9 Whij the voter has niariced the ballot paper lie shall enclose and seal thesame in the envelope sent to him for the purpose and shall sign the counterfoil withhis name in full and shall then place such counterfoil, together with the sealed ballotpaper, in another envelope and forward such envelope to the Chief Inspector ofFactories.

The result of the poll shall be ascertained by a scrutiny of the ballot papeisamid by count of the votes by the Chief Inspector of Factories.

The scrutiny and count of votes shall coinnienee as soon as practicable afterthe closing of the poll b the retiirnmg officer who shall open all envelopes contain-ing ballof papers, count all votes found therein (rejecting all informal ballot papers)and ascertain the determination of the majority of voters from such count ofthe votes.

TIme Chief Inspector of Factories shall notify the Minister of the result ofevery poll taken under these regulations.

THE regulations relating to disputes between Local Authorities concerning tile ques-hon as to tile district in which a license has been wholly, mainly, or substantiallyexercised under the provisions of subsection (2) of section ii of the Traffic Act,1919-1935, 1)ubiished in tile Government Gazette of March 27th, 1936, are herebyrepealed alld the following inserted in lieu tilereof :-Regulations relating to disputes between Local Authorities concerning tile question

Any Local Authority (herehiafter called ''the applicant a') desirous of hay-ing any dispute between tlìe applicant and any otiler Local Authority (hereinaftercalled ''the respondent'') tried and cleterniined by a Police or Resident Magistrateunder tile provisions of section 11 of tile Act uiay lodge an application in the officeof the Police or Resident Magistrate nearest to the office of tile applicant.

The application silail be in tile form in the Schedule.A copy of tile application shall be served on the respondent within seven days

of tile lodgment of tile application witil tile Magistrate, or such further time as theMagistrate may allow.

On proof by affidavit to tile satisfaction of tile Slagistrate tilat tile npphcn-hon has been duly served, tile Magistrate shall cause written notice to be sent. totile parties of the date and tulle for hearing (If tile applicatioll.

Such date shall not be less than 14 deal' days fronl tile service of tile applicationon the respondent.

On the hearing of the matter tile applicant shall open its case and tile mattershall proceed as nearly as may be according to tile procedure and rules of evidencerelating to tile trial of all action iii a Local Court.

NORTI-IAMPTON Road Board being a local authoritywithin time Inimaning and for the purposes of the NoxiousWeeds Act, 1924, hereby mmmakcs the following by-lawsin exercise of tIme p'm in the behalf conferred bysection 26 of the said Act, such by-laws to be in addi-tion to the by-law already made in exercise of the saidpowers.

(2) Every owner and every occupier of land withinthe district of time Board upon wduchm any noxious weedsire growing os presesit shall take one or more of thefollowing alternative sets of measures amid do tile oneor more following alternative sets of acts to destroysuch noxiot,s weeds, and shall diligently continue totake aud do the seine until all such noxious weeds havebeemi destroyed:

(a) Pull all such noxious weeds from the ground byhand; or

(13) sever mill such noxious weeds below the surfaceof tIme gm'ouimd by means of a suitable grub-himig implement used by hand ; or

(e) cultivate the ground by means of an implementwhich will sever such noxious weeds below' timeground level; or

(ci) plough tIme ground to a depth to be fixed in eachease by time Board or by time local Inspectorappointed by time Board; or

break or cut suclm noxious mveecls at or imme-diately above time surface of the ground bymacens of a suitable roller, snowing machine,or reaping and binding machine; or

(b) The hours of uight watchmen or night stable-men shall be seventy (70) per week of seven (7) days.

3.Overtime.Overtime shall be paid for at the rate of time and

a half, provided that:(a) Sunday time shall be paid for at the rate of

double time, except in the case of sanitaryemployees, caretakers, stablemen, watclnnenand attendants at public latrines. Any sani-tary work done on Saturday night shall bepaid for at the rate of time and a half.

(h) Any worker called upon to work on New Year'sDay, Anniversary Day, Good Friday, EasterMonday, Aazac Day, Labour Day, Union Pic-nic Day, Christmas Day and Boxing Day, shallhe paid at the rate of double time.

(c) Any worker whose duty is ordinarily performedbetween 6 o 'clock n.m. and 6 o'clock p.m. whois called upon to work between 6 p.m. and 6a.ni., or any worker whose duty is ordinarilyperformed between 6 pam. and 6 n.m. who iscalled upon to work between 6 n.m. and 6 l).m.shall receive not loss than two (2) lcomns 'at overtime rates.

4.Holidays.(a) The clays on which Nea' Year's Day, Anniversary

Day, Union Picnic Day, Good Friday, Easter Monday,Anzae Day, Labour Day, Christmas Day and BoxingDay are observed shall be holidays and paid for assuch. Provided that if any of the holidays named inthis snbela.nse fall on a. Sunday, the following Mondayshall be allowed.

(h) in addition to the above, six (6) (lays' aim nnalleave on full pay shall he allowed to all workers underthis Award upon completion of each twelve (12)months' consecutive service, except night watchmnemior night sta.blemnen and attendants at public latrines,who shall he allowed fourteen (14) days' annual leaveon fu]l pay on completion of each twelve (1.2) mouthsservice. Such leave shall be taken at such time as theemmsployer may decide, hut at least fourteen (14) days'notification of such decision shall be given to theworker.

(c) All workers, after one month 's service, shall beentitled t.o time holidays set out in the preceding pain-graph in proportion as the length of service is to thefull number of holidays for the twelve (12) macmaths.

