burns Centre (NBC) inAiroli, where three of them are in theintensive care unit (ICU), they added.

“A cylinder blast in the duplex flat,spread over the top two floors, triggeredthe fire around 6.30 am,” chief of theNavi Mumbai Disaster Control Room,Dadasaheb Chabukswar, said.

According to Santosh Kadam, headof the Regional Disaster ManagementCell (RDMC) of Thane MunicipalCorporation (TMC), six fire enginesfrom Nerul, CBD Belapur and Vashifire stations were sent to the site tocontrol the fire.

“At least seven firemen wereinjured during the firefightingoperation. They were admitted to theNBC in Airoli. Three of them are in ICUas their injuries are serious,”Chabukswar said.

The fire has been doused andcooling operation is underway, he said.

The injured were identified asstation officer V D Koli (50), assistantstation officer J P Gade (40) (both fromNerul Fire Station) and five firemen- JB Bhoye (40), D N Jawale (43), S LJoshi (43), M T Pawar (40) and B AThakrey (39)- belonging to different firestations, Chabukswar added.

The records of nearly half a million payment cardsof Indian banks are being sold for $9 apiece on theJoker’s Stash, one of the most popularunderground card shops, Singapore-basedcybersecurity company Group-IB has warned. Thecompany detected a database containing over4,60,000 payment card records uploaded to one of

the most populardarknet card shops onFebruary 5. Over 98 percent of the records werefrom the biggest Indianbanks, Group-IB said onFriday. This is thesecond major upload of

payment records related to Indian cardholdersregistered by Group-IB in the past several months.The underground market value of the database isestimated at more than $4.2 million. The source ofthis batch currently remains unknown, the firmsaid, adding that it immediately informed theIndian Computer Emergency Response Team. Thedatabase exposed card numbers, expiration dates,CVV/CVC codes, cardholders’ name, emails,phone numbers and addresses.

DC inspects warehouseof EVMs and VVPATs inDlr buildingJALANDHAR: Deputy CommissionerMr Varinder Kumar Sharma on Fridayinspected the warehouse and storageof the Electronic Voting Machines(EVMs) and Voter-Verified Paper AuditTrail (VVPAT) machines. During theinspection of the warehouse andstorage in the Office of the DirectorLand Records in Mithu Basti onJalandhar-Kapurthala road, the DeputyCommissioner said that districtadministration has made foolproofsecurity arrangements of thesemachines here. He also checked thesealing of the warehouse where themachines have been stored besidesrecording of CCTV cameras installedfor surveillance of the machines.Deputy Commissioner said thesecurity cover has been provided bythe personnel of Punjab Police. Hesaid that CCTV cameras have alsobeen installed for the surveillance ofvoting machines. Illegal kiosk set up overnight demolishedAMRITSAR: On the complaint of shopkeepers, the estate wing of the civic body on Saturdaydemolished the kiosk, which was installed by some persons at Pink Plaza outside Hall Gate onFriday night. Sushant Bhatia, MC estate officer, said, “We came to know in the morning thatsome mischievous persons had set up a kiosk on the prime land near Pink Plaza. Our team hadvisited the spot and demolished the kiosk.” According to information, a few illegal kiosks werealready present on the road and there was some space for one kiosk. The encroachers arrangedall material and set up the same overnight. After getting information about it, shopkeeperscomplained to the estate officer and threatened to stage a protest. Seven firemen were injured during a fire-fighting operation after a major blazebroke out in a 21- storey residentialbuilding in Navi Mumbai on Saturdaymorning, officials said.

The fire, which was triggered by anexplosion of a gas cylinder, broke out ina duplex flat located on the top two floorsof Sea Home Apartment in Seawoodsnear Palm Beach Road, the officials said.

All the seven injured were admittedto the National Burns Centre (NBC) inAiroli, where three of them are in the in-tensive care unit (ICU), they added.

“A cylinder blast in the duplex flat,spread over the top two floors, triggeredthe fire around 6.30 am,” chief of theNavi Mumbai Disaster Control Room,Dadasaheb Chabukswar, said.

According to Santosh Kadam, headof the Regional Disaster ManagementCell (RDMC) of Thane Municipal Cor-poration (TMC), six fire engines fromNerul, CBD Belapur and Vashi fire sta-tions were sent to the site to control the

fire.“At least seven firemen were injured

during the firefighting operation. Theywere admitted to the NBC in Airoli.Three of them are in ICU as their injuriesare serious,” Chabukswar said.

The fire has been doused and coolingoperation is underway, he said.

Finance Minister Nirmala Sitharaman onSaturday said her two hour plus budgetspeech days ago was inevitable sinceevery aspect of the economy warranted acareful response and expressed regret forputting people to inconvenience.

The minister, when asked if such alenghty budget speech was warranted -which drove her to a point of exhaustion-something which was not seen in the pastfew decades, said it was needed.

"It was needed. Definitely it wasneeded. I would have completed readingout the remaining portion after drinkingwater," she said addressing a press con-ference.

A Kashmiri verse, quotes from Tamilpoets and references to Saraswati-Sind-hu civilisation peppered Sitharaman's160- minute long marathon budgetspeech on February 1 which got cut shortat the fag end after she felt unwell.

"Sorry. I agree, all of you were put toinconvenience. I don't know if youthought (why) this lady was talking forabout two and a half hours.

But I had things to be spelt out andwe have a duty to implement and we willdo it," she said.

Pointing to elaborate pre-budgetconsultations with stakeholders and ef-forts to fulfill the aspirations of everysector, she said she had a need to speak

for such a duration and it became "in-evitable."

"I did not speak to create any record,but every aspect of the economy war-ranted a careful response and it made thespeech lengthy."

After around 150 minutes, Sithara-man appeared tired and sipped water atleast thrice before cutting short herspeech in Parliament.

In between when a staff memberwent to get a glass of water, Sitharamantook a candy that was offered by Gad-kari.

Incidentally, when she was address-ing the post budget press conferencehere, Secretary, Economic Affairs, AtanuChakraborty, who was seated right nextto the minister, repeatedly dozed off,prompting photo journalists to click pho-tographs. -

While exit polls forecast a comfortable victory for the ruling Aam Aadmi Par-ty, the Bharatiya Janata Party—their main challenger in one of the most acri-monious Delhi elections—has dismissed the predictions outright.

Soon after most of the pollsters, including right-leaning ones, predicted aclear victory for Arvind Kejriwal’s Aam Aadmi Party, BJP’s state presidentManoj Tiwari took to the social media to claim that his party would win 48seats in the 70-member Delhi Assembly.

“All these exit polls will fail on February 11. Please keep my statement asrecord. The BJP will win 48 seats to form the government. Please do not findways to blame the EVMs (when results are declared). We have also done ourexit polls throughout today, kindly do not try to create an atmosphere againstthe EVMs when the BJP wins,” Tiwari said in a tweet.

While his statement led to speculations and conspiracy theories overEVMs—such as possible “tampering”, an allegation BJP’s rivals have fre-quently leveled against the party—if the exit polls are any indication, the mes-sage is clear for the players in the do-or-die elections in which Bharatiya Jana-ta Party’s Amit Shah, the union minister for home affairs, and national presi-dent JP Nadda led the party from the front. It would mean that the electoratehas decided to vote for the development plank and against attempts to po-larise—that employment, amenities, infrastructure, better education, andhealth took precedence over the ‘Hindutva’ pitch.

Such a victory could also be construed as a verdict against the amendedCitizenship Act, and that, while people want Narendra Modi as their PrimeMinister, they also want a strong local leader and prioritise local issues in as-sembly elections.

Ever since Home Minister Shah took charge of the Delhi elections, theBJP used all its ammunition t push for a BJP government in the state—fromShah’s door-to-door campaigns, to a large contingent of MPs and ministershitting the roads to lobby for the party to even “polarising” statements by lead-ers like Anurag Thakur or Parvesh Verma amid anti-CAA protests at ShaheenBagh, the party appears to have used every weapon in its arsenal to fight theruling AAP. But if exit polls are any indication, the BJP needs to review itsstrategy, starting with its lack of strong local leadership and its decision tohead into elections with a chief ministerial candidate.