(d) s,lros.kem.s who have been in the employment ofthe employer for twelve (12) months preceding the dateof their annual leave shall be allowed a further leaveof six (6) clays without pay if they so request.

S.Perforinitig Higher Duties.Workers called upon to perform a duty for which a

lngher rate is provided than that which they areordinarily in receipt of, shall be paid for the day, suchhigher sate, if so employed for one hour or more inally one day.

9.Aged and Infi rmn \Voil-crs

Any worker who through old age or infirmity isunable to earn the prescribed miuinlumn wage may beemployed at such lesser rate as may be agreed uponbetween the employer and the President and Secretaryof the U'ision.

10.Travelling Allowance.

Workers required to walk more than a mile and ahalf from the yard or depot shall be provided withtravelling facilities or reimbursed any train or trainCares necessarily incurred.

11.Record Book.

The employer shall keep or cause to be kept a recordbook containing the following particulars:

The name of each worker.The time lie starts and finishes work each day.TIme total nuncter of hours worked.All overtime worked.The wages (amid overtime, if any) paid to each

worker.Such record shall be signed by the worker amid shall

be open for inspection cluring working hours by theSecretary of, or other person appointed by, the work-ers' union.

12.Leave of Absence to Officers.For the purpose of this Award leave of absence from

dnty without prejudice shall be granted to the Presi-dent or Secretary of the Union without pay, providedthat they shall first find satisfactory substitutes if sorequired by the Head of their Department.

13.Payment for Sickness.Any worker not attending for duty will lose his

pay for the actual time lost, unless he produces evi-dence satisfactory to the employer that his non-attendance was due to personal ill-health os accident,necessitating' such absence, when the following pro-visions shall apply:

A worker shall be entitled to payment for non-attendance on tIme ground of personal ill-healthfor one half day for each completed n'onth ofservice, provided that payment for absencethrough such ill-health shall be limited to six(6) days in each calendar year. Paymseent hjtm'e-under may be adjusted at the end of eachcalendar year or at the time the worker leavesthe service of the employer, in the event ofthe worker being entitled by service subsequentto the sickness to a greater allowance than thatmade at the time the sickness occurred. 'Thisclause shall not apply where the worker is en-titled to coisipensation under the Workers' Com-pensation Act.The yeas referred to in the preceding clause be-

ingly.14.Scope of Award.

Thus Award shall apply to workers eligible to belongto the applicant Union directly or indirectly employedby tIme respondents or any of them in time work to whichthe Award relates.

15.Board of Reference.The Court appoints for tIme purpose of the Award, a

6.Conditions.

(i) One shilling (is.) per day extra shall be paidto the following workers:

If any worker is employed for less thansix (6) consecutive working days in any ofthe work covered by the classifications con-tamed in subclauses (a), (b) and (c) ofclause 5 (ii) (Wages) lie shall also bedeemed to he a casual hand.

Workers using slag in building' or repairingroads.

Tar mixers and tar boilers.(li) Wood blocks and cube layers.

Men employed behind the wood block tarringmachine (in addition to tar allowance).

Men required to throw with a shovel, metal orother material more than six (6) feet intoa wagon.

Men engaged in drying or screening metal.(1) Men camped on the job.

(ii) One shilling and sixpenee (is. lid.) per dayextra shall be paid to stone crushers, where to ii pph-ances are provided for preventing dust.

(iii) Two shillings (2s.) per day extra shall be paidto men operating the tar-spraying pressure maclane.

(iv) Three slulhings (3s.) per day extra shall bepaid to men des ning bitumen tank or boiler when soemployed.

(v) Leading hands in charge of not less than throe(3) nor more than ten (10) nien shall be paid fifteenshillings (15s.) per veelc in advance of the workerswhose work they direct. Leading hands iii charge ofmore than ten (10) men shall receive one pound ff1)per week in advance of the men whose work theydirect.

(vi) Relief: Any worker temporarily employed re-lieving another worker shall not. be reduced in wageswhilst so employed.

7.Drivers.Drivers irho, in aclditioii to the hours of which the

working week is composed, arc required to feed horses,shall be paid the following rates in addition to theweekly wage:-

Classifying and fixing wages, rates and conditions for any occupation or calling not sped-iicallv mentioned in the Award;

Deciding any other matter that the Court mayrefer to such Board 'from tune to time.

An appeal shall lie from any decision of such Boardin tlio manner and sui,jcet to the conditions prescribedin the Industrial Arbitration Act, 1912-1935, which fortins purpose are embodied in tins Award.

16.Term of Award.Tins Award shall come into operation as from the

18th (lay of December, 1937, and shall remain in forcefor three (3) years, subject to the right of any partyto the Award to apply to the Court for a review of anyof the provisions of this Award in accordance with theIndustrial Arbitration Act, 1912.1935.

17.Area.This Award shall apply to the area contained witl,in

a radius of twenty-five (25) miles from the General PoetOffice at Perth, and to the Townsitc of Nortliam.

NOTICE is hereby given that all persons having claims against the Estates of the undermentioned deceased persons (ordersto collect and administer whose Estates were granted to me by the said Court under the Curator of Intestate Estates Act,1918) are hereby required to send particulars of such claims to me on or before the 15th day of August, 1938, after whichdate I willproceed to distribute the assets of the said deceased persons among those entitled thereto, having regard only tothose claims of which I shall then have had notice.
